The authors conclude that Israel is currently the greatest threat to US national interests because its nature and actions prevent normal US relations with Arab and Muslim countries and, to a growing degree, the wider international community. The study was commissioned by the US Intelligence Community comprising 16 American intelligence agencies with an annual budget in excess of $ 70 billion. The IC includes the departments of the Navy, Army, Air Force, Marine Corps, Coast Guard, Defense Intelligence Agency, Departments of Energy, Homeland Security, State, Treasury, Drug Enforcement Agency, Federal Bureau of Investigation, National Security Agency, National Geospatial Intelligence Agency, National Reconnaissance Agency and the Central Intelligence Agency commissioned the study.

Hacked Emails Prove Coordination Between Clinton Campaign and Super PACs - 0 views

  • The fact that political candidates are closely coordinating with friendly Super PACs — making a mockery of a central tenet of the Supreme Court’s 2010 Citizens United decision — is one of the biggest open secrets in Washington. Super PACs are only allowed to accept unlimited contributions on the condition that the money is spent independently of specific campaigns. The Federal Election Commission hasn’t reacted for a variety of reasons, including a lack of hard evidence, vague rules, and a partisan divide among the commissioners so bitter they can’t even agree to investigate obvious crimes. But newly disclosed hacked campaign documents published by WikiLeaks and a hacker who calls himself Guccifer 2.0 reveal in stark terms how Hillary Clinton’s staffers made Super PACs an integral part of her presidential campaign.
  • The emails show consistent, repeated efforts by the Clinton campaign to collaborate with Super PACs on strategy, research, attacks on political adversaries and fundraising. The cache also reveal meetings between the campaign and Priorities USA Action, and that campaign officials have helped with the group’s fundraising. The files were apparently hacked from a variety of Clinton staffers and have been posted online in recent weeks by Wikileaks and Guccifer 2.0. Obama administration intelligence officials have alleged, without providing evidence, that the email hacks were conducted on behalf of the Russian government in an attempt to disrupt the U.S. elections.

  • Correct the Record has long argued it could work directly with the Clinton campaign. When the group launched, it said it would only produce and distribute communications online, and that its work would therefore be exempt from FEC coordination rules. The Super PAC was recently the subject of a complaint filed with the Federal Elections Commission by the Campaign Legal Center, which called on regulators to investigate whether Clinton’s campaign has illegally coordinated with the group. The Campaign Legal Center, a nonpartisan watchdog organization, has also alleged that officials working for Donald Trump have similarly blurred the line between the campaign and one of its largest Super PACs, Make America Number 1, by employing common vendors. The Campaign Legal Center argued that Correct the Record has likely made “coordinated expenditures” that could be considered in-kind contributions to the Clinton campaign — such as its spending on “opposition research, message development, surrogate training, reporter pitches, media booking, video production, ‘rapid response’ press outreach, and other ‘earned media.’” “These documents affirm what we’ve been saying all along about Correct the Record,” said Brendan Fischer, an associate counsel at the Campaign Legal Center. “They are basically operating as an arm of the Clinton campaign.”
  • While Correct the Record has argued it is exempt from FEC rules, Clinton herself has said she does not work with Priorities USA Action. That Super PAC has spent millions of dollars on independent expenditures, including six-figure media advertising buys, to boost Clinton’s candidacy. The group has raised over $133 million through individual donations as large as $6 million. As other media outlets have reported, Marc Elias, the Clinton campaign attorney, provided a memo with guidance on how the campaign could solicit funds for Priorities USA Action. The memo notes that campaign staffers would have to use certain language when trying to raise money for the Super PAC:

WikiLeaks: Clinton Campaign Panics After Obama's Statements On Private Email Server - 0 views

  • An email hacked from the private Gmail account of John Podesta, Hillary Clinton’s campaign chair, is raising new questions about when President Barack Obama found out about Clinton’s private email server. In a March 7, 2015 interview with CBS News’ senior White House correspondent Bill Plante, Obama said he hadn’t been aware of Clinton’s use of a private email server during her time as secretary of state until “the same time everybody else learned it through news reports.”
  • On Tuesday, WikiLeaks’ highlighted a March 7, 2015 email found in its archives of Podesta’s emails, writing: “Clinton campaign panics after Obama misleads public over Clinton emails.”
  • In the original email sent shortly after the CBS interview aired, Josh Schwerin, spokesperson for Hillary For America, Clinton’s 2016 presidential campaign, alerted Jennifer Palmieri, the campaign’s director of communications, about Obama’s statements. Schwerin wrote: “Jen you probably have more on this but it looks like POTUS just said he found out HRC was using her personal email when he saw it in the news.” The email also includes a link to a March 7, 2015 tweet from Katherine Miller, a political editor at Buzzfeed. “I have some questions here,” she wrote about Obama’s statement.

