Israeli Prime Minister Binyamin Netanyahu, under extreme pressure over the real possibility that he will lose the March 17 elections, has made a powerful appeal to his far right wing constituency by openly admitting that he will never allow a Palestinian state and that he intends to flood Israeli squatters into East Jerusalem and its environs to make sure this Occupied territory never returns to the Palestinians.Millions of Palestinians whose families were violently expelled from their homes by Jewish settlers in Mandate Palestine in 1947-48 remain stateless. These include the people of Gaza, the West Bank (four million) and a million or more in diasporas in Lebanon, Syria, and other countries. A million Palestinians are now citizens in Israel, and others have rights of citizenship in far-flung places like Chile and Honduras, as well as the United States. But I figure five million at least remain stateless.

Statelessness is rare in today’s world, a result of reforms initiated by the international community after the horrors of World War II and its preceding decades. Franco rendered many on the Spanish Left stateless after his victory in the Civil War in 1939 (not to mention massacring tens of thousands of them). The White Russians lost citizenship after their revolt against the Communists failed. The Nazis took citizenship rights away from Jews, Gypsies and others in Europe. In fact, the Holocaust was made practically possible in part by the denial of citizenship to Jews, which left them with no access to courts or other levers of social power that might have combated the monstrous Nazi plans for genocide. Millions were stateless in the 1930s and 1940s, and their lack of citizenship rights often exposed them to ethnic cleansing or loss of property and displacement.

The Palestinians are the last major stateless population. Stateless people do not have rights as most people understand the term. Their situation in some ways resembles slavery, since slaves also were denied the rights of citizenship. Stateless people’s property is insecure, since people with citizenship rights have better access to courts and to ruling authorities. Palestinians never really know what they own, and Israeli squatters routinely steal their property with impunity. Squatters dig tube wells deeper than those of the Palestinian villagers, lowering aquifers and causing Palestinian wells to dry up. Squatters go on wilding attacks, chopping down entire olive orchards (a prime source of Palestinian income) or beating up Palestinians. If Palestinians assemble peacefully to protest the loss of their farms to ever-expanding squatter settlements, the Israel army arrests them, including, often, children, who are taken away from their families and put in jail. Palestinians can be held for long periods without being charged. The prisoners are sometimes tortured.

The Federal Chief Information Officers (CIO) Council has won the infamous Rosemary Award for worst open government performance of 2014, according to the citation published today by the National Security Archive at www.nsarchive.org. The National Security Archive had hoped that awarding the 2010 Rosemary Award to the Federal Chief Information Officers Council for never addressing the government's "lifetime failure" of saving its e-mail electronically would serve as a government-wide wakeup call that saving e-mails was a priority. Fallout from the Hillary Clinton e-mail debacle shows, however, that rather than "waking up," the top officials have opted to hit the "snooze" button. The Archive established the not-so-coveted Rosemary Award in 2005, named after President Nixon's secretary, Rose Mary Woods, who testified she had erased 18-and-a-half minutes of a crucial Watergate tape — stretching, as she showed photographers, to answer the phone with her foot still on the transcription pedal. Bestowed annually to highlight the lowlights of government secrecy, the Rosemary Award has recognized a rogue's gallery of open government scofflaws, including the CIA, the Treasury Department, the Air Force, the FBI, the Justice Department, and Director of National Intelligence James Clapper.

Chief Information Officer of the United States Tony Scott was appointed to lead the Federal CIO Council on February 5, 2015, and his brief tenure has already seen more references in the news media to the importance of maintaining electronic government records, including e-mail, and the requirements of the Federal Records Act, than the past five years. Hopefully Mr. Scott, along with Office of Management & Budget Deputy Director for Management Ms. Beth Cobert will embrace the challenge of their Council being named a repeat Rosemary Award winner and use it as a baton to spur change rather than a cross to bear.

