  • if  the mug is already yours (and you have to set a sell price)  you’ll think it’s worth a lot more than a similar mug that isn’t yet yours  (on which you have to place a “willing to purchase it” price.)  One way to think of this is as an instance of loss aversion.  You’ve got your precious mug in hand and you don’t want to lose it.  It means a lot to you.   And so you set a very high price on it.  That is,  people tend to value things they already have and might lose, much more highly than things they don’t have, but could get.

Rational Irrationality: Do Good Kindergarten Teachers Raise their Pupils' Wages? : The ... - 0 views

  • Columnist David Leonhardt reports the findings of a new study which suggests that children who are fortunate enough to have an unusually good kindergarten teacher can expect to make roughly an extra twenty dollars a week by the age of twenty-seven.

  • The new research (pdf), the work of six economists—four from Harvard, one from Berkeley, and one from Northwestern—upends this finding. It is based on test scores and demographic data from a famous experiment carried out in Tennessee during the late nineteen-eighties, which tracked the progress of about 11,500 students from kindergarten to third grade. Most of these students are now about thirty years old, which means they have been working for up to twelve years. The researchers also gained access to income-tax data and matched it up with the test scores. Their surprising conclusion is that the uplifting effect of a good kindergarten experience, after largely disappearing during a child’s teen years, somehow reappears in the adult workplace. (See Figure 7 in the paper.) Why does this happen? The author don’t say, but Leonhardt offers this explanation: “Good early education can impart skills that last a lifetime—patience, discipline, manners, perseverance. The tests that 5-year-olds take may pick up these skills, even if later multiple-choice tests do not.”

  • However, as I read the story and the findings it is based upon, some questions crept into my mind. I relate them not out of any desire to discredit the study, which is enterprising and newsworthy, but simply as a warning to parents and policymakers not to go overboard.
  • from a dense academic article that hasn’t been published or peer reviewed. At this stage, there isn’t even a working paper detailing how the results were arrived at: just a set of slides. Why is this important? Because economics is a disputatious subject, and surprising empirical findings invariably get challenged by rival groups of researchers. The authors of the paper include two rising stars of the economics profession—Berkeley’s Emmanuel Saez and Harvard’s Raj Chetty—both of whom have reputations for careful and rigorous work. However, many other smart researchers have had their findings overturned. That is how science proceeds. Somebody says something surprising, and others in the field try to knock it down. Sometimes they succeed; sometimes they don’t. Until that Darwinian process is completed, which won’t be for another couple of years, at least, the new findings should be regarded as provisional.
  • A second point, which is related to the first, concerns methodology. In coming up with the $320,000 a year figure for the effects that kindergarten teachers have on adult earnings, the authors make use of complicated statistical techniques, including something called a “jack knife regression.” Such methods are perfectly legitimate and are now used widely in economics, but their application often adds an additional layer of ambiguity to the findings they generate. Is this particular statistical method appropriate for the task at hand? Do other methods generate different results? These are the sorts of question that other researchers will be pursuing.

We have developed these practices and institutions by building upon habits and institutions which have proved successful in their own sphere and which have in turn become the foundation of the civilization we have built up.
  • To assume all the knowledge to be given to a single mind in the same manner in which we assume it to be given to us as the explaining economists is to assume the problem away and to disregard everything that is important and significant in the real world.
  • That an economist of Professor Schumpeter's standing should thus have fallen into a trap which the ambiguity of the term "datum" sets to the unwary can hardly be explained as a simple error. I am far from denying that in our system equilibrium analysis has a useful function to perform. But when it comes to the point where it misleads some of our leading thinkers into believing that the situation which it describes has direct relevance to the solution of practical problems, it is high time that we remember that it does not deal with the social process at all and that it is no more than a useful preliminary to the study of the main problem.

  • Michael Hor noted that despite the vocal attempts to demonise gay people and paint homosexual orientation as injurious (including by some members of the ruling party) the government did not subscribe to such reasoning. Yet the government chose to keep the law.
  • The “key speech arguing for the retention of 377A” that Hor refers to was that made by Thio. Hor then goes on to discover that the government’s decision was bi-layered. The surface justification, going by the prime minister’s words, was that it would be symbolic — a “signpost of heterosexual orthodoxy”. Hor next asks what the motivation might be for wanting such a symbol. He examines the possibility that it could be to steer people towards heterosexual orientation, yet the government itself, from its own words, does not believe so.
  • As was well-known, the anti-gay movement was religiously inspired. The government however was neither dictated nor swayed by them, Hor said. In fact, the government “roundly rejected” the movement’s essential beliefs. Still, it appears that the government did not want to annoy them any further by leaving them empty-handed. That motivation alone made the government decide to retain 377A.

