  • Amidst another week of deadly Israeli-Palestinian violence, fifteen faith leaders representing U.S. churches and faith organizations have called on Congress to condition U.S. military aid to Israel upon Israel’s “compliance with applicable U.S. laws and policies.” These leaders--representing Baptist, Lutheran, Catholic, Presbyterian, Methodist, Orthodox, Quaker and other major Christian groups--agree that unconditional U.S. military assistance to Israel has contributed to “sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians.”  [SEE LETTER BELOW]   As a Quaker peace lobby that has advocated for Israeli-Palestinian peace for decades in Washington, the Friends Committee on National Legislation (FCNL) is proud to be a partner in this effort.   These organizations draw upon their decades of experience in the region, during which they have collectively witnessed the horror of suicide bombing, rocket attacks, shootings of civilians, home demolitions, forced displacement, and other widespread human rights violations. These faith groups “recognize that each party — Israeli and Palestinian — bears responsibilities for its actions and we therefore continue to stand against all violence regardless of its source.”      Unconditional U.S. military aid has become one of those sources fueling violence and further entrenchment of Israel’s military occupation of the Palestinian territories. This statement highlights the United States’ responsibility to hold Israel accountable for “a troubling and consistent pattern of disregard by the government of Israel for U.S. policies that support a just and lasting peace.”
  • Congress must investigate possible violations of U.S. law The latest State Department human rights report on Israel and the Occupied Territories provides a devastating account of Israel’s human rights violations against civilians, many of which involve the misuse of U.S.-supplied weapons. This diverse religious coalition has called for “an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act,” and urges Congress to “ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace”.     The signers affirm that these are laws that “should be enforced in all instances regardless of location,” but that it is especially critical for Israel to comply with laws that regulate the use of U.S. supplied weapons, since Israel is the single largest recipient of U.S. foreign aid since World War II. Notably, the United States has initiated investigations of violations of these laws by other countries, and on four different occasions between 1978 and 1982, the Secretary of State notified Congress that Israel “may” have violated the provisions of the Arms Export Control Act.   The coalition has called for renewed investigations into human rights violations documented by the State Department’s report, including Israel’s escalation of home demolitions, forced displacement, suppression of dissent, and its use of prohibited weapons in densely populated areas during Israel’s military Operation Cast Lead in the Gaza Strip.  
  • Echoing urgent warnings from Israeli leader The letter also echoes the urgency for immediate action to secure a diplomatic settlement to the crisis that has been acknowledged by scores of Israeli and Palestinian leaders, including Ehud Barak, Israel’s current Defense Minister and former Prime Minister. In a historic speech delivered at the prestigious Herzliya National Security Conference in Israel in early 2010, Mr. Barak warned of Israel’s future in the absence of a political settlement, saying in stark terms:   “The reality is cruel but simple. Between the Jordan River...and the Mediterranean, 12 million people live, 7.5 million Israelis and 4.5 million Palestinians. And the simple truth is that as long as in this territory to the West of the Jordan River, there is one political entity which is called Israel[...]and if this bloc of Palestinians would not be able to vote, it’s going to be an apartheid state.”     Israeli, Palestinian, and U.S. interests require urgent efforts to avoid the nightmare that Israeli leader Ehud Barak has described as an apartheid state. A just and peaceful future for Israelis and Palestinians requires that all parties to a conflict are held accountable and that a comprehensive, inclusive diplomatic settlement be secured. An essential step for Congress to support Israeli-Palestinian peace efforts is to heed these warnings, and hold Israel accountable for how it uses U.S. military aid.   • Unfortunately, unconditional U.S. military assistance to Israel has contributed to this deterioration, sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians. This is made clear in the most recent 2011 State Department Country Report on Human Rights Practices covering Israel and the Occupied Territories (1), which details widespread Israeli human rights violations committed against Palestinian civilians, many of which involve the misuse of U.S.-supplied weapons. Accordingly, we urge an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act which respectively prohibit assistance to any country which engages in a consistent pattern of human rights violations and limit the use of U.S. weapons (2) to “internal security” or “legitimate self-defense.” (3) More broadly, we urge Congress to undertake careful scrutiny to ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace. We urge Congress to hold hearings to examine Israel’s compliance, and we request regular reporting on compliance and the withholding of military aid for non-compliance.

