THE U.S. DEPARTMENT of Justice will appeal the recent court ruling that overturned a federal mask mandate on public transportation. In response, the U.S. Travel Association said that the mandate is simply out of step with the current public health landscape. Last week, U.S. District Judge Kathryn Kimball Mizelle in Tampa ruled that the CDC had overstepped its authority in issuing the mask mandate. The Centers for Disease Control and Prevention asked the DOJ to appeal the ruling. In a statement on April 20, the CDC said that an order requiring masking in the indoor transportation corridor remains necessary for the public health. CDC will continue to monitor public health conditions to determine whether such an order remains necessary, it added.

THE FEDERAL GOVERNMENT may have expanded an immigrant visa program that can bring more workers to the U.S. to ease the labor shortage but processing those visas may still be delayed due to a pandemic-related backlog. A group of lawmakers recently wrote a letter to the Department of State urging the agency to bring that processing back to pre-COVID levels. The letter, sent by Reps. Darren Soto, a Florida Democrat, and Peter Meijer, a Michigan Republican, along with 86 other Congress members says visa processing has been slowed by procedures put in place at the beginning of the pandemic but which are no longer needed because testing and vaccines are so readily available. "[Pandemic restrictions] disrupt the reopening of American businesses. According to the U.S. Travel Association, international visitor spending in the U.S. dropped by 76 percent in 2020, leading to the loss of $141 billion and 1.1 million American jobs," the letter said. the letter said. "As international and domestic travel begin to recover, many travel businesses rely on H-2B and J1 visas to meet short-term and seasonal workforce demands that cannot otherwise be filled. With such a significant portion of U.S. visa processing sites fully or partially closed, travel businesses will not have the international visitors or the temporary workers they need to generate a speedy and robust recovery from the COVID-19 pandemic."

OMICRON, THE LATEST COVID-19 variant of concern, led to new restrictions on some international travel over the Thanksgiving weekend. Members of the travel industry are urging federal officials to be cautious, but not to impose bans that they say will not stop the spread of the new variant. On Nov. 26, the World Health Organization issued new guidance on the Omicron variant, which emerged out of South Africa. Researchers are still investigating the variant's transmissibility, severity and the effectiveness of current vaccines against it. "Preliminary evidence suggests there may be an increased risk of reinfection with Omicron (ie, people who have previously had COVID-19 could become reinfected more easily with Omicron)," the WHO said in its statement. "WHO is working with technical partners to understand the potential impact of this variant on our existing countermeasures, including vaccines. Vaccines remain critical to reducing severe disease and death, including against the dominant circulating variant, Delta. Current vaccines remain effective against severe disease and death."

THE U.S. TRAVEL Association and Tourism Diversity Matters formed a new strategic partnership to focus on issues related to diversity, equity and inclusion (DEI), a statement from USTA said. The partnership will provide USTA more access to Tourism Diversity Matters' subject matter expertise, research and resources. Founded in 2021, Tourism Diversity Matters addresses blind spots in ethnic disparities within the tourism and events industries. It will provide these industry leaders with resources and tactics to develop more effective DEI strategies to engage, recruit and retain a diverse workforce. DEI is a core priority of USTA, the association said in a statement, and is committed to having a vital role in affecting lasting change and supporting the development of industry-wide DEI plans. The partnership will advance workforce development issues and federal policy initiatives that support travel's recovery, the statement added. "USTA has a clear vision: in working closely with Tourism Diversity Matters, we aim to help the travel sector achieve a truly diverse, equitable and inclusive industry for all," said Roger Dow, USTA's president and CEO and a board member of Tourism Diversity Matters. "Aligning with Tourism Diversity Matters is a great step toward this pursuit that will enrich USTA's membership for years to come."

AAHOA IS CONTINUING its advocacy efforts with new meetings with members of Congress. On Sept. 27, representatives from the association met with Sen. John Hickenlooper, Democrat from Colorado, in Washington at his Capitol Hill office. Hickenlooper, who sits on both the Small Business Committee and the Senate Commerce Committee, met with AAHOA to discuss Small Business Administration loan limit increases as well as fairness and transparency in the franchise industry, according to AAHOA. In Hickenlooper's home state of Colorado, 39.5 percent of all hotels in the state are owned by AAHOA members, comprising 520 hotels and 55,861 rooms, according to a recent study for AAHOA by Oxford Economics. Those hotels provide $5 billion in wages and other compensation, along with approximately 54,490 direct jobs and 101,000 total impact jobs in the state. They provide $8.5 billion in contribution to the state's GDP, and $2.3 billion in federal, state and local taxes along with $201 million in total lodging taxes.