The Obama Administration has been pursuing a policy of covert support for the Muslim Brotherhood and other insurgent movements in the Middle East since 2010.  MEB has obtained a just-released U.S. State Department document through a Freedom of Information Act lawsuit that confirms the Obama Administration’s pro-active campaign for regime change throughout the Middle East and North Africa region. The October 22, 2010 document, titled “Middle East Partnership Initiative: Overview,” spells out an elaborate structure of State Department programs aimed at directly building “civil society” organizations, particularly non-governmental organizations (NGOs), to alter the internal politics of the targeted countries in favor of U.S. foreign policy and national security objectives. The five-page document, while using diplomatic language, makes clear that the goal is promoting and steering political change in the targeted countries:  “The Middle East Partnership Initiative (MEPI) is a regional program that empowers citizens in the Middle East and North Africa to develop more pluralistic, participatory, and prosperous societies.  As the figures in this overview illustrate, MEPI has evolved from its origins in 2002 into a flexible, region-wide tool for direct support to indigenous civil society that mainstreams that support into the daily business of USG diplomacy in the region.  MEPI engages all the countries of the NEA region except Iran.  In the seven of NEA’s eighteen countries and territories with USAID missions, country-level discussions and communication between MEPI and USAID in Washington ensure that programming efforts are integrated and complementary.”

According to the October 2010 document, the Deputy Chief of Mission (DCM) at every U.S. embassy in the MENA (Middle East/North Africa) is in charge of the MEPI program, giving it a clear high priority.  The document makes clear that the Middle East Partnership Initiative is not coordinated with host governments:  “MEPI works primarily with civil society, through NGO implementers based in the United States and in the region.  MEPI does not provide funds to foreign governments, and does not negotiate bilateral assistance agreements.  As a regional program, MEPI can shift funds across countries and to new issue-areas as needed.” The document makes clear that special priority, as early as 2010, was given to Yemen, Saudi Arabia, Tunisia, Egypt and Bahrain, and that project headquarters in Abu Dhabi and Tunis were overall coordinating centers for the entire regional program.  Within a year of its inception, Libya and Syria were added to the list of countries on the priority list for civil society intervention.

The State Department document was released as part of an FOIA suit focused on Presidential Study Directive 11, which remains classified “secret” and has not yet been released to the public.  According to MEB sources, PSD-11 spelled out the Obama Administration’s plans to support the Muslim Brotherhood and other allied “political Islam” movements believed at the time to be compatible with U.S. foreign policy objectives in the region.

Attorneys for a Canadian man who spent a decade detained by the United States military at Guantanamo Bay say details in the Obama administration’s recently released “drone memo” exonerates their client of war crimes.

But in a recent court filing [PDF], lawyers for Khadr, now 27, say a just-published US Department of Justice memorandum contains information that directly challenges the American government’s case against their client. Khadr’s attorneys wrote this week that the secret “drone memo” released by the White House last month — the DOJ document that the government relied on to justify the 2010 drone strike in Yemen that killed American citizen and suspected AL-Qaeda member Anwar Al-Awlaki — suggests prosecutors had no place to charge the Canadian teenager with murder in violation of the laws of war after he allegedly killed an American soldier during a firefight in Afghanistan. The DOJ memo itself was a penned by the department’s Office of Legal Counsel in response to the question of whether Central Intelligence Agency officers — who are not members of the US military — can be blamed for war crimes by launching drone strikes. The memo was written in July 2010, and justified the strike that later that year killed Al-Awlaki.

According to a footnote within the memo, released June 24 of this year due to a Freedom of Information Act lawsuit, “lethal activities conducted in accordance with the laws of war, and undertaken in the course of lawfully authorized hostilities, do not violate the laws of war by virtue of the fact that they are carried out in part by government actors who are not entitled to the combatant’s privilege.” "That completely blows away one of the major prongs of the government's theory in all these Guantanamo cases," Sam Morison, Khadr's Pentagon-based lawyer, told The Canadian Press during an interview on Wednesday this week. Although Khadr was charged with violating the “US common law of war” that dates back centuries, his attorneys say the memo concerning CIA drone strikes suggest such legislation simply doesn’t exist.

Perhaps you already assume that there's some kind of twisted marriage between Wall Street megabanks and the US global surveillance regime. Why wouldn't there be? But not even a total cynic could have anticipated spymaster Keith Alexander cashing in this hard, this fast. As Bloomberg recently reported, the former National Security Agency chief, who resigned in March at the age of 62, quickly offered his cyber-security expertise at the eye-popping price of $1 million per month to an assortment of shady business lobbies. And now at least one member of Congress is probing this most delightfully dystopian of arrangements, raising the possibility that Alexander will be shamed out of the practice, if nothing else. “Disclosing or misusing classified information for profit is, as Mr. Alexander well knows, a felony. I question how Mr. Alexander can provide any of the services he is offering unless he discloses or misuses classified information, including extremely sensitive sources and methods,” Florida Democratic Rep. Alan Grayson wrote one of the business groups, the Security Industries and Financial Markets Association (SIFMA), which holds it down for Wall Street in Washington. “Without the classified information that he acquired in his former position, he literally would have nothing to offer to you.”

