The Oscar-winning documentary film-maker Laura Poitras is suing the US government demanding to know why she has repeatedly been subjected to “Kafkaesque harassment” at airports across the world. Poitras, 51, said she had been held at borders more than 50 times between 2006 and 2012, often for hours at a time. At various times she alleges being told by officials that she was on a “no fly” list, having her electronic equipment confiscated and not returned for 41 days, and being threatened with handcuffs for taking notes. The latter incident took place when she was working on a film about the WikiLeaks founder Julian Assange. Poitras said she was launching the legal action, which demands the release of all documentation held on her tracking, targeting and questioning by agencies over the six year period, following the failure of a 2013 freedom of information request.

“I’m filing this lawsuit because the government uses the US border to bypass the rule of law,” said the film-maker in a statement, The Intercept reported. “This simply should not be tolerated in a democracy. I am also filing this suit in support of the countless other less high-profile people who have also been subjected to years of Kafkaesque harassment at the borders. We have a right to know how this system works and why we are targeted.” Poitras has previously said she was placed on the Department of Homeland Security’s watch list in 2006 after returning home to the US following work on My Country, My Country. She says airport security told her officials had assigned her the highest “threat rating” possible, even though she had never been charged with a crime. She was repeatedly stopped until 2012, when the journalist Glenn Greenwald wrote an article about her experiences.

Poitras’s reporting on the NSA whistleblower Edward Snowden, along with work by Greenwald, Ewen MacAskill and Barton Gellman contributed to the Pulitzer prize for public service won jointly by the Washington Post and the Guardian in 2014. Her film on Snowden, Citizenfour, won the 2015 Oscar for best documentary. The director is being represented by lawyers from digital-rights advocacy group the Electronic Frontier Foundation. “The well-documented difficulties Ms Poitras experienced while traveling strongly suggest that she was improperly targeted by federal agencies as a result of her journalistic activities,” senior counsel David Sobel told the Intercept. “Those agencies are now attempting to conceal information that would shed light on tactics that appear to have been illegal. We are confident that the court will not condone the government’s attempt to hide its misconduct under a veil of ‘national security.’”

The U.S. and China have reached their first ever cybercrime and cyberespionage agreement, but the deal is quite general and how it will translate into actions is still unclear.Leaders of both countries announced the deal in Washington on Friday after two days of top-level talks, but both dodged questions on specific hacking incidents or the indictment last year by the U.S. of five Chinese military hackers for cybercrimes."We have agreed that neither the U.S. or the Chinese government will conduct or knowingly support cyber-enabled theft of intellectual property, including trade secrets or other confidential business information for commercial advantage," President Obama said at a White House news conference.And that appears to be the main thrust of the agreement -- government-sponsored cyberespionage for the economic gain of companies. It doesn't cover government espionage and is pretty specific in its definition but, as President Obama indicated: It's a start.

Regin, an advanced spyware program widely believed to have been developed by US and British intelligence agencies, was found on a USB stick belonging to an official in German Chancellor Angela Merkel's office, Berlin sources say.Sources said the incident occurred months ago and said that the hackers involved could not be identified.

The malware was discovered after a mid-level official in the European policy section of the chancellery reportedly took home a document on her USB flash drive to read on her private laptop.

When she later inserted the USB drive into her chancellery computer, an anti-virus alert came up.Dr Merkel's staff are not supposed to use their private computers for work for fear of transferring a virus this way.

(Reuters) - Dozens of Turkish police including high-ranking officers were detained on Tuesday, accused of spying and illegal wire-tapping of Prime Minister Tayyip Erdogan and his inner circle in what the chief prosecutor said was a concocted probe of an alleged terrorist group. The former Istanbul anti-terror police chief, himself among those detained and led away in handcuffs, said the incident was entirely political, coming just a few weeks ahead of a presidential election in which Erdogan is standing.The operation follows a stream of purges targeting the police, judiciary and state institutions this year which government critics have condemned as a symptom of Erdogan's tightening grip.

olice conducted raids in 22 provinces, and officers involved in a separate government corruption probe which emerged in December and led to the departure of four ministers were among those detained, Turkish media reported.The officers were accused of making up an investigation into an alleged terrorist group named 'selam-tevhid' as a pretence to tap the phones of Erdogan, ministers and the head of the national intelligence agency."The order was given for the capture and detention of 76 police officers who were investigating the group named selam-tevhid but whose actual aims were spying," Istanbul chief prosecutor Hadi Salihoglu said in a written statement.He said the 'selam-tevhid' case, targeting 251 people, had been dismissed due to a lack of evidence after a three-year investigation during which 2,280 people were wire-tapped.Fifty-two of the 76 officers have so far been detained, and Turkish media published photos of former anti-terror police chiefs being led away in handcuffs by their colleagues.

The order was also given for the arrest of another 39 suspects, of whom 15 have so far been detained, over the wiretapping of around 250 people, including deputies, judges, journalists and senior bureaucrats, allegedly on the grounds of being members of an illegal group, the statement said.

