Seven months ago, Israel and the U.S. postponed a massive joint military exercise that was originally set to go forward just as concerns were brimming that Israel would launch a strike on Iran’s nuclear facilities. The exercise was rescheduled for late October and appears likely to go forward on the cusp of the U.S. presidential election. But it won’t be nearly the same exercise. Well-placed sources in both countries have told TIME that Washington has greatly reduced the scale of U.S. participation, slashing by more than two-thirds the number of American troops going to Israel and reducing both the number and potency of missile-interception systems at the core of the joint exercise.

My experience with Napolitano, as a retired lawyer, is that his present role is as a propagandist, willing to lie to make his central point. I've often caught him saying things about the law that he either knows are false or knows that he lacks sufficient knowledge to claim that one of his legal conclusions is true. (He is, however, a very effective orator.) This speech is no different. His premise is false, that there is no language in the Constitution authorizing a host of general welfare laws. First, we find in the Constitution's Preamble it's statement of purpose: "We the People of the United States, *in Order to* form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, *promote the general Welfare,* and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America." Note the distinction made between "promote the general Welfare" and the securing of Liberties. So the Constitution has a purpose beyond securing liberties that falls in the category of promoting the general welfare. Next we move on to Article 1 section 8, which itemizes the Powers of the Congress. In that section's first clause we find: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and *provide for the* common Defence and *general Welfare* of the United States;" But Napolitano's speech mistakenly brands a host of general welfare laws as abuses of the Commerce Clause, which only supplements the General Welfare Clause in relevant regard. His discussion of the meaning of "regulate" at the time of the Constitution's adoption is irrelevant. The far more pertinent question is what was meant at that time by the term "general Welfare." Napolitano simply ducks that question by ignoring the General Welfare Clause and pretending that it does not exist. That is not principled argument, in my humble opinion. Moral o

A bid to slap Iran with a new round of economic sanctions appears to have stalled in the Senate, after leading Democrats amplified concern about the threat such a move poses to a fragile diplomatic process. Early in the week, reports that a bill introduced by Republican Mark Kirk and Democrat Robert Menendez was within striking distance of a veto-proof majority cast a shadow over news that negotiators had finalized a temporary agreement to freeze Iran’s nuclear program, beginning Monday. New sanctions would likely kill negotiations for a final deal, the White House warned lawmakers, and increase the chances of an armed conflict with Iran. But Senate majority leader Harry Reid has given no indication that he will bring the bill up for a vote, and the pressure to do so is falling now that top Democrats have intensified opposition to the proposed legislation. The Kirk-Menendez bill gained no new endorsements this week, and even one supportive senator admitted Wednesday to a break in momentum.

The gorilla in the room is the American Israeli Public Affairs Committee, which has been calling for new sanctions for months. Of the 16 Democrats who have endorsed the Kirk-Menendez legislation, several are up for re-election in closely contested states; Senator Kirk himself suggested Tuesday that a vote for new sanctions would be an opportunity for lawmakers to shore up support from the powerful lobby. “The great thing, since we represent a nationwide community — the pro-Israel community is going to be heavily present in most states — this is a chance for senators to go back and tell them, ‘I’m with you,’” Kirk said. Other Democrats pushing for the bill have close ties with the group, particularly Chuck Schumer and Cory Booker. Tellingly, the Kirk-Menendez bill states that if Israel takes "military action in legitimate self-defense against Iran's nuclear weapons program,” the US "should stand with Israel and provide…diplomatic, military, and economic support to the Government of Israel in its defense of its territory, people, and existence." The language is nonbinding, but it raises flags about whose interests the legislation would truly serve.