There was significant anticipation surrounding Tuesday’s announcement, which was originally set to come from a balcony at the embassy but was reconfigured due to “security concerns.” As the New York Times noted, “[the] remarks from Mr. Assange disappointed many followers of WikiLeaks in the United States, who had stayed up into the early hours hoping to hear information relevant to the presidential election.”

The husband-and-wife Clinton insiders  are both shopping for separate immunity deals, sources said. “If they don’t cooperate they are going to see long sentences,” a federal law enforcement source said. NYPD sources said Weiner or Abedin stored all the emails in a massive Microsoft Outlook program on the laptop. The emails implicate other current and former members of Congress and one high-ranking Democratic Senator as having possibly engaged in criminal activity too, sources said. Prosecutors in the office of US Attorney Preet Bharara have issued a subpoena for Weiner’s cell phones and travel records, law enforcement sources confirmed. NYPD said it planned to order the same phone and travel records on Clinton and Abedin, however, the FBI said it was in the process of requesting the identical records. Law enforcement sources are particularly interested in cell phone activity and travel to the Bahamas, U.S. Virgin Islands and other locations that sources would not divulge.

Epstein’s island has also been dubbed Orgy Island or Sex Slave Island where Epstein allegedly pimps out underage girls and boys to international dignitaries. At one point, FBI sources said, Abedin and Clinton’s classified and top secret State Department documents and emails were stored in Weiner’s email on a server shared with a dog grooming service and a western Canadian bicycle shop. However, Weiner and Abedin, who is Hillary Clinton’s closest personal aide, weren’t the only people with access to the Weiner’s email account. Potentially dozens of unknown individuals had access to Abedin’s sensitive State Department emails that were stored in Weiner’s email account, FBI sources confirmed. FEC records show Weiner paid more than $92,000 of congressional campaign funds to Anne Lewis Strategies LLC to manage his email and web site. According to FBI sources, the D.C.-based political consulting firm has served as the official administrator of the anthonyweiner.com domain since 2010, the same time Abedin was working at the State Department. This means technically Weiner and Abedin’s emails, including top secret State Department emails, could have been accessed, printed, discussed, leaked, or distributed by untold numbers of personnel at the Anne Lewis consulting firm because they can control where the website and it emails are pointed, FBI sources said.
  • According to FBI sources, the bureau’s newly-minted probe into Clinton’s use and handling of emails while she served as secretary of state, has also been broadened to include investigating new email-related revelations, including: Abedin forwarded classified and top secret State Department emails to Weiner’s email Abedin stored emails, containing government secrets, in a special folder shared with Weiner warehousing over 500,000 archived State Department emails. Because Weiner’s campaign website is managed by the third-party consultant and political email guru, FBI agents are burdened with the task of trying to decipher just how many people had access to Weiner’s server and emails and who were these people. Or if the server was ever compromised by hackers, or other actors.
  • Abedin told FBI agents in an April interview that she didn’t know how to consistently print documents or emails from her secure Dept. of State system. Instead, she would forward the sensitive emails to her yahoo, Clintonemail.com and her email linked to Weiner. Abedin said, according to FBI documents, she would then access those email accounts via webmail from an unclassified computer system at the State Dept. and print the documents, many of which were classified and top secret, from the largely unprotected webmail portals. Clinton did not have a computer in her office on Mahogany Row at the State Dept. so she was not able to read timely intelligence unless it was printed out for her, Abedin said. Abedin also said Clinton could not operate the secure State Dept. fax machine installed in her Chappaqua, NY home without assistance. Perhaps more alarming, according to the FBI’s 302 Report detailing its interview with Abedin, none of the multiple FBI agents and Justice Department officials who conducted the interview pressed Abedin to further detail the email address linked to Weiner. There was never a follow up, according to the 302 report. But now, all that has changed, with the FBI’s decision to reopen the Clinton email investigation and the husband and wife seeking immunity deals to testify against Clinton and other associates about the contents of the laptop’s emails.

