Both Supreme Court justices Antonin Scalia and Clarence Thomas describe themselves as "originalists," meaning that they believe they possess the innate knowledge of exactly what the Founding Fathers intended when they penned the U.S. Constitution. Given such an almost reverent standard it is fair to ask a few questions regarding the Judiciary branch of government which, in my opinion, no longer represents the people of our country. It has become so deeply immersed in right-wing ideology that there is little resemblance to the this branch of government today and when the Founding Fathers established it. Did the Founding Fathers intend that Supreme Court judges sitting on the highest court of the land can decide who the president should be, especially if one of those judges was appointed by the father of one of the complainants? Surely, most of us would agree, that judge should be disqualified from involvement in such an extraordinary decision. Did the Founding Fathers intend that a judge sitting on the highest court of the land to be cozy with incendiary, hate-mongering partisan extremists who make seditious statements for the sole purpose of undermining and subverting democracy? Surely, you would ask, should a judge deciding cases on the Supreme court be colluding and conniving with a Screech Radio insurrectionist who spouts non-stop hatred and incites violence against our president and elected officials? Did the Founding Fathers also intend for the spouse of a sitting Supreme Court justice to be actively fomenting hatred, insurrection and subversion, the sole aim of which is to overthrow, even by armed insurrection, a democratically-elected president and political party? Surely, the Founding Fathers did not intend for that to be an admirable or patriotic role of the spouse of a Supreme Court justice? The solid phalanx of activist, partisan ideologues, Roberts,

Speaking at the 25th anniversary celebration of the national media watch group Fairness and Accuracy in Reporting, world-renowned political dissident and linguist Noam Chomsky analyzes the U.S. response to the popular uprisings sweeping the Middle East and North Africa. "Across the [Middle East], an overwhelming majority of the population regards the United States as the main threat to their interests," Chomsky says. "The reason is very simple... What amazes me most whenever I write about this topic is recalling how terribly upset so many Democrats pretended to be when Bush claimed the power merely to detain or even just eavesdrop on American citizens without due process.  Remember all that?  Yet now, here's Obama claiming the power not to detain or eavesdrop on citizens without due process, but to kill them; marvel at how the hardest-core White House loyalists now celebrate this and uncritically accept the same justifying rationale used by Bush/Cheney (this is war! the President says he was a Terrorist!) without even a moment of acknowledgment of the profound inconsistency or the deeply troubling implications of having a President - even Barack Obama - vested with the power to target U.S. citizens for murder with no due process. Also, during the Bush years, civil libertarians who tried to convince conservatives to oppose that administration's radical excesses would often ask things like this: would you be comfortable having Hillary Clinton wield the power to spy on your calls or imprison you with no judicial reivew or oversight?  So for you good progressives out there justifying this, I would ask this:  how would the power to assassinate U.S. citizens without due process look to you in the hands of, say, Rick Perry or Michele Bachmann?

When the war in Libya began, the U.S. government convinced a large number of war supporters that we were there to achieve the very limited goal of creating a no-fly zone in Benghazi to protect civilians from air attacks, while President Obama specifically vowed that "broadening our military mission to include regime change would be a mistake."  This no-fly zone was created in the first week, yet now, almost three months later, the war drags on without any end in sight, and NATO is no longer even hiding what has long been obvious: that its real goal is exactly the one Obama vowed would not be pursued -- regime change through the use of military force.  We're in Libya to forcibly remove Gaddafi from power and replace him with a regime that we like better, i.e., one that is more accommodating to the interests of the West.  That's not even a debatable proposition at this point. What I suppose is debatable, in the most generous sense of that term, is our motive in doing this.  Why -- at a time when American political leaders feel compelled to advocate politically radioactive budget cuts to reduce the deficit and when polls show Americans solidly and increasingly opposed to the war -- would the U.S. Government continue to spend huge sums of money to fight this war?  Why is President Obama willing to endure self-evidently valid accusations -- even from his own Party -- that he's fighting an illegal war by brazenly flouting the requirements for Congressional approval?  Why would Defense Secretary Gates risk fissures by so angrily and publicly chiding NATO allies for failing to build more Freedom Bombs to devote to the war?  And why would we, to use the President's phrase, "stand idly by" while numerous other regimes -- including our close allies in Bahrain and Yemen and the one in Syria -- engage in attacks on their own people at least as heinous as those threatened by Gaddafi, yet be so devoted to targeting the Libyan leader?

