The bank, the biggest U.S. lender by assets, has entered into a deferred prosecution agreement with the DOJ that will expire in three years if the firm satisfies its obligations under the deal. 

As manufacturing plummets to the weakest levels since September 2009 and new export orders collapse, the US railroad industry has jus seen carload volumes tumble to three-year lows, according to a weekly report from the Association of American Railroads (AAR), first reported by Bloomberg on Monday.  AAR's report showed a decline in carloads for 3Q19, down 5.5%, and one of the most significant drops in three years, indicating that the US economy continues to decelerate into year-end. Most of the shipment declines were seen in autos, coal, grain, chemicals, and consumer goods, but there was a small improvement in crude oil shipments.

After President Trump signed two sweeping executive orders on immigration on Wednesday, most of the attention was on his plans to build a wall along the border with Mexico and to hold back money from “sanctuary cities.” But the most immediate effect may come from language about deportation priorities that is tucked into the border wall order. It offers an expansive definition of who is considered a criminal — a category of people Mr. Trump has said he would target for deportation. Immigration agents will now have wider latitude to enforce federal laws and are being encouraged to deport broad swaths of unauthorized immigrants.

Each presidential administration must decide who it considers a priority for deportation. Mr. Trump’s order focuses on anyone who has been charged with a criminal offense, even if it has not led to a conviction. He also includes, according to language in the order, anyone who has “committed acts that constitute a chargeable criminal offense,” meaning anyone the authorities believe has broken any type of law — regardless of whether that person has been charged with a crime.Mr. Trump’s order also includes anyone who has engaged in “fraud or willful misrepresentation in connection with any official matter or application before a governmental agency,” a category that includes anyone who has used a false Social Security number to obtain a job, as many unauthorized immigrants do. Anyone who has received a final order to leave the country, but has not left, is also considered a priority.Finally, he allows the targeting of anyone who “in the judgment of an immigration officer” poses a risk to either public safety or national security. That gives immigration officers the broad authority they have been pressing for, and no longer requires them to receive a review from a supervisor before targeting individuals.

The order defines criminal loosely, and includes anyone who has crossed the border illegally — which is a criminal misdemeanor. Anyone who has abused any public benefits program is also considered a criminal under the order.The Obama administration, which deported nearly 400,000 people per year during its first five years, initially included those convicted of minor offenses such as shoplifting. But it later changed its policy to target primarily those who had been convicted of serious crimes, were considered national security threats or were recent arrivals. By the end of President Barack Obama’s time in office, around 90 percent of the country’s 11 million undocumented immigrants were not considered a priority for deportation. According to the Migration Policy Institute, a nonpartisan think tank, roughly 820,000 undocumented immigrants currently have a criminal record.

Israel’s three largest banks — Hapoalim Bank, Leumi Bank and Mizrahi Tefahot Bank — have all been ordered to pay record fines, which collectively are set to total over $1 billion, to the U.S. government after the banks were found to have actively colluded with thousands of wealthy Americans in massive tax-evasion schemes.

Despite the Trump administration’s “maximum pressure” campaign targeting the Iranian economy, Iran’s crude oil and oil product revenues jumped a surprising 60 percent from March 21 to July 23. In addition, figures provided by Iran’s Central Bank show that Iran’s revenues from oil sales soared by 84.2 percent over that same period, setting a new record. The increased revenues seem to have resulted from a jump in oil prices this year as well as Iran’s high oil export volume during part of that period. Notably, the increased revenues were reported despite the United States’ announcement in May that it would sanction those purchasing Iranian oil starting in early November, with the ultimate goal of reducing Iranian oil sales to zero in order to place pressure on the Iranian government

Further dashing U.S. hopes of crushing Iranian oil exports have been recent announcements from Iran’s top two customers, China and India, that they would continue to import Iranian crude despite the looming threat of U.S. sanctions. India, along with some other countries, has sought “waivers” from Washington that would allow them to continue to import Iranian oil and avoid retaliation from the U.S. for a certain period of time. In addition, the European Union, which had previously joined the U.S. in targeting Iranian oil exports in 2012, has shown its unwillingness to follow Washington’s lead this time around, openly vowing to rebel against the U.S. sanctions regimen and increasing the likelihood that Europe will continue to buy some Iranian oil despite U.S. threats.

