Mozilla Sets New Plans for Do Not Track Browser | Adweek - 0 views

  • Much to the disappointment of the digital advertising establishment, Mozilla is going ahead with plans to automatically block third-party cookie tracking in its Firefox browser. Mozilla first announced its Do Not Track browser in February, only to back off in May saying it needed to do more testing. But that didn't stop a growing chorus of loud protests from the advertising community, which argued that the browser would choke off the ad-supported Internet. The Interactive Advertising Bureau's general counsel Mike Zaneis called Mozilla's browser nothing less than a "nuclear first strike" against the ad community. No date has been set for when Firefox will turn on the feature, but advertisers, which have been regularly meeting with Mozilla and were hopeful for a compromise, are already lashing back at Mozilla.
  • "It's troubling," said Lou Mastria, the managing director for the Digital Advertising Alliance, which manages an online self-regulatory program called Ad Choices that provides consumers with the Choice to opt-out of targeted ads. "They're putting this under the cloak of privacy, but it's disrupting a business model," Mastria said. Advertisers are worried that Mozilla's plans could be the death knell to thousands of small Web publishers that depend on third-party targeted ads to stay in business. Nearly 1,000 signed a petition urging Mozilla to change its plans.  "One publisher said that 20 percent of their business would go away. That's huge," said Mastria. "Mozilla is really picking business model winners and losers."
  • Not all cookies will be blocked under Mozilla's latest plans for its proposed browser; there will be exceptions. Through a partnership with the Center for Internet and Society at Stanford Law School, the two are launching a Cookie Clearinghouse. Overseen by a six-person panel, it will determine a list of undesirable cookies and then block those. "The Cookie Clearinghouse will create, maintain and publish objective information," Aleecia McDonald, director of privacy at CIS, said in a statement. "Web browser companies will be able to choose to adopt the lists we publish to provide new privacy options to their users." But others say the approach is far from objective. "What these organizations and the privacy groups that back them are really saying is 'let us choose for you because we know best,' " said Daniel Castro, a senior analyst with the Information Technology and Innovation Foundation. "The proponents of this model have claimed they are empowering users. ... This is basically Sarah Palin's 'Death Panels' but for the Internet."

  • Advertisers have so far resisted some of the Do Not Track proposals advocated by privacy groups arguing they are technological solutions that could quickly be rendered obsolete by the fast-moving Internet economy. When Micosoft launched its Do Not Track default browser, advertisers said they would not honor it. Meanwhile, members of the World Wide Web Consortium's tracking group, represented by advertisers, privacy groups and other stakeholders, have been unable to reach consensus about a universal Do Not Track browser solution. In Congress, where baseline privacy legislation has moved at a glacial pace, Mozilla's news gave Sen. Jay Rockefeller (D-W.Va.) more ammunition for his Do Not Track Online Act. Introduced earlier this year, the bill hasn't gotten much traction and only has one co-sponsor, Sen. Richard Blumenthal (D-Conn.). "With major Web browsers now starting to provide privacy protections by default, it's even more important to give businesses the regulatory certainty they need and consumers the privacy protections they deserve," Rockefeller said in a statement. "I hope this will end the emerging back and forth so we can act quickly to pass new legislation."

Ad industry threatens Firefox users with more ads if Mozilla moves on tracking plans | Computerworld New Zealand - 0 views