  • Schwerin’s email was also sent to Nicholas Merrill, Clinton’s traveling press secretary, and other close Clinton associates. Merrill, in turn, forwarded the email to Cheryl Mills, former White House counsel to Bill Clinton and a top aide to Hillary Clinton. Hours later, Mills forwarded the email chain to Podesta, writing: “we need to clean this up – he has emails from her – they do not say state.gov” On Tuesday, Jon Scott, host of Fox News’ “Happening Now,” said the email showed Mills going into “damage control mode.” He added: “That is going to be the matter of some discussion, you would imagine, on Capitol Hill. What the president told the world versus what he may have known or perhaps should have known.” Some conservative news sources have suggested the email chain shows the president lied or was involved in a cover-up about Clinton’s private email server.

FBI Agents: Comey 'Stood In The Way' Of Clinton Investigation | The Daily Caller - 0 views

  • FBI agents say the bureau is alarmed over Director James Comey deciding not to suggest that the Justice Department prosecute Hillary Clinton over her mishandling of classified information. According to an interview transcript given to The Daily Caller, provided by an intermediary who spoke to two federal agents with the bureau last Friday, agents are frustrated by Comey’s leadership.
  • “This is a textbook case where a grand jury should have convened but was not. That is appalling,” an FBI special agent who has worked public corruption and criminal cases said of the decision. “We talk about it in the office and don’t know how Comey can keep going.” The agent was also surprised that the bureau did not bother to search Clinton’s house during the investigation. “We didn’t search their house. We always search the house. The search should not just have been for private electronics, which contained classified material, but even for printouts of such material,” he said. “There should have been a complete search of their residence,” the agent pointed out. “That the FBI did not seize devices is unbelievable. The FBI even seizes devices that have been set on fire.” Another special agent for the bureau that worked counter-terrorism and criminal cases said he is offended by Comey’s saying: “we” and “I’ve been an investigator.”

After becoming a U.S. Attorney in the Southern District of New York, Comey’s career moved through the U.S. Attorney’s Office until he became Deputy Attorney General during the George W. Bush administration. After Bush left office, Comey entered the private sector and became general counsel and Senior Vice President for Lockheed Martin, among other private sector posts. President Barack Obama appointed him to FBI director in 2013 replacing out going-director Robert Mueller. “Comey was never an investigator or special agent. The special agents are trained investigators and they are insulted that Comey included them in ‘collective we’ statements in his testimony to imply that the SAs agreed that there was nothing there to prosecute,” the second agent said. “All the trained investigators agree that there is a lot to prosecuted but he stood in the way.” He added, “The idea that [the Clinton/e-mail case] didn’t go to a grand jury is ridiculous.” According to Washington D.C. attorney Joe DiGenova, more FBI agents will be talking about the problems at bureau and specifically the handling of the Clinton case by Comey when Congress comes back into session and decides to force them to testify by subpoena.

  • DiGenova told WMAL radio’s Drive at Five last week, “People are starting to talk. They’re calling their former friends outside the bureau asking for help. We were asked to day to provide legal representation to people inside the bureau and agreed to do so and to former agents who want to come forward and talk. Comey thought this was going to go away.” He explained, “It’s not. People inside the bureau are furious. They are embarrassed. They feel like they are being led by a hack but more than that that they think he’s a crook. They think he’s fundamentally dishonest. They have no confidence in him. The bureau inside right now is a mess.” He added, “The most important thing of all is that the agents have decided that they are going to talk.”