Another indication that efforts to curb Iranian oil exports are backfiring for the Trump administration is the jump in oil prices that has resulted from concerns about the U.S. sanctions on Iran’s oil exports. The increase in oil prices is likely to be felt domestically in the U.S., the world’s largest consumer of oil, potentially posing a political risk to Trump and his fellow Republicans ahead of the November 6 midterm elections.  In addition, further oil price increases could trigger a slowdown in domestic or global economic growth, which could further complicate the U.S.’ Iran policy and Trump’s domestic political situation.

During a speech delivered on Tuesday to the United Nations Security Council, Syria’s Permanent UN Representative Bashir al-Jaafari claimed to have provided information to the council that was evidence that armed opposition groups, including Al Qaeda affiliate al-Nusra Front, were gearing up to use chemical weapons against civilians in the Syrian province of Idlib in an effort to frame the Syrian government for the attack. Jaafari’s warning comes as Syria and its allies are preparing for a major military offensive that would target the rebel-held Idlib province, which even mainstream Western outlets admit is dominated by terrorist groups and their affiliates. Speaking to the council, Jaafari stated:

I put in your hands documented information on the preparations taken by Jabhat al-Nusra [al-Nusra Front] terrorist organization and the affiliated groups to use the chemical weapons against civilians in Idlib province to accuse the Syrian Arab Army and to justify any aggression that might be launched on Syria.” He added that eight canisters of chlorine had been transported to Halouz village in Idlib. The evidence Jaafari provided to the Security Council regarding an imminent “false flag” attack has not been made public. Jaafari’s mention of chlorine gas being transported into Idlib follows similar warnings from Russia’s Defense Ministry, which warned in a statement on Tuesday that “a large supply of poisonous [chemical] agents has been brought to the city of Saraqib on two trucks from the village of Afs” and that the deadly cargo has been “accompanied by eight members of the White Helmets organization” and received by two high-ranking Ahrar al-Sham commanders. Ahrar al-Sham has long been a battlefield ally of al-Nusra Front and The New York Times wrote in 2015 that its membership included associates of Osama bin Laden. In addition, the White Helmets group, which receives millions in funding from Western governments, has repeatedly been linked to falsifying evidence of both bombings and chemical weapon attacks in order to facilitate Western military intervention in the Syrian conflict. The Russian military added that a part of the load was later put into “unmarked plastic barrels and transported to another militant base in southern Idlib in order to stage the use of chemical weapons.” It is currently unclear if the area of southern Idlib cited in this statement coincided with Jaafari’s statements that chlorine gas canisters had been delivered to Halouz village in Idlib with this intent.

Warnings from Syria’s UN representative and the Russian military follow hawkish statements recently made by members of the Trump administration, particularly National Security Advisor John Bolton, who stated last Wednesday that the U.S. would respond “very strongly” if the Syrian government is accused of chemical weapons use in Idlib. Bolton, speaking to reporters in Jerusalem, also boasted of the U.S.’ past responses to alleged Syrian government involvement in chemical weapons attacks on Syrian civilians this April and in April of last year.

A federal judge on Thursday ordered the release of an independent monitor’s review of HSBC’s internal cleanup after a landmark $1.92 billion settlement for laundering drug money and for sanctions violations. The U.S. Justice Department and the bank had claimed that disclosing the report could harm law enforcement efforts and provide criminals with a “road map” to holes in HSBC’s defenses against money laundering. But U.S. District Judge John Gleeson ruled that the court and the public had a right to know whether HSBC was living up to its agreement to improve internal controls and merited a deferral of prosecution by the government.

Gleeson also said it was “equally appropriate and desirable for the public to be interested and informed now in the progress” of the HSBC settlement. HSBC in 2012 reached a landmark settlement with the federal government, admitting that it had deliberately laundered funds for drug cartels and countries under trade sanctions. Prosecutors described the settlement as a “sword of Damocles” hanging over HSBC. Should the bank fail to improve, it would face prosecution for unbridled financial wrongdoing. A condition of the settlement was that the bank submit to extensive outside review of its reform efforts. The former New York State ethics chief Michael G. Cherkasky was appointed as the HSBC monitor in 2013. A leaked copy of his report recounted instances of U.S. bank managers bullying and shouting at compliance team members, and drew attention to the bank’s dealings with clients that had possible links to terrorism, according to Bloomberg.

The Argentinian authorities are wondering about the massive purchase of land in Patagonia by a British billionaire, and the « holidays » that tens of thousands of Israëli soldiers are enjoying on his property.

