    Update on that classic economic-political use case; "You have two cows". Hard to joke when the stock market has lost over $2 Trill in one week, and neither the government or the Federal Banksters Reserve show any concern.  Obama's golf game, fund raising and vacation schedule will not miss a beat.  Cape Cod calls and Obama is there.  Bernake and the Banksters met today, with a stock market begging for him to print up some more free fuel.  Bernake decides to stick with the plan and go with the collapse of the USA and the Dollar as scheduled. GOLD today is over $1780 /oz.  It's value in dollars has risen over $120 /oz since the raising of the debt limit to near $17 Trillion. The stock market melted down yesterday, crashing through key support barriers … shattering the confidence of millions of individual investors … and prompting most - who had been trying to turn a blind eye to the carnage - to start heading for the hills. Yesterday, Aug 9 2011 was the worst trading day since December of 2008. Just since the market began falling on July 26th, more than $7.8 trillion in equity has now been erased! Even though the Banksters are flush with $16.1 Trill in Federal Bankster Reserve coupons (GAO Audit of 2009-2010 Bankster books), the market can't seem to sort things out. And Banks stocks got hit hardest of all in yesterdays crash: US Bancorp and Wells Fargo were both down 9%. Huntington Bancshares and JP Morgan Chase declined 8.5% and 9.4% respectively. Fifth Third Bankcorp fell 11.4% and Capital One fell 12.08%. Regions Bank dropped 13.5% and SunTrust lost 13.9% of its value. Saw a National Media special on S&P last night.  These clowns gave Enron, Worldcom, Lehman Brothers, Ireland, Greece and Iceland their highest ratings right up until the eve of their collapse.  And then there's those trillions in garbage mortgage securities and derivatives rated triple A right through the collapse of the World economy

  • Three months, a naval fleet, 3,000 marines, one Billion dollars, and 450 cruise missiles later, it’s May 2011 and Obama had yet to ask for permission to engage in his offensive war from anyone but himself and the previously noted ‘club of the traveling pantsuits’. Despite the Office of Legal Council (the golfers own legal team) telling him approval is needed, he chose to violate the War Powers Act and more importantly the Constitution. It is critical to remember the political battle being waged at the time over whether President Obama had the authority to take “offensive military action”, without congressional approval,  when the threat was not against the United States. It’s critical because from that initial impetus you find the reason why arming the Libyan rebels had to be done by another method – because President Obama never consulted congress, nor sought permission.
  • Normally, in order to send arms to the rebels lawfully, President Obama would have to request approval from Congress. He did not want to do that.   Partly because he was arrogant, and partly because he did not want the politically charged fight that such a request would engage.  It would hamper his ability to take unilateral action in Libya.
  • So an alternate method of arming the rebels needed to be structured.    Enter the State Department, Hillary Clinton, and CIA David Petraeus. Weapons, specifically MANPADS or shoulder fired missiles, would be funneled to the Benghazi rebels by the State Dept, through the CIA under the auspices of ongoing NATO operations.   May, June, July, August, Sept, 2011 this covert process was taking place. It was this covert missile delivery process which later became an issue after Gaddafi was killed.    It was during the recovery of these missiles , and the redeployment/transfer to the now uprising “Syrian Rebels” when Ambassador Chris Stevens was killed on Sept. 11th 2012.

  • [O]n July 25, 2012, Taliban fighters in Kunar province successfully targeted a US Army CH-47 helicopter with a new generation Stinger missile. They thought they had a surefire kill. But instead of bursting into flames, the Chinook just disappeared into the darkness as the American pilot recovered control of the aircraft and brought it to the ground in a hard landing. The assault team jumped out the open doors and ran clear in case it exploded. Less than 30 seconds later, the Taliban gunner and his comrade erupted into flames as an American gunship overhead locked onto their position and opened fire. The next day, an explosive ordnance disposal team arrived to pick through the wreckage and found unexploded pieces of a missile casing that could only belong to a Stinger missile. Lodged in the right nacelle, they found one fragment that contained an entire serial number. The investigation took time. Arms were twisted, noses put out of joint. But when the results came back, they were stunning: The Stinger tracked back to a lot that had been signed out by the CIA recently, not during the anti-Soviet ­jihad. Reports of the Stinger reached the highest echelons of the US command in Afghanistan and became a source of intense speculation, but no action. Everyone knew the war was winding down. Revealing that the Taliban had US-made Stingers risked demoralizing coalition troops. Because there were no coalition casualties, government officials made no public announcement of the attack. My sources in the US Special Operations community believe the Stinger fired against the Chinook was part of the same lot the CIA turned over to the ­Qataris in early 2011, weapons Hillary Rodham Clinton’s State Department intended for anti-Khadafy forces in Libya. They believe the Qataris delivered between 50 and 60 of those same Stingers to the Taliban in early 2012, and an additional 200 SA-24 Igla-S surface-to-air missiles.  (link)

