  • 37      It must be stated that the interference caused by Directive 2006/24 with the fundamental rights laid down in Articles 7 and 8 of the Charter is, as the Advocate General has also pointed out, in particular, in paragraphs 77 and 80 of his Opinion, wide-ranging, and it must be considered to be particularly serious. Furthermore, as the Advocate General has pointed out in paragraphs 52 and 72 of his Opinion, the fact that data are retained and subsequently used without the subscriber or registered user being informed is likely to generate in the minds of the persons concerned the feeling that their private lives are the subject of constant surveillance.
  • 43      In this respect, it is apparent from recital 7 in the preamble to Directive 2006/24 that, because of the significant growth in the possibilities afforded by electronic communications, the Justice and Home Affairs Council of 19 December 2002 concluded that data relating to the use of electronic communications are particularly important and therefore a valuable tool in the prevention of offences and the fight against crime, in particular organised crime. 44      It must therefore be held that the retention of data for the purpose of allowing the competent national authorities to have possible access to those data, as required by Directive 2006/24, genuinely satisfies an objective of general interest.45      In those circumstances, it is necessary to verify the proportionality of the interference found to exist.46      In that regard, according to the settled case-law of the Court, the principle of proportionality requires that acts of the EU institutions be appropriate for attaining the legitimate objectives pursued by the legislation at issue and do not exceed the limits of what is appropriate and necessary in order to achieve those objectives (see, to that effect, Case C‑343/09 Afton Chemical EU:C:2010:419, paragraph 45; Volker und Markus Schecke and Eifert EU:C:2010:662, paragraph 74; Cases C‑581/10 and C‑629/10 Nelson and Others EU:C:2012:657, paragraph 71; Case C‑283/11 Sky Österreich EU:C:2013:28, paragraph 50; and Case C‑101/12 Schaible EU:C:2013:661, paragraph 29).
  • 67      Article 7 of Directive 2006/24, read in conjunction with Article 4(1) of Directive 2002/58 and the second subparagraph of Article 17(1) of Directive 95/46, does not ensure that a particularly high level of protection and security is applied by those providers by means of technical and organisational measures, but permits those providers in particular to have regard to economic considerations when determining the level of security which they apply, as regards the costs of implementing security measures. In particular, Directive 2006/24 does not ensure the irreversible destruction of the data at the end of the data retention period.68      In the second place, it should be added that that directive does not require the data in question to be retained within the European Union, with the result that it cannot be held that the control, explicitly required by Article 8(3) of the Charter, by an independent authority of compliance with the requirements of protection and security, as referred to in the two previous paragraphs, is fully ensured. Such a control, carried out on the basis of EU law, is an essential component of the protection of individuals with regard to the processing of personal data (see, to that effect, Case C‑614/10 Commission v Austria EU:C:2012:631, paragraph 37).69      Having regard to all the foregoing considerations, it must be held that, by adopting Directive 2006/24, the EU legislature has exceeded the limits imposed by compliance with the principle of proportionality in the light of Articles 7, 8 and 52(1) of the Charter.

  • 58      Directive 2006/24 affects, in a comprehensive manner, all persons using electronic communications services, but without the persons whose data are retained being, even indirectly, in a situation which is liable to give rise to criminal prosecutions. It therefore applies even to persons for whom there is no evidence capable of suggesting that their conduct might have a link, even an indirect or remote one, with serious crime. Furthermore, it does not provide for any exception, with the result that it applies even to persons whose communications are subject, according to rules of national law, to the obligation of professional secrecy. 59      Moreover, whilst seeking to contribute to the fight against serious crime, Directive 2006/24 does not require any relationship between the data whose retention is provided for and a threat to public security and, in particular, it is not restricted to a retention in relation (i) to data pertaining to a particular time period and/or a particular geographical zone and/or to a circle of particular persons likely to be involved, in one way or another, in a serious crime, or (ii) to persons who could, for other reasons, contribute, by the retention of their data, to the prevention, detection or prosecution of serious offences.

  • 34      As a result, the obligation imposed by Articles 3 and 6 of Directive 2006/24 on providers of publicly available electronic communications services or of public communications networks to retain, for a certain period, data relating to a person’s private life and to his communications, such as those referred to in Article 5 of the directive, constitutes in itself an interference with the rights guaranteed by Article 7 of the Charter. 35      Furthermore, the access of the competent national authorities to the data constitutes a further interference with that fundamental right (see, as regards Article 8 of the ECHR, Eur. Court H.R., Leander v. Sweden, 26 March 1987, § 48, Series A no 116; Rotaru v. Romania [GC], no. 28341/95, § 46, ECHR 2000-V; and Weber and Saravia v. Germany (dec.), no. 54934/00, § 79, ECHR 2006-XI). Accordingly, Articles 4 and 8 of Directive 2006/24 laying down rules relating to the access of the competent national authorities to the data also constitute an interference with the rights guaranteed by Article 7 of the Charter. 36      Likewise, Directive 2006/24 constitutes an interference with the fundamental right to the protection of personal data guaranteed by Article 8 of the Charter because it provides for the processing of personal data.
  • 65      It follows from the above that Directive 2006/24 does not lay down clear and precise rules governing the extent of the interference with the fundamental rights enshrined in Articles 7 and 8 of the Charter. It must therefore be held that Directive 2006/24 entails a wide-ranging and particularly serious interference with those fundamental rights in the legal order of the EU, without such an interference being precisely circumscribed by provisions to ensure that it is actually limited to what is strictly necessary.66      Moreover, as far as concerns the rules relating to the security and protection of data retained by providers of publicly available electronic communications services or of public communications networks, it must be held that Directive 2006/24 does not provide for sufficient safeguards, as required by Article 8 of the Charter, to ensure effective protection of the data retained against the risk of abuse and against any unlawful access and use of that data. In the first place, Article 7 of Directive 2006/24 does not lay down rules which are specific and adapted to (i) the vast quantity of data whose retention is required by that directive, (ii) the sensitive nature of that data and (iii) the risk of unlawful access to that data, rules which would serve, in particular, to govern the protection and security of the data in question in a clear and strict manner in order to ensure their full integrity and confidentiality. Furthermore, a specific obligation on Member States to establish such rules has also not been laid down.
  • 60      Secondly, not only is there a general absence of limits in Directive 2006/24 but Directive 2006/24 also fails to lay down any objective criterion by which to determine the limits of the access of the competent national authorities to the data and their subsequent use for the purposes of prevention, detection or criminal prosecutions concerning offences that, in view of the extent and seriousness of the interference with the fundamental rights enshrined in Articles 7 and 8 of the Charter, may be considered to be sufficiently serious to justify such an interference. On the contrary, Directive 2006/24 simply refers, in Article 1(1), in a general manner to serious crime, as defined by each Member State in its national law.61      Furthermore, Directive 2006/24 does not contain substantive and procedural conditions relating to the access of the competent national authorities to the data and to their subsequent use. Article 4 of the directive, which governs the access of those authorities to the data retained, does not expressly provide that that access and the subsequent use of the data in question must be strictly restricted to the purpose of preventing and detecting precisely defined serious offences or of conducting criminal prosecutions relating thereto; it merely provides that each Member State is to define the procedures to be followed and the conditions to be fulfilled in order to gain access to the retained data in accordance with necessity and proportionality requirements.
  • 55      The need for such safeguards is all the greater where, as laid down in Directive 2006/24, personal data are subjected to automatic processing and where there is a significant risk of unlawful access to those data (see, by analogy, as regards Article 8 of the ECHR, S. and Marper v. the United Kingdom, § 103, and M. K. v. France, 18 April 2013, no. 19522/09, § 35).56      As for the question of whether the interference caused by Directive 2006/24 is limited to what is strictly necessary, it should be observed that, in accordance with Article 3 read in conjunction with Article 5(1) of that directive, the directive requires the retention of all traffic data concerning fixed telephony, mobile telephony, Internet access, Internet e-mail and Internet telephony. It therefore applies to all means of electronic communication, the use of which is very widespread and of growing importance in people’s everyday lives. Furthermore, in accordance with Article 3 of Directive 2006/24, the directive covers all subscribers and registered users. It therefore entails an interference with the fundamental rights of practically the entire European population. 57      In this respect, it must be noted, first, that Directive 2006/24 covers, in a generalised manner, all persons and all means of electronic communication as well as all traffic data without any differentiation, limitation or exception being made in the light of the objective of fighting against serious crime.
  • 62      In particular, Directive 2006/24 does not lay down any objective criterion by which the number of persons authorised to access and subsequently use the data retained is limited to what is strictly necessary in the light of the objective pursued. Above all, the access by the competent national authorities to the data retained is not made dependent on a prior review carried out by a court or by an independent administrative body whose decision seeks to limit access to the data and their use to what is strictly necessary for the purpose of attaining the objective pursued and which intervenes following a reasoned request of those authorities submitted within the framework of procedures of prevention, detection or criminal prosecutions. Nor does it lay down a specific obligation on Member States designed to establish such limits. 63      Thirdly, so far as concerns the data retention period, Article 6 of Directive 2006/24 requires that those data be retained for a period of at least six months, without any distinction being made between the categories of data set out in Article 5 of that directive on the basis of their possible usefulness for the purposes of the objective pursued or according to the persons concerned.64      Furthermore, that period is set at between a minimum of 6 months and a maximum of 24 months, but it is not stated that the determination of the period of retention must be based on objective criteria in order to ensure that it is limited to what is strictly necessary.
  • 52      So far as concerns the right to respect for private life, the protection of that fundamental right requires, according to the Court’s settled case-law, in any event, that derogations and limitations in relation to the protection of personal data must apply only in so far as is strictly necessary (Case C‑473/12 IPI EU:C:2013:715, paragraph 39 and the case-law cited).53      In that regard, it should be noted that the protection of personal data resulting from the explicit obligation laid down in Article 8(1) of the Charter is especially important for the right to respect for private life enshrined in Article 7 of the Charter.54      Consequently, the EU legislation in question must lay down clear and precise rules governing the scope and application of the measure in question and imposing minimum safeguards so that the persons whose data have been retained have sufficient guarantees to effectively protect their personal data against the risk of abuse and against any unlawful access and use of that data (see, by analogy, as regards Article 8 of the ECHR, Eur. Court H.R., Liberty and Others v. the United Kingdom, 1 July 2008, no. 58243/00, § 62 and 63; Rotaru v. Romania, § 57 to 59, and S. and Marper v. the United Kingdom, § 99).
  • 26      In that regard, it should be observed that the data which providers of publicly available electronic communications services or of public communications networks must retain, pursuant to Articles 3 and 5 of Directive 2006/24, include data necessary to trace and identify the source of a communication and its destination, to identify the date, time, duration and type of a communication, to identify users’ communication equipment, and to identify the location of mobile communication equipment, data which consist, inter alia, of the name and address of the subscriber or registered user, the calling telephone number, the number called and an IP address for Internet services. Those data make it possible, in particular, to know the identity of the person with whom a subscriber or registered user has communicated and by what means, and to identify the time of the communication as well as the place from which that communication took place. They also make it possible to know the frequency of the communications of the subscriber or registered user with certain persons during a given period. 27      Those data, taken as a whole, may allow very precise conclusions to be drawn concerning the private lives of the persons whose data has been retained, such as the habits of everyday life, permanent or temporary places of residence, daily or other movements, the activities carried out, the social relationships of those persons and the social environments frequented by them.
  • 32      By requiring the retention of the data listed in Article 5(1) of Directive 2006/24 and by allowing the competent national authorities to access those data, Directive 2006/24, as the Advocate General has pointed out, in particular, in paragraphs 39 and 40 of his Opinion, derogates from the system of protection of the right to privacy established by Directives 95/46 and 2002/58 with regard to the processing of personal data in the electronic communications sector, directives which provided for the confidentiality of communications and of traffic data as well as the obligation to erase or make those data anonymous where they are no longer needed for the purpose of the transmission of a communication, unless they are necessary for billing purposes and only for as long as so necessary.
  • On those grounds, the Court (Grand Chamber) hereby rules:Directive 2006/24/EC of the European Parliament and of the Council of 15 March 2006 on the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks and amending Directive 2002/58/EC is invalid.