A few weeks ago we fought a battle for transparency in our flagship NSA spying case, Jewel v. NSA. But, ironically, we weren't able to tell you anything about it until now. On June 6, the court held a long hearing in Jewel in a crowded, open courtroom, widely covered by the press. We were even on the local TV news on two stations. At the end, the Judge ordered both sides to request a transcript since he ordered us to do additional briefing. But when it was over, the government secretly, and surprisingly sought permission to “remove” classified information from the transcript, and even indicated that it wanted to do so secretly, so the public could never even know that they had done so. We rightly considered this an outrageous request and vigorously opposed it. The public has a First Amendment right not only to attend the hearing but to have an accurate transcript of it. Moreover, the federal law governing court reporting requires that “each session of the court” be “recorded verbatim” and that the transcript be certified by the court reporter as “a correct statement of the testimony taken and the proceedings had.” 28 U.S.C. § 753(b).

The Court allowed the government a first look at the transcript and indicated that it was going to hold the government to a very high standard and would not allow the government to manufacture a misleading transcript by hiding the fact of any redactions. Ultimately, the government said that it had *not* revealed classified information at the hearing and removed its request. But the incident speaks volumes about the dangers of allowing the government free rein to claim secrecy in court proceedings and otherwise. We couldn't tell you anything about that fight because the government's request, our opposition to it, and the court's order regarding it were all sealed. But with today's order by Judge White, the transcript and the arguments over the government's request to revise it are finally public documents. Here's how the events transpired:

FSB source to "Komsomolskaya Pravda": "the customer of Nemtsov's murder was preparing an assassination of Vladimir Putin" The main suspect in the organization of the high-profile crime - is a commander of the Ukrainian battalion in the name of Dzhokhar Dudayev, Adam Osmayev. The correspondent of "Komsomolskaya Pravda" met with the FSB agent, who is part of the team investigating the murder of Boris Nemtsov. In an exclusive interview he spoke about the new details of the crime and named the most likely customer of the murder.

Today the investigators have irrefutable proof that all persons detained on suspicion of murder of the politician are the perpetrators, - said our source in the FSB. First of all, billing (data about calls and movements of the subscriber. - Ed.) from their mobile phones showed that they conducted surveillance of Nemtsov before the murder, following him closely. The suspects were tracked with their phones at the location where Nemtsov was present with his phone. During the murder all the detainees "were in the area": some under the bridge, some in a car, some nearby. Zaur Dadaev pulled the trigger. He first made a confession, and then, on the advice of his lawyers, took it back. But it changes nothing, the investigation has already collected compelling evidence of his guilt. I will not give details of how this was done. The pistol was thrown into the river after the crime, it was later recovered by divers. That Zaur Dadaev immediately said to the TV cameras: "I love prophet Muhammad" - is just a cover. There was no religious motive for the killings. They cynically carried out an order. They are far from devout Muslims. In fact, just real gangsters. And the most important thing. The executor of the murder was in close contact with Adam Osmaev, who recently became the commander of the Ukrainian battalion in the name of Dzhokhar Dudayev. They met, talked a lot on the phone. Zaur Dadaev and his cronies worked with Osmaev on Ukrainian affairs. And also with Chechens, who fought on the territory of Ukraine for the new regime. Zaur Dadaev was listed in the battalion "North" ("Sever") of the Chechen Interior Ministry, but while serving in it, in fact, was engaged in activities against Russia. He was associated with Osmaev by a certain relationship and mutual obligations.

The evidence is still being gathered. But I can say that today the main suspected customer of Nemtsov's murder is Adam Osmayev.

This is quite the bombshell delivered by two CHP deputies in the Turkish parliament and reported by Today’s Zaman, one of the top dailies in Turkey. It supports Seymour Hersh’s reporting that the notorious sarin gas attack at Ghouta was a false flag orchestrated by Turkish intelligence in order to cross President Obama’s chemical weapons “red line” and draw the United States into the Syria war to topple Assad. If so, President Obama deserves credit for “holding the line” against the attack despite the grumbling and incitement of the Syria hawks at home and abroad. And it also presents the unsavory picture of an al-Qaeda operatives colluding with ISIL in a war crime that killed 1300 civilians.

I find the report credible, taking into full account the fact that the CHP (Erdogan’s center-left Kemalist rivals) and Today’s Zaman (whose editor-in-chief, Bulent Kenes was recently detained on live TV for insulting Erdogan in a tweet) are on the outs with Erdogan. Considering the furious reaction it can be expected to elicit from Erdogan and the Turkish government, the temerity of CHP and Today’s Zaman in running with this story is a sign of how desperate their struggle against Erdogan has become.  Note that the author is shown only as “Columnist: Today’s Zaman”. I expect the anti-Erodgan forces hope this will be a game changer in terms of U.S.and European support for Erdogan. It will be very interesting to see if and how the media in the U.S. covers this story.  In case it doesn’t acquire enough “legs” to make into US media, I attach the full Zaman piece below:

CHP deputies: Gov’t rejects probe into Turkey’s role in Syrian chemical attack Two deputies from the main opposition Republican People’s Party (CHP) have claimed that the government is against investigating Turkey’s role in sending toxic sarin gas which was used in an attack on civilians in Syria in 2013 and in which over 1,300 Syrians were killed. CHP deputies Eren Erdem and Ali Şeker held a press conference in İstanbul on Wednesday in which they claimed the investigation into allegations regarding Turkey’s involvement in the procurement of sarin gas which was used in the chemical attack on a civil population and delivered to the terrorist Islamic State in Iraq and the Levant (ISIL) to enable the attack was derailed. Taking the floor first, Erdem stated that the Adana Chief Prosecutor’s Office launched an investigation into allegations that sarin was sent to Syria from Turkey via several businessmen. An indictment followed regarding the accusations targeting the government.
