Germany, US to negotiate 'no-spy' agreement | News | DW.DE | 12.08.2013 - 0 views

  • Germany and the US are to start talks on an anti-spying agreement, Germany's chancellery minister Ronald Pofalla has said. The announcement came as he testified on the government's role in the NSA scandal in parliament. Pofalla, who is responsible for coordinating the various intelligence services in Germany, told a parliamentary committee on Monday that the US had offered talks on a no-spy agreement, which showed that the US was serious about adhering to German law on German soil. "This offer could have never been made if the Americans' assurances that they will stick to German law in Germany wasn't actually true," he told the committee. Pofalla insisted that the allegations against the NSA and Germany's foreign intelligence service the BND had been refuted, as the NSA had declared in writing that it is prepared to observe German law in Germany. Pofalla also told parliamentarians that both British and US intelligence agencies had assured the government that there was no comprehensive spying and wiretapping by their services in Germany. "Unlike many erroneous statements to the contrary, the basic rights of millions of Germans are not being violated," Pofalla said, adding that, in the government's view, the spying allegations against the US and the UK were now "off the table."

DEA Global Surveillance Dragnet Exposed; Access to Data Likely Continues - The Intercept - 0 views

  • Secret mass surveillance conducted by the Drug Enforcement Administration is falling under renewed scrutiny after fresh revelations about the broad scope of the agency’s electronic spying. On Tuesday, USA Today reported that for more than two decades, dating back to 1992, the DEA and the Justice Department “amassed logs of virtually all telephone calls from the USA to as many as 116 countries linked to drug trafficking.” Citing anonymous current and former officials “involved with the operation,” USA Today reported that Americans’ calls were logged between the United States and targeted countries and regions including Canada, Mexico, and Central and South America.
  • The DEA’s data dragnet was apparently shut down by Attorney General Eric Holder in September 2013. But on Wednesday, following USA Today’s report, Human Rights Watch launched a lawsuit against the DEA over its bulk collection of phone records and is seeking a retrospective declaration that the surveillance was unlawful. The latest revelations shine more light on the broad scope of the DEA’s involvement in mass surveillance programs, which can be traced back to a secret program named “Project Crisscross” in the early 1990s, as The Intercept previously revealed. Documents from National Security Agency whistleblower Edward Snowden, published by The Intercept in August last year, showed that the DEA was involved in collecting and sharing billions of phone records alongside agencies such as the NSA, the CIA and the FBI.
  • The vast program reported on by USA Today shares some of the same hallmarks of Project Crisscross: it began in the early 1990s, was ostensibly aimed at gathering intelligence about drug trafficking, and targeted countries worldwide, with focus on Central and South America. It is also reminiscent of the so-called Hemisphere Project, a DEA operation revealed in September 2013 by The New York Times, which dated as far back as 1987, and used subpoenas to collect vast amounts of international call records every day. There is crossover, too, with a DEA database called DICE, revealed by Reuters in August 2013, which reportedly contains phone and Internet communication records gathered by the DEA through subpoenas and search warrants nationwide. The precise relationship between Crisscross, DICE, Hemisphere and the surveillance program revealed by USA Today is unclear. Whether or not they were part of a single overarching operation, the phone records and other data collected by each were likely accessible to DEA agents through the same computer interfaces and search and analysis tools.

  • A Justice Department spokesman told Reuters Wednesday that “all of the information has been deleted” and that the DEA was “no longer collecting bulk telephony metadata from U.S. service providers.” What the spokesman did not say is that the DEA has access to troves of phone records from multiple sources — and not all of them are obtained from U.S. service providers. As The Intercept’s reporting on Project Crisscross revealed, the DEA has had large-scale access to data covertly collected by the NSA, CIA and other agencies for years. According to NSA documents obtained by Snowden, the DEA can sift through billions of metadata records collected by other agencies about emails, phone calls, faxes, Internet chats and text messages using systems named ICREACH and CRISSCROSS/PROTON.
  • Notably, the DEA spying reported by USA Today encompassed phone records collected by the DEA using administrative subpoenas to obtain data from phone companies without the approval of a judge. The phone records collected by the agency as part of Project Hemisphere and the data stored on the DICE system were also collected through subpoenas and warrants. But ICREACH alone was designed to handle two to five billion new records every day — the majority of them not collected using any conventional search warrant or a subpoena. Instead, most of the data accessible to the DEA through ICREACH is vacuumed up by the NSA using Executive Order 12333, a controversial Reagan-era presidential directive that underpins several NSA bulk surveillance operations that monitor communications overseas. The 12333 surveillance takes place with no court oversight and has received minimal Congressional scrutiny because it is targeted at foreign, not domestic, communication networks.
  • This means that some of the DEA’s access to mass surveillance data — records collected in bulk through subpoenas or warrants — may have been shut down by Holder in 2013. But it is likely that the agency still has the ability to tap into other huge data repositories, and questions remain about how that access is being used.

Concurrently, a document was produced by the White House that mentioned that the forerunners of today's "fusion centers" would be created to begin trawling government databases for information to wage that war, including medical records held by the then-Veterans Administration. I''ve been keeping an eye on those rascals ever since. Believe me, we have merely scratched the surface of a very few of the Feds' "haystacks." There are very many to go before they're all rooted out into the sunlight.

