  • The big question: who to choose?  In the absence of formal criteria, much speculation has broken out over who should take up the role of EU president. According to Stanley Crossick, a veteran EU policy analyst and founding chairman of the European Policy Centre (EPC) - a Brussels think tank - the new EU Troika needs to strike a balance between the following criteria (see blog post on Blogactiv for full analysis ):  Nationality;  geography;  size of country, and;  political affiliation.

  • Description The Lisbon Treaty reformed the foundations of the European Union and marked the culmination of a process of Treaty reform that began after the Treaty of Nice and spanned almost a decade. This book addresses the main innovations made by the new Treaty, examining its legal and political consequences in a reformed EU. The book is organized thematically around the principal issues that occupied those engaged in the reforms over the last decade. The chapters include analysis of the reform process itself and the political forces that shaped the relevant provisions of the Lisbon Treaty. 19.06.08: What about the size of the eu-commission after the No vote in Ireland? - 0 views

  • The EU summit, which starts in Brussels today (19 June), was meant to give EU leaders the opportunity to discuss their first full-time president. But following the 'no' vote in Ireland, they now face the less pleasant prospect of having to reduce the size of the European Commission as currently required by the Nice Treaty.
  • Background: The Nice Treaty stipulates that when the number of EU member states reaches 27, the number of commissioners appointed in the subsequent EU executive would have to be less than this number, without giving a precise figure.  With the EU now having numbered 27 members since 1 January 2007, there is an understanding that the current number of commissioners exceeds the realistic number of portfolios.  As an example, to accommodate Bulgaria and Romania, Markos Kyprianou, the Cypriot health and consumer protection commissioner, had to abandon the second part of his portfolio in favour of his new Bulgarian colleague, Meglena Kuneva (EurActiv 26/10/06) Similarly, the multilingualism portfolio was taken from Ján Figel, the Slovak commissioner for education, training and culture, and handed to Leonard Orban, the Romanian commissioner (EurActiv 31/10/06).
  • But following the failed Irish referendum, heads of state and government will instead have to revert to the provisions of the Nice Treaty, which is designed for a Europe of 27 member states, diplomats said.  In short, this means having to consider reducing the number of commissioners to below 27, as foreseen under the current treaty agreed upon in Nice in 2001. In contrast, the Lisbon Treaty envisages reducing the number of commissioners to 15 by 2014.

  • "Under Lisbon, this would only have happened in 2014," Sellal told journalists in Brussels on 18 June. The question of which country (or countries) should give up their commissioner will therefore now have to be open to negotiation between EU heads of state. And because such decisions have to be taken by unanimity, this raises the prospect of endless haggling between member states.  "As long as there will be no Lisbon Treaty, this question will remain open," Sellal said.

06.11.08: Western Balkans still way off EU entry criteria - 0 views

  • EU Enlargement Commissioner Olli Rehn made clear yesterday (5 November) that Serbia, Montenegro, Macedonia, Albania and Bosnia and Herzegovina, as well as Kosovo, are still a long way away from getting clear persprectives of EU accession.
  • In spite of the EU executive's insistence that its assessments are based on objective criteria, the countries in the region are increasingly aware that enlargement is no longer fashionable in the EU, especially in the context of the current financial crisis and uncertainty following the rejection of the Lisbon Treaty by Ireland.  European Parliament President Hans-Gert Poettering said on Tuesday that "perhaps with the exception of Croatia," no enlargement was possible without the Lisbon Treaty. This statement contradicts strong views, expressed repeatedly by French President Nicolas Sarkozy, that no enlargement whatsoever was possible before the Lisbon Treaty comes into force (EurActiv 20/06/08). In fact, the Nice Treaty provides institutional arrangements for only 27 member states, but some countries believe that it may be possible to find a compromise to accommodate Croatia.

