Two Microsofts: Mulling an alternate reality | ZDNet - 0 views

  • Judge Jackson had it right. And the Court of Appeals? Not so much
  • Judge Jackson is an American hero and news of his passing thumped me hard. His ruling against Microsoft and the subsequent overturn of that ruling resulted, IMHO, in two extraordinary directions that changed the world. Sure the what-if game is interesting, but the reality itself is stunning enough. Of course, Judge Jackson sought to break the monopoly. The US Court of Appeals overturn resulted in the monopoly remaining intact, but the Internet remaining free and open. Judge Jackson's breakup plan had a good shot at achieving both a breakup of the monopoly and, a free and open Internet. I admit though that at the time I did not favor the Judge's plan. And i actually did submit a proposal based on Microsoft having to both support the WiNE project, and, provide a complete port to WiNE to any software provider requesting a port. I wanted to break the monopolist's hold on the Windows Productivity Environment and the hundreds of millions of investment dollars and time that had been spent on application development forever trapped on that platform. For me, it was the productivity platform that had to be broken.
  • I assume the good Judge thought that separating the Windows OS from Microsoft Office / Applications would force the OS to open up the secret API's even as the OS continued to evolve. Maybe. But a full disclosure of the API's coupled with the community service "port to WiNE" requirement might have sped up the process. Incredibly, the "Undocumented Windows Secrets" industry continues to thrive, and the legendary Andrew Schulman's number is still at the top of Silicon Valley legal profession speed dials. http://goo.gl/0UGe8 Oh well. The Court of Appeals stopped the breakup, leaving the Windows Productivity Platform intact. Microsoft continues to own the "client" in "Client/Server" computing. Although Microsoft was temporarily stopped from leveraging their desktop monopoly to an iron fisted control and dominance of the Internet, I think what were watching today with the Cloud is Judge Jackson's worst nightmare. And mine too. A great transition is now underway, as businesses and enterprises begin the move from legacy client/server business systems and processes to a newly emerging Cloud Productivity Platform. In this great transition, Microsoft holds an inside straight. They have all the aces because they own the legacy desktop productivity platform, and can control the transition to the Cloud. No doubt this transition is going to happen. And it will severely disrupt and change Microsoft's profit formula. But if the Redmond reprobate can provide a "value added" transition of legacy business systems and processes, and direct these new systems to the Microsoft Cloud, the profits will be immense.

  • Judge Jackson sought to break the ability of Microsoft to "leverage" their existing monopoly into the Internet and his plan was overturned and replaced by one based on judicial oversight. Microsoft got a slap on the wrist from the Court of Appeals, but were wailed on with lawsuits from the hundreds of parties injured by their rampant criminality. Some put the price of that criminality as high as $14 Billion in settlements. Plus, the shareholders forced Chairman Bill to resign. At the end of the day though, Chairman Bill was right. Keeping the monopoly intact was worth whatever penalty Microsoft was forced to pay. He knew that even the judicial over-site would end one day. Which it did. And now his company is ready to go for it all by leveraging and controlling the great productivity transition. No business wants to be hostage to a cold heart'd monopolist. But there is huge difference between a non-disruptive and cost effective, process-by-process value-added transition to a Cloud Productivity Platform, and, the very disruptive and costly "rip-out-and-replace" transition offered by Google, ZOHO, Box, SalesForce and other Cloud Productivity contenders. Microsoft, and only Microsoft, can offer the value-added transition path. If they get the Cloud even halfway right, they will own business productivity far into the future.     Comments on the latest SVN article mulling the effects of Judge Thomas Penfield Jackson's anti trust ruling and proposed break up of Microsoft. comment: "Chinese Wall" Ummm, there was a Chinese Wall between Microsoft Os and the MS Applciations layer. At least that's what Chairman Bill promised developers at a 1990 OS/2-Windows Conference I attended. It was a developers luncheon, hosted by Microsoft, with Chairman Bill speaking to about 40 developers with applications designed to run on the then soon to be released Windows 3.0. In his remarks, the Chairman described his vision of commoditizing the personal computer market through an open hardware-reference platform on the one side of the Windows OS, and provisioning an open application developers layer on the other using open and totally transparent API's. Of course the question came up concerning the obvious advantage Microsoft applications would have. Chairman Bill answered the question by describing the Chinese Wall that existed between Microsoft's OS and Apps develop departments. He promised that OS API's would be developed privately and separate from the Apps department, and publicly disclosed to ALL developers at the same time. Oh yeah. There was lots of anti IBM - evil empire stuff too :) Of course we now know this was a line of crap. Microsoft Apps was discovered to have been using undocumented and secret Window API's. http://goo.gl/0UGe8. Microsoft Apps had a distinct advantage over the competition, and eventually the entire Windows Productivity Platform became dependent on the MSOffice core.     Forbes magazine has a doom and gloom Microsoft article that "ends on a note of doom".  They lampoon Windows 8 using the reviews of other bloggers like Charlie Demerjian, "Microsoft has failed". http://goo.gl/H4mZc The end of Microsoft though comes from the inability of Microsoft to change course.  In short, Microsoft has fallen into a death spiral consistent with Catastrophe theory (http://goo.gl/6CWwY). Microsoft to host data in Germany to evade US spying | Naked Security - 0 views

