  • It had the air of Hollywood. On the night of 10 March 2004, James Comey, the nominee to lead the FBI for the next ten years, rushed to the hospital bedside of his terribly ill boss, Attorney General John Ashcroft.There, he eventually confronted White House Chief of Staff Andrew Card and White House Counsel Alberto Gonzales, who were trying to get the pancreatitis-stricken Ashcroft to renew a still secret and illegal surveillance program on Americans' electronic communications. Neither Ashcroft nor Comey, then acting attorney general because of Ashcroft's condition, would reauthorize the program. When Gonzales authorized the program to go forward without a Justice Department certification, Comey threatened to resign, along with his staff and FBI Director Robert Mueller.The threats worked: President Bush blinked, and Comey won modifications to the secret surveillance program that he felt brought it into compliance with the law. This event, now the stuff of DC legend, has solidified Comey's reputation as a "civil liberties superhero", in the words of CNN's Jake Tapper, and may be one of the reasons President Obama nominated him Friday to be the next director of the FBI.
  • There's one very big problem with describing Comey as some sort of civil libertarian: some facts suggest otherwise. While Comey deserves credit for stopping an illegal spying program in dramatic fashion, he also approved or defended some of the worst abuses of the Bush administration during his time as deputy attorney general. Those included torture, warrantless wiretapping, and indefinite detention.On 30 December 2004, a memo addressed to James Comey was issued that superseded the infamous memo that defined torture as pain "equivalent in intensity to the pain accompanying serious physical injury, such as organ failure". The memo to Comey seemed to renounce torture but did nothing of the sort. The key sentence in the opinion is tucked away in footnote 8. It concludes that the new Comey memo did not change the authorizations of interrogation tactics in any earlier memos.In short, the memo Comey that approved gave a thumbs-up on waterboarding, wall slams, and other forms of torture – all violations of domestic and international law.

  • Then, there's warrantless wiretapping. Many media reports describe that Comey's defiant stand at Ashcroft's bedside was in opposition to the warrantless wiretapping of Americans international communications. But we simply do not know exactly what Comey opposed, or why or what reforms he believed brought the secret program within the rule of law. We do, however, know that Comey was read into the program in January 2004.While, to his credit, he immediately began raising concerns, the program was still in existence when the New York Times exposed it in December 2005. This was a year and a half after Comey's hospital showdown with Gonzales and Card. In fact, the warrantless wiretapping program was supported by a May 2004 legal opinion (pdf) produced by the Justice Department's Office of Legal Counsel and signed off by Comey, which replaced the 2001 legal opinion Comey had problems with.This, of course, raises the question: just what illegal surveillance program did Comey oppose so much he would resign over it? Last weekend, the Washington Post provided a new theory: the Marina program, which collects internet metadata. Now, the Senate has an opportunity to end the theorizing and find out what exactly Comey objected to. It's a line of questioning that senators should focus doggedly on, in light of the recent revelations in the Post and the Guardian.
  • The final stain on Comey's record was his full-throated defense of the indefinite military detention of an American citizen arrested on American soil. In a June 2004 press conference, Comey told of Jose Padilla, an alleged al-Qaida member accused of plotting to detonate a dirty bomb as well as blow up apartment buildings in an American city. By working for al-Qaida, Padilla, Comey argued, could be deprived of a lawyer and indefinitely detained as an enemy combatant on a military brig off the South Carolina coast for the purpose of extracting intelligence out of him. It turned out that Padilla was never charged with the list of crimes and criminal associations pinned on him by Comey that day. When Padilla was finally convicted – in a federal court – in August 2007, it wasn't for plotting dirty bomb attacks or blowing up apartment buildings. Rather, he was convicted of material support of terrorism overseas. During his indefinite military detention, Padilla was tortured.
  • Everyone has a backstory, and the confirmation process should ensure the American public hears all relevant background information, both good and bad, when Comey appears before the Senate. Senators should insist that Comey explain his role during the Bush era and repudiate policies he endorsed on torture, indefinite detention, and illegal surveillance.The new FBI director will be around for the next decade. We need one who will respect the constitution and the rule of law; not one who will use discredited and illegal activities in the name of justice and safety.

    Comey's not right for the FBI directorship this time around. The nation needs an FBI Director and Comey's role in government surveillance, torture, warrantless wiretapping, extraordinary rendition, and indefinite detention of a U.S. citizen. That's too much to get sorted out any time soon given the government shroud of secrecy on those topics.

