What was supposed to be a single agency with a dual mission -- protecting the security of U.S. communications and eavesdropping on the communications of our enemies -- has become unbalanced in the post-Cold War, all-terrorism-all-the-time era. Putting the U.S. Cyber Command, the military's cyberwar wing, in the same location and under the same commander, expanded the NSA's power. The result is an agency that prioritizes intelligence gathering over security, and that's increasingly putting us all at risk. It's time we thought about breaking up the National Security Agency. Broadly speaking, three types of NSA surveillance programs were exposed by the documents released by Edward Snowden. And while the media tends to lump them together, understanding their differences is critical to understanding how to divide up the NSA's missions.

It's what Director of National Intelligence James R. Clapper meant when he lied to Congress. When asked, "Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?" he replied, "No sir, not wittingly." To him, the definition of "collect" requires that a human look at it.   • The NSA’s spying on everyone’s metadata can tell them just about everything about us … and it violates our Constitutional right to freedom of association. But people are getting distracted from the big picture by focusing on metadata. As security expert Bruce Schneier wrote yesterday: What frustrates me about all of this — [the Privacy and Civil Liberties Oversight Board] report, the president’s speech, and so many other things — is that they focus on the bulk collection of cell phone call records. There’s so much more bulk collection going on — phone calls, e-mails, address books, buddy lists, text messages, cell phone location data, financial documents, calendars, [smartphone apps] etc. — and we really need legislation and court opinions on it all. But because cell phone call records were the first disclosure, they’re what gets the attention. Indeed, Schneier confirmed last October what we’ve been saying for years … don’t get too distracted by the details, because the government is spying on everything:

New details about hows and whys will continue to emerge …but the big picture will remain the same. He’s right. So what should we make of the government’s denials that it records content?     Personally, I don't think the focus is on metadata because it was the first target exposed. I see it more as a propaganda weapon to divert attention from the other NSA targets.  In any event, this page offers a very comprehensive list of the types of data the NSA is collecting, with links to further information on each type.

One of the documents, a presentation titled "Tor Stinks," bluntly acknowledges how effective the tool is: "We will never be able to de-anonymize all Tor users all the time. With manual analysis we can de-anonymize a very small fraction of Tor users, however, no success de-anonymizing a user in response to a TOPI request/on demand." (Other documents: presentation 1, presentation 2.) The NSA is able to extract information sometimes, though, and Bruce Schneier details what we know of that process in an article of his own. "The NSA creates 'fingerprints' that detect http requests from the Tor network to particular servers. These fingerprints are loaded into NSA database systems like XKeyscore, a bespoke collection and analysis tool which NSA boasts allows its analysts to see "almost everything" a target does on the internet. ... After identifying an individual Tor user on the internet, the NSA uses its network of secret internet servers to redirect those users to another set of secret internet servers, with the codename FoxAcid, to infect the user's computer. FoxAcid is an NSA system designed to act as a matchmaker between potential targets and attacks developed by the NSA, giving the agency opportunity to launch prepared attacks against their systems." Schneier explains in a related article why it's important that we figure out exactly what the NSA is doing. "Given how inept the NSA was at protecting its own secrets, it's extremely unlikely that Edward Snowden was the first sysadmin contractor to walk out the door with a boatload of them. And the previous leakers could have easily been working for a foreign government."

Secret to Prism program: Even bigger data seizure - 0 views

  • The revelation of Prism this month by the Washington Post and Guardian newspapers has touched off the latest round in a decade-long debate over what limits to impose on government eavesdropping, which the Obama administration says is essential to keep the nation safe. But interviews with more than a dozen current and former government and technology officials and outside experts show that, while Prism has attracted the recent attention, the program actually is a relatively small part of a much more expansive and intrusive eavesdropping effort. Americans who disapprove of the government reading their emails have more to worry about from a different and larger NSA effort that snatches data as it passes through the fiber optic cables that make up the Internet's backbone. That program, which has been known for years, copies Internet traffic as it enters and leaves the United States, then routes it to the NSA for analysis.
  • Whether by clever choice or coincidence, Prism appears to do what its name suggests. Like a triangular piece of glass, Prism takes large beams of data and helps the government find discrete, manageable strands of information. The fact that it is productive is not surprising; documents show it is one of the major sources for what ends up in the president's daily briefing. Prism makes sense of the cacophony of the Internet's raw feed. It provides the government with names, addresses, conversation histories and entire archives of email inboxes.
  • The NSA is prohibited from spying on Americans or anyone inside the United States. That's the FBI's job and it requires a warrant. Despite that prohibition, shortly after the Sept. 11 terrorist attacks, President George W. "You have to assume everything is being collected," said Bruce Schneier, who has been studying and writing about cryptography and computer security for two decades. The New York Times disclosed the existence of this effort in 2005. In 2006, former AT&T technician Mark Klein revealed that the company had allowed the NSA to install a computer at its San Francisco switching center, a key hub for fiber optic cables.

