I have a legal question about the Wikileaks case, prompted by this this Guardian piece, by John Naughton, linked in Henry's comments. I must confess: I wasn't surprised or particularly scandalized when Amazon kicked Wikileaks off its cloud, because I figured Amazon was probably technically in the right. Wikileaks had probably violated whatever terms of service were in place. I thought this sounded like the sort of thing any private company was likely to do, whether or not Joe Lieberman actually brought pressure to bear. If you have a problem customer who has violated your terms of service, you terminate service. (Just to be clear: I think ongoing attempts to shut down Wikileaks in patently legally dodgy ways are an utter scandal. Joe Lieberman pressuring Amazon is a scandal. I'm with Glenn Greenwald. I also think existing intellectual property laws are, by and large, an atrocious mess. Still, the law is what it is, so the question of how a private company like Amazon can and should be expected to react to this sort of situation is narrower than certain other more general questions about free speech and the press and so forth.)

Numerous media outlets -- The New York Times, The Washington Post, The Guardian, The Telegraph, and NPR, among others - last night published classified files on more than 700 past and present Guantanamo detainees. The leak was originally provided to WikiLeaks, which then gave them to the Post, NPR and others; the NYT and The Guardian claim to have received them from "another source" (WikiLeaks suggested the "other source" was Daniel Domscheit-Berg, a former WikiLeaks associate who WikiLeaks claims took, without authorization, many WikiLeaks files when he left). The documents reveal vast new information about these detainees and, in particular, the shoddy and unreliable nature of the "evidence" used (both before and now) to justify their due-process-free detentions. There are several points worth noting about all this:

Pentagon investigators are reportedly still searching for Wikileaks co-founder Julian Assange, who helped release a classified US military video showing a US helicopter gunship indiscriminately firing on Iraqi civilians. The US military recently arrested Army Specialist Bradley Manning, who may have passed on the video to Wikileaks. Manning's arrest and the hunt for Assange have put the spotlight on the Obama administration's campaign against whistleblowers and leakers of classified information. We speak to Daniel Ellsberg, who's leaking of the Pentagon Papers has made him perhaps the nation's most famous whistleblower; Birgitta Jónsdóttir, a member of the Icelandic Parliament who has collaborated with Wikileaks and drafted a new Icelandic law protecting investigative journalists; and Glenn Greenwald, political and legal blogger for Salon.com. Reporters Without Borders condemns the blocking, cyber-attacks and political pressure being directed at cablegate.wikileaks.org, the website dedicated to the US diplomatic cables. The organization is also concerned by some of the extreme comments made by American authorities concerning WikiLeaks and its founder Julian Assange.

Throughout this year I've devoted substantial attention to WikiLeaks, particularly in the last four weeks as calls for its destruction intensified.  To understand why I've done so, and to see what motivates the increasing devotion of the U.S. Government and those influenced by it to destroying that organization, it's well worth reviewing exactly what WikiLeaks exposed to the world just in the last year:  the breadth of the corruption, deceit, brutality and criminality on the part of the world's most powerful factions.

Troops are coming home from Iraq despite the best efforts of the Obama administration to keep them there. "We're relieved to know all the troops will be home at the end of the year. This would not have been possible without the courageous actions of Wikileaks and the alleged participation of Bradley Manning" says Executive Director of Iraq Veterans Against the War, Jose Vasquez. Until their abrupt reversal a few weeks ago, the Obama administration had been working hard to maintain between 8000 and 20,000 troops in Iraq after the current Status of Forces agreement was set to expire at the end of this year. Fortunately, the Iraqi government refused to renew the judicial immunity, under which the U.S. Armed Forces had been operating. Establishment news outlets have largely ignored the reason for this sudden change of plans. A few weeks before the negotiations between Washington and Baghdad reached an impasse, WikiLeaks released a cable providing clear evidence that U.S. forces had been engaged in a cover up of the heinous execution of civilian non-combatants following a raid of a suspected insurgent stronghold. "A U.S. diplomatic cable made public by WikiLeaks provides evidence that U.S. troops executed at least 10 Iraqi civilians, including a woman in her 70s and a 5-month-old infant, then called in an airstrike to destroy the evidence, during a controversial 2006 incident in the central Iraqi town of Ishaqi." WikiLeaks is again publishing a trove of documents, in this case classified U.S. State Department diplomatic cables. The whistle-blower website will gradually be releasing more than 250,000 of these documents in the coming months so that they can be analyzed and gain the attention they deserve. The cables are internal, written communications among U.S. embassies around the world and also to the U.S. State Department. WikiLeaks described the leak as "the largest set of confidential documents ever to be released into the public domain [giving] an unprecedented insight into U.S. government foreign activities."

The soldier in a now-famous WikiLeaks video, who found a rocket launcher at the scene of a controversial 2007 Apache helicopter attack, in Baghdad, said in a radio interview this week that he did not believe an ambush was imminent. The video shows 12 men, including two Reuters newsmen, standing on a street corner before being fired upon by the Apache's 30mm cannon, resulting in what appears to be an unprovoked massacre.

American officials in recent days have warned repeatedly that the release of documents by WikiLeaks could put people's lives in danger. But despite similar warnings before the previous two releases of classified U.S. intelligence reports by the website, U.S. officials concede that they have no evidence to date that the documents led to anyone's death.

Examining WikiLeaks with a transparency advocate and harsh critic of the whistle-blowing site

I am hoping you will reconsider your call to place WikiLeaks on the list of foreign terrorist organizations. I would hope that as chair of the Homeland Security Committee you would take a more responsible approach than many of your Republican and conservative colleagues who are calling for the assassination of Julian Assange.

The largest intel leak in the United States history, has been the most revealing account of any war in history. Over 400,000 classified US military documents on the Iraq war were released by the whistle blowing website WikiLeaks and its founder Julian Assange. Iraq war veteran Josh Steiber says that

Judging by the press accounts, Washington is still buzzing over WikiLeaks' release of classified U.S. government information, with both Republicans and Democrats expressing outrage over the disclosures. Meanwhile, many media outlets seem to be practically mute on the subject, avoiding comment on whether WikiLeaks provided a public service or disservice.

Anonymous called DDoS attacks on Web sites of WikiLeaks foes a symbolic protest, not an effort to disrupt business

Do you believe that it is in Americans' interest to allow a small group of U.S. leaders to unilaterally murder, maim, imprison and/or torture anyone they choose anywhere in the world, without the knowledge let alone oversight of their citizens or the international community? And, despite their proven record of failure to protect America -- from Indochina to Iran to Iraq -- do you believe they should be permitted to clandestinely expand their war-making without informed public debate? If so, you are betraying the principles upon which America was founded, endangering your nation, and displaying a distinctly "unamerican" subservience to unaccountable authority. But if you oppose autocratic power, you are called to support Wikileaks and others trying to limit U.S. Executive Branch mass murder abroad and failure to protect Americans at home.