"Today, the California Public Safety Committee voted unanimously in favor of Assembly Bill 351 (AB351), the California Liberty Preservation Act. Introduced by Republican Assemblymember Tim Donnelly, AB351 is a strong stand against "indefinite detention" as supposedly authorized by the National Defense Authorization Act (NDAA) of 2012.  It declares such federal power to be unconstitutional and also requires the entire state to refuse to enforce or assist its implementation.  A broad coalition officially supported the legislation and moved the normally partisan, and strongly democratic committee to support the republican-introduced legislation. AB351 was supported by the ACLU, Tenth Amendment Center, San Francisco 99% coalition, San Francisco Board of Supervisors, the Libertarian Party of California - and many others. AB351 establishes the proper constitutional role by first citing the 10th Amendment as limiting the power of the federal government as to that which has been delegated to it and nothing more. The Tenth Amendment to the United States Constitution authorizes the United States federal government to exercise only those powers specifically delegated to it in the United States Constitution. Senate CIA torture report could throw Gitmo hearings into chaos | Al Jazeera America - 0 views

  • The possible declassification and release of a Senate report into the CIA’s detention and interrogation program — begun in the wake of the 9/11 terrorist attacks — could have a huge impact on the controversial military tribunals happening at Guantánamo Bay, experts and lawyers believe. The proceedings have been moving at a snail’s pace at the U.S.-held military base on the island of Cuba, amid widespread condemnation that they are being held in a legal limbo and outside the U.S. criminal justice system. Details surrounding the CIA’s activities have been one of the most contentious issues concerning the commissions at Guantánamo, where the alleged mastermind of the 9/11 attacks, Khalid Sheikh Mohammed, and his co-defendants are on trial. Their alleged treatment while in CIA custody has been a key stumbling block in the hearings’ progress. The same goes for the man alleged to be behind the USS Cole bombing, Abd al-Rahim al-Nashiri, another former CIA captive. In both cases, there have been dozens of delays — mainly due to the fact that the attorneys have been battling military prosecutors over access to classified information about the CIA interrogation program that the attorneys want to use as evidence. Both cases have been dragging on for two years and are still in the pretrial evidentiary phase.
  • But now that the Senate Intelligence Committee appears set to vote on releasing its long-awaited 6,300-page, $50 million study — or at least some portion of it — the defense attorneys will finally get the opportunity to talk openly at the military commissions about torture. That could prove disastrous for military prosecutors. According to defense attorneys and human rights observers who have been monitoring the proceedings, it might also derail the government’s attempts to convince a jury that the detainees, if convicted, deserve to be executed. “The U.S. government has gone to great lengths to classify evidence of crimes — crimes committed by U.S. actors,” said Army Maj. Jason Wright, one of Mohammed’s military defense attorneys. “Were this information in this Senate report to be revealed … it would completely gut the classification architecture currently in place before the commissions.” The panel is expected to vote April 3, and it is widely believed the panel will approve release of its 400-page executive summary. If that happens, Wright said, he anticipates petitioning the military court to amend the protective order that treats all information about the CIA torture program as classified.
  • The report is likely to contain reams of information that has not yet come to light. Intelligence Committee Chairwoman Sen. Dianne Feinstein has said the report “includes details of each detainee in CIA custody, the conditions under which they were detained, how they were interrogated, the intelligence they actually provided and the accuracy — or inaccuracy — of CIA descriptions about the program to the White House, Department of Justice, Congress and others.” Wright said that in addition to seeking a change to the protective order, he would file discovery motions to gain access to the 6.2 million pages of documents the Senate had. Such a move would lead to further legal wrangling and delay the start of the trial, which the government hopes will get underway in September. “We have an absolute right to review that and have it produced in discovery,” Wright said.

  • Richard Kammen, al-Nashiri’s civilian defense attorney, meanwhile, has already filed a motion with the military court to obtain a complete, unredacted copy of the Senate Intelligence Committee’s report. The motion, submitted in September prior to the revelations that have surfaced about infighting between the CIA and Senate committee investigators, said the report “will be central to the accused’s defense on the merits, in impeaching the credibility of the evidence against him and in mitigation of the death sentence the government is seeking to impose.” If the entire report were declassified by the Intelligence Committee, it “would be huge because it would really eliminate the ‘need’ for military commissions, which are in my view mainly a vehicle to have what will look like trials but will keep whatever evidence of torture the judge ultimately allows secret from or sanitized to the public,” Kammen said.
  • But not everyone expects the report to be released in great detail. Air Force Capt. Michael Schwartz, the attorney for alleged 9/11 co-conspirator Walid bin Attash, doesn’t believe the Senate committee’s report will ever see the light of day. If it is released, he said it will be highly redacted, rendering it useless to the public and Attash’s defense team. “This whole military commissions system is designed to make sure this information is never known to the public,” Schwartz said. “No one in my office is naive enough to think this report will come out in any unredacted form. Certainly that report contains a lot of mitigating information that would be relevant to the defense of this case. But I don’t believe for a second that we will see anything in that report that actually sheds light on the crimes committed by the CIA against our clients between 2003 and 2006.” Air Force Col. Morris Davis, the former chief prosecutor at Guantánamo and a staunch critic of the military commissions, doesn’t believe the Senate committee’s report “is legally relevant” to the military commission trial of Mohammed and the other high-value detainees. But he does believe it will force the hearings more into the public.
  • “Where I do think it will have an impact is in the assessment of whether those legal relevance proceedings take place in open court or in secret closed sessions,” he said. “The report is likely to officially reinforce and amplify what the public already knows about this regrettable chapter in our history. It should further undercut the government’s claim that all this absolutely must stay hidden behind closed doors or else cataclysmic things will happen.” Army. Lt. Col. Todd Breasseale, a Pentagon spokesman who deals with detainee matters at Guantánamo, declined to discuss the Senate report or how its release may affect the commissions. "I can't imagine a world where competent counsel — be they from the government or defense — would announce in advance, any strategy they might pursue or make predictions on how any given issue might affect the progress of their case," Breasseale said.
  • Daphne Eviatar, a lawyer for Human Rights First who has closely observed and written about the military commission proceedings, said whether the Senate’s report is a game changer will ultimately depend on what is declassified. Perhaps details of the interrogations will be released, or they may be heavily redacted. “Either way, you can be sure the defense lawyers will try to reopen this issue, and the government will fight it, and the case will get bogged down once again in months of argument in pretrial hearings that are already taking forever,” she said.

