Vienna Convention on Diplomatic Relations - Wikipedia, the free encyclopedia - 0 views

  • The Vienna Convention on Diplomatic Relations of 1961 is an international treaty that defines a framework for diplomatic relations between independent countries. It specifies the privileges of a diplomatic mission that enable diplomats to perform their function without fear of coercion or harassment by the host country. This forms the legal basis for diplomatic immunity.
  • Article 22. The premises of a diplomatic mission, such as an embassy, are inviolate and must not be entered by the host country except by permission of the head of the mission. Furthermore, the host country must protect the mission from intrusion or damage. The host country must never search the premises, nor seize its documents or property. Article 30 extends this provision to the private residence of the diplomats. Article 27. The host country must permit and protect free communication between the diplomats of the mission and their home country. A diplomatic bag must never be opened even on suspicion of abuse. A diplomatic courier must never be arrested or detained.

    Remember the NSA's electronic surveillance of foreign embassies and diplomats around the world and of U.N. missions and diplomats? The Vienna Convention on Diplomatic Relations is the governing international law. I've just completed reading the entire treaty but will highlight portions from its Wikipedia entry instead.  Disputes involving the treaty are decided by the International Court of Justice.  The treaty itself goes into far more detail, but suffice it to say that the NSA's electronic surveillance of diplomats and their staff is beyond doubt in direct conflict with both the letter and the spirit of the treaty. The inviolability privacy of diplomats and staff communications with each other and with their government is an obligation of the host nation. The U.S. committed a serious breach of the treaty by intercepting communications in this circumstance.

Israel Spied on Iran Nuclear Talks With U.S. - WSJ - 0 views

  • Soon after the U.S. and other major powers entered negotiations last year to curtail Iran’s nuclear program, senior White House officials learned Israel was spying on the closed-door talks. The spying operation was part of a broader campaign by Israeli Prime Minister Benjamin Netanyahu’s government to penetrate the negotiations and then help build a case against the emerging terms of the deal, current and former U.S. officials said. In addition to eavesdropping, Israel acquired information from confidential U.S. briefings, informants and diplomatic contacts in Europe, the officials said.
  • The espionage didn’t upset the White House as much as Israel’s sharing of inside information with U.S. lawmakers and others to drain support from a high-stakes deal intended to limit Iran’s nuclear program, current and former officials said. “It is one thing for the U.S. and Israel to spy on each other. Using levers of political influence unique to Israel, Messrs. Netanyahu and Dermer calculated that a lobbying campaign in Congress before an announcement was made would improve the chances of killing or reshaping any deal. They knew the intervention would damage relations with the White House, Israeli officials said, but decided that was an acceptable cost. The campaign may not have worked as well as hoped, Israeli officials now say, because it ended up alienating many congressional Democrats whose support Israel was counting on to block a deal. In November, the Israelis learned the contents of a proposed deal offered by the U.S. but ultimately rejected by Iran, U.S. and Israeli officials said. Israeli officials told their U.S. counterparts the terms offered insufficient protections.

Most Republicans were already prepared to challenge the White House on the negotiations, so Mr. Dermer focused on Democrats. “This deal is bad,” he said in one briefing, according to participants.

The Israeli officials told lawmakers that Iran would also be permitted to deploy advanced IR-4 centrifuges that could process fuel on a larger scale, meeting participants and administration officials said. Israeli officials said such fuel, which under the emerging deal would be intended for energy plants, could be used to one day build nuclear bombs. The information in the briefings, Israeli officials said, was widely known among the countries participating in the negotiations. When asked in February during one briefing where Israel got its inside information, the Israeli officials said their sources included the French and British governments, as well as their own intelligence, according to people there.

Unexpected reaction The congressional briefings and Mr. Netanyahu’s decision to address a joint meeting of Congress on the emerging deal sparked a backlash among many Democratic lawmakers, congressional aides said.

Ms. Feinstein said afterward she would oppose legislation allowing Congress to vote down an agreement.

Saudi Arabia's intelligence chief is vowing that the kingdom will make a "major shift" in relations with the United States to protest perceived American inaction over Syria's civil war as well as recent U.S. overtures to Iran, a source close to Saudi policy said on Tuesday.Prince Bandar bin Sultan told European diplomats that the United States had failed to act effectively against Syrian President Bashar al-Assad and the Israeli-Palestinian conflict, was growing closer to Tehran, and had failed to back Saudi support for Bahrain when it crushed an anti-government revolt in 2011, the source said."The shift away from the U.S. is a major one," the source close to Saudi policy said. "Saudi doesn't want to find itself any longer in a situation where it is dependent."It was not immediately clear whether the reported statements by Prince Bandar, who was the Saudi ambassador to Washington for 22 years, had the full backing of King Abdullah.

    This lengthy article from Reuters deserves attention. The peace initiatives by Russia/Syria and by Iran are forcing realignment of foreign policies throughout the Mideast. The U.S. is no longer perceived as being on the side of only Sunni Muslim states. One of the most visible changes (after cancellation of the U.S. military strike on Syria) is a go-it-alone declaration by the House of Saud that parallels the stance taken by Israel's ruling right-wing coalition. Both Israel and the Saudis had very successfully isolated the U.S. from the non-Sunni Arab nations, fueling and deepening a religious divide within the Arab nations. It remains to be seen whether the declarations by the House of Saud and Bibi Netanyahu will translate into effective military action against Iran and Syria, although Saudi money and weapons will continue to flow into Syria for the foreseeable future. Both nations will continue attempts to undo the looming Iran-U.S. thaw in relations. Predictably, the Zionist/Neocon hawks in Congress are pushing legislation to put a big freeze back on the Iran-U.S. thaw in relations, including a bill to stiffen economic sanctions on Iran and authorize military strikes against Syria. But that legislation seems to be going nowhere; the mood of the U.S. population (and thus of those up for election next year) has shifted to profoundly anti-war, at least as applied to Syria and Iran. It would be ironic if Russia/Syria and Iran's peace initiatives actually resulted in a lasting U.S. shift away from the Zionist/Neocon strategy to destabilize all of Israel's neighboring states except Egypt, Lebanon, and Jordan (those three have already been destabilized and swept into Israel's influence). If so, Obama might yet leave a positive legacy.

Review & Outlook: Loose Lips on Syria - WSJ.com - 0 views

  • An American military attack on Syria could begin as early as Thursday and will involve three days of missile strikes, according to "senior U.S. officials" talking to NBC News. The Washington Post has the bombing at "no more than two days," though long-range bombers could "possibly" join the missiles. "Factors weighing into the timing of any action include a desire to get it done before the president leaves for Russia next week," reports CNN, citing a "senior administration official." The New York Times, quoting a Pentagon official, adds that "the initial target list has fewer than 50 sites, including air bases where Syria's Russian-made attack helicopters are deployed." The Times adds that "like several other military officials contacted for this report, the official agreed to discuss planning options only on condition of anonymity." Thus do the legal and moral requirements of secret military operations lose out in this Administration to the imperatives of in-the-know spin and political gestures.
  • It's always possible that all of this leaking about when, how and for how long the U.S. will attack Syria is an elaborate head-fake, like Patton's ghost army on the eve of D-Day, poised for the assault on Calais. But based on this Administration's past behavior, such as the leaked bin Laden raid details, chances are most of this really is the war plan. Which makes us wonder why the Administration even bothers to pursue the likes of Edward Snowden when it is giving away its plan of attack to anyone in Damascus with an Internet connection. The answer, it seems, is that the attack in Syria isn't really about damaging the Bashar Assad regime's capacity to murder its own people, much less about ending the Assad regime for good. "I want to make clear that the options that we are considering are not about regime change," White House spokesman Jay Carney said Tuesday. Translation: We're not coming for you, Bashar, so don't worry. And by the way, you might want to fly those attack choppers off base, at least until next week.
  • So what is the purpose of a U.S. attack? Mr. Carney elaborated that it's "about responding to [a] clear violation of an international standard that prohibits the use of chemical weapons." He added that the U.S. had a national security interest that Assad's use of chemical weapons "not go unanswered." This is another way of saying that the attacks are primarily about making a political statement, and vindicating President Obama's ill-considered promise of "consequences," rather than materially degrading Assad's ability to continue to wage war against his own people. It should go without saying that the principal purpose of a military strike is to have a military effect. Political statements can always be delivered politically, and U.S. airmen should not be put in harm's way to deliver what amounts to an extremely loud diplomatic demarche. That's especially so with a "do something" strike that is, in fact, deliberately calibrated to do very little. We wrote Tuesday that there is likely to be no good outcome in Syria until Assad and his regime are gone. Military strikes that advance that goal—either by targeting Assad directly or crippling his army's ability to fight—deserve the support of the American people and our international partners. That's not what this Administration seems to have in mind.

