17.01.11: Poland: Elections will not disrupt EU presidency - 0 views

  • The Polish junior minister for EU affairs, Mikolaj Dowgielewicz, has promised that upcoming elections will not disrupt Poland's EU chairmanship and defended Hungary over its controversial media law. Speaking to EUobserver ahead of a visit by EU Council head Herman Van Rompuy to Warsaw on Monday (17 January), Mr Dowgielewicz predicted the election will take place in the second half of October - slap-bang in the middle of Poland's EU presidency - but said the vote will be separated from its EU activities by a "Chinese wall".
  • The latest poll, by GfK Polonia in December, indicated that centre-right Prime Minister Donald Tusk will sail through to a second term on 54 percent, leaving behind the main opposition party, Law and Justice, on 26 percent. Even if the situation changes drastically, Law and Justice' bull-in-a-china-shop boss, Jaroslaw Kaczynski, is unlikely to turn up at any EU summits in 2011. "The presidency has been set up in such a way as to allow the old government to continue running things until late December, until the last session of the European Parliament, no matter what happens," Mr Dowgielewicz noted.

27.08.10: Europeans losing faith in EU - 0 views

  • Just 42% of Europeans say they trust the European Union, according to a new opinion poll, down six percentage points in just six months.
  • The survey also found that fewer than half of Europe's citizens see their country's membership of the EU as a positive thing, but the European Commission is clinging to the positive elements of the report, particularly on economic governance. Officials are presenting the new Eurobarometer as an endorsement of greater budget oversight from Brussels, pointing to the 75% of Europeans who said stronger coordination between member states will help weather the economic storm.
  • Notwithstanding the positive spin from Brussels, a deeper analysis of the report shows a crisis of faith in the Union. Just 49% of citizens view membership of the European Union as a good thing, while 47% said they do not trust the EU. Even prospective members have gone cold on the European project, with just 27% of Turks saying they trust Brussels. For the first time, the Eurobarometer included Iceland, which is currently in talks to join the EU. A startling 35% said they trusted the Union, while only 29% thought that Iceland would benefit from becoming a member.

29.10.10: 'Small, small, small' EU treaty change to deliver 'quantum leap' - 0 views

  • European leaders have given way to German demands for a change to the European treaties, but the procedure for the change and its size has been calculated explicitly to avoid the danger that it could provoke referendums in some EU states.
  • Viritually all EU member states had vehemently opposed any treaty change going into the summit, but in the end they were convinced by Germany's need for the change in order to avoid a legal clash with its Karlsruhe-based Constitutional Court. The leaders agreed to construct a permanent crisis mechanism to fill the void left when the existing but temporary €110 billion bail-out package for Greece and €440 billion fund set up for the eurozone as a whole expire in 2013. According to diplomats, it is currently unclear whether this new mechanism would involve participation of eurozone members alone or the full 27 EU member states, including those who do not use the euro. Germany is worried that any permanent structure could run afoul of treaty rules forbidding EU bail-outs of member states and be struck down by the country's strict Constitutional Court, thus opening the euro once again to an assault by markets as occurred in the spring. Caught between the need for a structural change and their fear of both the activism of Karlsruhe and the growing euroscepticism of citizens, the other leaders signed off on the move only so long as the change envisaged was "small, small, small - the smallest possible ... in order to ensure there is no possibility of referendums," in the words of a Danish diplomat speaking to EUobserver. The method EU leaders chose to achieve the change will be via what is called the "special revision procedure," introduced by the Lisbon Treaty, under which the treaty can be amended by the European Council alone, so long as there is unanimity and the changes do not extend the competences of the European Union.

