EFF to Court: U.S. Warrants Don't Apply to Overseas Emails | Electronic Frontier Founda... - 0 views

  • The Electronic Frontier Foundation (EFF) has urged a federal court to block a U.S. search warrant ordering Microsoft to turn over a customer's emails held in an overseas server, arguing that the case has dangerous privacy implications for Internet users everywhere. The case started in December of last year, when a magistrate judge in New York signed a search warrant seeking records and emails from a Microsoft account in connection with a criminal investigation. However, Microsoft determined that the emails the government sought were on a Microsoft server in Dublin, Ireland. Because a U.S. judge has no authority to issue warrants to search and seize property or data abroad, Microsoft refused to turn over the emails and asked the magistrate to quash the warrant. But the magistrate denied Microsoft's request, ruling there was no foreign search because the data would be reviewed by law enforcement agents in the U.S.
  • Microsoft appealed the decision. In an amicus brief in support of Microsoft, EFF argues the magistrate's rationale ignores the fact that copying the emails is a "seizure" that takes place in Ireland. "The Fourth Amendment protects from unreasonable search and seizure. You can't ignore the 'seizure' part just because the property is digital and not physical," said EFF Staff Attorney Hanni Fakhoury. "Ignoring this basic point has dangerous implications – it could open the door to unfounded law enforcement access to and collection of data stored around the world."

NSA Spying Relies on AT&T's 'Extreme Willingness to Help' - ProPublica - 0 views

  • he National Security Agency’s ability to spy on vast quantities of Internet traffic passing through the United States has relied on its extraordinary, decades-long partnership with a single company: the telecom giant AT&T. While it has been long known that American telecommunications companies worked closely with the spy agency, newly disclosed NSA documents show that the relationship with AT&T has been considered unique and especially productive. One document described it as “highly collaborative,” while another lauded the company’s “extreme willingness to help.”
  • AT&T’s cooperation has involved a broad range of classified activities, according to the documents, which date from 2003 to 2013. AT&T has given the NSA access, through several methods covered under different legal rules, to billions of emails as they have flowed across its domestic networks. It provided technical assistance in carrying out a secret court order permitting the wiretapping of all Internet communications at the United Nations headquarters, a customer of AT&T. The NSA’s top-secret budget in 2013 for the AT&T partnership was more than twice that of the next-largest such program, according to the documents. The company installed surveillance equipment in at least 17 of its Internet hubs on American soil, far more than its similarly sized competitor, Verizon. And its engineers were the first to try out new surveillance technologies invented by the eavesdropping agency. One document reminds NSA officials to be polite when visiting AT&T facilities, noting: “This is a partnership, not a contractual relationship.” The documents, provided by the former agency contractor Edward Snowden, were jointly reviewed by The New York Times and ProPublica.
  • It is not clear if the programs still operate in the same way today. Since the Snowden revelations set off a global debate over surveillance two years ago, some Silicon Valley technology companies have expressed anger at what they characterize as NSA intrusions and have rolled out new encryption to thwart them. The telecommunications companies have been quieter, though Verizon unsuccessfully challenged a court order for bulk phone records in 2014. At the same time, the government has been fighting in court to keep the identities of its telecom partners hidden. In a recent case, a group of AT&T customers claimed that the NSA’s tapping of the Internet violated the Fourth Amendment protection against unreasonable searches. This year, a federal judge dismissed key portions of the lawsuit after the Obama administration argued that public discussion of its telecom surveillance efforts would reveal state secrets, damaging national security.

'UK surveillance is worse than 1984' says UN privacy chief (Wired UK) - 0 views

  • The UN's newly appointed special rapporteur on privacy, Joseph Cannataci, has described digital surveillance in the UK as "worse" than anything imagined in George Orwell's totalitarian dystopia 1984.Speaking to the Guardian, Cannataci -- who doesn't own a Facebook account or use Twitter -- lambasted the oversight of British digital surveillance as "a rather bad joke at its citizens' expense".Warning against the steady erosion of privacy and increasing levels of government intrusion, he also drew sinister parallels with Orwell's vision of a mass-surveilled society, adding that today's reality was far worse than the fiction: "At least Winston [a character in Orwell's 1984] was able to go out in the countryside and go under a tree and expect there wouldn't be any screen, as it was called. Whereas today there are many parts of the English countryside where there are more cameras than George Orwell could ever have imagined."