Fairly read, paragraph 59 outlaws bulk collection of such records, i.e., it requires the equivalent of a judge-issued search warrant in the U.S. based on probable cause to believe that the particular individual's communications are a legitimate object of a search.  Note also that paragraph 67 effectively forbids transfer of any retained data outside the E.U. So a barrier for NSA sharing of data with GCHQ derived from communications NSA collects from EU communications traffic. Bye-bye, Big Data for GCHQ in the E.U.

Exit South Stream, enter Turk Stream - RT Op-Edge - 0 views

  • So the EU “defeated” Putin by forcing him to cancel the South Stream pipeline. Thus ruled Western corporate media. Nonsense. Facts on the ground spell otherwise. This “Pipelineistan” gambit will continue to send massive geopolitical shockwaves all across Eurasia for quite some time. In a nutshell, a few years ago Russia devised Nord Stream – fully operational – and South Stream – still a project – to bypass unreliable Ukraine as a gas transit nation. Now Russia devised a new deal with Turkey to bypass the “non-constructive” (Putin’s words) approach of the European Commission (EC). Background is essential to understand the current game. Five years ago I was following in detail Pipelineistan’s ultimate opera – the war between rival pipelines South Stream and Nabucco. Nabucco eventually became road kill. South Stream may eventually resurrect, but only if the EC comes to its senses (don’t bet on it.)
  • The 3,600 kilometer long South Stream should be in place by 2016, branching out to Austria and the Balkans/Italy. Gazprom owns 50 percent of it - along with Italy’s ENI (20 percent), French EDF (15 percent) and German Wintershall, a subsidiary of BASF (15 percent). As it stands these European energy majors are not exactly beaming – to say the least. For months Gazprom and the EC were haggling about a solution. But in the end Brussels predictably succumbed to its own. Russia still gets to build a pipeline under the Black Sea – but now redirected to Turkey and, crucially, pumping the same amount of gas South Stream would. Not to mention Russia gets to build a new LNG (liquefied natural gas) central hub in the Mediterranean. Thus Gazprom has not spent $5 billion in vain (finance, engineering costs). The redirection makes total business sense. Turkey is Gazprom’s second biggest customer after Germany. And much bigger than Bulgaria, Hungary, and Austria combined. Russia also advances a unified gas distribution network capable of delivering natural gas from anywhere in Russia to any hub alongside Russia’s borders.
  • And as if it was needed, Russia gets yet another graphic proof that its real growth market in the future is Asia, especially China – not a fearful, stagnated, austerity-devastated, politically paralyzed EU. The evolving Russia-China strategic partnership implies Russia as complementary to China, excelling in major infrastructure projects from building dams to laying out pipelines. This is business with a sharp geopolitical reach – not ideology-drenched politics.