02.11.10: Nightmare scenario of Dutch referendum returns to haunt EU - 0 views

  • The nightmare scenario of another referendum on a change to the EU treaty in the Netherlands, five years after the country rejected the bloc's proposed constitution, could return to haunt European leaders, with the hard-right Dutch Freedom Party (PVV) of Geert Wilders on Tuesday (2 November) announcing it is considering proposing just such a vote.
  • MP Louis Bontes of the anti-immigrant PVV, which is part of the governing coalition pact, said his faction in the parliament may push for a referendum if the penalties for countries in breach of new EU fiscal rules are not strict enough.
  • The left-wing Socialist Party, one of the leaders of the No campaign in 2005 against the EU constitution, claiming that the dud EU charter had favoured the interests of businesses over citizens, has already endorsed the idea that another referendum should be called. On Friday, MP Harry Van Bommel, the party's spokesman for EU affairs and the deputy chair of the parliament's standing committee on the same subject, said that if a treaty change is approved by the European Council, it will call for a referendum. "We are very happy to have the support of the PVV in our push for a referendum," he told EUobserver, "and that they are willing to look into the issue as well." Mr Van Bommel was keen to stress that his party's opposition to the treaty change was for different reasons to that of the PVV. "They are more concerned that we not pay out to poorer countries whereas we are more worried that the proposed changes limit a nation's policy space in the social arena," he explained.

16.11.10: EU budget talks collapse after MEPs seek new powers - 0 views

  • A last attempt to reach an agreement for the 2011 EU budget failed on Monday (15 November) due to reluctance by member states to grant MEPs extra powers in future multi-annual budget negotiations. The EU commission will now have to draft a new proposal, while the first months of next year will be funded on the basis of the 2010 budget.
  • The final collapse was mainly due to disagreements over procedures and extra powers granted to MEPs under the Lisbon Treaty, the EU's new rulebook. Junior ministers from Britain and the Netherlands insisted that the only issue on the table was the budget for 2011 and declined to discuss contentious issues for the long-term budgetary perspective, such as raising more EU "own resources" through supplementary taxes or the "flexibility" of the budget when unexpected expenses arise. Shortly after announcing €95 billion in domestic budget cuts, Britain has spearheaded demands for next year's EU budget to stay frozen at 2010 levels or go up by a mere 2.9 percent, or less than half the MEPs' original request.

  • European Commission President Jose Manuel Barroso and French President Nicolas Sarkozy - currently chairing the EU - have urged the need for a permanent EU presidency to replace the rotating system. "We need a president of the Council [the institution representing EU member states] that does not change every six months," Mr Barroso told journalists at the end of an EU leaders' meeting in Brussels on Thursday (16 October). "To lead [EU] member states, we need a very strong presidency."

09.05.08: Danes likely to have two referendums on EU treaty op-outs - 0 views

  • The Danish centre-right government has launched negotiations with opposition parties to agree on a strategy for scrapping opt-outs from the EU treaties, with the government hoping to abolish the derogations in two steps, according to Danish media reports.

    Prime Minister Anders Fogh Rasmussen is set to call for a referendum in September to remove the derogation from judicial and defence co-operation and at the same time announce a subsequent referendum on the euro.
  • Denmark is not bound by first-pillar legislation on justice and home affairs and EU citizenship and does not take part in EU defence co-operation. Denmark is also not obliged to take part in the single currency and refused to abolish its national currency, the Krone, in a referendum in 2000. The liberal-conservative coalition government is eager to scrap the opt-outs and have the country participating fully in the EU.
  • Big-bang referendum difficult to win Opinion polls have suggested a big-bang referendum including all four Danish opt-outs would be very difficult to win – but taking the issues one-by-one would increase the chances of a yes. According to a fresh poll by the Greens polling institute, published by business paper Boersen on Friday (9 May), a slim plurality of 43 percent would accept scrapping all four derogations in such a big-bang referendum, 39 percent would vote no and 18 percent are undecided.

    Poland has reaffirmed it will not bow to pressure from its EU partners and is set to push for a fresh debate on the voting system in upcoming talks on a new treaty for the bloc.

    "We're going to talk about this at the intergovernmental conference simply because, when something is decided, it has to be acted upon", Polish prime minister Jaroslaw Kaczynski told Polish public radio on Wednesday (4 July).

    Poland's main concern centres around a specific part of the voting system which allows countries to delay an EU decision if they fall just short of the required number of countries to block it.

    Warsaw claims it secured a gentleman's agreement at a meeting of EU leaders last month, allowing countries to delay decisions by up to two years.

