Netanyahu-Mossad Split Divides U.S. Congress on Iran Sanctions - Bloomberg View - 0 views

  • The Israeli intelligence agency Mossad has broken ranks with Prime Minister Benjamin Netanyahu, telling U.S. officials and lawmakers that a new Iran sanctions bill in the U.S. Congress would tank the Iran nuclear negotiations. Already, the Barack Obama administration and some leading Republican senators are using the Israeli internal disagreement to undermine support for the bill, authored by Republican Mark Kirk and Democrat Robert Menendez, which would enact new sanctions if current negotiations falter. Bob Corker, chairman of the Senate Foreign Relations Committee  -- supported by Republican Senators Lindsay Graham and John McCain -- is pushing for his own legislation on the Iran nuclear deal, which doesn't contain sanctions but would require that the Senate vote on any pact that is agreed upon in Geneva. The White House is opposed to both the Kirk-Menendez bill and the Corker bill; it doesn't want Congress to meddle at all in the delicate multilateral diplomacy with Iran.
  • Israeli intelligence officials have been briefing both Obama administration officials and visiting U.S. senators about their concerns on the Kirk-Menendez bill, which would increase sanctions on Iran only if the Iranian government can't strike a deal with the so-called P5+1 countries by a June 30 deadline or fails to live up to its commitments. Meanwhile, the Israeli prime minister’s office has been supporting the Kirk-Menendez bill, as does the American Israel Public Affairs Committee, ahead of what will be a major foreign policy confrontation between the executive and legislative branches of the U.S. government in coming weeks. Evidence of the Israeli rift surfaced Wednesday when Secretary of State John Kerry said that an unnamed Israeli intelligence official had said the new sanctions bill would be “like throwing a grenade into the process.” But an initial warning from Israeli Mossad leaders was also delivered last week in Israel to a Congressional delegation -- including Corker, Graham, McCain and fellow Republican John Barrasso; Democratic Senators Joe Donnelly and Tim Kaine; and independent Angus King -- according to lawmakers who were present and staff members who were briefed on the exchange. When Menendez (who was not on the trip) heard about the briefing, he quickly phoned Israeli Ambassador to the U.S. Ron Dermer to seek clarification. Barrasso told us Tuesday that different parts of the Israeli government told the delegation different things. “We met with a number of government officials from many different parts of the government. There’s not a uniform view there,” he said.
  • Menendez is so livid at the administration, he decried its efforts to avert Congressional action on Iran at the hearing, telling Deputy Secretary of State Tony Blinken: “You know, I have to be honest with you, the more I hear from the administration in its quotes, the more it sounds like talking points that come straight out of Tehran.” Tuesday night, Obama threatened to veto the Kirk-Menendez bill if it passes Congress. Wednesday morning, House Speaker John Boehner responded by announcing that Netanyahu has accepted his invitation to address a joint session of Congress on Feb. 11, just as Congress is likely to be embroiled in a legislative fight over both bills. Boehner told fellow Republicans that he was specifically inviting Netanyahu to address the threat posed by radical Islam and Iran. Netanyahu is expected to deliver full-throated support for sanctions. The administration is upset that Netanyahu accepted Boehner’s invitation without notifying them, the latest indication of the poor relationship between the Israeli government and the White House. Two senior U.S. officials tell us that the Mossad has also shared its view with the administration that if legislation that imposed a trigger leading to future sanctions on Iran was signed into law, it would cause the talks to collapse.

  • The Israeli view shared with Corker and other senators also mirrors the assessment from the U.S. intelligence community. “We’ve had a standing assessment on this,” one senior administration official told us. “We haven’t run the new Kirk-Menendez bill through the process, but the point is that any bill that triggers sanctions would collapse the talks. That’s what the assessment is.” Another intelligence official said that the Israelis had come to the same conclusion.  This is not the first time Israel’s Mossad has been at odds with Netanyahu on Iran. In December 2010, former Mossad chief Meir Dagan told Israeli reporters that he had openly opposed an order from Netanyahu to prepare a military attack on Iran. At the time, Obama was also working to persuade the Israeli prime minister to hold off on attacking Iran. Iranian diplomats have also routinely threatened to leave the talks if new sanctions were imposed. Javad Zarif, Iran’s foreign minister, at the end of December said new sanctions would “violate the spirit” of the negotiations that have been going on for more than a year now. Despite the intelligence analyses, however, predicting Iranian behavior is no exact science. There is still much about Iran’s program that U.S. spies do not know. In November, former CIA director Michael Hayden told Congress that U.S. intelligence assessments do not have a “complete picture” of the extent of Iran’s nuclear program.
  • On Capitol Hill, the fight over how to proceed against the administration is far from over. The Senate Banking Committee was supposed to mark up the Kirk-Menendez bill on Thursday, but the session was delayed by one week. Some Senate staffers told us that Democrats asked for the delay because Menendez wants to get more Democrats to commit to his bill before he goes public. A main pitch of the Kirk-Menendez bill is that is could garner bipartisan -- even perhaps veto-proof -- support in the face of Obama's disapproval. So far, most Democrats have stayed on the sidelines, especially after Obama and Menendez got into a heated argument over the bill at last week’s private Democratic retreat. Kirk and Menendez softened their proposal to make it more palatable to Democrats, by giving the president more flexibility than the previous version and providing the administration waivers after the fact. Corker, Graham and McCain are trying to woo Democrats to their side by arguing that avoiding sanctions language altogether and simply mandating that the Senate get a vote is a more bipartisan approach. There are only a handful of Democrats that will support any Iran bill, so competition for these votes is heated.
  • Update, 12 p.m. Jan. 22:  The Israeli prime minister's office released a statement Thursday about Mossad chairman Tamir Pardo’s meeting with the U.S. Senate delegation last weekend. The statement said Pardo didn’t oppose new sanctions on Iran but acknowledged that Pardo used the term “hand grenade” to describe the effect new sanctions would have on the nuclear negotiations with Iran. “He used this term to describe the possibility of creating a temporary breakdown in the talks, at the end of which the negotiations will be restarted under better conditions,” the statement said. “The Mossad chairman explicitly pointed out that the agreement that is being reached with Iran is bad, and may lead to a regional arms race.”

