I hear that after long deliberations, NBC has decided to cancel the long-running procedural, which will end its run at 20 seasons, tied with Gunsmoke.

Zucker’s critics are ranting that first he killed comedy, losing the NBC franchise of Thursday night “Must See TV,” where “Seinfeld,” “Friends” and “Will & Grace” once hilariously reigned; then he killed drama, failing to develop successors to the formidable “ER,” “West Wing,” and “Law & Order”; then he killed the 10 o’clock hour by putting Jay Leno on at a time when people expect to be told a story; and then he killed late night by putting on a quirky redhead who did not have the bland mass-market appeal of Leno and who couldn’t compete with the peerless late-night comedian NBC had stupidly lost 16 years ago, David Letterman.

But Comcast had argued that the FCC order was illegal because the agency was seeking to enforce mere policy principles, which don't have the force of regulations or law. That is one reason that Genachowski is now trying to formalize those rules.

With so much at stake, the FCC now has several options. It could ask Congress to give it explicit authority to regulate broadband. Or it could appeal Tuesday's decision to the Supreme Court.

The more likely scenario, Scott believes, is that the agency will simply reclassify broadband as a more heavily regulated telecommuniciations service. And that, ironically, could be the worst-case outcome from the perspective of the phone and cable companies, he noted.