  • Many of the people interviewed for this report insisted on anonymity because they were not authorized to publicly discuss a classified, continuing effort. But those interviews, along with public statements and the few public documents available, show there are two vital components to Prism's success. The first is how the government works closely with the companies that keep people perpetually connected to each other and the world. That story line has attracted the most attention so far. The second and far murkier one is how Prism fits into a larger U.S. wiretapping program in place for years.
  • The government has said it minimizes all conversations and emails involving Americans. Exactly what that means remains classified. But former U.S. officials familiar with the process say it allows the government to keep the information as long as it is labeled as belonging to an American and stored in a special, restricted part of a computer. That means Americans' personal emails can live in government computers, but analysts can't access, read or listen to them unless the emails become relevant to a national security investigation. The government doesn't automatically delete the data, officials said, because an email or phone conversation that seems innocuous today might be significant a year from now. What's unclear to the public is how long the government keeps the data. That is significant because the U.S. someday will have a new enemy. Two decades from now, the government could have a trove of American emails and phone records it can tap to investigative whatever Congress declares a threat to national security.
  • The Bush administration shut down its warrantless wiretapping program in 2007 but endorsed a new law, the Protect America Act, which allowed the wiretapping to continue with changes: The NSA generally would have to explain its techniques and targets to a secret court in Washington, but individual warrants would not be required. Congress approved it, with Sen. Barack Obama, D-Ill., in the midst of a campaign for president, voting against it.

"I cannot think of anything, outside of a face-to-face conversation, that they could not have access to."
  • When the Protect America Act made warrantless wiretapping legal, lawyers and executives at major technology companies knew what was about to happen.
  • For years, the companies had been handling requests from the FBI. Now Congress had given the NSA the authority to take information without warrants. Though the companies didn't know it, the passage of the Protect America Act gave birth to a top-secret NSA program, officially called US-98XN. It was known as Prism. Though many details are still unknown, it worked like this:
  • Facebook said it received between 9,000 and 10,000 requests for data from all government agencies in the second half of last year. The social media company said fewer than 19,000 users were targeted.
  • Every company involved denied the most sensational assertion in the Prism documents: that the NSA pulled data "directly from the servers" of Microsoft, Yahoo, Google, Facebook, AOL and more. Technology experts and a former government official say that phrasing, taken from a PowerPoint slide describing the program, was likely meant to differentiate Prism's neatly organized, company-provided data from the unstructured information snatched out of the Internet's major pipelines. In slide made public by the newspapers, NSA analysts were encouraged to use data coming from both Prism and from the fiber-optic cables. Prism, as its name suggests, helps narrow and focus the stream. If eavesdroppers spot a suspicious email among the torrent of data pouring into the United States, analysts can use information from Internet companies to pinpoint the user. With Prism, the government gets a user's entire email inbox. Every email, including contacts with American citizens, becomes government property. Once the NSA has an inbox, it can search its huge archives for information about everyone with whom the target communicated. All those people can be investigated, too.
  • What followed was the most significant debate over domestic surveillance since the 1975 Church Committee, a special Senate committee led by Sen. Frank Church, D-Idaho, reined in the CIA and FBI for spying on Americans. Unlike the recent debate over Prism, however, there were no visual aids, no easy-to-follow charts explaining that the government was sweeping up millions of emails and listening to phone calls of people accused of no wrongdoing.
  • A few months after Obama took office in 2009, the surveillance debate reignited in Congress because the NSA had crossed the line. Eavesdroppers, it turned out, had been using their warrantless wiretap authority to intercept far more emails and phone calls of Americans than they were supposed to. Obama, no longer opposed to the wiretapping, made unspecified changes to the process. The government said the problems were fixed.

The NSA cannot insulate this program from Fourth Amendment scrutiny simply by promising that Americans’ private information will be safe in its hands. The Fourth Amendment exists to prevent the government from acquiring Americans’ private papers and communications in the first place. Because the metadata program vacuums up sensitive information about associational and expressive activity, it is also unconstitutional under the First Amendment. The Supreme Court has recognized that the government’s surveillance and investigatory activities have an acute potential to stifle association and expression protected by the First Amendment.

    Incredible must read article by Bruce Schneier, author of "Liars and Outliers: Enabling the Trust Society Needs to Thrive." Bruce makes the argument that the Government and big Corporations are locked in a parasitical symbiotic relationship, with the citizen being the host they feed on.   He argues that modern citizens need Internet communications and data services.  The corporate service providers need to "collect" massive amounts of citizen data to further their profit models. So the corporations need continuing government consent to use the personal citizen information.  The government seeks to control citizens, and needs access to the personal information the corporations are collecting.  The mutually beneficial symbiosis is formed.  One that will prove very difficult for citizens to turn back. Great piece of thinking!!!  Must read.