  • But, Hor points out, Page 340: to give legislative effect to a norm which stems almost exclusively from Christian or Muslim beliefs does appear to be a curiously misguided decision. Take the example of the prohibition against eating pork — certainly a tenet of Islam and Judaism. No one would even suggest that we enact a law banning the consumption of pork in Singapore, even for Muslims, no matter how strongly these two religious communities feel about it.
  • With reference to the constitutional guarantee of equality before the law, Hor explains that this provision requires that, Page 340: law must not be “arbitrary”; there must be a “rational nexus” or “reasonable classification” between what the law targets and the purpose for which it is laid down.

If, as we have seen, the legislature was acting in some manner on the antipathy of certain segments of society towards homosexual activity, then the non-inclusion of women in 377A is a very huge omission indeed — more than half our population and presumably half of all homosexual activity.  It would be akin to subjecting half all our cars to a certain speed limit rule based on the colour of the car.
  • The element of “weight” is no less shaky. Can the sole purpose of accommodation of sectarian sensibilities ever be weighty enough to justify the criminalization of private sexual conduct between consenting adults? If the answer is “yes”, then it is hard to imagine for what earthly purpose the equal protection clause was written into the Constitution for. Equal protection is about protection against prejudice, and if the government does not buy into the substantive arguments (of those who disapprove) for criminalization, then those putative reasons become, as far as the government is concerned, prejudice.

    In Chapter 19 of a new book Management of Success, Singapore revisited, National University of Singapore law professor Michael Hor makes a strong argument that Section 377A of the Penal Code is unconstitutional. This is the law that makes it an offence for men to have sexual relations with each other, effectively criminalising male homosexuality.

  • ‘scientism’ has become a favorite of critics of the scientific method. Accusations of scientism, which are largely unjustified, can be heard from proponents of alternative medicine, homeopathic practitioners and everyone in between.
  • Scientism is an umbrella term for a group of extreme attitudes towards science. For example, in his article “What is Scientism?”, Mikael Stenmark defines rationalistic scientism as the view that we are rationally entitled to believe only what can be scientifically proven, or what is scientifically knowable. Other forms of scientism offer variations on a basic idea which will serve as our definition of scientism: the view that in the future, all or nearly all of our real problems can and will be solved by science. Some of the implications of this idea are that problems which are not solved by science, or can not be put into scientific terms, aren’t important problems and that scientific knowledge is the only knowledge that exists.
  • Carl Sagan once said that humans are simply a “collection of almost identical molecules.” It is difficult for most people, who perceive themselves as thinking, feeling human beings, to reduce their existence in such a way. Can science really answer every question about our reality and render all other forms of inquiry meaningless? Few people will deny the effectiveness of the methods employed in the natural sciences for explaining the world around us. If a better method were discovered, it would be immediately adopted by scientists, since that is the nature of the scientific enterprise. But to stretch these methods to areas that normally wouldn’t be considered a part of the sciences, and claim that that is the only way to study said areas, is to step from science into scientism. Under this criterion, philosophy, religion, art and many other areas of human interest would all be effectively stripped of much of their significance.

  • Science, then, has its limits, but when dealing with claims that are testable within the methods of science, such as medical claims, to demand scientific evidence is simply to hold everyone to the same standards as the scientific community holds itself to. To cry scientism in this case shows disregard for the scientific method.

How wise are crowds? - 0 views

That made the models easier to deal with mathematically, but it also made them less representative of the real world.

There’s debate among economists and information theorists about which of these two conditions better reflects reality, and Kleinberg suggests that the answer may vary depending on the type of information propagating through the network. But previous models had suggested that, if there is a cap, information cascades are almost inevitable.

