Copyright Challenges in a MOOC Environment - 0 views

  •
The intersection of copyright and the scale and delivery of MOOCs highlights the enduring tensions between academic freedom, institutional autonomy, and copyright law in higher education. To gain insight into the copyright concerns of MOOC stakeholders, EDUCAUSE talked with CIOs, university general counsel, provosts, copyright experts, and other higher education associations. The consensus opinion was that intellectual property questions for MOOC content merit wide discussion because they affect multiple stakeholders and potentially carry significant consequences. Each MOOC provider, for example, establishes a proprietary claim on material included in its courses, licenses to the user the terms of access and use of that material, and establishes its ownership claim of user-generated content. This conflicts with the common institutional policy approach that grants rights to faculty who develop a course. Fair-use exceptions to traditional copyright protection face challenges as well, given a MOOC's potential for global reach. Nonetheless, fair use and MOOCs are not mutually exclusive ideas. MOOCs remain an experiment. Initiating discussions with a wide range of campus stakeholders will ensure clarity of purpose and a common understanding of copyright issues in a MOOC environment.

"Sherlock Holmes" Is Now Officially Off Copyright and Open for Business - 0 views

  •
"The legal case of Klinger v. Conan Doyle Estate that settled the claim actually rested on an interesting issue, whether a copyright claim can persist on a character even if the works depicting that character have fallen out of copyright. The defense of the Doyle estate went something like this: sure, Arthur Conan Doyle's stories are now at least 90 years old, but other stories about Sherlock Holmes are still under copyright, therefore Sherlock Holmes is still under copyright. Judge Richard Posner didn't buy the argument, and he ruled that Sherlock Holmes, the character, is now in the public domain."

Copyright Advisory Network - Copyright Advisory Network - 0 views

  •
"The Copyright Advisory Network (CAN) exists to help librarians understand Copyright law and appreciate the important role that they can play in serving the public "to advance the progress of science and the useful arts." We use the Network to respond to Copyright questions posed by librarians, but perhaps-more importantly, help librarians learn about Copyright from a broader perspective, primarily its impact on information policy issues fundamental to our profession, including free expression, equitable access to information, censorship, and intellectual freedom."

Five-Minute Film Festival: Copyright and Fair Use for Educators - 0 views

  •
I absolutely love it when teachers and students create, remix, and mash up media; it's a fantastic way to encourage deeper learning and media literacy. But one issue that complicates digital freedom of expression is copyright law. While many would argue that copyright law is outdated and badly in need of an overhaul, it's still critical that adults and kids alike have a basic understanding of what's legal and ethical while playing with other people's intellectual property. Here's a list of videos I collected to help you navigate the murky waters of copyright law in educational settings.

Fair Use Evaluator - 0 views

  •
"What this tool can do for you: Help you better understand how to determine the "fairness" of a use under the U.S. Copyright Code. Collect, organize & archive the information you might need to support a fair use evaluation. Provide you with a time-stamped, PDF document for your records [example], which could prove valuable, should you ever be asked by a Copyright holder to provide your fair use evaluation and the data you used to support it. [why is this important?] Provide access to educational materials, external Copyright resources, and contact information for Copyright help at local & national levels."

Surveying The Public Domain - 1A - 0 views

  •
"…because of term extensions, we've had to wait almost a century before copyrighted works enter the public domain (in 2019, works from 1923 are finally freely available). Under current copyright terms - life plus 70 years for natural authors, and 95 years from publication for works of corporate authorship - you're unlikely to see any works created in your lifetime enter the public domain. This imposes great (and in many cases unnecessary) costs on creativity, on libraries and archives, on education and on scholarship. More broadly, it imposes costs on our collective culture. Even for the works that are still commercially available, the shrinking public domain increases costs to citizens and limits creative reuse. But at least those works are available. Unfortunately, much of our cultural heritage, perhaps the majority of the culture of the last 80 years, consists of the orphan works described above-works that have no identifiable or locatable copyright holder. Though no one is benefiting from the copyright, they are nevertheless presumptively off limits."

Why Schools Aren't Safe Harbors for Copyright Infringement - 0 views

  •
"But the U.S. Copyright Law says otherwise, depending on the situation. While it's highly unlikely a teacher would be taken to court for Copyright infringement in the case of showing a movie at school, it's still useful to have a working knowledge of the law and how to be good citizens when showing media. Code of Best Practices in Fair Use for Media Literacy Education - Center for Media and Social Impact - 0 views

  •
"This document is a code of best practices that helps educators using media literacy concepts and techniques to interpret the copyright doctrine of fair use. Fair use is the right to use copyrighted material without permission or payment under some circumstances-especially when the cultural or social benefits of the use are predominant. It is a general right that applies even in situations where the law provides no specific authorization for the use in question-as it does for certain narrowly defined classroom activities."

Reselling Digital Goods Is Copyright Infringement, Judge Rules - 0 views

  •
A federal judge is declaring as unlawful a one-of-a-kind website enabling the online sale of pre-owned digital music files. ReDigi, which opened in late 2011, provides a platform to buy and sell used MP3s that were once purchased lawfully through iTunes. The case weighed the so-called first-sale doctrine, the legal theory that people in lawful possession of copyright material have the right to resell it. U.S. District Judge Richard Sullivan, ruling in a suit brought by Vivendi's Capitol Records, said the doctrine did not apply to digital goods.

Whose tattoo is it anyway? - 0 views

  •
"Who owns a tattoo? The obvious answer is the wearer, who paid for the ink and is now permanently (more or less) attached to it. Yet recent disputes have called into question the easy idea that if you buy a tattoo, you also own it and can display it as you like. Tattoo artists are increasingly claiming that they, like other artists, own the copyright to the images they create. And when those images, attached to living people, appear on the silver screen - or a computer monitor - the artists want to get paid."

Artist's spoof Ladybird book provokes wrath of Penguin - 0 views

  •
"An artist and comedian has been told by the publisher Penguin that her new satirical art book breaches its copyright, and if she continues to sell copies it could use the courts to seize the books and have them pulped. Miriam Elia, who has her own comedy series, A Series Of Psychotic Episodes, on BBC Radio 4 and has had a number of short segments on Channel 4, had produced a spoof version of the Ladybird books from the 60s. Generations of British children fondly remember these works, which famously portrayed the daily lives of Mummy, Peter and Jane as an introduction to reading and writing for young children."

Textbook Publisher Pearson Takes Down 1.5 Million Teacher And Student Blogs With A Single DMCA Notice - 0 views

  •
"Textbook publisher Pearson set off an unfortunate chain of events with a takedown notice issued aimed at a copy of Beck's Hoplessness Scale posted by a teacher on one of Edublogs' websites (You may recall Pearson from such other related copyright nonsense as The $180 Art Book With No Pictures and No Free Textbooks Ever!). The end result? Nearly 1.5 million teacher and student blogs taken offline by Edublogs' host, ServerBeach."