  • Microsoft's new plan to keep the US government's hands off its customers' data: Germany will be a safe harbor in the digital privacy storm. Microsoft on Wednesday announced that beginning in the second half of 2016, it will give foreign customers the option of keeping data in new European facilities that, at least in theory, should shield customers from US government surveillance. It will cost more, according to the Financial Times, though pricing details weren't forthcoming. Microsoft Cloud - including Azure, Office 365 and Dynamics CRM Online - will be hosted from new datacenters in the German regions of Magdeburg and Frankfurt am Main. Access to data will be controlled by what the company called a German data trustee: T-Systems, a subsidiary of the independent German company Deutsche Telekom. Without the permission of Deutsche Telekom or customers, Microsoft won't be able to get its hands on the data. If it does get permission, the trustee will still control and oversee Microsoft's access.

  • Microsoft and T-Systems' lawyers may well think that storing customer data in a German trustee data center will protect it from the reach of US law, but for all we know, that could be wishful thinking. Forrester cloud computing analyst Paul Miller: To be sure, we must wait for the first legal challenge. And the appeal. And the counter-appeal. As with all new legal approaches, we don’t know it is watertight until it is challenged in court. Microsoft and T-Systems’ lawyers are very good and say it's watertight. But we can be sure opposition lawyers will look for all the holes. By keeping data offshore - particularly in Germany, which has strong data privacy laws - Microsoft could avoid the situation it's now facing with the US demanding access to customer emails stored on a Microsoft server in Dublin. The US has argued that Microsoft, as a US company, comes under US jurisdiction, regardless of where it keeps its data.

    The European Community's Court of Justice decision in the Safe Harbor case --- and Edward Snowden --- are now officially downgrading the U.S. as a cloud data center location. NSA is good business for Europeans looking to displace American cloud service providers, as evidenced by Microsoft's decision. The legal test is whether Microsoft has "possession, custody, or control" of the data. From the info given in the article, it seems that Microsoft has done its best to dodge that bullet by moving data centers to Germany and placing their data under the control of a European company. Do ownership of the hardware and profits from their rent mean that Microsoft still has "possession, custody, or control" of the data? The fine print of the agreement with Deutsche Telekom and the customer EULAs will get a thorough going over by the Dept. of Justice for evidence of Microsoft "control" of the data. That will be the crucial legal issue. The data centers in Germany may pass the test. But the notion that data centers in the UK can offer privacy is laughable; the UK's legal authority for GCHQ makes it even easier to get the data than the NSA can in the U.S.  It doesn't even require a court order.