Rationally Speaking: The sorry state of higher education - 0 views

  • two disconcerting articles crossed my computer screen, both highlighting the increasingly sorry state of higher education, though from very different perspectives. The first is “Ed Dante’s” (actually a pseudonym) piece in the Chronicle of Higher Education, entitled The Shadow Scholar. The second is Gregory Petsko’s A Faustian Bargain, published of all places in Genome Biology.
  • There is much to be learned by educators in the Shadow Scholar piece, except the moral that “Dante” would like us to take from it. The anonymous author writes:“Pointing the finger at me is too easy. Why does my business thrive? Why do so many students prefer to cheat rather than do their own work? Say what you want about me, but I am not the reason your students cheat.
  • The point is that plagiarism and cheating happen for a variety of reasons, one of which is the existence of people like Mr. Dante and his company, who set up a business that is clearly unethical and should be illegal. So, pointing fingers at him and his ilk is perfectly reasonable. Yes, there obviously is a “market” for cheating in higher education, and there are complex reasons for it, but he is in a position similar to that of the drug dealer who insists that he is simply providing the commodity to satisfy society’s demand. Much too easy of a way out, and one that doesn’t fly in the case of drug dealers, and shouldn’t fly in the case of ghost cheaters.

  • As a teacher at the City University of New York, I am constantly aware of the possibility that my students might cheat on their tests. I do take some elementary precautionary steps
  • Still, my job is not that of the policeman. My students are adults who theoretically are there to learn. If they don’t value that learning and prefer to pay someone else to fake it, so be it, ultimately it is they who lose in the most fundamental sense of the term. Just like drug addicts, to return to my earlier metaphor. And just as in that other case, it is enablers like Mr. Dante who simply can’t duck the moral blame.
  • n open letter to the president of SUNY-Albany, penned by molecular biologist Gregory Petsko. The SUNY-Albany president has recently announced the closing — for budgetary reasons — of the departments of French, Italian, Classics, Russian and Theater Arts at his university.
  • Petsko begins by taking on one of the alleged reasons why SUNY-Albany is slashing the humanities: low enrollment. He correctly points out that the problem can be solved overnight at the stroke of a pen: stop abdicating your responsibilities as educators and actually put constraints on what your students have to take in order to graduate. Make courses in English literature, foreign languages, philosophy and critical thinking, the arts and so on, mandatory or one of a small number of options that the students must consider in order to graduate.
  • But, you might say, that’s cheating the market! Students clearly don’t want to take those courses, and a business should cater to its customers. That type of reasoning is among the most pernicious and idiotic I’ve ever heard. Students are not clients (if anything, their parents, who usually pay the tuition, are), they are not shopping for a new bag or pair of shoes. They do not know what is best for them educationally, that’s why they go to college to begin with. If you are not convinced about how absurd the students-as-clients argument is, consider an analogy: does anyone with functioning brain cells argue that since patients in a hospital pay a bill, they should be dictating how the brain surgeon operates? I didn’t think so.
  • Petsko then tackles the second lame excuse given by the president of SUNY-Albany (and common among the upper administration of plenty of public universities): I can’t do otherwise because of the legislature’s draconian cuts. Except that university budgets are simply too complicated for there not to be any other option. I know this first hand, I’m on a special committee at my own college looking at how to creatively deal with budget cuts handed down to us from the very same (admittedly small minded and dysfunctional) New York state legislature that has prompted SUNY-Albany’s action. As Petsko points out, the president there didn’t even think of involving the faculty and staff in a broad discussion of how to deal with the crisis, he simply announced the cuts on a Friday afternoon and then ran for cover. An example of very poor leadership to say the least, and downright hypocrisy considering all the talk that the same administrator has been dishing out about the university “community.”
  • Finally, there is the argument that the humanities don’t pay for their own way, unlike (some of) the sciences (some of the time). That is indubitably true, but irrelevant. Universities are not businesses, they are places of higher learning. Yes, of course they need to deal with budgets, fund raising and all the rest. But the financial and administrative side has one goal and one goal only: to provide the best education to the students who attend that university.
  • That education simply must include the sciences, philosophy, literature, and the arts, as well as more technical or pragmatic offerings such as medicine, business and law. Why? Because that’s the kind of liberal education that makes for an informed and intelligent citizenry, without which our democracy is but empty talk, and our lives nothing but slavery to the marketplace.
  • Maybe this is not how education works in the US. I thought that general (or compulsory) education (ie. up to high school) is designed to make sure that citizens in a democratic country can perform their civil duties. A balanced and well-rounded education, which includes a healthy mixture of science and humanities, is indeed very important for this purpose. However, college-level education is for personal growth and therefore the person must have a large say about what kind of classes he or she chooses to take. I am disturbed by Massimo's hospital analogy. Students are not ill. They don't go to college to be cured, or to be good citizens. They go to college to learn things that *they* want to learn. Patients are passive. Students are not.I agree that students typically do not know what kind of education is good for them. But who does?
  • students do have a saying in their education. They pick their major, and there are electives. But I object to the idea that they can customize their major any way they want. That assumes they know what the best education for them is, they don't. That's the point of education.