    My advice to Obama: tell John Kerry  to change Netanyahu's visa to impose travel restrictions, allowing him to travel only  to New York City  (where the U.N. is located). within the U.S. The U.S. did that routinely with Soviet Union officials during the Cold War days. That will teach Netanyahu a lesson he will remember, that  in the U.S. the Executive Branch has control of diplomatic relations. Netanyahu has already faced heavy criticism in Israel for straining relations with Obama. He's currently facing heavy criticism for forcing his way  into the Charlie Hebdo march in Paris after President Hollande had specifically requested that he not take part and for having the idocy to tell French Jews that they could never have a home if they did not emigrate to Israel. If  the Obama Administration makes a public issue out of Netanyahu's latest affront, it might well cost Netanyahu re-eloection as Prime Minister next month. That decision lies in the hands of a single Israeli official who will choose which party is to try to form a new ruling coalition of parties. Mr. Netanyahu's Likud Party has no guarantee of getting that nod.

Menendez Is to Face Corruption Charges, U.S. Official Says - NYTimes.com - 0 views

  • The Justice Department is preparing to file corruption charges against Senator Robert Menendez, a scrappy 61-year-old veteran of New Jersey politics, after a two-year investigation into allegations that he accepted gifts and lavish vacations in exchange for political favors for a longtime friend and political benefactor.A law enforcement official said on Friday that the charges would be filed within a month against Mr. Menendez, the son of Cuban immigrants, who rose from a childhood in the tenements to become the chairman of the Senate Foreign Relations Committee and is now the highest-ranking Latino Democrat in Congress.
  • With the senator aggressively raising money for a legal-defense fund for more than a year now, charges against him had long been anticipated. But even in New Jersey, a state with a long history of political corruption, the case is jarring.

Dr. Melgen eventually delivered hundreds of thousands of dollars to benefit Mr. Menendez and the national Democratic Party.Mr. Menendez accepted two round-trip flights aboard Dr. Melgen’s private jet for personal vacations in the Dominican Republic in 2010, but failed to report them as gifts or to reimburse Dr. Melgen at the time, as required under Senate disclosure rules.

  • According to court papers that were mistakenly and briefly unsealed last week, prosecutors have been examining whether Mr. Menendez improperly tried to persuade Medicare officials in recent years to change reimbursement policies in a way that would make millions of dollars for Dr. Melgen, one of the country’s biggest recipients of Medicare funds. Mr. Menendez has acknowledged urging the Centers for Medicare and Medicaid Services to change its reimbursement policy, but said he did so because he considered the policy unfair.

Sen. Menendez Top Recipient of MEK-Related Campaign Funding « LobeLog - 0 views

  • As readers of this blog already know, Sen. Robert Menendez (D-NJ) was the top congressional recipient of “pro-Israel” campaign funding in the 2012 election cycle, the last time he ran for office, according to the Center for Responsive Politics. He has since distinguished himself as the leading proponent among Senate’s Democrats of new sanctions against Iran. He has repeatedly co-sponsored sanctions legislation—with Mark Kirk (R-IL), the top recipient of pro-Israel campaign funding for the past decade—with the ostensible purpose of increasing pressure on Tehran to make far-reaching concessions at the negotiating table. It appears that Menendez has also been the top recipient of campaign funding from donors with ties to the Mojahedin-e Khalq (MeK), the cultish group that was until recently included on the State Department’s terrorism list, according to a new investigative report published Thursday by LobeLog alumni and occasional contributors Ali Gharib and Eli Clifton on The Intercept website. The article, “Long March of the Yellow Jackets: How a One-Time Terrorist Group Prevailed on Capitol Hill,” details how Menendez, then chairman of the Senate Foreign Relations Committee, maintained a hold for some six months—from July 2013 until late January 2014—on an arms package for the Iraqi government that included 24 Apache helicopters. Menendez explained publicly that he was concerned about then-Iraqi Prime Minister Nouri al-Maliki’s record of attacks against civilians and his tacitly allowing Iran to use Iraqi airspace to transport weapons to Syria.
  • But Ali and Eli cite sources that cumulatively suggest that Menendez’s position may have been influenced by intense lobbying on the part of pro-MeK individuals, including the lobbyist for one of the MeK’s political fronts and Menendez’s immediate predecessor, Robert Torricelli. Menendez finally lifted his hold after the Islamic State of Iraq and the Levant (ISIL) launched their first major offensive into al-Anbar province from bases along the Syrian-Iraqi border, taking Fallujah and most of Ramadi.
  • According to the article,Menendez accepted more than $25,000 from donors with ties to the MEK, making him the largest recipient from 2012, when the MeK was delisted that September, to the present. That’s not much compared to the well over $300,000 Menendez received from pro-Israel groups during the 2012 election cycle, but it was more than twice what was provided to the next biggest recipients, Sen. John McCain (R-AZ) and Rep. Dana Rohrabacher (R-CA). In any event, the article casts light on the seamier side of the politics around Iran, and it’s a good read besides.