Reagan's Iran-Contra affair 30 years later has lessons for Trump - 0 views

  • Exactly thirty years ago, President Ronald Reagan announced to the nation – after weeks of denials – that members of his White House staff had engaged in a web of covert intrigue linking illicit U.S. support for a guerrilla war in Central America with an illegal and politically explosive arms-for-hostages bargain with the Islamic Republic of Iran. The revelation quickly led to a new phrase – “Iran-Contra” – which became synonymous with political hubris, government incompetence, and dishonesty in the public sphere. Over the years, the National Security Archive has published major document collections, books, and web postings about Iran-Contra that expand on all of these areas of inquiry (see links in left column). Today, the Archive posts a selection of materials that spotlight the last of the elements above – deceitfulness – whose relevance has sadly become more pronounced after a bruising political season marked by examples and allegations of widespread public contempt for facts, evidence and the truth.
  • Today’s focus also follows Oxford Dictionaries’ selection earlier this month of the term “post-truth” as its Word of the Year, a choice it traced indirectly to the Reagan-era scandal: “Post-truth seems to have been first used in this meaning in a 1992 essay by the late Serbian-American playwright Steve Tesich in The Nation magazine. Reflecting on the Iran-Contra scandal and the Persian Gulf War, Tesich lamented that ‘we, as a free people, have freely decided that we want to live in some post-truth world.’” (See The Nation, January 6/13, 1992)  The historical record, including thousands of documents and hundreds of hours of testimony that are not possible to reproduce here, bears out the connection between the attitudes evident during the mid-1980s and what Americans have been witnessing in 2016. The Iran-Contra affair inundated national news coverage starting a few weeks before the November 1986 press conference (as stories about the Contra and Iran operations leaked out) and lasting through Summer 1987. A galvanized media that had faced criticisms for its lax treatment of Reagan seemed eager to make up for it now that it finally had a story of Watergate proportions. Picking up on aspects of secret administration policy that only a few intrepid reporters had noticed before, TV and print outlets uncovered sometimes shocking new information about the lengths to which the Reagan administration had gone to press the Contra war in and around Nicaragua without authorization from Congress. Similar disclosures came out about National Security Council staff-supervised contacts with Iranian intermediaries and Israeli counterparts, along with covert missile shipments from U.S. military stocks to Iran. Various committees in Congress hastily held hearings that produced more discoveries along the same lines. Eventually, a joint congressional select committee was convened and an independent counsel appointed by the courts, both of which uncovered volumes of invaluable documentary evidence of what had transpired, including:

A whirlwind day in D.C. showcases Trump's unorthodox views and shifting tone - The Washington Post - 0 views

  • Donald Trump endorsed an unabashedly noninterventionist approach to world affairs Monday during a day-long tour of Washington, casting doubt on the need for the North Atlantic Treaty Organization and expressing skepticism about a muscular U.S. military presence in Asia. The foreign policy positions — outlined in a meeting with the editorial board of The Washington Post — came on a day when Trump set aside the guerrilla tactics and showman bravado that have powered his campaign to appear as a would-be presidential nominee, explaining his policies, accepting counsel and building bridges to Republican elites.

Bipartisan Letter Urging President Obama to Get Congressional Approval Before Striking Syria - 0 views

  • Dear Mr. President,  We strongly urge you to consult and receive authorization from Congress before ordering the use of U.S. military force in Syria. Your responsibility to do so is prescribed in the Constitution and the War Powers Resolution of 1973.  While the Founders wisely gave the Office of the President the authority to act in emergencies, they foresaw the need to ensure public debate – and the active engagement of Congress – prior to committing U.S. military assets. Engaging our military in Syria when no direct threat to the United States exists and without prior congressional authorization would violate the separation of powers that is clearly delineated in the Constitution.  Mr. President, in the case of military operations in Libya you stated that authorization from Congress was not required because our military was not engaged in “hostilities.” In addition, an April 1, 2011, memorandum to you from your Office of Legal Counsel concluded: “…President Obama could rely on his constitutional power to safeguard the national interest by directing the anticipated military operations in Libya—which were limited in their nature, scope, and duration—without prior congressional authorization.” We view the precedent this opinion sets, where “national interest” is enough to engage in hostilities without congressional authorization, as unconstitutional. If the use of 221 Tomahawk cruise missiles, 704 Joint Direct Attack Munitions, and 42 Predator Hellfire missiles expended in Libya does not constitute “hostilities,” what does?  If you deem that military action in Syria is necessary, Congress can reconvene at your request. We stand ready to come back into session, consider the facts before us, and share the burden of decisions made regarding U.S. involvement in the quickly escalating Syrian conflict.  Sincerely,

    The page says that 116 members of Congress signed this letter (their names follow the quoted portion) but latest figure I saw was that 150 are now on board.  The letter is far tougher than has been reported. They've put it very bluntly both on what he did in Libya without consulting Congress and on the separation of powers in the Constitution that allocates to Congress the power to declare war, not to the Executive.