  • If a student of surgery fails to learn they might maim, kill or cripple someone. If an engineer of airplanes fails to learn they might design a faulty aircraft that fails and kills people. If a student of chemistry fails to learn they might design a faulty drug with unintended and unfortunate side effects, but what exactly would be the harm if a student of philosophy fails to learn Aristotle had to say about elements or Plato had to say about perfect forms? Rationally Speaking: Some animals are more equal than others - 0 views

  • society's answer to the question “Is it acceptable to hurt animals for our pleasure?” isn't always “No.” Odds are that most of the people who objected to the dog fighting and crush videos are frequent consumers of meat, milk, and eggs from industrialized farms. And the life of an animal in a typical industrialized farm is notoriously punishing. Many spend their lives in cages so confining they can barely move; ammonia fumes burn their eyes; their beaks or tails are chopped off to prevent them from biting each other out of stress; and the farm's conditions make many of them so sick or weak that they die in their cages or on the way to slaughter. As a society, however, we apparently believe that the pleasure we get from eating those animals makes their suffering worth it.
  • many people will object that eating animals isn’t a matter of pleasure at all, but of the need for sustenance. While that may have been true for our ancestors who survived by hunting wild animals, I don’t think it has much relevance to our current situation. It’s about pleasure — the pleasure of eating more meat than strictly necessary for health, and the pleasure of saving money that can then be spent on other things we enjoy.

  • One objective difference people might cite is the fact that a desire to eat meat is “natural” while a desire to watch kittens being crushed is not. First, it seems rather arbitrary, from a logical perspective, which is why it's often referred to as the naturalistic fallacy. And second, it would justify some pretty unsavory “natural” urges, like rape and tribalism, while prohibiting other “unnatural” urges, like the desire to wear clothing or to refrain from having children.
  • The closest thing that I can find to a morally relevant distinction between industrial farming, dogfighting, and crush videos is this: While it’s true that all three acts cause animal suffering in order to give people pleasure, the nature of that tradeoff differs. The consumers of crush videos and dogfighting are taking pleasure in the suffering itself, whereas the consumers of industrially-farmed meat are taking pleasure in the meat that was produced by the suffering. From a purely harm-based perspective, the moral calculus is the same: the animal suffers so that you can experience pleasure. But the degree of directness of that tradeoff makes a difference in how we perceive your character. Someone whose motive is “I enjoy seeing another creature suffer” seems more evil than someone whose motive is “I want a tasty meal,” even if both people cause the same amount of suffering.
  • And I can certainly understand why people would want to call a crush video enthusiast more “evil” than a person who buys meat from industrial farms, because of the difference in their motivations. That's a reasonable way to define evilness. But in that case we're left with the fact that a person's evilness may be totally unrelated to the amount of harm she causes; and that, in fact, some of the greatest harm may be caused by people whose motivations seem unobjectionable to us. Apathy, denial, conformity; none of these inspire the same outrage as sadism, but they've caused some pretty horrible outcomes. And if you believe that it's wrong to make animals suffer for our pleasure, but you reserve your moral condemnation only for cases that viscerally upset you, like dogfighting or crush videos, then you're falling prey to the trap that Isaac Asimov famously warned us against: “Never let your sense of morals prevent you from doing what is right.”