The Most Important Surveillance Order We Know Almost Nothing About | American Civil Liberties Union - 0 views

  • Over the last seven months, we have learned an incredible amount about the government's post-9/11 surveillance efforts. But there is a crucial gap in our basic understanding. We now know, for example, a good deal about how the government conducts surveillance that targets Americans, and about surveillance of foreigners that sweeps up Americans' international communications when the actual surveillance takes place on U.S. soil (for example, from a Google facility in the United States). But we still know very little about Executive Order 12,333, which governs the NSA's surveillance abroad — even when that surveillance sweeps up Americans' communications. To fill that gap, the ACLU, along with the Media Freedom and Information Access Clinic at Yale Law School, today filed a Freedom of Information Act lawsuit demanding that the government release basic information about its use of Executive Order 12,333 to conduct surveillance of Americans' international communications. Why is Executive Order 12,333 so important? Here is how we explained it in our complaint (filed today in federal court in New York):
  • Although EO 12,333 permits the government to target foreigners abroad for surveillance, recent revelations have confirmed that the government interprets that authority to permit sweeping monitoring of Americans' international communications. How the government conducts this surveillance, and whether it appropriately accommodates the constitutional rights of American citizens and residents whose communications are intercepted in the course of that surveillance, are matters of great public significance and concern. While the government has released several documents describing the rules that govern its collection and use of Americans' international communications under statutory authorities regulating surveillance on U.S. soil, little information is publicly available regarding the rules that apply to surveillance of Americans' international calls and emails under EO 12,333. That gap in public knowledge is particularly troubling in light of recent revelations, which make clear that the NSA is collecting vast quantities of data worldwide pursuant to EO 12,333. For instance, recent news reports indicate that, relying on the executive order, the NSA is collecting: nearly 5 billion records per day on the location of cell phones, including Americans' cell phones; hundreds of millions of contact lists or address books from personal email and instant messaging accounts; and information from Google and Yahoo user accounts as that information travels between those companies' data centers located abroad.
  • The core of the problem is that the NSA has, for years, relied upon its authority to gather foreign intelligence as permission to conduct sweeping surveillance of Americans' international communications. We know that this happens under the laws that govern surveillance on U.S. soil, and recent revelations confirm that it happens — perhaps to an even greater extent — in the surveillance that takes place abroad under Executive Order 12,333. Moreover, the rules that govern surveillance under the executive order are of particular concern because that surveillance is not meaningfully overseen by Congress, and it is not overseen at all by the Foreign Intelligence Surveillance Court. In other words, the executive is conducting surveillance under its own executive order without any real oversight. We now know too well that unchecked surveillance authority can lead to dangerous overreach. That's why we are fighting for the release of documents that would shed light on the internal rules that the executive has set for itself when it monitors international communications abroad — including Americans' international communications.

"Disreputable if Not Outright Illegal": The National Security Agency versus Martin Luther King, Muhammad Ali, Art Buchwald, Frank Church, et al. - 0 views

  • Washington, D.C., September 25, 2013 – During the height of the Vietnam War protest movements in the late 1960s and early 1970s, the National Security Agency tapped the overseas communications of selected prominent Americans, most of whom were critics of the war, according to a recently declassified NSA history. For years those names on the NSA's watch list were secret, but thanks to the decision of an interagency panel, in response to an appeal by the National Security Archive, the NSA has released them for the first time. The names of the NSA's targets are eye-popping. Civil rights leaders Dr. Martin Luther King and Whitney Young were on the watch list, as were the boxer Muhammad Ali, New York Times journalist Tom Wicker, and veteran Washington Post humor columnist Art Buchwald. Also startling is that the NSA was tasked with monitoring the overseas telephone calls and cable traffic of two prominent members of Congress, Senators Frank Church (D-Idaho) and Howard Baker (R-Tennessee). The NSA history, American Cryptology during the Cold War, is a multi-volume study that covers the intersection of secret communications intelligence with Cold War history. The National Security Archive filed the initial mandatory declassification review request for the histories in 2006. The next year, when the NSA denied significant information from the histories the Archive filed an appeal. The Agency declassified more information in 2008 and the Archive posted the first three volumes on its Web site in 2008, with commentary by Matthew Aid. The NSA had denied so much, however, that the Archive filed a final appeal with the Interagency Security Classification Appeals Panel (ISCAP) that same year. Book I remains under appeal. Five years after the Archive's appeal, the ISCAP has compelled the NSA to release more information from Books II and III.

How The FBI Actually Does Much Of The NSA's Spying, But Is Keeping That Quiet | Techdirt - 0 views