In an interview Monday, Grayson was even more strident in his criticism. "Frankly, what the general is doing is beginning to resemble an extortion racket," he told me. "This is a man who basically lied for a living, and he continues to do that." To be clear, what's uniquely outrageous about Alexander, who has apparently lowered his asking price to $600,000, is not that he is a former US official dangling his alleged expertise and the allure of privileged access to government officials before Wall Street. Former Secretary of State Hillary Clinton, who served under Barack Obama and is the odds-on favorite to succeed him, does this all the time, usually at a rate of about $250,000 a pop. (Indeed, one might argue that the very fact she has managed to do so while enjoying a stellar national reputation is what signaled to Alexander he might as well dive headlong through the revolving door.) But the former NSA head presumably knows things about sophisticated intelligence-gathering practices that very, very few people on Earth have been privy to—information that could be useful in the private sector, which has a tendency to collude with the military in ways that made former President and World War II General Dwight Eisenhower very sad.

"What could he possibly have that's worth $1 million a month other than classified information?" wonders Melanie Sloan, founder of Citizens for Responsibility and Ethics in Washington (CREW), a good government group. "That's more than former presidents make." Indeed, even former President Bill Clinton, whose corruption since leaving office is by now the stuff of legend, doesn't have the gall to ask for that much per gig. There's a sort of "fuck it!" attitude to what Alexander is doing, seemingly kicking sand in the face of everyone angry at his surveillance regime by getting paid to reflect on the experience of assembling it. More ominously, there's the prospect that Alexander, whether deliberately or otherwise, may have left behind vulnerabilities while running the NSA so as to put himself in prime position to effectively hold the banks hostage now. Certainly, there have been reports suggesting the agency was aware of some vulnerabilities it either could or did not address.   "What is especially troubling is he might actually be worth it," says former North Carolina Democratic Congressman Brad Miller, who worked extensively on financial regulation and Wall Street reform in Congress. "He's obviously not a computer geek. Some of the things that might have seemed paranoid a few years ago now seem more than plausible given what we've already learned the NSA has been doing."

Two new studies by political scientists offer compelling evidence that the rich use their wealth to control the political system and that the U.S. is a democratic republic in name only. In a study of Senate voting patterns, Michael Jay Barber found that “senators’ preferences reflect the preferences of the average donor better than any other group.” In a similar study of the House of Representatives, Jesse H. Rhodes and Brian F. Schaffner found that, “millionaires receive about twice as much representation when they comprise about 5 percent of the district’s population than the poorest wealth group does when it makes up 50 percent of the district.” In fact, the increasing influence of the rich over Congress is the leading driver of polarization in modern politics, with the rich using the political system to entrench wealth by pushing for tax breaks and blocking redistributive policies.

At the turn of the decade, political scientists Larry Bartels, Jacob Hacker and Martin Gilens wrote several incredibly influential important books arguing, persuasively, that the preferences of the rich were better represented in Congress than the poor. After the books were published, there was a flurry of research arguing that they had overstated their case. Critics alleged two key defects in Bartels’ and Gilens’ arguments. First, because polling data on the super-wealthy were sparse, it was difficult to prove that there were large differences in opinion. Political scientists often rely on composite measures of policy liberalism, but since the poor tend to be more economically liberal but socially conservative, the differences between the poor and moderately rich can often be obscured. Second, there was no way to show that influence of the wealthy was caused directly by the influence of money. It might well be that the rich are simply opinion leaders or are more likely to vote.

Recent research offers compelling answers to these criticisms. The new evidence adds credence to the Bartels-Gilens-Hacker view that money is corrupting American politics. By using a massive database of ideology that includes the super wealthy, Schaffner and Rhodes found that “members of Congress are much more responsive to the wealthy than to their poor constituents.” However, this difference is not equal between both parties; rather, Democrats are far more responsive to the poor than Republicans. (This is not surprising; other research supports this claim.) They find that both parties strongly favor the upper-middle class, those with $100,000 to $300,000 in wealth. But Republicans are not only more responsive to the rich, but particularly to rich donors. Schaffner and Rhodes argue that, “campaign donations, but not voter registration or participation in primary or general election, may help explain the disproportionate influence of the wealthy among Republican representatives.” Barber’s study is the first to directly examine the policy preferences of the donor class. Barber sent 20,500 letters to people who contributed to 22 Senate elections in 2012 and asked about various policy questions. This allowed Barber to examine the differences in representation between donors and non-donors. His finding: Donors’ preferences tend to be far better represented than non-donors’. The chart below measures the ideological differences between various groups, with 0 indicating a perfect fit. The data show that Senators are almost perfectly aligned with their donors, but rather distant from voters.