  • The online ad industry has attacked Mozilla over its decision to block third-party cookies in a future release of Firefox, calling the move "dangerous and highly disturbing," and claiming that it will result in more ads shown to users. The fierce reaction came from the Interactive Advertising Bureau (IAB) and Association of National Advertisers (ANA), both of which laid out positions in blog posts on March 14.
  • In their blogs, the two groups lambasted Mozilla, predicting dire consequences, including the shuttering of small businesses and small websites, fewer choices for online users, and more ads in Firefox. "If Mozilla follows through on its plan ... the disruption will disenfranchise every single Internet user," said Randall Rothenberg, president and CEO of the IAB, in his post.     A further thought: There is binding and enforceable international law on the subject of freedom of speech and access to information in a treaty that has been ratified by all nations other than China, which has signed but not yet ratified the treaty. That treaty's terms might provide a rallying point for at least limiting the ITU's desire to grab power over the Internet. The International Covenant on Civil and Political Rights ("ICCRR") Article 19 provides: "1. Everyone shall have the right to hold opinions without interference. "2. Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice. "3. The exercise of the rights provided for in paragraph 2 of this article carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but these shall only be such as are provided by law and are necessary: (a) For respect of the rights or reputations of others; (b) For the protection of national security or of public order (ordre public), or of public health or morals." http://www2.ohchr.org/english/law/ccpr.htm The last exception is broader than what I would prefer. However, while the rights created by by the ICCRR transcend national boundaries, the quoted provision unquestionably stands for the proposition that exception (b) applies only to nations and not to a U.N. body itself.     Javascript has a major advantage of being (likely) the most installed programming language in history. It's experiencing a renaissance lately where people actually learning it, not just copying code found on someone's website. ECMAScript Harmony will bring some much needed fixes to the language (although I think ECMAScript 4 would have been a true game-changer for the web). Regardless, until we have more mature tools for sever- and DB-side javascript, Javascript is really a browser language (and faces an army of entrenched programmers who'd rather use some other language). To the second argument, I say: Javascript is an amazing language, but you can't declare it off limits to people who prefer other languages. Programming is about choice. On the server we get to use whatever combinations of web server, database, programming language, and development environment we like. Not so for the browser. We're stuck with Javascript whether we like it or not. We can't stay away from it, we can't use something else. Everyone who dislikes working in Javascript is perfectly justified because he has no other avenue. When all browsers support and are prepackaged with VMs for many languages, I'll be the first to sound the clarion: if you don't like JS, get the hell away from it. Until then, you're stuck with us and we're stuck with you. To the third: again, it's really all about to choice. If you prefer Javascript keep using it, make it better, steal ideas from other languages, and seed the community with new ideas of your own. Nobody will complain about a better overall development community. If you'd like to see Red in Python, PHP, C#, or language X then steal Jesse's code. Red was a herculean effort on Jesse's part. I know he's worked on nothing else for two months and future ports of Red to other languages will benefit from this effort.

First, Intel gave wholly or partially hidden rebates to computer manufacturers on condition that they bought all, or almost all, their x86 CPUs from Intel. Intel also made direct payments to a major retailer on condition it stock only computers with Intel x86 CPUs. Such rebates and payments effectively prevented customers - and ultimately consumers - from choosing alternative products. Second, Intel made direct payments to computer manufacturers to halt or delay the launch of specific products containing competitors’ x86 CPUs and to limit the sales channels available to these products.