  • Even before I started writing Evolution: How We and All Living Things Came to Be I knew that it would very briefly mention religion, make a mild assertion that religious questions are out of scope for science, and move on. I knew this was likely to provoke blow-back from some in the atheist community, and I knew mentioning that blow-back in my recent post “The Standard Pablum — Science and Atheism” would generate more.
  • Still, I was surprised by the quantity of the responses to the blog post (208 comments as of this moment, many of them substantial letters), and also by the fierceness of some of those responses. For example, according to one poster, “you not only pandered, you lied. And even if you weren’t lying, you lied.” (Several took up this “lying” theme.) Another, disappointed that my children’s book does not tell a general youth audience to look to “secular humanism for guidance,” declared  that “I’d have to tear out that page if I bought the book.”
  • I don’t mean to suggest that there are not points of legitimate disagreement in the mix — there are, many of them stated powerfully. There are also statements of support, vigorous debate, and (for me at least) a good deal of food for thought. I invite anyone to browse the thread, although I’d urge you to skim some of it.   • This practical argument, that skepticism can get more done if we keep our mandate tight and avoid alienating our best friends, seems to me an important one. Even so, it is not my main reason for arguing that atheism and skepticism are different projects.
  • In my opinion, Metaphysics and ethics are out of scope for science — and therefore out of scope for skepticism. This is by far the most important reason I set aside my own atheism when I put on my “skeptic” hat. It’s not that I don’t think atheism is rational — I do. That’s why I’m an atheist. It appears to me that when Daniel says that science has nothing to say about religion, he really means it. I have nothing to say to that. It also appears to me that when he says skepticism is a “different project than atheism” he also means it.

  • Doctors and other health-care workers can provide patients and families with probabilities for improvement or recovery, but statistics are hardly what is wanted. Even after profound injury or the diagnosis of an illness that statistically is nearly certain to be fatal, what people hear is the word nearly. How do we not allow the death of someone who might be saved? How do we avoid the equally intolerable salvation of a clinically dead person?

      In what situations do we hear the word "nearly" and in what situations do we hear the word "certain"? When we're dealing with a person's life, we hear "nearly", but when we're dealing with climate science we hear "certain"?

  • The questions are how, when, and on whose terms we depart. It is curious that people might be convinced to avoid confronting death while they are healthy, and that society tolerates ad hominem arguments that obstruct rational debate over an authentic problem of ethics in an uncertain world.
  • Any seriously ill older person who winds up in a modern CCU immediately yields his autonomy. Even if the doctors, nurses, and staff caring for him are intelligent, properly educated, humanistically motivated, and correct in the diagnosis, they are manipulated not only by the tyranny of technology but also by the rules established in their hospital. In addition, regulations of local and state licensing agencies and the federal government dictate the parameters of what the hospital workers do and how they do it, and every action taken is heavily influenced by legal experts committed to their client’s best interest—values frequently different from the patient’s. Once an acutely ill patient finds himself in this situation, everything possible will be done to save him; he is in no position to offer an opinion.
  • Eventually, after hours or days (depending on the illness and who is involved in the care), the wisdom of continuing treatment may come into question. Vigilant nurses will add drugs by the dozens to the IV or push them into ports. Families will hover uncertainly. Meanwhile, tens and perhaps hundreds of thousands of dollars will have been transferred from one large corporation—an insurer of some kind—to another large corporation—a health care delivery system of some kind.

  • Joshua Greene from Harvard, known for his research on "neuroethics," the neurological underpinnings of ethical decision making in humans. The title of Greene's talk was "Beyond point-and-shoot morality: why cognitive neuroscience matters for ethics."
  • What Greene is interested in is to find out to what factors moral judgment is sensitive to, and whether it is sensitive to the relevant factors. He presented his dual process theory of morality. In this respect, he proposed an analogy with a camera. Cameras have automatic (point and shoot) settings as well as manual controls. The first mode is good enough for most purposes, the second allows the user to fine tune the settings more carefully. The two modes allow for a nice combination of efficiency and flexibility.
  • The idea is that the human brain also has two modes, a set of efficient automatic responses and a manual mode that makes us more flexible in response to non standard situations. The non moral example is our response to potential threats. Here the amygdala is very fast and efficient at focusing on potential threats (e.g., the outline of eyes in the dark), even when there actually is no threat (it's a controlled experiment in a lab, no lurking predator around).

However, he says this is interesting to philosophers because it may lead to question ethical theories that are implicitly or explicitly based on such judgments. (Though Greene raises the possibility that some philosophers engage in rationalizing, rather than reason, as in Kant's famously convoluted idea that masturbation is wrong because one is using oneself as a mean to an end...)
  • this is not to say that understanding moral decision making in humans isn't interesting or in fact even helpful in real life cases. An example of the latter is the common moral condemnation of incest, which is an emotional reaction that probably evolved to avoid genetically diseased offspring. It follows that science can tell us that three is nothing morally wrong in cases of incest when precautions have been taken to avoid pregnancy (and assuming psychological reactions are also accounted for). Greene puts this in terms of science helping us to transform difficult ought questions into easier ought questions.