Push for New Sanctions on Iran Stalls Amid Growing Resistance | The Nation - 0 views

  • A bid to slap Iran with a new round of economic sanctions appears to have stalled in the Senate, after leading Democrats amplified concern about the threat such a move poses to a fragile diplomatic process. Early in the week, reports that a bill introduced by Republican Mark Kirk and Democrat Robert Menendez was within striking distance of a veto-proof majority cast a shadow over news that negotiators had finalized a temporary agreement to freeze Iran’s nuclear program, beginning Monday. New sanctions would likely kill negotiations for a final deal, the White House warned lawmakers, and increase the chances of an armed conflict with Iran. But Senate majority leader Harry Reid has given no indication that he will bring the bill up for a vote, and the pressure to do so is falling now that top Democrats have intensified opposition to the proposed legislation. The Kirk-Menendez bill gained no new endorsements this week, and even one supportive senator admitted Wednesday to a break in momentum.
  • The gorilla in the room is the American Israeli Public Affairs Committee, which has been calling for new sanctions for months. Of the 16 Democrats who have endorsed the Kirk-Menendez legislation, several are up for re-election in closely contested states; Senator Kirk himself suggested Tuesday that a vote for new sanctions would be an opportunity for lawmakers to shore up support from the powerful lobby. “The great thing, since we represent a nationwide community — the pro-Israel community is going to be heavily present in most states — this is a chance for senators to go back and tell them, ‘I’m with you,’” Kirk said. Tellingly, the Kirk-Menendez bill states that if Israel takes "military action in legitimate self-defense against Iran's nuclear weapons program,” the US "should stand with Israel and provide…diplomatic, military, and economic support to the Government of Israel in its defense of its territory, people, and existence." The language is nonbinding, but it raises flags about whose interests the legislation would truly serve.
  • Dianne Feinstein addressed this point more directly than perhaps any other politician so far. “While I recognize and share Israel’s concern, we cannot let Israel determine when and where the US goes to war,” she said. “By stating that the US should provide military support to Israel should it attack Iran, I fear that is exactly what this bill will do.” Such outspokenness about the relationship between US policymaking in the Middle East and Israeli interests is remarkable. But other lawmakers are signalling that they too are shrugging off the lobby: Democratic Representative Debbie Wasserman-Shultz, normally a high-profile ally for AIPAC, reportedly argued against the Kirk-Menendez bill at a White House meeting attended by several dozen of her colleagues on Wednesday night. How things play out in the next week, and in the duration of the talks with Iran, will be a good test of AIPAC’s influence, which seemed diminished when Congress considered military strikes in Syria last year. Progressives claimed a victory when diplomacy prevailed then; as Peter Beinart points out, the current debate presents a real opportunity for the anti-war left to reassert itself, not only to punish lawmakers who start wars, but to set new expectations for a diplomacy-first approach.

    More signs that the power of the Israel Lobby in Congress is on the wane and that it is now a fit topic for open discussion. Might we yet again see the day when members of the Israel Lobby will be required to register as agents of a foreign power, as required by law?  (That bit about "Progressives claimed a victory when diplomacy prevailed then" is in my opinion off the wall. There are exceedingly few true "progressives" in Congress; they can be counted on the fingers of one hand. The statement ignores that members of Congress in both parties came out in opposition to war on Syria, as did the Pentagon. The precipitating sarin gas attack was quickly exposed as a false flag  attack cooperatively mounted by the Saudis and U.S. government officials to justify the planned U.S missile strikes. Public opinion was overwhelmingly against war on Syria and Russian diplomats offered Obama a face-saving path of retreat. Oh, yeah. Former Israeli Opposition Leader Puts Bibi-Boehner Ploy Bluntly « LobeLog - 0 views

  • Yossi Sarid, the former head of Israel’s Meretz Party and leader of the opposition in the Knesset from 2001 to 2003, has just written a very blunt—far too blunt for “acceptable” political discourse in Washington, DC—op-ed published Sunday by Haaretz. Unfortunately, it’s behind a pay wall, so the most I can do is extract a few excerpts. The title is straightforward: “Beware: Republican Jews on the Warpath,” and Sarid, who also served as minister of education under Ehud Barak, doesn’t pull any punches about what Boehner’s fraudulent invitation to Israeli Prime Minister Benjamin Netanyahu is really all about. Now it’s no longer a “crisis in the relationship” that they try to paper over; now it’s no longer just “tensions with the White House” that they’re making every effort to reduce in between meetings; now, it’s an open war with the United States. It’s Sheldon Adelson versus Barack Obama, and Israel is caught in the cross-fire. After Vice President Joe Biden, our greatest friend over there, announced an unspecified trip abroad that will prevent him from being in Congress at the fateful hour, Republican Jewish organizations launched a campaign of intimidation against those lawmakers who had already announced their intent to skip the joint session: Their political fate will be bitter.

  • You’ll remember that Obama, during an off-the-record meeting with Democratic senators three weeks ago, reportedly appealed to them to resist “donors and others” who opposed a deal with Iran and were pushing for new sanctions legislation that risked sabotaging the nuclear-focused talks with Iran and an eventual deal. Sen. Robert Menendez, who has been pushing for such legislation for more than a year, reportedly replied that he took “personal offense” at Obama’s remarks about donors, apparently interpreting Obama’s comments as suggesting that Menendez’s position was motivated by his desire and need for campaign cash. The New York Times helpfully noted in a profile of Menendez that the New Jersey senator had received $341,170 from hard-line pro-Israel groups over the past seven years, “more than any other Democrat in the Senate.” (In fact, he received more money than any other Senate candidate—Democratic or Republican—in the 2012 elections, while his Republican comrade-in-arms and co-sponsor for sanctions legislation, Illinois Sen. Mark Kirk, has received more campaign cash from pro-Israel political actions committees (PACs) associated with the American Israel Public Affairs Committee (AIPAC) than any other member of Congress over the past decade. And that doesn’t necessarily include all the much-harder-to-track money provided by donors like Adelson, who chairs Brooks’s RJC, through super PACS and other vehicles.)  Indeed, there’s no doubt that Obama’s reference to “donors” touched a very sensitive nerve with Menendez. Sarid, whose op-ed is most unlikely to appear in any mainstream U.S. publication, has now pounded it with a sledgehammer.