  • The head of the National Security Agency on Thursday told Senate lawmakers that preventing his agency from collecting Americans’ information in bulk would make it harder to do its job.Under questioning before the Senate Intelligence Committee, Adm. Michael Rogers agreed that ending bulk collection would “significantly reduce [his] operational capabilities.”ADVERTISEMENT“Right now, bulk collection gives us the ability ... to generate insights as to what’s going on,” Rogers told the committee.The NSA head also referenced a January report from the National Academy of Sciences that concluded there is “no software technique that will fully substitute for bulk collection” because of the ability to search through the storehouse of old information. “That independent, impartial, scientifically-founded body came back and said no, under the current structure there is no real replacement,” Rogers said.Rogers was questioned on Thursday by Sen. Ron Wyden (D-Ore.), a member of the Intelligence Committee who has become its most vocal privacy hawk.

Fourth Circuit adopts mosaic theory, holds that obtaining "extended" cell-site records ... - 0 views

  • A divided Fourth Circuit has ruled, in United States v. Graham, that “the government conducts a search under the Fourth Amendment when it obtains and inspects a cell phone user’s historical [cell-site location information] for an extended period of time” and that obtaining such records requires a warrant. The new case creates multiple circuit splits, which may lead to Supreme Court review. Specifically, the decision creates a clear circuit split with the Fifth and Eleventh Circuits on whether acquiring cell-site records is a search. It also creates an additional clear circuit split with the Eleventh Circuit on whether, if cell-site records are protected, a warrant is required. Finally, it also appears to deepen an existing split between the Fifth and Third Circuits on whether the Stored Communications Act allows the government to choose whether to obtain an intermediate court order or a warrant for cell-site records. This post will cover the reasoning of the new case in detail.

  • Abstract HTML4 and CSS2 currently support media-dependent style sheets tailored for different media types. For example, a document may use sans-serif fonts when displayed on a screen and serif fonts when printed. ‘screen’ and ‘print’ are two media types that have been defined. Media queries extend the functionality of media types by allowing more precise labeling of style sheets. A media query consists of a media type and zero or more expressions that check for the conditions of particular media features. Among the media features that can be used in media queries are ‘width’, ‘height’, and ‘color’. By using media queries, presentations can be tailored to a specific range of output devices without changing the content itself.
  • There must be at least two interoperable implementations. For the purposes of this criterion, we define the following terms: interoperable passing the respective test case(s) in the CSS test suite, or, if the implementation is not a Web browser, an equivalent test. Every relevant test in the test suite should have an equivalent test created if such a user agent (UA) is to be used to claim interoperability. In addition if such a UA is to be used to claim interoperability, then there must one or more additional UAs which can also pass those equivalent tests in the same way for the purpose of interoperability.     While the candidate Media Queries specification is interesting and a small step in the right direction, W3C continues to butcher the meaning of "interoperability." In this latest sleight of hand, we now have "interoperable" *user agents*, a term of art used by W3C for implementations that only receive and cannot return data, e.g., web browsers. But under competition law, "interoperability" requires implementations that can exchange data and *mutually* use data that has been exchanged. See e.g., European Commission v. Microsoft, European Community Court of First Instance (Grand Chamber Judgment of 17 September, 2007), para. 230, 374, 421, http://tinyurl.com/23md42c (rejecting Microsoft's argument that "interoperability" has a 1-way rather than 2-way meaning; "Directive 91/250 defines interoperability as 'the ability to exchange information and *mutually* to use the information which has been exchanged'") (emphasis added). W3C --- the World Wide Web Conspiracy --- continues down its rut of broadcasting information whilst denying the world the power to round-trip the data received. Incredibly, in its latest assault on the meaning of "interoperability", W3C no longer defines "conformance" but redefines the term "interoperability" as its substitute for "conformance." As though W3C could redefine the law?

