  • The alleged Syrian peace process now enters its Geneva charade stage. This could last months; get ready for lavish doses of posturing and bluster capable of stunning even Donald Trump.

So no wonder the Saudis want at least some of their proxies at the negotiating table in Geneva, while Turkey tries to change the subject by barring the Syrian Kurds: these are accused of being terrorists, much more than ISIS/ISIL/Daesh.    
  • As if this was not messy enough, US ‘Think Tankland’ is now spinning there is an “understanding” between Washington and Ankara for what will be, for all practical purposes, a Turkish invasion of northern Syria, under the pretext of Ankara smashing ISIS/ISIL/Daesh in northern Aleppo.This is utter nonsense. Ankara’s game is three-pronged; prop up their heavily battered Turkmen proxies; keep very much alive the corridor to Aleppo – a corridor that crucially includes the Jihadi Highway between Turkey and Syria; and most of all prevent by all means necessary that YPG Kurds bridge the gap from Afrin to Kobani and unite all three Syrian Kurd cantons near the Turkish border.None of this has anything to do with fighting ISISL/ISIL/Daesh. And the nuttiest part is that Washington is actually assisting the Syrian Kurds with air support. Either the Pentagon supports the Syrian Kurds or Erdogan’s invasion of northern Syria; schizophrenia does not apply here.A desperate Erdogan may be foolish enough to confront the Russian Air Force during his purported “invasion”. Putin is on the record saying response to any provocation will be immediate, and lethal. To top it off, the Russians and Americans are actually coordinating airspace action in northern Syria.

The YPG and its allies are planning a major attack to finally seize the 100-kilometer stretch of the Syria-Turkey border still controlled by ISIS/ISIL/Daesh – thus reuniting their three cantons.Erdogan was blunt; if the YPG pushes west of the Euphrates, it’s war. Well, looks like war then. The YPG is getting ready to attack the crucial towns of Jarabulus and Manbij. Russia most certainly will aid the YPG to reconquer Jarabulus. And that will directly pit – once again - Turkey against Russia on the ground.Geneva? That’s for tourists; the capital of the Syrian horror show is now Jarabulus.

  • NATO Secretary General Jens Stoltenberg announced on February 2nd that he approves of US ‘Defense’ Secretary Ash Carter’s proposal to quadruple US armaments and troops in Europe, against ‘Russian aggression’. Secretary Carter said earlier that same day, in his announcement of America’s arming for war against Russia: We are reinforcing our posture in Europe to support our NATO allies in the face of Russia’s aggression. In Pentagon parlance, this is called the European Reassurance Initiative and after requesting about $800 million for last year, this year we’re more than quadrupling it for a total of $3.4 billion in 2017. That will fund a lot of things: more rotational US forces in Europe, more training and exercising with our allies, more preposition and war-fighting gear and infrastructure improvements to support all this. And when combined with US forces already in and assigned to Europe – which are also substantial – all of this together by the end of 2017 will let us rapidly form a highly capable combined arms ground force that can respond across that theater, if necessary.

That’s all there was to the assertion there; he didn’t finish the sentence, nor even the thought. But in this offhanded way, he did at least try to give the impression that the US is never an aggressor – for example: that, though the US is expanding NATO right up to Russia’s borders, Russia is being the ‘aggressor’ to move troops and weapons up to those borders – up to Russia’s own borders (to counter the US & NATO invasion-threat, of course; but, no: it’s to threaten NATO, if you believe the West).

  • Two CIA reports on Iraq and its weapons activities produced during the months after 9/11; the CIA had denied both in their entirety. Neither treated Iraq as a significant threat, but both made claims which would become part of the justification for the 2003 war: that Iraq 1) had acquired aluminum tubes for gas centrifuges and 2) had deployed mobile biological laboratories, claims which were later disproven.

  • The memoranda also indicate a significant disparity between what was probable, and what was feared. The analysts were most confident assessing that Saddam Hussein could be developing nuclear capabilities in just under ten years. Iraq might produce a “nuclear weapon, potentially late this decade,” the SEM notes. The SPWR, on the other hand, concludes: “Iraq is trying to jump-start a clandestine uranium enrichment program to produce the fissile material for a weapon, potentially by late this decade.” Those assessments were produced in the shadow of the failure of U.S. intelligence to detect Saddam Hussein’s clandestine nuclear program before the Gulf War. CIA analysts were hesitant to conclude that Iraq was not an immediate threat, yet they had little evidence indicating the existence of an Iraqi nuclear program that genuinely posed a hazard. “Saddam never abandoned his nuclear weapons program, but reporting on Iraqi efforts to revive it is limited. Iraq continues to employ effective denial and deception measures and there are no indicators that Baghdad has embarked on an extensive nuclear weapons effort as it did before the Gulf War” [SEM]. The released paragraphs addressing Iraq’s support of terrorism failed to mention al-Qaeda, surprising in light of claims from Bush Administration officials that Iraq was linked to terrorism and September 11. The Senior Executive Memorandum notes: “Baghdad has reduced its reliance on surrogates, preferring instead to use its own intelligence services for sensitive terrorist operations,” making a connection to non-Iraqi terrorist groups, including al-Qaeda, doubtful. Within Iraq, the 2001 memo notes how Saddam maintained a “multilayered and pervasive security apparatus.” The underground networks were critical to the anti-American insurgency that developed following the 2003 U.S. invasion, fragments of which have since evolved into the Islamic State. 
  • Despite their equivocal findings, these reports are evidence of the intelligence failure which contributed to the U.S. war. For example, CIA analysts linked the procurement of aluminum tubes to the potential development of centrifuges for uranium enrichment – an assertion later seized on by top officials as evidence that Iraq was trying to reconstitute its nuclear weapons program. Interestingly, intelligence analysts at the Department of Energy disagreed with this CIA contention, instead assessing that the aluminum tubes in question were much more likely intended for more benign purposes. However this disagreement did not appear to receive a full vetting during the lead-up to the 2003 war. Just as dubious were the CIA statements about mobile biological warfare laboratories, information that can be traced back to the notorious dissembler Curveball.

