    This story from Bloomberg just hit the wires this morning.  Bank of America is shifting derivatives in its Merrill investment banking unit to its depository arm, which has access to the Fed discount window and is protected by the FDIC. What this means for you is that when Europe finally implodes and banks fail, U.S. taxpayers will hold the bag for trillions in CDS insurance contracts sold by Bank of America and JP Morgan.  Even worse, the total exposure is unknown because Wall Street successfully lobbied during Dodd-Frank passage so that no central exchange would exist keeping track of net derivative exposure.

    I'm genuinely excited today to announce the release of my new book, With Liberty and Justice for Some: How the Law is Used to Destroy Equality and Protect the Powerful. As of this morning, it is available in bookstores as well as for shipping online. The book focuses on what I began realizing several years ago is the crucial theme tying together most of the topics I write about: America's two-tiered justice system - specifically, the way political and financial elites are now vested with virtually absolute immunity from the rule of law even when they are caught committing egregious crimes, while ordinary Americans are subjected to the world's largest and one of its harshest and most merciless penal states even for trivial offenses. As a result, law has been completely perverted from what it was intended to be - the guarantor of an equal playing field which would legitimize outcome inequalities - into its precise antithesis: a weapon used by the most powerful to protect their ill-gotten gains, strengthen their unearned prerogatives, and ensure ever-expanding opportunity inequality. This is how I described that development in the book:

John Boehner, Roy Blunt and other "leaders" of the House Republicans thought they could strike a public pose as if they really cared about the credit seizure that looms over the country while secretly hoping to pin the bill's passage on Nancy Pelosi, Steny Hoyer, (and by association, Barack Obama).

  • A fairly typical example comes in the form of a blind quote from a Democratic strategist this morning at The Politico:A huge challenge for Obama, insiders say, is simply determining how much skin color will matter in November. Race is nearly impossible to poll – no one ever says “I’m a racist” – and no campaign wants it revealed they are even asking questions on the issue.
  • As we have described here before, polling numbers from the primaries suggested no presence of a Bradley Effect. On the contrary, it was Barack Obama -- not Hillary Clinton -- who somewhat outperformed his polls on Election Day.

Asked during a phone interview broadcast Monday if she considered her father a hero, she said: "Yes. Because now maybe people will listen." Authorities say Stack, 53, targeted the IRS office building in Austin on Thursday, killing employee Vernon Hunter and himself, after posting a ranting manifesto against the agency and the government. He apparently set fire to his home before flying his plane into the office building. Hunter's son, Ken Hunter, said he's alarmed by comments that the pilot was a hero. "How can you call someone a hero who after he burns down his house, he gets into his plane ... and flies it into a building to kill people?" Hunter told ABC."