Rationally Speaking: Does the Academy discriminate against conservatives? - 0 views

  • The latest from University of Virginia cognitive scientist Jonathan Haidt is that people holding to conservative values may be discriminated against in academia. The New York Times’ John Tierney — who is usually a bit more discriminating in his columns than this — reports of a talk that Haidt had given at the conference of the Society for Personality and Social Psychology (this is the same Society whose journal recently published a new study “demonstrating” people’s clairvoyance when it comes to erotic images, so there). Haidt polled his audience and discovered the absolutely unastounding fact that 80% were liberal, with only a scatter of centrists and libertarians, and very, very few conservatives.
  • “This is a statistically impossible lack of diversity,” said Haidt, noting that according to polls, 40% of Americans are conservative and only 20% liberal. He then went on to make the (truly astounding) suggestion that this is just the same as discrimination against women or minorities, and that the poor conservative academics are forced to live in closets just like gays “used to” in the 1980s (because as we all know, that problem has been solved since).
  • I have criticized Haidt before for his contention that progressives and conservatives have a different set of moral criteria, implying that because progressives don’t include criteria of “purity,” in-group loyalty and respect for authority, their moral spectrum is more limited than that of conservatives. My point there was that Haidt simply confuses character traits (respect for authority) with moral values (fairness, or avoidance of harm).

  • suppose that — as I think is highly probable — the overwhelming majority of people with high positions in Wall Street hold to libertarian or conservative views. Would Haidt therefore claim that liberals are being discriminated against in the financial sector? I think not, because the obvious and far more more parsimonious explanation is that if your politics are really to the left of the spectrum, the last thing you want to do is work for Wall Street in helping make the few outrageously rich at the expense of the many.
  • Similarly, I suspect the obvious reason for the “imbalance” of political views in academia is that the low pay, long time before one gets to tenure (if ever), frequent rejection rates from journals and funding agencies, and the necessity to constantly engage one’s critical thinking skills naturally select against conservatives. (Okay, the last bit about critical thinking was a conscious slip that got in there just for fun.)
  • A serious social scientist doesn’t go around crying out discrimination just on the basis of unequal numbers. If that were the case, the NBA would be sued for discriminating against short people, dance companies against people without spatial coordination, and newspapers against dyslexics. Claims of discrimination are sensibly made only if one has a reasonable and detailed understanding of the causal factors behind the numbers. We claim that women and minorities are discriminated against in their access to certain jobs because we can investigate and demonstrate the discriminating practices that result in those numbers. Haidt hasn’t done any such thing. He simply got numbers and then ran wild with speculation about closeted libertarians. It was pretty silly of him, and down right irresponsible of Tierney to republish that garbage without critical comment. Then again, the New York Times is a known bastion of liberal journalism...

  • appeals to intuitions are ubiquitous in philosophy. What are intuitions? Well, that’s part of the controversy, but most philosophers view them as intellectual “seemings.” George Bealer, perhaps the most prominent defender of intuitions-as-evidence, writes, “For you to have an intuition that A is just for it to seem to you that A… Of course, this kind of seeming is intellectual, not sensory or introspective (or imaginative).”2 Other philosophers have characterized them as “noninferential belief due neither to perception nor introspection”3 or alternatively as “applications of our ordinary capacities for judgment.”4

Since that fact alone suffices to explain the (widespread) presence of the “incest is morally wrong” intuition, why should we take that intuition as evidence that “incest is morally wrong” is true?

  • an interesting article I read recently, penned by Julian Savulescu for the Practical Ethics blog.
  • Savulescu discusses an ongoing controversy in Germany about genetic testing of human embryos. The Leopoldina, Germany’s equivalent of the National Academy of Sciences, has recommended genetic testing of pre-implant embryos, to screen for serious and incurable defects. The German Chancellor, Angela Merkel, has agreed to allow a parliamentary vote on this issue, but also said that she personally supports a ban on this type of testing. Her fear is that the testing would quickly lead to “designer babies,” i.e. to parents making choices about their unborn offspring based not on knowledge about serious disease, but simply because they happen to prefer a particular height or eye color.
  • He infers from Merkel’s comments (and many similar others) that people tend to think of selecting traits like eye color as eugenics, while acting to avoid incurable disease is not considered eugenics. He argues that this is exactly wrong: eugenics, as he points out, means “well born,” so eugenicists have historically been concerned with eliminating traits that would harm society (Wendell Holmes’ “three generation of imbeciles”), not with simple aesthetic choices. As Savulescu puts it: “[eugenics] is selecting embryos which are better, in this context, have better lives. Being healthy rather than sick is ‘better.’ Having blond hair and blue eyes is not in any plausible sense ‘better,’ even if people mistakenly think so.”