  • In its decision, the Commission does not object to rebates in themselves but to the conditions Intel attached to those rebates.
  • Intel structured its pricing policy to ensure that a computer manufacturer which opted to buy AMD CPUs for that part of its needs that was open to competition would consequently lose the rebate (or a large part of it) that Intel provided for the much greater part of its needs for which the computer manufacturer had no choice but to buy from Intel. The computer manufacturer would therefore have to pay Intel a higher price for each of the units supplied for which the computer manufacturer had no alternative but to buy from Intel. In other words, should a computer manufacturer fail to purchase virtually all its x86 CPU requirements from Intel, it would forego the possibility of obtaining a significant rebate on any of its very high volumes of Intel purchases. Moreover, in order to be able to compete with the Intel rebates, for the part of the computer manufacturers' supplies that was up for grabs, a competitor that was just as efficient as Intel would have had to offer a price for its CPUs lower than its costs of producing those CPUs, even if the average price of its CPUs was lower than that of Intel.
  • For example, rival chip manufacturer AMD offered one million free CPUs to one particular computer manufacturer. If the computer manufacturer had accepted all of these, it would have lost Intel's rebate on its many millions of remaining CPU purchases, and would have been worse off overall simply for having accepted this highly competitive offer. In the end, the computer manufacturer took only 160,000 CPUs for free.
  • Intel also interfered directly in the relations between computer manufacturers and AMD. Intel awarded computer manufacturers payments - unrelated to any particular purchases from Intel - on condition that these computer manufacturers postponed or cancelled the launch of specific AMD-based products and/or put restrictions on the distribution of specific AMD-based products. The Commission found that these payments had the potential effect of preventing products for which there was a consumer demand from coming to the market. The Commission found the following specific cases: For the 5% of computer manufacturer B’s business that was not subject to the conditional rebate outlined above, Intel made further payments to computer manufacturer B provided that this manufacturer : sold AMD-based business desktops only to small and medium enterprises sold AMD-based business desktops only via direct distribution channels (as opposed to through distributors) and postponed the launch of its first AMD-based business desktop in Europe by 6 months. Intel made payments to computer manufacturer E provided that this manufacturer postponed the launch of an AMD-based notebook from September 2003 to January 2004. Before the conditional rebate to computer manufacturer D outlined above, Intel made payments to this manufacturer provided that it postponed the launch of AMD-based notebooks from September 2006 to the end of 2006.
  • The Commission obtained proof of the existence of many of the conditions found to be illegal in the antitrust decision even though they were not made explicit in Intel’s contracts. Such proof is based on a broad range of contemporaneous evidence such as e-mails obtained inter alia from unannounced on-site inspections, in responses to formal requests for information and in a number of formal statements made to the Commission by the other companies concerned. In addition, there is evidence that Intel had sought to conceal the conditions associated with its payments.

Microsoft's Quest for Interoperability and Open Standards - 0 views

    Interesting article discussing the many ways Microsoft is using to improve the public perception that they are serious about interoperability and open formats, protocols and interfaces. Rocketman attended the recent ISO SC34 meeting in Prague and agrees that Microsoft has indeed put on a new public face filled with cooperation, compliance and unheard of sincerity.

    He also says, "Don't be fooled!!!"

    There is a big difference between participation in vendor consortia and government sponsored public standards efforts, and, actual implementation at the product level. Looking at how Microsoft products implement open standards, my take is that they have decided on a policy of end user choice. Their applications offer on the one hand the choice of aging, near irrelevant and often crippled open standards. And on the other, the option of very rich and feature filled but proprietary formats, protocols and interfaces that integrate across the entire Microsoft platform of desktop, devices and servers. For instance; IE8 supports 1998 HTML-CSS, but not the advanced ACiD-3 "HTML+" used by WebKit, Firefox, Opera and near every device or smartphone operating at the edge of the Web. (HTML+ = HTML5, CSS4, SVG/Canvas, JS, JS Libs).

    But they do offer advanced .NET-WPF proprietary alternative to Open Web HTML+. These include XAML, Silverlight, XPS, LINQ, Smart Tags, and OOXML. Very nice.

    "When an open source advocate, open standards advocate, or, well, pretty much anyone that competes with Microsoft (news, site) sees an extended hand from the software giant toward better interoperability, they tend to look and see if the other hand's holding a spiked club.

  • This line stems from the mistakes the Commission recognised it had made by imposing remedies on Microsoft in the Media Player case (see background). Indeed, although Microsoft is now obliged to offer a version of Windows without Media Player, for the most part, users are opting for the readily available bundled offer, which provides extra software at the same price. "That remedy was rubbish," acknowledged an official in the Commission's competition department.

