AAHOA survey finds only 5 percent of franchisees are happy - 0 views

    THE AMERICAN FRANCHISE business model is in trouble, according to a recent survey commissioned by AAHOA. The survey was inspired by a webinar AAHOA co-sponsored to gather public comment on the state of franchising for the Federal Trade Commission. The survey found that only 5 percent of the franchisee respondents are satisfied that their current franchise agreements provide fair terms representing a balanced relationship between themselves and their franchiser. Also, 72.6 percent of respondents would "possibly" or "probably" terminate their current franchised business within the next year if they could do so without penalty. "Franchising is in dire straits unless changes are made," said Laura Lee Blake, AAHOA president and CEO. "Franchising is still a powerful tool for economic mobility for America's small-business owners, including AAHOA Members. But franchising only works when both franchisors and franchisees are committed to its success, which requires transparency, fairness, and sustainable business practices. As this survey shows, there is much room for improvement when it comes to relationships that allow our small-business owners to thrive." Blake recently wrote an editorial supporting AAHOA's 12 Points of Fair Franchising and its promotion of a proposed New Jersey law that would reform that state's franchising regulations in ways similar to the 12 points. Several large hotel companies, including Choice Hotels International and Marriott International, protested AAHOA's recent annual convention in protest to its position on franchise reform The survey was conducted among owners of hotels, restaurants, retail stores and other small businesses that had participated in the FTC webinar. It was co-sponsored by the American Association of Franchisees and Dealers, and the Coalition of Franchisee Associations, conducted the survey after a recent webinar with FTC Chair Lina Khan. Best Western announces first recipients of Kong Legacy scholarship - 0 views

    BWH HOTEL GROUP has announced the recipients of the first ever David and Louise Kong Legacy Scholarship. The scholarship grants financial assistance to individuals associated with Best Western Hotels & Resorts. The four winners are Alexis Heichman of Eagle, Ashley Hernandez, of Patterson, and Phoenix residents Katerina Rose Levendi and Kayla McMahon, the group said in a statement. They will receive $12,000 as part of funding. Heichman will begin her journalism studies at Arizona State University this fall. She wants to be a travel, cultural or sports correspondent. Hernandez will continue her bachelor's degree studies in hotel and hospitality management. She is currently the general manager of the Best Western Plus Villa Del Lago Inn. Levendi now studies business at Paradise Valley Community College and wants to become a human resources manager. McMahon will start studying business administration and management at Arizona State University this fall. Her career interests is in family law and business. The scholarship is given to member hoteliers or their children, hotel staff or their children, and corporate associates or their children, the statement added.

    From the courtroom to the halls of Congress, Laura Lee Blake has been representing AAHOA in some capacity for more than a decade now. For the past year she has served as the organization's president and CEO, and recently she sat for Asian Hospitality's Leadership Series to discuss the issues facing the association today. Those issues include the promotion of franchise reform, programs to advance women in the hotel industry and her future plans in her role at AAHOA. Blake's work for the association began well before her current appointment. Making the decision Blake, who is an attorney, worked with AAHOA from 2005 to 2014, then left to return to her law firm in Newport Beach, California. She had just started a trial on a big case when AAHOA offered her the president position.

Castell Project releases new Women in Hospitality report - 0 views

    IT'S BEEN A tough year for women in the hospitality industry, but progress has been made as more female executives took leadership roles, according to an annual report from the Castell Project, a nonprofit focused on promoting women in the industry. The next challenge, according to the project, is getting more women in hospitality education programs. Castell Project founder and chairwoman Peggy Berg released the 2022 Women in Hospitality Industry Leadership report during the Americas Lodging Investment Summit in Los Angeles earlier this week. During the conference, Berg received the ISHC Pioneer Award for her work in the industry, and she told a story during her acceptance speech that encapsulates where women are coming from in the industry. When she was in college, Berg said, the Equal Employment Opportunity Act lifted the restrictions on women working. So, she walked into a large firm looking for a job. "The partner in charge of the office, Jerry, he took one look at me and said 'Well, this will never work.' And then because of the EEOA, he said, 'I will give you a job if you promise not to get pregnant for two years,'" Berg said. "Jerry thought this was impossible. I thought Jerry didn't understand the law. Mostly I thought, if that's the barrier to success, the best vertical I have to cross, I can run this company. And a few years later, 140 men found themselves with a female partner."

"We have made the decision, effective immediately, to close our corporate office in Moscow, and pause the opening of upcoming hotels and all future hotel development and investment in Russia," Marriott said in a statement. "We have been closely monitoring the deteriorating situation in Ukraine, Russia and neighboring countries, and remain in regular contact with our teams on the ground, as we work to comply with sanctions and applicable laws. Our hotels in Russia are owned by third parties and we continue to evaluate the ability for these hotels to remain open."