  • The U.S. military is spending millions on an advanced implant that would allow a human brain to communicate directly with computers.If it succeeds, cyborgs will be a reality.The Pentagon's research arm, the Defense Advanced Research Projects Agency (DARPA), hopes the implant will allow humans to directly interface with computers, which could benefit people with aural and visual disabilities, such as veterans injured in combat.The goal of the proposed implant is to "open the channel between the human brain and modern electronics" according to DARPA's program manager, Phillip Alvelda.

Former Drone Operators Say They Were "Horrified" By Cruelty of Assassination Program - 0 views

  • U.S. DRONE OPERATORS are inflicting heavy civilian casualties and have developed an institutional culture callous to the death of children and other innocents, four former operators said at a press briefing today in New York. The killings, part of the Obama administration’s targeted assassination program, are aiding terrorist recruitment and thus undermining the program’s goal of eliminating such fighters, the veterans added. Drone operators refer to children as “fun-size terrorists” and liken killing them to “cutting the grass before it grows too long,” said one of the operators, Michael Haas, a former senior airman in the Air Force. Haas also described widespread drug and alcohol abuse, further stating that some operators had flown missions while impaired. In addition to Haas, the operators are former Air Force Staff Sgt. Brandon Bryant along with former senior airmen Cian Westmoreland and Stephen Lewis. The men have conducted kill missions in many of the major theaters of the post-9/11 war on terror, including Iraq, Afghanistan and Pakistan.
  • “We have seen the abuse firsthand,” said Bryant, “and we are horrified.” An Air Force spokesperson did not address the specific allegations but wrote in an email that “the demands placed on the [drone] force are tremendous. A great deal of effort is being taken to bring about relief, stabilize the force, and sustain a vital warfighter capability. … Airmen are expected to adhere to established standards of behavior. Behavior found to be inconsistent with Air Force core values is appropriately looked into and if warranted, disciplinary action is taken.” Beyond the press conference, the group also denounced the program yesterday in an interview with The Guardian and in an open letter addressed to President Obama.

  • France has invoked an EU treaty collective defense article requesting military help from its European partners in response to the terror attacks in Paris. EU officials say the mutual defense article is being used for the first time.
  • The assistance would come from 28 European partners under Article 42.7 of the EU’s Lisbon Treaty, which outlines mutual defense among the EU members. Called the ‘mutual defense clause’, the Article reads that if any EU country “is the victim of armed aggression on its territory, the other Member States shall have towards it an obligation of aid and assistance by all the means in their power, in accordance with Article 51 of the United Nations Charter.”
  • Speaking at a press conference in Brussels on Tuesday, French Defense Minister Jean-Yves Le Drian said all 28 EU member states unanimously accepted France's formal call for “aid and assistance” under the EU treaty and he expected all to help quickly in various regions, Reuters reports.“This is firstly a political act,” Le Drian said of the decision to invoke article on mutual defense of the EU treaty.The minister said France at this time does not have sufficient capabilities to wage several different military operations simultaneously, and expects full military support from its European partners.

  • After the U.S. invasion of Iraq the U.S vice consul Paul Bremer tried to install a handpicked Iraqi government.  The top Shia religious authority in Iraq, Grand Ajatollah Sistani, demanded a democratic vote. The issue was thereby decided. There was no way the U.S could have circumvented Sisitani's edict without a massive revolt by the 65% of Iraqis who are Shia and mostly follow his advice. Bremer had to fold. Now Ajatollah Sistani takes position against the Turkish invasion of Iraq: Iraq's top Shi'ite cleric, Grand Ayatollah Ali al-Sistani, called on the government on Friday to show "no tolerance" of any infringement of the country's sovereignty, after Turkey deployed heavily armed troops to northern Iraq. Sistani's spokesman, Sheikh Abdul Mehdi Karbala'i, did not explicitly name Turkey, but a row over the deployment has badly soured relations between Ankara and Baghdad, which denies having agreed to it. ... "The Iraqi government is responsible for protecting Iraq's sovereignty and must not tolerate and side that infringes upon on it, whatever the justifications and necessities," Karbalai'i said in a weekly sermon. The issue is thereby decided. Turkish troops will have to leave or will have to decisively defeat all Shia of Iraq (and Iran). If Erdogan were smart he would now order the Turkish troops stationed near Mosul to leave Iraq.
  • The Russian President Putin also increased pressure on Turkey: President Vladimir Putin on Friday ordered Russia's armed forces to act in an "extremely tough way" in Syria to protect Russian forces striking Islamic State targets there.   • There was some Syrian opposition conference yesterday in Saudi Arabia were the Saudis tried to bribe everyone to agree on a common position. But the conference failed. Some 116 delegates took part under "international guidance" of their various sponsors. A spokesperson for the al-Qaeda aligned Ahrar al Sham, which closely cooperates with the al-Qaeda entity Jabhat al Nusra in Syria, also took part. No women were present. The conference resulted in the decision to hold another conference. The 116 delegates at the conference decided to select 33 delegates for a conference which would decide on 15 delegates to confer and maybe take part in some negotiations with the Syrian government side. The NYT's Ben Hubbard, who was there, tweeted: Ben Hubbard @NYTBen ...The meeting created yet another new opposition body, a high commission, meant to oversee negotiations. There was debate about how large it should be and what proportion should represent armed groups. Final was 32, changed after meetings to 33. Those 33 now tasked with choosing a 15 person negotiating team. So, yeah, umbrella groups making a new umbrella.