Prensa Latina News Agency - Ecuadorian Fugitives Gave Large Sums of Money to US Politic... - 0 views

  • Ecuadorian bankers Roberto and William Isaias, current fugitives, donated large sums of money to campaigns of U.S. politicians, the press revealed today. Reports underline that the Federal Bureau of Investigation (FBI) is investigating cases that involve Congressional Republican Senator Marco Rubio, Democrat Robert Menendez and Republican Representative Ileana Ros-Lehtinen, among other politicians. New York's NBC network told the FBI suspects that Menendez, through phone calls and recommendation letters to the Department of State and other bodies, helped the Ecuadorian brothers establish themselves in the U.S. in exchange for donations to his reelection campaign. Journalist and blogger Alberto Padilla claims he can confirm that, since they arrived to live in Miami, the Isaias have financed an active lobbying campaign against the Rafael Correa administration in Ecuador and have also aided senators, in exchange for being allowed to remain in the United States.
  • The Isaias were sentenced in absentia to eight years of imprisonment on April 11, 2012 by the National Court of Justice after a judicial process that lasted 13 years and in which 54 judges participated. In the Ros-Lehtinen case, the Daily Beast website assured that she recently received money from the former bankers in exchange for help. The Isaias had donated at least $23,700 USD to Ros-Lehtinen during the 2010, 2012 and 2014 electoral cycles, according to federal contribution campaign registers. The Isaias also contributed to the campaign funds of Florida's Senator Bill Nelson, and Congresswoman and also President of the National Democrat Committee Debbie Wasserman-Schultz and Representative Joe Garcia.

Lindsey Graham Says Congress Will "Follow [Bibi's] Lead" « LobeLog - 0 views

  • Lindsey Graham, who is not a stupid person, can be so embarrassing. Speaking at a press conference alongside Israeli Prime Minister Benjamin Netanyahu in Jerusalem Saturday, Graham said the following in response to Bibi’s call for “more sanctions, and stronger sanctions” against Iran. But you, above all others, have said that sanctions are what got Iran to the table, and it will be the only thing that brings them to a deal that we can all live with. I’m here to tell you, Mr. Prime Minister, that the Congress will follow your lead. [Emphasis added.]

He implied that people in the US intelligence community, which has insisted for more than seven years now that Iran has not made a decision to build a nuclear weapon, should have their driver’s licenses revoked whenever they return from overseas assignments, meetings or vacations. To those who believe the Iranians have not been trying to develop a nuclear weapon, if you come to America, you should not be allowed to drive on our highways. Clearly, this regime for years has been deceiving the international community, has been trying to pursuit [sic], in my view, a nuclear weapon.
  • And then there’s this little gem offered to a leader who, as prime minister or the leader of the opposition, has steadfastly opposed the peace-making efforts of three US presidents, including George W. Bush, and who enthusiastically encouraged the United States to invade and occupy Iraq, among other incredibly stupid moves. And what brings me here so many times, is common and shared values and common and shared enemies. The fate of one country determines the fate of the other. God bless the people of Israel, and you can count on the United States Congress, Republican and Democrat, to be there for you when you need us the most. [Emphasis added.]

  • But then last June, Graham, while on the rounds of the Sunday talk shows and apparently freaked out about Islamic State’s sweep in northern and western Iraq, called for Washington to work with Iran (and presumably with the hated Revolutionary Guard) to protect Baghdad. The US has to “have to have some dialogue with the Iranians that says, ‘let’s coordinate our efforts,’ but has some red lines,” he said on one show. “The Iranians can provide some assets to make sure Baghdad doesn’t fall,” he said on yet another. “We need to coordinate with the Iranians. To ignore Iran and not tell them, ‘Don’t take advantage of this situation,’ would be a mistake.”

Reacting to President Obama’s State of the Union Address last January, and particularly his remarks about imposing sanctions against Iran, the South Carolina senator warned that “the world is literally about to blow up.” At the 2010 Halifax International Security Forum, Graham reportedly stunned the audience—and apparently embarrassed his hosts—by calling for a full-scale attack on Iran beyond its nuclear facilities. So my view of military force would be not to just neutralize their nuclear program, which are probably dispersed and hardened, but to sink their navy, destroy their air force and deliver a decisive blow to the Revolutionary Guard. In other words, neuter that regime.
  • Now, to be fair to Graham, he did not explicitly endorse Netanyahu’s call for “more sanctions, and stronger sanctions” despite his promise that Congress will follow Bibi’s “lead” in dealing with Iran. Instead, he promised that Congress will vote on the Kirk-Menendez bill, or what I originally called the “Wag the Dog Act of 2014,” next month, the approval of which, according to virtually all knowledgeable observers, will result in the collapse not only of the negotiations over Iran’s nuclear program, but also of the international sanctions regime. (For a more specific analysis, you can examine Ed Levine’s assessment of the bill after it was introduced last year.) Graham, like Netanyahu himself, also insisted that he supports the administration’s efforts to negotiate a deal. “I would love nothing better than a diplomatic solution to the Iranian nuclear ambitions,” he said. “I support the Administration’s effort to try to bring this to a peaceful conclusion.” But then he went on to insist that any final agreement must include the abandonment by Tehran of its uranium enrichment capabilities—a demand that all of the P5+1 (US, UK, France, Russia, China plus Germany) consider totally unrealistic.
  • It’s pretty clear that Graham can sometimes get excitable, especially when the TV cameras are rolling. Assuming that the Kirk-Menendez bill does come to the floor next month, however, the big question is whether it will attract enough Senate Democrats to render its passage veto-proof (because there’s no doubt whatsoever that Obama will veto it). That will take 33 Democrats and/or independents and/or Republicans. At this point, I think the president should not have too much trouble getting those votes, and the fact that Graham has now taken the lead on this while on foreign soil will likely make it easier for Obama to get the Democratic support he needs. But Graham’s assurance that a Republican-led Congress will “follow [Netanyahu’s] lead” (against a US president, if necessary) should prompt a few of his fellow-Republicans to reflect just a little on the implications of such deference by a powerful US senator to a foreign leader.

