    The more interesting issue to me is the accusation that Google violates antitrust law by boosting its comparison shopping search results in its search results, unfairly disadvantaging competing shopping services and not delivering best results to users. What's interesting to me is that the Commission is attempting to portray general search as a separate market from comparison shopping search, accusing Google of attempting to leverage its general search monopoly into the separate comoparison shopping search market. At first blush, Iim not convinced that these are or should be regarded as separable markets. But the ramifications are enormous. If that is a separate market, then arguably so is Google's book search, its Google Scholar search, its definition search, its site search, etc. It isn't clear to me how one might draw a defensible line taht does not also sweep in every new search feature  as a separate market.

Good News for Ajax and the Open Web - The Browser Wars Are Back - 0 views

  • For much of this decade, Web browsing has been dominated by Microsoft's Internet Explorer (IE), which at its height achieved market share numbers approaching 95%, with the result that Microsoft owned a de facto standard for the Web and held effective veto power over the future of HTML. During much of this period, Microsoft suspended development of IE, with the result that virtually no new features appeared within the world's dominant browser from 2001 to 2006. But while IE was sleeping, one of the biggest phenomena of the computer age happened: Ajax. Clever Web developers discovered gold in them there mountains. Using Ajax techniques, Web developers could create desktop-like rich user interfaces right in the browser. Not only that, Ajax was evolutionary. Perhaps even more significant is the untold story of Microsoft's attempts to corner the Web server market. As someone whose company competes directly with Microsoft, (we sell a Web server called WebSite that runs on Windows NT, and we are active in promoting Perl, Linux and other open-source technologies), I've been privy to some of the not-so-small details that have guided the course of this recent history. This is what Adobe AIR, Microsoft Silverlight, Google Gears and Curl are fighting for. Nothing short of the future of desktop and RIA development. Microsoft brings with it a huge ecosystem of .NET developers - potentially millions of developers already skilled in WPF, XAML and C#. That's a pretty scary for others in the Fit Client arena. What Nick doesn't cover is how Chorme is desinged to bridge that gap between Web surfing and next generation Web Applications (RiA). Microsoft is in position to dominate this next generation, while Chrome represents Google's first step into the fray. Sure, Google dominates consumer applets and services, but RiA represents a model for enterprise and corporate business systems moving their core to the Web. It's a big shift.   • Today, in an effort to bring more of the Web to mobile devices, Adobe and microchip maker ARM, which powers 90 percent of mobile phones worldwide, have announced a collaboration to ensure that Adobe's software runs well on future ARM devices. Specifically, the companies say that Adobe's Flash Player 10 and AIR (a platform for building complex Web applications) will be compatible and optimized for the ARM chips available in 2009. While ARM is used in a huge number of mobile phones, the announcement has broader implications: the chips are also used in set-top boxes, mobile Internet devices, personal media players, and automotive platforms.

EU looks into telecoms blocking Internet calls - International Herald Tribune - 0 views

  • European Union regulators are looking into whether mobile phone operators who block customers from making inexpensive wireless calls over the Internet are breaking competition rules. The European Commission, the EU antitrust authority, has sent questionnaires to phone companies asking what "tools" they use to "control, manage, block, slow down or otherwise restrict or filter" Internet-based voice calls. The EU deadline for responding to the survey was Tuesday. The questionnaire, obtained by Bloomberg News, does not identify any companies. Some mobile carriers have blocked services that use voice-over-Internet protocol, or VoIP, which allows users to make calls over the Web. Companies may be seeking to stop customers from accessing applications, like eBay's Skype, to defend voice revenue from the less expensive Internet services, Carolina Milanesi, research director for mobile devices at Gartner, the research company, said.

    Superficially, this sounds like an application of the principles won by DG Competition in the Court of First Instance's Commission v. Microsoft interoperability decision. But note that here we deal with an investigation into deliberately-created interop barriers rather than those maintained by withholding full communication protocol specifications from competitors. Notice that the investigation encompasses throttling of internet connections for particular uses, an increasingly common practice by Comcast and other ISPs in the U.S., where both VOIP and P2P file-sharing are targeted uses. E.U. and U.S. antitrust law are similar, as efforts to harmonize antitrust law on both sides of The Pond are now decades old; this move does not bode well for bandwidth throttling in the U.S., particularly when aimed at throttling competition. It takes no giant mental leap to apply such principles to big vendor-dominated IT standards bodies that deliberately create or maintain interop barriers in data format standards. Indeed, DG Competition Commissioner Neelie Kroes has already served notice that interop barriers in standards-setting is an item of interest.

    With your purchase of On2, you now own both the world's largest video site (YouTube) and all the patents behind a new high performance video codec -- VP8. Just think what you can achieve by releasing the VP8 codec under an irrevocable royalty-free license and pushing it out to users on YouTube? You can end the web's dependence on patent-encumbered video formats and proprietary software (Flash). This ability to offer a free format on YouTube, however, is only a tiny fraction of your real leverage. The real party starts when you begin to encourage users' browsers to support free formats. There are lots of ways to do this. Our favorite would be for YouTube to switch from Flash to free formats and HTML, offering users with obsolete browsers a plugin or a new browser (free software, of course). Apple has had the mettle to ditch Flash on the iPhone and the iPad -- albeit for suspect reasons and using abhorrent methods (DRM) -- and this has pushed web developers to make Flash-free alternatives of their pages. You could do the same with YouTube, for better reasons, and it would be a death-blow to Flash's dominance in web video. If you care about free software and the free web (a movement and medium to which you owe your success) you must take bold action to replace Flash with free standards and free formats. Patented video codecs have already done untold harm to the web and its users, and this will continue until we stop it. Because patent-encumbered formats were costly to incorporate into browsers, a bloated, ill-suited piece of proprietary software (Flash) became the de facto standard for online video. Until we move to free formats, the threat of patent lawsuits and licensing fees hangs over every software developer, video creator, hardware maker, web site and corporation -- including you. You can use your purchase of On2 merely as a bargaining chip to achieve your own private solution to the problem, but that's both a cop-out and a strategic mistake. Without making VP

Complaints from AMD triggered the case.

  • "Right now there is a huge arms race between Apple, Google, Microsoft, and now Amazon has thrown their hat in the ring," said Vineet Jain, co-founder and CEO of Egnyte, a Mountain View company that sells software that allows companies to store data both in the cloud and on premise. "These four guys are capable of making it free or nearly free, and the price points that you're seeing from these vendors such as Box will have to come down, or they will have a shrinking user base. You cannot out-compete Microsoft and Google on price -- you just can't."