  • The political demands the conference agreed upon include non-starters for negotiations like the demand that the Syrian President Assad would leave within 6 weeks of the negotiations start. There was also this illuminating word game: Islamist delegates objected to using the word “democracy” in the final statement, so the term “democratic mechanism” was used instead, according to a member of one such group who attended the meeting. The Ahrar al-Sham delegate at the meeting signed the deal while the Ahrar al Sham bigwigs, who took not part, damned the deal and announced they were completely against it. They demand an Islamic State in Syria that would follow their militant Salafi line of believe. Hubbard again: Ben Hubbard ‏@NYTBen Re: @Ahrar_Alsham2. It's main delegate did not walk out. Before meeting ended, members not present released statement announcing withdrawal. The session's moderator said Ahrar delegate was not aware of statement by his group until later, but did sign the final communiqué. Then Ahrar members like @aleesa71 and @a_azraeel complained on Twitter, suggesting a split between military and political leaders.
  • The Saudi and Qatari Wahhabi rulers want Ahrar al Sham to be part of any future solution in Syria. They hired "western" think tanks like Brookings Doha to propagandize that Ahrar is "moderate". But Ahrar can not be "moderate" when it is fighting together with al-Qaeda and kills civilians because they are "unbelievers". It is now in an uncomfortable position. If it takes part in a peace conference with the Syrian government its Jabhat al-Nusra ally will roast it, if it doesn't take part its Saudi and Qartari financiers will fry it. Since the start of the war on Syria no unity has been achieved in the opposition of the Syrian government. The U.S., in form of the CIA head John Brennan, teamed up (again) with al-Qaeda while the State Department tried to sponsor more "moderates". The ensuing chaos continues today. To prevent further blowback from this nonsense strategy will obviously require a change towards a position that supports the Syrian government. It is doubtful that the U.S. is capable of such foresight and flexibility.

  • Russia’s arming its Su-34 warplanes in Syria with air-to-air missiles can only complicate an already difficult situation in Syria’s airspace, Pentagon spokesperson Michelle Baldanza told TASS on Monday.
  • "Such systems will further complicate an already difficult situation in the skies over Syria and do nothing to further the fight against ISIL [the former name of the terrorist group Islamic State which is outlawed in Russian] as they have no air force," she said. "·We expect that if Russia follows through, they will abide by our Memorandum of Understanding regarding flight safety and not direct this system against Coalition aircraft." On Monday, spokesman for the Russian Aerospace Forces Colonel Igor Klimov said Russia’s Sukhoi Su-34 fighter-bombers (NATO reporting name: Fullback) had for the first time taken, in addition to bombs, short-and medium-range air-to-air missiles on combat mission in Syria. "The Russian Su-34 fighter-bombers today have for the first time taken on combat mission not only the OFAB-500 air bombs and KAB-500 guided bombs, but also short-and medium-range air-to-air missiles. The planes are equipped with missiles for their defence," Klimov said. According to him, the missiles "are equipped with target seeking devices and are capable of hitting air targets within the range of 60 kilometres."

Former US Intelligence Chief Discusses Development of IS - SPIEGEL ONLINE - 0 views

  • Michael Flynn, 56, served in the United States Army for more than 30 years, most recently as director of the Defense Intelligence Agency, where he was the nation's highest-ranking military intelligence officer. Previously, he served as assistant director of national intelligence inside the Obama administration. From 2004 to 2007, he was stationed in Afghanistan and Iraq, where, as commander of the US special forces, he hunted top al-Qaida terrorist Abu Musab al-Zarqawi, one of the predecessors to Abu Bakr al-Baghdadi, who today heads the Islamic State (IS) in Syria and Iraq. After Flynn's team located Zarqawi's whereabouts, the US killed the terrorist in an air strike in June 2006. In an interview, Flynn explains the rise of the Islamic State and how the blinding emotions of 9/11 led the United States in the wrong direction strategically.