Dianne Feinstein addressed this point more directly than perhaps any other politician so far. “While I recognize and share Israel’s concern, we cannot let Israel determine when and where the US goes to war,” she said. “By stating that the US should provide military support to Israel should it attack Iran, I fear that is exactly what this bill will do.” Such outspokenness about the relationship between US policymaking in the Middle East and Israeli interests is remarkable. But other lawmakers are signalling that they too are shrugging off the lobby: Democratic Representative Debbie Wasserman-Shultz, normally a high-profile ally for AIPAC, reportedly argued against the Kirk-Menendez bill at a White House meeting attended by several dozen of her colleagues on Wednesday night. How things play out in the next week, and in the duration of the talks with Iran, will be a good test of AIPAC’s influence, which seemed diminished when Congress considered military strikes in Syria last year. Progressives claimed a victory when diplomacy prevailed then; as Peter Beinart points out, the current debate presents a real opportunity for the anti-war left to reassert itself, not only to punish lawmakers who start wars, but to set new expectations for a diplomacy-first approach.

One, called Cottonmouth I, looks like a normal USB plug but has a tiny transceiver buried in it. According to the catalog, it transmits information swept from the computer “through a covert channel” that allows “data infiltration and exfiltration.” Another variant of the technology involves tiny circuit boards that can be inserted in a laptop computer — either in the field or when they are shipped from manufacturers — so that the computer is broadcasting to the N.S.A. even while the computer’s user enjoys the false confidence that being walled off from the Internet constitutes real protection.The relay station it communicates with, called Nightstand, fits in an oversize briefcase, and the system can attack a computer “from as far away as eight miles under ideal environmental conditions.” It can also insert packets of data in milliseconds, meaning that a false message or piece of programming can outrace a real one to a target computer. Similar stations create a link between the target computers and the N.S.A., even if the machines are isolated from the Internet.

Precedence: IMMEDIATE We regret to inform you that some of our former co-workers are telling us, categorically, that contrary to the claims of your administration, the most reliable intelligence shows that Bashar al-Assad was NOT responsible for the chemical incident that killed and injured Syrian civilians on August 21, and that British intelligence officials also know this. In writing this brief report, we choose to assume that you have not been fully informed because your advisers decided to afford you the opportunity for what is commonly known as “plausible denial.” We have been down this road before – with President George W. Bush, to whom we addressed our first VIPS memorandumimmediately after Colin Powell’s Feb. 5, 2003 U.N. speech, in which he peddled fraudulent “intelligence” to support attacking Iraq. Then, also, we chose to give President Bush the benefit of the doubt, thinking he was being misled – or, at the least, very poorly advised.

They tell us that CIA Director John Brennan is perpetrating a pre-Iraq-War-type fraud on members of Congress, the media, the public – and perhaps even you. We have observed John Brennan closely over recent years and, sadly, we find what our former colleagues are now telling us easy to believe. Sadder still, this goes in spades for those of us who have worked with him personally; we give him zero credence. And that goes, as well, for his titular boss, Director of National Intelligence James Clapper, who has admitted he gave “clearly erroneous” sworn testimony to Congress denying NSA eavesdropping on Americans.

That Secretary of State John Kerry would invoke Clapper’s name this week in Congressional testimony, in an apparent attempt to enhance the credibility of the four-page “Government Assessment” strikes us as odd. The more so, since it was, for some unexplained reason, not Clapper but the White House that released the “assessment.” This is not a fine point. We know how these things are done. Although the “Government Assessment” is being sold to the media as an “intelligence summary,” it is a political, not an intelligence document. The drafters, massagers, and fixers avoided presenting essential detail. Moreover, they conceded upfront that, though they pinned “high confidence” on the assessment, it still fell “short of confirmation.”

There is a growing body of evidence from numerous sources in the Middle East — mostly affiliated with the Syrian opposition and its supporters — providing a strong circumstantial case that the August 21 chemical incident was a pre-planned provocation by the Syrian opposition and its Saudi and Turkish supporters. The aim is reported to have been to create the kind of incident that would bring the United States into the war. According to some reports, canisters containing chemical agent were brought into a suburb of Damascus, where they were then opened. Some people in the immediate vicinity died; others were injured. We are unaware of any reliable evidence that a Syrian military rocket capable of carrying a chemical agent was fired into the area. In fact, we are aware of no reliable physical evidence to support the claim that this was a result of a strike by a Syrian military unit with expertise in chemical weapons. In addition, we have learned that on August 13-14, 2013, Western-sponsored opposition forces in Turkey started advance preparations for a major, irregular military surge. Initial meetings between senior opposition military commanders and Qatari, Turkish and U.S. intelligence officials took place at the converted Turkish military garrison in Antakya, Hatay Province, now used as the command center and headquarters of the Free Syrian Army (FSA) and their foreign sponsors.