"A group of software developers have created a program to make Microsoft Office work with files in the OpenDocument format, a move that would bridge currently incompatible desktop applications. Gary Edwards, an engineer involved in the open-source OpenOffice.org project and founder of the OpenDocument Foundation, on Thursday discussed the software plug-in on the Web site Groklaw. The new program, which has been under development for about year and finished initial testing last week, is designed to let Microsoft Office manipulate OpenDocument format (ODF) files, Edwards said. "The ODF Plugin installs on the file menu as a natural and transparent part of the 'open,' 'save,' and 'save as' sequences. As far as end users and other application add-ons are concerned, ODF Plugin renders ODF documents as if (they) were native to MS Office," according to Edwards. If the software, which is not yet available, works as described, it will be a significant twist to an ongoing contest between Microsoft and the backers of OpenDocument, a document format gaining more interest lately, particularly among governments. Microsoft will not natively support OpenDocument in Office 2007, which will come out later this year. Company executives have said that there is not sufficient demand and OpenDocument is less functional that its own Office formats. Having a third-party product to save OpenDocument files from Office could give OpenDocument-based products a bump in the marketplace, said Stephen O'Grady, a RedMonk analyst.     One of the "Lessons of Massachusetts" is that the key lock-in point for Microsoft's monopoly is their iron fisted control of the productivity environment, anchored by MSOffice and the Windows local workgroup client/server system.  Key to office productivity is the compound document model that fuels every business process and business productivity system.  It's the embedded logic and database connectivity (OLE, ODBC, MAPI and COM ActiveX controls) that juice the compound document model.   Convert a compound document to another format (or PDF), and you BREAK the both the document, AND THE BUSINESS PROCESS!!!! It was the breaking of the business process that stopped Massachusetts from moving to the Open Document Format !!!! So now comes a story with consumer sales vs enterprise sales numbers that seemingly shatter the Lessons of Massachusetts.  How is that? My take is that the numbers Microsoft touts are true.  Consumers are making new purchases - NOT enterprises.  The simple truth is that, as Microsoft introduces new OS and Application Services geared to Mobile / Cloud Computing, these new systems BREAK legacy business systems.  It's still way too costly for businesses to transition to the new models. Eventually though, businesses will replace those legacy business productivity systems with Mobile / Cloud Computing systems.  And it will be a rip-out-and-replace transition; not the gradual "value-added" transition everyone hopes Microsoft will provide.   Interesting stuff. excerpt: "If Microsoft is an enterprise company, then why is it spending so much time and money on stuff like Bing, Xbox, Windows Phone, and the Surface RT?     Note that rip-out-and-replace to get to the cloud is a very risky strategy for MSFT because the company forfeits its vendor lock-in advantage; the question for the enterprise then becomes "replace with what?" The answer in many cases will be non-Microsoft services. And traditionally, what the enterprise uses has driven what enterprise workers use at home far more than vice versa.

  • The multitude of services gives Microsoft an early edge when it comes to cloud, but the channel-enablement model for Cisco can create much greater scale than a direct to line-of-business model. The key is ensuring its resellers are fully trained in selling to line-of-business, which isn't a simple undertaking. Bottom line: With regard to cloud, Microsoft has a faster route to market, but Cisco's should give it an advantage over time.
  • Putting cloud aside, Cisco and Microsoft have markedly different approaches in selling to lines of business. For Microsoft, the key lies in its developer community. Developers build applications that business people use and buy. Many of these applications use Microsoft as an underlying technology without the purchaser really even being aware of that fact. Microsoft gets pulled through with really no involvement from Microsoft, providing a low- to no-cost sales model for the company. The only down side is that the application brand often overshadows the underlying brand.
  • With regards to UC, as this market transitions away from products to platforms, services will play a significant role. Cisco's services plays a role similar to IBM services. IBM's consulting group works with its top tier customers to understand how to solve business problems through compute-centric solutions. Cisco services works with its customers to create solutions through networking- and communications-related products. As more and more organizations look to leverage UC strategically, I would expect Cisco services to target its top-tier customers. The key for Cisco then is to take these solutions and push them down through its channel for scale and market share gains.

  • Cisco has been trying to build its own "Cisco Developer Network" (CDN) for the better part of a decade. The company kicked off this initiative way back in the early 2000s when it bought a company called Metreos that had some interesting VoIP applications and a slick developer interface. Back then, the program was known as CTDP, Cisco Technology Developer Program, and was run by VoIP people, not individuals that understand software and how to build a developer environment. Since then the program has undergone a number of facelifts and Cisco appears to have some real software people running the group, so there is some potential.
  • Microsoft has made a living off selling products, many of them sub-par, into business because of its developer relationships. Does anyone really think Microsoft gained monopoly-like share with desktop operating systems because of quality of product and ease of use? Hardly. Windows became the de facto standard for developers because of the quality of the developer program. Microsoft does a good job of meeting the needs of its large software vendors, but does an even better job of making sure those millions of small ISVs have access to Microsoft platforms and developer support.
  • So developer-led or services-led?
  • Microsoft should get an early advantage, as many in-house developers will look to Lync; but the services strategy by Cisco should create longer, more sustainable value, as it has for IBM.
  • The key for Microsoft is being able to adapt its developer environment faster as market trends change. Obviously, compute is moving away from the traditional desktop to mobile clients and the cloud, and there are far more single-use, purpose-built applications being built in the consumer world. I think Microsoft's Developer Network is oriented towards more old-school developers.
  • The key for Cisco is having the patience to work with its lead customers and find those unique, game-changing applications and use cases that it can then push down into the channel. It's the right strategy for Cisco, but it might take a bit more time to bear some fruit.

