Remember that horrible train wreck in Spain not long ago, captured on video? As tragic as it was, watching the crash and its gruesome aftermath was almost irresistible, wasn't it? Well, what if the disastrous rollout of the President's signature legislative achievement - what if this spectacular slow motion ObamaCare train wreck has been and is being allowed to happen so that what's going on around the bend from the fiery crash site gets little attention, from the public, from the media or from Congressional investigators? Think about it, friends. How could Barack Obama and his celebrated team of incredibly proficient, plugged in techies - the team that twice got him elected - be behind the utterly disastrous launch of the ObamaCare online storefront, healthcare.gov - arguably the biggest website failure in history? How could so much money have been spent to produce such a problem-plagued site that apparently was doomed in its developmental confusion? And how to fix this monumental mess, well, there doesn't seem to be any clear plan…other than hope. And now we learn that many, if not most, of the people actually signing up for ObamaCare through the website are enrolling in Medicaid, not signing up for private insurance policies they pay for, but adding their names onto government roll

    There is no doubt in my mind that corporations (and their Chamber of Commerce boot licking lackys) believe that employer provided healthcare benefits was a HUGE MISTAKE. The key feature of ObamaCare is that of ENDING the HMO-Employee Healthcare profit draining quagmire these corporations somehow stumbled into. (Hint: they traded healthcare benefits for wide open government assisted Globalization - the new world order Merchantilism). IMHO, the insurance companies know full well that the entire HMO-Employee Healthcare bandwagon is going to end. Not because of socialism; because of profit hungry out of control mercantilism. So they are trying to cut the best deal possible with the government. The merchantilist doesn't care that their employees are going to suffer. They only care that this cost and the blame for losing the benefit is moved from their books to the government. Nor does the merchantilist care about protecting our borders. They want cheap labor. Even if the social cost of that cheap labor lands on the government and destroys the nation. That's why the merchantilist and his Bankster financiers support Open Borders. The merchantilist could care less about the trade deficit and the massive transfer of American manufacturing jobs overseas. As long as they can sell their junk back into the USA market without a 33% import tax these bastardos are happy to destroy their country. I wonder whose army and navy will secure their investments when the USA no longer can? Are their private armies enough? Just wondering.

  • The Affordable Care Act authorizes the disputed “employer mandate” penalties and the health insurance subsidies that trigger them, only through insurance exchanges that are “established by the State.” Due to public opposition to Obamacare, at least 34 states, including Virginia, Utah and Indiana, failed to establish exchanges. Those states are being served — if that’s the word — by HealthCare.Gov, an exchange established by the federal government, which is clearly not a “State.” Ignoring the clear and unambiguous language of the statute, the IRS somehow decided to deploy the disputed taxes and spending in HealthCare.Gov states. Two lower courts found that Obamacare itself “unambiguously forecloses” the IRS’ “invalid” misinterpretation of the law. The plaintiffs in King v. Burwell represent Kevin Pace and tens of millions of other Americans who are injured by this breathtaking power grab.
  • If the King plaintiffs prevail before the Supreme Court, it will mean more jobs, more hours and higher incomes for millions of Americans — particularly part-time and minimum-wage workers. Employers will have more flexibility to structure their health benefits. States will be able to attract new businesses by shielding employers from Obamacare’s employer mandate. Critics complain such a ruling would eliminate subsidies in HealthCare.gov states, making the cost of Obamacare coverage transparent to enrollees. But those enrollees will be able to switch to lower-cost “catastrophic” plans — if the Obama administration allows it. To date, the administration has adamantly refused to say whether it would take even this small step to help affected HealthCare.gov enrollees.
  • More important, transparency is a good thing. If enrollees don’t want to pay the full cost of Obamacare coverage, that tells us something very important about Obamacare. It means nobody likes the way Obamacare actually works. Forcing the IRS to implement the law as written will thus create an opportunity for real health care reforms that actually reduce the cost of care. Reining in the IRS would affirm the rule of law, and lead to real health care reform. We should all hope for such an outcome.