  • (Reuters) - As a key part of a campaign to embed encryption software that it could crack into widely used computer products, the U.S. National Security Agency arranged a secret $10 million contract with RSA, one of the most influential firms in the computer security industry, Reuters has learned. Documents leaked by former NSA contractor Edward Snowden show that the NSA created and promulgated a flawed formula for generating random numbers to create a "back door" in encryption products, the New York Times reported in September. Reuters later reported that RSA became the most important distributor of that formula by rolling it into a software tool called Bsafe that is used to enhance security in personal computers and many other products.Undisclosed until now was that RSA received $10 million in a deal that set the NSA formula as the preferred, or default, method for number generation in the BSafe software, according to two sources familiar with the contract. Although that sum might seem paltry, it represented more than a third of the revenue that the relevant division at RSA had taken in during the entire previous year, securities filings show.

  • In a recent column, security expert Bruce Schneier proposed breaking up the NSA – handing its offensive capabilities work to US Cyber Command and its law enforcement work to the FBI, and terminating its programme of attacking internet security. In place of this, Schneier proposed that “instead of working to deliberately weaken security for everyone, the NSA should work to improve security for everyone.” This is a profoundly good idea for reasons that may not be obvious at first blush.People who worry about security and freedom on the internet have long struggled with the problem of communicating the urgent stakes to the wider public. We speak in jargon that’s a jumble of mixed metaphors – viruses, malware, trojans, zero days, exploits, vulnerabilities, RATs – that are the striated fossil remains of successive efforts to come to grips with the issue. When we do manage to make people alarmed about the stakes, we have very little comfort to offer them, because Internet security isn’t something individuals can solve.
  • I remember well the day this all hit home for me. It was nearly exactly a year ago, and I was out on tour with my novel Homeland, which tells the story of a group of young people who come into possession of a large trove of government leaks that detail a series of illegal programmes through which supposedly democratic governments spy on people by compromising their computers.

I talked about the future of self-driving cars, smart buildings, implanted hearing aids and robotic limbs, and explained that the world is made out of computers that we put our bodies into, and that we put inside our bodies.These computers are badly secured. What’s more, governments and their intelligence agencies are actively working to undermine the security of our computers and networks. This was before the Snowden revelations, but we already knew that governments were buying “zero-day vulnerabilities” from security researchers. These are critical bugs that can be leveraged to compromise entire systems. Until recently, the normal response to the discovery of one of these “vulns” was to report them to the vendor so they could be repaired.

Not when it is illegal to tell people if there are flaws in their computers, where such a disclosure might compromise someone’s anti-copying strategy.But: If I had just stood here and spent an hour telling you about water-borne parasites; if I had told you about how inadequate water-treatment would put you and everyone you love at risk of horrifying illness and terrible, painful death; if I had explained that our very civilisation was at risk because the intelligence services were pursuing a strategy of keeping information about pathogens secret so they can weaponise them, knowing that no one is working on a cure; you would not ask me ‘How can I purify the water coming out of my tap?’”

Evolution drives these organisms to a continuously shifting array of tactics to slide past our defenses.Public health isn’t just about pathogens, either – its thorniest problems are about human behaviour and social policy. HIV is a blood-borne disease, but disrupting its spread requires changes to our attitudes about sex, pharmaceutical patents, drugs policy and harm minimisation. Almost everything interesting about HIV is too big to fit on a microscope slide.

Security requires good password choice, good password management, good laws about compelled crypto disclosure, transparency into corporate security practices, and, of course, an end to the governmental practice of spending $250M/year on anti-security sabotage through the NSA/GCHQ programmes Bullrun and Edgehill.

  • As the world focuses on the high-tech spying of the National Security Agency, the misplaced card offers a rare glimpse inside the seemingly low-tech but prevalent snooping of the United States Postal Service. Mr. Pickering was targeted by a longtime surveillance system called mail covers, but that is only a forerunner of a vastly more expansive effort, the Mail Isolation Control and Tracking program, in which Postal Service computers photograph the exterior of every piece of paper mail that is processed in the United States — about 160 billion pieces last year. It is not known how long the government saves the images. Together, the two programs show that snail mail is subject to the same kind of scrutiny that the National Security Agency has given to telephone calls and e-mail. The mail covers program, used to monitor Mr. Pickering, is more than a century old but is still considered a powerful tool. At the request of law enforcement officials, postal workers record information from the outside of letters and parcels before they are delivered. (Actually opening the mail requires a warrant.) The information is sent to whatever law enforcement agency asked for it. Tens of thousands of pieces of mail each year undergo this scrutiny. The Mail Isolation Control and Tracking program was created after the anthrax attacks in late 2001 that killed five people, including two postal workers. Highly secret, it seeped into public view last month when the F.B.I. cited it in its investigation of ricin-laced letters sent to President Obama and Mayor Michael R. Bloomberg. It enables the Postal Service to retroactively track mail correspondence at the request of law enforcement. No one disputes that it is sweeping.