In the 21st century, benefitting from the advantages offered them by the Falklands War Treaty, the United Kingdom and Israël are now setting up a new project Patagonia. British billionaire Joe Lewis has acquired immense territories in the South of Argentina and even neighbouring Chile. His properties cover areas several times larger than the State of Israël. They are situated in Tierra del Fuego, at the extreme Southern point of the continent. In particular, they surround the Lago Escondido, which effectively denies access to the entire region, despite a legal injunction. The billionaire has built a private airport with a two kilometre landing strip, in order to be able to receive civil and military aircraft. Since the Falklands War, the Israëli army has been organising « holiday camps » (sic) in Patagonia for its soldiers. Between 8,000 and 10,000 of them now come every year to spend two weeks on Joe Lewis’ land. While in the 1970’s, the Argentinian army noted the construction of 25,000 empty houses, which gave rise to the myth of the Andinia Plan, hundreds of thousands have been built today.

It is impossible for the moment to determine if Israël is engaged in a programme for the exploitation of Antarctica, or if it is building a rear base in case of defeat in Palestine.

African central bank leaders are currently discussing whether to hold the yuan as part of their foreign reserves, highlighting the Chinese money’s rise as one of the world’s major reserve currencies. Government officials from 14 African nations in eastern and southern Africa are meeting today (May 29) in the Zimbabwean capital Harare to discuss sovereign reserve management, according to a report from the official China press agency Xinhua. The forum is being held by the Macroeconomic and Financial Management Institute of Eastern and Southern Africa (MEFMI), a regional establishment with members including Angola, Kenya, Tanzania, Zambia, and Tanzania. Besides strategizing on how to improve the weakened external positions of member nations during the global economic downturn, policymakers will also debate how to keep pace with large shifts in the global economy, where China has risen as a dominant and disruptive player. “Most countries in the MEFMI region have loans or grants from China and it would only make economic sense to repay in renminbi (Chinese yuan),” MEFMI spokesperson Gladys Siwela-Jadagu said. “With China as the largest trading partner of over 130 countries, the main challenge for African countries is how to benefit from the new pattern of international commerce,” she added.

The move underscores China’s push to internationalize its currency in order to promote trade and investment, besides boosting its soft power. This is especially true in the era of Xi Jinping whose extended rule and assertive governance are set to reshape the country’s diplomatic, military, and economic place in coming years. The move is also indicative of China’s emergence as a greater power willing to fill in a financial gap, especially in the isolationist post-Brexit and “America first” era.

After a US federal judge in New York ordered Iran to pay billions of dollars to the families of victims of the September 11 terror attacks earlier this month in a largely symbolic default judgement, Iran is reportedly prepping to sue Washington for terror attacks carried out against Tehran within the last year. Iran says the US is responsible for the rise of ISIS, and is therefore indirectly to blame for twin terror attacks that rocked the Iranian parliament building and a popular religious shrine in June 2017, which left 17 civilians dead and 43 wounded, according to Iranian media figures.

That brings us back to Gina Haspel. I have no doubt that she considers herself to be a patriot, as her supporters do. But that’s not the issue here. The issue is respect for the rule of law. Since the end of World War II, we have had laws in this country that specifically ban exactly those torture techniques implemented and overseen by Gina Haspel at a secret prison overseas. And the United States is a signatory to the United Nations Convention Against Torture. Indeed, we were the primary drafters of that measure, which, having been ratified by the Senate, has the force of law in the United States. If Gina Haspel had any doubts about her “orders” from the CIA hierarchy, she had only to look at recent history. Just after the end of World War II, the United States executed Japanese soldiers who had waterboarded American prisoners of war. Similarly, in January 1968, the Washington Post published a front-page photo of an American soldier waterboarding a North Vietnamese prisoner. Secretary of Defense Robert McNamara ordered an investigation. The soldier was arrested, charged with torture, convicted, and sentenced to 20 years at Leavenworth. Torture was illegal in 1946. It was illegal in 1968. And it was illegal in 2002, no matter what Bush Justice Department officials John Yoo and Jay Bybee said. The law was clear.

Former President Barack Obama’s national security adviser Susan Rice ordered U.S. spy agencies to produce “detailed spreadsheets” of legal phone calls involving Donald Trump and his aides when he was running for president, according to former U.S. Attorney Joseph diGenova. “What was produced by the intelligence community at the request of Ms. Rice were detailed spreadsheets of intercepted phone calls with unmasked Trump associates in perfectly legal conversations with individuals,” diGenova told The Daily Caller News Foundation Investigative Group Monday. “The overheard conversations involved no illegal activity by anybody of the Trump associates, or anyone they were speaking with,” diGenova said. “In short, the only apparent illegal activity was the unmasking of the people in the calls.”