    This typically pompous Wall Street Journal editorial gets part of it right but ignores several elephants in the room. -- No way this goes down without Russia having agreed to it. Russia's only foreign military base is a naval port in Syria. Russia has deployed anti-aircraft missile batteries in Syria. Russia has supplied the Syrian government with state-of-the-art antiaircraft shoulder-held missiles. Several months ago, the Russians moved a fleet of warships into the Mediterranean for the first time, to protect Syria from foreign attack, including at least one submarine equipped with anti-ship missiles.  The U.S. and Russia have been engaged in building up their forces positioned around for over a year, in an escalating fashion. Russia has a huge economic incentive to keep Assad in power because he is blocking the natural gas pipeline that western interests want to run through Syria Russia has also built up its forces within Syria, a pipeline that would break Russia's near-monopoly on supplying natural gas to the European Union. A direct military intervention in Syria doesn't go down without Russia's approval, notwithstanding what their later statements might be. Obama is an accomplished liar but he's politically timid. Touching off World War III is not on his agenda. 2. Iran also has to acquiesce in advance. Syria and Iran have a mutual defense treaty, the first announced in 2005, a later treaty announced in 2008. http://tinyurl.com/oez2dq7 (.) Thousands of crack Iranian Revolutionary Guards troops are already stationed in Syria. As the only other Shia-majority state in the region, Syria is critical to Iran's own defense. Iran has the ability to close the Straits of Hormuz, thereby toppling the western world economy as petroleum supplies suddenly dry up. The U.S. Navy lacks the ability to quickly clear the Straits of mines, as was proved in embarrassingly bad tests the U.S. Navy did last year. Venezuela to Reevaluate U.S. Relations Due to "Interventionism" | nsnbc international - 0 views

  • Venezuelan president Nicolas Maduro has warned of “interventionist” activity emanating from the U.S. Embassy in Caracas, and says he is reevaluating relations with his country’s northern neighbour. In an interview with Telesur on Saturday Maduro claimed that actions being taken by the U.S. embassy were aimed at undermining Venezuela’s stability and were “beginning to become intolerable” despite Venezuelan efforts to “normalise diplomatic relations”.
  • “It’s lamentable that [U.S. president Barack] Obama allows his own U.S. embassy in Venezuela to act in a dangerous way…I have a lot of information about the interventionism of the U.S. embassy,” he said. The Venezuelan head of state explained that as a result his administration was “reevaluating” relations with the U.S. “At the right moment I will pertinently explain to our nation the actions that I have to take,” he added. Maduro also gave his opinion that racism had worsened in the U.S. under Obama. He said that the U.S. president had become “tired” of struggling for a progressive agenda and had “joined the worst causes, in the United States and the world”. The comments are the latest indicator of the poor state of U.S. – Venezuelan relations, which have remained frosty since the early years of the administration of former Venezuelan president Hugo Chavez.
  • Venezuela accuses the U.S. of having supported the short-lived coup against Chavez in 2002 and of plotting to destabilise and overthrow the Bolivarian government. U.S. government agencies have funneled over $100 million to pro-opposition groups since 2002. The U.S. meanwhile has expressed worry over some of Venezuela’s international alliances and has claimed the Bolivarian government displays authoritarian practices and tendencies domestically. In July the United States introduced a visa and travel ban against a handful of top Venezuelan officials for what it says were “human rights abuses” committed during an opposition-led wave of unrest in the country earlier this year which caused 43 deaths. Venezuelan officials counter that the opposition was responsible for the violence, and that any member of security forces suspected of using excessive force has been arrested or investigated.

  • In November an Obama administration spokesperson revealed the president’s willingness to support further sanctions against Venezuela which would freeze the financial assets of 27 Venezuelan government officials and increase funding for opposition groups. The proposed legislation is sponsored by Florida Republican Senator Marco Rubio Last month the U.S. Department of Commerce, Bureau of Industry and Security (BIS) amended the Export Administration Regulations to restrict exports to Venezuela of items intended for “a military end use or end user.” The term “military end user” is broad and refers to non military bodies such as the coast guard, police and government intelligence.

    Non-intervention in foreign government's internal affairs is one of the major cornerstones of international law that flows directly from the human right of self-determination in government via democratic principles. The U.S. intervention in Venezuela, as In Syria, Ukraine, and elsewhere, is thus profoundly anti-democratic. Several governments around the world are well along the path of shutting down U.S. (e.g., USAID, National Endowment for Democracy, Soros Open Society Foundation, Einstein Institute, etc/)  funding for rabble-rousers. Venezuela is among them, but now appears moving toward ejecting "diplomatic" officials who participate, if not the entire U.S. Embassy.

  • Amidst another week of deadly Israeli-Palestinian violence, fifteen faith leaders representing U.S. churches and faith organizations have called on Congress to condition U.S. military aid to Israel upon Israel’s “compliance with applicable U.S. laws and policies.” These leaders--representing Baptist, Lutheran, Catholic, Presbyterian, Methodist, Orthodox, Quaker and other major Christian groups--agree that unconditional U.S. military assistance to Israel has contributed to “sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians.”  [SEE LETTER BELOW]   As a Quaker peace lobby that has advocated for Israeli-Palestinian peace for decades in Washington, the Friends Committee on National Legislation (FCNL) is proud to be a partner in this effort.   These organizations draw upon their decades of experience in the region, during which they have collectively witnessed the horror of suicide bombing, rocket attacks, shootings of civilians, home demolitions, forced displacement, and other widespread human rights violations. These faith groups “recognize that each party — Israeli and Palestinian — bears responsibilities for its actions and we therefore continue to stand against all violence regardless of its source.”      Unconditional U.S. military aid has become one of those sources fueling violence and further entrenchment of Israel’s military occupation of the Palestinian territories. This statement highlights the United States’ responsibility to hold Israel accountable for “a troubling and consistent pattern of disregard by the government of Israel for U.S. policies that support a just and lasting peace.”
  • Congress must investigate possible violations of U.S. law The latest State Department human rights report on Israel and the Occupied Territories provides a devastating account of Israel’s human rights violations against civilians, many of which involve the misuse of U.S.-supplied weapons. This diverse religious coalition has called for “an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act,” and urges Congress to “ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace”.     The signers affirm that these are laws that “should be enforced in all instances regardless of location,” but that it is especially critical for Israel to comply with laws that regulate the use of U.S. supplied weapons, since Israel is the single largest recipient of U.S. foreign aid since World War II. Notably, the United States has initiated investigations of violations of these laws by other countries, and on four different occasions between 1978 and 1982, the Secretary of State notified Congress that Israel “may” have violated the provisions of the Arms Export Control Act.   The coalition has called for renewed investigations into human rights violations documented by the State Department’s report, including Israel’s escalation of home demolitions, forced displacement, suppression of dissent, and its use of prohibited weapons in densely populated areas during Israel’s military Operation Cast Lead in the Gaza Strip.  
  • Echoing urgent warnings from Israeli leader The letter also echoes the urgency for immediate action to secure a diplomatic settlement to the crisis that has been acknowledged by scores of Israeli and Palestinian leaders, including Ehud Barak, Israel’s current Defense Minister and former Prime Minister. In a historic speech delivered at the prestigious Herzliya National Security Conference in Israel in early 2010, Mr. Barak warned of Israel’s future in the absence of a political settlement, saying in stark terms:   “The reality is cruel but simple. Between the Jordan River...and the Mediterranean, 12 million people live, 7.5 million Israelis and 4.5 million Palestinians. And the simple truth is that as long as in this territory to the West of the Jordan River, there is one political entity which is called Israel[...]and if this bloc of Palestinians would not be able to vote, it’s going to be an apartheid state.”     Israeli, Palestinian, and U.S. interests require urgent efforts to avoid the nightmare that Israeli leader Ehud Barak has described as an apartheid state. A just and peaceful future for Israelis and Palestinians requires that all parties to a conflict are held accountable and that a comprehensive, inclusive diplomatic settlement be secured. An essential step for Congress to support Israeli-Palestinian peace efforts is to heed these warnings, and hold Israel accountable for how it uses U.S. military aid.   • Unfortunately, unconditional U.S. military assistance to Israel has contributed to this deterioration, sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians. This is made clear in the most recent 2011 State Department Country Report on Human Rights Practices covering Israel and the Occupied Territories (1), which details widespread Israeli human rights violations committed against Palestinian civilians, many of which involve the misuse of U.S.-supplied weapons. Accordingly, we urge an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act which respectively prohibit assistance to any country which engages in a consistent pattern of human rights violations and limit the use of U.S. weapons (2) to “internal security” or “legitimate self-defense.” (3) More broadly, we urge Congress to undertake careful scrutiny to ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace. We urge Congress to hold hearings to examine Israel’s compliance, and we request regular reporting on compliance and the withholding of military aid for non-compliance.