Duncan Campbell reports from the United States on the secret Anglo-American plan for a global electronic spy system for the 21st century capable of listening in to most of us most of the time   American, British and Allied intelligence agencies are soon to embark on a massive, billion-dollar expansion of their global electronic surveillance system. According to information given recently in secret to the US Congress, the surveillance system will enable the agencies to monitor and analyse civilian communications into the 21st century. Identified for the moment as Project P415, the system will be run by the US National Security Agency (NSA). But the intelligence agencies of many other countries will be closely involved with the new network, including those from Britain, Australia, Germany and Japan--and, surprisingly, the People's Republic of China. New satellite stations and monitoring centres are to be built around the world, and a chain of new satellites launched, so that NSA and its British counterpart, the Government Communications Headquarters (GCHQ) at Cheltenham, may keep abreast of the burgeoning international telecommunications traffic.

Both the new and existing surveillance systems are highly computerised. They rely on near total interception of international commercial and satellite communications in order to locate the telephone or other messages of target individuals. Last month, a US newspaper, the Cleveland Plain Dealer, revealed that the system had been used to target the telephone calls of a US Senator, Strom Thurmond. The fact that Thurmond, a southern Republican and usually a staunch supporter of the Reagan administration, is said to have been a target has raised fears that the NSA has restored domestic, electronic, surveillance programmes. These were originally exposed and criticised during the Watergate investigations, and their closure ordered by President Carter. After talking to the NSA, Thurmond later told the Plain Dealer that he did not believe the allegation. But Thurmond, a right-wing Republican, may have been unwilling to rock the boat. Staff members of the Permanent Select Committee on Intelligence said that staff were "digging into it" despite the "stratospheric security classification" of all the systems involved. The Congressional officials were first told of the Thurmond interception by a former employee of the Lockheed Space and Missiles Corporation, Margaret Newsham, who now lives in Sunnyvale, California. Newsham had originally given separate testimony and filed a lawsuit concerning corruption and mis-spending on other US government "black" projects. She has worked in the US and Britain for two corporations which manufacture signal intelligence computers, satellites and interception equipment for NSA, Ford Aerospace and Lockheed. Citing a special Executive Order signed by President Reagan. she told me last month that she could not and would not discuss classified information with journalists. GCHQ at Cheltenham is the co-ordinating centre for Europe, Africa and the Soviet Union (west of the Ural Mountains). The NSA covers the rest of the Soviet Union and most of the Americas. Australia--where another station in the NSA listening network is located in the outback--co-ordinates the electronic monitoring of the South Pacific, and South East Asia.

The Costa Rican government fired its recently appointed ambassador to Venezuela yesterday after the latter expressed support for the Bolivarian government in an interview with a prominent rightwing Venezuelan newspaper.Costa Rican President Luis Guillermo Solis stated that his government did not share the opinions of ex-ambassador Federico Picado, which have generated an uproar in the small Central American country with rightwing politicians demanding the ambassador's immediate dismissal.In his interview with La Nacion conducted via email, the 69 year-old ex-ambassador ridiculed suggestions of a lack of press freedom in Venezuela and attributed scarcities of essential goods to sabotage by "political factors" and "big business" seeking "internal destabilization". Picado also contrasted the image of the country presented by international media externally and the reality that he experienced on the ground.

Picado praised the example of Venezuela in the area of citizens' referenda and advocated that Costa Rica institute the option of midterm plebiscites for unseating inefficient leaders from their elected posts.However, not all Costa Rican political leaders sanctioned the firing of Picado.Patricia Mora of the leftwing Broad Front party stood up for the ex-ambassador, informing La Nacion, “It seems that they were objective declarations, he is experiencing what is happening [in Venezuela].”Kidnapping False ClaimThe dismissal of the Costa Rican ambassador for voicing support for the Bolivarian government comes in midst of an intensifying misinformation campaign directed against Venezuela in the international media.

