Today, we get information of a leaked report sourced from three different place - unconfirmed for now (but RT is trying to verify) - that Ukrainian nuclear scioentists misled the public and a radioactive leak has been detected - citing the country’s emergency services claiming that levels of radiation are 16.3 times the legally permitted norm.

  • Curiously, all this takes place at a peculiar time: just as Ukraine announces it is replacing its nuclear fuel supplier from Russia to US conglomerate Westinghouse: Ukraine on Tuesday sealed an additional nuclear fuel supply deal with US giant Westinghouse in order to ease its energy dependence on Russia.    Westinghouse Electric Company said it signed a deal in Brussels with Ukraine's Energoatom state nuclear power provider "to significantly increase fuel deliveries to Ukrainian nuclear power plants through 2020."   No figures were immediately available for the value of a deal which Ukrainian Prime Minister Arseniy Yatsenyuk had said would take place.    Nor were there details on the quantities of fuel or number of reactors involved.  The two sides had earlier this year extended their existing cooperation agreement through 2020.   A top Energoatom official said this month that Kiev would like to purchase additional Westinghouse nuclear fuel for 13 of its reactors.   US-based Westinghouse currently supplies fuel for only one of Ukraine's 15 operating units -- the third reactor of the South Ukranian Nuclear power Plant that is located 300 kilometres (185 miles) south of Kiev.   Ukranian media said Energoatom and the US firm had been cooperating on nuclear fuel supplies since 2000.   The former Soviet republic had previously relied on Russian nuclear fuel manufacturer TVEL.

    I needed some background regarding the founding documents and their position on individual property rights.  Google came back with this gem!   The basic argument i'm pursuing is that socialism is unconstitutional because it's based on the selective seizure and redistribution of wealth.  Meaning, not all citizens are equal before the law.  The complaints lodged against King George in the Declaration of Independence are very much about the colonist not having the same rights of Englishmen as those whom the King favors. excerpt: the purpose of the Declaration of Independence. "Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject . . . ."1 The "common sense of the subject" expressed in the Declaration of Independence was that a national civil government must be based upon the "Laws of Nature and of Nature's God." The laws of nature and of nature's God dictate that all men are equally endowed by their Creator with unalienable rights to "Life, Liberty and the pursuit of Happiness." In Jefferson's day, the common sense of the subject was that the pursuit of happiness included the unalienable right of the individual to acquire, possess, protect and dispose of property. Because the purpose of civil governments was to secure unalienable rights, violations of one's unalienable right of property were subject to civil sanction. Today, however, the common sense of the subject is quite the opposite. The modern idea is that civil government properly possesses all power over all subjects of property. Your responsibility to do so is prescribed in the Constitution and the War Powers Resolution of 1973.  While the Founders wisely gave the Office of the President the authority to act in emergencies, they foresaw the need to ensure public debate – and the active engagement of Congress – prior to committing U.S. military assets. Engaging our military in Syria when no direct threat to the United States exists and without prior congressional authorization would violate the separation of Powers that is clearly delineated in the Constitution.  Mr. President, in the case of military operations in Libya you stated that authorization from Congress was not required because our military was not engaged in “hostilities.” In addition, an April 1, 2011, memorandum to you from your Office of Legal Counsel concluded: “…President Obama could rely on his constitutional Power to safeguard the national interest by directing the anticipated military operations in Libya—which were limited in their nature, scope, and duration—without prior congressional authorization.” We view the precedent this opinion sets, where “national interest” is enough to engage in hostilities without congressional authorization, as unconstitutional. If the use of 221 Tomahawk cruise missiles, 704 Joint Direct Attack Munitions, and 42 Predator Hellfire missiles expended in Libya does not constitute “hostilities,” what does?  If you deem that military action in Syria is necessary, Congress can reconvene at your request.     The page says that 116 members of Congress signed this letter (their names follow the quoted portion) but latest figure I saw was that 150 are now on board.  The letter is far tougher than has been reported. They've put it very bluntly both on what he did in Libya without consulting Congress and on the separation of powers in the Constitution that allocates to Congress the power to declare war, not to the Executive.