The Real Blame for Deaths in Libya    :   Information Clearing House: ICH - 0 views

  • However, in this political season, the Republicans want to gain some political advantage by stirring up doubts about President Barack Obama’s toughness on terrorism — and the Obama administration is looking for ways to blunt those rhetorical attacks by launching retaliatory strikes in Libya or elsewhere. Thus, it was small comfort to learn that Teflon-coated John Brennan, Obama’s counterterrorism adviser, had flown to Tripoli, hoping to unearth some interim Libyan government officials to consult with on the Benghazi attack. With the embassy’s help, he no doubt identified Libyan officials with some claim to purview over “terrorism.”
  • But Brennan is not about investigation. Retribution is his bag. It is likely that some Libyan interlocutor was brought forth who would give him carte blanche to retaliate against any and all those “suspected” of having had some role in the Benghazi murders. So, look for “surgical” drone strike or Abbottabad-style special forces attack — possibly before the Nov. 6 election — on whomever is labeled a “suspect.” Sound wild? It is. However, considering Brennan’s penchant for acting-first-thinking-later, plus the entrée and extraordinary influence he enjoys with President Obama, drone and/or special forces attacks are, in my opinion, more likely than not. (This is the same Brennan, after all, who compiles for Obama lists of nominees for assassination by drone.) If in Tuesday’s debate with ex-Massachusetts Gov. Mitt Romney, Obama is pressed, as expected on his supposed weakness in handling Benghazi, attacks on “terrorists,” real or “suspect,” become still more likely. Brennan and other White House functionaries might succeed in persuading the president that such attacks would be just what the doctor ordered for his wheezing poll numbers.
  • It was no surprise, then, that almost completely absent from the discussion at last Tuesday’s hearing was any attempt to figure out why a well-armed, well-organized group of terrorists wanted to inflict maximum damage on the U.S. consulate in Benghazi and kill the diplomats there. Were it not for Rep. Dennis Kucinich, D-Ohio, impressionable listeners would have been left with the idea that the attack had nothing to do with Washington’s hare-brained, bomb-heavy policies, from which al-Qaeda and similar terrorist groups are more beneficiary than victim, as in Libya. Not for the first time, Kucinich rose to the occasion at Tuesday’s hearing:

The security situation did not happen overnight because of a decision made by someone at the State Department. … “We owe it to the diplomatic corps, who serves our nation, to start at the beginning and that’s what I shall do. Security threats in Libya, including the unchecked extremist groups who are armed to the teeth, exist because our nation spurred on a civil war destroying the security and stability of Libya. … We bombed Libya. We destroyed their army. We obliterated their police stations … Al Qaeda expanded its presence. “Weapons are everywhere. Thousands of shoulder-to-air missiles are on the loose. It’s not surprising and it’s also not acceptable. … “We want to stop attacks on our embassies? Let’s stop trying to overthrow governments. This should not be a partisan issue. Let’s avoid the hype. Let’s look at the real situation here. Interventions do not make us safer. They do not protect our nation. They are themselves a threat to America.”
  • Congressman Kucinich went on to ask the witnesses if they knew how many shoulder-to-air missiles were on the loose in Libya. Nordstrom: “Ten to twenty thousand.”
  • We are told we should not speak ill of the dead. Dead consciences, though, should be fair game. In my view, the U.S. Secretary of State did herself no credit the morning after the killing of four of her employees, when she said: “I asked myself — how could this happen? How could this happen in a country we helped liberate, in a city we helped save from destruction? This question reflects just how complicated and, at times, how confounding the world can be. But we have to be clear-eyed, even in our grief.” But some things are confounding only to those suppressing their own responsibility for untold death and misery abroad. Secretary Clinton continues to preen about the U.S. role in the attack on Libya. And, of Gadhafi’s gory death, she exclaimed on camera with a joyous cackle, “We came; we saw; he died.” Can it come as a surprise to Clinton that this kind of attitude and behavior can set a tone, spawning still more violence?
  • In my view, counterterrorism guru Brennan shares the blame for this and other failures. But he has a strong allergy to acknowledging such responsibility. And he enjoys more Teflon protection from his perch closer to the president in the White House. The back-and-forth bickering over the tragedy in Benghazi has focused on so many trees that the forest never came into view. Not only did the hearing fall far short in establishing genuine accountability, it was bereft of vision. Without vision, the old proverb says, the people perish — and that includes American diplomats. The killings in Benghazi on Sept. 11, 2012, validate that wisdom. If the U.S. does not change the way it relates to the rest of the world, and especially to the Muslim world, more and more people will perish. If we persist on the aggressive path we are on, Americans will in no way be safer. As for our diplomats, in my view it is just a matter of time before our next embassy, consulate or residence is attacked.
  • At Tuesday’s hearing, Kucinich noted that in Libya “we intervened, absent constitutional authority.” Most of his colleagues reacted with the equivalent of a deep yawn, as though Kucinich had said something “quaint” and “obsolete.” Like most of their colleagues in the House, most Oversight Committee members continue to duck this key issue, which directly involves one of the most important powers/duties given the Congress in Article I of the Constitution. Such was their behavior last Tuesday, with most members preferring to indulge in hypocritical posturing aimed at scoring cheap political points. Palpable in that hearing room was one of the dangers our country’s Founders feared the most — that, for reasons of power, position and money, legislators might eventually be seduced into the kind of cowardice and expediency that would lead them to forfeit their power and their duty to prevent a president from making war at will. Many of those now doing their best to make political hay out of the Benghazi “scandal” are the same legislators who appealed strongly for the U.S. to bomb Libya and remove Gadhafi. This, despite it having been clear from the start that eastern Libya had become a new beachhead for al-Qaeda and other terrorists. From the start, it was highly uncertain who would fill the power vacuums in the east and in Tripoli.
  • As Congress failed to exercise its constitutional duties — to debate and vote on wars — Obama, along with his Defense Secretary Leon Panetta and Hillary Clinton, took a page out of the Bush/Cheney book and jumped into a new war. Just don’t call it war, said the White House. It’s merely a “kinetic humanitarian action.” You see, our friends in Europe covet that pure Libyan oil and Gadhafi had been a problem to the West for a long time. So, it was assumed that there would be enough anti-Gadhafi Libyans that a new “democratic” government could be created and talented diplomats, like Ambassador Christopher Stevens, could explain to “the locals” how missiles and bombs were in the long-term interest of Libyans.
  • On Libya, the Obama administration dissed Congress even more blatantly than Cheney and Bush did on Iraq, where there was at least the charade of a public debate, albeit perverted by false claims about Iraq’s WMDs and Saddam Hussein’s ties to al-Qaeda. And so Defense Secretary Panetta and Secretary of State Clinton stepped off cheerily to strike Libya with the same kind of post-war plan that Cheney, Bush, and then-Defense Secretary Donald Rumsfeld had for Iraq — none. Small wonder chaos reigns in Benghazi and other parts of the country. Can it be that privileged politicians like Clinton and Panetta and the many “one-percenters” in Congress and elsewhere really do not understand that, when the U.S. does what it did to Libya, there will be folks who don’t like it; that they will be armed; that there will be blowback; that U.S. diplomats, given an impossible task, will die?
  • Constitutionally, the craven Congress is a huge part of the problem. Only a few members of the House and Senate seem to care very much when presidents act like kings and send off troops drawn largely by a poverty draft to wars not authorized (or simply rubber-stamped) by Congress. Last Tuesday, Kucinich’s voice was alone crying in the wilderness, so to speak. (And, because of redistricting and his loss in a primary that pitted two incumbent Democrats against each other, he will not be a member of the new Congress in January.) This matters — and matters very much. At a hearing of the Senate Armed Services Committee on March 7, Sen. Jeff Sessions, R-Alabama, pursued this key issue with Panetta and Joint Chiefs Chairman Gen. Martin Dempsey. Chafing ex post facto at the unauthorized nature of the war in Libya, Sessions asked repeatedly what “legal basis” would the Obama administration rely on to do in Syria what it did in Libya. Watching that part of the testimony it seemed to me that Sessions, a conservative Southern lawyer, was not at all faking when he pronounced himself “almost breathless,” as Panetta stonewalled time after time. Panetta made it explicitly clear that the administration does not believe it needs to seek congressional approval for wars like Libya. At times he seemed to be quoting verses from the Book of Cheney.
  • Sessions: “I am really baffled … The only legal authority that’s required to deploy the U.S. military [in combat] is the Congress and the president and the law and the Constitution.” Panetta: “Let me just for the record be clear again, Senator, so there is no misunderstanding.   • A senior U.S. diplomat touched down in Caracas on Wednesday where he met with Venezuelan President, Nicolas Maduro, ahead of the Organization of American State’s (OAS) 7th Summit of the Americas this Friday in Panama.  State Department Counsellor, Thomas A. Shannon, flew to Venezuela on Tuesday on behalf of Secretary of State, John Kerry, at the invitation of Caracas. Venezuelan Foreign Minister, Delcy Rodriguez, was also present.
  • Venezuelan President, Nicolas Maduro, stated that he hoped the meeting would lead to a new era of relations with the U.S. “I told him, with all due respect, I hope that what I am going to say here in this meeting, with the best Bolivarian commitment, is going to be received where it needs to be received and that the doors are opened to a new stage in our relationship, based on respect, respect for the dignity and sovereignty of Venezuela,” stated Maduro on Thursday.
  • The reaction has witnessed Washington tone down its rhetoric in relation to Venezuela and on Tuesday this week, Benjamin J. Rhodes, deputy national security adviser for strategic communications, stated that “The United States does not believe that Venezuela poses some threat to our national security,” in what seemed to be a contradiction of the language used in March’s Executive Order. Nevertheless, the issue is expected to be a significant point of contention throughout the upcoming summit, which will be attended by both President Nicolas Maduro and Barack Obama.

  • Following his meeting with government representatives on Wednesday, Shannon convened with members of the Venezuelan opposition coalition the “Roundtable of Democratic Unity” (MUD) at the U.S. embassy headquarters before flying back to Washington on Thursday. The MUD has confirmed that the purpose of the meeting was to talk to Shannon about “the release of political prisoners,” Venezuela’s human rights situation and the country’s upcoming legislative elections. “Following the summit (of the Americas), there will be a more active U.S. presence along with UNASUR foreign ministers and other actors, with a view to bringing about an electoral and peaceful way out of the Venezuelan crisis,” stated MUD secretary, Jesus Torrealba, who added that Shannon had confirmed that Washington would be “more emphatic” about addressing alleged “human rights abuses” in Venezuela following this week’s summit. According to the secretary, Washington is currently concerned that “a critical situation in Venezuela would not just affect Venezuelans, but that it would have an impact on the whole region”. The MUD also handed over an “updated human rights report” to Shannon before the closed meeting came to an end by 11am.
  • Despite his warm welcome from the Venezuelan opposition, U.S. diplomat Shannon was greeted with a cool reception by the country’s alternative media, which were reticent about the envoy’s speckled diplomatic history. Over the past few days, various articles have been circulating on the internet noting the diplomat’s links to Latin American and Caribbean countries which have experienced U.S. backed coups during the last fifteen years. According to reports and Wikileak cables, Shannon was present in Honduras in the months following the coup which ousted Manuel Zelaya in 2009, and played an extensive role in US- Haiti relations following the second ousting of elected leftist president, Jean Bertrand Aristide in 2004. The diplomat worked at the U.S. embassy in Caracas for three years between 1996-1999.

How 'Free Markets' Defame 'Democracy' | Consortiumnews - 0 views

  • Venezuela seems to be following Ukraine on the neocon hit list for “regime change” as Washington punishes Caracas for acting against a perceived coup threat. But a broader problem is how the U.S. conflates “free markets” with “democracy,” giving “democracy” a bad name, writes Robert Parry.
  • The one common thread in modern U.S. foreign policy is an insistence on “free market” solutions to the world’s problems. That is, unless you’re lucky enough to live in a First World ally of the United States or your country is too big to bully.So, if you’re in France or Canada or – for that matter – China, you can have generous health and educational services and build a modern infrastructure. But if you’re a Third World country or otherwise vulnerable – like, say, Ukraine or Venezuela – Official Washington insists that you shred your social safety net and give free reign to private investors.
  • If you’re good and accept this “free market” domination, you become, by the U.S. definition, a “democracy” – even if doing so goes against the wishes of most of your citizens. In other words, it doesn’t matter what most voters want; they must accept the “magic of the market” to be deemed a “democracy.”Thus, in today’s U.S. parlance, “democracy” has come to mean almost the opposite of what it classically meant. Rather than rule by a majority of the people, you have rule by “the market,” which usually translates into rule by local oligarchs, rich foreigners and global banks.Governments that don’t follow these rules – by instead shaping their societies to address the needs of average citizens – are deemed “not free,” thus making them targets of U.S.-funded “non-governmental organizations,” which train activists, pay journalists and coordinate business groups to organize an opposition to get rid of these “un-democratic” governments.

  • If a leader seeks to defend his or her nation’s sovereignty by such means as requiring these NGOs to register as “foreign agents,” the offending government is accused of violating “human rights” and becomes a candidate for more aggressive “regime change.”Currently, one of the big U.S. complaints against Russia is that it requires foreign-funded NGOs that seek to influence policy decisions to register as “foreign agents.” The New York Times and other Western publications have cited this 2012 law as proof that Russia has become a dictatorship, while ignoring the fact that the Russians modeled their legislation after a U.S. law known as the “Foreign Agent Registration Act.”So, it’s okay for the U.S. to label people who are paid by foreign entities to influence U.S. policies as “foreign agents” – and to imprison people who fail to register – but not for Russia to do the same. A number of these NGOs in Russia and elsewhere also are not “independent” entities but instead are financed by the U.S.-funded National Endowment for Democracy (NED) and the U.S. Agency for International Development.