16.03.10: EU Foreign Policymaking Post-Lisbon: Confused and Contrived - 0 views

  • Abstract: The European Union finally succeeded in ramming through introduction of the Lisbon Treaty in December 2009. The treaty was touted by the powers in Brussels as the vehicle that would create the long-awaited "single phone line" to Europe. Lisbon was to streamline the gargantuan EU bureaucracy and make communication between the two sides of the Atlantic smooth and tidy. Instead, the mess is worse than before, with five EU "presidents" tripping over each other and confusing Washington with ill-defined, overlapping, and flat-out confusing roles and foreign policy objectives. The Lisbon Treaty essentially allows the EU a foreign policy power-grab, the driving force of which is the notion that the countries of Europe will be stronger collectively than they are separately. But sovereignty cannot be traded for influence, and the EU's attempts to do so could threaten the security of Europe-- and of the United States.

  • Enlargement of the EU will come to halt if the Lisbon treaty does not enter into force, French president Nicolas Sarkozy warned member states in the aftermath of the Irish No vote last week. "It is certain that as long as we have not solved the institutional problem, the question of enlargement is stopped de jure or de facto," he said at a press conference in Brussels on Thursday night (19 June).
  • But Central and eastern European EU states, traditionally favouring further EU expansion, may harm the process if they do not continue to pursue treaty ratification, said the French president. "A certain number of countries which have some reserves on the Lisbon treaty are the most active on enlargement… the Lisbon [treaty] allows further enlargement. No Lisbon, no enlargement," he added.

24.06.08: Lisbon Deadlock Might Hit Croatia EU Hopes - 0 views

  • With EU enlargement in question following the Irish ‘no’ vote to the Lisbon Treaty, Zagreb fears a fresh delay to its accession.
  • Some experts also maintain that enlargement to include Croatia might be possible even if the Lisbon Treaty does not enter into force. The Brussels think tank, the European Policy Centre, for example, noted in a recent paper that while Croatian accession would require some adjustments to Nice, “some of these, concerning, for instance, the composition of EU institutions and the voting rules, could be introduced through the Accession Treaty with the next entrant (probably Croatia)”. Michael Emerson, enlargement expert for another EU think tank, the Centre for European Policy Studies, agrees. “It is not impossible legally for Croatia to come in with few bits of adjustment to exciting treaties”, Emerson said. “However politically, some member states will use this as leaver to try to get Lisbon Treaty through”, he added.

25.04.08: EU treaty set to be examined by Czech and German courts - 0 views

  • The Lisbon treaty is set to be examined to see if it breaches national laws in two member states, raising the risk that the 1 January 2009 deadline for the document to come into force across the EU will be delayed.

    The Czech Senate on Thursday (24 April) voted in favour of asking the constitutional court to check whether the treaty is in line with Czech law.
  • Germany Meanwhile, Germany's court is also set to examine the treaty. After the lower house of parliament strongly endorsed the charter on Thursday, conservative MP Peter Gauweiler repeated his intention to bring the treaty before the country's constitutional court.
  • The key issues that the senators asked the court to check include the transfer of certain powers to EU institutions, the shift of decision-making among member states from unanimous to majority voting, as well as the legal implications of adopting the Charter of Fundamental Rights - with the charter causing the most concern among Czech lawmakers.

  • He said his reason for bringing the case is the constitutional court's loss of power to the European court. The constitutional court has until now kept an eye on the inalienable rights of German citizens given to them by Germany's constitution (Grundgesetz), he noted. "With the Lisbon Treaty, the sovereignty over these rights is given to foreign courts, whose members are not sworn to protect the constitution. That is not allowed by the constitution," the MP told the paper.

  • The treaty, which aims to make decision-making smoother, creates a long-term president and enhances the powers of the EU foreign policy chief, is intended to give the 27-country bloc more political clout to match its economic weight.

  • As EU foreign ministers try to breathe life back into the Lisbon Treaty, the charter of institutional reforms rejected by Irish voters last week, Dublin is likely to be offered stronger guarantees in the sensitive areas of taxation, defence and family policies. According to the Financial Times, "explanatory protocols" should explicitly state that the document does not affect Ireland's ability to set its own tax rates, the country's neutrality status or its abortion policy.
  • Another solution being floated involves a legal assurance that Ireland will never lose its seat at the European Commission table, the Irish Times reports. The Lisbon Treaty enables EU leaders to put the reduction of the size of the commission on ice. Either scenario is expected to be agreed at the first top-level meeting of EU leaders under the French EU presidency in October.
  • Irish No will not put brakes on EU enlargement Aside from the size of the next European Commission - now capped by the current EU rules - a question mark hangs over the 27-nation bloc's capacity to absorb new members. The Nice Treaty is tailored to no more than 27 member states. When asked about the prospects of EU hopefuls' accession to the EU, Mr Rupel excluded any changes to the process. "The outcome of the Irish referendum in no way changes enlargement policy...The EU unanimously decided to invited the countries of the Western Balkans to take membership so there is no doubt about that," the minister said, but added: "How we will carry that out that is another question."