  • The outgoing U.S. director of national intelligence has extended an olive branch of sorts to Donald Trump — denouncing media leaks, casting skepticism on a report that Russia has damaging material on the president-elect, and assuring Trump that America's spies stand ready to serve him. In an unusual statement, James Clapper said he had spoken Wednesday evening with Trump, five days after the spy chief and some of his counterparts met with the incoming president to discuss U.S. intelligence assessments that Russia tried to interfere in the 2016 election, possibly to help him win.Story Continued Below The assessment has badly aggravated existing tensions between the intelligence community and Trump. On Tuesday, CNN, BuzzFeed and other media outlets reported that, during Friday’s briefing, the intelligence officials told Trump about an unsubstantiated private report that detailed how Russia's government allegedly had salacious information about him. In addition, BuzzFeed published the apparent dossier, which Trump has since denounced as “fake news.” "I expressed my profound dismay at the leaks that have been appearing in the press, and we both agreed that they are extremely corrosive and damaging to our national security," Clapper said of the information that has come out since last week's intelligence briefing.
  • Clapper’s statement represented a dramatic turn of events only 24 hours after initial leaks about the intelligence leaders having told Trump of the dossier. And while Clapper’s statement indirectly confirmed the media reports of the briefing, it also could be viewed as a concession of sorts from an intelligence community that has come under repeated, direct fire from the president-elect. Trump had compared the leak from his briefing to “Nazi Germany” on Twitter on Wednesday morning, writing, “Intelligence agencies should never have allowed this fake news to "leak" into the public. At the same time, he indicated that the intelligence community decided to share the material with Trump because its mere existence was important for the incoming president to know about.

Steven Hall, a former head of Russian operations at the CIA, said Clapper’s statement didn’t appear to be an all-out apology, but that it was possible the spy chief wants to try to patch up the tensions between Trump and the intelligence world before he himself steps down in just a few days. “He just might very well be like, wow, this really has kind of gotten out of control,” said Hall, who described Clapper as an “old-school, principled” kind of guy. “This might be his parting attempt to say, look at the very least after more than a 50-year career in intelligence, I don’t want this to be what I’m remembered by.”

    The Constitution and Foreign Policy by Bart Frazier, Posted October 17, 2007 Protecting the country from invasion and securing individual rights are two of the vital functions of the federal government. At the same time the government is the greatest threat to our freedom. This was the subject of FFF's June conference, "Restoring the Republic: Foreign Policy and Civil Liberties." An underlying theme, touched on by every one of the speakers, was the relationship between the state and the individual, for it is the individual who ultimately feels the effects of the government policies. For Americans, the rulebook for this relationship is the Constitution. In the United States, the Constitution is the primary connection between the individual and the state. It is the law of the land and the document that trumps all others when determining what the state may and may not do. The Constitution was designed to protect us, the people, from government. It is the government, however, that has advanced an overactive foreign policy for the past several decades, and it is the American people who now feel the adverse effects of the resulting blowback. It is the government that violates civil liberties, and it is the individual who feels the effects of government surveillance, detention, and torture.

