Students interact with music, movies, software, and other digital content every day-but many don't fully understand the rules surrounding the appropriate use of these materials, or why this should even matter. To help teach students about intellectual property rights and encourage them to become good "digital citizens," software giant Microsoft Corp. has unveiled a free curriculum that offers cross-curricular classroom activities aligned with national standards. The Digital Citizenship and Creative Content program was designed for students in grades 8-10 but can be adapted for use in grades 6-12, Microsoft says. In one unit, students are given a scenario in which a high school sponsors a school-wide Battle of the Bands. A student not involved in the production decides to videotape and sell copies of the show to students and family members. Later, one of the performers ("Johnny") learns his image has been co-opted by the maker of a video game without his permission. Students research intellectual property laws to see who owns the "rights" to the Battle of the Bands as a whole, as well as the rights of individual performers, to determine three or four steps that Johnny can take. http://digitalcitizenshiped.com

Congress has authorized a new federal research center that will be charged with helping to develop innovative ways to use digital technology at schools and in universities. The National Center for Research in Advanced Information and Digital Technologies was included as part of the latest reauthorization Requires Adobe Acrobat Reader of the Higher Education Act, approved last month. President Bush signed the law on Aug. 14. The center will be charged with supporting research and development of new education technologies, including internet-based technologies. It will also help adapt techniques already widely used in other sectors, such as advertising and the military, to classroom instruction.

Comprehensive research on how advanced computer and communication technologies can improve all levels of learning has been funded. This National Center was created and signed into law on August 14, 2008 in the United States. I think that research is a great thing. I they will involve all educators in developing their primary questions. Research based best practices underlie all we do and we do need more. I hope, however, they don't get too hung up on the technology (i.e. wiki, blog) and focus on what technology lets us do.

Tutorials about how we share video and overcome the "youtube barrier."

This page outlines how we are sharing video on the Horizon project this year. After literally hours of testing to overcome the "youtube barrier" we have worked out how to use Ning as our video sharing and embedding platform. Using tools like a firefox plug in that allows downloading of any video AND zamzar, these 7 videos literally show you how you may "snag" and edit any video. Just remember to follow copyright laws when you do this. This innovation was quite an epiphany for us and the videos were our effort to make it easy and take the video sharing aspect of the project out of the teacher's hands.

Excellent mash-up covering fair use and copyright laws

The Center for Social Media in the School of Communication at American University, the Program on Information Justice and Intellectual Property in American University Washington College of Law, and the Media Education Lab of Temple University are conducting a project 2007-2009 to clarify fair use in media education, with support from the John D. and Catherine T. MacArthur Foundation. This project will help media literacy educators understand their rights under the doctrine of fair use in order to help them more effectively use media as an essential part of their teaching.

Mary Minow August 01, 2008 Breaking News: Digital Promise legislation passes "Digital Promise Passed by Both Houses of Congress On Thursday, July 31, 2008, the legislation to create the Digital Promise was passed by both the House and Senate as part of the reauthorization of the Higher Education Act. It is expected to be signed into law by President Bush within days. The name has been changed to the "National Center for Research in Advanced Information and Digital Technologies." I much preferred "Digital Promise" but the main thing is that the legislation has passed. What it will do: It will create a Congressionally originated 501(c)(3) nonprofit corporation within the U.S. Department of Education. It will have a nine-member independent Board of Directors appointed by the Secretary of Education from nominations by members of Congress. Grants and contracts will be awarded on merit, and policies will be developed following the tested procedures of NSF and NIH. The Center will be able to receive grants, contracts, and philanthropic contributions, as well as federal appropriations. See the National Center section of the bill ."

Although the First Amendment may appear unconditional on its face, the right to speak and write freely has never been absolute. Intellectual property rights often prevail over an author's "creative license." The main benefit of copyright, for example, is the right to exclude others from making copies of a work (or any part of it) without permission. By protecting an author's expression, copyright guarantees that authors and other creators, derive financial benefits from their work. If you intend to use someone's copyrighted work, unless the use is considered a "fair use" (which is technically a defense to copyright infringement), you must obtain that person's written permission. Under federal law, only the copyright owner or someone acting with the owner's authority, such as a publisher, can grant that permission. Without written permission, you expose yourself to legal risks. While not every unauthorized use of a copyrighted work is an infringement, whenever you include another person's words, illustrations, photographs, charts or graphs in a work you publish, you must be sensitive to the risk of infringing someone's copyright. This ECAR research bulletin reviews some of the basic tenets of copyright in the digital millennium. Specifically, it discusses the ways in which copyright law, fair use provisions, and the TEACH Act interact with today's teaching and learning, especially the use of Web 2.0 tools by both faculty members and students.

There's a lot of misinformation out there about legal rights and responsibilities in the digital era. This is especially disconcerting when it comes to information being shared with youth. Kids and teens are bombarded with messages from a myriad of sources that using new technology is high-risk behavior. Downloading music is compared to stealing a bicycle - even though many downloads are lawful. Making videos using short clips from other sources is treated as probably illegal - even though many such videos are also lawful.