Lobe notes that financial incentives to block the Iran deal also affect media: Tuesday’s floor speech by Senate Intelligence Committee Chair Dianne Feinstein could bury AIPAC’s hopes of winning passage of what I have called the Kirk-Menendez Wag the Dog Act of 2013…at least for the next month or so. The speech, which was remarkably comprehensive in rebutting virtually every argument made by AIPAC and the 59 co-sponsors in favor of the bill, comes amid a surprising spate of newspaper editorials against the bill, particularly given the dearth of actual news coverage about it. Newspapers that have taken position against the legislation in just the last few days include the Minneapolis Star Tribune, USA Today, the New York Times, and the often-neoconservative-leaning Washington Post. As cash-poor as they are, newspapers are still less susceptible to the kind of pressure exerted by AIPAC and its associated PACs that are able to provide — or deny — substantial cash for political campaigns.

AIPAC's Annus Horribilis? by Jim Lobe -- Antiwar.com - 0 views

  • The year of 2014 is starting well for the American Israel Public Affairs Committee (AIPAC), the premier organization of this country’s Israel lobby. Not only has it been clearly and increasingly decisively defeated – at least for now and the immediate future – in its bid to persuade a filibuster-proof, let alone a veto-proof, super-majority of senators to approve the Kirk-Menendez “Wag the Dog” Act that was designed to torpedo the Nov. 24 “Joint Plan of Action” (JPA) between Iran and the P5+1. It has also drawn a spate of remarkably unfavorable publicity, a particularly damaging development for an organization that, as one of its former top honchos, Steve Rosen, once put it, like “a night flower, … thrives in the dark and dies in the sun.”
  • Consider first what happened with the Kirk-Menendez sanctions bill, named for the two biggest beneficiaries of “pro-Israel” PACs closely associated with AIPAC in the Congressional campaigns of 2010 and 2012, respectively. Introduced on the eve of the Christmas recess, the bill then had 26 co-sponsors, equally divided between Democrats and Republicans, giving it an attractive bipartisan cast – the kind of bipartisanship that AIPAC has long sought to maintain despite the group’s increasingly Likudist orientation and the growing disconnect within the Democratic Party between its strongly pro-Israel elected leadership and more skeptical base, especially its younger activists, both Jewish and gentile. By the second week of January, it had accumulated an additional 33 co-sponsors, bringing the total to 59 and theoretically well within striking distance of the magic 67 needed to override a presidential veto. At that point, however, its momentum stalled as a result of White House pressure (including warnings that a veto would indeed be cast); the alignment behind Obama of ten Senate Committee chairs, including Carl Levin of the Armed Services Committee and Dianne Feinstein of the Intelligence Committee; public denunciation of the bill by key members of the foreign policy elite; and a remarkably strong grassroots campaign by several reputable national religious, peace, and human-rights groups (including, not insignificantly, J Street and Americans for Peace Now), whose phone calls and emails to Senate offices opposing the bill outnumbered those in favor by a factor of ten or more.
  • The result: AIPAC and its supporters hit a brick wall at 59, unable even to muster the 60 needed to invoke cloture against a possible filibuster, let alone the 77 senators that AIPAC-friendly Congressional staff claimed at one point were either publicly or privately committed to vote for the bill if it reached the floor. By late this week, half a dozen of the 16 Democrats who had co-sponsored the bill were retreating from it as fast as their senatorial dignity would permit. And while none has yet disavowed their co-sponsorship, more than a handful now have (disingenuously, in my view) insisted that they either don’t believe that the bill should be voted on while negotiations are ongoing; that they had never intended to undercut the president’s negotiating authority; or, most originally, that they believed the mere introduction of the bill would provide additional leverage to Obama (Michael Bennet of Colorado) in the negotiations. Even the bill’s strongest proponents, such as Oklahoma’s Jim Inhofe, conceded, as he did to the National Journal after Obama repeated his veto threat in his State of the Union Address Tuesday: “The question is, is there support to override a veto on that? I say, ‘No.’” The Democratic retreat is particularly worrisome for AIPAC precisely because its claim to “bipartisanship” is looking increasingly dubious, a point underlined by Peter Beinart in a Haaretz op-ed this week that urged Obama to boycott this year’s AIPAC policy conference that will take place a mere five weeks from now. (This is the nightmare scenario for Rosen who noted in an interview with the JTA’s Ron Kampeas last week that the group’s failure to procure a high-level administration speaker for its annual conference “would be devastating to AIPAC’s image of bipartisanship.”) According to Beinart:

  • Of course, none of this means that the battle over Iran policy is won, but it does suggest that AIPAC’s membership has some serious thinking to do about the group’s relationship to Democrats and to the broader Jewish community. Nor does it necessarily mean that we have finally reached a “tipping point” regarding the lobby’s hold over Congress and U.S. Middle East policy. But this is unquestionably a significant moment. Update on Iran Sanctions Legislation « LobeLog - 0 views