Bulk Collection Under Section 215 Has Ended… What's Next? | Just Security - 0 views

  • The first (and thus far only) roll-back of post-9/11 surveillance authorities was implemented over the weekend: The National Security Agency shuttered its program for collecting and holding the metadata of Americans’ phone calls under Section 215 of the Patriot Act. While bulk collection under Section 215 has ended, the government can obtain access to this information under the procedures specified in the USA Freedom Act. Indeed, some experts have argued that the Agency likely has access to more metadata because its earlier dragnet didn’t cover cell phones or Internet calling. In addition, the metadata of calls made by an individual in the United States to someone overseas and vice versa can still be collected in bulk — this takes place abroad under Executive Order 12333. No doubt the NSA wishes that this was the end of the surveillance reform story and the Paris attacks initially gave them an opening. John Brennan, the Director of the CIA, implied that the attacks were somehow related to “hand wringing” about spying and Sen. Tom Cotton (R-Ark.) introduced a bill to delay the shut down of the 215 program. Opponents of encryption were quick to say: “I told you so.”
  • But the facts that have emerged thus far tell a different story. It appears that much of the planning took place IRL (that’s “in real life” for those of you who don’t have teenagers). The attackers, several of whom were on law enforcement’s radar, communicated openly over the Internet. If France ever has a 9/11 Commission-type inquiry, it could well conclude that the Paris attacks were a failure of the intelligence agencies rather than a failure of intelligence authorities. Despite the passage of the USA Freedom Act, US surveillance authorities have remained largely intact. Section 702 of the FISA Amendments Act — which is the basis of programs like PRISM and the NSA’s Upstream collection of information from Internet cables — sunsets in the summer of 2017. While it’s difficult to predict the political environment that far out, meaningful reform of Section 702 faces significant obstacles. Unlike the Section 215 program, which was clearly aimed at Americans, Section 702 is supposedly targeted at foreigners and only picks up information about Americans “incidentally.” The NSA has refused to provide an estimate of how many Americans’ information it collects under Section 702, despite repeated requests from lawmakers and most recently a large cohort of advocates. The Section 215 program was held illegal by two federal courts (here and here), but civil attempts to challenge Section 702 have run into standing barriers. Finally, while two review panels concluded that the Section 215 program provided little counterterrorism benefit (here and here), they found that the Section 702 program had been useful.
  • There is, nonetheless, some pressure to narrow the reach of Section 702. The recent decision by the European Court of Justice in the safe harbor case suggests that data flows between Europe and the US may be restricted unless the PRISM program is modified to protect the information of Europeans (see here, here, and here for discussion of the decision and reform options). Pressure from Internet companies whose business is suffering — estimates run to the tune of $35 to 180 billion — as a result of disclosures about NSA spying may also nudge lawmakers towards reform. One of the courts currently considering criminal cases which rely on evidence derived from Section 702 surveillance may hold the program unconstitutional either on the basis of the Fourth Amendment or Article III for the reasons set out in this Brennan Center report. A federal district court in Colorado recently rejected such a challenge, although as explained in Steve’s post, the decision did not seriously explore the issues. Further litigation in the European courts too could have an impact on the debate.

  • The US intelligence community’s broadest surveillance authorities are enshrined in Executive Order 12333, which primarily covers the interception of electronic communications overseas. The Order authorizes the collection, retention, and dissemination of “foreign intelligence” information, which includes information “relating to the capabilities, intentions or activities of foreign powers, organizations or persons.” In other words, so long as they are operating outside the US, intelligence agencies are authorized to collect information about any foreign person — and, of course, any Americans with whom they communicate. The NSA has conceded that EO 12333 is the basis of most of its surveillance. While public information about these programs is limited, a few highlights give a sense of the breadth of EO 12333 operations: The NSA gathers information about every cell phone call made to, from, and within the Bahamas, Mexico, Kenya, the Philippines, and Afghanistan, and possibly other countries. A joint US-UK program tapped into the cables connecting internal Yahoo and Google networks to gather e-mail address books and contact lists from their customers. Another US-UK collaboration collected images from video chats among Yahoo users and possibly other webcam services. The NSA collects both the content and metadata of hundreds of millions of text messages from around the world. By tapping into the cables that connect global networks, the NSA has created a database of the location of hundreds of millions of mobile phones outside the US.
  • Given its scope, EO 12333 is clearly critical to those seeking serious surveillance reform. The path to reform is, however, less clear. There is no sunset provision that requires action by Congress and creates an opportunity for exposing privacy risks. Even in the unlikely event that Congress was inclined to intervene, it would have to address questions about the extent of its constitutional authority to regulate overseas surveillance. To the best of my knowledge, there is no litigation challenging EO 12333 and the government doesn’t give notice to criminal defendants when it uses evidence derived from surveillance under the order, so the likelihood of a court ruling is slim. The Privacy and Civil Liberties Oversight Board is currently reviewing two programs under EO 12333, but it is anticipated that much of its report will be classified (although it has promised a less detailed unclassified version as well). While the short-term outlook for additional surveillance reform is challenging, from a longer-term perspective, the distinctions that our law makes between Americans and non-Americans and between domestic and foreign collection cannot stand indefinitely. If the Fourth Amendment is to meaningfully protect Americans’ privacy, the courts and Congress must come to grips with this reality.