    Maybe the EU can right the marketplace and restore competition by identifying all proprietary formats, protocols and interfaces used by Microsoft in an anti-competitive way; then issue a directive to either replace these locks with open standard alternatives, or pay a monthly anti-competitive reimbursement penalty until such time as the end user effectively replaces these systems. This approach is similar to the "WiNE solution" put forward to Judge Jackson as part of the USA anti-trust remedy. Judge Jackson favored a break up of Microsoft into two divisions; Operating systems and other businesses. Few believed this was enforceable, with many citing the infamous "Chinese Wall" claims made by Chairman Bill

  • Here, we have no better theory to explain why Microsoft is enthusiastic to spread C# onto the web via Silverlight, but not to give C# a run for its money in the open web standards by supporting ES4 in IE.The fact is, and we've heard this over late night truth-telling meetings between Mozilla principals and friends at Microsoft, that Microsoft does not think the web needs to change much. Or as one insider said to a Mozilla figure earlier this year: "we could improve the web standards, but what's in it for us?"

    Microsoft opposes the stunning collection of EcmaScript standards improvements to JavaScript ES3 known as "ES4". Brendan Eich, author of JavaScript and lead Mozilla developer claims that Microsoft is stalling the advance of JavaScript to protect their proprietary advantages with Silverlight - WPF technologies. Opera developer "Haavard" asks the question, "Why would Microsoft do this?" Brendan Eich explains: Indeed Microsoft does not desire serious change to ES3, and we heard this inside TG1 in April. The words were (from my notes) more like this: "Microsoft does not think the web needs to change much". Except, of course, via Silverlight and WPF, which if not matched by evolution of the open web standards, will spread far and wide on the Web, as Flash already has. And that change to the Web is apparently just fine and dandy according to Microsoft. First, Microsoft does not think the Web needs to change much, but then they give us Silverlight and WPF? An amazing contradiction if I ever saw one. It is obvious that Microsoft wants to lock the Web to their proprietary technologies again. They want Silverlight, not some new open standard which further threatens their locked-in position. They will use dirty tricks - lies and deception - to convince people that they are in the right. Excellent discussion on how Microsoft participates in open standards groups to delay, stall and dumb down the Open Web formats, protocols and interfaces their competitors use. With their applications and services, Microsoft offers users a Hobbsian choice; use the stalled, limited and dumbed down Open Web standards, or, use rich, fully featured and advanced but proprietary Silverlight-WPF technologies.   • The European Commission can confirm that it has sent a Statement of Objections (SO) to Microsoft on 15th January 2009. The SO outlines the Commission’s preliminary view that Microsoft’s tying of its web browser Internet Explorer to its dominant client PC operating system Windows infringes the EC Treaty rules on abuse of a dominant position (Article 82).
  • In the SO, the Commission sets out evidence and outlines its preliminary conclusion that Microsoft’s tying of Internet Explorer to the Windows operating system harms competition between web browsers, undermines product innovation and ultimately reduces consumer choice. The SO is based on the legal and economic principles established in the judgment of the Court of First Instance of 17 September 2007 (case T-201/04), in which the Court of First Instance upheld the Commission's decision of March 2004 (see IP/04/382), finding that Microsoft had abused its dominant position in the PC operating system market by tying Windows Media Player to its Windows PC operating system (see MEMO/07/359).