THE AMERICAN FRANCHISE business model is in trouble, according to a recent survey commissioned by AAHOA. The survey was inspired by a webinar AAHOA co-sponsored to gather public comment on the state of franchising for the Federal Trade Commission. The survey found that only 5 percent of the franchisee respondents are satisfied that their current franchise agreements provide fair terms representing a balanced relationship between themselves and their franchiser. Also, 72.6 percent of respondents would "possibly" or "probably" terminate their current franchised business within the next year if they could do so without penalty. "Franchising is in dire straits unless changes are made," said Laura Lee Blake, AAHOA president and CEO. "Franchising is still a powerful tool for economic mobility for America's small-business owners, including AAHOA Members. But franchising only works when both franchisors and franchisees are committed to its success, which requires transparency, fairness, and sustainable business practices. As this survey shows, there is much room for improvement when it comes to relationships that allow our small-business owners to thrive." Blake recently wrote an editorial supporting AAHOA's 12 Points of Fair Franchising and its promotion of a proposed New Jersey law that would reform that state's franchising regulations in ways similar to the 12 points. Several large hotel companies, including Choice Hotels International and Marriott International, protested AAHOA's recent annual convention in protest to its position on franchise reform The survey was conducted among owners of hotels, restaurants, retail stores and other small businesses that had participated in the FTC webinar. HOSPITALITY INVESTMENT EXECUTIVE Leslie Hale has won the third annual Castell Award instituted by the American Hotel & Lodging Association Foundation, a statement said. The award honors a female trailblazer in the hospitality investment arena who paves the way for more women to rise to the top. The award will be presented at the Lodging Conference on Sept. 20. Hale is the president and CEO of RLJ Lodging Trust and vice chair of the AHLA board of directors, the statement said. She also serves on the board of directors of Macy's, Inc. and Delta Airlines Inc. The female leader is a Howard University Trustee and is a board member of the Federal Reserve Bank of Richmond's Baltimore Branch. "Leslie is the ideal candidate for this important award," said Rosanna Maietta, president and CEO, AHLA Foundation. "Over the years, her dedication to advancing the hospitality industry sets the gold standard for leadership, she has inspired men and women in our industry, and we are thrilled to honor her leadership."

REFORMS TO THE distribution of Small Business Administration loans, a new H2-C visa program and expansion of the Earned Income Tax Credit to benefit hotels were the main topics discussed at AAHOA's recent Fall National Advocacy Conference with legislators in Washington. Days later, AAHOA leadership met with Federal Trade Commission Commissioner Alvaro Bedoya to discuss fair franchising concerns. A day of advocacy AAHOA board members and representatives met with more than 100 agency heads and 40 U.S. senators and representatives in Washington to advocate for these and other causes for the hospitality industry.

AAHOA LEADERS AND members met with the nation's leaders in Washington, D.C., for the association's 2023 Fall National Advocacy Conference on Oct. 24 to 25. Topics covered included Small Business Administration loan limits, the Credit Card Competition Act and the labor shortage. The AAHOA contingent met with more than 200 offices and 70 members of Congress as part of the conference. Keynote speakers for the event were Reps. Beth Van Duyne, Republican from Texas; Rich McCormick, Republican from Georgia; and Shri Thanedar, Democrat from Michigan. "Advocacy at the state, local, and federal level is a pillar upon which AAHOA stands," said Bharat Patel, AAHOA chairman. "Representing such a large portion of the hotel industry, it is through our voice that we strive to shape and fortify policies that help pave the way to our industry's success."

THE DEPARTMENT OF Homeland Security will issue more than 64,000 additional H-2B visas for fiscal year 2024, surpassing a congressionally authorized discretionary cap for the second consecutive year. The American Hotel & Lodging Association, AAHOA and others have been lobbying for the increase as a step to relieving the labor shortage challenge in the hotel industry. A forthcoming interim final rule, which was announced on Friday, will additionally approve temporary work visas, bringing the total to over 130,000 including those issued under the regular annual cap of 66,000. Chip Rogers, AHLA president and CEO, commended the federal government's action. "The H-2B Workforce Coalition, which AHLA co-chairs, worked hard to convince the Biden administration to offer this considerable expansion, which nearly doubles the yearly allocation of H-2B visas," said Rogers. "These extra visas will be crucial to helping hotels and resorts in remote vacation destinations fill seasonal roles, and we thank Homeland Security Secretary Mayorkas for making them available. But we still need help from Congress to get hoteliers across the country all the employees they need. That includes establishing an H-2B returning worker exemption, passing the Asylum Seeker Work Authorization Act, and passing the H-2 Improvements to Relieve Employers (HIRE) Act."