  • For all the focus on the NSA of late, a few folks have been trying to remind everyone that the FBI is heavily involved in all of this and, in many ways, has an equally bad if not worse record in abusing the rights of Americans. Many of the programs discussed were to retrieve information by the FBI or the NSA, and it turns out that the FBI often does much of the dirty work for the NSA, including interfacing with various companies to get access to data. We'd mentioned recently how the FBI was pushing tech companies to install "port readers" at both telco and tech companies (though, many tech firms were resisting), and also that the FBI had been ramping up their use of malware. Shane Harris, over at Foreign Policy has a nice profile on the FBI's Data Intercept Technology Unit, or DITU, who handles most of this work. It repeats the story of the port readers, but adds how the DITU is often the unit that works with tech companies and then passes info along to the NSA -- so some companies don't even realize they're dealing with the NSA, believing it's just via the FBI (not that this would make things any better). It also notes that the DITU tends to be made up of a lot of ex-telco guys who know very specifically how the telco networks work, something that at least some people at the telcos may be uncomfortable with the government knowing (though, again, the telcos seem much more willing to open up to the government than the tech companies).
  • It's an interesting profile all around, but at the end it gets even more interesting, as an ex-law enforcement source that Harris talks to highlights that without investigating what the DITU is up to, Congress' exploration of what's going on will be very incomplete. The former law enforcement official said Holder and Mueller should have offered testimony and explained how the FBI works with the NSA. He was concerned by reports that the NSA had not been adhering to its own minimization procedures, which the Justice Department and the FBI review and vouch for when submitting requests to the Foreign Intelligence Surveillance Court. "Where they hadn't done what was represented to the court, that's unforgivable. That's where I got sick to my stomach," the former law enforcement official said. "The government's position is, we go to the court, apply the law -- it's all approved. That makes for a good story until you find out what was approved wasn't actually what was done." That makes it sound like even more bad behavior is going to be revealed eventually...

  • The National Security Agency on Saturday released a statement in answer to questions from a senator about whether it “has spied, or is … currently spying, on members of Congress or other American elected officials”, in which it did not deny collecting communications from legislators of the US Congress to whom it says it is accountable. In a letter dated 3 January, Senator Bernie Sanders of Vermont defined “spying” as “gathering metadata on calls made from official or personal phones, content from websites visited or emails sent, or collecting any other data from a third party not made available to the general public in the regular course of business”. The agency has been at the centre of political controversy since a former contractor, Edward Snowden, released thousands of documents on its activities to media outlets including the Guardian. In its statement, which comes as the NSA gears up for a make-or-break legislative battle over the scope of its surveillance powers, the agency pointed to “privacy protections” which it says it keeps on all Americans' phone records.

Such protections are built into and cut across the entire process. Members of Congress have the same privacy protections as all US persons. NSA is fully committed to transparency with Congress. Russ Tice, Bush-Era Whistleblower, Claims NSA Ordered Wiretap Of Barack Obama In 2004 - 0 views

Speaking on "The Boiling Frogs Show," Tice claimed the intelligence community had ordered surveillance on a wide range of groups and individuals, including high-ranking military officials, lawmakers and diplomats. "Here's the big one ... this was in summer of 2004, one of the papers that I held in my hand was to wiretap a bunch of numbers associated with a 40-something-year-old wannabe senator for Illinois," he said. "You wouldn't happen to know where that guy lives right now would you? It's a big white house in Washington, D.C. That's who they went after, and that's the president of the United States now."

While defenders of the program have insisted that there is nothing to suggest the government has the authority -- or desire -- to listen in on people's phone calls without a warrant, Tice told The Guardian that he believes the NSA has developed the capability "to collect all digital communications word for word."

She's ending it because, in the post-9/11 era, there's no viable and reliable way to assure that our email won't be read by the state — because she can't confidently communicate privately with her readers and tipsters and subjects and friends and family.

  • The extent of NSA surveillance is unknown, but what little we see is deeply unsettling. What our government says about it can't be believed; the government uses deliberately misleading language or outright lies about the scope of surveillance. So I don't blame Pamela Jones or question her decision. It's not the only way. I don't think it's my way, yet — though I am having some very concerned conversations about whether it's safe, or even ethical, to have confidential attorney-client communications by email.
  • I hope that Pamela's decision will arouse the interest, or attention, or outrage, of a few more people, who will in turn talk and write and advocate to get more people involved. Groklaw was a great resource; citizens will care that it's gone. (The government and its minions won't.) Pamela's choice will likely be met with the usual arguments: the government doesn't care about your emails. If you have nothing to hide you have nothing to worry about. This is about protecting us from terrorist attacks, not about snooping into Americans' communications. Don't you remember 9/11? I tire of responding to those. Let me offer one response that applies to all of them: I don't trust my government, I don't trust the people who work for my government, and I believe that the evidence suggests that it's irrational to offer such trust.

Snowden Documents Reveal Covert Surveillance and Pressure Tactics Aimed at WikiLeaks and Its Supporters - The Intercept - 0 views

  • Top-secret documents from the National Security Agency and its British counterpart reveal for the first time how the governments of the United States and the United Kingdom targeted WikiLeaks and other activist groups with tactics ranging from covert surveillance to prosecution. The efforts – detailed in documents provided previously by NSA whistleblower Edward Snowden – included a broad campaign of international pressure aimed not only at WikiLeaks founder Julian Assange, but at what the U.S. government calls “the human network that supports WikiLeaks.” The documents also contain internal discussions about targeting the file-sharing site Pirate Bay and hacktivist collectives such as Anonymous. One classified document from Government Communications Headquarters, Britain’s top spy agency, shows that GCHQ used its surveillance system to secretly monitor visitors to a WikiLeaks site. By exploiting its ability to tap into the fiber-optic cables that make up the backbone of the Internet, the agency confided to allies in 2012, it was able to collect the IP addresses of visitors in real time, as well as the search terms that visitors used to reach the site from search engines like Google.
  • Another classified document from the U.S. intelligence community, dated August 2010, recounts how the Obama administration urged foreign allies to file criminal charges against Assange over the group’s publication of the Afghanistan war logs. A third document, from July 2011, contains a summary of an internal discussion in which officials from two NSA offices – including the agency’s general counsel and an arm of its Threat Operations Center – considered designating WikiLeaks as “a ‘malicious foreign actor’ for the purpose of targeting.” Such a designation would have allowed the group to be targeted with extensive electronic surveillance – without the need to exclude U.S. persons from the surveillance searches.

