A Rose By Any Other Name Or Speak No Evil, See No Evil, Hear No Evil Things have been a little quiet on the healthcare debate front over the past day or two, but the 800 pound gorilla is still in the room and is still very much alive and well. During this short lull I wanted to take a look at the critical public option piece for the program, and the fact that it is apparently losing its luster with many on the near left as a it remains a huge impediment to any legislation having a chance of being passed. And not getting something passed will doom the democrats in mid-term elections...

The Framers knew about corporations but chose not to mention these contrived entities in the Constitution. For them, the document shielded living beings from arbitrary government and endowed them with the right to speak, assemble, and petition. Today, however, corporations enjoy virtually the same umbrella of constitutional protections as individuals do. They have become in effect artificial persons with infinitely greater power than humans. This constitutional equivalence must end. Consider a few noxious developments during the last 10 years. A group of large Boston companies invoked the First Amendment in order to spend lavishly and thus successfully defeat a referendum that would have permitted the legislature to enact a progressive income tax that had no direct effect on the property and business of these companies. An Idaho electrical and plumbing corporation cited the Fourth Amendment and deterred a health and safety investigation. A textile supply company used Fifth Amendment protections and barred retrial in a criminal anti-trust case in Texas. The idea that the Constitution should apply to corporations as it applies to humans had its dubious origins in 1886. The Supreme Court said it did "not wish to hear argument" on whether corporations were "persons" protected by the 14th Amendment, a civil rights amendment designed to safeguard newly emancipated blacks from unfair government treatment. It simply decreed that corporations were persons. Now that is judicial activism. A string of later dissents, by Justices Hugo Black and William O. Douglas, demonstrated that neither the history nor the language of the 14th Amendment was meant to protect corporations. But it was too late. The crash has laid bare many unpleasant truths about the United States. One of the most alarming, says a former chief economist of the International Monetary Fund, is that the finance industry has effectively captured our government-a state of affairs that more typically describes emerging markets, and is at the center of many emerging-market crises. If the IMF's staff could speak freely about the U.S., it would tell us what it tells all countries in this situation: recovery will fail unless we break the financial oligarchy that is blocking essential reform. And if we are to prevent a true depression, we're running out of time.

It's become a TV ritual: Every year in mid-January, around the time of Martin Luther King's birthday, we get perfunctory network news reports about "the slain civil rights leader." The remarkable thing about this annual review of King's life is that several years - his last years - are totally missing, as if flushed down a memory hole. What TV viewers see is a closed loop of familiar file footage: King battling desegregation in Birmingham (1963); reciting his dream of racial harmony at the rally in Washington (1963); marching for voting rights in Selma, Alabama (1965); and finally, lying dead on the motel balcony in Memphis (1968). An alert viewer might notice that the chronology jumps from 1965 to 1968. Yet King didn't take a sabbatical near the end of his life. In fact, he was speaking and organizing as diligently as ever. Almost all of those speeches were filmed or taped. But they're not shown today on TV.

The death of Osama bin Laden has sparked a debate over whether torture of suspects held at places such as the U.S. military base at Guantánamo Bay helped track down and kill the al-Qaeda leader. Some claim the mission vindicated controversial Bush policies on harsh interrogation techniques. We speak with Matthew Alexander, a former senior military interrogator in Iraq. "The laying of the groundwork, if you will, of these [Bush-era] techniques, I believe wholeheartedly, slowed us down on the road towards Osama bin Laden and numerous other members of al-Qaeda," Alexander says. "I'm convinced we would have found him a lot earlier had we not resorted to torture and abuse." [includes rush transcript]

law enforcement official says the FBI has opened an investigation into allegations media mogul Rupert Murdoch's News Corp. sought to hack into the phones of Sept. 11 victims. The official spoke Thursday to The Associated Press on condition of anonymity because he wasn't authorized to speak publicly. New York City-based News Corp. has been in crisis mode because of a scandal that sank its UK newspaper the News of the World. A rival newspaper reported last week the News of the World had hacked into the phone of UK teenage murder victim Milly Dowler in 2002 and may have impeded a police investigation into her disappearance. More possible victims soon emerged, including former Prime Minister Gordon Brown. Murdoch says his media company will recover from any damage wrought by the phone-hacking and police bribery allegations. The FBI's New York office hasn't commented.

"Never has the time been so right," Louisiana State Representative Noble Ellington told conservative legislators gathered in Washington to plan the radical remaking of policies in the states. It was one month after the 2010 midterm elections. Republicans had grabbed 680 legislative seats and secured a power trifecta-control of both legislative chambers and the governorship-in twenty-one states. Ellington was speaking for hundreds of attendees at a "States and Nation Policy Summit," featuring GOP stars like Texas Governor Rick Perry, former House Speaker Newt Gingrich and House Majority Leader Eric Cantor. Convened by the American Legislative Exchange Council (ALEC)-"the nation's largest, non-partisan, individual public-private membership association of state legislators," as the spin-savvy group describes itself-the meeting did not intend to draw up an agenda for the upcoming legislative session. That had already been done by ALEC's elite task forces of lawmakers and corporate representatives. The new legislators were there to grab their weapons: carefully crafted model bills seeking to impose a one-size-fits-all agenda on the states.

Opponents of hydraulic "fracking" say it pollutes water and causes illness. Actor, activist (and newly-minted Countdown contributor) Mark Ruffalo joins Keith to discuss the lucrative practice that potentially threatens supplies of drinking water, and why so many have their heads in the sand. "This is an industry that is the dirtiest, slimiest, most arrogant, and negligent that you can imagine," Ruffalo says. Ruffalo also talks about rumors of blacklisting actors who speak out on political matters, and ponders why he was singled out by CNN to comment on it.  "You can do what's right or you can put your head in the sand," Ruffalo tells Keith, shortly before Keith bestows the ultimate Countdown honor -- welcoming Ruffalo into the ranks of official on-air contributors.

It's sometimes useful to see ourselves as others do, and reports this Independence Day weekend in a couple of English-speaking newspapers usually sympathetic to the United States are sobering.

While politicians from Athens to Washington are pushing through devastating austerity programs, Argentines voted in droves Sunday to re-elect their populist, welfare queen of a president, Cristina Fernandez de Kirchner. Fernandez is the widow of Nestor Kirchner, who died a year ago after winning the award for world's best husband (Nestor decided not to run for re-election so that his wife could take a turn). But before he left office, Nestor Kirchner infuriated global elites by defaulting on Argentina's $95 billion foreign debt. Greece, facing an external debt load five to six times that amount, has decided instead to severely cut back on public spending while it works with other governments to address its debt crisis. Argentina, on the other hand, pumped money into subsidies and social programs. And while the rest of the world has been circling the drain, financially speaking, Argentina's economy has been booming, with GDP growing last year by more than 9 percent. There are a lot of learned fellows who don't approve of the economic policies of Nestor and Cristina Kirchner, but the undisputed result in the short term is a thriving economy and a landslide re-election.  −PZS