Has the NSA Wiretapping Violated Attorney-Client Privilege? | The Nation - 0 views

  • The first time Adis Medunjanin tried to call Robert C. Gottlieb in mid-2009, Gottlieb was out of the office. Medunjanin was agitated. He had to speak to an attorney. Gottlieb’s assistant told him Gottlieb would be back soon. When Medunjanin spoke to the lawyer a little later, he was told he might need legal representation. He thought he might be under investigation. Over the next six months and in forty-two phone calls, Medunjanin sought legal advice from Gottlieb. When he was arrested in January 2010 on charges that he tried to bomb the New York subway, it was Gottlieb who defended him, receiving security clearance to review government documents pertinent to the case in the process. Gottlieb was preparing Medunjanin’s defense when a federal officer in charge of information distribution e-mailed him that there was new classified information he needed to review at the US Eastern District Court in Brooklyn. “I went over to the Brooklyn Federal courthouse, went up to the secured room, gained entry with the secret security codes, opened the file cabinet that is also secure and in the second drawer was a CD,” Gottlieb told me. On that CD were recordings of every single one of his forty-two phone calls with Medunjanin before he was taken into custody and indicted on January 7, 2010.
  • Such calls are normally sacrosanct under the principle of attorney-client privilege, the ability to speak confidentially with your lawyer. But a leak to The Guardian last summer of National Security Agency (NSA) procedures that are supposed to protect privileged calls showed that some attorney-client privileged calls are not subject to internal rules that detail the instances when a wiretap should be turned off. A later version of the procedures declassified by the NSA last August contains the same language. These “minimization” procedures, as they are known, are the rules and regulations for wiretaps under the Foreign Intelligence Surveillance Act (FISA). They tell NSA agents when they can listen, and when they have to turn the tap off, when they can record and when they should not be recording. There are rules for which kinds of communications can be monitored—for example, domestic communications are off limits, although communications from agents of foreign powers and suspected terrorists don’t count as domestic—and there is a section that provides for the protection of attorney-client calls.
  • Section four of the declassified 2011 guidelines is the part of that document that governs wiretapping attorney-client calls. At first glance, it seems quite clear: when the agent realizes that he or she is monitoring an attorney-client communication, “monitoring of that communication will cease and the communication will be identified as an attorney-client communication in a log maintained for that purpose.” But given a second reading, section four doesn’t apply to all attorney-client calls. It provides only for the minimization (and protection) of the calls of “a person who is known to be under criminal indictment in the United States”—someone who has already been charged under US law. This is because indicted persons have a Sixth Amendment right to counsel. People who aren’t indicted don’t have this right, and so their calls are not minimized. When I asked an NSA press officer, Vanee’ M. Vines, how attorney-client privilege was protected, she referred me to the Department of Justice. I left several messages, but the DOJ never contacted me back.

When the CIA's Empire Struck Back | Global Research - 0 views

  • In the mid-1970s, Rep. Otis Pike led a brave inquiry to rein in the excesses of the national security state. But the CIA and its defenders accused Pike of recklessness and vowed retaliation, assigning him to a political obscurity that continued to his recent death. Otis Pike, who headed the House of Representatives’ only wide-ranging and in-depth investigation into intelligence agency abuses in the 1970s, died on Jan. 20. A man who should have received a hero’s farewell passed with barely a mention. To explain the significance of what he did, however, requires a solid bit of back story.
  • Rep. Otis Pike, D-New York, took over what became known as the “Pike Committee.” Under Pike, the committee put some real teeth into the investigation, so much so that Ford’s White House and the CIA went on a public-relations counterattack, accusing the panel and its staff of recklessness. The CIA’s own historical review acknowledged as much:
  • “The final draft report of the Pike Committee reflected its sense of frustration with the Agency and the executive branch. Devoting an entire section of the report to describing its experience, the committee characterized Agency and White House cooperation as ‘virtually nonexistent.’ The report asserted that the executive branch practiced ‘footdragging, stonewalling, and deception’ in response to committee requests for information. It told the committee only what it wanted the committee to know. It restricted the dissemination of the information and ducked penetrating questions.”

