Vessel Strikes of Large Whales in the Eastern Tropical Pacific: A Case Study of Regiona... - 0 views

    Vessel strike is recognized as a major modern threat to the recovery of large whale populations globally, but the issue is notoriously difficult to assess. Vessel strikes by large ships frequently go unnoticed, and those involving smaller vessels are rarely reported. Interpreting global patterns of vessel strikes is further hindered by underlying reporting biases caused by differences in countries' research efforts, legislation, reporting structures and enforcement. This leaves global strike data "patchy" and typically scarce outside of developed countries, where resources are more limited. To explore this we investigated vessel strikes with large whales in the Eastern Tropical Pacific (ETP), a coastal region of ten developing countries where heavy shipping and high cetacean densities overlap. Although this is characteristic of vessel strike "hotspots" worldwide, only 11 ETP strike reports from just four countries (∼2% of total reports) existed in the International Whaling Commission's Global Ship Strike Database (2010). This contrasts greatly with abundant reports from the neighboring state of California (United States), and the greater United States/Canadian west coast, making it a compelling case study for investigating underreporting. By reviewing online media databases and articles, peer review publications and requesting information from government agencies, scientists, and tourism companies, we compiled a regional ETP vessel strike database. We found over three times as many strike reports (n = 40), from twice as many countries (n = 8), identifying the geographic extent and severity of the threat, although likely still underestimating the true number of strikes. Reports were found from 1905 until 2017, showing that strikes are a regional, historic, and present threat to large whales.     Since the Brexit happened in January 2020, it is likely to impact the United Kingdom (UK) and the whole of Europe in different ways. The UK and other European countries will revise their preferences concerning fisheries, ports access and governance, and bilateral diplomatic relationships with the countries alongside the 21st Century Maritime Silk Road (MSR). However, this is not an end to uncertainties, but the beginning to show the double-edged effects of Brexit. This paper focuses on the opportunities and challenges for Sino-UK as well as European Union (EU) relations arising from Brexit. The present study considers Brexit's impact on the MSR countries, especially China, Pakistan, and India. It examines what Brexit means for the Sino-UK/EU relationship, politically, economically, and culturally. It concludes with the potential impacts of Brexit on Sino-UK/EU trade relations, maritime security, marine resources usage, the safety of navigation, port governance and cooperation, and suggests the appropriate strategies that can be put in place to capitalise on opportunities to reap benefits while mitigating the challenges.

    Under the low-carbon background, 37 ports of countries along the South China Sea with capacity ranking in the world's top 100 container ports are selected as the research object to establish a shipping network, construct a directed dichotomous shipping network, and divide the port tiers after finding the kernel number by using kernel analysis method, respectively, to explore the relationship between tiers and the relationship between ports at the higher level, and then make clear the direction of the improvement for the reduction of carbon emissions. The results show that: the routes sent between container ports in countries along the South China Sea have formed a more stable connection, but the receiving routes are still in a passive position, and the port call relationship is affected by the port hierarchy. High-level ports such as Shanghai Port and Singapore Port undertake the transshipment function of cargo concentration and redistribution within the network. The small-world characteristics among ports such as Singapore Port, Ningbo Port, Haiphong Port, Shenzhen Port, Guangzhou Port, and Linchaban Port are obvious. Based on the results of the empirical analysis, corresponding suggestions are put forward to optimize the structure of the container port system in the countries along the South China Sea and promote the low-carbon development of the sea.