    However, the written mandate for negotiating a new EU treaty only promises a reasonable delay, which some officials say should not exceed four months.

  • EU foreign ministers have agreed on how the new EU treaty should be presented – it should not be called a constitution, and not contain symbols such as an EU flag – but key divisions on the substance of the text remain unresolved.
  • But deep rifts remain on key parts of the treaty that go beyond mere names and symbols and which concern the division of power between the EU and its member states. The status of the Charter of Fundamental Rights – a document listing citizens rights and fully integrated into the draft constitution – is the subject of strong controversy, with the UK in particular opposing a charter that is legally binding.

  • Digital Agenda Commissioner Neelie Kroes said yesterday (11 January) that the European Commission would not make any compromise and would make sure EU law is implemented fully in the case of the controversial Hungarian media law.
  • But Kroes made clear that the directive was "an instrument to find the issues to tackle" and that if problems were identified, Reding would be called into play, in respect of Article 7 of the Lisbon Treaty. Article 7 reads that after a reasoned proposal by one third of EU member states, by the European Parliament or by the European Commission, the Council, acting by a majority of four fifths of its members after obtaining the consent of the European Parliament, may determine that there is a clear risk of a serious breach by a member state of the EU values of respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities.

30.09.09: Slovenia lifts veto on Croatia's EU talks - 0 views

  • Croatia will open six and close five negotiating chapters with the EU next Friday (2 October), following a vote in the Slovenian parliament to unblock negotiations which had been put on ice over a border dispute between the two former Yugoslav republics.
  • The parliamentary committee on EU affairs in Ljubljana voted unanimously on Tuesday (29 September) in favour of lifting the veto, the Croatian news agency Hina reported.  The move follows a decision by the two countries' prime ministers, who recently said the border dispute that had poisoned their relations should not present an obstacle to proceeding with Croatia's EU accession negotiations.

  • The European Union is just months away from launching a new unified diplomatic service. But any hopes that the new structure will bring greater focus and effectiveness to the bloc's foreign policy are probably premature, analysts say.The European External Action Service (EEAS), whose creation was a key provision of last year's Lisbon Treaty, is expected to be fully operational on January 1. It eventually will be staffed with thousands of diplomats in Brussels and in EU missions around the world.

  • Just one year after the second Irish referendum on the Lisbon Treaty - one of the most bitter political battles in EU history - France and Germany are coming into an EU summit ready to pitch the idea of rewriting the legal pact. As the premiers and presidents of the bloc's 27 states arrive in Brussels on Thursday (28 October) for a two-day summit intended to endorse new fiscal rules, a last-minute deal between two of the EU's most powerful countries has caused shocked and anger across the continent.
  • Last week at a bilateral pow-wow in Deauville, France, President Nicolas Sarkozy and German Chancellor Angela Merkel cut a deal in which Berlin backed Paris in its desire to water down sanctions to be imposed on excessive-spending EU countries. In return, Paris endorsed Berlin's push for a change to the EU treaty in order to set-up an EU bailout fund and default mechanism. Ms Merkel is adamant that her country cannot endorse a repeat of the emergency bail-outs cobbled together this spring. Germany is the main bankroller of the €110 billion loan to Greece and of the European Financial Stability Fund (EFSF), the yet-to-be-tapped €440 billion rescue mechanism for the eurozone as a whole. Both of these funds have an expiry date of 2013 and Berlin is looking to see that something more substantial replaces them before then. The default mechanism would signal to investors that they, rather than taxpayers alone, would be on the hook for at least part of the costs of the bankruptcy of a country. The mechanism is designed to deal with sovereign defaults without setting off a cascading panic in the markets similar to the Greek debt crisis that shook Europe in spring. The idea is highly controversial, with even the reticent European Central Bank chief Jean-Claude Trichet voicing steadfast opposition.