  • Turkey also made a killing. It’s not only the deal with Gazprom; Moscow will build no less than Turkey’s entire nuclear industry, apart from increased soft power interaction (more trade and tourism). Most of all, Turkey is now increasingly on the verge of becoming a full member of the Shanghai Cooperation Organization (SCO); Moscow is actively lobbying for it. This means Turkey acceding to a privileged position as a major hub simultaneously in the Eurasian Economic Belt and of course the Chinese New Silk Road(s). The EU blocks Turkey? Turkey looks east. That’s Eurasian integration on the move. Washington has tried very hard to create a New Berlin Wall from the Baltics to the Black Sea to “isolate” Russia. Now comes yet another Putin judo/chess/go counterpunch – which the opponent never saw coming. And exactly across the Black Sea. A key Turkish strategic imperative is to configure itself as the indispensable energy crossroads from East to West – transiting everything from Iraqi oil to Caspian Sea gas. Oil from Azerbaijan already transits Turkey via the Bill Clinton/Zbig Brzezinski-propelled BTC (Baku-Tblisi-Ceyhan) pipeline. Turkey would also be the crossroads if a Trans-Caspian pipeline is ever built (slim chances as it stands), pumping natural gas from Turkmenistan to Azerbaijan, then transported to Turkey and finally Europe.
  • So what Putin’s judo/chess/go counterpunch accomplished with a single move is to have stupid EU sanctions once again hurt the EU. The German economy is already hurting badly because of lost Russia business. The EC brilliant “strategy” revolves around the EU’s so-called Third Energy Package, which requires that pipelines and the natural gas flowing inside them must be owned by separate companies. The target of this package has always been Gazprom – which owns pipelines in many Central and Eastern European nations. And the target within the target has always been South Stream.
  • Now it’s up to Bulgaria and Hungary – which, by the way, have always fought the EC “strategy” – to explain the fiasco to their own populations, and to keep pressing Brussels; after all they are bound to lose a fortune, not to mention get no gas, with South Stream out of the picture. So here’s the bottom line; Russia sells even more gas – to Turkey; and the EU, pressured by the US, is reduced to dancing like a bunch of headless chickens in dark Brussels corridors wondering what hit them. The Atlanticists are back to default mode – cooking up yet more sanctions while Russia is set to keep buying more and more gold.
  • This is not the endgame – far from it. In the near future, many variables will intersect. Ankara’s game may change – but that’s far from a given. President Erdogan – the Sultan of Constantinople – has certainly identified a rival Caliph, Ibrahim of ISIS/ISIL/Daesh fame, trying to steal his mojo. Thus the Sultan may flirt with mollifying his neo-Ottoman dreams and steer Turkey back to its previously ditched “zero problems with our neighbors” foreign policy doctrine. The House of Saud is like a camel in the Arctic. The House of Saud’s lethal game in Syria always boiled down to regime change so a Saudi-sponsored oil pipeline from Syria to Turkey might be built – dethroning the proposed, $10 billion Iran-Iraq-Syria “Islamic” pipeline. Now the Saudis see Russia about to supply all of Turkey’s energy needs – and then some. And “Assad must go” still won’t go.
  • US neo-cons are also sharpening their spears. As soon as early 2015 there may be a Ukrainian Freedom Act approved by the US Congress. Translation: Ukraine as a “major US non-NATO ally” which means, in practice, a NATO annexation. Next step; more turbo-charged neo-con provocation of Russia. A possible scenario is vassal/puppies such as Romania or Bulgaria – pressed by Washington – deciding to allow full access for NATO vessels into the Black Sea. Who cares this would violate the current Black Sea agreements that affect both Russia and Turkey? And then there’s a Rumsfeldian “known unknown”; how the weak Balkans will feel subordinated to the whims of Ankara. As much as Brussels keeps Greece, Bulgaria and Serbia in a strait jacket, in energy terms they will start depending on Turkey’s goodwill. For the moment, let’s appreciate the magnitude of the geopolitical shockwaves. There will be more, when we least expect them.

Dangerous Crossroads: US-NATO To Deploy Ground Troops, Conduct Large Scale Naval Exerci... - 0 views

  • The World is at a dangerous Crossroads. The Western military alliance is in an advanced state of readiness. And so is Russia. Russia is heralded as the “Aggressor”. US-NATO military confrontation with Russia is contemplated. Enabling legislation in the US Senate under “The Russian Aggression Prevention Act” (RAPA) has “set the US on a path towards direct military conflict with Russia in Ukraine.”  Any US-Russian war is likely to quickly escalate into a nuclear war, since neither the US nor Russia would be willing to admit defeat, both have many thousands of nuclear weapons ready for instant use, and both rely upon Counterforce military doctrine that tasks their military, in the event of war, to preemptively destroy the nuclear forces of the enemy. (See Steven Starr, Global Research, August 22, 2014) The Russian Aggression Prevention Act (RAPA) is the culmination of more than twenty years of US-NATO war preparations, which consist in the military encirclement of both Russia and China:
  • On July 24, in consultation with the Pentagon, NATO’s Europe commander General Philip Breedlove called for “stockpiling a base in Poland with enough weapons, ammunition and other supplies to support a rapid deployment of thousands of troops against Russia”.(RT, July 24, 2014). According to General Breedlove, NATO needs “pre-positioned supplies, pre-positioned capabilities and a basing area ready to rapidly accept follow-on forces”: “He plans to recommend placing supplies — weapons, ammunition and ration packs — at the headquarters to enable a sudden influx of thousands of Nato troops” (Times, August 22, 2014, emphasis added) Breedlove’s “Blitzkrieg scenario” is to be presented at NATO’s summit in Wales in early September, according to The London Times.  It is a “copy and paste” text broadly consistent with the  Russian Aggression Prevention Act (RAPA) which directs President Obama to:
  • “(1) implement a plan for increasing U.S. and NATO support for the armed forces of Poland, Estonia, Lithuania, and Latvia, and other NATO member-states; and (2) direct the U.S. Permanent Representative to NATO to seek consideration for permanently basing NATO forces in such countries.” (S.2277 — 113th Congress (2013-2014)) More generally, a scenario of military escalation prevails with both sides involved in extensive war games. In turn, the structure of US sponsored military alliances plays a crucial role in war planning. We are dealing with a formidable military force involving a global alliance of 28 NATO member states. In turn, the US as well as NATO have established beyond the “Atlantic Region” a network of bilateral military alliances with “partner” countries directed against Russia, China, Iran and North Korea.