    Author David Malone digs into world events, suggesting that all the saber rattling over Iran and nuclear weapons is really about GOLD!   He argues that the dollar is rapidly being replaced as the world's "settlement" currency.  As a function, "settlement" is different than "reserve", but since WWII and the Basel Conference, the USA Dollar has been both the currency of "reserve" and settlement".  That is now changing, and fast! David further suggests that the Iraqi wars with Saddam Hussein were also about his use of the Euro to "settle" oil purchases.  It could also be argued that Muamma Gaddafi in Lybia was removed because he was organizing all of Africa to "settle" oil and other commodity purchases in GOLD, and not the USA Dollar. Are the Islamic wars really about oil?  Or are they about how oil purchases are "settled"?   • The year of 2014 is starting well for the American Israel Public Affairs Committee (AIPAC), the premier organization of this country’s Israel lobby. Not only has it been clearly and increasingly decisively defeated – at least for now and the immediate future – in its bid to persuade a filibuster-proof, let alone a veto-proof, super-majority of senators to approve the Kirk-Menendez “Wag the Dog” Act that was designed to torpedo the Nov. 24 “Joint Plan of Action” (JPA) between Iran and the P5+1. It has also drawn a spate of remarkably unfavorable publicity, a particularly damaging development for an organization that, as one of its former top honchos, Steve Rosen, once put it, like “a night flower, … thrives in the dark and dies in the sun.”
  • The result: AIPAC and its supporters hit a brick wall at 59, unable even to muster the 60 needed to invoke cloture against a possible filibuster, let alone the 77 senators that AIPAC-friendly Congressional staff claimed at one point were either publicly or privately committed to vote for the bill if it reached the floor. By late this week, half a dozen of the 16 Democrats who had co-sponsored the bill were retreating from it as fast as their senatorial dignity would permit. And while none has yet disavowed their co-sponsorship, more than a handful now have (disingenuously, in my view) insisted that they either don’t believe that the bill should be voted on while negotiations are ongoing; that they had never intended to undercut the president’s negotiating authority; or, most originally, that they believed the mere introduction of the bill would provide additional leverage to Obama (Michael Bennet of Colorado) in the negotiations. Even the bill’s strongest proponents, such as Oklahoma’s Jim Inhofe, conceded, as he did to the National Journal after Obama repeated his veto threat in his State of the Union Address Tuesday: “The question is, is there support to override a veto on that? I say, ‘No.’” The Democratic retreat is particularly worrisome for AIPAC precisely because its claim to “bipartisanship” is looking increasingly dubious, a point underlined by Peter Beinart in a Haaretz op-ed this week that urged Obama to boycott this year’s AIPAC policy conference that will take place a mere five weeks from now. (This is the nightmare scenario for Rosen who noted in an interview with the JTA’s Ron Kampeas last week that the group’s failure to procure a high-level administration speaker for its annual conference “would be devastating to AIPAC’s image of bipartisanship.”) According to Beinart:
  • Consider first what happened with the Kirk-Menendez sanctions bill, named for the two biggest beneficiaries of “pro-Israel” PACs closely associated with AIPAC in the Congressional campaigns of 2010 and 2012, respectively. Introduced on the eve of the Christmas recess, the bill then had 26 co-sponsors, equally divided between Democrats and Republicans, giving it an attractive bipartisan cast – the kind of bipartisanship that AIPAC has long sought to maintain despite the group’s increasingly Likudist orientation and the growing disconnect within the Democratic Party between its strongly pro-Israel elected leadership and more skeptical base, especially its younger activists, both Jewish and gentile. By the second week of January, it had accumulated an additional 33 co-sponsors, bringing the total to 59 and theoretically well within striking distance of the magic 67 needed to override a presidential veto. At that point, however, its momentum stalled as a result of White House pressure (including warnings that a veto would indeed be cast); the alignment behind Obama of ten Senate Committee chairs, including Carl Levin of the Armed Services Committee and Dianne Feinstein of the Intelligence Committee; public denunciation of the bill by key members of the foreign policy elite; and a remarkably strong grassroots campaign by several reputable national religious, peace, and human-rights groups (including, not insignificantly, J Street and Americans for Peace Now), whose phone calls and emails to Senate offices opposing the bill outnumbered those in favor by a factor of ten or more.

