    As we approach July 4, 2013, is America in a pre-revolutionary state? Are we headed for a Tahrir Square of our own with the attendant mammoth social turmoil, possibly even violence. Could it happen here? We are two-thirds of the way into the most incompetent presidency in our history. People everywhere are fed up. Even many of the so-called liberals who propelled Barack Obama into office have stopped defending him in the face of an unprecedented number of scandals coming at us one after the other like hideous monsters in some non-stop computer game. And now looming is the monster of monsters, ObamaCare, the healthcare reform almost no one wanted and fewer understood. It will be administered by the Internal Revenue Service, an organization that has been revealed to be a kind of post-modern American Gestapo, asking not just to examine our accounting books but the books we read . What could be more totalitarian than that? Meanwhile, the Wall Street Journal warns the costs of ObamaCare are close to tripling what were promised , and the number of doctors in our country is rapidly diminishing. No more "My son, the doctor!" It doesn't pay. And young people most of all will not be able to afford escalating health insurance costs and will end up paying the fine to the IRS, simultaneously bankrupting the health system and enhancing the brutal power of the IRS - all this while unemployment numbers remain near historical highs. No one knows how many have given up looking for work while crony capitalist friends of the administration enrich themselves on mythological clean-energy projects. In fact, everywhere we look on this July Fourth sees a great civilization in decline. And much of that decline can be laid at the foot of the incumbent.   • Customers of Silent Circle’s encrypted mail service got an unfortunate surprise on Friday: all their messages had been deleted. The management  of Silent Circle, an encryption firm that specializes in smartphone communication, abruptly shut down their e-mail service yesterday, saying they were pre-empting the U.S. government from forcing them to hand over customer data. While they were confident they could protect text messages, voice calls and video calls, e-mail had always been less secure because it relied on standard Internet protocols. Yesterday’s catalyst was a competitor, Lavabit, whose founder announced he was shutting his email-hosting company down due to an apparent government investigation, and told Forbes on Friday: “If you knew what I knew about e-mail, you might not use it.” Edward Snowden had been a Lavabit user.

    Good interview with Phil Zimmerman, the inventor of PGP, and founder of Silent Circle eMail Service.  Which is being shut down because of the what the Feds did to LavaBit. What concerns me most about this illegal and systematic invasion of privacy is the massive potential for blackmail and extortion.  Think of what the IRS illegally did to tens of millions of Americans, targeting them because of their religious and political views, and seeking volumes of highly personal information far beyond reasonable requirements.   What happens when the politicians in power start using the IRS and NSA for political purposes - like what we just saw in the 2012 elections? When I was working on the wiki-Word and SurDoc projects, we were very concerned about having our documents and designs hosted or passing through competitor (Microsoft and Google) servers and email systems.  At the time I thought I was just being paranoid.  Now we know differently.  We had every reason to be concerned.

    "Here is another example of how this administration and Congress randomly decide which laws they like and which ones they don't. For those of us paying attention we remember that Sen. Chuck Grassley, (R-Iowa) added a clause into the original text of the Affordable Care Act that said members of Congress and their aides MUST be covered by plans created by the law or offered through an exchange. Before Obamacare, Congress and their staff were covered by a health care plan that was considered "golden".  This was being paid for by the taxpayers.  Under Obamacare and Grassley's provision, Congress and staff would be subject to the exact same treatment as the rest of us. In other words, if government payments stopped, lawmakers and their aides would have been looking at thousands of dollars in additional premium payments.  (Just like the rest of us.)  Before Obamacare, the government contributed almost 75% to their premium payments. When they finally got around to "finding out what was in the bill", Capitol Hill started wringing their hands and hyperventilating.  With Grassley's provision in there, that would mean that, gasp, they would have to live by the same rules as the rest of and they just could not let that happen. All sorts of complaints were being made. For instance, "staffers don't make enough money to pay those premiums"; or "they will look for more lucrative jobs" in order to afford them.  Really?  How about the rest of the American people out there?  Do you think that they can afford higher premiums on the part-time work that they now will be forced into because of employer cut-backs?  The best line came from Nancy Pelosi who said that if Congress lost these Capitol Hill workers, a "tremendous intellectual resource" would be lost.  You just have to shake your head in disbelief.   • The House Ways and Means Committee plans to send a letter to Attorney General Eric Holder saying former IRS executive Lois Lerner should be prosecuted for violating taxpayers’ rights, misleading investigators and disclosing taxpayers’ private information, a House aide said. The aide, who has knowledge of the letter, spoke on condition of anonymity before the panel’s scheduled vote tomorrow. Lerner, who retired from the U.S. Internal Revenue Service as director of exempt organizations, said at a congressional hearing last year that she has done nothing wrong and committed no crime.     excerpt: The fact that the wealthiest already pay their fair share and more is borne out by this from the IRS: Individuals earning in the top one percent paid 40 percent of all income taxes, while those in the top 10 percent paid 71 percent of all income taxes. The fact that going after the wealthiest for even more isn't going to generate significant additional revenues - certainly not enough to make a dent in the debt - isn't mentioned by the President in his letter. And if Obama is so determined to be "fair", why doesn't he simply offer to write a check to the IRS for the part of his income that he feels he doesn't deserve? He doesn't say. The President did get one thing right: The middle class is the target of any deficit-reduction plans likely to come out of Washington in the next few days: "It's just not right to ask them to pay the whole tab - especially when they're not the ones who caused this mess in the first place." He's right: The middle class didn't create the financial crisis; the Ruling Class did. Instead, the middle class, by and large, just want to be left alone to work out their own lives. Whenever possible, they resist further government intrusions into their lives - witness the growth of the Tea Party - and are waiting to see if Washington will, for the first time in memory, not listen to the siren song of entitlement protection and class warfare being sung by the President, and instead ignore him and start some serious cutting back of Leviathan. Luxembourg: a tax haven by any other name? | nsnbc international - 0 views