  • t is worth noting that FLEETEX is one among several US-NATO naval war games directed against an unnamed enemy. In July, NATO conducted naval exercises in the Black sea, in an area contiguous to Russia’s maritime borders.
  • NATO’s “Breeze” formally hosted by Bulgaria took place from July 4 to July 13, with the participation of naval vessels from Greece, Italy, Romania, Turkey, the U.K. and the U.S. The underlying scenario was the “”destruction of enemy ships in the sea and organization of air defense of naval groups and coastal infrastructure.” The exercises were “aimed at improving the tactical compatibility and collaboration among naval forces of the alliance’s member states…” (See Atlantic Council , see also Russia, U.S. ships sail in competing Black Sea exercises, July 7, Navy Times 2014) Ironically, NATO’s July Black Sea games started on exactly the same day as those of the “unnamed enemy”[Russia], involving its Crimea Black sea fleet of some 20 war ships and aircraft:
  • Russia has made it clear they don’t welcome NATO’s presence in the Black Sea. Russia’s navy let it be known that it is following the exercises with reconnaissance aircraft and surveillance ships. “The aviation of the Black Sea Fleet is paying special attention to the missile cruiser USS Vella Gulf which, though not formally the flagship of the ‘Breeze’ exercises, effectively is leading them,” a Russian naval source told NTV. (Ibid)
  • Since 2006, the US has been building up its weapons arsenal in Poland on Russia’s Western border (Kalingrad). The deployment of US forces in Poland was initiated  in July 2010 (within 40 miles from the border), with a view to training Polish forces in the use of US made Patriot missiles. (Stars and Stripes, 23 July 2010). In recent developments, the Pentagon announced in early August the deployment of US troops and National Guard forces to Ukraine as part of a military training operation. US-NATO is also planning further deployments of ground forces (as described by NATO General Breedlove) in Poland, Latvia, Estonia and Lithuania as well as in Georgia and Azerbaijan on Russia’s southern border. These deployments which are envisaged in the draft text of the “Russian Aggression Prevention Act” (RAPA) (S.2277 — 113th Congress (2013-2014)) are also part of a NATO “defensive” strategy in the case of a “Russian invasion”: Russia’s annexation of Crimea and the conflict in eastern Ukraine have alarmed Latvia, Estonia and Lithuania – like Ukraine, former Soviet republics with Russian-speaking minorities.   • Deployment on Russia’s Southern border is to be coordinated under a three country agreement signed on August 22, 2014 by Turkey, Georgia and Azerbaijan: Following the trilateral meeting of Azerbaijani, Turkish and Georgian defense ministers, Tbilisi announced that the three countries are interested in working out a plan to strengthen the defense capability. “The representatives of the governments of these three countries start to think about working out a plan to strengthen the defense capability,” Alasania said, adding that this is in the interests of Europe and NATO.“Because, this transit route [Baku-Tbilisi-Kars] is used to transport the alliance’s cargo to Afghanistan,” he said.   • In the Far-east, Russia’s borders are also threatened by Obama’s “Pivot to Asia”. The “Pivot to Asia” from a military standpoint consists in extending US military deployments in the Asia-Pacific as well as harnessing the participation of Washington’s allies in the region, including Japan, South Korea and Australia. These countries have signed bilateral military cooperation agreements with Washington. As US allies, they are slated to be involved in Pentagon war plans directed against Russia, China and North Korea: Japan and South Korea are also both part of a grand U.S. military project involving the global stationing of missile systems and rapid military forces, as envisioned during the Reagan Administration.   • On August 12, the US and Australia signed a military agreement allowing for the deployment of US troops in Australia. This agreement is part of Obama’s Pivot to Asia: The U.S. and Australia signed an agreement Tuesday [August 12] that will allow the two countries’ militaries to train and work better together as U.S. Marines and airmen deploy in and out of the country. “This long-term agreement will broaden and deepen our alliance’s contributions to regional security,” U.S. Defense Secretary Chuck Hagel said Tuesday. He described the U.S.-Australia alliance as the “bedrock” for stability in the Asia-Pacific region.
  • Ironically, coinciding with the announcement of the US-Australia agreement (August 12), Moscow announced that it would be conducting naval exercises in the Kuril Islands of the Pacific Ocean (which are claimed by Japan): “Exercises began involving military units in the region, which have been deployed to the Kuril Islands,” Colonel Alexander Gordeyev, a spokesman for Russia’s Eastern Military District, told news agency Interfax.   • While this renewed East-West confrontation has mistakenly been labelled a “New Cold War”, none of the safeguards of The Cold War era prevail. International diplomacy has collapsed. Russia has been excluded from the Group of Eight (G-8), which has reverted to the G-7 (Group of Seven Nations). There is no “Cold War East-West dialogue” between competing superpowers geared towards avoiding military confrontation. In turn, the United Nations Security Council has become a de facto mouthpiece of the U.S. State Department. US-NATO will not, however, be able to win a conventional war against Russia, with the danger that military confrontation will lead to a nuclear war. In the post-Cold war era, however, nuclear weapons are no longer considered as a  “weapon of last resort” under the Cold War doctrine of “Mutual Assured Destruction” (MAD).  Quite the opposite. nuclear weapons are heralded by the Pentagon as “harmless to the surrounding civilian population because the explosion is underground”. In 2002, the U.S. Senate gave the green light for the use of nuclear weapons in the conventional war theater.  Nukes are part of the “military toolbox” to be used alongside conventional weapons.
  • When war becomes peace, the world is turned upside down.  In a bitter irony, nukes are now upheld by Washington as “instruments of peace”. In addition to nuclear weapons, the use of chemical weapons is also envisaged. Methods of non-conventional warfare are also contemplated by US-NATO including financial warfare, trade sanctions, covert ops, cyberwarfare, geoengineering and environmental modification technologies (ENMOD). But Russia also has  extensive capabilities in these areas.
  • The timeline towards war with Russia has been set. The Wales NATO venue on September 4-5, 2014 is of crucial importance. What we are dealing with is a World War III Scenario, which is the object of the Wales NATO Summit, hosted by Britain’s Prime Minister David Cameron. The agenda of this meeting has already been set by Washington, NATO and the British government. It requires, according to PM David Cameron in a letter addressed to heads of State and heads of government of NATO member states ahead of the Summit that: “Leaders [of NATO countries] must review NATO’s long term relationship with Russia at the summit in response to Russia’s illegal actions in Ukraine. UK Pilots In Syria Ordered To Shoot Down "Hostile" Russian Aircraft - 0 views

  • With tensions between the US and Russia escalating over the Syrian conflict, it appears the UK is more than willing to leap into the fray. According the Sunday Times, Royal Air Force (RAF) pilots have been given orders to shoot down Russian military jets operating in Syria if they feel that the Russian jets pose a threat: “[…] if a pilot is fired on or believes he is about to be fired on, he can defend himself.” The order, which is eerily reminiscent of the modus operandi of US police, comes days after UK Foreign Secretary Boris Johnson pushed for the UK to consider military options against the Russian-backed Assad regime in Syria over its controversial bombing campaign in Aleppo. UK/Russian relations have also been tested in recent weeks as the UK has joined the US in accusing Russia of not targeting ISIS and instead bombing civilian infrastructure. According to UK defense officials: “It took six days for Russia to strike any Isis targets at all. Their air strikes have included moderate opposition groups who have been fighting to defend their areas from Isis. Among the targets hit were three field hospitals.” However, the UK and the US have both been unable to show evidence or even name the civilian hospitals and infrastructure allegedly bombed by Russia and the Syrian government.

EU-US Personal Data Privacy Deal 'Cracked Beyond Repair' - 0 views

  • Privacy Shield is the proposed new deal between the EU and the US that is supposed to safeguard all personal data on EU citizens held on computer systems in the US from being subject to mass surveillance by the US National Security Agency. The data can refer to any transaction — web purchases, cars or clothing — involving an EU citizen whose data is held on US servers. Privacy groups say Privacy Shield — which replaces the Safe Harbor agreement ruled unlawful in October 2015 — does not meet strict EU standard on the use of personal data. Monique Goyens, Director General of the European Consumer Organization (BEUC) told Sputnik: “We consider that the shield is cracked beyond repair and is unlikely to stand scrutiny by the European Court of Justice. A fundamental problem remains that the US side of the shield is made of clay, not iron.”
  • The agreement has been under negotiation for months ever since the because the European Court of Justice ruled in October 2015 that the previous EU-US data agreement — Safe Harbor — was invalid. The issue arises from the strict EU laws — enshrined in the Charter of Fundamental Rights of the European Union — to the privacy of their personal data.
  • The Safe Harbor agreement was a quasi-judicial understanding that the US undertook to agree that it would ensure that EU citizens’ data on US servers would be held and protected under the same restrictions as it would be under EU law and directives. The data covers a huge array of information — from Internet and communications usage, to sales transactions, import and exports.

Russia Reports Discovery of Rebel-Held Chemical Weapons at Site of Idlib Gas Attack - 0 views

  • In the aftermath of yesterday’s chemical gas attack in Syria’s Idlib Province, numerous governments – including those that have funded and armed rebels in an attempt to overthrow the Syrian government – have accused the Syrian army of being primarily responsible for the attack, despite no independent confirmation of their claim and no investigation into who was truly responsible for the tragedy. As MintPress recently reported, the only information available regarding the attack so far has come from only two sources: the White Helmets and the Syrian Observatory for Human Rights. Both groups have strong ties to pro-interventionist governments that have armed and funded rebel groups and even have ties to al-Qaeda.
  • However, pro-interventionist elements in foreign governments and within the Syrian opposition seem disinterested in obtaining valid information, jumping on initial accusations from dubious sources to support long-standing efforts to destabilize and overthrow the Syrian government. Wednesday morning, while media outlets throughout the West ran headlines calling for foreign intervention in Syria with headlines like “We Must Not Look Away,” the Russian Defense Ministry announced a surprising discovery in Khan Sheikhoun the very township where the gas attack took place. Maj. Gen. Igor Konashenkov publicly stated Wednesday morning that a warehouse in the vicinity of Khan Sheikhoun had been destroyed as part of a Syrian Air Force airstrike conducted midday Tuesday, several hours after the gas attack. According to Konashenkov, the facility produced and stored shells that contained toxic gas, many of which had been delivered to Iraq and repeatedly used there by Daesh militants and other extremists. He also pointed out that the same weapons had been used by foreign-funded rebels in Aleppo in 2016 – a conclusion derived by the analysis of samples taken by Russian military experts. He also stated that the victims of yesterday’s gas attack displayed identical symptoms to those shown by victims of the Aleppo attack. Rebels operating in the area – all of which are allied with the al-Nusra Front and Ahrar al-Sham, both al-Qaeda affiliates – have rejected Konashenkov’s claims. Hasan Haj Ali, commander of the al-Nusra affiliate Free Idlib Army rebel group, told Reuters: “all the civilians in the area know that there are no military positions there, or places for the manufacture [of weapons]. The various factions of the opposition are not capable of producing these substances.”
  • However, it was proven back in 2013 that not only were the rebels capable of producing chemical weapons, but they had used them repeatedly in both Syria and Iraq. For instance, UN officials have confirmed that anti-Assad rebels were responsible for the 2013 sarin gas attack in Ghouta, another attack that was prematurely blamed on the Assad regime. In addition, Pulitzer Prize-winning journalist Seymour Hersh established in his 2014 piece “The Red Line and the Rat Line” that rebels have long had the capacity to carry out chemical weapon attacks and that countries such as Turkey and Saudi Arabia have supplied them with such weapons. Sria’s government, by contrast, no longer has chemical weapons, a fact established by the Organization for the Prohibition of Chemical Weapons (OPCW). The organization confirmed in 2016 that all Syrian government chemical weapons had been destroyed under their supervision per Assad’s affirmation of the International Chemical Weapons Convention three years prior. OPCW’s fact-finding mission, a joint effort with the United Nations, is still active within Syria and has yet to report its findings regarding Tuesday’s attack, according to a statement released Wednesday. In addition, questions have been raised regarding the information that has come from opposition sources regarding the gas attack in Idlib, particularly the now widely-shared images purporting to show victims of yesterday’s attack.