  • The sponsors of the latest Kirk-Menendez Iran sanctions bill appear determined to move the legislation as quickly as possible, although it has yet to be formally introduced. Of course, both Obama and visiting British Prime Minister David Cameron came out strongly against any sanctions legislation during their joint press appearance at the White House Friday, warning that approval risked sabotaging not only the ongoing negotiations, but also unity among the P5+1 (U.S., U.K, France, Russia, China plus Germany) themselves. In olden times one would have expected most Republicans to take seriously what a British prime minister–especially one from Winston Churchill’s Conservative Party–has to say about a foreign policy issue of mutual interest. But the combination of their real hatred for Obama and purported love for Israel (and especially for the campaign funds from wealthy Republican Jewish Coalition donors like Sheldon Adelson) is likely to supersede the historic “special relationship” extolled by Churchill himself. In any event, the best and most up-to-date summary of where things stand was provided in the weekly Legislative Round-Up by Lara Friedman of Americans for Peace Now (APN), lengthy excerpts of which are reproduced below with permission. (APN legislative round-ups are an excellent source for tracking what’s happening on Capitol Hill on Middle East policy.) Note that there are two parts to her account: the first is regarding an AIPAC draft that circulated earlier this week (and Lara’s analysis of that legislation); the second, an updated version circulated at week’s end apparently in the hope of securing more Democratic support, as well as Lara’s analysis of that draft.
  • Updated analysis of Kirk-Menendez text (as of 3pm, 1/16) In some annoying corollary to Murphy’s Law, shortly after posting analysis of the draft text of the new Kirk-Menendez sanctions bill (in which it was noted that the text should not be considered final or authoritative), a newer draft of the bill began circulating (underscoring the oddness of AIPAC circulating a “summary” of the bill while it was/is apparently still being tweaked).  Bearing in mind that this new text should still not be considered final or authoritative, the following are some observations about this newer text:
  • Existing sanctions don’t snap back, but additional sanctions relief remains elusive: This newer text repeats language in the earlier draft to the effect that while following an agreement (and required notification to Congress) the President may not waive any sanctions on Iran until Congress has had time to review the deal and the Administration’s plans to verify Iranian compliance. The newer version includes language – completely absent in the earlier draft – stipulating that this ban on waiving sanctions does not apply to sanctions previously waived under the JPOA. Notably, the updated version of the bill still stipulates that the Congressional review period during which the President is barred from waiving any new sanctions must last “30 days of continuous session of Congress,” and defines “continuous session” as not including periods where Congress is in recess for more than 3 days.  What does this mean? Looking at the House Calendar for 2105 and counting the days, it means that if the President sends the details of a deal and the required “verification assessment” to Congress on July 5, no new sanctions may be waived until at least November 13.

  • Automatic new sanctions if no agreement or further delay: Like the earlier version, this text stipulates that new sanctions would automatically be imposed, escalating over a period of months, in the event that  the Presidents fails to send to Congress the details of a comprehensive deal reached with Iran and the required “verification assessment” by July 5. This appears to apply even in the case of an additional extension or the sides agreeing to a period to iron out the details of implementation of an agreement.  It also stipulates that in the event that the President fails to send to Congress the details of a comprehensive deal reached with Iran and the required “verification assessment” by July 5, any sanctions previously waived by the President under the JPOA will automatically snap back on.
  • Laying out far-reaching parameters for a deal: Like in the previous version, the Sense of Congress included in the bill is, by definition, non-binding. It nonetheless sends a strong statement of Congressional intent. And this Sense of Congress, like the previous version, sends a statement of hardline red lines in order for any deal to be acceptable to Congress (and the lengthy review period imposed by this bill clearly implies that Congress will be reviewing any agreement to determine if it meets its standards – and implies that if it does not meet its standards, there will be concrete consequences). Promising that sanctions will continue, regardless of a deal. While, like in the previous version, the Sense of Congress is by definition non-binding, it nonetheless sends a strong statement of Congressional intent. And this Sense of Congress once again makes clear that even if there is a deal that verifiably addresses U.S. concerns about Iran’s nuclear program, Congress will seek to continue to impose far-reaching sanctions against Iran for other reasons.
  • Planting the seeds for a deal to far apart:  The key provisions of this updated version of the bill, even amended, are a clear poison pill for any agreement.  In effect, this bill undermines negotiations and weakens U.S. negotiators. Rather than offering more sanctions relief to Iran in exchange for a deal, it prohibits it, and establishes a 4-month period during which the President is explicitly deprived of any authority to deliver anything to Iran beyond what was already delivered during negotiations. Assuming Iran would agree to a deal under such circumstances – which is doubtful – this bill sets into motion a dynamic in which Iranian opponents of a diplomacy will have an easy time arguing against the deal, and in which mischief-makers in Congress will have ample time to push ahead with new legislation rejecting a deal or putting new conditions on its implementation and limitations on sanctions relief. And given the Sense of Congress in this bill – which makes the case for continued Iran sanctions even after a nuclear deal, it is not a stretch to imagine that members of Congress would adopt such an approach during this 4 month waiting period.