Leading the denunciation of Russia and other governments that restrain these U.S.-financed NGOs is Freedom House, which marks down countries on its “freedom index” when they balk at letting in this back-door U.S. influence. However, over the past three decades, Freedom House has become essentially a subsidiary of NED, a bought-and-paid-for NGO itself.
  • That takeover began in earnest in 1983 when CIA Director William Casey was focused on creating a funding mechanism to support Freedom House and other outside groups that would engage in propaganda and political action that the CIA had historically organized and financed covertly. Casey helped shape the plan for a congressionally funded entity that would serve as a conduit for this U.S. government money.But Casey recognized the need to hide the CIA’s strings. “Obviously we here [at CIA] should not get out front in the development of such an organization, nor should we appear to be a sponsor or advocate,” Casey said in one undated letter to then-White House counselor Edwin Meese III – as Casey urged creation of a “National Endowment.” [See Consortiumnews.com’s “CIA’s Hidden Hand in ‘Democracy’ Groups.”]Casey’s planning led to the 1983 creation of NED, which was put under the control of neoconservative Carl Gershman, who remains in charge to this day. Gershman’s NED now distributes more than $100 million a year, which included financing scores of activists, journalists and other groups inside Ukraine before last year’s coup and now pays for dozens of projects in Venezuela, the new emerging target for “regime change.”
  • But NED’s cash is only a part of how the U.S. government manipulates events in vulnerable countries. In Ukraine, prior to the February 2014 coup, neocon Assistant Secretary of State Victoria Nuland reminded Ukrainian business leaders that the United States had invested $5 billion in their “European aspirations.”Nuland then handpicked who would be the new leadership, telling U.S. Ambassador Geoffrey Pyatt that “Yats is the guy,” referring to “free market” politician Arseniy Yatsenyuk, who not surprisingly emerged as the new prime minister after a violent coup ousted elected President Viktor Yanukovych on Feb. 22, 2014.The coup also started a civil war that has claimed more than 6,000 lives, mostly ethnic Russians in eastern Ukraine who had supported Yanukovych and were targeted for a ruthless “anti-terrorist operation” spearheaded by neo-Nazi and other far-right militias dispatched by the U.S.-backed regime in Kiev. But Nuland blames everything on Russia’s President Vladimir Putin.   • Before the Senate Foreign Relations Committee on Tuesday, Nuland hailed “reforms” to turn Ukraine into a “free-market state,” including decisions “to reduce and cap pension benefits, increase work requirements and phase in a higher retirement age; … [and] cutting wasteful gas subsidies.”In other words, these “reforms” are designed to make the hard lives of average Ukrainians even harder – by slashing pensions, removing work protections, forcing people to work into their old age and making them pay more for heat during the winter.‘Sharing’ the Wealth In exchange for those “reforms,” the IMF approved $17.5 billion in aid that will be handled by Ukraine’s Finance Minister Natalie Jaresko, who until last December was a former U.S. diplomat responsible for a U.S. taxpayer-financed $150 million investment fund for Ukraine that was drained of money as she engaged in lucrative insider deals – deals that she has fought to keep secret. For instance, Vice President Joe Biden’s son Hunter was named to the board of directors of Burisma Holdings, Ukraine’s largest private gas firm, a shadowy Cyprus-based company linked to Privat Bank.Privat Bank is controlled by the thuggish billionaire oligarch Ihor Kolomoysky, who was appointed by the Kiev regime to be governor of Dnipropetrovsk Oblast, a south-central province of Ukraine. In this tribute to “democracy,” the U.S.-backed Ukrainian authorities gave an oligarch his own province to rule. Exclusive: Inside America's Plan to Kill Online Privacy Rights Everywhere | The Cable - 0 views

  • The United States and its key intelligence allies are quietly working behind the scenes to kneecap a mounting movement in the United Nations to promote a universal human right to online privacy, according to diplomatic sources and an internal American government document obtained by The Cable. The diplomatic battle is playing out in an obscure U.N. General Assembly committee that is considering a proposal by Brazil and Germany to place constraints on unchecked internet surveillance by the National Security Agency and other foreign intelligence services. American representatives have made it clear that they won't tolerate such checks on their global surveillance network. The stakes are high, particularly in Washington -- which is seeking to contain an international backlash against NSA spying -- and in Brasilia, where Brazilian President Dilma Roussef is personally involved in monitoring the U.N. negotiations.
  • The Brazilian and German initiative seeks to apply the right to privacy, which is enshrined in the International Covenant on Civil and Political Rights (ICCPR), to online communications. Their proposal, first revealed by The Cable, affirms a "right to privacy that is not to be subjected to arbitrary or unlawful interference with their privacy, family, home, or correspondence." It notes that while public safety may "justify the gathering and protection of certain sensitive information," nations "must ensure full compliance" with international human rights laws. A final version the text is scheduled to be presented to U.N. members on Wednesday evening and the resolution is expected to be adopted next week. A draft of the resolution, which was obtained by The Cable, calls on states to "to respect and protect the right to privacy," asserting that the "same rights that people have offline must also be protected online, including the right to privacy." It also requests the U.N. high commissioner for human rights, Navi Pillay, present the U.N. General Assembly next year with a report on the protection and promotion of the right to privacy, a provision that will ensure the issue remains on the front burner.
  • Publicly, U.S. representatives say they're open to an affirmation of privacy rights. "The United States takes very seriously our international legal obligations, including those under the International Covenant on Civil and Political Rights," Kurtis Cooper, a spokesman for the U.S. mission to the United Nations, said in an email. "We have been actively and constructively negotiating to ensure that the resolution promotes human rights and is consistent with those obligations." But privately, American diplomats are pushing hard to kill a provision of the Brazilian and German draft which states that "extraterritorial surveillance" and mass interception of communications, personal information, and metadata may constitute a violation of human rights. The United States and its allies, according to diplomats, outside observers, and documents, contend that the Covenant on Civil and Political Rights does not apply to foreign espionage.