Defense Manual Allows for Journalists' Detention | Al Jazeera America - 0 views

  • New Defense Department guidelines allow commanders to punish journalists and treat them as "unprivileged belligerents" if they believe journalists are sympathizing or cooperating with the enemy. The Law of War manual, updated to apply for the first time to all branches of the military, contains a vaguely worded provision that military commanders could interpret broadly, experts in military law and journalism say. Commanders could ask journalists to leave military bases or detain journalists for any number of perceived offenses. "In general, journalists are civilians," the 1,180 page manual says, but it adds that "journalists may be members of the armed forces, persons authorized to accompany the armed forces, or unprivileged belligerents." A person deemed to be an "unprivileged belligerent" is not entitled to the rights afforded by the Geneva Convention. A commander could restrict from certain coverage areas or even hold indefinitely without charges any reporter considered an "unprivileged belligerent." The manual adds, "Reporting on military operations can be very similar to collecting intelligence or even spying. A journalist who acts as a spy may be subject to security measures and punished if captured." It is not specific as to the punishment or under what circumstances a commander can decide to "punish" a journalist.
  • Defense Department officials said the reference to "unprivileged belligerents" was intended to point out that armed group members or spies could be masquerading as reporters. The designation was also made to warn against someone who works publications like Al-Qaeda's "Inspire" magazine that can be used to encourage or recruit adherents. Another provision says that "relaying of information" could be construed as "taking a direct part in hostilities." Officials said that is intended to refer to passing information about ongoing operations, locations of troops or other classified data to an enemy. Army Lt. Col. Joe Sowers, a Pentagon spokesman, said it was not the Defense Department's intent to allow an overzealous commander to block journalists or take action against those who write critical stories.
  • But Ken Lee, an ex-Marine and military lawyer who specializes in "law of war" issues and is now in private practice, said it was worrisome that the detention of a journalist could come down to a commander's interpretation of the law.  If a reporter writes an unflattering story, "does this give a commander the impetus to say, now you're an unprivileged belligerent? I would hope not," Lee said. Defense officials said the manual describes the law for informational purposes and is not an authorization for anyone to take any particular action regarding journalists. The manual also notes that journalists captured by the enemy are supposed to be given the rights of prisoners of war under the Geneva Convention.

BRAZIL: TORTURE TECHNIQUES REVEALED IN DECLASSIFIED U.S. DOCUMENTS - 0 views

  • The Brazilian military regime employed a "sophisticated and elaborate psychophysical duress system" to "intimidate and terrify" suspected leftist militants in the early 1970s, according to a State Department report dated in April 1973 and made public last week. Among the torture techniques used during the military era, the report detailed "special effects" rooms at Brazilian military detention centers in which suspects would be "placed nude" on a metal floor "through which electric current is pulsated." Some suspects were "eliminated" but the press was told they died in "shoot outs" while trying to escape police custody. "The shoot-out technique is being used increasingly," the cable sent by the U.S. Consul General in Rio de Janeiro noted, "in order to deal with the public relations aspect of eliminating subversives," and to "obviate 'death-by-torture' charges in the international press."
  • Peter Kornbluh who directs the National Security Archive's Brazil Documentation Project called the document "one of the most detailed reports on torture techniques ever declassified by the U.S. government." Titled "Widespread Arrests and Psychophysical Interrogation of Suspected Subversives," the document was among 43 State Department cables and reports that Vice President Joseph Biden turned over on June 17 to President Dilma Rousseff during his trip to Brazil for the World Cup competition for use by the Brazilian Truth Commission. The Commission is in the final phase of a two-year investigation of human rights atrocities during the military dictatorship which lasted from 1964 to 1985. On July 2, the Commission posted all 43 documents on its website, accompanied by this statement: "The CNV greatly appreciates the initiative of the U.S. government to make these records available to Brazilian society and hopes that this collaboration will continue to progress." The records range in date from 1967 to 1977. They report on a wide range of human rights-related issues, among them: secret torture detention centers in Sao Paulo, the military's counter-subversion operations, attitudes of the Church on human rights violations, and the regime's hostile reaction in 1977 to the first State Department human rights report on abuses. Some of the documents had been previously declassified under routine release procedures; others, including the April 1973 report on psychophysical torture, were reviewed for declassification as recently as June 5, 2014, in preparation for Biden's trip.
  • During his meeting with President Rousseff, Biden announced that the Obama administration would undertake a broader review of still highly classified U.S. records on Brazil, among them CIA and Defense Department documents, to assist the Commission in finalizing its report. "I hope that in taking steps to come to grips with our past we can find a way to focus on the immense promise of the future," he noted. Since the inception of the Truth Commission in May 2012, the National Security Archive has been assisting the Commissioners in obtaining U.S. records for their investigation, and pressing the Obama administration to fulfill its commitment to a new standard of global transparency and the right-to-know by conducting a special, Brazil declassification project on the military era. "Advancing truth, justice and openness is precisely the way these classified U.S. historical records should be used," according to Kornbluh. "Biden's declassified diplomacy will not only assist the Truth Commission in shedding light on the dark past of Brazil's military era, but also create a foundation for a better and more transparent future in U.S.-Brazilian relations." To call attention to the records and the Truth Commission's work, the Archive is highlighting five key documents from Biden's timely donation.