  • Of course, none of this means that the battle over Iran policy is won, but it does suggest that AIPAC’s membership has some serious thinking to do about the group’s relationship to Democrats and to the broader Jewish community. Nor does it necessarily mean that we have finally reached a “tipping point” regarding the lobby’s hold over Congress and U.S. Middle East policy. But this is unquestionably a significant moment. But the term refers to discredited intelligence from suspect sources. One of the issues Obama administration officials are insisting must be resolved to the satisfaction of the International Atomic Energy Agency (IAEA) before any nuclear agreement may be concluded involves "possible military dimensions." That term refers to documents long discredited by German intelligence but which the United States and the IAEA have maintained came from a covert Iranian nuclear weapons program. A former senior German official has now revealed that the biggest collection of documents cited as evidence of such a covert Iran program actually came from a member of the Iranian terrorist organization Mujihedin-E-Khalq (MEK) and that German intelligence sought to warn the George W. Bush administration that the source of the documents was not trustworthy.
  • The use of those documents to make a case for action against Iran closely parallels the Bush administration's use of the testimony of the now-discredited Iraqi exile called "Curveball" to convince the US public to support war against Iraq. The parallel between the two episodes was recognized explicitly by the German intelligence service, the Bundesnachrichtendienst (BND), according to Karsten Voigt, who was the German Foreign Office's coordinator of North American-German relations. Voigt provided details of the story behind the appearance of the mysterious Iran nuclear documents in an interview with this writer last March for a book on the false narrative surrounding Iran's nuclear program that is newly published, Manufactured Crisis. 
  • In 2004, Powell and his State Department team still regarded the MEK as a disreputable terrorist organization, but the neoconservatives in the administration viewed it as useful as an anti-regime tool. The MEK was known to have served the interests of Israel's Mossad by providing a way to "launder" intelligence claims that Israel wanted to get out to the public but didn't want identified as having come from Israel. In the best-known case, the group's political front organization, the National Council of Resistance in Iran, had revealed the location of the Iranian uranium enrichment facility at Natanz in an August 2002 press conference, but it had been given the coordinates of the construction site by Israeli intelligence, according to both a senior IAEA official and an Iranian opposition group source, cited by Seymour Hersh and New Yorker writer Connie Bruck, respectively. The purported Iranian documents conveyed by the MEK to Western intelligence also displayed multiple indications of having been fabricated by an outside actor. The clearest and most significant anomaly was that the drawings of efforts to redesign the Shahab-3 missile to accommodate a nuclear weapons showed a missile that had already been abandoned by Iran's Defense Ministry by the time the drawings were said to have been made, as was confirmed by former IAEA deputy director general for safeguards, Olli Heinonen, in an interview with this writer. The Iranian abandonment of the earlier missile design became known to foreign analysts, however, only after Iran flight-tested a completely new missile design in August 2004 - after the "laptop documents" had already been conveyed to the BND by its MEK source. Whoever ordered those drawings was unaware of the switch to the new missile design, which would rule out a genuine Iranian Defense Ministry or military program.

  • A former IAEA official familiar with those documents recalled in interview with Truthout that senior officials at the IAEA were immediately suspicious of the entire collection of documents given to the agency in 2005. "The documents were never really convincing," said the former official. The creators of the documents had taken publicly available information about people, organizations and location and had "woven their own narrative" around them, he said. Furthermore, he recalled finding anomalies in the stamps and signature blocs of documents. The fabricated documents, depicting Iran as redesigning their missile reentry vehicle to accommodate a nuclear weapon, among other things, fit into a Bush administration strategy - coordinated with Israel - that was aimed at justifying a military confrontation with Iran. The working assumption, as was revealed by David Wurmser, special assistant to Bolton and then to Cheney, in October 2007, was that the United States would probably need to use force to bring about that change once Iraq was brought under control. Bolton recalls in his memoirs that his aim was to move the Iran nuclear issue out of the IAEA to the United Nations Security Council, where the Bush administration would call for international action against Iran, and failing that, take unilateral action.
  • The IAEA got more documents and intelligence directly from Israel in 2008 and 2009 claiming Iranian work on nuclear weapons, according to then-IAEA Director-General Mohamed ElBaradei. The intelligence passed on by Israel included the claim that Iran had installed a large metal cylinder for high explosives tests at its Parchin military facility in 2000, which it intended to use for hydrodynamic tests of nuclear weapons designs. But the IAEA never revealed the information had come from Israel, covering up the primary fact relevant to its reliability and authenticity. The Safeguards Department had been prepared as early as 2009 to publish a dossier on what it called the "possible military dimensions" of the Iranian nuclear program that would accept all the intelligence reports and documents provided by Israel as genuine and accurate. But ElBaradei's successor, Yukiya Amano, waited to do so until November 2011, when the Obama administration was ready to organize an international coalition for harsh sanctions against Iran's oil export sector. The Obama administration returned to the "possible military dimensions" last November, insisting on a provision in the interim Iran nuclear agreement that required Iran to "resolve" all the "concerns" about that issue. A "senior administration official" briefing the press on the agreement November 24 said there would be no final agreement unless Iran showed that it had "come into compliance with its obligations under the NPT and its obligations to the IAEA."
  • In response to a request from Truthout for a confirmation or denial of the revelation by Karsten Voigt of the MEK role in transmitting the purported Iranian documents to the BND in 2004, NSC officials declined to comment on the matter, according to NSC spokesperson Bernadette Meehan. Some observers believe US negotiators hope to get Iran to admit to having had a nuclear weapons program. However, Iran is certainly not going to admit that the documents and intelligence reports it knows to be fabrications are true. But the Obama administration may well believe so strongly in the Iran nuclear narrative it inherited from the Bush administration and in the idea that the sanctions against Iran confer ultimate negotiating leverage on the United States that it sees an Iranian confession as a realistic goal. In any case, the decision to introduce the falsified evidence of the past into the final negotiations is bound to bring them to an impasse unless the United States is prepared to back down.