  • Essentially, the CIA and the White House forbade the Pike report’s release by leaning on friendly members of Congress to suppress the report, which a majority agreed to do. But someone leaked a copy to CBS News reporter Daniel Schorr, who took it to the Village Voice, which published it on Feb. 16, 1976. Mitchell Rogovin, the CIA’s Special Counsel for Legal Affairs, threatened Pike’s staff director, saying, “Pike will pay for this, you wait and see … We [the CIA] will destroy him for this. … There will be political retaliation. Any political ambitions in New York that Pike had are through. We will destroy him for this.” And, indeed, Pike’s political career never recovered. Embittered and disillusioned by the failure of Congress to stand up to the White House and the CIA, Pike did not seek reelection in 1978 and retired into relative obscurity.
  • But what did Pike’s report say that was so important to generate such hostility? The answer can be summed up with the opening line from the report: “If this Committee’s recent experience is any test, intelligence agencies that are to be controlled by Congressional lawmaking are, today, beyond the lawmaker’s scrutiny.” In other words, Otis Pike was our canary in the coal mine, warning us that the national security state was literally out of control, and that lawmakers were powerless against it. Pike’s prophetic statement was soon ratified by the fact that although former CIA Director Richard Helms was charged with perjury for lying to Congress about the CIA’s cooperation with ITT in the overthrow of Chilean President Salvador Allende, Helms managed to escape with a suspended sentence and a  $2,000 fine.
  • As Pike’s committee report stated: “These secret agencies have interests that inherently conflict with the open accountability of a political body, and there are many tools and tactics to block and deceive conventional Congressional checks. Added to this are the unique attributes of intelligence — notably, ‘national security,’ in its cloak of secrecy and mystery — to intimidate Congress and erode fragile support for sensitive inquiries. “Wise and effective legislation cannot proceed in the absence of information respecting conditions to be affected or changed. Nevertheless, under present circumstances, inquiry into intelligence activities faces serious and fundamental shortcomings. “Even limited success in exercising future oversight requires a rethinking of the powers, procedures, and duties of the overseers. This Committee’s path and policies, its plus and minuses, may at least indicate where to begin.” The Pike report revealed the tactics that the intelligence agencies had used to prevent oversight, noting the language was “always the language of cooperation” but the result was too often “non-production.” In other words, the agencies assured Congress of cooperation, while stalling, moving slowly, and literally letting the clock run out on the investigation. The Pike Committee, alone among the other investigations, refused to sign secrecy agreements with the CIA, charging that as the representatives of the people they had authority over the CIA, not the other way around.

Specifically, the president’s assassination power “does not require that the US have clear evidence that a specific attack . . . will take place in the immediate future”. The US routinely assassinates its targets not when they are engaged in or plotting attacks but when they are at home, with family members, riding in a car, at work, at funerals, rescuing other drone victims, etc.
  • “This is a chilling document” because “it argues that the government has the right to carry out the extrajudicial killing of an American citizen” and the purported limits “are elastic and vaguely defined, and it’s easy to see how they could be manipulated.”

A top-secret document, obtained by the former N.S.A. contractor Edward J. Snowden, shows that an American law firm was monitored while representing a foreign government in trade disputes with the United States. The disclosure offers a rare glimpse of a specific instance in which Americans were ensnared by the eavesdroppers, and is of particular interest because lawyers in the United States with clients overseas have expressed growing concern that their confidential communications could be compromised by such surveillance.   • In a 13-page brief filed on Friday in federal court in Washington, DC, government lawyers assert that a June 3 declaration signed by Guantanamo prison warden Colonel John Bogdan, which sought to justify the rationale behind the genital search policy , contains details about "operational-security and force-protection procedures" that, if made public, "would better enable our enemies to attack the detention facilities at Guantanamo or undermine security at the facility".
  • The government made these claims in response to a motion to intervene  filed by this reporter in federal court last month which sought to unseal Bogdan's six-page declaration. Journalists can intervene in court cases and argue for the release of certain materials on the grounds that the public has a right of access to judicial records. The warden's declaration was submitted by the government - under seal - in response to a lawsuit filed by Guantanamo attorneys, who argued the genital search policy Bogdan enacted at the height of a mass hunger strike in April interfered with prisoners' access to their lawyers. The new procedures required prisoners to agree to have their genitals searched whenever they left their cells to meet with attorneys, and upon return, to ensure they were not transporting "contraband". Rather than submit to the searches, numerous prisoners declined to meet with their lawyers.
  • Last month, US District Court Judge Royce Lamberth banned the searches, calling them "religiously and culturally abhorrent". Lamberth said the protocol Bogdan implemented under the guise of security was actually intended to deter prisoners from meeting with their lawyers. Three days after Lamberth issued his opinion, this reporter's Washington, DC-based attorney, Jeffrey Light, filed a motion to intervene to unseal Bogdan's declaration. In response to the court filing, the government on Friday released a partially redacted version of Bogdan's declaration, and argued that the blacked-out passages in the document should remain secret - because they contained sensitive "operational-security information" about Guantanamo. But it appears government lawyers were unaware that another version of Bogdan's declaration - one that contained a different set of redactions - was publicly released last month, in documents filed with the federal appeals court when the government asked Lamberth's decision to be put on hold. Redacted passages that the government says needs to remain secret are unredacted in the earlier version filed on the public record as part of the government's appeal. At the same time, some unredacted passages in the declaration submitted on Friday are redacted in the public version of Bogdan's declaration filed with the appeals court last month.

