    THE CITY OF Los Angeles is not doing enough to regulate short-term rental properties, according to AAHOA and a report from local advocacy group Better Neighbors LA. Both groups say the city should do more to enforce its existing 2019 ordinance on home sharing apps such as Airbnb and Vrbo. Los Angeles' ordinance requires short-term rentals to register and sets other regulations on home sharing apps. However, the Better Neighbors report found that the city's enforcement of the ordinance has been dropping since 2022, evidenced by a 54 percent decrease in warning letters, an 85 percent decrease in fines and a 25 percent increase in non-compliant listings. "Every year we put out an annual report that gives a snapshot of how enforcement is going in the city of Los Angeles, how many short-term rentals exist, and how that's changed from the prior year. This year, we've found that non-compliance is up," Allison Kriste, a representative of Better Neighbors Los Angeles, said in an interview with the Santa Monica Mirror newspaper. "We found a high rate of non-compliance across the boards in the city of Los Angeles. In addition, we've also found that enforcement activity is down. We're identifying more non-compliant listings, as compared to last year. The city is issuing fewer warning letters, they're issuing fewer fines. They're not doing a whole lot."

AHLA protests new 'joint-employer standard' - 0 views

    PROPOSED FEDERAL REGULATIONS defining a "joint-employer standard" would have a "chilling effect" on the hospitality industry and franchises in general, according to the American Hotel & Lodging Association. The National Labor Relations Board's latest version of the standard could define two companies as joint employers if they both control certain elements of employees' terms and conditions. The period for comments on the proposed regulations ended Nov. 21 and the would rescind and replace the joint-employer rule that took effect on April 27, 2020. That previous rule established that "a business must possess and exercise substantial direct and immediate control over one or more essential terms and conditions of employment of another employer's employees" to be considered a joint employer. However, a ruling by the U.S. Court of Appeals for the D.C. Circuit in July reversed that rule. Now, under the new rule, "two or more employers would be considered joint employers if they 'share or codetermine those matters governing employees' essential terms and conditions of employment,' such as wages, benefits and other compensation, work and scheduling, hiring and discharge, discipline, workplace health and safety, supervision, assignment, and work rules," according to NLRB.

The demand for economy extended-stay hotels declined 1.3 percent for the second consecutive month in May compared to same period last year mainly due to sharp increase in ADR in last few months, the report said. The U.S. Extended-Stay Hotels Bulletin: May 2022 by The Highland Group said that the extended-stay room supply growth was just 1.9 percent during the month. It is the second successive month that the growth was below 2 percent since 2013, and the eighth consecutive month of 4 percent or lower supply growth. The report added that the supply increase will be well below pre-pandemic levels during the near term. According to STR, all hotel room revenue was up 43 percent in May 2022 compared to last year. "In May, mid-price and upscale extended-stay segments reported their lowest monthly change in demand in 2022. Except for February 2021, due to the leap year in 2020, economy extended-stay hotels reported only the second monthly fall in demand in 23 consecutive months," the report said. "Overall hotel occupancy gained more than extended-stay hotels in May compared to one year ago, decreasing extended-stay hotel's occupancy premium to 12 percentage points, and remains within its long-term average range."

However, a full recovery in real terms, after adjusting for inflation, remains a few years away, it added. With more assets, both distressed and well performing, expected to come to market this year, 2022 will be an exciting year for the industry, said Rod Clough, president of HVS, in an article titled 'ALIS 2022 Takeaways - Our Industry Braces for a Big Year Ahead'. A near full recovery in RevPAR at $85 for U.S. hotels is likely to happen by the end of 2022 when compared to $86 in 2018-19. "The higher inflationary environment will continue to bode well for hotels, resulting in ADR pricing power leading to a lift in revenue on top of still lean operational models. Group travel is still lagging the recovery, but near-term, smaller-group bookings (at newly raised room rates) should help bridge the gap while the industry waits for larger meetings to return," Clough wrote in the article. "Rising development costs due to supply-chain disruptions, labor shortages, and overall inflation are leading to a general contraction in new hotel openings. Moreover, development challenges are intensifying for major CBDs, attributed to slow office re-openings, a lag in larger convention bookings, higher operating/labor costs, and even higher construction costs than your average project."

The NLRB ruling, issued Oct. 26 and due to take effect Feb. 26, defines a joint employer to be any company that shares or codetermines one or more essential terms and conditions of employment. Those include ages, benefits, and other compensation; hours of work and scheduling; the assignment and supervision of duties to be performed; work rules and tenure of employment. The final rule rescinds the 2020 rule that was promulgated by the prior board and applies the new definition of joint employer to any entity that can control the essential terms of employment whether or not such control is exercised and without regard to whether any such exercise of control is direct or indirect. House Joint Resolution 98 would nullify the NLRB's rule.