Bipartisan bill to review Iran deal is now looking a lot less bipartisan - The Washingt... - 0 views

  • If Hill Republicans thought Israeli Prime Minister Benjamin Netanyahu's Tuesday address would build broad support for having Congress review any nuclear deal with Iran, they thought wrong. By the end of the day Tuesday, key Democratic senators had pulled their support for just such a bill after Majority Leader Mitch McConnell (R-Ky.) announced he was fast-tracking the legislation, bringing it to the Senate floor for debate as soon as next week, short-circuiting committee deliberations that Democrats say are necessary to perfect it. Bob Corker (R-Tenn.), Robert Menendez (D-N.J.), Lindsey Graham (R-S.C.) and Tim Kaine (D-Va.) introduced the Iran Nuclear Agreement Review Act late last week, which would provide for 60 days of congressional review for any deal that comes out of the pending "P5+1" negotiations in Geneva, where the United States, Germany, Russia, China, Britain and France are now at the table with the Iranian regime. Once submitted to Congress, lawmakers could approve, disapprove, or take no action on the deal. The talks are currently scheduled to end on March 24.
  • The legislation had not only two Democratic sponsors but four co-sponsors in the Democratic conference, giving the measure a filibuster-proof level of support. But that was before McConnell moved to place the bill on next week's legislative calendar -- guaranteeing a Senate vote while negotiators are still at the table. "We think the timing is important," McConnell said Tuesday. "We think it will help prevent the administration from entering into a bad deal, but if they do, then it will provide an opportunity for Congress to weigh in." REUTERS REPORT PROMPTS LETTER Reuters reported Monday that major banks and other loan servicers have continued to file questionable documents in foreclosure cases. 47 Senators Take AIPAC's Word Over U.S. Intel Community « LobeLog.com - 0 views

  • The American Israel Public Affairs Committee (AIPAC) has published the list of senators who so far have agreed to co-sponsor the Nuclear Weapon Free Iran Act of 2013, aka the Wag the Dog Act of 2014. You’ll recall that the initial list, which was introduced by its principal engineers, Sens. Mark Kirk and Robert Menendez, Dec 19, included 26 co-sponsors equally divided between Democrats and Republicans, to which newly elected New Jersey Sen. Cory Booker quickly added his name. Since then, 20 other senators — all Republicans, unsurprisingly — have added their names, for a grand total of 47 — still short of a majority, let alone one that could survive an Obama veto that the White House has already committed the president to cast if the bill is passed in its present form. According to the AIPAC list, which is reproduced below, 53 senators, including 36 Democrats and the two independents who normally vote with the Democratic caucus, have not agreed to co-sponsor the bill, or, in the dreaded moniker used by AIPAC to score lawmakers’ voting records (presumably for the benefit of the “pro-Israel” PACs that decide how to dole out campaign cash), are labeled “DNC.” They will undoubtedly be the top targets for AIPAC’s legendary powers of persuasion when the Senate reconvenes early next week.
  • What is remarkable about this list, however, is that very few of the 47 co-sponsors have chosen to publicize their support for the bill to their constituents through local media or other means. A handful of the original co-sponsors put out press releases, as did Rob Portman, a late joiner. Lamar Alexander, another late-comer, courageously “tweeted” his backing for the bill. “If this were a bill senators were excited about; that is, something they thought they’d earn a lot of credit for — and not draw a lot of heat — from their voters, you’d think all of the co-sponsors would be proudly touting their support,” one veteran Hill observer told me. “Clearly, even for the Republican [co-sponsors], that doesn’t seem to be the case with this bill.” In other words, the co-sponsors appear to be targeting a very narrow constituency — AIPAC, which is now touting their names — rather than  their voters back home, most of whom probably have no idea of what their senator’s position is or what may be at stake. Which raises an interesting question: If the folks back home knew that their senator was supporting a bill that would make another war in the Middle East more, rather than less likely, would there be an outcry as there was after Obama (and AIPAC) asked Congress to approve military action against Syria? Would some senators feel compelled to reassess their support?
  • One other point: others — most recently and convincingly, Colin Kahl and Paul Pillar — have argued just how counter-productive and potentially dangerous this bill is, and we have republished their arguments for the benefit of LobeLog readers in recent days. But it should be stressed that the 47 co-sponsors of this bill, most notably the 14 Democrats who have signed on to it, have effectively decided that Bibi Netanyahu and AIPAC are more credible sources about Iran and what it is likely to do in the P5+1 negotiations if this sanctions bill becomes law than either the U.S. diplomats who are directly involved in the talks or the U.S. intelligence community. Which is a rather startling fact, especially given, for example, Bibi’s predictive record on Iraq in the run-up to the U.S. invasion and his quarrels with his own intelligence community with respect to Iran. U.S. officials beginning at the top with Obama, then running through John Kerry and Wendy Sherman have stated repeatedly that the passage of a new sanctions bill — even one that would take effect prospectively — would not only violate the spirit, if not the letter, of the Nov. 24 agreement; it would also call into serious question Washington’s good faith; quite possibly isolate the U.S. within the P5+1 with disastrous results for the existing sanctions regime; and sufficiently strengthen hardliners in Tehran to force its government to toughen its demands at the negotiating table, if not abandon the diplomatic path altogether (and with it the chances of a peaceful diplomatic settlement). Senate Foreign Relations Committee Approves ISIL AUMF and Sunset of 2001 AUMF | Just Se... - 0 views