    So according to Bloomberg, JPMorgan's commercial bank was the recipient of 99 percent of JPMorgan's $79 trillion (face value of derivatives) in bad bets. So adding JPMorgan's $78 trillion or so to the $75 trillion in bad bets Bank of America unloaded on its FDIC insured subsidiary, we arrive at $153 trillion in bad bets moved by two investment banks alone under the FDIC umbrella. Meanwhile, FDIC has authority under Dodd-Frank to liquidate these insolvent banks but doesn't, despite several successful lawsuits to recover the value of toxic derivatives that they sold to smaller banks that failed (which implies that FDIC could tell JPMorgan and BoA's investment banksters that they've got to pay off the toxic assets they transferred to their commercial banks, rather than diluting the insurance for normal depositors. Problem: the two big investment banks don't have sufficient assets to absorb those losses, so the too-politically-connected-to-fail factor kicks in. Note that I have not done any legal research in regard to these issues and am basing these observations on what has been stated about legal requirements in various media articles.

The high court issued a notice early Monday without comment acknowledging that it would not be weighing in on a matter introduced this past June by a privacy watchdog group after NSA leaker Edward Snowden revealed evidence showing that the United States intelligence agency was collecting metadata pertaining to the phone calls of millions of American customers of the telecommunications company Verizon on a regular basis. That disclosure — the first of many NSA documents leaked by Mr. Snowden — prompted the Washington, DC-based Electronic Privacy Information Center, or EPIC, to ask the Supreme Court to consider taking action that would end the collection of phone records on a major scale.
  • When EPIC filed their petition in June, they wrote, “We believe that the NSA’s collection of domestic communications contravenes the First and Fourth Amendments to the United States Constitution, and violates several federal privacy laws, including the Privacy Act of 1974 and the Foreign Intelligence Surveillance Act of 1978 as amended.” “We ask the NSA to immediately suspend collection of solely domestic communications pending the competition of a public rulemaking as required by law. We intend to renew our request each week until we receive your response,” EPIC said. Five months later, though, the Supreme Court said this week that it would not be hearing EPIC’s plea. A document began circulating early Monday in which the high court listed the petition filed by the privacy advocates as denied. With other cases still pending, however, alternative routes may eventually lead to reform of the NSA’s habits on some level. Lower courts are still in the midst of deciding what action they will take with regards to similar lawsuits filed by other groups in response to the Snowden leaks and the revelations they made possible. The American Civil Liberties Union, the Electronic Frontier Foundation and conservative legal activist Larry Klayman have filed separate civil lawsuits in various US District Courts challenging the NSA’s program, all of which are still pending.

  • The United States and its key intelligence allies are quietly working behind the scenes to kneecap a mounting movement in the United Nations to promote a universal human right to online privacy, according to diplomatic sources and an internal American government document obtained by The Cable. The diplomatic battle is playing out in an obscure U.N. General Assembly committee that is considering a proposal by Brazil and Germany to place constraints on unchecked internet surveillance by the National Security Agency and other foreign intelligence services. American representatives have made it clear that they won't tolerate such checks on their global surveillance network. The stakes are high, particularly in Washington -- which is seeking to contain an international backlash against NSA spying -- and in Brasilia, where Brazilian President Dilma Roussef is personally involved in monitoring the U.N. negotiations.
  • The Brazilian and German initiative seeks to apply the right to privacy, which is enshrined in the International Covenant on Civil and Political Rights (ICCPR), to online communications. Their proposal, first revealed by The Cable, affirms a "right to privacy that is not to be subjected to arbitrary or unlawful interference with their privacy, family, home, or correspondence." It notes that while public safety may "justify the gathering and protection of certain sensitive information," nations "must ensure full compliance" with international human rights laws. A final version the text is scheduled to be presented to U.N. members on Wednesday evening and the resolution is expected to be adopted next week. A draft of the resolution, which was obtained by The Cable, calls on states to "to respect and protect the right to privacy," asserting that the "same rights that people have offline must also be protected online, including the right to privacy." It also requests the U.N. high commissioner for human rights, Navi Pillay, present the U.N. General Assembly next year with a report on the protection and promotion of the right to privacy, a provision that will ensure the issue remains on the front burner.