Senior opposition commanders who came from Istanbul pre-briefed the regional commanders on an imminent escalation in the fighting due to “a war-changing development,” which, in turn, would lead to a U.S.-led bombing of Syria. At operations coordinating meetings at Antakya, attended by senior Turkish, Qatari and U.S. intelligence officials as well as senior commanders of the Syrian opposition, the Syrians were told that the bombing would start in a few days. Opposition leaders were ordered to prepare their forces quickly to exploit the U.S. bombing, march into Damascus, and remove the Bashar al-Assad government The Qatari and Turkish intelligence officials assured the Syrian regional commanders that they would be provided with plenty of weapons for the coming offensive. And they were. A weapons distribution operation unprecedented in scope began in all opposition camps on August 21-23. The weapons were distributed from storehouses controlled by Qatari and Turkish intelligence under the tight supervision of U.S. intelligence officers.

We hope your advisers have warned you that retaliation for attacks on Syrian are not a matter of IF, but rather WHERE and WHEN. Retaliation is inevitable. For example, terrorist strikes on U.S. embassies and other installations are likely to make what happened to the U.S. “Mission” in Benghazi on Sept. 11, 2012, look like a minor dust-up by comparison. On January 17, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit ruled, as a matter of first impression, that First Amendment defamation rules apply equally to both the institutional press and individual speakers and writers, such as bloggers.

In reaching this conclusion, the Ninth Circuit analyzed two key prior Supreme Court precedents: New York Times v. Sullivan (public official seeking damages for defamation must show “actual malice” as defined as a showing thatthe defendant published the defamatory statement with knowledge that it was false, or with reckless disregard as to whether it was false or not) and Gertz v. Robert Welch, Inc. (First Amendment requires only a negligence standard for private defamation actions). Notably, Gertz involved an institutional media defendant, and the Gertz Court invoked the need to shield “the press and broadcast media from the rigors of strict liability for defamation.” Yet neither New York Times nor Gertz, as the Ninth Circuit noted, were expressly limited to the institutional press. Moreover,a number of other Supreme Court cases have rejected such a limitation: Bartnicki v. Vopper; Cohen v. Cowles Media Co.; First National Bank of Boston v. Bellotti; and Citizens United v. Since World War II – and extending well into the Twenty-first Century – the United States has invaded or otherwise intervened in so many countries that it would be challenging to compile a complete list. Just last decade, there were full-scale U.S. invasions of Afghanistan and Iraq, plus American bombing operations from Pakistan to Yemen to Libya. So, what is one to make of Secretary of State John Kerry’s pronouncement that Russia’s military intervention in the Crimea section of Ukraine – at the behest of the country’s deposed president – is a violation of international law that the United States would never countenance?

Kerry decried the Russian intervention as “a Nineteenth Century act in the Twenty-first Century.” However, if memory serves, Sen. Kerry in 2002 voted along with most other members of the U.S. Congress to authorize President George W. Bush’s invasion of Iraq in 2003, which was also part of the Twenty-first Century. And, Kerry is a member of the Obama administration, which like its Bush predecessor, has been sending drones into the national territory of other nations to blow up various “enemy combatants.” Are Kerry and pretty much everyone else in Official Washington so lacking in self-awareness that they don’t realize that they are condemning actions by Russian President Vladimir Putin that are far less egregious than what they themselves have done?

