Chief executive of the Pharmaceutical Services Negotiating Committee Janet Morrison has said government ministers are looking at the future of community pharmacy in England in a "bigger way" and have a vision to go "beyond the Scotland model". "I think they believe they're going beyond the Scotland model," she said, in her closing keynote at the 7th Annual Pharmacy Business Conference held in London on Sunday (May 14). Giving her views on the latest government funding - worth £645 million - for community pharmacy, the head of pharmacy negotiator, added: "Their thinking is for the future in a bigger and a more forward-thinking way." She added it was for the first time that community pharmacy has been seen "as part of primary care in a really fundamental way that gives us hope for the future". Morrison said the new funding uplift was effectively "for five quarters of activity," arguing that the common condition service won't start before December or early in the New Year due to the time it would take to get the IT systems up and running to support the rollout.

The Pharmaceutical Services Negotiating Committee (PSNC) has urged the pharmacy contractors to follow appropriate procedures for unplanned temporary closures due to current workforce pressure, to avoid a breach of terms of service. "If the temporary closure is not for reasons beyond the contractor's control, this may be a breach of the terms of service," said PSNC. The committee also informed that in some areas, NHS England regional teams may ask contractors to complete a new notification form for any temporary closures that request more information than the standard form, for example, on the mitigating actions taken by the contractor. It added: "Completion of these forms is voluntary but may help to show NHS England that the closure was for reasons beyond the contractor's control, or that the overall circumstances of the closure, including time closed and steps taken to ensure patient and public needs are met, indicate that there is no public interest in taking any regulatory/performance action (such as a breach notice) against the contractor."

Labour's Paulette Hamilton has raised concerns regarding the increasing reliance on pharmacy technicians in clinical practice due to staffing shortages within pharmacies. At the recent Pharmacy Inquiry session, Hamilton highlighted the mounting pressure on technicians to take on more responsibilities beyond their qualifications, attributing it to the launch of Pharmacy First in January. With almost 50,000 Pharmacy First consultations conducted in the first month alone as per a report by the Company Chemists' Association, Hamilton expressed apprehension about technicians being classified under the broad term of "pharmacy professionals," blurring the distinction between their roles and those of clinical pharmacists. She further drew parallels between this situation and the scrutiny faced by physician associates (PAs) in GP practices following a patient's death due to misdiagnosis and cautioned against technicians performing tasks beyond their expertise and urged policymakers to prevent similar incidents in pharmacy settings. Health Minister Dame Andrea Leadsom responded by defending the current approach, denying any "blurring of the edges" and emphasizing patient safety as the top priority.

Many community pharmacies are under severe financial strain due to chronic underfunding and a mismatch between medicine costs and reimbursement rates. A report by the National Pharmacy Association (NPA) revealed that NHS underpays pharmacies by up to £75 a pack for common medicines, resulting in losses of thousands of pounds each month. The Royal Pharmaceutical Society (RPS) Assembly has announced the re-appointment of Professor Claire Anderson as President for a further term of two years on Tuesday (11 July). Nearly 70 years ago the UK Government recognised the imbalance of power between commercial landlords and tenants and passed the Landlord and Tenant Act 1954 (the Act), giving most commercial tenants a right of security of tenure. What is security of tenure? The Act grants tenants of business premises (so this would include pharmacy tenants) the right when the fixed term of their lease has ended to remain in occupation of the premises and the right to apply for the grant of a new lease. The landlord can only object to the grant of the new lease of the premises to the tenant, and therefore regain possession of the property on certain grounds set out in the Act. The parties to a lease can contract outside the provisions of the Act and where this is the case, a tenant would not have security of tenure. Most landlords will insist on no security of tenure where a lease is granted for a short term. As pharmacy leases have tended to be granted for longer terms (usually between 10 and 15 years) pharmacy tenants often have security of tenure. The Act sets out strict procedures which need to be followed to both contract outside the provisions of security of tenure and also to exercise the security of tenure rights granted by the Act. Pharmacists should take legal advice before agreeing to a pharmacy lease being excluded from the Act, and also at the end of their lease term whether or not they have security of tenure. If the lease is contracted outside of the Act, advice should be sought on agreeing new lease terms, if the pharmacist wishes to remain, as there will be no right to do so beyond the end of the lease term. If the lease is protected by the security of tenure provisions of the Act, advice should still be sought, as the Act prescribes a formal notice procedure that both the landlord and tenant must adhere to, before a new lease can be granted.

There is clear evidence that the majority of distance selling pharmacies are operating in breach of their NHS contracts, and a failure to properly regulate 'pseudo' distance selling pharmacies is leading to local pharmacy closures, the Company Chemists' Association has reported. According to the CCA's recent findings, 72 per cent of DSPs dispense over 50 per cent of their prescriptions to patients within a single postcode area within 10 miles of the pharmacy. "Operating within constrained geographical regions, pseudo-DSPs achieve reduced overheads and operational costs by focusing on localised marketing and medicine delivery. They compete against local brick-and-mortar pharmacies, causing them to lose vital trade," the CCA claimed, based on its recent survey - The Impact of Pseudo Distance Selling Pharmacies. "As per their terms of service, DSPs are obligated to provide prescription delivery nationwide, extending beyond local patients," said the CCA, adding that the financial savings resulting from the lack of patient access are balanced by the necessity to function on a national scale.

The Integrated Care Systems (ICSs) provide an opportunity to break the silo mentality in the health and care sector, National Pharmacy Association (NPA) chair Andrew Lane told MPs. While giving evidence to the Health and Social Care Select Committee on 6 December about the effectiveness of ICSs, Lane also poured cold water on newspaper reports that community pharmacists will be drafted in to break the NHS strike, as he reiterated the call for a "properly costed and funded environment." "We've been in different silos historically and ICSs are an opportunity to pull all systems together for the benefit of patients," he told committee members. Lane pointed to dementia-trained pharmacy delivery drivers and the Discharge Medicines Service as instances where the influence of community pharmacy already stretches beyond primary care into hospitals and social care. "We've seen pharmacists prescribe and get UTIs off doctors' desks, so we are starting to release capacity [in the system] and we're on that clinical journey. We welcome that, but it has to be with the right level of funding," he added.

The English health secretary has fumbled the opportunity to prevent a crisis in the NHS this winter. Adding a new service here and there, even with some additional funding, does not address the longer term viability of the network which needs to know which patient services it will be expected to provide over the next 10 years - not just the next few months - and how those will be adequately remunerated. Asking more from our sector with no new investment is a strategy which is bound to fail. The pharmacy contract remains economically illiterate. The sector's finances need open heart surgery not a couple of paracetamol tablets.
