DOJ agrees with US Sentencing Commission that child porn guidelines are badly broken - 0 views

    [T]he Department agrees with the Commission's conclusion that advancements in technologies and the evolution of the child pornography "market" have led to a significantly changed landscape -- one that is no longer adequately represented by the existing sentencing guidelines. Specifically, we agree with the Report's conclusion that the existing Specific Offense Characteristics ("SOCs") in USSG § 2G2.2 may not accurately reflect the seriousness of an offender's conduct, nor fairly account for differing degrees of offender dangerousness. The current guidelines can at times under-represent and at times over-represent the seriousness of an offender's conduct and the danger an offender possesses.

    REOFFENDING rates by child pornography users are far below rates for assaults, drink-driving or property damage, with fewer than one in 10 people who download sexual images of minors later convicted of the crime again. Despite community concern about the dangers posed by convicted child pornography users, new Corrections Victoria figures reveal only about 7.5 per cent are found to reoffend. The recidivism rate for those convicted of assault is five times as high, according to comparable data from NSW.

"Sexting": From bad judgment to a registered sex offender - 0 views

    The technological phenomenon of "sexting" has seen such a dramatic increase in popularity that it is now defined in the Merriam Webster Dictionary: "the sending of sexually explicit messages or images by cell phone." Moreover, if you ask a high school student to describe sexting, you may be surprised to hear it is a social norm. In a 2009 survey conducted by the National Campaign to Prevent Teen & Unplanned Pregnancy, twenty percent of teens said they had sexted. That number has since increased to over twenty-five percent. What these students and many others do not know is that sexting could land them on a sex offender registry for life. As a result, their names and reputations could forever be ruined by the simple push of a computer key, or touch of an iPhone.