As if Obamacare weren't problematic enough, two federal courts have found that the IRS unlawfully expanded the health care law's individual and employer mandates, by imposing them on tens of millions of Americans whom Congress exempted. On Wednesday, the Supreme Court will hear King v. Burwell, a case challenging that illegal and ongoing attempt to expand Obamacare outside the legislative process. The victims of this illegal Obamacare expansion include Kevin Pace, a jazz musician and adjunct professor of music in Northern Virginia. Anticipating the Obamacare mandate that employers cover all workers who put in at least 30 hours a week, Pace's employer was forced to cut hours for part-time professors like him in order to avoid massive penalties. In 2013, The Washington Post reported that Pace was left with "an $8,000 pay cut." "Thousands of other workers in Virginia" also had their hours cut. Even though the Obama administration has delayed the employer mandate, many employers have left the cuts in place for when the rules are enforced. " King v. Burwell is about more than IRS rules; it could kill the employer mandate, too." This unlawful expansion of Obamacare's employer mandate is causing workers across the country to lose more income with every passing day. It forced Utah's Granite School District to cut hours for 1,200 part-timers. According to the state of Indiana, which filed a similar legal challenge, this IRS power grab pushed "many Indiana public school corporations (to) reduc(e) the working hours of instructional aides, substitute teachers, non-certified employees, cafeteria staff, bus drivers, coaches and leaders of extracurricular activities." Another code phrase is "reward doctors for quality not quantity." Government bureaucracies in Washington do not know how to do this. But they will make a huge mess out of your health care in trying to. These government bureaucracies will also have the power to cut off your health care when they decide it is no longer worth the money. We have already seen a glimpse of this in the declaration by a bureaucracy, to be expanded with more powers under Obamacare, that women over 72 should not have mammograms. What they are saying here is that if you are over 72 and get breast cancer, they don't want to know about it. Just take the painkiller and go home, to paraphrase President Obama. They believe they can buy more votes taking the money for your care and spending it somewhere else. This is called "cost effectiveness."     Much has been made of several states suing the federal government over the passage of ObamaCare. The argument is, essentially, that the new law violates the 10th Amendment and infringes on the "commerce clause" of the Constitution. In this article, I will argue that this approach by the states will probably fail (in and of itself) -- but that the suits brought by the states could play a role in a more comprehensive strategy to challenge the constitutionality of ObamaCare. Let's make one thing clear up front. The states are motivated to take legal action to stop the recently passed health care bill because of one primary factor: political pressure. Around 60% of the people in America are mad as hell about the passage of ObamaCare -- and any local or state elected official with a lick of sense knows it. There are some governors and state legislators who have figured out that ObamaCare may amount to the final nail in the coffins of their financially deceased states' treasuries. But few politicians worry about their states' debts; most agonize over being reelected. States have ceded power, with few complaints, to the federal government for highway funding, control of education, Medicare and Medicaid mandates, management of waterways, etc., etc., ad nauseam, for over fifty years. The states, acting alone in a constitutional challenge of the new health care legislation, will have some difficult hurdles to overcome: A) Article VI of the Constitution states in part: This Constitution, and the Laws of the United States which shall be made in Pursuance thereof ... shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding. States can pass all the laws that they want "nullifying" ObamaCare. But they can't nullify the Constitution.     Interesting discussion by Walter Williams as guest host for Rush Limbaugh.  Walter points to the 1798 Jefferson-Madison "Kentucky Resolution" and, the Marbury v Madison ruling as the legal rational for States to oppose and nullify the Supreme Court Obamacare Tax. Many Conservatives erroneously blame the Kentucky Resolution for being the pretext of the Southern States defending their sovereignty by succeeding from the Union following the election of Lincoln in 1860.  My read is that Jefferson and Madison both saw the States as having the final say on the Constitutionality of any Federal action - be it Congress, Justice or Executive branch.  Marbury v. Madison seems to fully justify the Jefferson-Madison view of the Constitution and State Sovereignty.   Note that Jefferson and Madison were responding to the reprehensible Federalist "Alien and Sedition Act". excerpt: On Rush Limbaugh's Thursday program, George Mason University professor Walter E. Williams outlined the case that states can nullify Obamacare, citing Thomas Jefferson's 1789 Kentucky Resolution, which was a claim that the U. S. But over the long Fourth of July weekend, in a "Never Mind" moment, the Obama Administration announced, through a Deputy Assistant Secretary of the Treasury, that contrary to federal law, the employer mandate of Obamacare shall not become fully effective in months beginning after December 31, 2013, but only in months beginning after December 31, 2014. Making the announcement through such a low level Administration official to me says that Obama has contempt for the American people, and for the rule of law.     "Here is another example of how this administration and Congress randomly decide which laws they like and which ones they don't. For those of us paying attention we remember that Sen. Chuck Grassley, (R-Iowa) added a clause into the original text of the Affordable Care Act that said members of Congress and their aides MUST be covered by plans created by the law or offered through an exchange. Before Obamacare, Congress and their staff were covered by a health care plan that was considered "golden".  This was being paid for by the taxpayers.  Under Obamacare and Grassley's provision, Congress and staff would be subject to the exact same treatment as the rest of us. In other words, if government payments stopped, lawmakers and their aides would have been looking at thousands of dollars in additional premium payments.  (Just like the rest of us.)  Before Obamacare, the government contributed almost 75% to their premium payments. When they finally got around to "finding out what was in the bill", Capitol Hill started wringing their hands and hyperventilating.  With Grassley's provision in there, that would mean that, gasp, they would have to live by the same rules as the rest of and they just could not let that happen. All sorts of complaints were being made. For instance, "staffers don't make enough money to pay those premiums"; or "they will look for more lucrative jobs" in order to afford them.  Really?  How about the rest of the American people out there?  Do you think that they can afford higher premiums on the part-time work that they now will be forced into because of employer cut-backs?  The best line came from Nancy Pelosi who said that if Congress lost these Capitol Hill workers, a "tremendous intellectual resource" would be lost.  You just have to shake your head in disbelief. In every month before, sign-ups lagged behind the administration's original forecast by wide margins and had fallen 1.4 million behind by the end of February. In mid-March, the AP said that it would take "close to a miracle" just to reach 6 million. And a Rand survey out this week puts enrollment by early March at less than 4 million. To reach 7.1 million, sign-ups had to rocket up by 67% in just one month. That's astounding enough, but an IBD review of existing ObamaCare enrollment data shows that the mathematical challenge of reaching 7.1 million sign-ups was even tougher.