  • n recent days, the United States circulated to its allies a confidential paper highlighting American objectives in the negotiations, "Right to Privacy in the Digital Age -- U.S. Redlines." It calls for changing the Brazilian and German text so "that references to privacy rights are referring explicitly to States' obligations under ICCPR and remove suggestion that such obligations apply extraterritorially." In other words: America wants to make sure it preserves the right to spy overseas. The U.S. paper also calls on governments to promote amendments that would weaken Brazil's and Germany's contention that some "highly intrusive" acts of online espionage may constitute a violation of freedom of expression. Instead, the United States wants to limit the focus to illegal surveillance -- which the American government claims it never, ever does. Collecting information on tens of millions of people around the world is perfectly acceptable, the Obama administration has repeatedly said. It's authorized by U.S. statute, overseen by Congress, and approved by American courts.
  • "Recall that the USG's [U.S. government's] collection activities that have been disclosed are lawful collections done in a manner protective of privacy rights," the paper states. "So a paragraph expressing concern about illegal surveillance is one with which we would agree." The privacy resolution, like most General Assembly decisions, is neither legally binding nor enforceable by any international court. But international lawyers say it is important because it creates the basis for an international consensus -- referred to as "soft law" -- that over time will make it harder and harder for the United States to argue that its mass collection of foreigners' data is lawful and in conformity with human rights norms. "They want to be able to say ‘we haven't broken the law, we're not breaking the law, and we won't break the law,'" said Dinah PoKempner, the general counsel for Human Rights Watch, who has been tracking the negotiations. The United States, she added, wants to be able to maintain that "we have the freedom to scoop up anything we want through the massive surveillance of foreigners because we have no legal obligations."
  • The United States negotiators have been pressing their case behind the scenes, raising concerns that the assertion of extraterritorial human rights could constrain America's effort to go after international terrorists. But Washington has remained relatively muted about their concerns in the U.N. negotiating sessions. According to one diplomat, "the United States has been very much in the backseat," leaving it to its allies, Australia, Britain, and Canada, to take the lead. There is no extraterritorial obligation on states "to comply with human rights," explained one diplomat who supports the U.S. position. "The obligation is on states to uphold the human rights of citizens within their territory and areas of their jurisdictions."
  • The position, according to Jamil Dakwar, the director of the American Civil Liberties Union's Human Rights Program, has little international backing. The International Court of Justice, the U.N. Human Rights Committee, and the European Court have all asserted that states do have an obligation to comply with human rights laws beyond their own borders, he noted. "Governments do have obligation beyond their territories," said Dakwar, particularly in situations, like the Guantanamo Bay detention center, where the United States exercises "effective control" over the lives of the detainees. Both PoKempner and Dakwar suggested that courts may also judge that the U.S. dominance of the Internet places special legal obligations on it to ensure the protection of users' human rights.
  • "It's clear that when the United States is conducting surveillance, these decisions and operations start in the United States, the servers are at NSA headquarters, and the capabilities are mainly in the United States," he said. "To argue that they have no human rights obligations overseas is dangerous because it sends a message that there is void in terms of human rights protection outside countries territory. It's going back to the idea that you can create a legal black hole where there is no applicable law." There were signs emerging on Wednesday that America may have been making ground in pressing the Brazilians and Germans to back on one of its toughest provisions. In an effort to address the concerns of the U.S. and its allies, Brazil and Germany agreed to soften the language suggesting that mass surveillance may constitute a violation of human rights. Instead, it simply deep "concern at the negative impact" that extraterritorial surveillance "may have on the exercise of and enjoyment of human rights." The U.S., however, has not yet indicated it would support the revised proposal.
  • The concession "is regrettable. But it’s not the end of the battle by any means," said Human Rights Watch’s PoKempner. She added that there will soon be another opportunity to corral America's spies: a U.N. discussion on possible human rights violations as a result of extraterritorial surveillance will soon be taken up by the U.N. High commissioner.

Obama Gave Up on Ukraine, Press Simply Ignored It Washington's Blog - 0 views

  • On Tuesday, May 12th, U.S. Secretary of State John Kerry was asked at a press conference in Sochi Russia, to respond to Ukrainian President Petro Poroshenko’s recent statements promising renewed war against Donbass, which were made first on April 30th, “The war will end when Ukraine regains Donbass and Crimea,” and which were repeated on May 11th, by his saying, “I have no doubt, we will free the [Donetsk] Airport, because it is our land.” In other words, Poroshenko had repeatedly made clear that he plans a third invasion of Donbass, and, ultimately, also to invade and retake Crimea. (The Western press, however, had not reported any of these threats that were being made by Poroshenko.) Kerry responded: “ I have not had a chance – I have not read the speech. I haven’t seen any context. I have simply heard about it in the course of today [which would be shocking if true]. But if indeed President Poroshenko is advocating an engagement in a forceful effort at this time, we would strongly urge him to think twice not to engage in that kind of activity, that that would put Minsk in serious jeopardy. And we would be very, very concerned about what the consequences of that kind of action at this time may be.”
  • None of this was reported by Western ‘news’ media. Even Russia’s own Sputnik News, which was Russia’s main English-language medium reporting on Kerry’s comment, ignored this shocking assertion by the U.S. Secretary of State contradicting the nominal leader of the Ukrainian Government that the U.S. itself had installed in February 2014.  The Obama Administration now had slammed Poroshenko down on the key issue of whether to resume the war against Ukraine’s former Donbass region, and also slammed him on whether Ukraine should invade Crimea, which is Russian territory and would therefore mean a war against the Russian armed forces. America’s stooge-regime in Kiev was here being publicly taken to the woodshed about the advisability of yet another Ukrainian invasion of Ukraine’s former southeastern breakaway regions, Donbass and, even Crimea. 
  • Western ‘news’ media were far worse than a botch; they were outright dishonest. Typical was BBC, which headlined on May 12th, “Ukraine Crisis: Kerry Has ‘Frank’ Meeting with Putin,” and their article said nothing whatsoever about Kerry’s shocking slam-down of his Ukrainian stooge. To that ‘news’ report was also appended an “Analysis: Bridget Kendall, BBC News, Sochi,” which simply blathered, and concluded, “There was no breakthrough on anything.” That statement was the exact opposite of the truth. The one good, and, really, brilliant, news-analysis on this important matter, was from the legendary specialist on “the Empire’s [Washington’s] War on Russia,” the anonymous blogger who goes by the name, “The Saker.” His was not really a news-report, because he, too, failed to quote Kerry’s pathbreaking and shocking statement. He didn’t even quote the insignificant squib that Sputnik itself had quoted from Kerry’s remarks. Instead, he merely paraphrased Kerry, which is far less reliable than a quotation, and also far less informative than the packed shocker that Kerry actually delivered. Saker’s paraphrase was far briefer than was Kerry’s statement which is quoted here; it was merely: “Kerry made a few rather interesting remarks, saying that the Minsk-2  Agreement (M2A) was the only way forward and that he would strongly caution Poroshenko against the idea of renewing military operations.” That’s all there was to it. So, The Saker failed to provide a news-report on Kerry’s shocker. But his news-analysis  of its significance was superb, and it’s extremely worth reading (it’s worth clicking onto the link which will now be provided on the article’s title). That analysis was dated May 13th, and it was bannered, “Yet Another Huge Diplomatic Victory for Russia.”

  • But also there was just a slice of real news in The Saker’s article, when he said, only in passing (as if it were insignificant, which it was not), “Then, there was the rather interesting behavior of [Victoria] Nuland, who was with Kerry’s delegation, she refused to speak to the press and left looking rather unhappy.” Nothing more than that, but that’s plenty. In other words: Nuland, the agent whom President Obama had placed in charge of arranging the February 2014 coup in Ukraine, and of selecting the leader of the junta that would be imposed upon Ukraine (“Yats” Yatsenyuk), and who told the U.S. Ambassador to Ukraine what to do and how to do it, was now exceedingly disturbed to find herself overridden at this late date in her Ukrainian escapade, publicly overridden by her own immediate boss, Secretary of State Kerry.  In other words: she is now sidelined. That’s important news, but The Saker there merely hinted at it, and only in passing. So, as a news-report, The Saker’s article was poor but perhaps the best around; but as a news-analysis, it was excellent, and by far the best.
  • Nuland now knows that she has lost, and that Obama has thrown in the towel on the original plan for Ukraine, which had been for an all-out military conquest of the region, Donbass, where the people had voted over 90% for the man whom Nuland’s team had overthrown on 22 February 2014, Viktor Yanukovych, and so Obama had wanted those people to be either killed or else expelled from Ukraine (so that they’d never again be able to vote in a Ukrainian national election and thus possibly restore a neutralist leadership of Ukraine, such as had existed under the man Obama deposed, Yanukovych). Consequently, clearly, now, Obama is on-board with the “Plan B” for Ukraine, which Francois Hollande and Angela Merkel had put into place, the Minsk II Agreement, which brought about the present ceasefire, which now has become clearly the utter (even accepted by Kerry) capitulation of Obama’s Plan A on Ukraine, which plan Nuland had been carrying out. Kerry’s public statement there was a public slap in the face to his own #2 official on Ukraine; and it could not have been asserted by him if he were not under Obama’s instruction that the previous plan, to exterminate or drive out all the residents of Donbass, was no longer worth trying, and that the Hollande-Merkel plan would be America’s fall-back position.
  • Obama’s message in this, through Kerry, to Ukraine’s President Poroshenko, and indirectly also to Ukraine’s Prime Minister Yatsenyuk (the leader whom Nuland herself had selected), is: we’ll back you only as long as you accept that you have failed our military expectations and that we will be stricter with you in the future regarding how you spend our military money. We’re getting in line now behind the Hollande-Merkel peace plan for Ukraine. Dmitriy Yarosh, and the other outright nazis who had been threatening to overthrow Poroshenko if he doesn’t renew the war against Donbass and seize Crimea; Dmitriy Yarosh, who was the man who had led the Ukrainian coup for the U.S., and whose thugs had dressed as Yanukovych’s security forces when gunning down both police and demonstrators in the February 2014 coup, in order for Yanukovych to become blamed for the bloodshed on that occasion; is now, in effect, being told: if you will try another coup, this time to overthrow our own stooges in Ukraine, then you’re finished, Mr. Yarosh. Don’t do it.
  • Merkel and Hollande thus won. Putin had decidedly won. Obama and the nazis he had empowered in Ukraine have now, clearly, been defeated. But the mess that Obama’s people have created in Ukraine by their coup and subsequent ethnic-cleansing to eliminate the residents of Donbass, will take decades, if ever, to repair. Western ‘news’ media can cover it all up, but they can’t change this reality, which, increasingly as time goes by, will expose the press’s failure to have even reported on this historically important U.S. coup in Ukraine and its ultimate failure. As a story about  the press, it is about yet another system-wide press-deceit upon the public, comparable to their ‘news coverage’ of ‘Saddam’s WMD,’ and other lies, in 2002 and 2003.