    The Future of the Open Web You're right that the browser wars do not matter - except for this point of demarcation; browsers that support HTML+ and browser that support 1998 HTML. extensive comment by ~ge~ Not all Web services and applications support HTML+, the rapidly advancing set of technologies that includes HTML5, CSS3, SVG/Canvas, and JavaScript (including the libraries and JSON). Microsoft has chosen to draw the Open Web line at what amounts to 1998-2001 level of HTML/CSS. Above that line, they provision a rich-client / rich-server Web model bound to the .NET-WPF platform where C#, Silverlight, and XAML are very prominent. Noticeably, Open Web standards are for the most part replaced at this richer MSWeb level by proprietary technologies. Through limited support for HTML/CSS, IE8 itself acts to dumb down the Open Web. The effect of this is that business systems and day-to-day workflow processes bound to the ubiquitous and very "rich" MSOffice Productivity Environment have little choice when it comes to transitioning to the Web but to stay on the Microsoft 2010 treadmill. Sure, at some point legacy business processes and systems will be rewritten to the Web. The question is, will it be the Open Web or the MS-Web? The Open Web standards are the dividing line between owning your information and content, or, having that content bound to a Web platform comprised of proprietary Microsoft services, systems and applications. Web designers and developers are still caught up in the browser wars. They worry incessantly as to how to dumb down Web content and services to meet the limited functionality of IE. This sucks. So everyone continues to watch "the browser wars" stats. What they are really watching for though is that magic moment where "combined" HTML+ browser uptake in marketshare signals that they can start to implement highly graphical and collaboratively interactive HTML+ specific content.     I disagree with the authors conclusions here.  He misses some very significant developments.  Particularly around Google, WebKit, and WebKit-HTML5. For instance, there is this article out today; "Google Really is Giving Away Free Nexus One and Droid Handsets to Developers".  Also, Palm is working on a WiMAX/WiFi version of their WebOS (WebKit) smartphone for Sprint.  Sprint and ClearWire are pushing forward with a very aggressive WiMAX rollout in the USA.  San Francisco should go on line this year!   One of the more interesting things about the Sprint WiMAX plan is that they have a set fee of $69.00 per month that covers EVERYTHING; cellphone, WiMAX Web browsing, video, and data connectivity, texting (SMS) and VOIP.  Major Sprint competitors, Verizon, AT&T and TMobile charge $69 per month, but it only covers cellphone access.  Everything else is extra adn also at low speed/ low bandwidth.  3G at best.  WiMAX however is a 4G screamer.  It's also an open standard.  (Verizon FIOS and LTE are comparable and said to be coming soon, but they are proprietary technologies).   The Cable guys are itneresting in that they are major backers of WiMAX, but also have a bandwidth explosive technology called Docsis. There is an interesting article at TechCrunch, "In Mobile, Fragmentation is Forever. Deal With It."  I disagree entirely with the authors conclusion.  WebKit is capable of providing a universal HTML5 application developers layer for mobile and desktop browser computing.  It's supported by Apple, Google, Palm (WebOS), Nokia, RiMM (Blackberry) and others to such an extent that 85% of all smartphones shipped this year will either ship with WebKit or, an Opera browser compatible with the WebKit HTML5 document layout/rendering model.   I would even go as far as to say that WebKit-HTML5 owns the Web's document model and application layer for the future.  Excepting for Silverlight, which features the OOXML document model with over 500 million desktop develop

Both software and hardware were being written and developed to the Windows OS, with features doubling and costs being halved at a rate that even Moore's Law envied. Microsoft fully cemented the emerging hardware - OS - application platform with a business productivity environment that necessitated the use of the MS Office suite of servers and apps. No one understands platform better than Microsoft.  Control the platform's base formats, protocols, interfaces and internal messaging system, and you control all applications, services and devices using that platform.   The problem for Microsoft has been that the Web is a platform used by all, but owned by none.  It's based on open standards that no one owns or controls.  So as the Web evolves into a universal platform for converged communications, content and collaborative computing, Microsoft was facing the one fate every monopolist fears - having to compete on a level playing field! While it took them well over ten years to come up with a counter strategy and effective implementation, Microsoft has finally achieved the impossible.   They have carved out a huge section of the Open Web for their proprietary and exclusive use.