07.10.09: Brussels in limbo over Klaus treaty delay - 0 views

  • The heads of the EU's three main institutions on Wednesday (7 September) came together to point out to Czech President Vaclav Klaus the "costs" to Europe if he continues to delay ratification of the Lisbon Treaty, the union's new rulebook. European Commission chief Jose Manuel Barroso, European Parliament President Jerzy Buzek and Fredrik Reinfeldt, the Swedish Prime Minister and the current chair of the EU, said several pending decisions are awaiting clarification from Prague.
  • The uncertainty stems from the fact that the Czech constitutional court is examining a legal challenge to the Lisbon Treaty, lodged by senators close to Mr Klaus. It is unclear how quickly the court will make its decision and, if the decision is positive, how much later Mr Klaus would then sign the treaty, completing ratification. Time is pressing because the current commission's mandate expires at the end of October, as does the post of the current high representative for foreign affairs, held by Javier Solana. The Swedish presidency is nervous about entering uncharted legal territory. It can either keep the commission as a caretaker, but ineffectual, executive, or try to set up a new commission under the Lisbon Treaty rules. Another option would be to negotiate a new commission with the current rules, but that would mean unwanted negotiations on reducing its size.

26.11.08: Debates about lisbon-treaty in Ireland and Czechia - 0 views

  • An Irish parliamentary committee is to debate a report arguing that a second referendum on the EU's Lisbon treaty is legally possible. The draft report, first seen by the Irish Times, has been discussed in a private session by the Subcommittee on Ireland's Future in the EU and is due to be presented to the joint Committee on European Affairs on Thursday (27 November).
  • It argues that a second poll on the EU's new reform treaty - following the debacle in June when the Irish voters rejected the document by a clear majority - would be preferable, suggesting a vote on the same text but accompanied by clarifying declarations on controversial issues.
  • Meanwhile, Prague is expecting a verdict from the Czech constitutional court on whether the EU reform plan is in line with the Czech constitution after a heated exchange between the country's president and government officials in the courtroom on Tuesday (25 November). The Czech Republic is the only country that has not yet voted on the Lisbon treaty. Despite this fact, the republic is preparing to take over the helm of the EU from France in January, when it assumes the six-month rotating EU presidency, and must then lead talks with Ireland on how to solve the institutional problem.

01.04.08: Polish parliament approves EU treaty - 0 views

  • The lower house of the Polish parliament approved the European Union's new treaty on Tuesday (1 April).

    The document, which EU leaders signed in December in Lisbon and which aims to revitalise the bloc's institutions and boost its efficiency, was approved by 384 deputies from the 460-seat lower house, the Sejm.
  • The Sejm's special session was convened after Liberal Prime Minister Donald Tusk (Civic Platform party) and conservative opposition leader Jaroslaw Kaczynski of the Law and Justice Party struck a deal on Tuesday (31 March), lifting the threat of a block by the opposition.
  • The ratification bill is now expected to be approved by the Polish Senate on Wednesday (2 April). The process will then be finalised with a signature by the country's president. So far, Poland, Hungary, Slovenia, Malta, Romania, France and Bulgaria have approved the document. Ratification of the Lisbon treaty is expected to be finalised by the end of this year, in order that the treaty can come into force in 2009. So far, only Ireland is to hold a referendum on the treaty, expected in June.