This has to raise questions.” While Western governments and the corporate media have already assured themselves of Assad’s guilt, this latest discovery – along with other notable evidence – suggests that the basis for this assumption is faulty at best. The warehouse was discovered less than a day prior to a UN Security Council emergency meeting over Tuesday’s gas attack, leading many pro-interventionist governments to suggest that Russia is merely trying to protect its ally from international criticism and retaliation. Though the timing could be construed as suspect, Assad – on the verge of reclaiming nearly all Syrian cities from the opposition – stands little to gain from using internationally banned weapons, while the increasingly desperate NATO-armed and funded rebels are the greatest beneficiaries from the renewed calls for foreign intervention in Syria following Tuesday’s attack. At the very least, this latest discovery of a chemical weapons warehouse demands that world leaders, pro-intervention and otherwise, must wait for a complete investigation of the incident before taking drastic action. As Antonopoulos noted: “Before the war cries begin and the denouncement of the government from high officials in power positions begin, time must be given so that all evidence can emerge.”

  • Russia’s parliament has approved President Putin’s request for the use of force inside neighboring Ukraine, as the latest neocon-approved “regime change” spins out of control and threatens to inflict grave damage on international relations, ex-CIA analyst Ray McGovern explains. By Ray McGovern Is “regime change” in Ukraine the bridge too far for the neoconservative “regime changers” of Official Washington and their sophomoric “responsibility-to-protect” (R2P) allies in the Obama administration? Have they dangerously over-reached by pushing the putsch that removed duly-elected Ukrainian President Viktor Yanukovych? Russian President Vladimir Putin has given an unmistakable “yes” to those questions – in deeds, not words. His message is clear: “Back off our near-frontier!”
  • Unless Obama is completely bereft of advisers who know something about Russia, it should have been a “known-known” (pardon the Rumsfeldian mal mot) that the Russians would react this way to a putsch removing Yanukovich. It would have been a no-brainer that Russia would use military force, if necessary, to counter attempts to use economic enticement and subversive incitement to slide Ukraine into the orbit of the West and eventually NATO. This was all the more predictable in the case of Ukraine, where Putin – although the bête noire in corporate Western media – holds very high strategic cards geographically, militarily, economically and politically.

  • There is one huge difference between Prague in 1968 and Kiev 2014. The “Prague Spring” revolution led by Dubcek enjoyed such widespread spontaneous popular support that it was difficult for Russian leaders Leonid Brezhnev and Aleksey Kosygin to argue plausibly that it was spurred by subversion from the West. Not so 45-plus years later. In early February, as violent protests raged in the Ukrainian capital of Kiev and the White House professed neutrality, U.S. State Department officials were, in the words of NYU professor emeritus of Russian studies Stephen Cohen, “plotting a coup d’état against the elected president of Ukraine.” We know that thanks to neocon prima donna Victoria Nuland, now Assistant Secretary of State for European Affairs, who seemed intent on giving new dimension to the “cookie-pushing” role of U.S. diplomats. Recall the photo showing Nuland in a metaphor of over-reach, as she reached deep into a large plastic bag to give each anti-government demonstrator on the square a cookie before the putsch. More important, recall her amateurish, boorish use of an open telephone to plot regime change in Ukraine with a fellow neocon, U.S. Ambassador Geoffrey Pyatt. Crass U.S. interference in Ukrainian affairs can be seen (actually, better, heard) in an intercepted conversation posted on YouTube on Feb. 4.
  • There was a surreal quality to President Obama’s remarks, several hours after Russian (or pro-Russian) troops took control of key airports and other key installations in the Crimea, which is part of Ukraine, and home to a large Russian naval base and other key Russian military installations. Obama referred merely to “reports of military movements taken by the Russian Federation inside of Ukraine” and warned piously that “any violation of Ukraine’s sovereignty and territorial integrity would be deeply destabilizing.” That Obama chose the subjunctive mood – when the indicative was, well, indicated – will not be lost on the Russians. Here was Obama, in his typically lawyerly way, trying to square the circle, giving a sop to his administration’s neocon holdovers and R2P courtiers, with a Milquetoasty expression of support for the new-Nuland-approved government (citing Biden’s assurances to old whatshisname/yatshisname). While Obama stuck to the subjunctive tense, Prime Minister Yatsenyuk appealed to Russia to recall its forces and “stop provoking civil and military resistance in Ukraine.” Obama’s comments seemed almost designed to sound condescending – paternalistic, even – to the Russians. Already into his second paragraph of his scripted remarks, the President took a line larded with words likely to be regarded as a gratuitous insult by Moscow, post-putsch.
  • “We’ve made clear that they [Russian officials] can be part of an international community’s effort to support the stability of a united Ukraine going forward, which is not only in the interest of the people of Ukraine and the international community, but also in Russia’s interest.” By now, Russian President Vladimir Putin is accustomed to Obama, Secretary of State John Kerry, National Security Adviser Susan Rice, et al. telling the Kremlin where its interests lie, and I am sure he is appropriately grateful. Putin is likely to read more significance into these words of Obama: “The United States will stand with the international community in affirming that there will be costs for any military intervention in Ukraine … and we will continue to coordinate closely with our European allies.”
  • There are bound to be fissures in the international community and in the Western alliance on whether further provocation in Ukraine is advisable. Many countries have much to lose if Moscow uses its considerable economic leverage over natural gas supplies, for example. And, aspiring diplomat though she may be, Victoria Nuland presumably has not endeared herself to the EC by her expressed “Fuck the EC” attitude. Aside from the most servile allies of the U.S. there may be a growing caucus of Europeans who would like to return the compliment to Nuland. After all does anyone other than the most extreme neocon ideologue think that instigating a civil war on the border of nuclear-armed Russia is a good idea? Or that it makes sense to dump another economic basket case, which Ukraine surely is, on the EU’s doorstep while it’s still struggling to get its own economic house in order? Europe has other reasons to feel annoyed about the overreach of U.S. power and arrogance. The NSA spying revelations – that continue, just like the eavesdropping itself does – seem to have done some permanent damage to transatlantic relationships.
  • In any case, Obama presumably knows by now that he pleased no one on Friday by reading that flaccid statement on Ukraine. And, more generally, the sooner he realizes that – without doing dumb and costly things – he can placate neither the neocons nor the R2P folks (naively well meaning though the latter may be), the better for everyone. In sum, the Nulands of this world have bit off far more than they can chew; they need to be reined in before they cause even more dangerous harm. Broader issues than Ukraine are at stake. Like it or not, the United States can benefit from a cooperative relationship with Putin’s Russia – the kind of relationship that caused Putin to see merit last summer in pulling Obama’s chestnuts out of the fire on Syria, for example, and in helping address thorny issues with Iran.