Netanyahu-Mossad Split Divides U.S. Congress on Iran Sanctions - Bloomberg View - 0 views

  • The Israeli intelligence agency Mossad has broken ranks with Prime Minister Benjamin Netanyahu, telling U.S. officials and lawmakers that a new Iran sanctions bill in the U.S. Congress would tank the Iran nuclear negotiations. Already, the Barack Obama administration and some leading Republican senators are using the Israeli internal disagreement to undermine support for the bill, authored by Republican Mark Kirk and Democrat Robert Menendez, which would enact new sanctions if current negotiations falter. Bob Corker, chairman of the Senate Foreign Relations Committee  -- supported by Republican Senators Lindsay Graham and John McCain -- is pushing for his own legislation on the Iran nuclear deal, which doesn't contain sanctions but would require that the Senate vote on any pact that is agreed upon in Geneva. The White House is opposed to both the Kirk-Menendez bill and the Corker bill; it doesn't want Congress to meddle at all in the delicate multilateral diplomacy with Iran.
  • Israeli intelligence officials have been briefing both Obama administration officials and visiting U.S. senators about their concerns on the Kirk-Menendez bill, which would increase sanctions on Iran only if the Iranian government can't strike a deal with the so-called P5+1 countries by a June 30 deadline or fails to live up to its commitments. Meanwhile, the Israeli prime minister’s office has been supporting the Kirk-Menendez bill, as does the American Israel Public Affairs Committee, ahead of what will be a major foreign policy confrontation between the executive and legislative branches of the U.S. government in coming weeks. Evidence of the Israeli rift surfaced Wednesday when Secretary of State John Kerry said that an unnamed Israeli intelligence official had said the new sanctions bill would be “like throwing a grenade into the process.” But an initial warning from Israeli Mossad leaders was also delivered last week in Israel to a Congressional delegation -- including Corker, Graham, McCain and fellow Republican John Barrasso; Democratic Senators Joe Donnelly and Tim Kaine; and independent Angus King -- according to lawmakers who were present and staff members who were briefed on the exchange. When Menendez (who was not on the trip) heard about the briefing, he quickly phoned Israeli Ambassador to the U.S. Ron Dermer to seek clarification. Barrasso told us Tuesday that different parts of the Israeli government told the delegation different things. “We met with a number of government officials from many different parts of the government. There’s not a uniform view there,” he said.
  • Menendez is so livid at the administration, he decried its efforts to avert Congressional action on Iran at the hearing, telling Deputy Secretary of State Tony Blinken: “You know, I have to be honest with you, the more I hear from the administration in its quotes, the more it sounds like talking points that come straight out of Tehran.” Tuesday night, Obama threatened to veto the Kirk-Menendez bill if it passes Congress. Wednesday morning, House Speaker John Boehner responded by announcing that Netanyahu has accepted his invitation to address a joint session of Congress on Feb. 11, just as Congress is likely to be embroiled in a legislative fight over both bills. Boehner told fellow Republicans that he was specifically inviting Netanyahu to address the threat posed by radical Islam and Iran. Netanyahu is expected to deliver full-throated support for sanctions. The administration is upset that Netanyahu accepted Boehner’s invitation without notifying them, the latest indication of the poor relationship between the Israeli government and the White House. Two senior U.S. officials tell us that the Mossad has also shared its view with the administration that if legislation that imposed a trigger leading to future sanctions on Iran was signed into law, it would cause the talks to collapse.

  • The Israeli view shared with Corker and other senators also mirrors the assessment from the U.S. intelligence community. “We’ve had a standing assessment on this,” one senior administration official told us. “We haven’t run the new Kirk-Menendez bill through the process, but the point is that any bill that triggers sanctions would collapse the talks. That’s what the assessment is.” Another intelligence official said that the Israelis had come to the same conclusion.  This is not the first time Israel’s Mossad has been at odds with Netanyahu on Iran. In December 2010, former Mossad chief Meir Dagan told Israeli reporters that he had openly opposed an order from Netanyahu to prepare a military attack on Iran. At the time, Obama was also working to persuade the Israeli prime minister to hold off on attacking Iran. Iranian diplomats have also routinely threatened to leave the talks if new sanctions were imposed. Javad Zarif, Iran’s foreign minister, at the end of December said new sanctions would “violate the spirit” of the negotiations that have been going on for more than a year now. Despite the intelligence analyses, however, predicting Iranian behavior is no exact science. There is still much about Iran’s program that U.S. spies do not know. In November, former CIA director Michael Hayden told Congress that U.S. intelligence assessments do not have a “complete picture” of the extent of Iran’s nuclear program.
  • On Capitol Hill, the fight over how to proceed against the administration is far from over. The Senate Banking Committee was supposed to mark up the Kirk-Menendez bill on Thursday, but the session was delayed by one week. Some Senate staffers told us that Democrats asked for the delay because Menendez wants to get more Democrats to commit to his bill before he goes public. A main pitch of the Kirk-Menendez bill is that is could garner bipartisan -- even perhaps veto-proof -- support in the face of Obama's disapproval. So far, most Democrats have stayed on the sidelines, especially after Obama and Menendez got into a heated argument over the bill at last week’s private Democratic retreat. Kirk and Menendez softened their proposal to make it more palatable to Democrats, by giving the president more flexibility than the previous version and providing the administration waivers after the fact. Corker, Graham and McCain are trying to woo Democrats to their side by arguing that avoiding sanctions language altogether and simply mandating that the Senate get a vote is a more bipartisan approach. There are only a handful of Democrats that will support any Iran bill, so competition for these votes is heated.
  • Update, 12 p.m. Jan. 22:  The Israeli prime minister's office released a statement Thursday about Mossad chairman Tamir Pardo’s meeting with the U.S. Senate delegation last weekend. The statement said Pardo didn’t oppose new sanctions on Iran but acknowledged that Pardo used the term “hand grenade” to describe the effect new sanctions would have on the nuclear negotiations with Iran. “He used this term to describe the possibility of creating a temporary breakdown in the talks, at the end of which the negotiations will be restarted under better conditions,” the statement said. “The Mossad chairman explicitly pointed out that the agreement that is being reached with Iran is bad, and may lead to a regional arms race.”

    My advice to Obama: tell John Kerry  to change Netanyahu's visa to impose travel restrictions, allowing him to travel only  to New York City  (where the U.N. is located). within the U.S. The U.S. did that routinely with Soviet Union officials during the Cold War days. Netanyahu has already faced heavy criticism in Israel for straining relations with Obama. He's currently facing heavy criticism for forcing his way  into the Charlie Hebdo march in Paris after President Hollande had specifically requested that he not take part and for having the idocy to tell French Jews that they could never have a home if they did not emigrate to Israel. If  the Obama Administration makes a public issue out of Netanyahu's latest affront, it might well cost Netanyahu re-eloection as Prime Minister next month. That decision lies in the hands of a single Israeli official who will choose which party is to try to form a new ruling coalition of parties. Mr. Netanyahu's Likud Party has no guarantee of getting that nod.