Russia in Syria: Air strikes pose twin threat to Turkey by keeping Assad in power and strengthening Kurdish threat | Middle East | News | The Independent - 0 views

  • Russian planes carried out 71 sorties and 118 air strikes against Islamic fighters in Syria over the past two days compared to just one air strike by the US-led coalition – and this single strike, against a mortar position, was the first for four days. The Russian air campaign in Syria is far more intense than the US-led attempt to contain the “Islamic State” (Isis) that has focused on helping the Syrian Kurds and attacking Isis-controlled oil facilities in eastern Syria. Countries affected by the Syrian conflict sense that its nature is changing and are seeking new strategies to take account of this. 
  • The US says it will increase the number of its air strikes and possibly make limited use of special forces to target Isis leaders. The problem for the US is that, aside from Syrian-Kurdish Peoples’ Protection Units (YPG), which number about 25,000 fighters, it does not have an effective partner on the ground in Syria capable of identifying and giving the coordinates of targets to attack. Russia is providing an air force for the Syrian army, the largest military force in Syria and one which, unlike the Kurds, is not confined to one corner of the country.   Turkey is seeking an effective way to respond to two developments in Syria this year that are much against its interests. One is the start of Russian air strikes in support of President Bashar al-Assad on 30 September which makes Turkey’s policy of removing the Syrian leader, even if he is to be allowed to stay for a transition period, look unrealistic. The Russian presence also makes any direct Turkish military intervention increasingly risky. All attention in Turkey is on the parliamentary elections on 1 November, but last Sunday there was an ominous clash in Tal Abyad, a town on the Syrian-Kurdish border captured by the YPG from Isis in June, in which Turkish forces twice opened fire with machine guns on the Kurdish paramilitaries. Nobody was injured, but the Turkish Prime Minister, Ahmet Davutoglu, confirmed that the Turkish army had targeted the YPG. He said that Turkey would not allow the Syrian Kurdish force “to go west of the Euphrates and that we would hit it the moment it did. We hit it twice.” 
  • Although it is not playing much of a role in the election, Turkey’s policy towards the war in Syria has been a complete failure. Its aim was to get rid of Mr Assad and his regime, but both are still power. Even more seriously, whatever Ankara’s intentions at the start of the conflict in 2011, it did not dream that four years later the Syrian Kurds, 10 per cent of the Syrian population, would have established a de facto state they call Rojava in north-east Syria which runs along half of Turkey’s 550-mile Syrian Kurdish border.  Furthermore, the mini-state is tightly controlled by the PYD, the Syrian branch of the Kurdistan Workers Party (PKK) with whom the Turkish army has been fighting since 1984.

The All Writs Act, Software Licenses, and Why Judges Should Ask More Questions | Just Security - 0 views

  • Pending before federal magistrate judge James Orenstein is the government’s request for an order obligating Apple, Inc. to unlock an iPhone and thereby assist prosecutors in decrypting data the government has seized and is authorized to search pursuant to a warrant. In an order questioning the government’s purported legal basis for this request, the All Writs Act of 1789 (AWA), Judge Orenstein asked Apple for a brief informing the court whether the request would be technically feasible and/or burdensome. After Apple filed, the court asked it to file a brief discussing whether the government had legal grounds under the AWA to compel Apple’s assistance. Apple filed that brief and the government filed a reply brief last week in the lead-up to a hearing this morning.
  • We’ve long been concerned about whether end users own software under the law. Software owners have rights of adaptation and first sale enshrined in copyright law. But software publishers have claimed that end users are merely licensees, and our rights under copyright law can be waived by mass-market end user license agreements, or EULAs. Over the years, Granick has argued that users should retain their rights even if mass-market licenses purport to take them away. The government’s brief takes advantage of Apple’s EULA for iOS to argue that Apple, the software publisher, is responsible for iPhones around the world. Apple’s EULA states that when you buy an iPhone, you’re not buying the iOS software it runs, you’re just licensing it from Apple. The government argues that having designed a passcode feature into a copy of software which it owns and licenses rather than sells, Apple can be compelled under the All Writs Act to bypass the passcode on a defendant’s iPhone pursuant to a search warrant and thereby access the software owned by Apple. Apple’s supplemental brief argues that in defining its users’ contractual rights vis-à-vis Apple with regard to Apple’s intellectual property, Apple in no way waived its own due process rights vis-à-vis the government with regard to users’ devices. Apple’s brief compares this argument to forcing a car manufacturer to “provide law enforcement with access to the vehicle or to alter its functionality at the government’s request” merely because the car contains licensed software. 
  • This is an interesting twist on the decades-long EULA versus users’ rights fight. As far as we know, this is the first time that the government has piggybacked on EULAs to try to compel software companies to provide assistance to law enforcement. Under the government’s interpretation of the All Writs Act, anyone who makes software could be dragooned into assisting the government in investigating users of the software. If the court adopts this view, it would give investigators immense power. The quotidian aspects of our lives increasingly involve software (from our cars to our TVs to our health to our home appliances), and most of that software is arguably licensed, not bought. Conscripting software makers to collect information on us would afford the government access to the most intimate information about us, on the strength of some words in some license agreements that people never read. (And no wonder: The iPhone’s EULA came to over 300 pages when the government filed it as an exhibit to its brief.)