  • The US National Security Agency may have accessed computers within the Indian embassy in Washington and mission at the United Nations in New York as part of a huge clandestine effort to mine electronic data held by its south Asian ally.Documents released by the US whistleblower Edward Snowden also reveal the extent and aggressive nature of other NSA datamining exercises targeting India as recently as March of this year.The latest revelations – published in the Hindu newspaper – came as Manmohan Singh, the Indian prime minister, flew to Europe on his way to the US, where he will meet President Barack Obama.The NSA operation targeting India used two datamining tools, Boundless Informant and Prism, a system allowing the agency easy access to the personal information of non-US nationals from the databases of some of the world's biggest tech companies, including Apple, Google, Microsoft and Yahoo.
  • The largest amount of intelligence was gathered from Iran, with more than 14bn reports in that period, followed by 13.5bn from Pakistan. Jordan, one of America's closest Arab allies, came third with 12.7bn, Egypt fourth with 7.6bn and India fifth with 6.3bn.

  • The European Parliament has voted to suspend the sharing of financial data with the US, following allegations that citizens' data was spied on. The allegation forms part of leaked documents from whistleblower Edward Snowden. The vote is non-binding but illustrates MEPs' growing unease over how much data was shared with the US.
  • It comes a day after it was alleged that German Chancellor Angela Merkel's mobile phone calls were monitored. The European Parliament voted to suspend its Terrorist Finance Tracking Program (TFTP) agreement with the US, in response to the alleged tapping of EU citizens' bank data held by the Belgian company SWIFT. The agreement granted the US authorities access to bank data for terror-related investigations but leaked documents made public by whistleblower Edward Snowden allege that the global bank transfer network was the target of wider US surveillance. MEPs also want to launch a full inquiry into the alleged spying.
  • The row over exactly how much snooping was done on European citizens appears to be escalating. Germany has summoned the US ambassador in Berlin over the claims that the US monitored Mrs Merkel's mobile phone calls. Other leaders are also likely to want further clarification from Washington over the activities of its National Security Agency (NSA) in Europe.

  • Hardly discussed in the pre-vote campaigns were the Snowden NSA revelations; the shady negotiations between Washington and Brussels over a free trade agreement which will be a boon for US Big Business; and how the financial casino supervised by the European Central Bank, the IMF, and the European Commission (EC) will remain untouched, further ravaging the European middle classes. The anti-EU crowd performed very well in France, the UK, Denmark and Greece. Not so well in Italy and the Netherlands. The mainstream did relatively well in Germany and ultraconservative Spain – even though losing votes to small parties.

After all, their mantra is that “democracy” is only good for others (even Ukrainians…) but not for the EU; when the European flock of sheep votes, they should only be allowed to pick obscure Brussels-peddled and Brussels-approved treaties. Brussels, anyway, is bound to remain the Kafkaesque political epitome of centralized control and red tape run amok. No wonder the EU is breathlessly pivoting with itself as the global economy relentlessly pivots to Asia.
  • To believe that an EU under troika austerity will bail Kiev out of its massive outstanding debts is wishful thinking. The recipe - already inbuilt in the $17 billion IMF “rescue” package is, of course, austerity. Oligarchs will remain in control, while assorted plunderers are already lining up. Former US Secretary of State Madeleine Albright – for whom hundreds of thousands of Iraqi children were expendable – “observed” the elections, and most of all observed how to privatize Telecom Ukraine, as she is doing now with Telekom Kosovo. There’s no evidence Right Sector and Svoboda will cease to be crypto-fascist, racist and intolerant just because Poroshenko – the King of Ukrainian Chocolate – is now the president. By the way, his margin for maneuver is slim, as his own markets – not to mention some of his factories – are in Russia. Heavy industry and the weapons industry in eastern Ukraine depend on Russian demand. It would take at least a whopping $276 billion for the West to “stabilize” eastern Ukraine. The notion of the EU “saving” Ukraine is D.O.A.
  • Moscow, once again, just needs to do what it is doing: nothing. And make sure there will be no economic or political help unless a federalized – and Finlandized - Ukraine with strong regions sees the light of day. Even the Brookings Institution has reluctantly been forced to admit that the US neo-con gambit has failed miserably; there’s no Ukraine without Russian help.
  • Signs so far are mixed. Poroshenko said Ukraine could “possibly” become an EU member state by 2025 (it won’t happen). He ruled out entering NATO (wise move). He rejects federalization (dumb move). He believes that with a strong economy Crimea would want to be back (wishful thinking). Still, he believes in reaching a compromise with Moscow (that’s what Moscow always wanted, even before regime change).
  • Back in NATOstan, there’s the crucial point of what happens to the ultra-right-wing anti-EU brigade in the Parliament in Strasbourg. They may all abhor the EU, but the fact is this ideological basket case will hardly form an alliance.
  • What this ultimately means is that conservative and moderate parties, as per the status quo, will remain in control, expressed via an extremely likely coalition of the European People’s Party (center-right) and the Socialists and Democrats (center-left). What comes next, in the second half of 2014, is the appointment of a new EU Commission. That’s Kafka redux, as in the bureaucrat-infested executive arm of the EU, which shapes the agenda, sort of (when it’s not busy distributing subventions in color-coded folders for assorted European cows.) There are 5 candidates fighting for the position of EC president. According to the current EU treaty, member states have to consider the result of EU Parliament elections when appointing a new president. Germany wants a conservative. France and Italy want a socialist. So expect a tortuous debate ahead to find who will succeed the spectacularly mediocre Jose Manuel Barroso. The favorite is a right-winger of the European People’s Party, former Prime Minister of Luxembourg Jean-Claude Juncker. He is an avid defender of banking secrecy while posing himself as a champion of “market social economy.”
  • Then there’s more Kafka: choosing the new president of the EU Council and the High Representative for Foreign Affairs. Translation: the EU won’t decide anything, or “reform” anything for months. That includes the critical negotiations with the Americans over the free trade deal. It’s absolutely impossible to spin these Sunday elections as not discrediting even more the EU project as it stands. As I’ve seen for myself, since early 2014, in 5 among the top EU countries, what matters for the average citizen is as follows: how to deal with immigration; how to fight the eradication of the welfare state; the implications of the free trade agreement with the US; the value of the euro –including an absurdly high cost of living; and what the ECB mafia is actually doing to fight unemployment.
  • With Kafka in charge for the foreseeable future, what’s certain is that Paris and Berlin will drift further and further apart. There will be no redesign of the EU’s institutions. And the next Parliament, filled with sound and fury, will be no more than a hostage of the devastating, inexorable political fragmentation of Europe. “Saving” Ukraine? What a joke. Syria ready to unleash missiles on Israel | The Sunday Times - 0 views

  • SYRIA has put its most advanced missiles on standby with orders to hit Tel Aviv if Israel launches another raid on its territory. Reconnaissance satellites have been monitoring preparations by the Syrian army to deploy surface-to-surface Tishreen missiles. An Israeli official told The New York Times that Israel, which has launched three recent attacks on Syria, was considering further strikes and warned President Bashar al-Assad that his government would face “crippling consequences” if he hit back at Israel.
  • All parties fear hostilities spreading beyond Syria’s borders. Faisal al-Miqdad, Syria’s deputy foreign minister, said last week that the Israeli airstrikes represented “a declaration of war”.
  • Some Israeli defence experts believe that if Israel strikes again, Assad will have little choice but to retaliate. “The Tishreen missiles are extremely accurate and can cause serious harm,” said Uzi Rubin, Israel’s leading missile expert. He said Syria had large stocks of Tishreens. The penalties will add to already escalating costs for leading global lenders.   • Nearly fifty senior commanders of a major coalition of Islamic 'moderates' opposed to ISIS in Syria have been killed by an explosion at their secret command bunker as they met to discuss strategy against the the Islamic State. The blast in the Northwest region of Idlib, Syria on Tuesday killed senior members of rebel group the Ahrar-al-Sham brigade (AaS), including leader Hassan Abboud and 45 others including senior members from other rebel alliance groups, reports The Times. The Idlib region stands in AaS territory, but it is close to the front-line with ISIS in neighbouring Aleppo. Sources dispute the source of the blast, with it being unclear whether it was an opposition group, suicide bomber, or accidental explosion at a nearby ammunition dump. Regardless, the incident will destabilise and possibly tear apart the AaS group and associated Islamic Front Coalition which was recently described as "the most powerful armed group in Syria". Islamic group Ahrar-al-Sham, whose name translates as 'The Free Men of Syria', is one of many movements competing in the inter-rebel conflict in Syria. A number of rebel groups are presently fighting each other as well as besieged Syrian President Bashar al-Assad, whose power base is in West and South-West, for overall control of the Region.
  • As the main rival to ISIS for control of Syria, the AaS blast if not orchestrated by the Islamic State will certainly be greatly beneficial to them. The 'decapitation' strategy, targeting Ahrar-al-Sham’s political, military and spiritual leadership is reminiscent of the United States’ targeted strikes against the leadership of Al-Qaeda. The death of Abboud and his followers in Idlib highlights the difficulty of Western involvement in the conflict, where enemies of the apparent first enemy ISIS also make fairly poor potential allies. Many members of AaS have come from groups like Al-Qaeda and would in any other context be considered hard line Islamists. The Ahrar-al-Sham brigade has also been extremely critical of Western involvement in the conflict. In an interview before his death leader Abboud rejected the Geneva peace conference saying: "We see Geneva as a tool of manipulation; to derail the Syrian revolution away from its goals and objectives .... Whatever outcome the conference may yield, will be binding on the Syrian National Coalition only. For us, we will continue to fight for our revolution until we restore our rights”. Ahrar-al-Sham has appointed a new leader, Hashim al-Sheikh, who will attempt to hold together the fragile coalition which has lost most of its senior thinkers and strategists. al-Sheik said the attack "will only make us more resilient to fight and continue the fight until we liberate our homeland" on Wednesday.