[See Consortiumnews.com’s “What Neocons Want from Ukraine Crisis.”] The Post is demanding a new Cold War with Russia in retaliation for its relatively non-violent interventions to protect pro-Russian provinces of two countries that were carved out of the old Soviet Union: Georgia where Russian troops have protected South Ossetia and Abkhazia since 2008 and in Ukraine where Russian soldiers have taken control of Crimea. In both cases, the pro-Russian areas felt threatened from their central governments and sought Moscow’s assistance. In the case of Ukraine, a neo-Nazi-led putsch – representing the interests of the western part of the country – overthrew the democratically elected president, Viktor Yanukovych, who came from the eastern region. Then, under the watchful eye of the neo-Nazi storm troopers in Kiev, a rump parliament voted unanimously or near unanimously to enact a series of draconian laws offensive to the ethnic Russian areas in the east and south.

In 2003, when the Bush-Cheney administration dispatched troops halfway around the world to invade Iraq under the false pretense of seizing its non-existent weapons of mass destruction, the U.S. touched off a devastating war that killed hundreds of thousands of Iraqis and left their country a bitterly divided mess. But there has been virtually no accountability. And, why haven’t many of the leading Washington journalists who pimped for those false WMD claims at least been fired from their prestigious jobs, if not also trundled off to The Hague for prosecution as propagandists for aggressive war? Remarkably, many of these same “journalists” are propagandizing for more U.S. wars today, such as attacks on Syria and Iran, even as they demand harsh penalties for Russia over its intervention in the Crimea, which incidentally was an historic part of Russia dating back centuries.

Though the Russian case for intervention in both Georgia and Ukraine is much stronger than the excuses often used by the United States to intervene in other countries, the Washington Post was apoplectic about Russia’s “violation” of suddenly sacred international law. The Post wrote, “as long as some leaders play by what Mr. Kerry dismisses as 19th-century rules, the United States can’t pretend that the only game is in another arena altogether. Military strength, trustworthiness as an ally, staying power in difficult corners of the world such as Afghanistan — these still matter, much as we might wish they did not.” The Post also laments what it sees as a “receding” tide of democracy around the world, but it is worth noting that the U.S. government has a long and sorry record of overthrowing democratic governments. Just a partial list since World War II would include: Mossadegh in Iran in 1953, Arbenz in Guatemala in 1954, Allende in Chile in 1973, Aristide in Haiti twice, Chavez in Venezuela briefly in 2002, Zelaya in Honduras in 2009, Morsi in Egypt in 2013, and now Yanukovych in Ukraine in 2014. The next target of a U.S.-embraced “democratic” coup looks to be Nicolas Maduro of Venezuela. Perhaps the closest U.S. parallel to the Russian intervention in Ukraine was President Bill Clinton’s decision to invade Haiti in 1994 to reinstall Haiti’s elected president Jean-Bertrand Aristide to office, though Russia has not gone nearly that far regarding Yanukovych in Ukraine. Russia has only intervened to prevent the fascist-spearheaded coup regime in Kiev from imposing its will on the country’s ethnic Russian provinces.

Thus, the overriding hypocrisy of the Washington Post, Secretary Kerry and indeed nearly all of Official Washington is their insistence that the United States actually promotes the principle of democracy or, for that matter, the rule of international law. Those are at best situational ethics when it comes to advancing U.S. interests around the world.

The president of the ÇGD's western Central Anatolia branch, Can Hacıoğlu, said the decisions to ban journalists from entering police departments and the closure of press rooms at those departments are unacceptable. The message, delivered to senior members of the Syrian National Coalition at a meeting of the anti-Assad Friends of Syria alliance in London last week, was prompted by rise of al Qaeda and other militant groups, and their takeover of a border crossing and arms depots near Turkey belonging to the moderate Free Syrian Army, the sources told Reuters. "Our Western friends made it clear in London that Assad cannot be allowed to go now because they think chaos and an Islamist militant takeover would ensue," said one senior member of the Coalition who is close to officials from Saudi Arabia.