One classified document from Government Communications Headquarters, Britain’s top spy agency, shows that GCHQ used its surveillance system to secretly monitor visitors to a WikiLeaks site. By exploiting its ability to tap into the fiber-optic cables that make up the backbone of the Internet, the agency confided to allies in 2012, it was able to collect the IP addresses of visitors in real time, as well as the search terms that visitors used to reach the site from search engines like Google.

The documents call into question the Obama administration’s repeated insistence that U.S. citizens are not being caught up in the sweeping surveillance dragnet being cast by the NSA. Under the broad rationale considered by the agency, for example, any communication with a group designated as a “malicious foreign actor,” such as WikiLeaks and Anonymous, would be considered fair game for surveillance.

  • The system used by GCHQ to monitor the WikiLeaks website – codenamed ANTICRISIS GIRL – is described in a classified PowerPoint presentation prepared by the British agency and distributed at the 2012 “SIGDEV Conference.” At the annual gathering, each member of the “Five Eyes” alliance – the United States, United Kingdom, Canada, Australia and New Zealand – describes the prior year’s surveillance successes and challenges. In a top-secret presentation at the Conference, two GCHQ spies outlined how ANTICRISIS GIRL was used to enable “targeted website monitoring” of WikiLeaks (See slides 33 and 34). The agency logged data showing hundreds of users from around the world, including the United States, as they were visiting a WikiLeaks site –contradicting claims by American officials that a deal between the U.K. and the U.S. prevents each country from spying on the other’s citizens. The IP addresses collected by GCHQ are used to identify individual computers that connect to the Internet, and can be traced back to specific people if the IP address has not been masked using an anonymity service. If WikiLeaks or other news organizations were receiving submissions from sources through a public dropbox on their website, a system like ANTICRISIS GIRL could potentially be used to help track them down. (WikiLeaks has not operated a public dropbox since 2010, when it shut down its system in part due to security concerns over surveillance.)

  • After years of being held at the US Naval Base in Cuba without trial, Ibrahim Idris, one of two Sudanese detainees released on Thursday, said US prison officials had "systematically tortured" him in the course of his 11-year imprisonment at Gitmo. Idris, who has been described by US officials as mentally ill, delivered his comments in a news conference in Khartoum, just hours after returning home courtesy of a US military plane. Appearing weak and speaking with apparent difficultly, Idris gave a brief account of his lengthy imprisonment at Gitmo. “We have been subjected to meticulous, daily torture," he said. "We were helpless…on an isolated island, surrounded by weapons." He praised the Sudanese government and human rights organizations for working to secure the release of prisoners at Gitmo, which has been called “the GULAG of our times” by Amnesty International. Closed-door military tribunals, for example, have been riddled with problems, including courtroom speakers that have a mysterious tendency for being blocked during key testimony.
  • Another released detainee, Noor Othman Muhammed, was unable to attend the conference because he was recovering in the hospital, Idris said. On Feb. 18, 2011, Muhammed pleaded guilty in a military tribunal to offenses under the Military Commissions Act of 2009, and was sentenced to 14 years confinement, according to a Defense Department news release. In exchange for his guilty plea and Muhammed's cooperation with prosecutors, the military court agreed through a pre-trial agreement to suspend all confinement in excess of 34 months. As Barack Obama wins congressional approval to transfer some prisoners from Guantanamo Bay to their home countries, a released Sudanese inmate spoke of the torture he and others endured at the hands of their American jailers. Approval for a partial detainee release is contained in the National Defense Authorization Act, which passed the Senate by an 84-15 vote on Thursday night.