CIA and White House under pressure after Senate torture report leaks | World news | the... - 0 views

  • A leak of the major findings of a landmark Senate inquiry into the CIA’s post-9/11 torture of terrorism detainees led, on Friday, to intensified pressure on the White House and the CIA to release the inquiry speedily and with a minimum of redactions.The classified study, prepared by the Senate select committee on intelligence, concluded that the CIA’s interrogations, secret detentions and outsourced torture sessions were “brutal, and far worse than the agency communicated to policymakers.” More suspected terrorists underwent the agency’s post-9/11 treatment, which largely lasted from 2002 to 2006, than the CIA has publicly admitted, according to the report’s findings, which were first reported by McClatchy. Last week, committee chairwoman Dianne Feinstein of California stated that the Senate investigated the cases of 100 detainees – dozens more than previously known to have gone through the CIA’s so-called “interrogation, detention and rendition” programs.
  • In addition to misleading policymakers, the Senate report charges the CIA with selectively and leaking classified and inaccurate information to journalists in order to portray the program in a positive light.“The CIA manipulated the media by co-ordinating the leak of classified information, which inaccurately portrayed the effectiveness of the agency’s enhanced interrogation techniques,” the committee found.The agency also, according to the report, provided factually inaccurate information to Bush administration lawyers, who relied on it to concoct the legal theories that underpinned an apparatus of torturous interrogations and detentions that quickly spread to US military facilities at Guantánamo Bay, Iraq and Afghanistan.
  • According to the leaked conclusions, the committee found that that the agency poorly managed its interrogation and detention efforts. It relied extensively on outside contractors for design and implementation, especially “two contract psychologists,” whom an earlier Senate Armed Services Committee investigation identified as Bruce Jessen and Jim Mitchell. Both men were influential in retrofitting techniques that had been designed to train captured US troops to survive and resist torture by foreign adversaries for use on detainees.“Numerous internal critiques and objections concerning the CIA’s management and use of the Detention and Interrogation [sic] were ignored,” according to the committee findings. Those internal critiques include a now partially declassified 2004 inspector general’s report.

  • Despite the acrimony, the White House announced last week that the CIA will lead the executive-branch panel that will recommend how much of the Senate report’s executive summary, findings and recommendations to make public, a decision blasted by human-rights groups and intelligence scholars as a conflict of interest.
  • In a letter he sent to President Obama on Friday, Senator Mark Udall, a Democrat from Colorado, wrote, "[T]he most pressing reason for the White House to step in and manage this process is the CIA's clear conflict of interest on this issue and its demonstrated inability to face the truth about this program. … The CIA is certainly entitled to issue a public response to the Committee's study, but not to impede the declassification of the study itself."

What is no longer classified? (and what does it portend for the credibility of governme... - 0 views

  • The prosecution’s motion to amend the protective order in the 9/11 military commission is finally posted.  As I discussed here, Judge Spath has granted a similar motion in the al-Nashiri case.  Judge Pohl has yet to rule on this motion in the 9/11 case because the defense apparently intends to file at least one response to it. In an earlier post I explained why I think this development is very welcome and overdue. There’s another very noteworthy thing about the prosecution’s motion, as well:  It enumerates those categories of information about the CIA’s rendition/detention/interrogation program that are no longer classified at all, and that therefore presumably can now be discussed even by those (unlike the detainees) who were properly subject to restrictions on disclosing such matters–including information about the treatment of all 119 individuals who were in CIA custody, to wit:
  • • The fact that the former RDI Program was a covert action program authorized by the President in the September 17, 2001 Memorandum of Notification; • General allegations of torture by high-value detainees, unless such allegations reveal the identities (e.g., names, physical descriptions, or other identifying information) of CIA personnel or contractors, the locations of detention sites (including the name of any country in which the detention site was allegedly located), or any foreign intelligence service involvement in the detainees’ capture, rendition, detention, or interrogation; • The names and descriptions of the thirteen Enhanced Interrogation Techniques (EITs) that were approved for use, and the specified parameters within which the EITs could be applied;
  • • The techniques themselves as applied to the 119 individuals mentioned in Appendix 2 of the SSCI Executive Summary acknowledged to have been in CIA custody; • Information regarding the conditions of confinement as applied to those 119 individuals; • Information regarding the treatment of those 119 individuals, including the application of standard interrogation techniques; and • Information regarding the conditions of confinement or treatment during the transfer (“rendition”) of the 119 individuals.