  • The revelations that global and multinational businesses have been brokering “secret” tax deals with Luxembourg to avoid paying taxes in their home countries, may be the first time an entire country has been implicated in tax avoidance collusion. A cache of leaked agreements uncovered by the International Consortium of Investigative Journalism (ICIJ) appears to show that major companies have used the tiny EU state to dramatically cut their tax liabilities.
  • The ICIJ’s six-month investigation claims to have found household companies such as Aviva, HSBC, E-on, Tyco, Pepsi, IKEA and Deutsche Bank were among those which had taken advantage of legal tax avoidance schemes in Luxembourg. Luxembourg is routinely named as a tax haven on many of the world’s authoritative lists of tax havens, including the one compiled by me and my two co-authors, Richard Murphy and Christian Chavagneux. But Luxembourg has managed to remain “under the radar” not least because its politicians and bankers have been denying for years that it is, or ever was, a tax haven. The revelations suggest Luxembourg has been playing a double game. Luxembourg has been quick to comply with new regulations proposed by the Organisation for Economic Co-operation and Development (OECD) and the EU. In 2011, the OECD global forum on transparency and exchange of information commended Luxembourg for introducing new rules governing banking information or information protected by secrecy rules.
  • But at the same time, the revelations show that 340 well-known foreign companies have entered into secret agreements with the Luxembourg authorities, brokered by the accounting firm PricewaterhouseCoopers. To take a random example that applies for many of these companies, the ICIJ have a letter to the Luxembourg tax administration written on a PwC letterhead, where FedEx lays down its plan to set up a limited liability company as a tax resident in Luxembourg – so subject in principle to Luxembourg’s corporate income tax. The letter then provides details of a proposed shareholding arrangement that will ensure, I quote, that “neither that Fedex SCS nor its shareholders will be subject to corporate income tax, Municipal Business Tax and Net Wealth tax in Luxembourg”. The letter implies that Luxembourg will serve in effect as a tax haven for Fedex.

  • There have been a number of other highly publicised tax evasion and avoidance cases recently. For instance, many cases in the US involved branches or even key individuals working in branches of well-known Swiss and Israeli banks in the US, including UBS, Credit Swiss or Bank Leumi, or alternatively branches of American banks in Switzerland. But these tended to involve private firms. The Swiss government professed to have had no knowledge of such activities. Indeed, Swiss law prohibited Swiss banks, whether domestic or international, from providing any information on their clients to the Swiss state. This is a scandal with a difference. The leaked PricewaterhouseCoopers books imply there has been systemic collusion between companies from all over the world and the Luxembourg authorities in flagrant contravention of EU rules. The documents suggest that preferential tax treatments were guaranteed to these companies prior to their incorporation in Luxembourg.
  • This is the first case of suspected collusion between a government and a foreign firm in tax avoidance matters that I am aware of. In that sense, the current scandal places Luxembourg on par with Greece whose officials allegedly provided misleading data on Greek national debt to the Commission. More embarrassingly, all this took place during the time when the current president of the European Commission, Jean-Claude Juncker, served as the prime minister of Luxembourg from 1995-2013. It is difficult to imagine that the prime minister of such a small state was unaware such deals were taking place. There is a difference between the court of law and the court of public opinion. But we know from recent cases that the EU Commission has tended to follow the court of public opinion with criminal investigations of its own, as was the case of Amazon. It is likely that the Commission will now investigate these leaks and may impose fines on Luxembourg. I doubt Juncker can ride this one out.