    The pieces of the puzzle are slowly coming together, and it isn't pretty.   • A researcher who specializes in the security of commercial airplanes was barred from a United Airlines flight Saturday, three days after he tweeted a poorly advised joke mid-flight about hacking a key communications system of the plane he was in. Chris Roberts was detained by FBI agents on Wednesday as he was deplaning his United flight, which had just flown from Denver to Syracuse, New York. While on board the flight, he tweeted a joke about taking control of the plane's engine-indicating and crew-alerting system, which provides flight crews with information in real-time about an aircraft's functions, including temperatures of various equipment, fuel flow and quantity, and oil pressure. In the tweet, Roberts jested: "Find myself on a 737/800, lets see Box-IFE-ICE-SATCOM, ? Shall we start playing with EICAS messages? 'PASS OXYGEN ON' Anyone ? :)" FBI agents questioned Roberts for four hours and confiscated his iPad, MacBook Pro, and storage devices.

    Bruce Schneier's take on this: "But to me, the fascinating part of this story is that a computer was monitoring the Twitter feed and understood the obscure references, alerted a person who figured out who wrote them, researched what flight he was on, and sent an FBI team to the Syracuse airport within a couple of hours. There's some serious surveillance going on. Now, it is possible that Roberts was being specifically monitored. He is already known as a security researcher who is working on avionics hacking. But still..." Some serious surveillance, indeed. And does the FBI have its own social media monitoring program or is this the result of a tip from the NSA, which assuredly does have a social media surveillance capability?  Consider the short time between the post and interception by FBI agents at the airport and all of the steps it takes to accomplish that feat. I come up with a system that is directly harvesting tweets as they are transmitted, not a web crawler. A huge amount of automation to identify the tweet as a potential threat and get it to someone with the vocabulary to understand the message. And another round of automation to get the import of the post to an FBI dispatcher who sends the agents to the airport armed with the information needed to question the tweeter for four hours on an esoteric subject. That's astounding to me.

  • Many of the technologies, both military technologies and surveillance technologies, that are developed for purposes of policing the empire find their way back home and get repurposed. You saw this in Ferguson, where we had military equipment in the streets to police nonviolent civil unrest, and we’re seeing this with surveillance technologies, where things that are deployed for use in war zones are now commonly in the arsenals of local police departments. For example, a cellphone surveillance tool that we call the StingRay—which mimics a cellphone tower and communicates with all the phones around—was really developed as a military technology to help identify targets. Now, because it’s so inexpensive, and because there is a surplus of these things that are being developed, it ends up getting pushed down into local communities without local democratic consent or control.