  • The government’s brief does not acknowledge the sweeping implications of its arguments. It tries to portray its requested unlocking order as narrow and modest, because it “would not require Apple to make any changes to its software or hardware, … [or] to introduce any new ability to access data on its phones. It would simply require Apple to use its existing capability to bypass the passcode on a passcode-locked iOS 7 phone[.]” But that undersells the implications of the legal argument the government is making: that anything a company already can do, it could be compelled to do under the All Writs Act in order to assist law enforcement. Were that the law, the blow to users’ trust in their encrypted devices, services, and products would be little different than if Apple and other companies were legally required to design backdoors into their encryption mechanisms (an idea the government just can’t seem to drop, its assurances in this brief notwithstanding). Entities around the world won’t buy security software if its makers cannot be trusted not to hand over their users’ secrets to the US government. That’s what makes the encryption in iOS 8 and later versions, which Apple has told the court it “would not have the technical ability” to bypass, so powerful — and so despised by the government: Because no matter how broadly the All Writs Act extends, no court can compel Apple to do the impossible.

Section 215 and "Fruitless" (?!?) Constitutional Adjudication | Just Security - 0 views

  • This morning, the Second Circuit issued a follow-on ruling to its May decision in ACLU v. Clapper (which had held that the NSA’s bulk telephone records program was unlawful insofar as it had not properly been authorized by Congress). In a nutshell, today’s ruling rejects the ACLU’s request for an injunction against the continued operation of the program for the duration of the 180-day transitional period (which ends on November 29) from the old program to the quite different collection regime authorized by the USA Freedom Act. As the Second Circuit (in my view, quite correctly) concluded, “Regardless of whether the bulk telephone metadata program was illegal prior to May, as we have held, and whether it would be illegal after November 29, as Congress has now explicitly provided, it is clear that Congress intended to authorize it during the transitionary period.” So far, so good. But remember that the ACLU’s challenge to bulk collection was mounted on both statutory and constitutional grounds, the latter of which the Second Circuit was able to avoid in its earlier ruling because of its conclusion that, prior to the enactment of the USA Freedom Act, bulk collection was unauthorized by Congress. Now that it has held that it is authorized during the transitional period, that therefore tees up, quite unavoidably, whether bulk collection violates the Fourth Amendment. But rather than decide that (momentous) question, the Second Circuit ducked:
  • We agree with the government that we ought not meddle with Congress’s considered decision regarding the transition away from bulk telephone metadata collection, and also find that addressing these issues at this time would not be a prudent use of judicial authority. We need not, and should not, decide such momentous constitutional issues based on a request for such narrow and temporary relief. To do so would take more time than the brief transition period remaining for the telephone metadata program, at which point, any ruling on the constitutionality of the demised program would be fruitless. In other words, because any constitutional violation is short-lived, and because it results from the “considered decision” of Congress, it would be fruitless to actually resolve the constitutionality of bulk collection during the transitional period.
  • Hopefully, it won’t take a lot of convincing for folks to understand just how wrong-headed this is. For starters, if the plaintiffs are correct, they are currently being subjected to unconstitutional government surveillance for which they are entitled to a remedy. The fact that this surveillance has a limited shelf-life (and/or that Congress was complicit in it) doesn’t in any way ameliorate the constitutional violation — which is exactly why the Supreme Court has, for generations, recognized an exception to mootness doctrine for constitutional violations that, owing to their short duration, are “capable of repetition, yet evading review.” Indeed, in this very same opinion, the Second Circuit first held that the ACLU’s challenge isn’t moot, only to then invokes mootness-like principles to justify not resolving the constitutional claim. It can’t be both; either the constitutional challenge is moot, or it isn’t. But more generally, the notion that constitutional adjudication of a claim with a short shelf-life is “fruitless” utterly misses the significance of the establishment of forward-looking judicial precedent, especially in a day and age in which courts are allowed to (and routinely do) avoid resolving the merits of constitutional claims in cases in which the relevant precedent is not “clearly established.” Maybe, if this were the kind of constitutional question that was unlikely to recur, there’d be more to the Second Circuit’s avoidance of the issue in this case. But whether and to what extent the Fourth Amendment applies to information we voluntarily provide to third parties is hardly that kind of question, and the Second Circuit’s unconvincing refusal to answer that question in a context in which it is quite squarely presented is nothing short of feckless.

Russian Warplane Down: NATO's Act of War | Global Research - Centre for Research on Globalization - 0 views