  • A still-classified report on the CIA's interrogation program established in the wake of 9/11 sparked a furious row last week between the agency and Senate Intelligence Committee chairwoman Dianne Feinstein. Al Jazeera has learned from sources familiar with its contents that the committee's report alleges that at least one high-value detainee was subjected to torture techniques that went beyond those authorized by George W. Bush's Justice Department. Two Senate staffers and a U.S. official, who spoke on the condition of anonymity because the information they disclosed remains classified, told Al Jazeera that the committee's analysis of 6 million pages of classified records also found that some of the harsh measures authorized by the Department of Justice had been applied to at least one detainee before such legal authorization was received. They said the report suggests that the CIA knowingly misled the White House, Congress and the Justice Department about the intelligence value of detainee Zain Abidin Mohammed Husain Abu Zubaydah when using his case to argue in favor of harsher interrogation techniques.
  • Even before accessing the documents, committee staffers received crucial information in a briefing from former FBI agent Ali Soufan in early 2008, according to Al Jazeera’s sources.   • Soufan described his briefing of Intelligence Committee researchers in his memoir, “The Black Banners.” “In early 2008, in a conference room that is referred to as a sensitive compartmented information facility (SCIF), I gave a classified briefing on Abu Zubaydah to staffers of the Senate Select Committee on Intelligence,” Soufan wrote. “The staffers present were shocked. What I told them contradicted everything they had been told by Bush administration and CIA officials. When the discussion turned to whether I could prove everything I was saying, I told them, ‘Remember, an FBI agent always keep his notes.’ ”  The committee tried to gain access to Soufan’s notes — then in possession of the CIA and FBI — after it launched a review of the agency’s detention and interrogation program in 2009. But Senate investigators were told, according to Al Jazeera’s sources, that Soufan’s notes were missing and could not be found in either the FBI’s or CIA’s computer system, where other classified records about the interrogation program were stored. More than a year later, the notes ended up with the Senate Intelligence Committee, although it's not clear whether they were turned over to committee investigators by the CIA or FBI or if they were in the cache of documents taken by investigators from the secure facility in Northern Virginia in 2010, which Senate staffers refer to as the Panetta review.
  • A few weeks before the 2009 announcement of the Senate Intelligence Committee’s investigation, Abu Zubaydah’s attorney Brent Mickum was invited to meet with committee staffers in a secure conference room in the Senate Hart Office Building in Washington. Mickum recalled in an interview with Al Jazeera that committee staffers were interested in Abu Zubaydah’s recollections. “The committee was talking about torture and whether it was effective,” Mickum said. “I was able to relate to them what Abu Zubaydah told me. We talked about where he was tortured. I told them where we thought he was. I told them that the government confirmed he was never a member of Al-Qaeda. The drawings were then passed around the room.” Mickum and his co-counsel, Amy Jacobsen, presented to the committee staffers a set of ink drawings on yellow legal paper marked top secret by the CIA. Abu Zubaydah, they said, made the sketches to depict his torture and the torture of two other high-value detainees. One of the highly detailed drawings, according to knowledgeable intelligence officials, depict Abu Zubaydah being waterboarded.