  • SG & TP: How do you see the current state of the right to privacy? BW: I joked when I took this job that I was relieved that I was going to be working on the Fourth Amendment, because finally I’d have a chance to win. That was intended as gallows humor; the Fourth Amendment had been a dishrag for the last several decades, largely because of the war on drugs. The joke in civil liberties circles was, “What amendment?” But I was able to make this joke because I was coming to Fourth Amendment litigation from something even worse, which was trying to sue the CIA for torture, or targeted killings, or various things where the invariable outcome was some kind of non-justiciability ruling. We weren’t even reaching the merits at all. It turns out that my gallows humor joke was prescient.
  • The truth is that over the last few years, we’ve seen some of the most important Fourth Amendment decisions from the Supreme Court in perhaps half a century. Certainly, I think the Jones decision in 2012 [U.S. v. Jones], which held that GPS tracking was a Fourth Amendment search, was the most important Fourth Amendment decision since Katz in 1967 [Katz v. United States], in terms of starting a revolution in Fourth Amendment jurisprudence signifying that changes in technology were not just differences in degree, but they were differences in kind, and require the Court to grapple with it in a different way. Just two years later, you saw the Court holding that police can’t search your phone incident to an arrest without getting a warrant [Riley v. California]. Since 2012, at the level of Supreme Court jurisprudence, we’re seeing a recognition that technology has required a rethinking of the Fourth Amendment at the state and local level. We’re seeing a wave of privacy legislation that’s really passing beneath the radar for people who are not paying close attention. It’s not just happening in liberal states like California; it’s happening in red states like Montana, Utah, and Wyoming. And purple states like Colorado and Maine. You see as many libertarians and conservatives pushing these new rules as you see liberals. It really has cut across at least party lines, if not ideologies. My overall point here is that with respect to constraints on government surveillance—I should be more specific—law-enforcement government surveillance—momentum has been on our side in a way that has surprised even me.
  • Do you think that increased privacy protections will happen on the state level before they happen on the federal level? BW: I think so. For example, look at what occurred with the death penalty and the Supreme Court’s recent Eighth Amendment jurisprudence. The question under the Eighth Amendment is, “Is the practice cruel and unusual?” The Court has looked at what it calls “evolving standards of decency” [Trop v. Dulles, 1958]. It matters to the Court, when it’s deciding whether a juvenile can be executed or if a juvenile can get life without parole, what’s going on in the states. It was important to the litigants in those cases to be able to show that even if most states allowed the bad practice, the momentum was in the other direction. The states that were legislating on this most recently were liberalizing their rules, were making it harder to execute people under 18 or to lock them up without the possibility of parole. I think you’re going to see the same thing with Fourth Amendment and privacy jurisprudence, even though the Court doesn’t have a specific doctrine like “evolving standards of decency.” The Court uses this much-maligned test, “Do individuals have a reasonable expectation of privacy?” We’ll advance the argument, I think successfully, that part of what the Court should look at in considering whether an expectation of privacy is reasonable is showing what’s going on in the states. If we can show that a dozen or eighteen state legislatures have enacted a constitutional protection that doesn’t exist in federal constitutional law, I think that that will influence the Supreme Court.
  • The question is will it also influence Congress. I think there the answer is also “yes.” If you’re a member of the House or the Senate from Montana, and you see that your state legislature and your Republican governor have enacted privacy legislation, you’re not going to be worried about voting in that direction. I think this is one of those places where, unlike civil rights, where you saw most of the action at the federal level and then getting forced down to the states, we’re going to see more action at the state level getting funneled up to the federal government.

  • As US aircraft continued to pound the Islamist militants in northern Iraq, the Obama administration was studying a range of options for pressuring Isis in Syria, primarily through training "moderate" Syrian rebels as a proxy force, with air strikes as a possible backup.
  • The favoured option, according to two administration officials, is to press forward with a training mission, led by elite special operations forces, aimed at making non-jihadist Syrians an effective proxy force. But the rebels are outgunned and outnumbered by Isis and the administration still has not received $500m from Congress for its rebel training plans. Pentagon officials said they had yet to work out what the training program would actually look like, where it will be hosted, or if air strikes on Isis targets in Syria will support it. For all the internal administration focus on propping up moderate Syrian rebels, the US military would not be able to begin training them until October, the earliest that Congressional approval could be obtained for the required funding and authorisation. Kirby said he was unaware of any "plan to accelerate it". Nor have critical details for the training program been worked out, despite it being effectively the lynchpin of what the administration considers a long-term plan to defeat Isis. "I can't tell you where it would take place, or how many people would be trained, and there's still a vetting process that needs to be fully developed here," Kirby conceded.

The Free Syrian Army has been a joke from the beginning, a largely fictional entity composed of "moderates" used as political cover for the U.S. to smuggle weapons to mercenaries paid by Saudi Arabia that operated under the "Al Nusrah" flag. Most of Al Nusrah and the FSF joined ISIS after the U.S. attack on Syria was called off last year. The real "moderates" in Syria are fighting for the Syrian government. So I view this "strategy" as mere window dressing so the Obama Administration can claim that it has one.

  • First, just in case it's not utterly obvious, I'm glad that the two murderous cowards who attacked civilians in Boston recently are off the streets. One dead and one in custody is a great outcome. That said, a large percent of the reaction in Boston has been security theater. "Four victims brutally killed" goes by other names in other cities. In Detroit, for example, they call it "Tuesday". …and Detroit does not shut down every time there are a few murders.
  • "Then why the hell do you care, Clark?" First, the unprecendented shutdown of a major American city may have increased safety some small bit, but it was not without a cost: keeping somewhere between 2 and 5 million people from work, shopping, and school destroyed a nearly unimaginable amount of value. If we call it just three million people, and we peg the cost at a mere $15 per person per hour, the destroyed value runs to a significant fraction of a billion dollars. "Yeah, maybe…but in this day and age where the federal government is borrowing an extra $3.85 billion per day, a couple of hundred million doesn't sound like much. After all, if we're borrowing money that our children and grandchildren will have to pay back to fund Cowboy Poetry Festival and military golf courses, then what's another $200 or $400 million to keep people safe?"