Other official sources with direct knowledge and who requested anonymity confirmed to TheDCNF diGenova’s description of surveillance reports Rice ordered one year before the 2016 presidential election. Also on Monday, Fox News and Bloomberg News, citing multiple sources reported that Rice had requested the intelligence information that was produced in a highly organized operation. Fox said the unmasked names of Trump aides were given to officials at the National Security Council (NSC), the Department of Defense, James Clapper, President Obama’s Director of National Intelligence, and John Brennan, Obama’s CIA Director. Joining Rice in the alleged White House operations was her deputy Ben Rhodes, according to Fox. Critics of the atmosphere prevailing throughout the Obama administration’s last year in office point to former Obama Deputy Defense Secretary Evelyn Farkas who admitted in a March 2 television interview on MSNBC that she “was urging my former colleagues,” to “get as much information as you can, get as much intelligence as you can, before President Obama leaves the administration.”

Michael Doran, former NSC senior director, told TheDCNF Monday that “somebody blew a hole in the wall between national security secrets and partisan politics.” This “was a stream of information that was supposed to be hermetically sealed from politics and the Obama administration found a way to blow a hole in that wall,” he said.

Judicial Watch today released 1,606 pages of documents from the U.S. Department of State revealing repeated use of unsecured communications for classified information and numerous examples of Clinton Foundation donors receiving special favors from former Secretary of State Hillary Clinton’s staff. The documents, containing emails from the unsecure, non-government account of Huma Abedin, Clinton’s then-deputy chief of staff, also show Clinton or her staff expressing interest in visiting Venezuelan dictator Hugo Chavez and North Korean dictator Kim Jung II. The documents included 91 Clinton email exchanges not previously turned over to the State Department, bringing the known total to date to at least 530 emails that were not part of the 55,000 pages of emails that Clinton turned over to the State Department, and further contradicting a statement by Clinton that, “as far as she knew,” all of her government emails had been turned over to the State Department. The documents were obtained in response to a court order from a May 5, 2015, lawsuit filed against the State Department (Judicial Watch, Inc. v. U.S. Department of State (No. 1:15-cv-00684)) after it failed to respond to a March 18, 2015, Freedom of Information Act (FOIA) request seeking: “All emails of official State Department business received or sent by former Deputy Chief of Staff Huma Abedin from January 1, 2009 through February 1, 2013 using a non-‘state.gov’ email address.”

The United States on Monday warned it was ready to act in Syria if needed to end chemical attacks and “inhuman suffering” as it pushed for a new 30-day ceasefire in Eastern Ghouta at the United Nations Security Council The US ambassador [Nikki Haley] recalled that President Donald Trump had ordered missile strikes on a Syrian air base in April last year in retaliation for a sarin gas attack blamed on President Bashar al-Assad’s forces.

“We also warn any nation that is determined to impose its will through chemical attacks and inhuman suffering, most especially the outlaw Syrian regime: the United States remains prepared to act if we must,” Haley said. The Russian military at least is taking the threat seriously. The chief of Russia’s armed forces has issued a warning of his own: Moscow is ready to respond if lives of the Russian servicemen are endangered, including by strikes on Damascus, head of Russia’s General Staff Valery Gerasimov said. “There are many Russian advisers, representatives of the Russian Center for Reconciliation of Opposing Sides and [Russian] servicemen in Damascus and at Syrian defense facilities,” Gerasimov stated. In case lives of Russian military personnel are put in danger, the Russian Armed Forces will respond with certain measure to both “missiles” and “lauchers” which are delivering these projectiles.

What Gerasimov is saying here is two-fold: Any strikes in and around Damascus would almost certainly endanger Russian military personnel. If that were to happen, the Russian military will take measures against any missiles, and also against launch vehicles delivering the payload. Meaning, the Russians won’t be passively absorbing US strikes. Instead they will use their potent anti-air defenses, including against any manned aircraft.

Top Russian officials have threatened to retaliate with force if President Donald Trump orders an attack that could endanger the lives of its soldiers stationed there in support of Syrian President Bashar al-Assad’s campaign against rebels and jihadis near Damascus.Army General Valery Gerasimov warned on Tuesday that the U.S. was preparing to launch raids against Moscow’s ally, the Syrian government, as it attempted to clear the pockets of insurgents—some of which were once backed by the West—in the suburbs of the capital city of Damascus. Gerasimov, who acted as chief of Russia’s general staff and deputy defense minister, claimed that the U.S. would strike under the false pretense of a chemical weapon attack—a tactic that Russia has denied the Syrian military utilizes—and vowed to fight back.