Over the past few days, news headlines and social media feeds have been dominated by the story of an alleged kidnapping of a child in Venezuela.Nevertheless, Chief Prosecutor Luisa Ortega Diaz announced today that there was no kidnapping and that the child's mother was paid $18,000 of a total of $1 million Bolivars in order to issue the false claim.Carmen Yanet Briones, who is of Ecuadorian nationality, was detained yesterday, along with those accused of paying her, after the child's father dismissed the claim as false.President Nicolas Maduro denounced the false kidnapping as an instance of "psychological war" waged against Venezuela and called for those responsible to be brought to justice, mentioning the name of rightwing Venezuelan media consultant and fugitive J.J. Rondón.

“Zionism is a form of racism and racial discrimination,” reads UN General Assembly Resolution 3379. The measure was adopted 40 years ago, on Nov. 10, 1975, and the majority of the international community backed it. 72 countries voted for the resolution, with just 35 opposed (and 32 abstentions). Although little-known in the US today (it is remarkable how effectively the US and its allies have rewritten history in their favor), UN GA Res. 3379, titled “Elimination of all forms of racial discrimination,” made an indelible imprint on history. The geographic distribution of the vote was telling. The countries that voted against the resolution were primarily colonial powers and/or their allies. The countries that voted for it were overwhelmingly formerly colonized and anti-imperialist nations.

The resolution also cited two other little-known measures passed by international organizations in the same year: the Assembly of the Heads of State and Government of the Organization of African Unity’s resolution 77, which ruled “that the racist regime in occupied Palestine and the racist regimes in Zimbabwe and South Africa have a common imperialist origin, forming a whole and having the same racist structure”; and the Political Declaration and Strategy to Strengthen International Peace and Security and to Intensify Solidarity and Mutual Assistance among Non-Aligned Countries, which called Zionism a “racist and imperialist ideology.” When the resolution was passed, Israeli Ambassador to the UN Chaim Herzog — who later became Israel’s sixth president, and the father of Isaac Herzog, the head of Israel’s opposition — famously tore up the text at the podium. Herzog claimed the measure was “based on hatred, falsehood, and arrogance,” insisting it was “devoid of any moral or legal value.” Still today, supporters of Israel argue UN GA Res. 3379 was an anomalous product of anti-Semitism. In reality, however, the resolution was the result of international condemnation of the illegal military occupation to which Palestinians had been subjected since 1967 and the apartheid-like conditions the indigenous Arab population had lived under as second-class citizens of an ethnocratic state since 1948.

In 1991, resolution 3379 was repealed for two primary reasons: One, the Soviet bloc, which helped pass the resolution, had collapsed; and two, Israel and the US demanded that it be revoked or they refused to participate in the Madrid Peace Conference. At the UN on Nov. 11, US Ambassador to the UN Samantha Power and Secretary of State John Kerry eulogized the late Herzog and forcefully condemned the resolution on its 40th anniversary. In his 2,500-word statement, Kerry mentioned Palestinians just once, and only then as an extension of Israelis. In her remarks, Power did not mention Palestinians at all.

Egyptian media have reacted with fury as Britain and the United States increasingly point to a bomb as the cause of the Oct. 31 Russian plane crash in Sinai, with many outlets hammering home the same message: Egypt is facing a Western conspiracy that seeks to scare off tourists and destroy the country's economy. The warnings of a plot have been widely promoted by opinion-makers in print, online, and on TV, sometimes hinting and sometimes saying flat-out that the West has restricted flights to Egypt not purely out of safety concerns for its citizens but because it wants to undermine the country or prevent President Abdel-Fattah el-Sissi from making Egypt too strong.And though they seem wild, these conspiracy theories have apparently tapped into the Egyptian mindset — so much so that when Russia last Friday grounded all flights to Egypt, some media speculated that Moscow had fallen victim to British pressure and manipulation."The people defy the conspiracy — Egypt will not cave in to pressures," the state-owned Al-Gomhuria newspaper proclaimed in a front-page headline this week. "Egypt stands up to 'the West's terrorism,'" an independent daily, El-Watan, headlined.

In response to the tragic Paris events of November 13, Central Intelligence Agency director  John Brennan  warned that “ISIL is planning additional attacks… It is clear to me that ISIL has an external agenda, that they are determined to carry out these types of attacks.” (Quoted in Daily Telegraph, November 16, 2015) Five days later following the CIA Chief’s  premonition, the Bamako Radisson Hotel Blu in Mali’s capital was the object of a terrorist attack, resulting in  21 people dead. Following the attack and the taking of hostages by the terrorists, French and Malian special forces raided the hotel. US. Africa Command (AFRICOM) also confirmed that US special forces were involved.