  • European Union leaders have come to a consensus that the bloc's treaty must be changed, although only in a limited fashion, in order to allow for the creation of a permanent bail-out fund for member states. "Today we took important decisions to strengthen the euro," European Council President Herman Van Rompuy told reporters at a press conference in the early morning hours of Friday (29 October).
  • Initially horrified at the Franco-German demand for a wholesale re-writing of the EU rulebook only a year after the Lisbon Treaty had been approved, the other EU leaders are now warming to the idea of a "limited" tweaking of the treaty in a way that they hope will avoid major political fall-out. "Heads of state and government agree on the need for member states to establish a permanent crisis mechanism to safeguard the financial stability of the euro area as a whole and invite the president of the European Council to undertake consultations with the members of the European Council on a limited treaty change required to that effect," the draft conclusions of a two-day summit in Brussels read.
  • "No country is opposed in principle to a moderate treaty change but they want to know what the political and legal consequences of this would be," said one source close to the discussions. Two moves have been tentatively agreed. EU Council President Herman Van Rompuy is to be tasked with exploring whether such a limited change can be done via a simplified revision procedure, in which EU leaders can make the change without having to call a full Intergovernmental Conference (IGC) - involving negotiations between the governments, consultations with the European Parliament and the participation of the European Commission, which could open a Pandora's Box of other new proposals. Mr Van Rompuy would also explore whether legally this can be done without the tweak having to be presented to national parliaments for approval, which would almost certainly grind down the process, or even further, whether such a move would provoke referendums in some countries, notably Ireland, which maintains a constitutional requirement that any shift in powers from Dublin to Brussels be approved in a vote by the people. He would report back to the European Council in December.

  • The French EU presidency is expected to endorse the Russia-Georgia ceasefire, offer humanitarian aid and urge EU unity in a statement after an EU foreign ministers meeting on Wednesday (13 August), with Paris keen to avoid controversy on who to blame for the crisis.   • Even if the EU manages to avoid referendums on its new Reform Treaty, ratification of the text may prove less easy than has been assumed so far, a Brussels think tank has warned.

    A paper by the European Policy Centre released on Thursday (26 July) highlights "hurdles and traps" in member states' ratification of the reform treaty, which the Portuguese EU presidency hopes to get signed by EU leaders before the end of the year.

  • Rebel Labour MPs are expected to join forces with the Conservatives today (21 January) in a bid to force through a referendum on the new EU Reform Treaty, after a report by the House of Commons' Foreign Affairs Committee concluded that the text is the same as the abandoned EU Constitution.
  • The case for a referendum was further strengthened yesterday (20 January) with the publication of a report by the House of Commons' Labour-dominated Foreign Affairs Committee, which claims that the British government is misleading the public by playing down the significance of new institutions, such as the creation of a new full-time EU President and foreign affairs chief.  "We conclude that there is no material difference between the provisions on foreign affairs in the Constitutional Treaty, which the government made subject to approval in a referendum, and those in the Lisbon Treaty, on which a referendum is being denied," concludes the report.

  • With just three days to go to a tense summit on the future of the EU treaty, Poland has still not decided if prime minister Jaroslaw Kaczysnki or president Lech Kaczynski will go to Brussels, in a move that could indicate how hard Poland will fight for voting system reforms.
  • The question comes amid an ugly disagreement between Warsaw and the German EU presidency over EU voting weights - an elaborate calculus on power sharing that kicks in on the rare occasions that EU members cannot agree on new laws by consensus. Berlin and almost all other EU members want to go for a "double majority" system, which gives big states more power vis-a-vis medium-sized countries than the current "Nice" system. But Poland is pushing for a middle way, based on the "square root" of member states' populations.

  • The EU-critical Socialist Party and the anti-immigrant Party for Freedom are the biggest winners of the Dutch elections. Balkenende's Christian-Democrat CDA remains the strongest formation but future coalition talks will be difficult.

    It is unclear what the implications of these elections will be for the European Union, but the strong protest vote for the very EU-critical SP and the anti-immigration party might spell bad news for the future of the European Constitution.
    The big win for the SP confirms that the Netherlands have turned from a reliable EU lover to a euro-critical country. The party of Marijnissen has rejected the EU draft Constitution and wants to renationalise European policies in the areas of education, health, social affairs, public transport and housing. It also wants a stronger role for national parliaments in European decision-making.