  • The evidence gathered during the investigation leads the Commission to believe that the tying of Internet Explorer with Windows, which makes Internet Explorer available on 90% of the world's PCs, distorts competition on the merits between competing web browsers insofar as it provides Internet Explorer with an artificial distribution advantage which other web browsers are unable to match. The Commission is concerned that through the tying, Microsoft shields Internet Explorer from head to head competition with other browsers which is detrimental to the pace of product innovation and to the quality of products which consumers ultimately obtain. In addition, the Commission is concerned that the ubiquity of Internet Explorer creates artificial incentives for content providers and software developers to design websites or software primarily for Internet Explorer which ultimately risks undermining competition and innovation in the provision of services to consumers.
  • Microsoft has 8 weeks to reply the SO, and will then have the right to be heard in an Oral Hearing should it wish to do so. If the preliminary views expressed in the SO are confirmed, the Commission may impose a fine on Microsoft, require Microsoft to cease the abuse and impose a remedy that would restore genuine consumer choice and enable competition on the merits.
  • A Statement of Objections is a formal step in Commission antitrust investigations in which the Commission informs the parties concerned in writing of the objections raised against them. The addressee of a Statement of Objections can reply in writing to the Statement of Objections, setting out all facts known to it which are relevant to its defence against the objections raised by the Commission. The party may also request an oral hearing to present its comments on the case. The Commission may then take a decision on whether conduct addressed in the Statement of Objections is compatible or not with the EC Treaty’s antitrust rules. Sending a Statement of Objections does not prejudge the final outcome of the procedure. In the March 2004 Decision the Commission ordered Microsoft to offer to PC manufacturers a version of its Windows client PC operating system without Windows Media Player. Microsoft, however, retained the right to also offer a version with Windows Media Player (see IP/04/382).

    It's official, hot off the presses (wasn't there a few minutes ago). We're now into a process where DG Competition will revisit its previous order requiring Microsoft to market two versions of Windows, one with Media Player and one without. DG Competition staff were considerably outraged that Microsoft took advantage of a bit of under-specification in the previous order and sold the two versions at the same price. That detail will not be neglected this time around. Moreover, given the ineffectiveness of the previous order in restoring competition among media players, don't be surprised if this results in an outright ban on bundling MSIE with Windows.

  • Prior to CSS, nearly all of the presentational attributes of HTML documents were contained within the HTML markup; all font colors, background styles, element alignments, borders and sizes had to be explicitly described, often repeatedly, within the HTML. CSS allows authors to move much of that information to a separate stylesheet resulting in considerably simpler HTML markup. Headings (h1 elements), sub-headings (h2), sub-sub-headings (h3), etc., are defined structurally using HTML. In print and on the screen, choice of font, size, color and emphasis for these elements is presentational. Prior to CSS, document authors who wanted to assign such typographic characteristics to, say, all h2 headings had to use the HTML font and other presentational elements for each occurrence of that heading type. The additional presentational markup in the HTML made documents more complex, and generally more difficult to maintain. In CSS, presentation is separated from structure. In print, CSS can define color, font, text alignment, size, borders, spacing, layout and many other typographic characteristics. It can do so independently for on-screen and printed views. CSS also defines non-visual styles such as the speed and emphasis with which text is read out by aural text readers. The W3C now considers the advantages of CSS for defining all aspects of the presentation of HTML pages to be superior to other methods.   • The choices for desktop runtimes will be more flexible and will largely be driven by the type of applications rather than the type of platform. It’s likely that desktop computers will eventually ship with two or three different runtimes and that consumers will be more or less ignorant of which one they are using. What will determine the success of one desktop runtime over others will be the execution and development environment. Desktop runtimes that provide the most processing power, speed of execution, and security will dominate. In this scenario the end-user is no longer the customer, it's independent software developers and Integrated Software Vendors that are of primary importance. It’s the developers who will choose the platform on which they create cross-platform applications – the consumer will be largely ignorant of the choices made.  With the exception of download and install differences, the applications will look the same to end-users.

      "It's independent application developers and integrated software vendors that determine which RiA platforms will prevail. Will this group value "cross-platform" RiA? Or will they go for integrated cloud services designed to drive down the cost of development and implementation? Integration into existing business systems i think will trump cross-platform concerns. For sure Microsoft is betting the farm on this.

While dominance of the desktop has been maintained for the last decade or more by Microsoft, which at one point represented 95% of the desktops used by all consumers, the future is less certain.it will not be a single operating system that prevails. In the end it will be desktop runtimes that become the most important platforms A desktop runtime is a platform that provides a consistent runtime environment regardless of the underlying operating system. Desktop runtimes are already extending beyond their primary target platform, the desktop, to the Fourth Screen - smart phones.