In God-blessed America, the land of the free where everyone is an economic slave, our founding fathers' sacred idea of a government "of the people, by the people, for the people" has become but a cruel joke. The federal government is currently spending at least $60 billion per month on military excursions in Afghanistan, the Middle East, and northern and western Africa - including operating between 800 and 1,000 foreign military bases all over the world. Our country's over-used flying drone aircraft kills hundreds daily overseas, many of whom are only innocent bystanders. Meanwhile here on the home front, one in seven people are on food stamps, and at any given time one in four American children are going hungry today.   • I have just been watching the news and, frankly, I ended up laughing.
  • To be serious, I really am amazed by what is going on.  Western politicians seem to be stuck in total "lala land" or "bizarro world" (pick your expression).  There is such an absolute disconnect between what is actually happening in Banderastan (north and west), the rump-Ukraine (east and south), Crimea and Russia on one hand, and the mental representation which people in the West seem to have about it that I often wonder, yet again, whether the world has not gone completely mad.  I almost feel sorry for western politicians when I hear them speak.  They sound like a flat-earth society meeting and yet they try so hard to look dignified and important it's almost sad.  I say almost, because I realize that these want-to-look-dignified politicians are also the prime culprits for the hell which the (now ex-) Ukraine is going through. Lastly, I am amazed to see that the White House does not realize a basic dilemma it is facing: either the sanctions against Russia are ridiculously ineffective or, in theory, they could really hurt Russia (booting Russia out of the SWIFT system, revoking overflight and landing rights for Russian airlines, etc.).  Then what would happen?  Does the White House not know that Russia holds US$164 billion in US Treasury Securities?  That Russia could simply shut down the northern evacuation route for US forces in Afghanistan?  The millions of dollars in US and EU investment in Russia ( US$300,1 billion) could also be seized?  That Russia can shut down the "northern route" to US ships or stop cooperating on security and terrorism issues?  Fundamentally - does it do any good for the US to really hurt Russia (assuming that it could)? The US and EU remind me of a toddler playing with a hand grenade: either it is a very boring toy and nothing happens, or it works, but then you are dead. Western international diplomacy as a dead baby joke - how pathetic....

  • The tentative security deal reached between Secretary of State John Kerry and Afghan President Hamid Karzai could be at risk after Karzai told a gathering of elders that the signing should be put off until after next year's Afghan presidential election -- and signed only if it is approved by the council and the parliament. 
  • A delay in the signing would be problematic for the U.S. government, which wants an agreement as soon as possible to allow American planners to prepare for a military presence after 2014, when the majority of foreign combat forces will have left Afghanistan.  Despite the decision to defer signing the agreement until after the scheduled April 5 election, Karzai spoke in support of the deal on the first day of the meeting of the 2,500-member national consultative council of Afghan elders known as the Loya Jirga Thursday in Kabul.  At one point, Karzai acknowledged there was little trust between his government and Washington. He was quoted by Reuters as saying "My trust with America is not good. I don't trust them and they don't trust me. During the past 10 years I have fought with them and they have made propaganda against me.'' 
  • Karzai did not address one of the biggest points of contention in the proposed deal, the U.S. request for jurisdiction over its own troops. Lack of agreement over that issue helped scuttle a similar agreement with Iraq and prompted Washington to order most troops out of that country in 2011.  The Loya Jirga retains the right to revise or reject any clause of the deal. If the deal is approved by the council, whatever version of the pact that is extant must also be approved by the Afghan parliament.

    Here's hoping that the Jirga or Afghan Parliament will nix the deal as Iraq did, by refusing to grant U.S. troops and contractors immunity from Afghan criminal law. I read the leaked U.S. markup version of the deal two days ago. It would extend the U.S. Afghan War until 2024 or beyond. Kerry and Obama might be upset; both announced that Kerry had signed the deal this morning. According to Kerry, U.S. involvement will gradually wind down to about 15K troops plus who-knows-how-many contractors and subcontractors. Number of U.S. troops in Afghanistan when Obama took office: 26,607. Number of U.S. troops there as of October, 2013: roughly 51,000. Our Nobel Peace Prize Prez who jokes to his staff about how many people he kills. Ha, ha. Funny. Not.  Let's remember that as recently as June, Obama said that the U.S. could have all troops out before the present deal expires in 2014 if there's no new agreement. I can hope.

