If you want to change government policy, change the politicians who make it. The implications of this truism have now taken hold in the market-modeled "education reform movement." As a result, the private funders and nonprofit groups that run the movement have overhauled their strategy. They've gone political as never before-like the National Rifle Association or Big Pharma or (ed reformers emphasize) the teachers' unions.

Two education companies are in a battle over the right to provide testing items to the Florida Department of Education under a Race to the Top contract worth tens of millions of dollars. A subsidiary of McGraw-Hill, which is based in New York, filed a bid protest earlier this week to block a contract between the DOE and Boston-based Houghton Mifflin Harcourt. The filing with the Department of Administrative Hearings argues that the department used the wrong criteria in weighing the offers of McGraw-Hill and Houghton Mifflin Harcourt in the final round of bid consideration.

The articles in this issue are designed to do exactly that: to defend the hope that public education (an education truly controlled by the public) provides, while promoting the goal of all true education-the emancipation of human creativity, i.e., of human beings themselves.

My first reaction when hearing that we should be more businesslike in our approach is, "You can"t be serious! You want to use the model that for the last 30 years has driven people out of the middle-class, has foisted imperialism on large parts of the world, and created the worst economic catastrophe in eighty years? You want to use that failed model? Are you BSC?" One of the reasons for the failure of this model is the focus immediate profits rather than long term results.

Nearly 40 years have passed since the Fiscal Crisis budget cuts and our public schools now face a challenge more insidious and perhaps, more formidable. All across the nation, a poisonous coalition of multi billionaire business leaders, test and technology companies, charitable foundations and elected officials are pushing a nationwide education agenda that involves the introduction of high stakes testing at all grade levels, evaluation of teachers and schools based on student test scores, and the introduction of "competition" into public education by the creation of independently managed charter schools given special advantages in funding and recruitment.

As attendees stood up to leave the hall, the phalanx of lobbyists surrounding the room converged, buttonholing legislators and school officials. On a floor above the main hall, an expo center had been set up, with companies like McGraw-Hill, Connections Academy, K12 Inc., proud sponsors of the event, providing information on how to work with politicians to make education technology a reality.

In state after state, teacher seniority and due process has been undermined, and the use of standardized tests to pay and evaluate teachers been expanded. In recent months, reports have emerged of a shadowy group that has developed tremendous influence over legislation in states across the country. This group is the American Legislative Exchange Council (ALEC).

When people like Diane Ravitch talk about the billionaires taking over education policy, they are sometimes dismissed as being alarmist, or even of promoting conspiracy theories. But a recent video details exactly how this has been happening, in the state of Illinois. The video released last week of Jonah Edelman describing how he and his group, Stand For Children, managed to maneuver education "reform" legislation is still reverberating through the education blog world.

Today, President Obama hosts a meeting at the White House with CEOs to try to raise private cash for K-12 education.

A federal district court in Florida has ruled that parents of a student with autism have stated a valid claim that charter school employees' use of excessive force constituted a violation of the student's substantive due process rights. The court concluded that the parents had alleged facts sufficient to show: (1) use of excessive force that "shocks the conscience;" and (2) the charter school employees acted under color of state law. It found, however, that the parents' allegations of emotional injuries and psychological harm were insufficient to rise to the level of conduct that shocks the conscience.

Rupert Murdoch's attempt to corner the education market is not going to go smoothly, it appears. On Thursday, Joel Klein, vice president of Murdoch's News Corp., which owns Fox News, appeared on a panel discussion about school board governance at Jeb Bush's Excellence in Education summit in San Francisco. Klein was at the conference in his role as the former long-serving chancellor of the New York City school system. But there was no getting around his current position. Klein was testy when I asked him about the protesters preparing to descend on the hotel to greet his boss on Friday morning, when Murdoch is scheduled to speak. And he didn't escape his panel discussion without having to face more questions about News Corp.'s education ventures.