European scientist are extremely concerned about a dubious research program, financed by the Pentagon, that seems designed to spread diseases to crops, animals and people abroad. The creation of such weapons and of special ways to distribute them is prohibited under national and international law. The U.S. is running biological weapon research across the globe: Bio warfare scientists using diplomatic cover test man-made viruses at Pentagon bio laboratories in 25 countries across the world. These US bio-laboratories are funded by the Defense Threat Reduction Agency (DTRA) under a $ 2.1 billion military program– Cooperative Biological Engagement Program (CBEP), and are located in former Soviet Union countries such as Georgia and Ukraine, the Middle East, South East Asia and Africa. Until the mid nineteen-seventies the U.S. military tested biological warfare weapons on U.S. people, sometimes over large areas and on specific races. After a Congress investigation revealed the wide ranging program such testing was moved abroad. Private companies use U.S. government controlled laboratories in foreign countries for secret biological research under contract of the U.S. military, the CIA and the Department of Homeland Security. Last month the Bulgarian journalist Dilyana Gaytandzhieva reported of one of these U.S. controlled bio-laboratories: The US Embassy to Tbilisi transports frozen human blood and pathogens as diplomatic cargo for a secret US military program. Internal documents, implicating US diplomats in the transportation of and experimenting on pathogens under diplomatic cover were leaked to me by Georgian insiders. According to these documents, Pentagon scientists have been deployed to the Republic of Georgia and have been given diplomatic immunity to research deadly diseases and biting insects at the Lugar Center – the Pentagon biolaboratory in Georgia’s capital Tbilisi.   • Analogies with apartheid regime in the wake of Mandela’s death could accelerate efforts to ostracize Israel. This has happened in recent days: The Dutch water company Vitens severed its ties with Israeli counterpart Mekorot; Canada’s largest Protestant church decided to boycott three Israeli companies; the Romanian government refused to send any more construction workers; and American Studies Association academics are voting on a measure to sever links with Israeli universities. Coming so shortly after the Israeli government effectively succumbed to a boycott of settlements in order to be eligible for the EU’s Horizon 2020 scientific cooperation agreement, it is hard to avoid the conclusion that the BDS (Boycott, Divestment and Sanctions) movement is picking up speed. And the writing on the wall, if anyone missed it, only got clearer and sharper in the wake of the death of Nelson Mandela.

Among the many developments that could be creating the required critical mass one can cite the passage of time since the Twin Towers attacks in September 2001, which placed Israel in the same camp as the U.S. and the West in the War on Terror; Israel’s isolation in the campaign against Iran’s nuclear programs; the disappearance of repelling archenemies such as Osama bin Laden, Muammar Gadhafi, Mahmoud Ahmadinejad and, to a lesser degree, Yasser Arafat; the relative security and lack of terror inside Israel coupled with its own persistent settlement drive; and the negative publicity generated by revelations of racism in Israeli society, the image of its rulers as increasingly rigid and right wing and the government’s own confrontations with illegal African immigrants and Israeli Bedouin, widely perceived as being tinged with bias and prejudice.  In recent days, American statesmen seem to be more alarmed about the looming danger of delegitimization than Israelis are. In remarks to both the Saban Forum and the American Joint Distribution Committee this week, Secretary of State John Kerry described delegitimization as “an existential danger." Vice President Joe Biden, speaking to the same JDC forum, went one step further: “The wholesale effort to delegitimize Israel is the most concentrated that I have seen in the 40 years I have served. It is the most serious threat in my view to Israel’s long-term security and viability.”

  • One must always take into account the possibility of unforeseen developments that will turn things completely around. Barring that, the only thing that may be keeping Israel from crossing the threshold and “going over the cliff” in the international arena is Kerry’s much-maligned peace process, which is holding public opinion and foreign governments at bay and preventing a “tipping point” that would dramatically escalate the anti-Israeli boycott campaign.  Which only strengthens Jeffrey Goldberg’s argument in a Bloomberg article on Wednesday that Kerry is “Israel’s best friend." It also highlights, once again, how narrow-minded, shortsighted and dangerously delusional Kerry’s critics, peace process opponents and settlement champions really are (though you can rest assured that if and when the peace process collapses and Israel is plunged into South African isolation, they will be pointing their fingers in every direction but themselves.

Labeling all products produced wholly or in part in Israel-occupied Palestine territory is among the mildest of sanctions under discussion, a measure already adopted in two E.U. nations. The BSD Movement's success has also been marked by Israel attaining the pariah state status previously experienced by South Africa. Only the U.S., Canada, and a half-dozen or so tiny island nations closely aligned with the U.S. still vote in favor of Israel at the U.N. For example, the vote on granting Palestine U.N. observer state status was 138-9, with 41 abstentions.  The prospect of an end to the non-secular Jewish state has enormous ramifications for U.S. foreign policy, not the least of which is the influence of the Israel lobby in the U.S. that has thus far led the U.S. to three Treasury-draining wars in Southwest Asia and Northern Africa and host of minor military actions in other area nations, as well as a near-war in Syria, averted mainly via Russian diplomacy that outfoxed Secretary of State John Kerry. Germany Opens Criminal Investigation On Alleged NSA Merkel Phone Tap - 0 views

  • German prosecutors have opened an investigation into the alleged monitoring of Chancellor Angela Merkel’s cellphone by the U.S. National Security Agency, officials said Wednesday, in a move that could again complicate diplomatic relations between the two allies. It was not immediately clear what the new investigation might mean in terms of possible prosecutions of Americans. Documents provided by National Security Agency leaker Edward Snowden indicated in October that the U.S. was monitoring Merkel’s cellphone conversations, as well as those of 35 other foreign leaders. Merkel expressed outrage and accused Washington of a grave breach of trust. In the ensuing diplomatic fallout, President Barack Obama acknowledged Germany’s anger and promised that new guidelines would cut back on such monitoring, except in the case of a national security interest. “The leaders of our close friends and allies deserve to know that if I want to learn what they think about an issue, I will pick up the phone and call them rather than turning to surveillance,” Obama said at the time.

    There's a bit of comedy beneath the surface here. When Edward Snowden was in Hong Kong and news of the NSA leak hit, the U.S. Dept. of Justice promptly filed a criminal espionage charge against Snowden and attempted to extradite him from Hong Kong. Snowden left Hong Kong before the extradition paperwork was processed enough to result in his arrest.  Now with a pending criminal investigation of the NSA's espionage activities aimed at Germany's chancellor, the Obama White House says it wants dialog, not a criminal investigation. Would the U.S. honor its extradition treaty with Germany if NSA officials or the Director of Intelligence were charged with espionage in Germany? One might suspect that a dual-standard would be deployed, in effect saying that only espionage charges that the U.S. lodges can justify extradition. Or at least that's the way it worked when Italy tried and convicted in absentia several CIA officials and an Air Force officer of espionage activities, relating to the kidnapping and "extraordinary rendition" of a gentleman in Italy.       But this incident serves as a reminder that when the NSA officials conduct foreign intelligence activities, they will in most cases be deliberately violating the criminal laws of other nations. And the same activity aimed at U.S. citizens is also criminal, which is undoubtedly why Sen. Ron Wyden asked Director of Intelligence Clapper if the NSA had taken account of the Computer Fraud and Abuse Act in its processing of domestic digital communications. Clapper said he would get back to Wyden on that in writing. So far as I'm aware, Wyden is still waiting for that answer. There are lots of comedians in Washington, D.C. Most of them have no idea that they are comedians.
