The intersection of copyright and the scale and delivery of MOOCs highlights the enduring tensions between academic freedom, institutional autonomy, and copyright law in higher education. To gain insight into the copyright concerns of MOOC stakeholders, EDUCAUSE talked with CIOs, university general counsel, provosts, copyright experts, and other higher education associations. The consensus opinion was that intellectual property questions for MOOC content merit wide discussion because they affect multiple stakeholders and potentially carry significant consequences. Each MOOC provider, for example, establishes a proprietary claim on material included in its courses, licenses to the user the terms of access and use of that material, and establishes its ownership claim of user-generated content. This conflicts with the common institutional policy approach that grants rights to faculty who develop a course. Fair-use exceptions to traditional copyright protection face challenges as well, given a MOOC's potential for global reach. Nonetheless, fair use and MOOCs are not mutually exclusive ideas. MOOCs remain an experiment. Initiating discussions with a wide range of campus stakeholders will ensure clarity of purpose and a common understanding of copyright issues in a MOOC environment.

I absolutely love it when teachers and students create, remix, and mash up media; it's a fantastic way to encourage deeper learning and media literacy. But one issue that complicates digital freedom of expression is copyright law. While many would argue that copyright law is outdated and badly in need of an overhaul, it's still critical that adults and kids alike have a basic understanding of what's legal and ethical while playing with other people's intellectual property. Here's a list of videos I collected to help you navigate the murky waters of copyright law in educational settings.

"The Copyright Crash Course was created by Georgia Harper and is currently maintained by UT Libraries. The Course is arranged into several sections that allow users to explore certain areas of copyright law individually or as a group. The Course was originally created with faculty in mind, but can be used by anyone who is interested in understanding and managing their copyrights."

This is a course for educators who want to learn about US copyright law in the education context. P2PU also offers a similar courses for Australia, if that content is more appropriate. Educators who are not in the US are welcome to sign up, too, if they want to learn about copyright law in the US.

"But the U.S. Copyright Law says otherwise, depending on the situation. While it's highly unlikely a teacher would be taken to court for copyright infringement in the case of showing a movie at school, it's still useful to have a working knowledge of the law and how to be good citizens when showing media. "

A federal judge is declaring as unlawful a one-of-a-kind website enabling the online sale of pre-owned digital music files. ReDigi, which opened in late 2011, provides a platform to buy and sell used MP3s that were once purchased lawfully through iTunes. The case weighed the so-called first-sale doctrine, the legal theory that people in lawful possession of copyright material have the right to resell it. U.S. District Judge Richard Sullivan, ruling in a suit brought by Vivendi's Capitol Records, said the doctrine did not apply to digital goods.

"This article examines a relatively recent and increasingly problematic trend in fair use jurisprudence: courts' tendency to decide whether a copyright defendant has made a fair use of the plaintiff's work based in part on whether the defendant has acted in "bad faith." Courts use the term "bad faith" to encompass a wide range of conduct weighing against a finding of fair use."

"An artist and comedian has been told by the publisher Penguin that her new satirical art book breaches its copyright, and if she continues to sell copies it could use the courts to seize the books and have them pulped. Miriam Elia, who has her own comedy series, A Series Of Psychotic Episodes, on BBC Radio 4 and has had a number of short segments on Channel 4, had produced a spoof version of the Ladybird books from the 60s. Generations of British children fondly remember these works, which famously portrayed the daily lives of Mummy, Peter and Jane as an introduction to reading and writing for young children."

"The important point to remember is that the fair use guidelines that are used to determine what materials can be used on the local campus do not automatically transfer to online courses offered to the consumer public. To many faculty, these rules seem bureaucratic, but librarians can help navigate the terrain that faculty are not accustomed to dealing with. And, by becoming comfortable with copyright provisions themselves, faculty can ensure that their online students access the same level of resources that on-campus students enjoy."

The rationale for seeking open terms of both access and use is as follows. Free access provides the literature to at least five overlapping audiences: researchers who happen upon open-access research articles while browsing the Web rather than a password-protected database; researchers at institutions that cannot afford the subscription prices for the growing literature; researchers in disciplines other than that of a journal's intended audience, who would not otherwise subscribe; patients, their families, students, and other members of the public with an interest in the information but without the means to subscribe; and researchers' computers running text-mining software to analyze the literature. In addition, granting readers full reuse rights unleashes the full range of human creativity for translating, combining, analyzing, adapting, and preserving the scientific record, whereas traditional copyright arrangements in scientific publishing increasingly inhibit scholarly communication.

"There are over 7 billion photos on Flickr, and, more importantly, many of them are (a) pretty good photos and (b) licensed under Creative Commons. The latter is important because in the United States when you take a photo, you get the copyright to that photo. That means if you want to use a photo you find online somewhere (perhaps using a Google image search), you need to contact the person who took that photo and get permission... unless that person has released the photo under Creative Commons, in which case you can use it without asking!"