Thus far, no such assurances have been given, according to Al Jazeera’s sources, nor is there any indication that the Senate Intelligence Committee’s report would prompt a criminal investigation.
  • Chris Anders, senior legislative counsel for the American Civil Liberties Union, told Al Jazeera he's not surprised by the CIA's response, because many of those involved in the creation of the interrogation program still work at the agency and may fear being placed in legal jeopardy.  “Whatever is in the report is big enough and significant enough that the CIA has fought tooth and nail to keep it buried,” Anders said. “If what comes out in this report is as bad as some senators have said, it’s going to require a broader and deeper discussion about what took place, and it will be up to the president and Congress to lead the country through it, figure out what it means and how we need to respond to clean it up.”

And we knew uber patriot Edward Snowden had used Lavabit. Yet, it didn't occur to us that the Feds would shut demand their information and shut them down. We are fools. We take our freedom for granted and expect the Constitution to be upheld and adhered to. It's the law of the land, and no entity, public or private, can trump the law of the land. Yet, here we are. Totally trumped. No longer free. I feel like someone so used to the passing of night into day and back again, my freedom so caught up within the rhythms of the seasons and the passing of time that I am unable to see that it's become night time and darkness everywhere. There will be no return to sunlight unless we make it so.   • The Obama administration’s sweeping response to an alleged al Qaida plot – closing diplomatic posts in parts of Africa, the Middle East and Asia – suggests a terrorist organization that’s capable of striking virtually anywhere, not the one U.S. officials have depicted as a group that’s near defeat. Counterterrorism analysts said Monday that the U.S. government’s global response to a threat emanating from Yemen, home to al Qaida’s most active affiliate, was at odds with how dismissive President Barack Obama was in a speech in May, when he said that “not every collection of thugs that labels themselves as al Qaida will pose a credible threat to the United States.”That was only one of a series of public statements by Obama and his Cabinet members that played down the capabilities of al Qaida-linked groups. For at least the past two years, the administration has sought to reassure Americans that al Qaida is “on the run,” while counterterrorism experts were warning about the semiautonomous affiliates that have wreaked havoc in North Africa, Yemen, Iraq and Syria.

    Was the "intelligence" real that sparked the closing of embassies across the Mideast and Northern Africa or was it fabricated to beef up Obama Administration claims of necessity to conduct dragnet NSA surveillance of electronic communications? Although not mentioned in this McClatchy report, other media outlets have disclosed that the claimed intercept was of a 20-person al-Qaeda leadership telephone conference call, which would suggest -- if one were to accept that version as fact -- that al-Qaeda leadership is oblivious to the facts spilling out around the NSA scandal. Certainly, there has been no effort made by the Administration to brand such disclosures about the "intelligence" as fabricated, nor has there been a call for prosecution of the leaker(s). But the Administration can't have it both ways; either they have no real concern about alerting al-Qaeda to specific instances of surveillance that would allow discernment of surveillance methods, which conflicts with the claimed need for secrecy on the scope of surveillance; or [ii] the "intelligence" was fabricated, embassies were closed, and the  "intelligence" leaked  purely to defend the NSA surveillance program politically in the U.S.

    "What the hell just happened? That is the question that many Americans should be asking themselves following the news conference where Obama unveiled his plan for destroying the Bill of Rights to the U.S. Constitution. At first glance it appeared to be a case of Obama shamelessly using the deaths of innocents, and some live children as a backdrop, to push for the passage of radical gun control measures by Congress. Most of these have no chance of passing, yet, Obama's signing of Executive orders initiating 23 so called Executive actions on gun control seemed like an afterthought. Unfortunately, that is the real story, but it is generally being overlooked. The fact is that with a few strokes of his pen Obama set up the mechanisms he will personally use to not only destroy the Second Amendment to the Constitution, but also the First, Fourth, and Fifth Amendments. It will not matter what Congress does, Obama can and will act on his own, using these Executive actions, and will be violating both the Constitution and his oath of office when he does it. Here are the sections of the Executive Order that he will use: "1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background-check system." What exactly is relevant data? Does it include our medical records obtained through Obamacare, our tax returns, our political affiliations, our military background, and our credit history? I suggest that all of the above, even if it violates our fourth Amendment right to privacy will now be relevant data for determining if we are allowed to purchase a firearm. "2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background-check system." This should be read in conjunction with section 16 of the order that says: "16. Clarify that the Affordable Care Act does not prohibit doctors