    "The American Left's desire to crush Liberty and dissent in order to "fundamentally transform the United States of America" has reached metastatic levels. In the last three weeks alone, the following stories have surfaced. All of which indicate we are well on our way toward relinquishing our birthright. Even worse, millions of Americans are apparently more than willing to do so. First, this week the Supreme Court heard arguments in the United States v. Texas case that will determine whether a president can unilaterally rewrite immigration law. If SCOTUS rules in Barack Obama's favor, the separation of powers outlined in the first three articles of the Constitution will be rendered moot and, as political analyst Charles Krauthammer wryly observed, "you can send Congress home." And the Left is not content to stop there. A coalition of 118 cities and counties have filed a legal brief asserting they will lose up to $800 million in economic benefits if large numbers of illegal aliens remain subject to deportation. Second, the IRS has admitted it abides the use of fraudulent Social Security numbers used by illegal aliens to process tax payments - and refunds. Third, in New York and California, Democratic attorneys general Eric Schneiderman and Kamala Harris are pursuing fraud investigations against Exxon, based on the premise they can "prosecute persons and institutions with nonconforming views on global warming," writes National Review's Kevin Williams. "Prosecuting political institutions and businesses for political activism is brown-shirt business." Fourth, the Obama administration, already under fire for its determination to flood America with Syrian "refugees," announced it will reduce its vetting process to three months, instead of 18-24 months.     I'll leave well enough alone on Mr. Ahert's positions regarding the U.S. v. Texas case and IRS reliance on fraudulent Social Security numbers; I have not studied those issues. But Mr. Ahert has not done his homework on the Exxon investigations and on the law governing the Syrian refugee situation. Re Exxon, the criminal investigations are to determine whether Exxon committed fraud against *investors* by concealing its knowledge of climate change the company was contributing to --- and knew of decades ago. We don't yet know the outcome of those investigations, but this is a far cry from prosecuting "persons and institutions with nonconforming views on global warming." If pursued, it will be a prosecution of a company -- and conceivably its managers -- who damned well knew through in-house scientific studies it sponsored that global warming was man-made and that their own company was a major causative agent. On the Syrian refugee situation, the right of war refugees to refuge in the U.S. and all other nations is, under the U.S. Constitution's Treaty Clause, "the law of this land." There is nothing in that body of international law created by treaty that permits the U.S. or any other nation to delay providing refuge for purposes of vetting refugees for possible terrorists among them. Vetting can, however, proceed lawfully after refugees are admitted while being held in refugee camps. One need only ask how one would feel were the tables turned and it was yourself fleeing from U.S. violence? Would you want to be forced to linger in the war zone while your anti-terrorism bona fides were established over a period of months? Refuge must be granted when it is needed, not months or years later, regardless of how much "terrorist" hysteria our mainstream media and the military-industrial complex drums up to fan the flames of war and industry profits. Losing public opinion on BDS, activists turn to 'lawfare' - 0 views

  •      Champions of proposed Senate Bill SB1761, which passed both houses of the Illinois General Assembly May 18th, say it’s designed to fight anti-Semitic activism and protects Israel from the existential threat posed by the Boycott, Divestment, & Sanctions movement (BDS). Opponents of the bill say it places the economic welfare of Israel before U.S. interests, tacitly endorses the full annexation of the West Bank into Israel, and violates our country’s First Amendment rights. The bill’s opponents are right. But a potential threat of this legislation, edging closer to the criminalization of advocating for Palestinian rights and against occupation, threatens our core First Amendment rights and has been relatively absent from the discourse surrounding this bill.
  • And that’s not just here in the United States. Israeli lawmakers sought to criminalize public support of boycotts against Israel back in 2010 through their “Law for Prevention of Damage to the State of Israel through Boycott.” When I spoke with a staffer for Illinois State Rep. Sara Feigenholtz, one of the bill’s primary sponsors, inquiring if SB1761 was modeled after the 1977 amendments to the Export Administration Act (regarding the Arab League boycott of Israel), I was informed “These ‘antiboycott’ laws are the 1977 amendments to the Export Administration Act (EAA) and the Ribicoff Amendment to the 1976 Tax Reform Act (TRA). I hope this helps.…SB1761 falls in line with these federal laws”
  • Referencing EAA is another indication of the move toward weakening our First Amendment rights, as that amendment was meant to criminalize people who adhered to the Arab League’s boycott of Israel. Melissa Redmiles writes of the 70’s legislation in International Boycott Reports, 2003 and 2004 (pdf), from the IRS.gov website: “Those U.S persons who agree to participate in such boycotts are subject to criminal and civil penalties.” SB1761 seems to be the latest manifestation of a trend toward enacting a kind of trickle-down suppression. From the Center For Constitutional Rights website for Palestine Solidarity Legal Support: “These bills must be opposed in order to protect the right to engage in boycotts that reflect collective action to address a human rights issue, which the US Supreme Court has declared is protected speech… These bills would make it state policy to discourage support of human rights boycotts against Israel… and have the potential to stifle expressions of political beliefs…”

