    Of all the topics on which I've focused, I've likely written most about America's two-tiered justice system -- the way in which political and financial elites now enjoy virtually full-scale legal immunity for even the most egregious lawbreaking, while ordinary Americans, especially the poor and racial and ethnic minorities, are subjected to exactly the opposite treatment: the world's largest prison state and most merciless justice system. That full-scale destruction of the rule of law is also the topic of my forthcoming book. But The New York Times this morning has a long article so perfectly illustrating what I mean by "two-tiered justice system" -- and the way in which it obliterates the core covenant of the American Founding: equality before the law -- that it's impossible for me not to highlight it.

    The NAACP has just passed a historic resolution demanding an end to the War on Drugs.  The resolution comes as young Black male unemployment hovers near 50 percent and the wealth gap's become a veritable gulf. So why is the forty-year-old "War on Drugs" public enemy number one for the nation's oldest civil rights organization? Well here's why:  it's not extraneous - it's central: the war on drugs is the engine of 21st century discrimination - an engine that has brought Jim Crow into the age of Barack Obama.     Author Michelle Alexander lays out the statistics -- and the stories --  of 21st Century Jim Crow in her ought-to-blow-your-socks off book: "The New Jim Crow: Mass Incarceration in an Age of Colorblindness." I had a chance to sit down with Alexander earlier this summer. We'll be posting the full interview in two parts.     "We have managed decades after the civil rights movement to create something like a caste system in the United States," says Alexander in part one here  "In major urban areas, the majority of African American men are either behind bars, under correctional control or saddled with criminal record and once branded as criminal or a felon, they're trapped for life in 2nd class status."     It's not just about people having a hard time getting ahead and climbing the ladder of success. It's about a rigged system.     They are frequently cited as the first instance in American history when people in the homosexual community fought back against a government-sponsored system that persecuted sexual minorities, and they have become the defining event that marked the start of the gay rights movement in the United States and around the world. American gays and lesbians in the 1950s and 1960s faced a legal system more anti-homosexual than those of some Warsaw Pact countries.[note 1][2] Early homophile groups in the U.S. sought to prove that gay people could be assimilated into society, and they favored non-confrontational education for homosexuals and heterosexuals alike. The last years of the 1960s, however, were very contentious, as many social movements were active, including the African American Civil Rights Movement, the Counterculture of the 1960s, and antiwar demonstrations. These influences, along with the liberal environment of Greenwich Village, served as catalysts for the Stonewall riots. Very few establishments welcomed openly gay people in the 1950s and 1960s. Those that did were often bars, although bar owners and managers were rarely gay. The Stonewall Inn, at the time, was owned by the Mafia.[3][4] It catered to an assortment of patrons, but it was known to be popular with the poorest and most marginalized people in the gay community: drag queens, representatives of a newly self-aware transgender community, effeminate young men, hustlers, and homeless youth. Police raids on gay bars were routine in the 1960s, but officers quickly lost control of the situation at the Stonewall Inn, and attracted a crowd that was incited to riot. Tensions between New York City police and gay residents of Greenwich Village erupted into more protests the next evening, and again several nights later. The number of people having in-hospital, adverse drug reactions (ADR) to prescribed medicine is 2.2 million.   • As always, the most harmful aspect of the Obama legacy is that he has converted what were once controversial right-wing Bush policies into unchallenged bipartisan consensus, to endure indefinitely and without any opposition from either party.  And, to underscore the point once more:  Obama's plan as President (as opposed to as a candidate) was never to dismantle the Bush/Cheney system at Guantanamo; before Congress acted at all, his only objective was to preserve its core, defining features and then move that system to Illinois.

Operators of the Bay Area Rapid Transit system (BART) shut down cell phone service to four stations in downtown San Francisco yesterday in response to a planned protest. Last month, protesters disrupted BART service in response to the fatal shooting of Charles Blair Hill by BART police on July 3rd. Thursday's protest failed to materialize, possibly because the disruption of cell phone service made organization and coordination difficult.