The Washington Post has the bombing at "no more than two days," though long-range bombers could "possibly" join the missiles. "Factors weighing into the timing of any action include a desire to get it done before the president leaves for Russia next week," reports CNN, citing a "senior administration official." The New York Times, quoting a Pentagon official, adds that "the initial target list has fewer than 50 sites, including air bases where Syria's Russian-made attack helicopters are deployed." The Times adds that "like several other military officials contacted for this report, the official agreed to discuss planning options only on condition of anonymity." Thus do the legal and moral requirements of secret military operations lose out in this Administration to the imperatives of in-the-know spin and political gestures.

We wrote Tuesday that there is likely to be no good outcome in Syria until Assad and his regime are gone. Military strikes that advance that goal—either by targeting Assad directly or crippling his army's ability to fight—deserve the support of the American people and our international partners. That's not what this Administration seems to have in mind.

Russia's only foreign military base is a naval port in Syria. Russia has deployed anti-aircraft missile batteries in Syria. Russia has supplied the Syrian government with state-of-the-art antiaircraft shoulder-held missiles. Several months ago, the Russians moved a fleet of warships into the Mediterranean for the first time, to protect Syria from foreign attack, including at least one submarine equipped with anti-ship missiles.  The U.S. and Russia have been engaged in building up their forces positioned around for over a year, in an escalating fashion. Russia has a huge economic incentive to keep Assad in power because he is blocking the natural gas pipeline that western interests want to run through Syria Russia has also built up its forces within Syria, a pipeline that would break Russia's near-monopoly on supplying natural gas to the European Union. A direct military intervention in Syria doesn't go down without Russia's approval, notwithstanding what their later statements might be. Obama is an accomplished liar but he's politically timid. Touching off World War III is not on his agenda. 2. Iran also has to acquiesce in advance.   • On the fourth day of Israel's most recent onslaught against Gaza's Palestinian population, President Barack Obama declared, “No country on Earth would tolerate missiles raining down on its citizens from outside its borders.” In an echo of Israeli officials, he sought to frame Israel's aerial missile strikes against the 360-square kilometer Strip as the just use of armed force against a foreign country. Israel's ability to frame its assault against territory it occupies as a right of self-defense turns international law on its head.  A state cannot simultaneously exercise control over territory it occupies and militarily attack that territory on the claim that it is “foreign” and poses an exogenous national security threat. In doing precisely that, Israel is asserting rights that may be consistent with colonial domination but simply do not exist under international law.

Absent the political will to make state behavior comport with the law, violations are the norm rather than the exception. Therefore, where an occupation already is in place, the right to initiate militarized force in response to an armed attack, as opposed to police force to restore order, is not a remedy available to the occupying state. In the case of Israel, its occupation of the West Bank, the Gaza Strip, the Golan Heights, and the Sinai in 1967 marked a military victory against Arab belligerents.  Occupation Law prohibits an occupying power from initiating armed force against its occupied territory. By mere virtue of the existence of military occupation, an armed attack, including one consistent with the UN Charter, has already occurred and been concluded. Therefore the right of self-defense in international law is, by definition since 1967, not available to Israel with respect to its dealings with real or perceived threats emanating from the West Bank and Gaza Strip population. To achieve its security goals, Israel can resort to no more than the police powers, or the exceptional use of militarized force, vested in it by IHL. This is not to say that Israel cannot defend itself—but those defensive measures can neither take the form of warfare nor be justified as self-defense in international law.   • When It Is Just to Begin to Fight  The laws of armed conflict are found primarily in the Hague Regulations of 1907, the Four Geneva Conventions of 1949, and their Additional Protocols I and II of 1977. This body of law is based on a crude balance between humanitarian concerns on the one hand and military advantage and necessity on the other. The post-World War II Nuremberg trials defined military exigency as permission to expend “any amount and kind of force to compel the complete submission of the enemy…” so long as the destruction of life and property is not done for revenge or a lust to kill. Thus, the permissible use of force during war, while expansive, is not unlimited.  In international law, self-defense is the legal justification for a state to initiate the use of armed force and to declare war. This is referred to as jus ad bellum—meaning “when it is just to begin to fight.” The right to fight in self-defense is distinguished from jus in bello, the principles and laws regulating the means and methods of warfare itself. Jus ad bellum aims to limit the initiation of the use of armed force in accordance with United Nations Charter Article 2(4); its sole justification, found in Article 51, is in response to an armed attack (or an imminent threat of one in accordance with customary law on the matter). The only other lawful way to begin a war, according to Article 51, is with Security Council sanction, an option reserved—in principle, at least—for the defense or restoration of international peace and security.