The shift in Western priorities, particularly the United States and Britain, from removing Assad towards combating Islamist militants is causing divisions within international powers backing the nearly three-year-old revolt, according to diplomats and senior members of the coalition. But long ago, Israel should have said, “No, thanks.” Not every show of loud and pushy, even crazed support is a display of friendship. Sometimes caring and friendship mean criticism. But that is not in AIPAC’s playbook. The word is that the organization’s power is waning, but it doesn’t look that way on the ground. We see what happens to Congress members who dare to criticize Israel. AIPAC is still in the field with its army of lobbyists, and it is the second most effective lobby in Washington, after the gun lobby – and this should cause Israel to worry. Just like the gun lobby, the Israel lobby is not a good partner. It has affected U.S. policy in the past, as one of the factors that led to continued American support for the occupation, as well as Israeli violence and expansion.

Republicans are torn between supporting the president they love to hate and delivering him a stinging rebuke - as much as they are aching to follow the orders of their masters, ranging from the American Israel Public Affairs Committee to military contractors. Once again, this is farce - caused by the fact that a man elected to finish off wars is eager to start yet another one. And once again without a United Nations vote. The White House ''strategy'' in this crucial negotiating week boils down to this; to convince the US Congress that the United States must start a war on Syria to punish an ''evil dictator'' - once again, as bad as Hitler - for gassing children. The evidence? It's ''indisputable''. Well, it's not ''irrefutable''. It's not even ''beyond-a-reasonable-doubt''. As Obama's Chief of Staff Denis McDonough admitted, with a straight face, it boils down to ''a quite strong common sense test, irrespective of the intelligence, that suggests that the regime carried this out''. So if this is really about ''common sense'', the president is obviously not being shown by his close coterie of sycophants this compendium of common sense, compiled by a group of top, extremely credible former US intelligence officials, which debunks all the ''evidence'' as flawed beyond belief. To evoke a farce from 12 years ago, this clearly seems to be a case of ''facts being fixed around the policy''.

The Arab street doesn't buy it because they clearly see through the hypocrisy; the desperate rush to ''punish'' the Bashar al-Assad government in Syria while justifying everything the apartheid state of Israel perpetrates in occupied Palestine. The Muslim world doesn't buy it because it clearly sees the demonization only applies to Muslims - from Arafat to bin Laden to Saddam to Gaddafi and now Assad. It would never apply to the military junta in Myanmar, which was clever enough to engineer an ''opening''; the next day Westerners were lining up to kiss the hem of Burmese longyis. It would never apply to the Islam Karimov dictatorship in Uzbekistan because ''we'' always need to seduce him as one of our bastards away from Russia and China. It eventually applies, on and off, to the Kim dynasty in North Korea, but with no consequences - because these are badass Asians who can actually respond to an US attack. Informed public opinion across the developing world does not buy it because they clearly see, examining the historical record, that Washington would never really be bothered with the sorry spectacle of Arabs killing Arabs, or Muslims killing Muslims, non-stop. The 1980-1988 Iran-Iraq war is a prime piece of evidence.

Then there's the ''credibility'' farce. The Obama administration has convoluted the whole world in its own self-spun net, insisting that the responsibility for the ''red line'' recklessly drawn by the president is in fact global. Yet the pesky ''world'' is not buying it.

At the Group of 20 summit last week, the BRICS group of emerging powers - Brazil, Russia, India, China and South Africa - as well as Indonesia and Argentina, clearly stressed that a war on Syria without UN Security Council approval would qualify Obama as a war criminal. Even among the European poodles ''support'' for the White House is extremely qualified. Germany's Angela Merkel and even France's attack dog Francois Hollande said the primacy is with the UN. The European Union as a whole wants a political solution. It's enlightening to remember that the EU in Brussels can issue arrest warrants for heads of EU governments guilty of war crimes. Someone in Paris must have warned attack dog Hollande that he would not welcome the prospect of slammer time. ''Evil'' as a political category is something worthy of the brain dead. The key question now revolves around the axis of warmongers - Washington, Israel and the House of Saud. Will the Israel lobby, the more discreet but no less powerful Saudi lobby, and the Return of the Living Dead neo-cons convince the US Congress to fight their war?