The Bamako terror operation was allegedly coordinated by Mokhtar Belmokhtar (aka Khaled Abu al-Abbas), leader of an affiliate of Al Qaeda in the Islamic Maghreb (AQIM), the Islamist al-Mulathameen (Masked) Brigade, or “Those who Sign with Blood.” Belmokhtar’s group was created in 2012 in the wake of the war on Libya. His organization has also allegedly been involved in the drug trade, smuggling as well kidnapping operations of foreigners in North Africa.  While his whereabouts are said to be known, French intelligence has dubbed Belmokhtar “the uncatchable”. In June he was reported dead  as a result in a U.S. air strike in Libya. His death was subsequently denied. Based on shaky evidence, The New York Times report below (November 20) concludes that Belmokhtar’s group (together with AQIM) is unequivocally behind the Bamako attacks:

A member of Al Qaeda in Africa confirmed Saturday that the attack Friday on a hotel in Bamako, Mali, had been carried out by a jihadist group loyal to Mokhtar Belmokhtar, an Algerian operative for Al Qaeda. The Qaeda member, who spoke via an online chat, said that an audio message and a similar written statement in which the group claimed responsibility for the attack were authentic. The SITE Intelligence Group, which monitors jihadist groups, also confirmed the authenticity of the statement. The Qaeda member, who refused to be named for his protection, said that Mr. Belmokhtar’s men had collaborated with the Saharan Emirate of Al Qaeda in the Islamic Maghreb, … In the audio recording, the group, known as Al Mourabitoun, says it carried out the operation in conjunction with Al Qaeda’s branch in the Islamic Maghreb. The recording was released to the Al Jazeera network and simultaneously to Al Akhbar, … The recording states: “We, in the group of the Mourabitoun [Arabic Rebel Group], in cooperation with our brothers in Al Qaeda in Islamic Maghreb, the great desert area, claim responsibility for the hostage-taking operation in the Radisson hotel in Bamako.” (emphasis added)

What the colonial powers have done in Muslim countries is well known. Less well known are the machinations of Allen Dulles and the CIA in one of these colonial powers, France.Without the knowledge or consent of President John F. Kennedy, Allen Dulles orchestrated the efforts of retired French generals, rightwing French, Nazi sympathizers, and at least one White Russian, to overthrow Charles de Gaulle, who wanted to give Algeria its independence. Dulles et al feared an independent Algeria would go Communist, giving the Soviets a base in Africa.And there was another reason to hang onto Algeria: its natural resources. When the coup against de Gaulle began three months later, Kennedy was still in the dark. It was a tumultuous time for the young administration. As he continued to wrestle with fallout from the Bay of Pigs crisis, JFK was suddenly besieged with howls of outrage from a major ally, accusing his own security services of seditious activity.

On Wednesday, in the wake of Israel’s announcement of hundreds of more units in West Bank settlements, the Israeli Ministry of Foreign Affairs posted a page on its website articulating its view that building in the occupied West Bank is legal under international law and is not, as many critics claim, an impediment to peace. The fact that the MFA felt the need to make such a case indicates that rising international criticism, particularly from the U.S., is having an impact, and that case bears an examination of its key claims. Israel claims that the settlements are not illegal because the laws of belligerent occupation do not apply to the West Bank and that the prohibition against transferring citizens of an occupying power to occupied territory “…applied to forcible transfers and not to the case of Israeli settlements.” The vast majority of legal opinions, including those of the High Court of Justice in Israel and the US State Department (which consistently refers to the West Bank as “occupied territory”), directly contradict this claim. As recently as 2004, the High Court in Israel ruled “…that Israel holds the (West Bank) in belligerent occupation,” and that its authority over the Palestinians “… flows from the provisions of public international law regarding belligerent occupation.” No ruling since has superseded this view. Indeed, in an analysis requested by the Israeli Prime Minister’s office in 1967 regarding the potential legality of settlements in the then-newly occupied territories, Israeli Foreign Ministry legal adviser Theodor Meron wrote, “My conclusion is that civilian settlement in the administered territories contravenes the explicit provisions of the Fourth Geneva Convention.” This is the overwhelming consensus view of international legal opinion, and contradicts Israel’s claim that Article 49 of the Fourth Geneva Convention applies only to forcible transfers, rather than voluntary ones like those of Israeli settlers. Israel says “the current Israeli government, like several preceding governments, has limited Jewish construction primarily to those areas that are fully expected to remain under Israeli control in any final agreement with the Palestinians.”