    The Protocol on Environmental Protection of the Antarctic Treaty stipulates that the protection of the Antarctic environment and associated ecosystems be fundamentally considered in the planning and conducting of all activities in the Antarctic Treaty area. One of the key pollutants created by human activities in the Antarctic is noise, which is primarily caused by ship traffic (from tourism, fisheries, and research), but also by geophysical research (e.g., seismic surveys) and by research station support activities (including construction). Arguably, amongst the species most vulnerable to noise are marine mammals since they specialize in using sound for communication, navigation and foraging, and therefore have evolved the highest auditory sensitivity among marine organisms. Reported effects of noise on marine mammals in lower-latitude oceans include stress, behavioral changes such as avoidance, auditory masking, hearing threshold shifts, and-in extreme cases-death. Eight mysticete species, 10 odontocete species, and six pinniped species occur south of 60°S (i.e., in the Southern or Antarctic Ocean). For many of these, the Southern Ocean is a key area for foraging and reproduction. Yet, little is known about how these species are affected by noise. We review the current prevalence of anthropogenic noise and the distribution of marine mammals in the Southern Ocean, and the current research gaps that prevent us from accurately assessing noise impacts on Antarctic marine mammals. A questionnaire given to 29 international experts on marine mammals revealed a variety of research needs. Those that received the highest rankings were (1) improved data on abundance and distribution of Antarctic marine mammals, (2) hearing data for Antarctic marine mammals, in particular a mysticete audiogram, and (3) an assessment of the effectiveness of various noise mitigation options.     In addressing climate change, the shipping industry, which is regarded as one sector that cannot be ignored in controlling greenhouse gas emissions, has become a key area of concern for the international community to achieve emissions reduction targets. The International Maritime Organization-the body that regulates international shipping-as well as the European Union and other international entities have adopted a series of emissions reduction policies, beginning a new era of shipping emissions reduction. In view of the urgency and complexity of this issue, the future policy direction of shipping emissions reduction and whether or not existing policies can achieve the emissions reduction targets have become the focus of attention in the global shipping industry. In addition, China's dual identity as a shipping magnate and a developing country plays a crucial role in the development of shipping emissions reduction trends, and reducing shipping emissions is necessary for China to achieve the "double carbon" commitment. In view of the above, this study endeavours to compare the current major shipping emission reduction policies from the perspective of international law and the perspective of macro policies, and analyze the future direction of international shipping emissions reduction policy. At the same time, the study identify China as one of the key countries to influence future policy making and proposes the position and path for China's participation in international shipping emissions reduction, which provided valuable contributions for China to participate in accelerating energy transformation, exploring participation in the carbon emission market, and promoting international unified shipping policy.

    The entry into force of the Regional Comprehensive Economic Partnership (RCEP), the world's largest free trade agreement, has injected new vitality into multilateralism and free trade, against a background of global economic and political instability. Its core concept is to liberalize and facilitate trade. Regulation of the shipping market warrants attention. Under the RCEP, the international shipping industry is characterized by a digital development trend in shipping supervision, continuous upgrading of shipping management and supervision capabilities, and more open and transparent shipping market supervision. However, in the process of implementing new rules for shipping market supervision, there are still some challenges, such as logistics risks and loopholes in shipping supply chains, insufficient coordination of shipping supervision among RCEP member countries, and an imperfect legal and regulatory system. This paper therefore suggests that under the RCEP, China should strengthen the anti-risk ability of shipping supply chains, promote coordinated supervision among member countries, strengthen environmental protection, and promote the coordination of digital supervision.

    Maritime transport is a major source of pollution of marine environment, which is the essential object in a series of international maritime legislations and various countries' domestic laws. Focused on protecting the marine environment, China has spent over 40 years developing the rule of law for marine environmental governance in maritime transport, including efforts made in legislation, law enforcement, and the judiciary. In this article, we attempt to examine China's experience and practice in the marine environment, explain the logic and consideration in relevant practices, and summarize China's paradigm for the rule of law for such governance. China has sought to resolve two major issues: the relationship between domestic and international law and the balance of interests between flag, coastal, and port states, offering a vivid model of marine environmental governance on which other countries can base their own legal systems. The findings reveal that with following and enforcing the international law of the sea, now China's domestic laws have form lawful authority on binding foreign vessels. China is continually strengthening the construction of its legislative system to harmonize inconsistencies and keep pace with international marine environmental law. To eliminate administrative inefficiency resulting from cumbersome procedures, China has reformed its maritime enforcement system by consolidating multiple administrations. China's independent maritime judicial system is meeting the demand to develop environmental specialization, enabling further exploitation of its profession in solving maritime environment cases and implementing environmental legislation.