  • With cameras rolling, Turkey has claimed it has shot down a Russian Sukhoi Su-24 attack aircraft. The New York Times in its article, “Turkey Shoots Down Russian Warplane Near Syria Border,” reports that: Turkish fighter jets on patrol near the Syrian border shot down a Russian warplane on Tuesday after it violated Turkey’s airspace, a long-feared escalation that could further strain relations between Russia and the West. The escalation is “long feared” not because the Turkish government actually fears that Russian warplanes crossing their border pose a threat to it or its people, but because Russia has ended NATO’s proxy war, a proxy war spearheaded in part by Turkey itself, amid Russia’s joint military operations with Syria against the self-proclaimed “Islamic State” (ISIS) and supporting terrorist factions. In addition to having a camera rolling as the plane went down in flames, terrorists operating in region had allegedly surrounded the dead pilot shortly after the incident according to Reuters. While Turkey maintains that it was only reacting in self-defense – it was against a nation’s planes that it knew had no intention of attacking its territory – and what looks like instead was Turkey targeting planes operating along reoccurring routes and shooting one down once the pieces were in place to maximize the event politically.
  • For Russia’s part, it claims its plane had not even entered Turkish territory which would reveal Turkey’s actions as an outright act of war.
  • In recent weeks with Russian air support, Syrian troops have retaken large swaths of territory from ISIS, Al Qaeda, and other terrorist fighters. The Syrian Arab Army (SAA) has even begun approaching the Euphrates River east of Aleppo, which would effectively cut off ISIS from its supply lines leading out of Turkish territory. From there, Syrian troops would move north, into the very “safe zone” the US and its Turkish partners have long-sought but have so far failed to establish within Syria’s borders. This “safe zone” includes a region of northern Syrian stretching from Jarabulus near the west bank of the Euphrates to Afrin and Ad Dana approximately 90-100 kilometers west. Once Syrian troops retake this territory, the prospect of the West ever making an incursion into Syria, holding territory, or compromising Syria’s territorial integrity would be lost forever. Western ambitions toward regime change in Damascus would be indefinitely suspended. The endgame is at hand, and only the most desperate measures can hope to prevent Russia and Syria from finally securing Syria’s borders. Turkey’s provocation is just such a measure.

  • Russia’s time, place, and method of retaliating against Turkey is something only the Kremlin will know. But Russia’s actions upon the international stage have been so far thoroughly thought out, allowing Moscow to outmaneuver the West at every juncture and in the wake of every Western provocation. For Turkey’s government – one that has been consistent only in its constant failure regarding its proxy war against its neighbor Syria, who has been caught planning false flag provocations to trigger wider and more direct war in Syria, and whose government is now exposed and widely known to be directly feeding, not fighting ISIS – the prospect of Russian retaliation against it, either directly or indirectly, and in whatever form will leave it increasingly isolated. Until then, Russia’s best bet is to simply continue winning the war. Taking the Jarabulus-Afrin corridor and fortifying it against NATO incursions while cutting off ISIS and other terrorist factions deeper within Syria would be perhaps the worst of all possible retaliations. With Syria secured, an alternative arc of influence will exist within the Middle East, one that will inevitably work against Saudi and other Persian Gulf regimes’ efforts in Yemen, and in a wider sense, begin the irreversible eviction of Western hegemony from the region. The West, already being pushed out of Asia by China, will suffer immeasurably as the world dismantles its unipolar international order, region by region. As in the game of chess, a player often seeks to provoke their opponent into a series of moves. The more emotional their opponent becomes, the easier it is to control the game as it unfolds. Likewise in geopolitics and war, emotions can get one killed, or, be channeled by reason and superior strategic thinking into a plan that satisfies short-term requirements but serves long-term objectives. Russia has proven time and time again that it is capable of striking this balance and now, more than ever, it must prove so again.

Paris: Made in Libya, not Syria? | Asia Times - 0 views

  • Using the criterion cui bono (who benefits?) to the Paris outrage, one notes an apparent shortage of “bono” to ISIL, unless the thinking of the leadership runs to: “It would be an excellent idea to focus the fury of the West upon us here in Iraq instead of laying low and letting the West go along with the GCC/Turkish plan of quagmiring Russia in Syria.” Doesn’t make too much sense.  Which is why, in my opinion, is why you see a lot of metaphysical hand waving that the real motive for the attacks was to erase the Muslim “grey zone,” provoke a fatal over-reaction from the West, contribute to the agonies of the Syrian refugees in Europe, rend the time-space continuum and thereby bring the Crusaders to their knees, etc.
  • Media and analyst coverage appears determined to overlay a profitable traffic-building and mission-enhancing narrative of “Western civilization under attack by ISIL,” and ignore the factors that point to the attack as a murderous local initiative, not by ISIL or the mythical immigrant threat, but by alienated Muslim citizens of the EU.  The rhetoric of righteous, united fury against a monstrosity committed by the external “other,” perhaps, is easier to digest than the awkward theme of national minorities committing extreme acts of violence against societies they believe oppress and marginalize them. So we get lots about the horrors of ISIL and relatively little about the, to me, rather eye-opening statistic that while 8% of the population of France is Muslim, it is estimated that 70% of the prison population is.  I suppose it would be churlish to explore the issue of blowback from French penal and social policies at this juncture.  But there is some interesting data that places the alleged and now apparently deceased mastermind, Abdelhamid Abaaoud, in context concerning the degree of his allegiance to ISIL.
  • Katibat al-Battar al-Libi, in other words, was formed as a rather bloody piece of outreach by Libyan Islamists to share Libya experience in insurrection and revolution with Syria.  After IS arose and became a dominant military and financial force, the “KBL” threw in their lot with ISIS, and members of the brigade subsequently returned to Libya to establish an IS beachhead. A July 2015 study by Small Arms Survey confirms the autonomous character of Katibat al-Battar al-Libi. While the uncertain relationship between JAN and IS was being clarified, Libyans stayed ‘outside’ the fray, remaining in their own units and not integrating into other IS hierarchies or command structures. In Latakia for instance, Libyans kept their own separate battalion (The Daily Star, 2013). As the split between JAN and IS deepened, Libyans chose IS but remained apart, forming the Katibat al-Battar al-Libiya (KBL) (The Libyan al-Battar Brigade), under the auspices of IS. Since its formation, the KBL has been active in eastern Syria, notably in Al Hasakah and Deir az-Zor. The battalion maintained links with Ansar al-Sharia in Libya, an early and prominent supporter of IS. Ansar al-Sharia proved to be an excellent recruiting tool and played a role in the arrival of many Libyans in Syria prior to 2014. And who is Ansar al-Sharia in Libya?  Via The Telegraph:

  • Abaaoud, a citizen of Belgium of Moroccan descent, was well known as a violent radical miscreant linked to an Islamic cell in Verviers, Belgium, that did all sorts of mean, murderous crap.  As far as Belgian and French authorities were concerned, he had been an item long before Paris.
  • Washington believes the group is responsible for the 2012 attack on the US consulate in Benghazi that killed the ambassador and three other Americans.  In November, the United Nations blacklisted Ansar al-Sharia Benghazi and its sister group, Ansar al-Sharia Derna, over links to Al-Qaeda and for running camps for the Islamist State group.  So there you have your soundbite.  The Paris outrage: Made in Libya.  Not Syria.  And brought to us by the people who killed Christopher Stevens in Benghazi. I am sure that Hillary Clinton is grateful to the French police for botching the raid to capture Abaaoud and pumping 5000 rounds into his apartment instead of capturing him; otherwise, he might have become a lively topic of interest and curiosity and the right wing could have cooked off the Benghazi! munitions through election day.  For that matter, it seems unlikely that the governments of the West, or the media cheerleaders thirsting for a rousing good vs. evil narrative, are very interested in exploring the morally fraught issue of blow back from the spectacular Libyan disaster, either. To sum up: the alleged and now reportedly deceased architect of the Paris attacks, Abdelhamid Abaaoud, did not fight “for IS.”  He fought “with” Katibat al-Battar al-Libi, a Libyan outfit whose presence in Syria predates that of ISIS.  Even after Katibat al-Battar al-Libi decided to pledge allegiance to ISIS, it retained its independent identity.  And it would appear unlikely that Abaaoud, as a European of Moroccan descent, would be a central figure in the brigade, whose personnel, funding, and mission seem to have largely emanated from Libya.
  • Despite his seemingly junior status in an autonomous militia, it is possible that Abaaoud was recruited by al-Baghdadi to commit the Paris outrage.  But foreign fighters flock to Syria not only to accumulate general jihadi merit, but also to acquire skills they could apply in their own struggles.  And Abaaoud may have gone to the Syrian war zone to hook up with an extremely capable Libyan outfit and acquire the experience and connections to fulfill his own ambitions for mayhem in Europe, and not necessarily to support the global or even local objectives of the IS caliphate.  So it is by no means axiomatic that Abaaoud returned to Europe with the mission to execute a high-level ISIS strategy. Instead, Abaaoud might have been an angry guy with the skills, resources, and inclination to commit mass murder on his own kick.  The police were already after him big time after the Verviers raid in January (we are now told that Abaaoud was “on” or a “candidate for” a spot on the drone assassination assignment list, but I wonder if this is post-hoc ass-covering).  So maybe he and his friends decided to pull the pin, and go out in a big way.   • Taser’s Axon body camera data management software on Evidence.com will run on Azure and Windows 10 devices to integrate evidence collection, analysis, and archival features as set forth by the Federal Bureau of Investigation Criminal Justice Information Services (CJIS) Security Policy. As per the partnership, Taser will utilize Azure’s machine learning and computing technologies to store police data on Microsoft’s government cloud. In addition, redaction capabilities of Taser will be improved which will assist police departments that are subject to bulk data requests. Currently, Taser is operating on Amazon Web Services; however this deal may entice police departments to upgrade their technology, which in turn would drive up sales of Windows 10. This partnership comes after Taser was given a lucrative deal with the Los Angeles Police Department (LAPD) last year, who ordered 7,000 body cameras equipped with 800 Axom body cameras for their officers in response to the recent deaths of several African Americans at the hands of police.

Taser, according to records and interviews, allegedly has “financial ties to police chiefs whose departments have bought the recording devices.” In fact, Taser has been shown to provide airfare and luxury hotels for chiefs of police when traveling for speaking engagements in Australia and the United Arab Emirates (UAE); and hired them as consultants – among other perks and deals. Since 2013, Taser has been contractually bound with “consulting agreements with two such chiefs’ weeks after they retired” as well as is allegedly “in talks with a third who also backed the purchase of its products.”

  • Russian President Vladimir Putin said on Monday he would start pulling his armed forces out of Syria, five months after he ordered a military intervention that turned the tide of the war in favor of Syrian President Bashar Assad."I believe that the task put before the defense ministry and Russian armed forces has, on the whole, been fulfilled," Putin said at a Kremlin meeting with his defense and foreign ministers at which he announced the withdrawal, starting Tuesday.Kremlin spokesman Dmitry Peskov said Putin had telephoned Assad to inform him of the Russian decision, but Peskov said the two leaders had not discussed Assad's future - the biggest obstacle to reaching a peace agreement.