    The Supreme Court will begin hearing arguments on the constitutional challenges to the Patient Protection and Affordable Care Act in March. The court is expected to issue its ruling in late June. Last month, the Supreme Court received a resounding and unmistakable message from the state of Ohio.  Millions of Ohioans rejected ObamaCare and overwhelmingly passed the Ohio Health Care Freedom Amendment, repudiating ObamaCare's mandates and infringements on individual liberty and personal freedom. Now it's time for the Supreme Court to hear from Congress. As a coequal branch of government in our system of checks and balances, it is important that Congress clearly make its opinion known to the Supreme Court before it rules. Congressman Phil Roe, M.D. (R-TN) has introduced H. Res. 475. The resolution is short and to-the-point: It declares ObamaCare to be unconstitutional and the onerous individual mandate to be non-severable from rest of the law. Currently 63 members of Congress are co-sponsors of Congressman Roe's resolution. We need more.

To the surprise of only those who believe the fairy tail that ObamaCare will never add to the national debt, Secretary Sebelius was compelled to finally cease defending CLASS and abandon it. If only that same standard could be applied to all of ObamaCare. Now, the repeal of the CLASS Act moves on to the Senate. It's high time the Patriots mobilize to put pressure on the Senate to follow the House in repealing CLASS and sending it on to President Obama's desk. Not surprisingly the President has indicated he wouldn't sign repeal of CLASS.  Nonetheless, he should feel the pressure from the American people to do so.

      I din't agree with this statement!!  Jefferson fully supported the Madison Constitutional design.  If anything though, Jefferson was concerned about the sovereignty and power of the States as a limiting force on the Federal government.  This belief was excercized in 1798 when Jefferson and Madison took their opposition to the horrid  Adams-Federalist "Alien and Sediton Act" directly to the State legislatures.  Jefferson and Madison did not turn to to the federal Congress, that had passed the Act. they went straight to the States legislatures to marshal opposition and counter this first assault on  the Constitution and Bill of Rights (first andammendment).