  • On Thursday, the Senate Foreign Relations Committee approved a draft authorization for the use of military force (AUMF) against ISIL (full text) by a margin of 10-8 along party lines. The text also includes an amendment that would sunset the 2001 AUMF in three-years. Most of today’s news headlines will be focused on the authorization to fight ISIL—and we will have plenty of discussion about it at Just Security. But the sunset of the 2001 AUMF is highly significant in its own right – and it should be welcome news to a wide range of national security law experts across the political spectrum, as Jack Goldsmith, Steve Vladeck, and I discussed in an  Op-Ed in the Washington Post. (Indeed, a sunset of the 2001 AUMF is endorsed by the Principles for drafting an ISIL AUMF published at Just Security and a proposed AUMF published at Lawfare.)
  • The action on the 2001 sunset was a bit of a surprise because  Sen. Menendez’s draft ISIL AUMF did not originally include a provision to sunset the 2001 AUMF. Nor did Sen. Tim Kaine’s similar draft AUMF. Both Senators Menendez and Kaine, however, spoke strongly in favor of the amendment today (and I applaud them for that). The action on the 2001 AUMF is significant as a potential turning point in the armed conflict with Al Qaeda. In his National Defense University speech in May 2013, President Obama called for refining and eventually repealing the 2001 AUMF when conditions permit. He stated: “I look forward to engaging Congress and the American people in efforts to refine, and ultimately repeal, the [2001] AUMF’s mandate.” Placing a sunset on the 2001 AUMF has been a key plank in Harold Koh’s position, in testimony and in Just Security posts (here and here), outlining how the President can bring an eventual end to the “Forever War.” Another part of that roadmap includes disengaging from Afghanistan. It is notable that today’s decision on the 2001 sunset also comes on the heels of yesterday’s news of the closure of the detention facility at the Bagram Airfield in Afghanistan. At least these aspects of the armed conflict with Al Qaeda and the Taliban may be winding down or narrowing, albeit while the conflict with ISIL heats up.
  • Increase transparency. Neither Congress nor the American public has a clear idea whom the United States is fighting or where, especially when it comes to forces associated with al-Qaeda. Any new AUMF should require the president to identify the groups against which force is used, along with related details, regularly in a report to Congress and, unless strictly required by national security, the American people. The president should also share with Congress, and the public to the extent possible, the administration’s legal rationales for using force. Such transparency rules should also be imposed on the 2001 AUMF … Congress should also consider imposing these transparency requirements on uses of force against terrorists under the president’s Article II powers. 3) Geographic limits on ISIL AUMF Sen. Rand Paul proposed an amendment to limit the ISIL AUMF so that the authorization to use force does not apply “outside of the geographic boundaries of Iraq and Syria.” He explained that if ISIL moves some of its forces outside of Iraq and Syria, the administration could return to Congress for additional authorities. That amendment was defeated in a separate vote. With a group of seven other national security law experts, I have supported geographic limits on an ISIL AUMF, but not as restrictive as the limits that Sen. Paul proposes. Our set of Principles recommend Congress to authorize force in Iraq and Syria as well as “any other locations from which ISIL forces actively plan and/or launch attacks against the United States or Iraq.” As Sen. Paul noted, a recent study found that 60 percent of congressional force authorizations have contained geographic limitations.

  • Three points deserve special mention: 1) A caveat: “revise” not “repeal” Senators who spoke during the Committee’s meeting in favor of the amendment to sunset the 2001 AUMF did not describe the provision as an opportunity to repeal the AUMF but to “refine,” “reevaluate,” or reconsider it three years from now. 2. A missed opportunity for transparency? The ISIL AUMF includes a robust set of transparency and reporting requirements. This is good news. But, while we are in the business of applying such reporting requirements to the fight with ISIL, what’s the possible justification for not applying them to the fight with Al-Qaeda as well? Republicans Warn Iran -- and Obama -- That Deal Won't Last - Bloomberg View - 0 views

  • A group of 47 Republican senators has written an open letter to Iran's leaders warning them that any nuclear deal they sign with President Barack Obama's administration won’t last after Obama leaves office. Organized by freshman Senator Tom Cotton and signed by the chamber's entire party leadership as well as potential 2016 presidential contenders Marco Rubio, Ted Cruz and Rand Paul, the letter is meant not just to discourage the Iranian regime from signing a deal but also to pressure the White House into giving Congress some authority over the process. “It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system … Anything not approved by Congress is a mere executive agreement,” the senators wrote. “The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.”
  • Arms-control advocates and supporters of the negotiations argue that the next president and the next Congress will have a hard time changing or canceling any Iran deal -- -- which is reportedly near done -- especially if it is working reasonably well. Many inside the Republican caucus, however, hope that by pointing out the long-term fragility of a deal with no congressional approval -- something Supreme Leader Ayatollah Ali Khamenei has also noted -- the Iranian regime might be convinced to think twice. "Iran's ayatollahs need to know before agreeing to any nuclear deal that … any unilateral executive agreement is one they accept at their own peril,” Cotton told me. The issue has already become part of the 2016 GOP campaign. Former Florida Governor Jeb Bush came out against the negotiations in a speech at the Chicago Council last month. Former Texas Governor Rick Perry released a video criticizing the negotiations and calling for Congressional oversight. “An arms control agreement that excludes our Congress, damages our security and endangers our allies has to be reconsidered by any future president,” Perry said. Republicans also have a new argument to make in asserting their role in the diplomatic process: Vice President Joe Biden similarly insisted -- in a letter to then-Secretary of State Colin Powell -- on congressional approval for the Moscow Treaty on strategic nuclear weapons with Russia in 2002, when he was head of the Senate Foreign Relations Committee.
  • The new letter is the latest piece of an effort by Senators in both parties to ensure that Congress will have some say if and when a deal is signed. Senators Bob Corker, Lindsey Graham, Tim Kaine and the embattled Bob Menendez have a bill pending that would mandate a Congressional review of the Iran deal, but Republicans and Democrats have been bickering over how to proceed in the face of a threatened presidential veto. Still, Senators from both parties are united in an insistence that, at some point, the administration will need their buy-in for any nuclear deal with Iran to succeed. There’s no sign yet that Obama believes this -- or, if he does, that he plans to engage Congress in any meaningful way.
