Section 17 of the Bill of Rights provides for rights to conduct peaceful and unarmed activities such as assembly, demonstrations, pickets and petitions. Political protest also involves imparting related information, and this right is guaranteed by the section regarding freedom of expression (Section 16 of the Bill of Rights). Although the right to political protest is protected by the Constitution, this right may be limited by principle. Activists must remember that none of the fundamental rights and freedoms guaranteed by the Bill of Rights are absolute. The Constitution gives government the power to limit these rights. Section 36 of the Bill, however, says the limitation of fundamental rights or freedoms must be reasonable and justifiable in an open and democratic society based on human dignity, equality and freedom. The Following Abstracts from the Bill of Rights Might Apply To Any On-Line Protest Section 15: Freedom of religion, belief and opinion Everyone has the right to believe or think what they want, even if their opinion is different to the government. Everyone has the right to practise the religion they choose. Government institutions, like schools, can follow religious practices (like having prayers in the morning) but this must be done fairly and people cannot be forced to attend them. A person can also get married under the laws of their religion. But these cannot go against the Bill of Rights. For example, a woman who marries according to customary law does not lose her rights of equality when she gets married. Which is not to say that the Obama era has meant an end to law enforcement. On the contrary: In the past few years, the administration has allocated massive amounts of federal resources to catching wrongdoers - of a certain type. Last year, the government deported 393,000 people, at a cost of $5 billion. Since 2007, felony immigration prosecutions along the Mexican border have surged 77 percent; nonfelony prosecutions by 259 percent. In Ohio last month, a single mother was caught lying about where she lived to put her kids into a better school district; the judge in the case tried to sentence her to 10 days in jail for fraud, declaring that letting her go free would "demean the seriousness" of the offenses. So there you have it. Illegal immigrants: 393,000. Lying moms: one. Bankers: zero. The math makes sense only because the politics are so obvious. You want to win elections, you bang on the jailable class. You build prisons and fill them with people for selling dime bags and stealing CD players. But for stealing a billion dollars? For fraud that puts a million people into foreclosure? Pass. It's not a crime. Prison is too harsh. Get them to say they're sorry, and move on. Oh, wait - let's not even make them say they're sorry. That's too mean; let's just give them a piece of paper with a government stamp on it, officially clearing them of the need to apologize, and make them pay a fine instead. But don't make them pay it out of their own pockets, and don't ask them to give back the money they stole. In fact, let them profit from their collective crimes, to the tune of a record $135 billion in pay and benefits last year. What's next? Taxpayer-funded massages for every Wall Street executive guilty of fraud?

The rapid and terrifying acceleration of global warming, which is disfiguring the ecosystem at a swifter pace than even the gloomiest scientific studies predicted a few years ago, has been confronted by the power elite with two kinds of self-delusion. There are those, many of whom hold elected office, who dismiss the science and empirical evidence as false. There are others who accept the science surrounding global warming but insist that the human species can adapt. Our only salvation-the rapid dismantling of the fossil fuel industry-is ignored by both groups. And we will be led, unless we build popular resistance movements and carry out sustained acts of civil disobedience, toward collective self-annihilation by dimwitted pied pipers and fools.

The Money Party is a small group of enterprises and individuals who have most of the money in this country. They use that money to make more money. Controlling who gets elected to public office is the key to more money for them and less for us. As 2008 approaches, The Money Party is working hard to maintain its perfect record. It is not about Republicans versus Democrats. Right now, the Republicans do a better job taking money than the Democrats. But The Money Party is an equal opportunity employer. They have no permanent friends or enemies, just permanent interests. Democrats are as welcome as Republicans to this party. It's all good when you're on the take and the take is legal. This is not a conspiracy theory. There are no secret societies or sinister operators. This party is up front and in your face. Just follow the money. One percent of Americans hold 33% of the nation's wealth. The top 10% hold 72% of the total wealth. The bottom 40% of Americans control only 0.3% (three tenths of one percent). And that was before "pay day loans."

A whopping 70,000 questions poured into Change.gov over the past week, in response to the Obama transition team's call for citizen queries to the President-Elect. After votes from about 100,000 people, the top ranked question asks Obama whether he will appoint a special prosecutor to investigate allegations of torture and illegal surveillance by the U.S. government. I've been working with activist Bob Fertik to organize support for the question, and several progressive bloggers urged readers and Obama supporters to vote for it last week. Digby, who has written extensively about the Bush administration's abuse of the rule of law, recently reported on the progress:

"Never has the time been so right," Louisiana State Representative Noble Ellington told conservative legislators gathered in Washington to plan the radical remaking of policies in the states. It was one month after the 2010 midterm elections. Republicans had grabbed 680 legislative seats and secured a power trifecta-control of both legislative chambers and the governorship-in twenty-one states. Ellington was speaking for hundreds of attendees at a "States and Nation Policy Summit," featuring GOP stars like Texas Governor Rick Perry, former House Speaker Newt Gingrich and House Majority Leader Eric Cantor. Convened by the American Legislative Exchange Council (ALEC)-"the nation's largest, non-partisan, individual public-private membership association of state legislators," as the spin-savvy group describes itself-the meeting did not intend to draw up an agenda for the upcoming legislative session. That had already been done by ALEC's elite task forces of lawmakers and corporate representatives. The new legislators were there to grab their weapons: carefully crafted model bills seeking to impose a one-size-fits-all agenda on the states.