  • This is important for several reasons, not least of which is that it might mean that it is now permissible to release the vast majority of the complete, 6000-or-so-page SSCI Report. One other thing:  The motion relates that in April 2012, in support of the Government’s motion requesting that Judge Pohl issue the protective order, the accompanying declarations of government officials set forth the “grave harm to national security that unauthorized disclosure of such information would cause.”  I think it’s fair to say, now that such information has been disclosed, that these alarms were unwarranted and ill-advised.  No grave harm has befallen the nation.  And so it appears, at least, as though there never was a very good reason why these important categories of information about the RDI program could not and should not have been disclosed years ago.

U.S. military confirms rebels had sarin - 1 views

  • As part of the Obama administration’s repeated insistence – though without offering proof – that the recent sarin gas attack near Damascus was the work of the Assad regime, the administration has downplayed or denied the possibility that al-Qaida-linked Syrian rebels could produce deadly chemical weapons. However, in a classified document just obtained by WND, the U.S. military confirms that sarin was confiscated earlier this year from members of the Jabhat al-Nusra Front, the most influential of the rebel Islamists fighting in Syria. The document says sarin from al-Qaida in Iraq made its way into Turkey and that while some was seized, more could have been used in an attack last March on civilians and Syrian military soldiers in Aleppo.
  • The document, classified Secret/Noforn – “Not for foreign distribution” – came from the U.S. intelligence community’s National Ground Intelligence Center, or NGIC, and was made available to WND Tuesday. It revealed that AQI had produced a “bench-scale” form of sarin in Iraq and then transferred it to Turkey. A U.S. military source said there were a number of interrogations as well as some clan reports as part of what the document said were “50 general indicators to monitor progress and characterize the state of the ANF/AQI-associated Sarin chemical warfare agent developing effort.” “This (document) depicts our assessment of the status of effort at its peak – primarily research and procurement activities – when disrupted in late May 2013 with the arrest of several key individuals in Iraq and Turkey,” the document said. “Future reporting of indicators not previously observed would suggest that the effort continues to advance despite the arrests,” the NGIC document said.
  • This seizure followed a chemical weapons attack in March on the Khan al-Assal area of rural Aleppo, Syria. In that attack, some 26 people and Syrian government forces were killed by what was determined to be sarin gas, delivered by a rocket attack. The Syrian government called for an investigation by the United Nations. Damascus claimed al-Qaida fighters were behind the attack, also alleging that Turkey was involved. “The rocket came from a place controlled by the terrorists and which is located close to the Turkish territory,” according to a statement from Damascus. “One can assume that the weapon came from Turkey.” The report of the U.S. intelligence community’s NGIC reinforces a preliminary U.N. investigation of the attack in Aleppo which said the evidence pointed to Syrian rebels. It also appears to bolster allegations in a 100-page report on an investigation turned over to the U.N. by Russia. The report concluded the Syrian rebels – not the Syrian government – had used the nerve agent sarin in the March chemical weapons attack in Aleppo.

The sarin gas was found in the homes of suspected Syrian Islamic radicals detained in the southern provinces of Adana and Mersia. Some 12 suspected members of the al-Nusra Front were arrested. At the time, they were described by Turkish special anti-terror forces as the “most aggressive and successful arm” of the Syrian rebels. In the seizure, Turkish anti-terror police also found a cache of weapons, documents and digital data. At the time of the arrest, the Russians called for a thorough investigation of the detained Syrian militants found in possession of sarin gas.
  • While the contents of the report have yet to be released, sources tell WND the documentation indicates that deadly sarin poison gas was manufactured in a Sunni-controlled region of Iraq and then transported to Turkey for use by the Syrian opposition, whose ranks have swelled with members of al-Qaida and affiliated groups. The documentation that the U.N. received from the Russians indicated specifically that the sarin gas was supplied to Sunni foreign fighters by a Saddam-era general working under the outlawed Iraqi Baath party leader, Izzat Ibrahim al-Douri. Al-Douri was a top aide to Saddam Hussein before he was deposed as Iraqi president. The sarin nerve gas used in the Allepo attack, sources say, had been prepared by former Iraqi Military Industries Brig. Gen. Adnan al-Dulaimi. It then was supplied to Baath-affiliated foreign fighters of the Sunni and Saudi Arabian-backed al-Nusra Front in Aleppo, with Turkey’s cooperation, through the Turkish town of Antakya in Hatay Province. The source who brought out the documentation now in the hands of the U.N. is said to have been an aide to al-Douri. Al-Dulaimi was a major player in Saddam’s chemical weapons production projects, the former aide said. Moreover, Al-Dulaimi has been working in the Sunni-controlled region of northwestern Iraq where the outlawed Baath party now is located and produces the sarin.
  • The NGIC depiction of the variety of sarin as “bench-scale” reinforces an analysis by terrorism expert Yossef Bodansky, who said the recent findings on the chemical weapons attack of Aug. 21 on the outskirts of Damascus, Syria, was “indeed a self-inflicted attack” by the Syrian opposition to provoke U.S. and military intervention in Syria.
  • The terrorism expert said that the jihadist movement has technologies which have been confirmed in captured jihadist labs in both Turkey and Iraq, as well as from the wealth of data recovered from al-Qaida in Afghanistan in 2001 and 2002. He added that the projectiles shown by the opposition, which were tested by U.N. inspectors, are not standard weapons of the Syrian army.
  • Now, a former analyst for the Central Intelligence Agency, Ray McGovern, similarly backs the claim that the Syrian rebels perpetrated the poison gas attack on Aug. 21 McGovern was one of a number of veteran intelligence professionals who recently signed a letter to Obama saying that Damascus wasn’t behind the Aug. 21 chemical attack. As WND recently reported, former U.S. intelligence analysts claim current intelligence analysts have told them Assad was not responsible for the Aug. 21 poison gas attack, saying there was a “growing body of evidence” that reveals the incident was a pre-planned provocation by the Syrian opposition.
  • “Initial meetings between senior opposition military commanders and Qatari, Turkish and U.S. intelligence officials took place at the converted Turkish military garrison in Antakya, Hatay Province, now used as the command center and headquarters of the Free Syrian Army and their foreign sponsors,” the analysts said.
  • The VIPS memo to Obama reinforces separate videos, which show foreign fighters associated with the Syrian opposition firing artillery canisters of poison gas. One video shows Nadee Baloosh, a member of an al-Qaida-affiliated group Rioyadh al-Abdeen, admitting to the use of chemical weapons. In the video clip, al-Abdeen, who is in the Latakia area of Syria, said his forces used “chemicals which produce lethal and deadly gases that I possess.”