The documents call into question the Obama administration’s repeated insistence that U.S. citizens are not being caught up in the sweeping surveillance dragnet being cast by the NSA. Under the broad rationale considered by the agency, for example, any communication with a group designated as a “malicious foreign actor,” such as WikiLeaks and Anonymous, would be considered fair game for surveillance.

  • The system used by GCHQ to monitor the WikiLeaks website – codenamed ANTICRISIS GIRL – is described in a classified PowerPoint presentation prepared by the British agency and distributed at the 2012 “SIGDEV Conference.” At the annual gathering, each member of the “Five Eyes” alliance – the United States, United Kingdom, Canada, Australia and New Zealand – describes the prior year’s surveillance successes and challenges. In a top-secret presentation at the conference, two GCHQ spies outlined how ANTICRISIS GIRL was used to enable “targeted website monitoring” of WikiLeaks (See slides 33 and 34). The agency logged data showing hundreds of users from around the world, including the United States, as they were visiting a WikiLeaks site –contradicting claims by American officials that a deal between the U.K. and the U.S. prevents each country from spying on the other’s citizens. The IP addresses collected by GCHQ are used to identify individual computers that connect to the Internet, and can be traced back to specific people if the IP address has not been masked using an anonymity service. If WikiLeaks or other news organizations were receiving submissions from sources through a public dropbox on their website, a system like ANTICRISIS GIRL could potentially be used to help track them down. (WikiLeaks has not operated a public dropbox since 2010, when it shut down its system in part due to security concerns over surveillance.)
  • It is unclear from the PowerPoint presentation whether GCHQ monitored the WikiLeaks site as part of a pilot program designed to demonstrate its capability, using only a small set of covertly collected data, or whether the agency continues to actively deploy its surveillance system to monitor visitors to WikiLeaks. It was previously reported in The Guardian that X-KEYSCORE, a comprehensive surveillance weapon used by both NSA and GCHQ, allows “an analyst to learn the IP addresses of every person who visits any website the analyst specifies.”

Sweden promptly launches an alleged rape investigation and Assange is forced by the UK courts to take refuge in the London embassy of Ecuador. Because of urging by the Obama administration aimed at chilling the the First Amendment rights of journalists. That should be grounds for impeachment.

NSA Critics, Right All Along | National Review Online - 1 views

  • Barton Gellman’s explosive story in last Thursday’s Washington Post revealed an unnerving audit of the National Security Agency that showed, among other things, that the federal government “broke privacy rules thousands of times per year” in conducting extensive and “unauthorized surveillance of Americans or foreign intelligence targets in the United States, both of which are restricted by statute and executive order.” Thus was put convincingly to bed the now-obselete notion that the NSA’s claim on the privacy of the righteous was merely declaratory.
  • Contrary to the self-satisfied insistence of America’s national-security apologists, none of the excuses made on behalf of the NSA are reassuring. To both their credit and discredit, people in the United States continue to exhibit a definite fear of accusing public servants of mendacity. It is therefore apparently beyond the pale to suggest that President Obama was “lying” when he promised that the “transparent” NSA has not been “actually abusing” its power and that “we don’t have a domestic spying program.” For the sake of this column, I shall defer to the tradition.
  • Nevertheless, if Obama was in fact not lying, then there remain only two reasonable options as to why his explanations and the truth are so far removed from one another: Either the president of the United States is so genuinely and worryingly out of touch with his own NSA that he has no idea what is going on, or his conception of what constitutes “abuse” is appreciably different enough from everyone else’s that he is unsuited to the high office he holds. As The Atlantic’s Conor Friedersdorf helpfully clarifies: “The 2,776 incidents of illegal surveillance” that the audit revealed “don’t mean that just 2,766 people had their rights violated — in just a single one of those 2,776 incidents, 3,000 people had their rights violated,” sometimes because operators inadvertently started tracking all calls into Washington, D.C. If this is not “abuse,” what is?

  • Defenders of the NSA's program always point to two things: it's all legal and it's all subject to oversight. Part of the "oversight" is the FISA "thumbs up" system that has approved every request for two years in a row. The other part of the "oversight" is Congress itself. Unfortunately, members of Congress have been lied to directly about the extent of the collections occurring under Section 215 (and 702), so that's one strike against the "oversight." Now, it appears that members of Congress are being selectively provided with information about the programs.

