In May 2008, Josh Fox received a letter from a natural gas company offering to lease his family's land in Milanville, Pennsylvania for $100,000 to drill for gas.[1]Following the lease offer, he looked for information about natural gas drilling in the Marcellus Shale under large parts of Pennsylvania, New York, Ohio and West Virginia. He visited Dimock, Pennsylvania where natural gas drilling was already taking place. In Dimock, he met families able to light their tap water on fire as well as suffering from numerous health issues and fearing their well water had been contaminated.Fox then set out to see how communities are being affected in the west where a natural gas drilling boom has been underway for the last decade. He spent time with citizens in their homes and on their land as they relayed their stories of natural gas drilling in Colorado, Wyoming, Utah and Texas, among others. He spoke with residents who have experienced a variety of chronic health problems as well as contamination of their air, water wells or surface water. In some instances, the residents are reporting that they obtained a court injunction or settlement monies from gas companies to replace the affected water supplies with potable water or water purification kits.[2]Throughout the documentary, Fox reached out to scientists, politicians and gas industry executives and ultimately found himself in the halls of Congress as a subcommittee was discussing the Fracturing Responsibility and Awareness of Chemicals Act, "a bill to amend the Safe Drinking Water Act to repeal a certain exemption for hydraulic fracturing."[3] Hydraulic fracturing was exempted from the Safe Drinking Water Act in the Energy Policy Act of 2005.[4]Making appearances in the film are Dr. Theo Colborn, founder of the Endocrine Disruption Exchange (TEDX); John Hanger, Secretary of the Pennsylvania Department of Environmental Protection (DEP); Dr. Al Armendariz, Environmental Protection Agency (EPA) Administrator for Region 6; W

I'm genuinely excited today to announce the release of my new book, With Liberty and Justice for Some: How the Law is Used to Destroy Equality and Protect the Powerful. The book focuses on what I began realizing several years ago is the crucial theme tying together most of the topics I write about: America's two-tiered justice system - specifically, the way political and financial elites are now vested with virtually absolute immunity from the rule of law even when they are caught committing egregious crimes, while ordinary Americans are subjected to the world's largest and one of its harshest and most merciless penal states even for trivial offenses. As a result, law has been completely perverted from what it was intended to be - the guarantor of an equal playing field which would legitimize outcome inequalities - into its precise antithesis: a weapon used by the most powerful to protect their ill-gotten gains, strengthen their unearned prerogatives, and ensure ever-expanding opportunity inequality. The original text of the talk is below: Imagine for a moment that somewhere in the middle of Texas there was a large foreign military base, say Chinese or Russian. Imagine that thousands of armed foreign troops were constantly patrolling American streets in military vehicles. Imagine they were here under the auspices of "keeping us safe" or "promoting democracy" or "protecting their strategic interests." Imagine that they operated outside of US law, and that the Constitution did not apply to them. Imagine that every now and then they made mistakes or acted on bad information and accidentally killed or terrorized innocent Americans, including women and children, most of the time with little to no repercussions or consequences. The candidate supported by progressives - President Obama - himself holds heinous views on a slew of critical issues and himself has done heinous things with the power he has been vested. He has slaughtered civilians - Muslim children by the dozens - not once or twice, but continuously in numerous nations with drones, cluster bombs and other forms of attack. He has sought to overturn a global ban on cluster bombs. He has institutionalized the power of Presidents - in secret and with no checks - to target American citizens for assassination-by-CIA, far from any battlefield. He has waged an unprecedented war against whistleblowers, the protection of which was once a liberal shibboleth. He rendered permanently irrelevant the War Powers Resolution, a crown jewel in the list of post-Vietnam liberal accomplishments, and thus enshrined the power of Presidents to wage war even in the face of a Congressional vote against it. His obsession with secrecy is so extreme that it has become darkly laughable in its manifestations, and he even worked to amend the Freedom of Information Act (another crown jewel of liberal legislative successes) when compliance became inconvenient.