  • This whole morning, while all these stories of the NSA hacking directly into Google and Yahoo's network have been popping up, I've been at the Inbox Love conference, all about the future of email. The "keynote" that just concluded, was Ladar Levison from Lavabit (with an assist from Mike Janke from Silent Circle), talking about the just announced Dark Mail Alliance, between Lavabit and Silent Circle -- the other "security" focused communications company who shut down its email offering after Lavabit was forced to shut down. Levison joked that they went with "Dark Mail" because "Black Mail" might have negative connotations. Perhaps just as interesting, Levison is going to be releasing the Lavabit source code (and doing a Kickstarter project to support this), with the hope that many others can set up their own secure email using Lavabit's code, combined with the new Dark Mail Alliance secure technology which will be available next year. As noted, the Alliance is working on trying to create truly secure and surveillance-proof email. Of course, nothing is ever 100% surveillance proof -- and both members of the alliance have previously claimed that it was almost impossible to do surveillance-proof email. However, they're claiming they've had a "breakthrough" that will help.
  • The newly developed technology has been designed to look just like ordinary email, with an interface that includes all the usual folders—inbox, sent mail, and drafts. But where it differs is that it will automatically deploy peer-to-peer encryption, so that users of the Dark Mail technology will be able to communicate securely. The encryption, based on a Silent Circle instant messaging protocol called SCIMP, will apply to both content and metadata of the message and attachments. And the secret keys generated to encrypt the communications will be ephemeral, meaning they are deleted after each exchange of messages. For the NSA and similar surveillance agencies across the world, it will sound like a nightmare. The technology will thwart attempts to sift emails directly from Internet cables as part of so-called “upstream” collection programs and limit the ability to collect messages directly from Internet companies through court orders. Covertly monitoring encrypted Dark Mail emails would likely have to be done by deploying Trojan spyware on a targeted user. If every email provider in the world adopted this technology for all their users, it would render dragnet interception of email messages and email metadata virtually impossible.
  • Importantly, they're not asking everyone to just trust them to be secure -- even though both companies have the right pedigree to deserve some level of trust. Instead, they're going to release the source code for public scrutiny and audits, and they're hoping that other email providers will join the alliance. At the conference, Levison recounted much of what's happened over the last few months (with quite a bit of humor), joking about how he tried to be "nice" in giving the feds Lavabit's private keys printed out, by noting that he included line numbers to help (leaving unsaid that this would make OCR'ing the keys even more difficult). He also admitted that giving them the paper version was really just a way to buy time to shut down Lavabit.

  • Janke came up on stage to talk about the importance of changing the 40-year-old architecture of email, because it's just not designed for secure communications. The hope is that as many other email providers as possible will join the Alliance and that this new setup becomes the de facto standard for end-to-end secure email, which is where Levison's open sourcing of his code gets more interesting. In theory, if it all works out, it could be a lot easier for lots of companies to set up their own "dark mail" email providers. Either way, I would imagine that this development can't make the NSA all that happy.

  • And they wonder why people don’t trust the NSA’s mass metadata collection. The conversations that began at least in 2010 continued for three years. In fact, two days before Lerner “apologized” and outed the whole conspiracy, she wrote an email to the acting IRS commissioner’s chief of staff detailing ongoing discussions with DOJ officials. “These new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” said Judicial Watch President Tom Fitton. “The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection. And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information. How can the Justice Department and FBI investigate the very scandal in which they are implicated?”
  • The answer to that last, albeit rhetorical, question is that they can’t and they aren’t. Any “investigation” by the DOJ or FBI will no doubt exonerate anyone of importance in the Obama administration. If any guilt is unavoidable, it will be hung around the necks of those rascals in Cincinnati or some other unfortunate scapegoat. All while Lerner continues to enjoy her comfortable retirement, and Obama himself remains untouched. On top of the serious breach of law and abuse of power in targeting Obama’s political opponents, the agencies' carefully crafted stonewall blocked the timely release of information. As with Hillary Clinton’s emails and the Benghazi cover-up, the slow bleed of information leaves the public tired of hearing “old news” and makes it all the more certain the perpetrators won’t face real accountability, much less justice.
  • Finally, we’re reminded of a commencement speech Obama delivered in 2009 at Arizona State University, after university officials declined to give Obama an honorary doctorate. Obama “joked” that “[university president Michael] Crowe and the Board of Regents will soon learn all about being audited by the IRS.” Clearly, that wasn’t much of a joke.
