The NAACP has just passed a historic resolution demanding an end to the War on Drugs.  The resolution comes as young Black male unemployment hovers near 50 percent and the wealth gap's become a veritable gulf. So why is the forty-year-old "War on Drugs" public enemy number one for the nation's oldest civil rights organization? Well here's why:  it's not extraneous - it's central: the war on drugs is the engine of 21st century discrimination - an engine that has brought Jim Crow into the age of Barack Obama.     Author Michelle Alexander lays out the statistics -- and the stories --  of 21st Century Jim Crow in her ought-to-blow-your-socks off book: "The New Jim Crow: Mass Incarceration in an Age of Colorblindness." I had a chance to sit down with Alexander earlier this summer. We'll be posting the full interview in two parts.     "We have managed decades after the civil rights movement to create something like a caste system in the United States," says Alexander in part one here  "In major urban areas, the majority of African American men are either behind bars, under correctional control or saddled with criminal record and once branded as criminal or a felon, they're trapped for life in 2nd class status."     It's not just about people having a hard time getting ahead and climbing the ladder of success. It's about a rigged system. Sound familiar?  Like the Pew Research Center report on household wealth and the Great Recession -- the NAACP resolution story was a one-day news-blip - despite the fact that it pierces the by-your-bootstraps myth that is at the heart of - you pick it - the deficit, the stimulus, the tax code - every contemporary US economic debate.     White America just maybe ought to pay attention. By executive order on Aug. 4, President Barack Obama refused entry to the United States of war criminals and human-rights violators (jurist.org, Aug. 4). He ignored, as he often does, the deeply documented factual evidence of war crimes committed by the Bush-Cheney administration along with grim proof that the Obama administration also violates our anti-torture laws and the U.N. Convention Against Torture we signed. Take, for example, right now under Obama, "The CIA Secret Sites in Somalia" (the nation.com, July 12).

The Land of the Free punishes or imprisons more of its citizens than any other nation. This collection of testimonials from criminal offenders, family members, and experts on America's criminal justice system puts a human face on the millions of Americans subjugated by the US Government's 40 year, one trillion dollar social catastrophe: The War on Drugs; a failed policy underscored by fear, politics, racial prejudice and intolerance in a public atmosphere of out of sight, out of mind. The United States has only 5% of the world's population, yet a full 25% of the world's prisoners. At 2.5 million, the US has more prisoners than even China does with five times the population of the United States. 8 million Americans (1 in every 31) languish under some form of state monitoring known as correctional supervision. On top of that, the security and livelihood of over 13 million more has been forever altered by a felony conviction. The American use of punishment is so pervasive, and so disproportionate, that even the conservative magazine The Economist declared in 2010, never in the civilized world have so many been locked up for so little. The project will unfold over a two year period, beginning with the release of this feature-length documentary and then continuing on with the release of short films and complete interviews from each of the 100 participants in the project, meant to represent the 1 in 100 Americans that are currently sitting behind bars.

WARNING: Graphic and disturbing photos between 38:40 and 40:45. U.S. Army Ranger John Needham, who was awarded two purple hearts and three medals for heroism, wrote to military authorities in 2007 reporting war crimes that he witnessed being committed by his own command and fellow soldiers in Al Doura, Iraq. His charges were supported by atrocity photos which, in the public interest, are now released in this video. John paid a terrible price for his opposition to these acts. His story is tragic.  CBS reported obtaining an Army document from the Criminal Investigation Command suggestive of an investigation into these war crimes allegations. The Army's conclusion was that the "offense of War Crimes did not occur." However, CBS also stated that the report was "redacted and incomplete; 111 pages were withheld."  This video is placed with the context of Vice President, Dick Cheney, insistence that this nation's efforts "must go to the dark side;" which included ignoring the Geneva Conventions.  John's story is told, here, by his father, Michael Needham. David Garland is a well-respected sociologist and legal scholar who taught courses on crime and punishment at the University of Edinburgh before relocating to the United States over a decade ago. His recent Peculiar Institution: America's Death Penalty in an Age of Abolition is the product of his attempt to learn "why the United States is such an outlier in the severity of its criminal sentencing." Thus, while the book primarily concerns the death penalty, it also illuminates the broader, dramatic differences between American and Western European prison sentences.

It's one thing that the United States will soon be taking orders from China (or already is). But what about when we're becoming less forward-thinking than England? That's the only possible reading of the fact that there, the former top drug official Bob Ainsworth has addressed the House of Commons and argued for the legalization of all drugs. Not just pot-all of them. His reasoning is simple, and has nothing to do with the ideology of Timothy Leary: "We need to take effective measures to rob the dealers of their markets and the only way that we can do that is by supplying addicts through the medical profession, through prescription. We cannot afford to be shy about being prepared to do that." He continues: "We spend billions of pounds without preventing the wide availability of drugs. It is time to replace our failed war on drugs with a strict system of legal regulation, to make the world a safer, healthier place, especially for our children. We must take the trade away from organised criminals and hand it to the control of doctors and pharmacists."

This is one of the best examples we've had yet of the profound difference in the style of criminal justice enforcement for the very rich and connected, versus the style of justice for everyone else. This scam that Chase, Bank of America and UBS were involved with was no different in any way, really, from old-school mafia-style bid-rigging scams.

The prominent political and legal blogger Glenn Greenwald comments on the growing Occupy Wall Street movement. "What this movement is about is more important than specific legislative demands. It…is expressing dissent to the system itself," says Greenwald. "It is not a Democratic Party organ. It is not about demanding that President Obama's single [jobs] bill pass or anything along those lines. It is saying that we believe the system itself is radically corrupted, and we no longer are willing to tolerate it. And that's infinitely more important than specific legislative or political demands." Greenwald also discusses the possible shutdown of the online whistleblower website WikiLeaks due to a "financial blockade" led by MasterCard, Visa and PayPal. "The reason why all these companies cut off funds is because the government pressured and demanded that they do so," Greenwald says. "So, no due process, no accusation of criminal activity. You could never charge WikiLeaks with a crime. They're engaged in First Amendment activity. And the government has destroyed them through their pressure and influence over the private sector... WikiLeaks has shed more light on the world's most powerful factions than all media outlets combined, easily, over the last year, and that's the reason why they're so hated." Why KBR continues to be awarded huge open-ended, cost-plus, no-compete contracts from the Pentagon is a question worthy of a criminal investigation, because their track record as a military contractor suggests that "KBR" is actually short for "Kickbacks, Bribes & Ripoffs".  According to the POGO Federal Contractor Misconduct Database, since 1995 the company has been involved in not less than 23 documented cases of misconduct including but not limited to Overcharging the Government, Violation of Anti-Kickback Act, Excessive Subcontract Costs, Fraud and Accepting Kickbacks, Exposing Troops to Hazardous Water Conditions, Bribery to Win International Government Contracts, Overpricing Fuel, Breach of Contract, Hurricane Relief Contract Overcharges, Sexual Assault, Freight Forwarding Kickbacks, Procurement Irregularities, and Conspiracy to Defraud the Government.  For this KBR has paid millions in fines, which it surely considers a small price to pay for the billions it continues to receive in new federal contracts every year:

The Ninth Circuit Court of Appeals split down the middle in finding (PDF) that the Justice Department was entitled to halt a civil lawsuit between private parties because of the threat that the suit would expose state secrets. By the margin of a single vote, it reversed the decision of a panel of the same court (PDF) holding that the doctrine could only be applied to individual pieces of evidence, not to entire lawsuits.