"The United States takes very seriously our international legal obligations, including those under the International Covenant on Civil and Political Rights," Kurtis Cooper, a spokesman for the U.S. mission to the United Nations, said in an email. It calls for changing the Brazilian and German text so "that references to privacy rights are referring explicitly to States' obligations under ICCPR and remove suggestion that such obligations apply extraterritorially." In other words: America wants to make sure it preserves the right to spy overseas. The U.S. paper also calls on governments to promote amendments that would weaken Brazil's and Germany's contention that some "highly intrusive" acts of online espionage may constitute a violation of freedom of expression. Instead, the United States wants to limit the focus to illegal surveillance -- which the American government claims it never, ever does. Collecting information on tens of millions of people around the world is perfectly acceptable, the Obama administration has repeatedly said. It's authorized by U.S. statute, overseen by Congress, and approved by American courts.
  • "Recall that the USG's [U.S. government's] collection activities that have been disclosed are lawful collections done in a manner protective of privacy rights," the paper states. "So a paragraph expressing concern about illegal surveillance is one with which we would agree." The privacy resolution, like most General Assembly decisions, is neither legally binding nor enforceable by any international court. But international lawyers say it is important because it creates the basis for an international consensus -- referred to as "soft law" -- that over time will make it harder and harder for the United States to argue that its mass collection of foreigners' data is lawful and in conformity with human rights norms. "They want to be able to say ‘we haven't broken the law, we're not breaking the law, and we won't break the law,'" said Dinah PoKempner, the general counsel for Human Rights Watch, who has been tracking the negotiations. The United States, she added, wants to be able to maintain that "we have the freedom to scoop up anything we want through the massive surveillance of foreigners because we have no legal obligations."
  • The United States negotiators have been pressing their case behind the scenes, raising concerns that the assertion of extraterritorial human rights could constrain America's effort to go after international terrorists. But Washington has remained relatively muted about their concerns in the U.N. negotiating sessions. According to one diplomat, "the United States has been very much in the backseat," leaving it to its allies, Australia, Britain, and Canada, to take the lead. There is no extraterritorial obligation on states "to comply with human rights," explained one diplomat who supports the U.S. position. "The obligation is on states to uphold the human rights of citizens within their territory and areas of their jurisdictions."
  • The position, according to Jamil Dakwar, the director of the American Civil Liberties Union's Human Rights Program, has little international backing. The International Court of Justice, the U.N. Human Rights Committee, and the European Court have all asserted that states do have an obligation to comply with human rights laws beyond their own borders, he noted. "Governments do have obligation beyond their territories," said Dakwar, particularly in situations, like the Guantanamo Bay detention center, where the United States exercises "effective control" over the lives of the detainees. Both PoKempner and Dakwar suggested that courts may also judge that the U.S. dominance of the Internet places special legal obligations on it to ensure the protection of users' human rights.
  • "It's clear that when the United States is conducting surveillance, these decisions and operations start in the United States, the servers are at NSA headquarters, and the capabilities are mainly in the United States," he said. "To argue that they have no human rights obligations overseas is dangerous because it sends a message that there is void in terms of human rights protection outside countries territory. It's going back to the idea that you can create a legal black hole where there is no applicable law." There were signs emerging on Wednesday that America may have been making ground in pressing the Brazilians and Germans to back on one of its toughest provisions. In an effort to address the concerns of the U.S. and its allies, Brazil and Germany agreed to soften the language suggesting that mass surveillance may constitute a violation of human rights. Instead, it simply deep "concern at the negative impact" that extraterritorial surveillance "may have on the exercise of and enjoyment of human rights." The U.S., however, has not yet indicated it would support the revised proposal.
  • The concession "is regrettable. But it’s not the end of the battle by any means," said Human Rights Watch’s PoKempner. She added that there will soon be another opportunity to corral America's spies: a U.N. discussion on possible human rights violations as a result of extraterritorial surveillance will soon be taken up by the U.N.   • (CHICAGO) (WLS) -- Lawyers for a west suburban teenager charged with a downtown bomb plot say he was caught in a "fake war on terror" contrived by U.S. spy agencies. Each week it seems as though there is a new salvo of accusations by the legal team defending Hillside 19-year-old Adel Daoud. On Tuesday, a court filing by Daoud's attorneys characterizes U.S. spy agencies as outlaw arms of the government that snagged the west suburban teenager in a dummied-up bomb plot. The nation's intelligence gathering agencies, they believe, are operating in what amounts to a fourth, runaway, branch of government. Daoud was arrested a little more than a year ago, according to authorities planning to detonate a car bomb at this downtown intersection that would take out a popular nearby bar--if it was real. But the so-called plot was a sting operation and the bomb operatives worked for the FBI.
  • "Look, he's a young kid," said Daoud attorney Thomas Durkin. "He just graduated from high school." Durkin, from the beginning, has cried foul about the government investigation and tactics. In the sharply-critical Daoud surveillance motion filed Tuesday, Durkin states that the government has concocted a "fake choice between national security and civil rights, not unlike the fake war being conducted in our name against terror." Durkin, a former assistant U.S. Attorney in Chicago, states that: "The usually reliable representations of the U.S. Attorney's office can no longer be trusted. . .because the intelligence agencies. . . simply do not inform the local prosecutors of all material information." "The spy agencies," Durkin writes, "are as fearful of the prosecutors as they are defense counsel". . .and "just as easily compromised."
  • During the investigation, FBI agents secretly recorded phone conversations at the suspect's home, and elsewhere, and they monitored internet communications. Prosecutors have argued that evidence must be held in secret, from both the public and the defendant-- and so far, the courts have agreed. Lawyers for the 19-year old man from west suburban Chicago are challenging the initial legal grounds permitting authorities to monitor his communications. They contend Daoud may have been targeted by intelligence agencies for viewpoints expressed on the internet. The accused teenage jihadist remains in federal custody without bail, where he has been for 14 months. Authorities have said that Daoud made statements he intended to kill 100 people and injure 300. As his attorney continues a vigorous challenge of government tools and tactics, prosecutors declined to comment to the I-Team.