“In the event of a threat to our military servicemen’s lives, Russia’s armed forces will take retaliatory measures to target both the missiles and their delivery vehicles,” Gerasimov said, according to the state-run Tass Russian News Agency.

Last Sunday, the largest joint military exercise between the United States and Israel began with little fanfare. The war game, dubbed “Operation Juniper Cobra,” has been a regular occurrence for years, though it has consistently grown in size and scope. Now, however, this year’s 12-day exercise brings a portent of conflict unlike those of its predecessors.

Israel has also been preparing for a conflict on the embattled Gaza strip, which – owing to the effects of Israel’s illegal blockade and the devastation wrought by past wars – is set to be entirely uninhabitable by 2020. Reports have quoted officials of the Palestinian resistance group Hamas, which governs the Gaza strip, as saying that they place the chances of a new war with Israel in 2018 “at 95 percent” and that war games, like Operation Juniper Cobra, were likely to be used to plan or even initiate such a conflict. This concern was echoed by IDF Chief of Staff Gadi Eizenkot, who stated that another Israeli invasion of Gaza, home to 1.8 million people, was “likely” to occur this year. Eizenkot ironically framed the imminent invasion as a way to “prevent a humanitarian collapse” in Gaza.

However, this year’s “Juniper Cobra” is unique for several reasons. The Post reported on Thursday that the drill, set to end on March 15, was not only the largest joint U.S.-Israeli air defense exercise to ever happen but it was also simulating a battle “on three fronts.” In other words, Israel and the U.S. are jointly simulating a war with Lebanon, Syria, and Palestine – namely, the Gaza strip – simultaneously. What makes this last part so concerning are Israel’s recent statements and other preparations for war with all three nations, making “Juniper Cobra” anything but a “routine” drill. It is instead yet another preparation for a massive regional conflict, suggesting that such a conflict could be only a matter of months away.

In another sign that the field of zero emission transportation is accelerating, the company Nikola has announced plans to build a new truck factory in Arizona. These aren’t pick-ups or other light duty vehicles. The company’s Nikola 1 model is built for long hauls and heavy loads, with an electric drive train powered by a hydrogen fuel cell system.With plans for the new factory firming up, it looks like Nikola’s plan for hydrogen long haul trucking is on the road to realization. It’s also another sign that the trucking industry is slowly beginning to abandon the idea of “clean diesel” for a more sustainable future.Nikola’s Hydrogen Fuel Cell Electric TruckThe latest announcement is certainly good news for Arizona. The new factory, located near Phoenix in the town of Buckeye, is expected to create 2,000 jobs and stimulate capital investment to the tune of $1 billion within the next six years or so.The news is also bad for Utah, which is losing Nikola’s current headquarters. The company plans to transfer its R&D work to Arizona as well as building trucks there.The company already has 8,000 trucks on pre-order, and so far it looks like everything is on track to have the factory up and running within two years.

ECCHR’s legal intervention filed with the German Federal Public Prosecutor (Generalbundesanwalt – GBA) is aimed at securing an arrest warrant for CIA Deputy Director Gina Haspel. Haspel was appointed to the post by President Donald Trump in February 2017. The information submitted to the GBA by ECCHR on 6 June 2017 documents Haspel’s role in the torture of detainees in 2002 at a secret CIA prison in Thailand. In the dossier, ECCHR argues that Haspel oversaw the daily torture of detainees at the black site in 2002 and failed to do anything to stop it.  “Those who commit, order or allow torture should be brought before a court – this is especially true for senior officials from powerful nations,” said ECCHR’s General Secretary Wolfgang Kaleck. “The prosecutor must, under the principle of universal jurisdiction, open investigations, secure evidence and seek an arrest warrant. If the deputy director travels to Germany or Europe, she must be arrested.”

The new CIA director Gina Haspel is well known for actively directing and participating in the torture of prisoners at 'black sites': Beyond all that, she played a vital role in the destruction of interrogation videotapes that showed the torture of detainees both at the black site she ran and other secret agency locations. The concealment of those interrogation tapes, which violated multiple court orders as well as the demands of the 9/11 commission and the advice of White House lawyers, was condemned as “obstruction” by commission chairs Lee Hamilton and Thomas Keane. Haspel would be in jail if former president Barack Obama had not decided against prosecuting the CIA torture crimes. Torturing prisoners is a war crime. Obstruction of courts and destruction of evidence are likewise crimes.