Israeli Drone Feeds Hacked By British and American Intelligence - 0 views

  • MERICAN AND BRITISH INTELLIGENCE secretly tapped into live video feeds from Israeli drones and fighter jets, monitoring military operations in Gaza, watching for a potential strike against Iran, and keeping tabs on the drone technology Israel exports around the world. Under a classified program code-named “Anarchist,” the U.K.’s Government Communications Headquarters, or GCHQ, working with the National Security Agency, systematically targeted Israeli drones from a mountaintop on the Mediterranean island of Cyprus. GCHQ files provided by former NSA contractor Edward Snowden include a series of “Anarchist snapshots” — thumbnail images from videos recorded by drone cameras. The files also show location data mapping the flight paths of the aircraft. In essence, U.S. and British agencies stole a bird’s-eye view from the drones.
  • Several of the snapshots, a subset collected in 2009 and 2010, appear to show drones carrying missiles. Although they are not clear enough to be conclusive, the images offer rare visual evidence to support reports that Israel flies attack drones — an open secret that the Israeli government won’t acknowledge. “There’s a good chance that we are looking at the first images of an armed Israeli drone in the public domain,” said Chris Woods, author of Sudden Justice, a history of drone warfare. “They’ve gone to extraordinary lengths to suppress information on weaponized drones.” The Intercept is publishing a selection of the drone snapshots in an accompanying article.
  • Additionally, in 2012, a GCHQ analyst reported “regular collects of Heron TP carrying weapons,” referring to a giant drone made by the state-owned Israel Aerospace Industries, known as IAI. Anarchist operated from a Royal Air Force installation in the Troodos Mountains, near Mount Olympus, the highest point on Cyprus. The Troodos site “has long been regarded as a ‘Jewel in the Crown’ by NSA as it offers unique access to the Levant, North Africa, and Turkey,” according to an article from GCHQ’s internal wiki. Last August, The Intercept published a portion of a GCHQ document that revealed that NSA and GCHQ tracked weapons signals from Troodos, and earlier reporting on the Snowden documents indicated that the NSA targeted Israeli drones and an Israeli missile system for tracking, but the details of the operations have not been previously disclosed. “This access is indispensable for maintaining an understanding of Israeli military training and operations and thus an insight to possible future developments in the region,” a GCHQ report from 2008 enthused. “In times of crisis this access is critical and one of the only avenues to provide up to the minute information and support to U.S. and Allied operations in the area.”

The two nations are close counterterrorism partners, and have a memorandum of understanding, dating back to 2009, that allows Israel access to raw communications data collected by the NSA. Yet they are nonetheless constantly engaged in a game of spy versus spy. Last month, the Wall Street Journal reported that, although President Obama had pledged to stop spying on friendly heads of state, the White House carved out an exception for Israeli Prime Minister Benjamin Netanyahu and other top Israeli officials. Michael Hayden, former head of the CIA and NSA, told the Journal that the intelligence relationship with Israel was “the most combustible mixture of intimacy and caution that we have.”

Obama's Lies, NSA Spies, and the Sons of Liberty: Will You Choose Dangerous Freedom or Peaceful Slavery? - 0 views

  • After such a 1984-esque send-up, it doesn’t even really matter what else Obama had to say in his speech about NSA reforms and the like. Rest assured, it was largely a pack of lies. Mind you, Obama said it eloquently enough and interspersed it with all the appropriately glib patriotic remarks about individual freedom and the need to defend the Constitution and securing the life of our nation while preserving our liberties. After all, Obama has proven to be very good at saying one thing and doing another, whether it’s insisting that “you can keep your health care plan,” that he’ll close Guantanamo, or that his administration’s controversial drone strikes only target terrorists and not civilians. When it comes to the NSA, Obama has been lying to the American people for quite some time now. There was the time he claimed the secret FISA court is “transparent.” Then he insisted that “we don’t have a domestic spying program.” And then, to top it all off, he actually insisted there was no evidence the NSA was “actually abusing” its power. As David Sirota writes for Salon: “it has now become almost silly to insinuate or assume that the president hasn’t also been lying. Why? Because if that’s true — if indeed he hasn’t been deliberately lying — then it means he has been dangerously, irresponsibly and negligently ignorant of not only the government he runs, but also of the news breaking around him.”
  • So in terms of Obama’s latest speech on the NSA, if you read between the lines—or just ignore the president’s words and pay attention to his actions—it’s clear that nothing is going to change. The NSA will continue to abuse its power by spying on Americans’ phone calls and emails. They will continue to collect metadata on our various communications and activities. And they will continue to carry out their surveillance in secret, with no attempts at transparency or accountability. The NSA will do so, no matter what Obama claims to the contrary, because this black ops-funded agency whose very existence is abhorrent to the Constitution has become a power unto itself. They no longer work for us or for the president, for that matter. He works for them. Remember, Obama is the chief executive of a super secretive surveillance state whose overarching purpose is to remain in power by any means available. As such, he and his surveillance state cohorts have far more in common with King George and the British government of his day than with the American colonists who worked hard to foment a rebellion and overthrow a despotic regime.
  • Indeed, Obama and his speechwriters would do well to brush up on their history. In doing so, they will find that the Sons of Liberty, the “small, secret surveillance committee” they conveniently liken to the NSA, was in fact an underground, revolutionary movement that fought the established government of its day, whose members were considered agitators, traitors and terrorists not unlike Edward Snowden.

UN Report Finds Mass Surveillance Violates International Treaties and Privacy Rights - The Intercept - 0 views