The Great Recession could have spawned another era of fundamental reform, just as the Great Depression did. But the financial rescue reduced immediate demands for broader reform. Obama might still have succeeded had he framed the challenge accurately. Yet in reassuring the public that the economy would return to normal, he missed a key opportunity to expose the longer-term scourge of widening inequality and its dangers. Containing the immediate financial crisis and then claiming the economy was on the mend left the public with a diffuse set of economic problems that seemed unrelated and inexplicable, as if a town's fire chief dealt with a conflagration by protecting the biggest office buildings but leaving smaller fires simmering all over town: housing foreclosures, job losses, lower earnings, less economic security, soaring pay on Wall Street and in executive suites.

Pentagon investigators are reportedly still searching for Wikileaks co-founder Julian Assange, who helped release a classified US military video showing a US helicopter gunship indiscriminately firing on Iraqi civilians. The US military recently arrested Army Specialist Bradley Manning, who may have passed on the video to Wikileaks. Manning's arrest and the hunt for Assange have put the spotlight on the Obama administration's campaign against whistleblowers and leakers of classified information. We speak to Daniel Ellsberg, who's leaking of the Pentagon Papers has made him perhaps the nation's most famous whistleblower; Birgitta Jónsdóttir, a member of the Icelandic Parliament who has collaborated with Wikileaks and drafted a new Icelandic law protecting investigative journalists; and Glenn Greenwald, political and legal blogger for Salon.com. Subsequently, Ortiz sued both prison officials in federal court for doing nothing to protect her from the guard and punishing her instead.

The laws of war are essential for citizens and legislators to master if humanity is to evolve beyond our violent history of war to enjoy civil communities. To bring these basic laws to life, we'll touch on war's history, explain the letter of US war laws, explain the philosophy/spirit of US war laws, and make the obvious conclusion once the laws are clearly understood that current US wars in Afghanistan and Iraq are unlawful orders that our military must refuse and stop as demanded in their oath to the protect and defend the US Constitution.

Let's review Manning's detention over the last nine straight months:  23-hour/day solitary confinement; barred even from exercising in his cell; one hour total outside his cell per day where he's allowed to walk around in circles in a room alone while shackled, and is returned to his cell the minute he stops walking; forced to respond to guards' inquiries literally every 5 minutes, all day, everyday; and awakened at night each time he is curled up in the corner of his bed or otherwise outside the guards' full view.  Is there anyone who doubts that these measures -- and especially this prolonged forced nudity -- are punitive and designed to further erode his mental health, physical health and will?  As The Guardian reported last year, forced nudity is almost certainly a breach of the Geneva Conventions; the Conventions do not technically apply to Manning, as he is not a prisoner of war, but they certainly establish the minimal protections to which all detainees -- let alone citizens convicted of nothing -- are entitled.

Preventable medical errors kill and seriously injure hundreds of thousands of Americans every year. Any discussion of medical negligence that does not involve preventable medical errors ignores this fundamental problem. And while some interested parties would prefer to focus on doctors' insurance premiums, health care costs, or alternative compensation systems-anything other than the negligence itself-reducing medical errors is the best way to address all the related problems. Preventing medical errors will lower health care costs, reduce doctors' insurance premiums, and protect the health and well-being of patients.

Pop quiz: where did a government agency shut down cell service yesterday to disrupt a political protest? Syria? London? Nope. San Francisco. The answer may seem surprising, but that's exactly what happened yesterday evening. The Bay Area Rapid Transit (BART) asked wireless providers to halt service in four stations in San Francisco to prevent protestors from communicating with each other. The action came after BART notified riders that there might be demonstrations in the city. All over the world people are using mobile devices to organize protests against repressive regimes, and we rightly criticize governments that respond by shutting down cell service, calling their actions anti-democratic and a violation of the rights to free expression and assembly. Are we really willing to tolerate the same silencing of protest here in the United States? BART's actions were glaringly small-minded as technology and the ability to be connected have many uses. Imagine if someone had a heart attack on the train when the phones were blocked and no one could call 911. And where do we draw the line? These protestors were using public transportation to get to the demonstration - should the government be able to shut that down too? Shutting down access to mobile phones is the wrong response to political protests, whether it's halfway around the world or right here at home. The First Amendment protects everybody's right to free expression, and when the government responds to people protesting against it by silencing them, it's dangerous to democracy.
