The Swiss competition commission (COMCO) has opened an investigation of Novartis over possible unlawful use of a patent to reduce competitive pressure, the Swiss drugmaker confirmed on Thursday, September 15. COMCO conducted an early morning raid on the company on Sept. 13, it said in a statement that did not name Novartis, which subsequently said in its own statement that it was the group under investigation. "The company allegedly attempted to protect its drug for the treatment of skin diseases against competing products by using one of its patents to initiate litigation proceedings," COMCO said in a statement. Novartis said COMCO had started an investigation in collaboration with the European Commission into the assertion of a patent in the broader field of dermatology treatments. "In connection with this investigation, COMCO representatives visited the company headquarters in Basel," it said.

A couple in Maidenhead, Berkshire has been handed suspended sentence for illegal possession and supply of £1.6m of unlicensed medicines. Following investigations initiated by the MHRA, Karina Filimonova and Andrejs Stolarovs were caught with the unlicensed medicines which included prescription-only medications. Southwark Crown Court sentenced each "to eight months imprisonment suspended for 18 months and 150 hours unpaid work" for possessing and intending to supply medicinal products contrary to the Human Medicines Regulations 2012. "This was a sophisticated operation illegally bringing unlicensed medicines into the UK from Singapore and India, and then distributing them across the country and abroad," said Andy Morling, MHRA Deputy Director of Criminal Enforcement. "Criminals trading in medicines illegally like this are not only breaking the law, but they also have no regard for your safety. These are powerful medicines that can lead to serious adverse health consequences if taken without appropriate medical supervision." In 2020, the Royal Mail Group (RMG) informed the MHRA about parcels containing unlicensed medicines discovered during their investigation into suspicious parcel activity. Following this, the MHRA's Criminal Enforcement Unit, in cooperation with local police, launched an investigation and apprehended the couple at their residence in Kidwells Close, Maidenhead.

The UK Health Security Agency on Friday said it had designated a sub-lineage of the dominant and highly transmissible Omicron coronavirus variant as a variant under investigation. BA.2, which does not have the specific mutation seen with Omicron that can be used as a proxy to easily distinguish it from Delta, is being investigated but has not been designated a variant of concern. "It is the nature of viruses to evolve and mutate, so it's to be expected that we will continue to see new variants emerge," Dr Meera Chand, incident director at the UKHSA, said. "Our continued genomic surveillance allows us to detect them and assess whether they are significant." Britain had identified 53 sequences of the BA.2 sub-lineage as of January 10, with updated figures due to be published later on Friday.

The General Pharmaceutical Council (GPhC) has revealed it has received 25 whistleblowing disclosures between April 2021 and March 2022. The pharmacy regulator said, in its annual report, that it has concluded enquiries on 22 disclosures so far with a further three still under review. "We also concluded two qualifying disclosures that were raised during the previous reporting period," it said, adding: "The action GPhC took included a full investigation through established fitness to practise processes and follow-up action through its inspection network. "The former can result in any available outcome throughout the fitness to practise process. The latter can include guidance, a follow-up visit or an unexpected inspection." 12 concerns were investigated and concluded with no further action. Three were signposted to another organisation. The remaining seven cases were concluded by sharing information with inspection colleagues for follow up action. Of the two concerns from the previous reporting period, one was concluded with no further action and the other remains under investigation.

Laganside Crown Court, on Friday, sentenced Gerard Cullinan, a 48-year-old pharmacist and Director of Castlereagh Pharmacy Ltd in East Belfast, for unlawfully supplying controlled prescription medicines, including co-codamol and fentanyl, and for failing to maintain controlled drugs registers. Cullinan was sentenced to 11 months imprisonment, suspended for three years, and his pharmacy was fined £8,000. The sentencing follows an investigation by the Department of Health's Medicines Regulatory Group (MRG), which uncovered that Cullinan's pharmacy on Castlereagh Road had illegally supplied over 300,000 co-codamol tablets between January 2017 and June 2020. Additionally, the MRG investigation identified significant breaches in record-keeping for Class A controlled drugs such as fentanyl, tapentadol, methylphenidate, morphine, and oxycodone. "It is a serious criminal offence to sell or supply prescription only medicines without a prescription," said Peter Moore, Senior Medicines Enforcement Officer at the MRG, who led the investigation.

The Competition and Markets Authority (CMA) has launched an investigation following 'rocketing prices of antibiotics in the wake of Strep A cases', Sky News reported on Wednesday (December 14). On Monday, the Department of Health issued a medicine supply notification for antibiotics for the treatment of Strep A. "Supplies of antibiotics for the treatment of Group A Strep have seen a surge in demand and may be temporarily in limited supply at certain wholesalers and pharmacies. Supplies are available with manufacturers, and deliveries into wholesalers and pharmacies are being expedited and are expected in the coming days" said DHSC. Sky quoted a spokesperson for the CMA as saying: "People have got real concerns about the price of antibiotics used to treat Strep A, and we want companies to be clear about their obligations under the law.

A BBC investigation has found 20 UK online pharmacies selling prescription-only medicines without adhering to the regulatory standards, such as checking for GP approval or patient's medical records. The news organisation was able to purchase over 1,600 restricted pills, including anti-anxiety drug, painkiller and sleeping medication, from these regulated online pharmacies easily by providing false information. However, the report didn't mention the names of the drugs as "they can be dangerous when taken without medical guidance." Some pharmacies were also found selling high-risk and potentially addictive medicines, including benzodiazepines and antidepressants, based on online questionnaires and did not require further checks. The General Pharmaceutical Council (GPhC), which regulate online pharmacies in the UK, states that selling and supplying medicines at a distance brings "different risks which need to be appropriately managed to protect patient safety."