  • The United Nations’ top official for counter-terrorism and human rights (known as the “Special Rapporteur”) issued a formal report to the U.N. General Assembly today that condemns mass electronic surveillance as a clear violation of core privacy rights guaranteed by multiple treaties and conventions. “The hard truth is that the use of mass surveillance technology effectively does away with the right to privacy of communications on the Internet altogether,” the report concluded. Central to the Rapporteur’s findings is the distinction between “targeted surveillance” — which “depend[s] upon the existence of prior suspicion of the targeted individual or organization” — and “mass surveillance,” whereby “states with high levels of Internet penetration can [] gain access to the telephone and e-mail content of an effectively unlimited number of users and maintain an overview of Internet activity associated with particular websites.” In a system of “mass surveillance,” the report explained, “all of this is possible without any prior suspicion related to a specific individual or organization. The communications of literally every Internet user are potentially open for inspection by intelligence and law enforcement agencies in the States concerned.”
  • Mass surveillance thus “amounts to a systematic interference with the right to respect for the privacy of communications,” it declared. As a result, “it is incompatible with existing concepts of privacy for States to collect all communications or metadata all the time indiscriminately.” In concluding that mass surveillance impinges core privacy rights, the report was primarily focused on the International Covenant on Civil and Political Rights, a treaty enacted by the General Assembly in 1966, to which all of the members of the “Five Eyes” alliance are signatories. The U.S. ratified the treaty in 1992, albeit with various reservations that allowed for the continuation of the death penalty and which rendered its domestic law supreme. With the exception of the U.S.’s Persian Gulf allies (Saudi Arabia, UAE and Qatar), virtually every major country has signed the treaty. Article 17 of the Covenant guarantees the right of privacy, the defining protection of which, the report explained, is “that individuals have the right to share information and ideas with one another without interference by the State, secure in the knowledge that their communication will reach and be read by the intended recipients alone.”
  • The report’s key conclusion is that this core right is impinged by mass surveillance programs: “Bulk access technology is indiscriminately corrosive of online privacy and impinges on the very essence of the right guaranteed by article 17. In the absence of a formal derogation from States’ obligations under the Covenant, these programs pose a direct and ongoing challenge to an established norm of international law.” The report recognized that protecting citizens from terrorism attacks is a vital duty of every state, and that the right of privacy is not absolute, as it can be compromised when doing so is “necessary” to serve “compelling” purposes. It noted: “There may be a compelling counter-terrorism justification for the radical re-evaluation of Internet privacy rights that these practices necessitate. ” But the report was adamant that no such justifications have ever been demonstrated by any member state using mass surveillance: “The States engaging in mass surveillance have so far failed to provide a detailed and evidence-based public justification for its necessity, and almost no States have enacted explicit domestic legislation to authorize its use.”

  • Instead, explained the Rapporteur, states have relied on vague claims whose validity cannot be assessed because of the secrecy behind which these programs are hidden: “The arguments in favor of a complete abrogation of the right to privacy on the Internet have not been made publicly by the States concerned or subjected to informed scrutiny and debate.” About the ongoing secrecy surrounding the programs, the report explained that “states deploying this technology retain a monopoly of information about its impact,” which is “a form of conceptual censorship … that precludes informed debate.” A June report from the High Commissioner for Human Rights similarly noted “the disturbing lack of governmental transparency associated with surveillance policies, laws and practices, which hinders any effort to assess their coherence with international human rights law and to ensure accountability.” The rejection of the “terrorism” justification for mass surveillance as devoid of evidence echoes virtually every other formal investigation into these programs. A federal judge last December found that the U.S. Government was unable to “cite a single case in which analysis of the NSA’s bulk metadata collection actually stopped an imminent terrorist attack.” Later that month, President Obama’s own Review Group on Intelligence and Communications Technologies concluded that mass surveillance “was not essential to preventing attacks” and information used to detect plots “could readily have been obtained in a timely manner using conventional [court] orders.”
  • Three Democratic Senators on the Senate Intelligence Committee wrote in The New York Times that “the usefulness of the bulk collection program has been greatly exaggerated” and “we have yet to see any proof that it provides real, unique value in protecting national security.” A study by the centrist New America Foundation found that mass metadata collection “has had no discernible impact on preventing acts of terrorism” and, where plots were disrupted, “traditional law enforcement and investigative methods provided the tip or evidence to initiate the case.” It labeled the NSA’s claims to the contrary as “overblown and even misleading.” While worthless in counter-terrorism policies, the UN report warned that allowing mass surveillance to persist with no transparency creates “an ever present danger of ‘purpose creep,’ by which measures justified on counter-terrorism grounds are made available for use by public authorities for much less weighty public interest purposes.” Citing the UK as one example, the report warned that, already, “a wide range of public bodies have access to communications data, for a wide variety of purposes, often without judicial authorization or meaningful independent oversight.”
  • The report was most scathing in its rejection of a key argument often made by American defenders of the NSA: that mass surveillance is justified because Americans are given special protections (the requirement of a FISA court order for targeted surveillance) which non-Americans (95% of the world) do not enjoy. Not only does this scheme fail to render mass surveillance legal, but it itself constitutes a separate violation of international treaties (emphasis added): The Special Rapporteur concurs with the High Commissioner for Human Rights that where States penetrate infrastructure located outside their territorial jurisdiction, they remain bound by their obligations under the Covenant. Moreover, article 26 of the Covenant prohibits discrimination on grounds of, inter alia, nationality and citizenship. The Special Rapporteur thus considers that States are legally obliged to afford the same privacy protection for nationals and non-nationals and for those within and outside their jurisdiction. Asymmetrical privacy protection regimes are a clear violation of the requirements of the Covenant.
  • That principle — that the right of internet privacy belongs to all individuals, not just Americans — was invoked by NSA whistleblower Edward Snowden when he explained in a June, 2013 interview at The Guardian why he disclosed documents showing global surveillance rather than just the surveillance of Americans: “More fundamentally, the ‘US Persons’ protection in general is a distraction from the power and danger of this system. Suspicionless surveillance does not become okay simply because it’s only victimizing 95% of the world instead of 100%.” The U.N. Rapporteur was clear that these systematic privacy violations are the result of a union between governments and tech corporations: “States increasingly rely on the private sector to facilitate digital surveillance. This is not confined to the enactment of mandatory data retention legislation. Corporates [sic] have also been directly complicit in operationalizing bulk access technology through the design of communications infrastructure that facilitates mass surveillance. ”
  • The latest finding adds to the growing number of international formal rulings that the mass surveillance programs of the U.S. and its partners are illegal. In January, the European parliament’s civil liberties committee condemned such programs in “the strongest possible terms.” In April, the European Court of Justice ruled that European legislation on data retention contravened EU privacy rights. A top secret memo from the GCHQ, published last year by The Guardian, explicitly stated that one key reason for concealing these programs was fear of a “damaging public debate” and specifically “legal challenges against the current regime.” The report ended with a call for far greater transparency along with new protections for privacy in the digital age. Continuation of the status quo, it warned, imposes “a risk that systematic interference with the security of digital communications will continue to proliferate without any serious consideration being given to the implications of the wholesale abandonment of the right to online privacy.” The urgency of these reforms is underscored, explained the Rapporteur, by a conclusion of the United States Privacy and Civil Liberties Oversight Board that “permitting the government to routinely collect the calling records of the entire nation fundamentally shifts the balance of power between the state and its citizens.”