Revealed: Senate report contains new details on CIA black sites | Al Jazeera America - 0 views

  • A Senate Intelligence Committee report provides the first official confirmation that the CIA secretly operated a black site prison out of Guantánamo Bay, two U.S. officials who have read portions of the report have told Al Jazeera. The officials — who spoke on condition of anonymity because the 6,600-page report on the CIA’s detention and interrogation program remains classified — said top-secret agency documents reveal that at least 10 high-value targets were secretly held and interrogated at Guantánamo’s Camp Echo at various times from late 2003 to 2004. They were then flown to Rabat, Morocco, before being officially sent to the U.S. military’s detention facility at Guantánamo in September 2006. In September 2006, President George W. Bush formally announced that 14 CIA captives had been transferred to Guantánamo and would be prosecuted before military tribunals. He then acknowledged for the first time that the CIA had been operating a secret network of prisons overseas to detain and interrogate high-value targets.
  • The Senate report, according to Al Jazeera’s sources, says that the CIA detained some high-value suspects on Diego Garcia, an Indian Ocean island controlled by the United Kingdom and leased to the United States. The classified CIA documents say the black site arrangement at Diego Garcia was made with the “full cooperation” of the British government. That would confirm long-standing claims by human rights investigators and journalists, whose allegations — based on flight logs and unnamed government sources — have routinely been denied by the CIA. The CIA and State Department declined Al Jazeera’s requests for comment. The Intelligence Committee last week voted 11 to 3 to declassify the report’s 480-page executive summary and 20 conclusions and findings, which incorporate responses from Republican members of the committee and from the CIA. The executive summary will undergo a declassification review, led by the CIA, with input from the State Department and the Office of the Director of National Intelligence, the U.S. officials said. The panel’s chairwoman, Democratic Sen. Dianne Feinstein, said in a statement last Thursday that the full 6,600-page report, with 37,000 footnotes, “will be held for declassification at a later time.”
  • Leaked details of the committee’s report have caused waves in countries like Poland, where the CIA is known to have operated a black site prison — which Polish officials continue to deny having known about. The U.S. officials who spoke to Al Jazeera said that the Senate report reveals 20 prisoners were secretly detained in Poland from 2002 to 2005. They added that Polish officials recently sought assurances from diplomats and visiting U.S. officials that the Senate report would conceal details about Poland’s role in allowing the CIA black site to be operated on Polish soil. Al Jazeera’s sources said U.S. officials reassured their Polish counterparts last year that it was almost certain that the declassified version of the report would not identify the countries that cooperated with the CIA’s detention and interrogation program.

