Nearly 70 years ago the UK Government recognised the imbalance of power between commercial landlords and tenants and passed the Landlord and Tenant Act 1954 (the Act), giving most commercial tenants a right of security of tenure. What is security of tenure? The Act grants tenants of business premises (so this would include pharmacy tenants) the right when the fixed term of their lease has ended to remain in occupation of the premises and the right to apply for the grant of a new lease. The landlord can only object to the grant of the new lease of the premises to the tenant, and therefore regain possession of the property on certain grounds set out in the Act. The parties to a lease can contract outside the provisions of the Act and where this is the case, a tenant would not have security of tenure. Most landlords will insist on no security of tenure where a lease is granted for a short term. As pharmacy leases have tended to be granted for longer terms (usually between 10 and 15 years) pharmacy tenants often have security of tenure. The Act sets out strict procedures which need to be followed to both contract outside the provisions of security of tenure and also to exercise the security of tenure rights granted by the Act. Pharmacists should take legal advice before agreeing to a pharmacy lease being excluded from the Act, and also at the end of their lease term whether or not they have security of tenure. If the lease is contracted outside of the Act, advice should be sought on agreeing new lease terms, if the pharmacist wishes to remain, as there will be no right to do so beyond the end of the lease term. If the lease is protected by the security of tenure provisions of the Act, advice should still be sought, as the Act prescribes a formal notice procedure that both the landlord and tenant must adhere to, before a new lease can be granted.

One in eight people who were hospitalised with Covid-19 between May 2020 and March 2021 were later diagnosed with myocarditis, according to major new research into the clinical long-term effects of coronavirus. The government has unveiled its much awaited 'NHS Long-Term Workforce Plan' to tackle the staff shortage in the pharmacy sector. The plan set out an ambition to increase the training places for pharmacists to around 5,000 places by 2031/32. David Webb, Chief Pharmaceutical Officer for England, in his open letter to pharmacy professionals said: "The NHS LTWP sets out how we can build on changes, addressing the changing needs of patients over the next 15 years, by closing the current workforce shortfall through funding for increased education and training places and a comprehensive retention strategy." The plan commits to expand training places for pharmacists by 29% to around 4,300 by 2028/29 and Grow the number of pharmacy technicians in future years. "The development of independent prescribing as part of initial education and training is a gamechanger for pharmacists, patients and the NHS, with approximately 2,800 newly registered pharmacist independent prescribers due to join the workforce every year from September 2026," said Webb. More than three quarters of British people, who have suffered persistent ill health following a Covid-19 infection, have had to cut back or change the work they do, according to a survey on the impact of long Covid published on Wednesday (November 9). In the survey of 1,002 people, conducted by market research company Censuswide, some 98 per cent of long Covid sufferers said the condition had limited their ability to work, with 78 per cent needing to cut back or change their work and 19 having ceased work altogether. Long Covid, a collection of symptoms ranging from pain and heart palpitations to insomnia and brain fog, can last for many months after initial infection. Britain's most recent official labour market data showed that a record proportion of people classified as "economically inactive" - neither working nor looking for a job - were suffering from long-term sickness. In absolute terms, the number of working-age people who are long-term sick has risen by 378,000 since early 2020.

The Pharmacists' Defence Association (PDA) has expressed disappointment at the omission, once again, of the promised Employment Rights Bill omitted from the Queen's Speech earlier this week. The Bill is pledged to strengthen day one employment rights and increase the productivity of businesses. It set out plans which would protect and enhance workers' rights and aim to make the UK the best place in the world to work at. This included plans to introduce the right to request flexible working for around 2.2 million people in Great Britain - regardless of time served in a bid to modernise the way employees work. The PDA said: "The Employment Rights Bill would have presented an opportunity to improve the ability for workers to obtain redress in the event of poor treatment or discrimination through the development of a single labour market enforcement body. "Poor employment practices, such as insecure work through long-term zero-hours contracts, unilaterally changing workers' terms and conditions by terminating their contracts and re-hiring them on new terms and conditions (also known as fire and rehire), and the sacking of workers without notice, as recently demonstrated by P & O Ferries, could have been outlawed under new legislation."

The National Pharmacy Association (NPA) highlighted the role played by community pharmacies during pandemic to provide urgent care and vital support to people with long-term medical conditions at its opening remark in the Covid-19 public inquiry held on Tuesday (28 February). NPA is the core participant in the Covid-19 public inquiry. lawyer Brian Stanton made an opening statement on the NPA's behalf which focused on three areas- health inequalities and the needs of vulnerable patients; the impact of medicine shortages and medicine price increases and the challenge that community pharmacy faced in responding to the pandemic and maintaining patient services following long-term under investment. Stanton said: "The UK's community pharmacies were on the frontline of efforts to limit the impact of coronavirus and to keep people well, and as well as handling a massive increase in demand for healthcare advice and medicines, they also continued to provide urgent care and vital support to people with long-term medical conditions. The Parliamentarians have called the government to urgently consider the short-term funding to stabilise the community pharmacy sector. 39 MPs and Peers from across the political spectrum have signed letters to the Health Secretary, Steve Barclay MP and raised their growing concern about the pressures facing England's community pharmacies and the risks this poses to patient care and safety. "Steve Barclay MP received correspondence from 23 Opposition MPs, with six Peers also signing a letter. Separately, 9 Conservative MPs also wrote to the Health Secretary and up to 10 others have signalled their intention to write to the relevant Minister," said the Pharmaceutical Services Negotiating Committee (PSNC). The Parliamentarians acknowledged that pharmacies have the potential to do more to support the NHS and they called for the government to urgently consider a commitment to working with the sector to create a fair and fit for purpose future funding model that ensures sustainability and properly funds pharmacies for what they do. All signatories also called for the introduction of a fairly-funded Pharmacy First service.

Campaigners have submitted an open letter to the Department of Health and Social Care (DHSC), urging the Minister for Primary Care and Public Health to freeze prescription charges to keep people with long-term conditions alive and well. The campaign is led by the Prescription Charges Coalition, which represents over 50 organisations, including Royal Pharmaceutical Society (RPS) and Pharmacists' Defence Association (PDA). Currently, the prescription charge is £9.65 per item, and campaigners have asked the government to freeze it for 2024 and 2025 as people living with long-term health conditions in England are "being forced to choose between heating, eating, and taking their vital medication on a daily basis." In 2023, a study conducted by the Prescription Charges Coalition revealed that almost 10 per cent of survey participants had skipped medication in the previous year due to the cost of prescriptions. This led to increased physical and mental health problems, as well as impacted the time they took off work.