  • For months, the American public has received a steady stream of new information detailing the massive scale and scope of the United States’ spying activities. Of course, maintaining a surveillance state powerful enough to reach into the inboxes of world leaders, friend and foe, is not cheap. Indeed, as the Washington Post revealed when it released portions of the so-called Black Budget, this year’s price tag on America’s spook infrastructure comes out to a whopping $52.6 billion. This is, of course, a tremendous sum – more than double the size of the Department of Agriculture, more than triple the size of NASA; the list goes on… But, what really puts this number into perspective is its average cost to each American taxpayer, or what I would call the NSA and associated agencies’ “rent.” Yes, the NSA’s rent, charged to every taxpayer living under its web of surveillance, comes out to an exorbitant $574 per year. If this is the price the federal government is charging American taxpayers to have their own privacy invaded, then I say the NSA’s rent is too damn high. Normally, at the end of one of these blogs, I would ask a rhetorical question like: “Washington, are you listening?” But, in this case, we know Washington is listening, and now we know how much we’re being charged for it.

House Intelligence Bill Fumbled Transparency - Federation Of American Scientists - 0 views

  • Intelligence community whistleblowers would have been able to submit their complaints to the Privacy and Civil Liberties Oversight Board (PCLOB) under a proposed amendment to the intelligence authorization act that was offered last week by Rep. Tulsi Gabbard (D-HI). This could have been an elegant solution to the whistleblowing conundrum posed by Edward Snowden. It made little sense for Snowden to bring his concerns about bulk collection of American phone records to the congressional intelligence committees, considering that they had already secretly embraced the practice. The PCLOB, by contrast, has staked out a position as an independent critical voice on intelligence policy. (And it has an unblemished record for protecting classified information.) The Board’s January 2014 report argued cogently and at length that the Section 215 bulk collection program was likely unlawful as well as ineffective. In short, the PCLOB seemed like a perfect fit for any potential whistleblower who might have concerns about the legality or propriety of current intelligence programs from a privacy or civil liberties perspective.
  • But when Rep. Gabbard offered her amendment to the intelligence authorization act last week, it was not voted down– it was blocked. The House Rules Committee declared that the amendment was “out of order” and could not be brought to a vote on the House floor. Several other amendments on transparency issues met a similar fate. These included a measure proposed by Rep. Adam Schiff to require reporting on casualties resulting from targeted killing operations, a proposal to disclose intelligence spending at the individual agency level, and another to require disclosure of the number of U.S. persons whose communications had been collected under FISA, among others. In dismay at this outcome, Rep. Rush Holt (D-NJ) and I lamented the “staggering failure of oversight” in a May 30 op-ed. See The House Committee on Intelligence Needs Oversight of Its Own, MSNBC.
  • The House did approve an amendment offered by Rep. John Carney (D-DE) to require the Director of National Intelligence “to issue a report to Congress on how to improve the declassification process across the intelligence community.” While the DNI’s views on the subject may indeed be of interest, the amendment failed to specify the problem it intended to address (erroneous classification standards? excessive backlogs? something else?), and so it is unclear exactly what is to be improved.

  • However, a more focused classification reform program may be in the works. Rep. Bennie Thompson (D-MS), the ranking member of the House Homeland Security Committee, said that he would introduce “a comprehensive security clearance reform bill” that would also address the need to shrink the national security classification system. The Thompson bill, which is to be introduced “in the coming weeks,” would “greatly expand the resources and responsibilities of the Public Interest Declassification Board,” Rep. Thompson said during the House floor debate on the intelligence bill on May 30. “A well-resourced and robust Board is essential to increasing accountability of the intelligence community,” he said.