    Recently, Larry Cuculic, president and CEO of BWH Hotel Group, sat down with Asian Hospitality to share his insights into the status of the Best Western Hotel brand and the industry as a whole. Subjects included the labor crisis, attracting new franchisees and the state of the economy. Below are excerpts from the interview along with additional information on the subjects discussed, including franchise relations, the labor crisis and changes the company has seen since his appointment to the top role. Franchise relations One of the biggest issues Cuculic discusses in the interview is maintaining positive relations with Best Western franchisees. He emphasized the need for openness and transparency. "We disclose all of our contract terms throughout the negotiation. I tell our people, I believe in karma," Cuculic said in the Leadership Series interview. "Karma doesn't forget a name or an address. If you treat someone who's thinking about coming into your brand reasonably fairly, and then when they sign a contract, you drive revenue to them, that's a win-win relationship. That's what we want. If you don't have that win-win relationship, they're going to leave and your reputation is that you don't support your hoteliers or believe in that relationship, which then hinders development." Cuculic said his training at West Point Military Academy and law school at Notre Dame University instilled in him an innate sense of fairness. Also, due to its structure, the company has to involve its members in every decision. "I'm the president, CEO of Best Western, I cannot design a governance change," Cuculic said. "The members vote on all those changes. Our board of directors approves our contracts."

AHLA opposes the pro-union PRO Act - 0 views

    SPONSORS AND SUPPORTERS of the proposed Richard L. Trumka Protecting the Right to Organize Act of 2023 say it is needed to protect the rights of workers to organize under labor unions. However, the American Hotel & Lodging Association and others claim the PRO Act puts an undue burden on small businesses, including hotels. The PRO Act would authorize penalties against employers that interfere with employees' efforts to organize, according to Democratic Rep. Robert "Bobby" Scott of Virginia, one of the co-sponsors of the bill. Also, the bill would facilitate collective bargaining agreements, close loopholes that allow employers to misclassify employees as supervisors and independent contractors. Other aspects of the PRO Act include protection for employees that experience retaliation for trying to organize a union, ensures that workers can collect "fair share" fees and authorizes a private right of action for violation of workers' rights. It also prevents employers from interfering in union elections or holding captive audience meetings. "Regrettably, for too long, workers have suffered from anti-union attacks and toothless labor laws that undermined their right to form a union," Scott said. "As a historic number of Americans put their support behind labor unions, Congress has an urgent responsibility to ensure that workers can join a union and negotiate for higher pay, better benefits, and safer workplaces."

Associations welcome passage of federal omnibus spending bill - 0 views

    THE RECENTLY PASSED federal $1.7 trillion omnibus spending bill contains important gains for the travel and hospitality industries, according to several advocacy groups. That includes the Omnibus Travel and Tourism Act and the creation of a position in the Department of Commerce to coordinate travel and tourism industry strategy. AAHOA, the American Hotel & Lodging Association and the U.S. Travel Association all welcomed the passage of the spending bill that was signed into law by President Biden on Dec. 23. All cited the OTTA legislation created by U.S. Sens. Jacky Rosen, Democrat of Nevada, and Republic Roger Wicker of Mississippi through the Senate Committee on Commerce, Science, and Transportation. What is the OTTA? The elements of the OTTA include the Visit America Act, which authorizes the creation of the new position in the DOC. The new assistant secretary would coordinate a strategy across multiple federal agencies to increase travel and tourism nationwide through annual goals and recommendations. The company has appointed Katherine Seitz as its new compliance officer. Conley joined Noble in 2006 as chief financial officer before becoming the firm's first compliance officer. In this role, he led the oversight and administration of Noble's regulatory and compliance functions and helped oversee the impact of Noble's core ESG initiatives and its duties as a signatory to the United Nations Principles of Responsible Investment, the company said in a statement. AHLA opposes new DOL rule defining independent contractors - 0 views

    THE U.S. DEPARTMENT of Labor's definition of who qualifies as independent contractors, due to take effect in March, is meant to ensure that workers are treated fairly, according to the department. However, the American Hotel & Lodging Association says the new rule limits independent contractors to work and impact hotels' ability to find workers. The new rule under the Fair Labor Standards Act aims to prevent misclassification of workers that can affect workers' rights to minimum wage and overtime pay, "facilitates wage theft, allows some employers to undercut their law-abiding competition and hurts the economy at-large," the Labor Department said in a statement. It uses a multifactor analysis of six factors defining a worker's relationship with an employer, such as the worker's opportunities for profit or loss; the financial stake and nature of any resources a worker has invested in the work; the degree of permanence of the work relationship; the degree of control an employer has over the individual's work; how essential the work is to the employer's business; and the worker's skill and initiative.

The research firm said in the motion that the seven individuals named as plaintiffs in the lawsuit failed to show a knowing conspiracy to fix prices through STR's "Forward STAR" program in violation of federal antitrust laws.     IN ITS LATEST drive to convince Wyndham Hotels & Resorts stakeholders to accept its proposed acquisition of the company, Choice Hotels International has released a detailed presentation accusing Wyndham of making misleading statements regarding the antitrust aspects of the deal. The specific accusations include that Wyndham is manipulating data on how the hotel industry works, the competition a Choice-Wyndham combination would face and the benefits of the merger for franchisees. Choice filed the presentation with the U.S. Securities and Exchange Commission and is also available at CreateValueWithChoice.com, the company said in a statement. Choice's presentation was released nearly three weeks after Wyndham's latest statement in which it said Choice was not being forthcoming with Wyndham shareholders regarding its offer.
