FLORIDA ATTORNEY GENERAL Ashley Moody is targeting fake postings offering vacation rental properties. The state's campaign against these specific scams plays into AAHOA's call for more short-term rental regulation, the association said. The scams involve fake postings offering vacation rental properties with requests for application fees or security deposits, according to Moody's office. Victims of the scam pay the deposit, only to find the listing has disappeared and so has the deposit money. The would-be vacationers often show up at the property and find that the actual owners have no record or intention of renting. "Florida is one of the most popular vacation destinations in the nation," Moody said. "Scammers will take advantage of this by creating fake vacation rental listings in hopes of stealing personal information and money. Whether you are traveling within the state or from out of state, make sure to take extra precautions when renting a vacation home to avoid being burned this summer vacation season."

STAFFING PROBLEMS CONTINUE for 97 percent of American Hotel & Lodging Association members, according to a recent survey. In response, AHLA is expanding its "A Place to Stay" multi-channel advertising campaign to help with recruitment. AHLA's member survey also found that the staffing shortage is severe for 49 percent of respondents. For 58 percent, finding housekeepers is their biggest challenge. Nearly 90 percent of respondents have increased wages to help meet the demand. Also, 71 percent are offering greater flexibility with hours, and 43 percent have expanded benefits. As a result, in the last three months the respondents say they have hired an additional 23 new employees per property, but are also trying to fill an additional 12 positions. Still, 97 percent say they have been unable to fill open positions. "If you've ever thought about working at a hotel, now's the time because the pay is better than it's ever been, the benefits are better than they've ever been, and the opportunity is better than it's ever been," said Chip Rogers, AHLA president and CEO.

A BALLOT MEASURE in Los Angeles that would have required hotels in the city to house the homeless along with paying guests has been officially withdrawn from consideration. However, the Los Angeles City Council also passed an ordinance to replace the ballot measure that some local hoteliers also protest its passage. The ballot measure, sponsored by Unite Here Local 11 hospitality workers union, would have required hotels to house homeless voucher holders with regular guests, spurring protests by AAHOA, the American Hotel & Lodging Association and others. Last week, Unite Here agreed to withdraw that ballot measure, which was going to go before voters in March. Also last week, the council approved the Responsible Hotel Ordinance to replace the ballot measure and that would allow hotels to voluntarily make vacant rooms available for interim housing for the homeless. It also would require developers of new hotel properties to obtain a conditional use permit through a public review of the proposed development's impact on the existing housing supply and to replace any housing that would be demolished or otherwise lost in the neighborhood.

THE HOLIDAY INN Express in LaPlace, Louisiana, reopened on Jan. 17, after the owner, QHotels Management in LaPlace led by Vimal Patel, completed $5 million in repairs to damage form Hurricane Ida in September. The repairs were slowed by his insurance company's failure to pay for the work in a timely manner, Patel said. The situation also is affecting Patel's ability to repair and reopen other properties in the area. "We had to use our own line of credit, to finish the hotel," Patel said. "Five more hotels to go. They are still a work in progress. A couple of hotels will open probably next month and then a couple probably will open in sometime in April. And the last hotel will probably take some time, so maybe May or June before we can open it up." The 91-room Holiday Inn Express is near Cajun Pride Swamp Tours, The Choice Hall, YMC EVENTS Venue and the Dream Event Center.

U.S. HOTELS WILL generate $46.71 billion in state and local tax revenue, more than ever before, according to a survey from the American Hotel & Lodging Association and Oxford Economics. Occupancy is expected to continue its recovery, the report said, but challenges remain. "To continue growing, we need to hire more people. Fortunately, there's never been a better time to be a hotel employee, with wages, benefits, flexibility and upward mobility better than ever before."

SPONSORS AND SUPPORTERS of the proposed Richard L. Trumka Protecting the Right to Organize Act of 2023 say it is needed to protect the rights of workers to organize under labor unions. However, the American Hotel & Lodging Association and others claim the PRO Act puts an undue burden on small businesses, including hotels. The PRO Act would authorize penalties against employers that interfere with employees' efforts to organize, according to Democratic Rep. Robert "Bobby" Scott of Virginia, one of the co-sponsors of the bill. Also, the bill would facilitate collective bargaining agreements, close loopholes that allow employers to misclassify employees as supervisors and independent contractors. Other aspects of the PRO Act include protection for employees that experience retaliation for trying to organize a union, ensures that workers can collect "fair share" fees and authorizes a private right of action for violation of workers' rights. It also prevents employers from interfering in union elections or holding captive audience meetings. "Regrettably, for too long, workers have suffered from anti-union attacks and toothless labor laws that undermined their right to form a union," Scott said. "As a historic number of Americans put their support behind labor unions, Congress has an urgent responsibility to ensure that workers can join a union and negotiate for higher pay, better benefits, and safer workplaces."

GEORGIA HOTELIER NAVIN Patel has contracted with Hospitality Ventures Management Group to manage his 111-room boutique Darwin Hotel in Atlanta. HVMG oversaw the complete rebranding and renovation of the hotel. The four-story Darwin is in Atlanta's Old Fourth Ward and features eight individually themed suites and a lobby that displays a collection of local art. THE U.S. DEPARTMENT of Labor's definition of who qualifies as independent contractors, due to take effect in March, is meant to ensure that workers are treated fairly, according to the department. However, the American Hotel & Lodging Association says the new rule limits independent contractors to work and impact hotels' ability to find workers. The new rule under the Fair Labor Standards Act aims to prevent misclassification of workers that can affect workers' rights to minimum wage and overtime pay, "facilitates wage theft, allows some employers to undercut their law-abiding competition and hurts the economy at-large," the Labor Department said in a statement. It uses a multifactor analysis of six factors defining a worker's relationship with an employer, such as the worker's opportunities for profit or loss; the financial stake and nature of any resources a worker has invested in the work; the degree of permanence of the work relationship; the degree of control an employer has over the individual's work; how essential the work is to the employer's business; and the worker's skill and initiative.

PINAL PATEL WAS elected secretary of AAHOA in the culmination of 2024 AAHOA Convention & Trade Show held this week in Orlando. New members of the association's board of directors also were elected and new industry partners were announced. Pinal, of Goodlettsville, Tennessee, defeated H.K. "Hare Krishna" Patel for the secretary position. He was born in Bardoli, India, and his family moved to the U.S. in 1984 when he was 2, according to AAHOA. They lived in Nashville, Tennessee, Pinal said his parents did not speak any English when they brought him and his 1-year-old brother to America. Pinal's parents bought their first independent hotel in 1991, and he is a second-generation hotelier even after graduating flight school at Embry Riddle in Daytona Beach, Florida, before buying his first franchise property. Previously, he has served as an AAHOA ambassador and as AAHOA's director at large Eastern Division. "Hard work definitely pays off," Patel said. "I'm going to make sure we do what's right for the association and for the members. I promise to all my supporters, my family, and my fellow members that I will not let you down. I will do what's best for the association's interests."

Average hotel occupancy is expected to reach nearly 63.6 percent in 2024, a slight increase from the 62.9 percent in 2023 but below the 65.8 percent rate recorded in 2019. Nominal RevPAR is also anticipated to rise to $101.82 in 2024, up by 4 percent from 2023 and over 17 percent from 2019.