In its effort to address workforce challenges, Health Education and Improvement Wales has outlined initiatives aimed at facilitating the return of pharmacy professionals with refugee status to active practice within Wales. This possibility has been stated in HEIW's Strategic Pharmacy Workforce Plan, which commits to investigating the practicality and significance of establishing a registration pathway for pharmacy professionals displaced due to refugee status. According to HEIW, it is currently investigating the viability and importance of revitalising 'return to practice' packages, formulating pharmacy apprenticeships, initiating international recruitment initiatives, and establishing a registration pathway in Wales for displaced pharmacists and pharmacy technicians holding refugee status. "In the past two years, we have arrived at a point where maintaining the desired access to the volume and quality of pharmacy services for our population has proven unattainable," said HEIW. "In Wales, instances of diminished pharmacy services are evident in both hospital and community settings. The trend of abrupt, temporary closures in community pharmacies continues."

The Medicines and Healthcare products Regulatory Agency (MHRA) has cautioned people to stop using certain eye gels, highlighting a potential risk of microbial contamination that can cause an infection. As a precaution, the agency on Friday announced recall of specific batches of carbomer-containing lubricating eye gels branded Aacarb, Aacomer and Puroptics, which are generally used to relieve the symptoms of dry eye. Burkholderia cenocepacia is suspected to have caused the microbial contamination, and the issue was raised after an ongoing investigation conducted by UK Health Security Agency (UKHSA) identified a small number of cases of infection. Investigations are on to determine if there is a link between these products and the infections which have been identified. Meanwhile, retailers have been told to withdraw the affected products, and users are asked to return their product to the place of purchase immediately.

One type of bacteria found in the gut may contribute to the development of Type 2 diabetes, while another may protect from the disease, according to early results from an ongoing, prospective study led by investigators at Cedars-Sinai. The study, published in the peer-reviewed journal Diabetes, found people with higher levels of a bacterium called Coprococcus tended to have higher insulin sensitivity, while those whose microbiomes had higher levels of the bacterium Flavonifractor tended to have lower insulin sensitivity. Mark Goodarzi, the director of the Endocrine Genetics Laboratory at Cedars-Sinai in Los Angeles, California, is leading an ongoing study that is following and observing people at risk for diabetes to learn whether those with lower levels of these bacteria develop the disease. "The big question we're hoping to address is: Did the microbiome differences cause diabetes, or did diabetes cause the microbiome differences?" said Goodarzi, who is the senior author of the study and principal investigator of the multicenter study called Microbiome and Insulin Longitudinal Evaluation Study (MILES).

Kent Pharma UK has announced a precautionary recall of multiple batches of Itraconazole 10mg/ml oral solution following the identification of out-of-specification appearance in the solution, particularly the presence of suspended particles or clusters of crystals. Itraconazole is an antifungal medication prescribed for treating fungal or yeast infections in different parts of the body. Its oral solution form is specifically intended for treating oropharyngeal or esophageal candidiasis, commonly known as thrush or oral thrush. The Medicines and Healthcare products Regulatory Agency (MHRA) has advised the recall following initial investigations, which indicated a solubilisation issue of the active ingredient, itraconazole. This problem may result in some doses containing lower amounts of the active ingredient. The root cause of the issue is currently under investigation. However, due to the potential for underdosage, the affected batches are being recalled as a precautionary measure.

Community Pharmacy England (CPE) has submitted evidence to Lord Darzi's investigation into NHS performance, highlighting the sector's value, challenges, and potential opportunities. The Royal College of Nursing (RCN) has called on the UK government to launch an urgent investigation into the exploitation of migrant care workers, following a sharp rise in reported cases. According to new RCN data, there has been a six-fold increase in the number of overseas care workers being exploited by rogue employers over the past three years. In 2020/21, the RCN's advice team handled 22 calls from members regarding repayment clauses in their contracts. This figure shot up to 134 in 2023/24, with May 2024 alone seeing 17 calls - the highest in a single month. The RCN highlighted that repayment clauses are being misused by employers to demand thousands of pounds from migrant care workers, leaving staff unable to leave their jobs and trapped in "appalling conditions" years after they were first hired.

The National Pharmacy Association (NPA) has commissioned Professor David Taylor of University College London to investigate the implications of all-time high inflation rates on community pharmacies in the UK. Professor Taylor's will assess rates of inflation affecting community pharmacy across the UK, using public data sources whilst examining inflated costs in the context of the current five year contractual framework in England (2019-2024). He would review the EY (Ernst & Young) report into pharmacy funding, to identify whether current inflationary pressures could change any of the findings and consider the policy implications and impacts of inflationary pressures, including pharmacy's ability to prepare for a more clinically focused future and maintain current core services. NPA chief executive Mark Lyonette said: "Inflationary pressures are eating into the limited funds provided by the NHS for pharmacy services. We believe the real level of inflation for pharmacy businesses could be higher than the CPI inflation rate, which itself is at a 40 year high. Staff and locum costs in the sector as well as medicines costs have risen dramatically.