  • And there is another, related aspect of discussions about eugenics that should be at the forefront of our consideration: what was particularly objectionable about American and Nazi early 20th century eugenics is that the state, not individuals, were to make decisions about who could reproduce and who couldn’t. Savulescu continues: “to grant procreative liberty is the only way to avoid the objectionable form of eugenics that the Nazis practiced.” In other words, it makes all the difference in the world if it is an individual couple who decides to have or not have a baby, or if it is the state that imposes a particular reproductive choice on its citizenry.
  • but then Savulescu expands his argument to a point where I begin to feel somewhat uncomfortable. He says: “[procreative liberty] involves the freedom to choose a child with red hair or blond hair or no hair.”
  • Savulescu has suddenly sneaked into his argument for procreative liberty the assumption that all choices in this area are on the same level. But while it is hard to object to action aimed at avoiding devastating diseases, it is not quite so obvious to me what arguments favor the idea of designer babies. The first intervention can be justified, for instance, on consequentialist grounds because it reduces the pain and suffering of both the child and the parents. The second intervention is analogous to shopping for a new bag, or a new car, which means that it commodifies the act of conceiving a baby, thus degrading its importance. I’m not saying that that in itself is sufficient to make it illegal, but the ethics of it is different, and that difference cannot simply be swept under the broad rug of “procreative liberty.”
  • designing babies is to treat them as objects, not as human beings, and there are a couple of strong philosophical traditions in ethics that go squarely against that (I’m thinking, obviously, of Kant’s categorical imperative, as well as of virtue ethics; not sure what a consequentialist would say about this, probably she would remain neutral on the issue).
  • Commodification of human beings has historically produced all sorts of bad stuff, from slavery to exploitative prostitution, and arguably to war (after all, we are using our soldiers as means to gain access to power, resources, territory, etc.)

That would quickly lead to an even further divide between the haves and the have-nots, more inequality, more injustice, possibly, in the long run, even two different species (why not design your babies so that they can’t breed with certain types of undesirables, for instance?). Is that the sort of society that Savulescu is willing to envision in the name of his total procreative liberty? That begins to sounds like the libertarian version of the eugenic ideal, something potentially only slightly less nightmarish than the early 20th century original.
  • Rich people already have better choices when it comes to their babies. Taller and richer men can choose between more attractive and physically fit women and attractive women can choose between more physically fit and rich men. So it is reasonable to conclude that on average rich and attractive people already have more options when it comes to their offspring. Moreover no one is questioning their right to do so and this is based on a respect for a basic instinct which we all have and which is exactly why these people would choose to have a DB. Is it fair for someone to be tall because his daddy was rich and married a supermodel but not because his daddy was rich and had his DNA resequenced? Is it former good because its natural and the latter bad because its not? This isn't at all obvious to me.
  • Not to mention that rich people can provide better health care, education and nutrition to their children and again no one is questioning their right to do so. Wouldn't a couple of inches be pretty negligible compared to getting into a good school? Aren't we applying double standards by objecting to this issue alone? Do we really live in a society that values equal opportunities? People (may) be equal before the law but they are not equal to each other and each one of us is tacitly accepting that fact when we acknowledge the social hierarchy (in other words, every time we interact with someone who is our superior). I am not crazy about this fact but that's just how people are and this has to be taken into account when discussing this.

A weak form of involvement would have a judge listen to a statement from victims, but ensure the judge alone does the sentencing. A slightly stronger form would be when the impact on victims is considered as part of assessing the moral seriousness of the crime. The strongest form would be when victims have a direct say in the type of sentence. So which is the more just?
  • A utilitarian approach, which seeks people's greatest happiness and is associated with the British philosopher Jeremy Bentham, can provide one reason why victims should, in part, play judge. It can be called the therapeutic argument.

  • However, this might backfire. Given the choice, many victims might desire longer sentences than the judiciary would allow. When that desire is not satisfied, their anguish might be exacerbated. The therapeutic argument has also been called the "Oprahisation" of sentencing.