  • Every year on 15 September, thousands of Salvadorans celebrate the date when much of Central America gained independence from Spain. Fireworks are set off and marching bands parade through villages across the country. But, last year, in the town of San Isidro, in Cabañas, the festivities had a markedly different tone. Hundreds had gathered to protest against the mine. Gold mines often use cyanide to separate gold from ore, and widespread concern over already severe water contamination in El Salvador has helped fuel a powerful movement determined to keep the country’s minerals in the ground. In the central square, colourful banners were strung up, calling on OceanaGold to drop its case against the country and leave the area. Many were adorned with the slogan, “No a la mineria, Si a la vida” (No to mining, Yes to life). On the same day, in Washington DC, Parada gathered his notes and shuffled into a suite of nondescript meeting rooms in the World Bank’s J building, across the street from its main headquarters on Pennsylvania Avenue. This is the International Centre for the Settlement of Investment Disputes (ICSID): the primary institution for handling the cases that companies file against sovereign states. (The ICSID is not the sole venue for such cases; there are similar forums in London, Paris, Hong Kong and the Hague, among others.) The date of the hearing was not a coincidence, Parada said. The case has been framed in El Salvador as a test of the country’s sovereignty in the 21st century, and he suggested that it should be heard on Independence Day. “The ultimate question in this case,” he said, “is whether a foreign investor can force a government to change its laws to please the investor as opposed to the investor complying with the laws they find in the country.”
  • Most international investment treaties and free-trade deals grant foreign investors the right to activate this system, known as investor-state dispute settlement (ISDS), if they want to challenge government decisions affecting their investments. In Europe, this system has become a sticking point in negotiations over the controversial Transatlantic Trade and Investment Partnership (TTIP) deal proposed between the European Union and the US, which would massively extend its scope and power and make it harder to challenge in the future. Both France and Germany have said that they want access to investor-state dispute settlement removed from the TTIP treaty currently under discussion. Investors have used this system not only to sue for compensation for alleged expropriation of land and factories, but also over a huge range of government measures, including environmental and social regulations, which they say infringe on their rights. Multinationals have sued to recover money they have already invested, but also for alleged lost profits and “expected future profits”. The number of suits filed against countries at the ICSID is now around 500 – and that figure is growing at an average rate of one case a week. The sums awarded in damages are so vast that investment funds have taken notice: corporations’ claims against states are now seen as assets that can be invested in or used as leverage to secure multimillion-dollar loans. Increasingly, companies are using the threat of a lawsuit at the ICSID to exert pressure on governments not to challenge investors’ actions.

  • The quiet village of Moorburg in Germany lies just across the river from Hamburg. Past the 16th-century church and meadows rich with wildflowers, two huge chimneys spew a steady stream of thick, grey smoke into the sky. This is Kraftwerk Moorburg, a new coal-fired power plant – the village’s controversial next-door neighbour. In 2009, it was the subject of a €1.4bn investor-state case filed by Vattenfall, the Swedish energy giant, against the Federal Republic of Germany. It is a prime example of how this powerful international legal system, built to protect foreign investors in developing countries, is now being used to challenge the actions of European governments as well. Since the 1980s, German investors have sued dozens of countries, including Ghana, Ukraine and the Philippines, at the World Bank’s Centre in Washington DC. But with the Vattenfall case, Germany found itself in the dock for the first time. The irony was not lost on those who considered Germany to be the grandfather of investor-state arbitration: it was a group of German businessmen, in the late 1950s, who first conceived of a way to protect their overseas investments as a wave of developing countries gained independence from European colonial powers. Led by Deutsche Bank chairman Hermann Abs, they called their proposal an “international magna carta” for private investors.
  • In the 1960s, the idea was taken up by the World Bank, which said that such a system could help the world’s poorer countries attract foreign capital. “I am convinced,” the World Bank president George Woods said at the time, “that those … who adopt as their national policy a welcome [environment] for international investment – and that means, to mince no words about it, giving foreign investors a fair opportunity to make attractive profits – will achieve their development objectives more rapidly than those who do not.” At the World Bank’s 1964 annual meeting in Tokyo, it approved a resolution to set up a mechanism for handling investor-state cases. The first line of the ICSID Convention’s preamble sets out its goal as “international cooperation for economic development”. There was sharp opposition to this system from its inception, with a bloc of developing countries warning that it would undermine their sovereignty. A group of 21 countries – almost every Latin American country, plus Iraq and the Philippines – voted against the proposal in Tokyo. But the World Bank moved ahead regardless. Andreas Lowenfeld, an American legal academic who was involved in some of these early discussions, later remarked: “I believe this was the first time that a major resolution of the World Bank had been pressed forward with so much opposition.”
  • now governments are discovering, too late, the true price of that confidence. The Kraftwerk Moorburg plant was controversial long before the case was filed. For years, local residents and environmental groups objected to its construction, amid growing concern over climate change and the impact the project would have on the Elbe river. In 2008, Vattenfall was granted a water permit for its Moorburg project, but, in response to local pressure, local authorities imposed strict environmental conditions to limit the utility’s water usage and its impact on fish. Vattenfall sued Hamburg in the local courts. But, as a foreign investor, it was also able to file a case at the ICSID. These environmental measures, it said, were so strict that they constituted a violation of its rights as guaranteed by the Energy Charter Treaty, a multilateral investment agreement signed by more than 50 countries, including Sweden and Germany. It claimed that the environmental conditions placed on its permit were so severe that they made the plant uneconomical and constituted acts of indirect expropriation.
  • With the rapid growth in these treaties – today there are more than 3,000 in force – a specialist industry has developed in advising companies how best to exploit treaties that give investors access to the dispute resolution system, and how to structure their businesses to benefit from the different protections on offer. It is a lucrative sector: legal fees alone average $8m per case, but they have exceeded $30m in some disputes; arbitrators’ fees at start at $3,000 per day, plus expenses.
  • Vattenfall v Germany ended in a settlement in 2011, after the company won its case in the local court and received a new water permit for its Moorburg plant – which significantly lowered the environmental standards that had originally been imposed, according to legal experts, allowing the plant to use more water from the river and weakening measures to protect fish. The European Commission has now stepped in, taking Germany to the EU Court of Justice, saying its authorisation of the Moorburg coal plant violated EU environmental law by not doing more to reduce the risk to protected fish species, including salmon, which pass near the plant while migrating from the North Sea. A year after the Moorburg case closed, Vattenfall filed another claim against Germany, this time over the federal government’s decision to phase out nuclear power. This second suit – for which very little information is available in the public domain, despite reports that the company is seeking €4.7bn from German taxpayers – is still ongoing. Roughly one third of all concluded cases filed at the ICSID are recorded as ending in “settlements”, which – as the Moorburg dispute shows – can be very profitable for investors, though their terms are rarely fully disclosed.
  • “It was a total surprise for us,” the local Green party leader Jens Kerstan laughed, in a meeting at his sunny office in Hamburg last year. “As far as I knew, there were some [treaties] to protect German companies in the [developing] world or in dictatorships, but that a European company can sue Germany, that was totally a surprise to me.”
  • While a tribunal cannot force a country to change its laws, or give a company a permit, the risk of massive damages may in some cases be enough to persuade a government to reconsider its actions. The possibility of arbitration proceedings can be used to encourage states to enter into meaningful settlement negotiations.
  • A small number of countries are now attempting to extricate themselves from the bonds of the investor-state dispute system. One of these is Bolivia, where thousands of people took to the streets of the country’s third-largest city, Cochabamba, in 2000, to protest against a dramatic hike in water rates by a private company owned by Bechtel, the US civil engineering firm. During the demonstrations, the Bolivian government stepped in and terminated the company’s concession. The company then filed a $50m suit against Bolivia at the ICSID. In 2006, following a campaign calling for the case to be thrown out, the company agreed to accept a token payment of less than $1. After this expensive case, Bolivia cancelled the international agreements it had signed with other states giving their investors access to these tribunals. But getting out of this system is not easily done. Most of these international agreements have sunset clauses, under which their provisions remain in force for a further 10 or even 20 years, even if the treaties themselves are cancelled.
  • There are now thousands of international investment agreements and free-trade acts, signed by states, which give foreign companies access to the investor-state dispute system, if they decide to challenge government decisions. Disputes are typically heard by panels of three arbitrators; one selected by each side, and the third agreed upon by both parties. Rulings are made by majority vote, and decisions are final and binding. There is no appeals process – only an annulment option that can be used on very limited grounds. If states do not pay up after the decision, their assets are subject to seizure in almost every country in the world (the company can apply to local courts for an enforcement order).
  • While there is no equivalent of legal aid for states trying to defend themselves against these suits, corporations have access to a growing group of third-party financiers who are willing to fund their cases against states, usually in exchange for a cut of any eventual award.
  • Increasingly, these suits are becoming valuable even before claims are settled. After Rurelec filed suit against Bolivia, it took its case to the market and secured a multimillion-dollar corporate loan, using its dispute with Bolivia as collateral, so that it could expand its business. Over the last 10 years, and particularly since the global financial crisis, a growing number of specialised investment funds have moved to raise money through these cases, treating companies’ multimillion-dollar claims against states as a new “asset class”.
  • El Salvador has already spent more than $12m defending itself against Pacific Rim, but even if it succeeds in beating the company’s $284m claim, it may never recover these costs. For years Salvadoran protest groups have been calling on the World Bank to initiate an open and public review of ICSID. To date, no such study has been carried out. In recent years, a number of ideas have been mooted to reform the international investor-state dispute system – to adopt a “loser pays” approach to costs, for example, or to increase transparency. The solution may lie in creating an appeals system, so that controversial judgments can be revisited.