  • On the 21st floor of a high-rise hotel in Cleveland, in a room full of political operatives, Microsoft’s Research Division was advertising a technology that could read each facial expression in a massive crowd, analyze the emotions, and report back in real time. “You could use this at a Trump rally,” a sales representative told me. At both the Republican and Democratic conventions, Microsoft sponsored event spaces for the news outlet Politico. Politico, in turn, hosted a series of Microsoft-sponsored discussions about the use of data technology in political campaigns. And throughout Politico’s spaces in both Philadelphia and Cleveland, Microsoft advertised an array of products from “Microsoft Cognitive Services,” its artificial intelligence and cloud computing division. At one exhibit, titled “Realtime Crowd Insights,” a small camera scanned the room, while a monitor displayed the captured image. Every five seconds, a new image would appear with data annotated for each face — an assigned serial number, gender, estimated age, and any emotions detected in the facial expression. When I approached, the machine labeled me “b2ff” and correctly identified me as a 23-year-old male.

    Today Microsoft announced an open source cloud collaboration that may surprise some people, but not our customers and partners who have relied on our interoperability solutions over the past few years. Today Microsoft announced that it has partnered with Cloud.com to provide integration and support of Windows Server 2008 R2 Hyper-V  to the OpenStack project, an open source cloud infrastructure platform. The Hyper-V addition provides enterprise customers running a mix of Microsoft and non-Microsoft technologies greater flexibility when using OpenStack. Until today, OpenStack only supported several open source virtualization products. Comment:  Microsoft needs to slow down Google and keep Apple's focus elsewhere.  Contributing a Windows only hypervisor to the OSS Cloud.com OpenStack project is one way Microsoft can hedge their own flailing Azure Cloud effort.  Read the Ray Ozzie good-bye letter.  The combination of Cloud, Web and Mobile Computing is the end of the Windows OS.

    Good title.  Nice to see that some of the tech media are starting to figure this out.  It's about time. excerpt: While Microsoft has struggled with its mobile operating system, it still occupies a dominant stake of the server operating system, desktop operating system, business productivity software, messaging, and Web browser markets. Bells and whistles aside, it's hard to argue with the potential of a smartphone platform that can seamlessly tie in with the platforms and tools that businesses rely on. RIM, Apple, Palm, and now Google, all recognize and respect Microsoft's presence in the enterprise. These other mobile platforms realize that integration with Microsoft backend tools--particularly Exchange Server--is imperative to success in the enterprise. No matter how hard they try, though, the solutions are often clumsy or cumbersome, and have a sort of "square peg in the round hole" feel to them. The core appeal of a Microsoft mobile operating system is the inclusion of native tools that naturally integrate with the existing server, desktop, and office productivity environment. Windows Mobile is uniquely suited to deliver a seamless and familiar experience for business professionals. Expecting Microsoft to introduce unique innovations or raise the bar in any way for mobile operating systems is probably a recipe for disappointment. Assuming that Microsoft can at least improve Windows Mobile to the point that Windows Phones are more or less on par with next-generation smartphones like the iPhone or Droid will be enough, though, for Microsoft to get the ship pointed in the right direction and begin to reclaim some of its lost mobile platform market share. Microsoft has a built-in audience and the game is Microsoft's to lose.

    Right now, we're all worrying about Apple's patent claims against HTC, but Android may face a similar attack from Microsoft. It's not terribly well known that Microsoft claims that it owns significant intellectual property used in Linux, the operating system at the heart of Android. Starting in 2006, Microsoft began reaching licensing deals with a number of companies that use the open source OS, among them Novell,  I-O Data, Samsung, LG Electronics and most recently, Amazon. All these deals are similar, but as an example, Amazon has agreed to pay Microsoft licensing fees to use Linux on Amazon.com and on the Kindle. Read that again and let it sink in. Many have voiced skepticism that Microsoft could successfully defend their claims, but so far, companies have rolled over and complied rather than take the question to court.

The SFGate article compares Google Apps lack of service to Microsoft's Productivity monopoly, suggesting that Microsoft provides better service?  That's idocy.  Microsoft's service is non existent.  Third party MSDN developers and service businesses provide near 100% of MS Productivity support.  And always have.   Where Microsoft does provide outstanding support is to their MSDN network of developers and service providers.   Google will have to match that support if Google Apps is to make a credible run at Microsoft.  But there is no doubt that the monopolist iron grip on the desktop productivity platform is an almost impossible barrier for Google to climb over.  Service excellence or not.