Two weeks after the U.S. killed American citizen Anwar Awlaki with a drone strike in Yemen - far from any battlefield and with no due process - it did the same to his 16-year-old son, Abdulrahman al-Awlaki, ending the teenager's life on Friday along with his 17-year-old cousin and seven other people. News reports, based on government sources, originally claimed that Awlaki's son was 21 years old and an Al Qaeda fighter (needless to say, as Terrorist often means: "anyone killed by the U.S."), but a birth certificate published by The Washington Post proved that he was born only 16 years ago in Denver. As The New Yorker's Amy Davidson wrote: "Looking at his birth certificate, one wonders what those assertions say either about the the quality of the government's evidence - or the honesty of its claims - and about our own capacity for self-deception." The boy's grandfather said that he and his cousin were at a barbecue and preparing to eat when the U.S. attacked them by air and ended their lives. There are two points worth making about this:

In March, 2002, American citizen Jose Padilla was arrested in Chicago and publicly accused by then-Attorney-General John Ashcroft of being "The Dirty Bomber."  Shortly thereafter, he was transferred to a military brig in South Carolina, where he was held for almost two years completely incommunicado (charged with no crime and denied all access to the outside world, including even a lawyer) and was brutally tortured, both physically and psychologically.  All of this -- including the torture -- was carried out pursuant to orders from President Bush, Secretary Rumsfeld and other high-ranking officials.  Just as the Supreme Court was about to hear Padilla's plea to be charged or released -- and thus finally decide if the President has the power to imprison American citizens on U.S. soil with no charges of any kind -- the Government indicted him in a federal court on charges far less serious than Ashcroft had touted years earlier, causing the Supreme Court to dismiss Padilla's arguments as "moot"; Padilla was then convicted and sentenced to 17 years in prison.

I am shocked by the U.S. budget negotiations between Congress and President Obama. Every part of the budget debate in the U.S. is built on a tissue of willful deceit.

The past few days have seen some very unusual events in New York. You might have heard that, over the weekend, a large contingent of folks started a protest on Wall Street. Using Twitter and other online tools, they started a large sit-in of the south end of Manhattan. The day before that, New York mayor Michael Bloomberg warned that frustrations over the U.S. economic and political situation could boil over into riots. The U.S. has seen its share of robust political protests in recent years, but this feels different. Something is emerging within America that has never happened before: the country has to choose between democracy and capitalism.

Pakistan's success against the home-grown terrorism is recognized worldwide. So convincing is the effect of military engagement with terrorists of various hues and colors, but on the convergence of a unanimous decision to be made to visit each dignitary of the state of Pakistan has a point in the Swat Valley to visit and about first-hand the now known as the Swat success model. Compare that with the collapse of the U.S. war against terrorism in Afghanistan, despite extensive military and economic resources and the importance of the so-called ally Pakistan even more. Encouraged by the success in Malakand Pakistan Army has chosen to expand to dismantle the operation in South Waziristan on the structure of command and control and training camps for terrorists.

Glenn Greenwald of Salon joins the show to talk about the Obama administration's policy targeting American citizens for execution. Attorney General Holder's speech earlier this week in defense of the policy did little to calm concerns. In fact, alarm bells are ringing...

WARNING: Graphic and disturbing photos between 38:40 and 40:45. U.S. Army Ranger John Needham, who was awarded two purple hearts and three medals for heroism, wrote to military authorities in 2007 reporting war crimes that he witnessed being committed by his own command and fellow soldiers in Al Doura, Iraq. His charges were supported by atrocity photos which, in the public interest, are now released in this video. John paid a terrible price for his opposition to these acts. His story is tragic.  CBS reported obtaining an Army document from the Criminal Investigation Command suggestive of an investigation into these war crimes allegations. The Army's conclusion was that the "offense of War Crimes did not occur." However, CBS also stated that the report was "redacted and incomplete; 111 pages were withheld."  This video is placed with the context of Vice President, Dick Cheney, insistence that this nation's efforts "must go to the dark side;" which included ignoring the Geneva Conventions.  John's story is told, here, by his father, Michael Needham. It is produced in the spirit of the public interest and towards promoting justice and the rule of law.