  • According to the Senate report, Al Jazeera’s sources said, a majority of the more than 100 detainees held in CIA custody were detained in secret prisons in Afghanistan and Morocco, where they were subject to torture methods not sanctioned by the Justice Department. Those methods are recalled by the report in vivid narratives lifted from daily logs of the detention and interrogation of about 34 high-value prisoners. The report allegedly notes that about 85 detainees deemed low-value passed through the black sites and were later dumped at Guantánamo or handed off to foreign intelligence services. More than 10 of those handed over to foreign intelligence agencies “to face terrorism charges” are now “unaccounted for” and presumed dead, the U.S. officials said. The Senate report says more than two dozen of these men designated low-value had, in fact, been wrongfully detained and rendered to other countries on the basis of intelligence obtained from CIA captives under torture and from information shared with CIA officials by other governments, both of which turned out to be false. The report allegedly singles out a top CIA official for botching a handful of renditions and outlines agency efforts to cover up the mistakes. The Senate report allegedly accuses “senior CIA officials” of lying during multiple closed-session briefings to members of Congress from 2003 to 2005 about the use of certain “enhanced” interrogation techniques. The report says an agency official lied to Congress in 2005 when he insisted the U.S. was adhering to international treaties barring cruel and degrading treatment of prisoners, the U.S. officials told Al Jazeera.
  • The report not only accuses certain CIA officials of deliberately misleading Congress; Al Jazeera’s sources say it also suggests that the agency sanctioned leaks to selected journalists about phantom plots supposedly disrupted as a result of information gained through the program in order to craft a narrative of success. The Senate report, like a 2009 Senate Armed Services Committee report (PDF), says Air Force psychologists under contract to the CIA reverse-engineered a decades-old resistance-training program taught to U.S. airmen known as survival evasion resistance escape (SERE). According to a SERE training document obtained by Al Jazeera titled “Coercive Exploitation Techniques,” Air Force personnel were taught that communist regimes used “deprivations” of “food, water, sleep and medical care” as well as “the use of threats” in order to weaken a captive’s mental and physical ability to resist interrogation. “Isolation” would be used, according to the SERE program, to deprive the “recipient of all social support” so that he develops a “dependency” on his interrogator. And “physical duress, violence and torture” are used to weaken “mental and physical ability to resist exploitation.” Ironically, perhaps, the SERE document (displayed below) notes that such techniques were used by the Soviet Union, China and North Korea to obtain false confessions.

  • According to Al Jazeera’s sources, Zain Abidin Mohammed Husain Abu Zubaydah was the only captive subjected to all 10 torture techniques identified in an August 2002 Justice Department memo. But the U.S. officials said the Senate report concludes that the methods applied to Abu Zubaydah went above and beyond the guidelines outlined in that memo and were used before the memo establishing their legality was written. The Senate report allegedly adopts part of a narrative from former FBI special agent Ali Soufan, who first interrogated Abu Zubaydah at the black site and wrote in his book “The Black Banners” that Mitchell was conducting an “experiment” on Abu Zubaydah. For example, the August 2002 Justice Department legal memo authorized sleep deprivation for Abu Zubaydah for 11 consecutive days, but Mitchell kept him awake far longer, the U.S. officials said, citing classified CIA cables. Abu Zubaydah was stripped naked, strapped into a chair and doused with cold water to keep him awake. He was then interrogated and asked what he knew, at which point, his attorney told Al Jazeera, Abu Zubaydah was “psychotic” and would have admitted to anything.
  • Additionally, the report allegedly says that Abu Zubaydah was stuffed into a pet crate (the type used to transport dogs on airplanes) over the course of two weeks and routinely passed out, was shackled by his wrists to the ceiling of his cell and subjected to an endless loop of loud music. He expects the report to “show that my client was a nonmember of Al-Qaeda, contrary to all of the earlier reports by the Bush administration. I am also confident that the report will show that, after he was deemed to be compliant while he was held in Thailand, that he continued to be tortured on explicit orders from the Bush administration.” The Senate report, according to Al Jazeera’s sources, says that CIA interrogators were under an enormous pressure from top agency officials, themselves under pressure from the White House, to use “enhanced” interrogation techniques to obtain information from detainees connecting Iraq and Al-Qaeda.

US to Detainee: The Government "Regrets Any Hardship" - 0 views

  • In an unusual gesture, the U.S. Government last week apologized to Abdullah al-Kidd, a U.S. citizen who was arrested in 2003 and detained as a material witness in connection with a terrorism-related case. Mr. Al-Kidd, represented by American Civil Liberties Union attorney Lee Gelernt, challenged his detention as unconstitutional and inhumane. Now the case has been settled, with an official apology and a payment of $385,000. “The government acknowledges that your arrest and detention as a witness was a difficult experience for you and regrets any hardship or disruption to your life that may have resulted from your arrest and detention,” wrote U.S. Attorney Wendy J. Olson in a January 15 letter. This sort of admission of regret is rare. The government apologizes much less frequently than it perpetrates injuries that are inappropriate or unwarranted. So, for example, the recent Senate report on post-9/11 CIA interrogation practices noted that at least 26 individuals had been “wrongfully detained.” But legal attempts to recover damages are typically foreclosed by courts based on “separation of powers, national security, and the risk of interfering with military decisions.”
  • Why not apologize and compensate those who have been abused and mistreated, starting with those individuals who by all accounts are innocent of any wrongdoing? It would be the just and honorable thing to do, both for the intelligence community and for the country. And it would be most powerful (and most “therapeutic”) if the IC undertook this step at its own initiative, rather than waiting to be compelled by others. “Personally I agree,” a senior U.S. intelligence community legal official said privately, “for the reasons you say and some others. [But] getting it done is a lot harder.” And so it is. Even as it apologized to Abdullah al-Kidd, the U.S. Government insisted on a stipulation that the settlement of the case “is not, is in no way intended to be, and should not be construed as, an admission of liability or fault on the part of the United States.”