  • Just as it seems the White House is close to finally announcing its policy on encryption - the FBI has been pushing for tech companies like Apple and Google to insert backdoors into their phones so the US government can always access users’ data - new Snowden revelations and an investigation by a legendary journalist show exactly why the FBI’s plans are so dangerous. One of the biggest arguments against mandating backdoors in encryption is the fact that, even if you trust the United States government never to abuse that power (and who does?), other criminal hackers and foreign governments will be able to exploit the backdoor to use it themselves. A backdoor is an inherent vulnerability that other actors will attempt to find and try to use it for their own nefarious purposes as soon as they know it exists, putting all of our cybersecurity at risk. In a meticulous investigation, longtime NSA reporter James Bamford reported at the Intercept Tuesday that the NSA was behind the notorious “Athens Affair”. In surveillance circles, the Athens Affair is stuff of legend: after the 2004 Olympics, the Greek government discovered that an unknown attacker had hacked into Vodafone’s “lawful intercept” system, the phone company’s mechanism of wiretapping phone calls. The attacker spied on phone calls of the president, other Greek politicians and journalists before it was discovered. According to Bamford’s story, all this happened after the US spy agency cooperated with Greek law enforcement to keep an eye on potential terrorist attacks for the Olympics. Instead of packing up their surveillance gear, they covertly pointed it towards the Greek government and its people. But that’s not all: according to Snowden documents that Bamford cited, this is a common tactic of the NSA. They often attack the “lawful intercept” systems in other countries to spy on government and citizens without their knowledge:
  • Exploiting the weaknesses associated with lawful intercept programs was a common trick for NSA. According to a previously unreleased top-secret PowerPoint presentation from 2012, titled “Exploiting Foreign Lawful Intercept Roundtable”, the agency’s “countries of interest” for this work included, at that time, Mexico, Indonesia, Egypt and others. The presentation also notes that NSA had about 60 “Fingerprints” — ways to identify data — from telecom companies and industry groups that develop lawful intercept systems, including Ericsson, as well as Motorola, Nokia and Siemens. It’s the exact nightmare scenario security experts have warned about when it comes to backdoors: they are not only available to those that operate them “legally”, but also to those who can hack into them to spy without anyone’s knowledge. If the NSA can do it, so can China, Russia and a host of other malicious actors.

  • There's a new international survey on Internet security and trust, of "23,376 Internet users in 24 countries," including "Australia, Brazil, Canada, China, Egypt, France, Germany, Great Britain, Hong Kong, India, Indonesia, Italy, Japan, Kenya, Mexico, Nigeria, Pakistan, Poland, South Africa, South Korea, Sweden, Tunisia, Turkey and the United States." Amongst the findings, 60% of Internet users have heard of Edward Snowden, and 39% of those "have taken steps to protect their online privacy and security as a result of his revelations." The press is mostly spinning this as evidence that Snowden has not had an effect: "merely 39%," "only 39%," and so on. (Note that these articles are completely misunderstanding the data. It's not 39% of people who are taking steps to protect their privacy post-Snowden, it's 39% of the 60% of Internet users -- which is not everybody -- who have heard of him. So it's much less than 39%.)
  • Even so, I disagree with the "Edward Snowden Revelations Not Having Much Impact on Internet Users" headline. He's having an enormous impact. I ran the actual numbers country by country, combining "data on Internet penetration with data from this survey. Multiplying everything out, I calculate that *706 million people* have changed their behavior on the Internet because of what the NSA and GCHQ are doing. (For example, 17% of Indonesians use the Internet, 64% of them have heard of Snowden and 62% of them have taken steps to protect their privacy, which equals 17 million people out of its total 250-million population.)
  • Note that the countries in this survey only cover 4.7 billion out of a total 7 billion world population. Taking the conservative estimates that 20% of the remaining population uses the Internet, 40% of them have heard of Snowden, and 25% of those have done something about it, that's an additional 46 million people around the world. It's certainly true that most of those people took steps that didn't make any appreciable difference against an NSA level of surveillance, and probably not even against the even more pervasive corporate variety of surveillance. It's probably even true that some of those people didn't take steps at all, and just wish they did or wish they knew what to do. But it is absolutely extraordinary that *750 million people* are disturbed enough about their online privacy that they would represent to a survey taker that they did something about it.
