    It is unsurprising that the 9/11 attack fostered a massive expansion of America's already sprawling Surveillance State. But what is surprising, or at least far less understandable, is that this growth shows no signs of abating even as we approach almost a full decade of emotional and temporal distance from that event. The spate of knee-jerk legislative expansions in the immediate aftermath of the 9/11 trauma - the USA-PATRIOT Act - has actually been exceeded by the expansions of the last several years - first secretly and lawlessly by the Bush administration, and then legislatively and out in the open once Democrats took over control of the Congress in 2006. Simply put, there is no surveillance power too intrusive or unaccountable for our political class provided the word "terrorism" is invoked to "justify" those powers.

  • In Cheneyworld, that would be an act of war. So why aren't the Cheneys attacking the German government for its "mindset" problem? Because they have no political interest in weakening that administration, and they do in attacking the American administration. Or they're more scared of Angela Merkel than they are of Barack Obama. Unlike the US, Germany has had a recent successful experience in rolling up a terrorist threat against the country, when the Baader-Meinhof Gang was dealt with as... a criminal conspiracy.     While the Cheneys, father and daughter, continue to hammer away at the accusation that the Obama administration has a "mindset" problem because it (sometimes) chooses to deal with terrorists through the criminal justice system, another bullet-hole has been leveled at their argument by, of all nations, Germany. This isn't France that chose to try terrorist suspects in a civilian criminal court. This is big bad Germany. And these were not just any terrorists. The judge in the case declared, they had dreamed of "mounting a second September 11 2001" by killing US civilians and soldiers by bombing targets like Ramstein Air Base. They were accused of operating as a German cell of the radical al-Qaeda-linked group, the Islamic Jihad Union.

    Over the past couple years, I've written numerous times about the serious left-right coalition that had emerged in Britain -- between the Tories and Liberal Democrats -- in opposition to the Labour Government's civil liberties abuses, many (thought not all) of which were justified by Terrorism. In June of 2008, David Davis, a leading Tory MP, resigned from Parliament in protest of the Government's efforts to expand its power of preventive detention to 42 days (and was then overwhelmingly re-elected on a general platform of opposing growing surveillance and detention authorities). Numerous leading figures from both the Right and Left defied their party's establishment to speak out in support of Davis and against the Government's growing powers. Back then, the Liberal Democrats' Leader, Nick Clegg, notably praised the right-wing Davis' resignation, and to show his support for Davis' positions, Clegg even refused to run a Lib Dem candidate for that seat because, as he put it, "some issues 'go beyond party politics'."