The police portrayals contrast sharply with those of Homan Square detainees and their lawyers, who insist that “if this could happen to someone, it could happen to anyone”. A 30-year-old man named Jose, for example, was one of the few detainees with an attorney present when he surrendered to police. He said officers at the warehouse questioned him even after his lawyer specifically told them he would not speak.

  • The narcotics, vice and anti-gang units operating out of Homan Square, on Chicago’s west side, take arrestees to the nondescript warehouse from all over the city: police data obtained by the Guardian and mapped against the city grid show that 53% of disclosed arrestees come from more than 2.5 miles away from the warehouse. No contemporaneous public record of someone’s presence at Homan Square is known to exist. Nor are any booking records generated at Homan Square, as confirmed by a sworn deposition of a police researcher in late September, further preventing relatives or attorneys from finding someone taken there.
  • But those documents do not tell the entire story of Homan Square. Chicago police have not disclosed any figures at all on people who were detained at Homan Square but never ultimately charged. (Chicago purchased the warehouse in 1995.) “It’s hard to believe that 7,185 arrests is an accurate number of arrestees at Homan Square,” said the University of Chicago’s Futterman. “Even if it were true that less than 1% of Homan arrestees were given access to counsel, that would be abhorrent in and of itself.”

The facility’s use by police has intensified in recent years. Nearly 65% of documented Homan Square arrests since August 2004 took place in the five years since Rahm Emanuel, formerly Barack Obama’s top aide, became mayor. (The Guardian has filed a Foia request with Emanuel’s office to disclose the extent of its involvement in Homan Square.) The 68 documented attorney visits are actually slightly higher, statistically speaking, than the extremely minimal legal access Chicago police provide suspects in custody during the initial stages of their arrest. The 2014 citywide total at declared police stations, according to First Defense Legal Aid, was 0.3%. On face value, the lawyer visit rate at Homan Square, according to the newly disclosed documents, was 0.9% over nearly 11 years.
  • Twenty-two people have told the Guardian that Chicago police kept them at Homan Square for hours and even days. They describe pressure from officers to become informants, and all but two – both white – have said the police denied them phone calls to alert relatives or attorneys of their whereabouts. Their accounts point to violations of police directives, which say police must “complete the booking process” regardless of their interest in interrogating a suspect and must also “allow the arrestee to make a reasonable number of telephone calls to an attorney, family member or friend”, usually within “the first hour” of detention. The most recent disclosure of Homan Square data provides the scale behind those accounts: the demographic trends within the 7,185 disclosed arrests at the warehouse are now far more vast than what the Guardian reported in August after launching the transparency lawsuit – but are consistently disproportionate in terms of race and constitutional access to legal counsel. 82.2% of people detained at Homan Square were black, compared with 32.9% of the Chicago population.
  • Chicago attorneys say they are not routinely turned away from police precinct houses, as they are at Homan Square. The warehouse is also unique in not generating public records of someone’s detention there, permitting police to effectively hide detainees from their attorneys. “Try finding a phone number for Homan to see if anyone’s there. You can’t, ever,” said Gaeger. “If you’re laboring under the assumption that your client’s at Homan, there really isn’t much you can do as a lawyer. You’re shut out. It’s guarded like a military installation.”

  • International Criminal Court (ICC) prosecutor, Fatou Bensouda, has accepted the complaint lodged in January alleging that UK military personnel committed war crimes against Iraqis in their custody between 2003 and 2008. She has ordered a preliminary investigation. It is the first step into a possible criminal prosecution against Britain’s political and military leaders, including politicians, senior civil servants, lawyers, Chief of Defence Staff and Chief of Defence Intelligence, who bear ultimate responsibility for systematic abuse of detainees in Iraq. This is the first time the ICC in The Hague has opened an enquiry into a Western state. Almost all of the ICC’s indictees have been African heads of state or officials.
  • Bensouda’s decision flows from an official complaint by the British Public Interest Lawyers (PIL) and the European Centre for Constitutional and Human Rights (ECCHR) last January. Their 250-page submission, the most detailed ever submitted to the ICC on war crimes committed by British forces in Iraq, took years to compile. In all, the victims made thousands of allegations of mistreatment that amount to war crimes: torture, inhuman or degrading treatment as well as the deliberate infliction of grievous suffering and/or serious injury. They were not dissimilar from those of the infamous US torture at Abu Ghraib prison. The sheer scale of the crimes, committed repeatedly at numerous sites and over a long period, testify to the systematic use of illegal methods of detention and interrogation, sanctioned at the top of the military and political chain.

The war in Afghanistan doesn’t seem to be ending, but renewed under new, scaled-down U.S.-Afghan terms. Factoring in troop rotations, home leave, and breaks between deployments, the service of tens of thousands of American troops would be required to maintain a force of seven to eight thousand for a decade or longer. The anticipated costs would likely run into the billions quickly.

  • Military prosecutors this year learned about a massive cache of CIA photographs of its former overseas “black sites” while reviewing material collected for the Senate investigation of the agency’s interrogation program, U.S. officials said. The existence of the approximately 14,000 photographs will probably cause yet another delay in the military commissions at Guantanamo Bay, Cuba, as attorneys for the defendants demand that all the images be turned over and the government wades through the material to decide what it thinks is relevant to the proceedings.
