Gallup has found that Americans favor marijuana legalization now more than ever. A record-high 50 percent of Americans say the use of marijuana should be made legal, up 4 percent from last year and 14 percent from 2006. Now only 46 percent say marijuana use should remain illegal, according to a poll released Monday. "If this current trend on legalizing marijuana continues, pressure may build to bring the nation's laws into compliance with the people's wishes," Gallup noted.

President-elect Barack Obama offered Americans a unique opportunity to directly relay their concerns to the incoming administration when his change.gov website unveiled its "Open for Questions" tool late last week. The result of that tool's first round of voting may have surprised Obama and his staff: two of the top ten questions -including the highest ranking question - concerned marijuana policy and questions that challenged the drug war in general took 16 of the top 50 spots. Many were disappointed, though unsurprised, by the administration's response to the question that landed in the top slot. When asked whether or not he would "consider legalizing marijuana so that the government [could] tax it, put age limits on it, and create millions of new jobs [and] a billion dollar industry right here in the U.S.," Obama's team responded with a resounding "no," stating simply that the President-elect "is not in favor of the legalization of marijuana."

Everybody knows that if you torture people you don't get good information. It was never about that. Disappearing people and putting them into orange jumpsuits, and into legal black holes and waterboarding them and freezing them and killing detainees was about signaling to the rest of world that you can not challenge or stand up to American power, because if you do, we will respond without constraints, and there is nothing anybody can or will do about it. It was about creating a climate of repression and fear to deter any would-be dissenters or challengers to American power. And that is what this war on whistleblowing and this war on Wikileaks is about as well.

Outside of Islamic governments, Islam poses little threat to the rights of Americans and others. That sounds rather insane to say, but consider that Islam's only threat to America lies in its few radical extremists' ability to cause fear by taking lives. Yet the actual number of lives they take is small compared to even the seasonal flu."

It appears that there is a growing contingent  of marijuana users and people associated with the industry who are fighting against efforts to make it legal for all adults.

Democrat or Republican, Libertarian or Socialist, politically active and not we are reaping the bitter reward of a political and legal system designed to maximize corporate profits at the expense of our environment, our livelihood, and our very lives. Our society is unraveling. We all know this. This is not idle conspiracy theory. These are well established facts. We are ruled by a headless beast that is no longer accountable to us. That it is headless makes it no less beastly. But there is a silver bullet. It's within our power to restore a functioning free market; to take back our democracy. We must end limited liability for corporations. Only when wealthy investors are no longer shielded from the costs that we collectively bear in their stead, only when they can no longer hide from the burden they have placed on us, only then can we expect the end of corporate plunder.   We are running out of time. Millions of Germans lost faith in the free market and capitalism during the Great Depression, and "with the failure of the left to provide a viable alternative, they became vulnerable to the rhetoric of a party that, once it came to power, combined Keynesian pump-priming measures that brought unemployment down to 3 percent with a devastating counterrevolutionary social and cultural program."

United States v. Dougherty was a 1972 decision by the United States Court of Appeals for the District of Columbia in which the court ruled that members of the D.C. Nine, who had broken into Dow Chemical Company, vandalized office furniture and equipment, and spilled about a bloodlike substance, were not entitled to a new trial on the basis of the judge's failing to allow a jury nullification jury instruction. The Appeals Court ruled, by a 2-1 vote: " The fact that there is widespread existence of the jury's prerogative, and approval of its existence as a "necessary counter to casehardened judges and arbitrary prosecutors," does not establish as an imperative that the jury must be informed by the judge of that power. On the contrary, it is pragmatically useful to structure instructions in such wise that the jury must feel strongly about the values involved in the case, so strongly that it must itself identify the case as establishing a call of high conscience, and must independently initiate and undertake an act in contravention of the established instructions. This requirement of independent jury conception confines the happening of the lawless jury to the occasional instance that does not violate, and viewed as an exception may even enhance, the over-all normative effect of the rule of law. An explicit instruction to a jury conveys an implied approval that runs the risk of degrading the legal structure requisite for true freedom, for an ordered liberty that protects against anarchy as well as tyranny. Everything we do is for the purpose of altering consciousness. We form friendships so that we can feel certain emotions, like love, and avoid others, like loneliness. We eat specific foods to enjoy their fleeting presence on our tongues. We read for the pleasure of thinking another person's thoughts. Every waking moment-and even in our dreams-we struggle to direct the flow of sensation, emotion, and cognition toward states of consciousness that we value.Drugs are another means toward this end. Some are illegal; some are stigmatized; some are dangerous-though, perversely, these sets only partially intersect. There are drugs of extraordinary power and utility, like psilocybin (the active compound in "magic mushrooms") and lysergic acid diethylamide (LSD), which pose no apparent risk of addiction and are physically well-tolerated, and yet one can still be sent to prison for their use-while drugs like tobacco and alcohol, which have ruined countless lives, are enjoyed ad libitum in almost every society on earth. There are other points on this continuum-3,4-methylenedioxymethamphetamine (MDMA or "Ecstasy") has remarkable therapeutic potential, but it is also susceptible to abuse, and it appears to be neurotoxic.[1]One of the great responsibilities we have as a society is to educate ourselves, along with the next generation, about which substances are worth ingesting, and for what purpose, and which are not. The problem, however, is that we refer to all biologically active compounds by a single term-"drugs"-and this makes it nearly impossible to have an intelligent discussion about the psychological, medical, ethical, and legal issues surrounding their use. The poverty of our language has been only slightly eased by the introduction of terms like "psychedelics" to differentiate certain visionary compounds, which can produce extraordinary states of ecstasy and insight, from "narcotics" and other classic agents of stupefaction and abuse.

The prominent political and legal blogger Glenn Greenwald comments on the growing Occupy Wall Street movement. "What this movement is about is more important than specific legislative demands. It…is expressing dissent to the system itself," says Greenwald. "It is not a Democratic Party organ. It is not about demanding that President Obama's single [jobs] bill pass or anything along those lines. It is saying that we believe the system itself is radically corrupted, and we no longer are willing to tolerate it. And that's infinitely more important than specific legislative or political demands." Greenwald also discusses the possible shutdown of the online whistleblower website WikiLeaks due to a "financial blockade" led by MasterCard, Visa and PayPal. "The reason why all these companies cut off funds is because the government pressured and demanded that they do so," Greenwald says. "So, no due process, no accusation of criminal activity. You could never charge WikiLeaks with a crime. They're engaged in First Amendment activity. And the government has destroyed them through their pressure and influence over the private sector...