But the government still clings to its position that neither the defense nor the public should be allowed to see the NSA intelligence. The judge in the case originally sided with the government. The Court repeated that promise in its opinion dismissing the Amnesty International case. But the issue is still alive. Daod is still in jail pending trial. And I'll hazard a guess that his defense just acquired new wheels with yesterday's disclosure of NSA surveillance being used to ruin the reputations of non-terrorists because of the content of their speech.

  • The Central Intelligence Agency today asked a court to allow more time to declassify its response to the Senate Select Committee on Intelligence report on CIA rendition, detention and interrogation (RDI) activities, which itself is undergoing a time-consuming declassification review. “This complex process requires the careful review of over 500 pages of highly classified material. In addition, sufficient time must be allowed not only for coordination with other agencies, but — after completion of declassification review — for implementation of security measures to ensure the safety of U.S. personnel and facilities overseas,” according to a May 15 motion filed by the government in a FOIA lawsuit brought by the ACLU. “Due to the fluid nature of this process, aspects of which are beyond the CIA’s control, the Agency does not yet have a firm date by which it can complete the processing of the CIA Response [to the SSCI report] and the so-called Panetta Report, although it hopes the declassification review and accompanying processing of those documents can be completed this summer.” The CIA therefore requested an extension of time to respond, to which the ACLU plaintiffs did not consent.

  • It's hardly news that the Obama administration is intensely and, in many respects, unprecedentedly hostile toward the news-gathering process. Even the most Obama-friendly journals have warned of what they call "Obama's war on whistleblowers". James Goodale, the former general counsel of the New York Times during its epic fights with the Nixon administration, recently observed that "President Obama wants to criminalize the reporting of national security information" and added: "President Obama will surely pass President Richard Nixon as the worst president ever on issues of national security and press freedom."Still, a new report released today by the highly respected Committee to Protect Journalists - its first-ever on press freedoms in the US - powerfully underscores just how extreme is the threat to press freedom posed by this administration. Written by former Washington Post executive editor Leonard Downie, Jr., the report offers a comprehensive survey of the multiple ways that the Obama presidency has ushered in a paralyzing climate of fear for journalists and sources alike, one that severely threatens the news-gathering process.The first sentence: "In the Obama administration's Washington, government officials are increasingly afraid to talk to the press."

It quotes New York Times reporter David Sanger as saying that "this is the most closed, control freak administration I've ever covered." It identifies at least a dozen other long-time journalists making similar observations.

Instead, as the New Yorker's investigative reporter Jane Mayer recently said about the Obama administration's attacks: "It's a huge impediment to reporting, and so chilling isn't quite strong enough, it's more like freezing the whole process into a standstill."

    Note how Obama is not winning over the press with his legislation to give reporters for mainstream media a special privilege from some types of surveillance. When last I checked, that effort had bogged down in the effort to define "journalist" in a way that did not include every blogger on the planet. Small wonder: the Supreme Court has repeatedly held that there is no constitutional basis for a special protection for journalists *because the lone, anonymous pamphleteer has the same Freedom of the Press that mainstream journalists have.* I rarely make absolute predictions about what courts will do in the future, but this is black-letter First Amendment law. The legislation is doomed to be voided by the courts even if passed. Big, big denial of equal protection by the First Amendment. There is no alternative to ending the government surveillance except forfeiture of our freedoms.