17.11.08: Irish voters may back Lisbon treaty, poll reveals - 0 views

  • A fresh poll has suggested the Irish could back the EU's Lisbon treaty in a second attempt, repeating the same scenario as with the vote on the previous EU institutional reform. The survey published in Irish Times on Monday (17 November) indicates there has been a change of mood among Ireland's voters since the June referendum, as 43 percent of respondents say they would vote for the Lisbon treaty against 39 percent who would vote No and 18 percent who have no opinion.
  • The poll asked people if they would vote for a modified document which would allow Dublin to keep a national commissioner in the EU executive.
  • The other modification suggested by the authors of the poll was that the Irish would get clear confirmation of their neutrality and their right to rule on issues such as abortions or taxation, in a document attached to the treaty - an idea already supported by several EU leaders as a way to enable a second ballot in Ireland.

09.01.09: Czechs prepare for possible second Irish No - 0 views

  • The Czech EU presidency is preparing a contingency plan for one of the most sensitive areas in the EU institutional set-up in case Ireland rejects Europe's new treaty for a second time later this year. According to the Irish Times newspaper, Prague is working on a plan for how to reduce the size of the European Commission should Irish voters once again vote No in autumn.
  • "On the composition of the commission we have to be ready for both possible scenarios: One scenario is that the Lisbon Treaty enters force at the end this year or we have to act and co-operate in the EU under Nice," deputy prime minister Alexander Vondra told the newspaper. The rules of the Nice Treaty state that if the number of EU member states reaches 27, the number of commissioners would then be reduced. The EU's pending set of new rules, known as the Lisbon Treaty, however allows the continuation of one commissioner per member state if all EU governments unanimously agree to it.

  • Polish President Lech Kaczynski on Tuesday (1 July) toned down his rhetoric against the Lisbon treaty, with the French EU presidency also downplaying the mini-crisis and analysts saying Mr Kaczynski's stance is a bargaining tool for foreign policy concessions.
  • Mr Kaczynski is fighting to win oversight powers on Polish government behaviour in EU negotiations and to get government approval to host a US missile shield. The Lisbon row also generates momentum for his flagging conservative opposition party, as campaigning slowly begins for the 2009 European Parliament elections. "If Lech Kaczynski signs the treaty it will be a victory for [Polish liberal Prime Minister Donald] Tusk. So the president wants his own victory by winning concessions from the liberals," Polish Institute of Political Sciences analyst Kazimierz Kik told AFP.

08.10.09: Barroso fears powerful 'European president' - 0 views

  • European Commission President Jose Manuel Barroso has sided with smaller member states in trying to restrict the role of the proposed president of the European Council, a new post created by the Lisbon Treaty. Addressing the European Parliament on Wednesday (7 October), Mr Barroso chastised MEPs for referring to the post as "president of Europe."
  • "I am sorry, there will not be a president of Europe. There will be, if we have Lisbon, the president of the European Council. It is important to understand that point because sometimes I think there are some ideas about certain derives institutionelles [institutional drifts]," he said.
  • The commission president has no formal powers in appointing the European Council president but he warned: "The European Commission will not accept the idea that the president of European Council is the president of Europe." Mr Barroso's remarks came shortly after a leaked paper on the new Lisbon Treaty posts by Belgium, the Netherlands and Luxembourg underlined the importance of maintaining the "institutional balance" of the union. The paper has been interpreted in some quarters as an anti-Blair move. Poland has also prepared a document on the role of the president of the European Council. Earlier this week, Polish Europe minister Mikolaj Dowgielewicz indicated to EUobserver the limited role that Warsaw foresees for the new president.

21.01.08: UK Parliament ups pressure on EU Treaty referendum - 0 views

  • Rebel Labour MPs are expected to join forces with the Conservatives today (21 January) in a bid to force through a referendum on the new EU Reform Treaty, after a report by the House of Commons' Foreign Affairs Committee concluded that the text is the same as the abandoned EU Constitution.
  • The case for a referendum was further strengthened yesterday (20 January) with the publication of a report by the House of Commons' Labour-dominated Foreign Affairs Committee, which claims that the British government is misleading the public by playing down the significance of new institutions, such as the creation of a new full-time EU President and foreign affairs chief.  "We conclude that there is no material difference between the provisions on foreign affairs in the Constitutional Treaty, which the government made subject to approval in a referendum, and those in the Lisbon Treaty, on which a referendum is being denied," concludes the report.