  • SB1761 requires all five public retirement benefits systems of the Illinois Pension Code to divest “all direct holdings” from any company which engages in boycotting Israel. This is designed to financially punish companies which participate in BDS; presumably European companies. But it will also burden an already severely crippled,“worst in nation”, Illinois pension system. Illinois Governor Bruce Rauner was quoted by Jewish United Fund News (JUF) earlier this month as saying, “I made a pledge that Illinois would become the first state in America to divest its public pension funds from any company in the world that boycotts Israel.” Rauner includes U.S. companies in his threat of divestment when he says “any company in the world.”
  • Relatedly from SB1761 itself: “It is not the intent [of this bill]… to cause divestiture from any company based in the United States of America.” Not intended? This soft language clearly leaves the door open to require Illinois public retirement systems’ divestiture from U.S. companies that participate in BDS. So, while politicians endorsing this bill can point to this statement of “intent” as some kind of safeguard for American companies, this same sentence simultaneously functions as a veiled threat to those companies.
  • SB1761 characterizes the motivations of the BDS movement as “intending to penalize… Israel.” Similarly, JUF News this month quoted JUF President Steven B. Nasatir saying, “At the core of the BDS movement is a quest to delegitimize Israel as a Jewish state.” That’s like stating that the intent of the Civil Rights Montgomery bus boycott was to “penalize white people.

    As though ACLU didn't already have enough lawsuits going. But this takes the cake. Although anti-BDS legislation has been introduced several times in Congress but never got off the ground because of the First Amendment barrier. Similar measures pending in Europe too.  The good news here is that Israel's right-wing government is getting desperate. The BDS movement is mushrooming globally and routinely is achieving success in convincing companies (and recording artists, etc.) to pull out of Israel. More so in Europe, but BDS is off to a great start in the U.S. Kerry warned Netanyahu before the latter blew up the last round of negotations with the Palestinians that BDS would soon make it politically impossible for the U.S. to continue providing cover for Israel on the U.N. Security Council. There's a big shift of public opinion in the U.S. about Israel's abuse of Palestinians well under way. It won't be long before introducing Israel Lobby measures in Congress will stop happening.

  • (Reuters) - A U.S. soldier who deserted because he thought the Iraq war was illegal could have grounds for seeking asylum in Germany but only if he can show he would have been involved in war crimes, Europe's highest court said on Thursday.

    The European Court of Justice added that even if Andre Shepherd could prove war crimes were very likely to have been committed, he would still have to show he had no alternative to desertion, such as becoming a conscientious objector.

    The Luxembourg-based court was asked for guidance by a German court after Shepherd took legal action when German authorities rejected his asylum application.

     
     
     
     
     
     

    The final decision will be taken by the German court in accordance with the European court's ruling.

  • Shepherd, who served in Iraq between September 2004 and February 2005 as an Apache helicopter mechanic in the 412th Aviation Support Battalion, deserted in 2007 after being ordered to return to Iraq. He applied for asylum in Germany, where he was based. He remains in Germany."When I read and heard about people being ripped to shreds from machine guns or being blown to bits by the Hellfire missiles I began to feel ashamed about what I was doing," Shepherd told a news conference in Frankfurt in 2008."I could not in good conscience continue to serve," the army specialist from Cleveland, Ohio, said.Shepherd believed he should no longer participate in a war he considered unlawful and in war crimes he believed were committed in Iraq. He said he risked criminal prosecution in the United States because of his desertion.

Police Trained to Treat Keystone XL Protesters as 'Terrorists' (View TransCanada's Powe... - 0 views

But on Wednesday, environmental activists protesting the Keystone XL pipeline saw firsthand how much TransCanada, the corporation in charge of the pipeline, is shaking in its boots. Bold Nebraska, a grassroots landowner advocacy group, obtained TransCanada's presentation slides (below) via a Freedom of Information Act request to the Nebraska State Patrol. These slides revealed that TransCanada provided training to both federal and local police forces on how to crack down on environmental activists, even going so far as to train them to arrest the activists under anti-terrorism statutes.

    Well, now we know that it ain't just the IRS harrassing conservatives. This is all very reminiscent of the situation in the 80s, when New Right activists successfully prompted federal, state, and local police to investigate anti-herbicide activists as "marijuana growers" and touted a propaganda line that environmentalism was a plot funded by the KGB to overthrow the U.S. government. Unfortunately, there were too many Reagan Administration appointees who believed it. The result: a Presidential declaration of "War on Drugs" and a national surveillance program of environmental activists instigated under cover of that program.