    I don't agree that whistleblowers need a secret system for their complaints. Secrecy is the problem, not the solution.In a supposedly democratic republic, every bit of government secrecy runs directly contrary to the citizen's right to be know what their government is up to.  All of the NSA reform measures in Congress share a fundamental flaw: they focus on what the NSA is allowed to do in secret. Any sane legislative approach would begin by identifying and clarifying what digital privacy rights citizens have and the obligation of government agencies and the private sector to report violations to their victims. Then one can proceed to examine how intelligence agencies might function within those parameters.  But the approach in Congress has been a catfight over "NSA reform" with secrecy accepted as the norm and without consideration of citizens' privacy rights, not even their Constitutional rights. But it is our privacy laws and their enforcement that needs attention, not directions to the Dark Government that is still allowed to remain in the dark. In other words, it is the public that should be informed of whistleblowers' revelations, not selected members of Congress, not secret courts, not some Privacy and Civil Liberties Oversight Board whose public reports are only summaries with all data they examine hid from view.  Bring that Dark Government into the sunlight and then real reform can happen but not before.

Circuit formally ended an appeal in the case Tuesday, effectively returning control over the underlying lawsuit to U.S. District Court Judge Richard Leon.Leon could now act at any time to require the NSA to shut the program down, but such a move seems most likely after Thursday, when a hearing is scheduled on the suit filed by conservative activist Larry Klayman.
  • Nearly two years ago, Leon ruled that the NSA program--sometimes known as the Section 215 business records program--was likely unconstitutional and he ordered the program halted. That time he put his order on hold pending appeal, but at a hearing last month the judge sounded eager to issue a permanent injunction in the case before the program's scheduled end next month."The clock is running and there isn't much time between now and November 29," Leon told Klayman at the Sept. 2 session. "This court believes there are millions and millions of Americans whose constitutional rights have been and are being violated, but the window ... for action is very small ... It's time to move."
  • In May, the New York-based 2nd Circuit U.S. Court of Appeals ruled that the NSA phone metadata program was unlawful because the Patriot Act provision used to authorize it did not in fact provide authority for bulk collection of records largely unrelated to terrorism. The appeals court heard a new round of oral arguments on that case last month, focusing on the impact the law passed in June will have on the litigation.

  • In August, the D.C. Circuit overturned Leon's self-stayed injunction in the case. The three-judge panel didn't get into the substance of the legality of the NSA program, but focused on whether Klayman and his clients had enough facts to reasonably allege that they were subject to the program.Two judges said Klayman might be able to show standing. Leon appears to consider that issue resolved because Klayman recently added to the case a California law firm that used the only telecom provider which government lawyers concede took part in the program: Verizon Business Network Services.

France Targeted by NSA Spies and Parliament Passes Surveillance Law - 0 views

  • On Wednesday, France woke up to find that the National Security Agency had been snooping on the phones of its last three presidents. Top-secret documents provided by WikiLeaks to two media outlets, Mediapart and Libération, showed that the NSA had access to confidential conversations of France’s highest ranking officials, including the country’s current president, François Hollande; the prime minister in 2012, Jean-Marc Ayrault; and former presidents Nicolas Sarkozy and Jacques Chirac. Yet also today, the lower house of France’s legislature, the National Assembly, passed a sweeping surveillance law. The law provides a new framework for the country’s intelligence agencies to expand their surveillance activities. Opponents of the law were quick to mock the government for vigorously protesting being surveilled by one of the country’s closest allies while passing a law that gives its own intelligence services vast powers with what its opponents regard as little oversight. But for those who support the new law, the new revelations of NSA spying showed the urgent need to update the tools available to France’s spies.
  • The response from the French government today was firm but predictable. Senior intelligence officials will travel to the U.S. to meet their counterparts in Washington, while the U.S. ambassador in Paris was summoned to the Elysee Palace. A similar scenario played out in 2013, when Le Monde published Snowden documents that revealed some of the extent of American surveillance in France. Prime Minister Manuel Valls said today that he wants a “code of conduct” to guide the relationship between France and the U.S. on intelligence activities — but the government demanded the exact same thing almost two years ago. When The Intercept published NSA documents in March indicating the Five Eyes — the NSA’s core allies — were intercepting large swaths of internet traffic in France’s Pacific islands, an official protest from France was nowhere to be heard. Even when it appeared that France’s closest ally, Germany, was using its surveillance capabilities to spy, on behalf of the NSA, on France’s foreign affairs ministry and some of the country’s most strategic companies, French authorities remained silent.
  • Until the law was passed, France’s intelligence services operated almost without any laws to regulate them. Although the new law delivers a much-needed framework, its safeguards are regarded by many critics as insufficient. The powers of the oversight body in charge of the intelligence agencies have been slightly strengthened and it will be possible, if a citizen suspects she is being surveilled, to take her case before the Conseil d’Etat, France’s highest court. But other parts of the law have drawn controversy, including the way it defines the purposes the government can invoke to surveil French residents. The categories extend well beyond terrorism. Many opponents of the law think these guidelines are so broad that they could enable political surveillance. But the key point of disagreement is what the government calls “black boxes.” The law allows the use of government equipment inside Internet Service Providers and large web companies to analyze streams of metadata and find “terrorist” patterns and behaviors.

  • The country’s intelligence community got everything it wanted — almost. An amendment that would remove any oversight of surveillance of foreigners, targeting chief executives and foreign spies, had been demanded by France’s top spy, Bernard Bajolet, the director general of external security, during a hearing at the National Assembly a few weeks ago, but the government opposed it and managed to get rid of it before the final vote. Yet, the government added a last minute amendment that tears to pieces the meager whistleblower protection the bill was supposed to set up. The end result is that most of what France’s intelligence services have been doing in the dark is now authorized by law.