    "Luis Parada's office is just four blocks from the White House, in the heart of K Street, Washington's lobbying row - a stretch of steel and glass buildings once dubbed the "road to riches", when influence-peddling became an American growth industry. Parada, a soft-spoken 55-year-old from El Salvador, is one of a handful of lawyers in the world who specialise in defending sovereign states against lawsuits lodged by multinational corporations. He is the lawyer for the defence in an obscure but increasingly powerful field of international law - where foreign investors can sue governments in a network of tribunals for billions of dollars. Fifteen years ago, Parada's work was a minor niche even within the legal business. But since 2000, hundreds of foreign investors have sued more than half of the world's countries, claiming damages for a wide range of government actions that they say have threatened their profits. In 2006, Ecuador cancelled an oil-exploration contract with Houston-based Occidental Petroleum; in 2012, after Occidental filed a suit before an international investment tribunal, Ecuador was ordered to pay a record $1.8bn - roughly equal to the country's health budget for a year. (Ecuador has logged a request for the decision to be annulled.)   • The European Commission plans to unify data protection within the European Union (EU) with a single law, the General Data Protection Regulation (GDPR). The current EU Data Protection Directive 95/46/EC does not consider important aspects like globalization and technological developments like social networks and cloud computing sufficiently and new guidelines for data protection and privacy were required. Therefore a proposal for the regulation has been released on 25 January 2012. The adoption is aimed for in 2014 and the regulation is planned to take effect in 2016 after a transition period of 2 years.

Saudi Prince Threatens 'Military Action Without American Support' Against Iran | MRCTV - 0 views

  • In the first public criticism of the P5+Iran deal by a member of the Saudi Arabian royal family, Prince Bandar bin Sultan told Lebanon’s Daily Star the deal would allow Iran to acquire a nuclear bomb and would “wreak havoc in the region." Covered in The Times of London, the prince also told Daily Star, "Saudi Arabia and the Gulf powers are prepared to take military action without American support after the Iran nuclear deal" Iran and Saudi Arabia are the two leading players in the Sunni/Shia divide and are competing for leadership of the Muslim world. The Sunni Islam Saudi Arabian monarchy fears that the Shia Islam Iranians will employ terrorists in an attempt topple the monarchy and the ruling House of Saud.  Prince Bandar was the Saudi ambassador to Washington for 20 years before returning home to run the country’s intelligence service from 2005-2014. While he is no longer a part of the inner ring of Saudi decision-making, the prince is still a very connected member of the ruling family. The prince would not be conducting interviews without the permission of highest authorities; most likely he was asked to to put himself out there by his uncle King Salman.
  • The Prince also said that regional powers have lost faith in America: “People in my region now are relying on God’s will, and consolidating their local capabilities and analysis with everybody else except our oldest and most powerful ally” The prince was less polite in an op-ed he wrote for the London-based Arabic news Web site Elaph. He compared the Iran nuclear deal made by Obama to the North Korean nuclear deal Bill Clinton made.  Bandar suggested that they were both bad deals but Clinton made a bad deal with the best of intentions thinking it was a good deal. Obama on the other hand knew he was making a lousy deal and made it anyway.  Quoted in a Washington Post article which translated part of the Elaph piece: Bandar says [about the North Korean pact], "it turned out that the strategic foreign policy analysis was wrong and there was a major intelligence failure." He added that if Clinton had known the full picture, "I am absolutely confident he would not have made that decision."
  • The Saudi royal then contrasts this with the present situation with Iran, "where the strategic foreign policy analysis, the national intelligence information, and America’s allies in the region's intelligence all predict not only the same outcome of the North Korean nuclear deal but worse – with the billions of dollars that Iran will have access to." Bandar says Obama is smart enough to understand this but that he is ideologically willing to accept collateral damage because he believes he is right. (..)The Saudi prince says the new Iran deal and other developments in the region have led him to conclude that a phrase first used by Henry Kissinger – “America’s enemies should fear America, but America’s friends should fear America more" – is correct.

    The more interesting issue to me is the accusation that Google violates antitrust law by boosting its comparison shopping search results in its search results, unfairly disadvantaging competing shopping services and not delivering best results to users. What's interesting to me is that the Commission is attempting to portray general search as a separate market from comparison shopping search, accusing Google of attempting to leverage its general search monopoly into the separate comoparison shopping search market. At first blush, Iim not convinced that these are or should be regarded as separable markets. But the ramifications are enormous. If that is a separate market, then arguably so is Google's book search, its Google Scholar search, its definition search, its site search, etc. It isn't clear to me how one might draw a defensible line taht does not also sweep in every new search feature  as a separate market.

Julian Assange set to be cleared as sex allegations expire - Telegraph - 0 views

  • ulian Assange is expected to be cleared of three sexual assault claims next week after spending so long in hiding in Britain that the allegations have expired, it has emerged. The Wikileaks founder has been seeking refuge at the Ecuadorian embassy in London for more than three years at a cost to the taxpayer of around £12 million.
  • Within a week, three of the four claims he faces will have reached their five year expiry date under Sweden’s statute of limitations. As a result Mr Assange, 44, is due to be cleared, Swedish prosecutors told the Times.
  • Mr Assange, who denies the sex claims, fears that he will be extradited on to the US to face charges relating to the huge leaks of sensitive data.