And then there's the curioser and curioser case of al-Qaeda - essentially the Arabic denomination for a CIA database of US-Pakistani-Saudi trained mujahideen during the 1980s: the oh so convenient transnational bogeyman that ''legitimized'' the Global War On Terror (GWOT) of the George W Bush years; the ''opening'' for al-Qaeda to move to Iraq; and now, no middle men; the CIA and the Obama administration fighting side-by-side with al-Qaeda in Syria. No wonder the denomination ''al-CIAeda'' has gone viral. With farce after farce after farce piling up in their own Tower of Babel, the much-vaunted ''US credibility'' is in itself the biggest farce of all. Politically, no one knows how the vacuum will be filled. It won't be via the UN. It won't be via the BRICS. It won't be via the G-20 - which is seriously divided; at least new multipolar players are carrying way more weight than US poodles. Much would be made to restore ''US credibility'' if the Obama administration had the balls to force both the House of Saud and Qatar (''300 people and a TV station'', in the epic definition of Saudi Arabia's Prince Bandar Sultan - aka Bandar Bush) to end once and for all their weaponizing of hardcore ''rebels'' and ultimately hardcore jihadis, and accept Iran in the negotiating table for a real Geneva II peace process in Syria. It won't happen because this bypasses farce. Once again; helpless Barack is just a paperboy. The plutocrats in charge are getting extremely nervous. The system is melting - and they need to act fast.

They need a Syria as docile as the Arab petro-monarchies. They want to hit Russia bad - and then discuss missile defense and Russian influence in Eastern Europe from a position of force. They want to hit Iran bad - and then continue to issue ultimatums from a position of force. They want to facilitate yet another Israeli attempt to capture southern Lebanon (it's the water, stupid). They want a monster gas pipeline from Qatar for European customers bypassing Iran and Syria as well as Gazprom. Most of all, this is all about control of natural resources and channels of distribution. These are real motives - and they have nothing to do with farce. Farce is only deployed to kill any possibility of real diplomacy and real political discussion. Farce is a theatrical mask - as in ''humanitarian'' imperialism - the ''acceptable'' version of the Dick Cheney-run years. It's as if Dick Cheney had never left the building; paperboy Barack is Dick Cheney with a ''human'' face. The only good outcome in this multi-sorrowful tale is that the real ''international community'', all around the world, has seen the naked Emperor in all its (farcical) glory.

A 5-hour documentary will have to wait for tomorrow. I'm about 7 hours away from a deadline for the current development cycle's Help file. :-) I do think Pepe is a off on a couple of details in this article. The Neocons were mostly silent on this one and Rumsfeld came out against the intervention, saying that Obama hadn't made a valid case for war. That's most likely because the Neocons are joined at the hip with Israeli government and that government is a house divided this time around, with only factions supporting the military strike. The current thinking in Tel Aviv/Jerusalem is, in line with the Israeli right's long term strategy, that it's just fine with them to have Muslims running around killing each other in Syria. That long-term strategy is to destabilize Israel's Arab neighbor states while Israel builds its economic empire and military hegemony in the region. Israeli government isn't exactly thrilled by the prospect of Obama delivering fulfillment of the Saudi goal of transforming Syria from a secular state into a non-secular Islamic state run by Wahabi extremists. Such a state, armed to the teeth by the U.S. and/or the Saudi-Qatari zillionaires could be very bad news for Israel. Notably, the very strongest case thus far that the August 21 chemical attack was conducted by the opposition forces with the U.S. and Syria in on it to create a false flag attack, has been delivered in installments by Yossef Bodansky, an Israeli-American uber-scholar of Islamic "terrorism" and Soviet/Russian weaponry who is incapable of criticising Israel's decades-long terrorism inflicted on the Palestinian people and Israel's continuing unlawful occupation of Palestine plus parts of Jordan, Syria, and Lebanon. Bodanysky sits at the center of an intelligence web of intelligence professionals from nations worried about Islamic "terrorism."