LESLIE HALE, PRESIDENT and CEO of RLJ Lodging Trust, will join Mit Shah, CEO of Noble Investment Group, for the 10th Annual Bharat Shah Leadership Speaker Series at the Hunter Hotel Investment Conference. The Bharat Shah Leadership Speaker Series was established and endowed in honor of Dr. Bharat Shah at Georgia State's Cecil B. Day School of Hospitality Administration, J. Mack Robinson College of Business. The upcoming series is scheduled for March 21, accessible to registered attendees, special guests, and Georgia State University students. Hale is the first African American woman to lead a publicly listed real estate investment trust. She serves on the board of directors for Delta Airlines, is a trustee of Howard University, and is a board member of the Federal Reserve Bank of Richmond. CHOICE HOTELS INTERNATIONAL is accusing the board of directors for Wyndham Hotels & Resorts of not being forthcoming with the company's shareholders regarding Choice's exchange offer to acquire Wyndham. In its counter to the Wyndham board's rejection of the offer, Choice took issue with Wyndham's concerns about getting regulatory approval for the deal and said Wyndham shareholders support the "industrial merits of a transaction." In its original proposal, made public in October, Choice said it sought to acquire all the outstanding shares of Wyndham at a price of $90 per share and shareholders would have received $49.50 in cash and 0.324 shares of Choice common stock for each Wyndham share they own. Choice claimed that is a 30 percent premium to Wyndham's 30-day volume-weighted average closing price ending on Oct. 16, an 11 percent premium to Wyndham's 52-week high, and a 30 percent premium to Wyndham's latest closing price. Wyndham's board unanimously rejected Choice's proposal, calling it unsolicited, "highly conditional" and not in the best interest of shareholders. On Nov. 14, however, Choice sent a letter to the Wyndham board with an "enhanced proposal" intended to address Wyndham's concerns about clearing federal regulations. On Dec. 12, Choice launched its public exchange offer to acquire Wyndham and on Dec. 19 the Wyndham board officially rejected the offer and urged shareholders not to tender shares for the deal.

THE AMERICAN HOTEL and Lodging Association relaunched its "Hospitality is Working" campaign to highlight hotels' commitment to workforce, guests and communities, according to a statement. The campaign aims to reengage travelers and showcase the economic and community benefits hotels provide in neighborhoods across the U.S. As more Americans begin to travel, the initiative will highlight the broad range of benefits hotels provide the communities they serve and point out the industry's strong commitment to investing in its workforce, providing quality career opportunities and protecting employees and guests, AHLA said. "In every American city, hotels support employees and their families and serve our communities," said Chip Rogers, AHLA's president and CEO. "Hotels are investing in our workforce to create good jobs that power local economies. We're keeping guests and employees safe. Six in 10 hotels are small businesses, and they're creating opportunities for other small companies to grow and thrive. Hotels also help fund vital government services through local, state and federal taxes. Hotels are a net benefit to the communities we serve, and as we seek to reignite travel, we look forward to growing together."

TRAVEL INDUSTRY LEADERS are continuing their press of federal officials and the Biden Administration to end pre-departure testing for COVID-19 by vaccinated international air travelers bound for the U.S. This time they went directly to the White House. On May 24, representatives from the U.S. Travel Association and Airlines for America met at the White House to make their case that pre-departure testing is no longer required at this stage in the pandemic. USTA and other organizations have been lobbying the White House persistently for the past few months to take the step, and in May they sent a letter to White House COVID-19 Response Coordinator Dr. Ashish Jha saying the requirement is discouraging international travelers. Roger Dow, USTA president and CEO, reiterated that point after last week's meeting.

MAGNUSON HOTELS HAS added a new hotel to its Magnuson Independent Collection portfolio, the Studios & Suites 4 Less Charlotte, in Charlotte, North Carolina. It is the sixth hotel added to the Independent Collection by owner Ray Patel of Charlotte. The 126-room hotel is near Charlotte Douglas International Airport, The Billy Graham Library, the NASCAR Hall of Fame and the Levine Museum of the New South, according to Magnuson. The new hotel looks to draw a 52-week nonseasonal business base from the regional banking, finance, software, and biotech sectors. Charlotte is also home to the Research Triangle Park, a globally prominent research center with over 170 companies and federal agencies in the U.S. "When Ray Patel called us in 2005, he wanted to build his own brand called Studios & Suites 4 Less, and that is exactly what Ray did," said Thomas Magnuson, CEO of Magnuson Hotels.