    The company halted its work on Wave, but aspects of its radical approach to communication have been reincarnated for business collaboration. When Google Wave launched in 2009, the company suggested the program was a "new category" of communication because it combined the virtues of e-mail, instant messaging, and methods for sharing pictures, links, and other documents. Among its other features, Wave went a step beyond IM by letting people see what their message partners were writing as they typed it. That meant that the people on the receiving end of your messages would see characters appear onscreen even before you had finished formulating a sentence. It was a radical approach. I tried Wave myself and found it very distracting to watch people type, delete, retype, and misspell their thoughts. People I had persuaded to try it with me never signed in again, unsure as to how it was useful. We weren't alone in our confusion: last year, Google announced it would stop developing Wave. And yet, Google Wave lives on-in business software.

AT&T Centennial Purchase Cleared by Antitrust Agency (Update1) - Bloomberg.com - 0 views

  • AT&T Inc.’s purchase of Centennial Communications Corp. was approved by the U.S. Justice Department on condition the combined company sells wireless assets in Louisiana and Mississippi. AT&T, based in Dallas, agreed to purchase Wall, New Jersey-based Centennial last November for $945 million. Centennial has wireless customers in Puerto Rico and rural areas in the Midwest and Southeast.
  • The deal still awaits approval by the Federal Communications Commission. Ruth Milkman, who heads the FCC’s wireless bureau, told a news conference today the agency will make a decision on the combination “very soon.” The Justice Department said it has cooperated with the FCC in reviewing the deal.
  • In recent months, the FCC has been asking the companies about their connections to America Movil, which has customers in Puerto Rico.   • So it makes sense that Firefox 3.5 called its rendering engine TraceMonkey, and with it has made the browser more than twice as fast as Firefox 3, by our own measurements. Using the SunSpider Javascript benchmark tool on a Windows PC, Firefox 3.5 scored 1,426ms, which is significantly faster than Firefox 3 which scored 3,250ms. Safari 4 and Chrome 2 scored 910ms and 709ms respectively. The average user will not find the previous version slow, and so may not notice version 3.5 working much harder. But it is, and pages are loading closer to the speed of Chrome now.

      uh oh.  I'm not so worried about IE specific features or Silverlight only features as i am about MOSS 2010 specific features (MSOffice desktop and SharePoint-SQL Server).  Especially critical will be the OLE, VBA scripting, and data bindings feature sets. How will Microsoft move these stalwarts of the local MOPE (Microsoft Productivity Environment and Client/Server WorkGroup) to the Web?  The end game here is for Microsoft to successfully move the desktop MOPE "Point of Assembly" to a Web centered SharePoint-SQL Server MOPE.  And cut Oracle out in the process.

    Move over Flipboard, Push Pop and TreeSaver.  Here comes OnSwipe.  Packaging a Web site for a highly interactive and mobile world just got easier. excerpt: OnSwipe does something web developers should have been racing to accomplish ever since the iPad was first unveiled: it makes a website -- any website -- into a tablet-friendly experience. (It's already available to everyone who publishes their blog on Wordpress.com.) It uses HTML5 to make a site feel like an app, even though it's running in the browser. Onswipe points to a future of tablet media delivery that is incredibly simple, even boring: Websites that are designed to look good on tablets. Given the history of creating alternate designs for sites in order to make them mobile-friendly, why anyone ever imagined it would be otherwise is baffling. Probably, it was wishful thinking. IPad magazine app sales are tanking. Media aggregation apps like Flipboard and Zite are re-atomizing publishers' content into pleasurable, full-screen, mostly ad-free experiences. The great do-over that tablets were to represent for publishers like Condé Nast -- a chance to put the free-content genie back in the bottle, and charge for admission -- appears to have gone bust. Onswipe and the startups that will inevitably follow in its wake are the final nail in the coffin of the dream of appification of magazines and other media content

  • A federal appeals court on Friday upheld the Federal Communications Commission’s effort to convert its $4.5 billion program that pays for telephone service in rural parts of the country into one that subsidizes high-speed Internet service in high-cost areas.The program, known as Connect America, is the largest portion of the $8 billion Universal Service Fund, which pays for a variety of efforts to provide telecommunications links to schools, low-income families and others.In October 2011, the F.C.C. approved an overhaul of the fund. Soon after its approval, however, the effort was challenged in court by dozens of phone companies. Many were small carriers that provided service in rural areas and that stood to lose annual subsidies because of the changes.The United States Court of Appeals for the Tenth Circuit, in Denver, rejected the phone companies’ arguments because their claims were “either unpersuasive or barred from judicial review.”
