If reality is as stated, the reporter has a pretty strong civil rights case against the government officials who knowingly participated in the theft and retention of the reporter's notes, two distinct conspiracies. Under the 4th Amendment, officers executing a search and seizure warrant may lawfully seize the items particularly described in the warrant and any other evidence of crime that is in plain view during the search. It's a big push of credibility to argue that reading documents stored in a bag in search for a gun falls within the "plain view" doctrine. The officer could instead just reach his hand into the bag and feel around for a gun. Quite a few extra steps involved in removing the documents and reading them simply to determine whether the bag contains a gun. Add in the facts that: [i] the supposed recognition of government documents argument does not explain why the officers seized personal handwritten notes too; and [ii] the evidence that the officer who discovered the docs had learned that the reporter was one who had called the conduct of his agency into question, and it comes out smelling a lot more like an attempt to discover the reporters' sources than a legitimate search for guns when the bag was searched.   Only one side heard from so far, of course. But this sounds more like low-level government officials who were ignorant of their legal obligations than a White House-driven scandal. But I wouldn't want to be the government lawyer who authorized the retention of the seized notes and other documents. They should have been returned without retaining copies the instant the lawyer learned of the circumstances of their seizure. There's not only a 4th Amendment liberty interest but also a 1st Amendment freecdom to communicate anonymously right protecting those documents and notes.

What troubles me the most about this event, assuming the truth of what's reported, is how well known the limitations on execution of a search warrant are within the law enforcement community. If it happened as described, it seems very unlikely that the officer who grabbed the documents did not know he was violating the 4th Amendment. Ditto for the lawyer or other official(s) who learned of what went down shortly thereafter, but kept the documents anyway. There's an arrogance that goes with government and corporate officials who don't have to personally pay damage awards. With no personal monetary liability (in reality, since the government or corporation picks up the tab), it becomes a matter of personal ethics and whether the misbehavior will anger or please the boss. If the ethics are weak, that becomes a pretty simple choice.

I give a lot of credibility to this article's author when it comes to matters involving the oil market. Remember when reading that the only thing propping up the U.S. dollar is the Saudi (later extended to all OPEC nations) insistence that they be paid for their oil and natural gas in U.S. dollars, which creates artificial demand for the dollar globally. If the Gulf Coast States begin accepting payment in rubles or yuan, it is curtains for the U.S. dollar in global markets.

Economic comparison that describes the prosperity differences between a Republican led congress and a Democratic controlled congress. Excerpt: If you want to give Bill Clinton credit for economic results during his terms, you have to link those results to his policies.  If you want to give him credit for those policies, you must admit that they were virtually all in line with Republican rhetoric and antithetical to modern liberalism. Conservatives like me have always encouraged tax rate cuts, spending cuts, free trade and eliminating government programs like welfare and the byzantine farm program.  Reagan did what he could (with a Democrat-controlled House the entire time), and the economy grew 3.5% annually over his eight years.  Clinton did these things as well (with Republicans controlling both houses of Congress his last six years), and the economy grew 3.8% annually over his eight years. This is not hard: cut taxes, cut spending, cut programs.  Oh, and elect Republicans to the Senate.  At least that's what the facts say.

Whoa!  Incredible fact filled analysis of the pre election GDP numbers released by Obama. excerpt:  Disposable personal income decreased in nominal terms q/o/q by 5.9% while in real terms (inflation adjusted) it decreased q/o/q by 7.4%!  That is an enormous swing in purchasing power and not in the right direction! Personal outlays increased $148.2 billion (5.8 percent) in the third quarter, compared with an increase of $8.2 billion (0.3 percent) in the second. Personal saving -- disposable personal income less personal outlays -- was $364.6 billion in the third quarter, compared with $533.1 billion in the second. The personal saving rate -- saving as a percentage of disposable personal income -- was 3.3 percent in the third quarter, compared with 4.9 percent in the second. So into decreasing personal income and disposable personal income people tried to spend anyway.  Best guess: most of this was "cash for clunkers", which is the worst sort of "spending" - it is the taking on of more debt by replacing a paid-off car with one that now comes with a shiny (and nasty) payment book.  The Trade: Go long auto repo outfits (aside: as far as I know there are no publicly-traded repo companies.) Nothing in here I like; to the contrary, this report sucks and on a drill-down appears to be full of outright lies.

Spot on analysis by a retired Navy lawyer who knows his U.S. military history.The striking parallels he points to between contemporary U.S. drone terrorism and the notorious Viet Nam War Phoenix Program terrorism are no accident. Among the super-hawks of the War Party, there has been a persistent meme that the U.S. military suffered no defeat in Viet Nam, that the vaunted "counter-insurgency" strategy and tactics were working, and that the war was lost by politicians and the American public who lost the nerve to continue the war.  If you put your blinders on firmly enough to pretend that the North and South Vietnamese were separate people, there's an element of truth to that myth. The South Vietnamese Viet Cong guerrillas were decimated by 1970. But the North and South Vietnamese were in fact one people of a single nation, who had united to defeat and evict the French military force. The division into two nations was to have been only a one-year thing, prelude to national election of a government for a reunited Viet Nam. It was the U.S. puppet government of the South that, realizing they could not win the election, reneged on allowing it in the South.  Long before the Viet Cong became a shadow of its former force, the Vietnamese from the North had responded to the betrayal of the treaty by sending North Vietnamese regular army troops ("NVA") to the South, spearheaded by the same battle-hardened men who had defeated the French. And the U.S. military was well and truly overwhelmed by the NVA's strategy and tactics, forced to retreat into strongholds from which they ventured only in force. The NVA's Tet Offensive in 1968 failed to succeed in the effort to capture multiple Vietnamese cities concurrently. Too hot to handle. An honest investigation would have revealed Hillary and the CIA's involvement in running the CIA/State Dept. "ratline" of weapons from Libya to jihadis in Syria via Turkey. Republicans have no love for Hillary, but the fact that the U.S. was supplying weapons to the jihadis long before the Syrian government was falsely accused of using Sarin chemical warfare would interfere too much with the current "ISIL" narrative. Can't force that kind of dirt out into mainstream media because it might hinder U.S. war industry profits.

The return of the occupied Golan Heights is absolutely required by the U.N. Charter, Geneva Conventions, and numerous U.N. Security Council resolutions.  Israel's purported security concerns do not create a lawful exception. What is really at stake in the Golan Heights and the occupied territories of Palestine is whether the U.N. Charter did in fact put an end to the right of Conquest. 

Indirect negotiations to begin in Cairo today and this time, Israel has agreed to participate. The success of the negotiations depends, in my opinion, on how hard the U.S. is willing to push Israel. Obviously, Obama has pushed harder in the last few days because Israel is not boycotting the negotiations and is pulling its troops out of Gaza and Turkey's determination to deploy its Navy to end the Israeli naval blockade of Gaza. Israel boycotted the last negotiations held a couple of days ago in Cairo and immediately broke the cease-fire that Egypt had arranged. Israel has run up a trial balloon for the U.N. to take over administration of Gaza but I think it unlikely that the Palestinians would agree to that without U.N. peacekeeping forces stationed there with authorization to respond militarily if Israel maintains or reinstates its blockade of Gaza or invades again. It bears notice that Israel pulled off a propaganda coup by convincing western mainstream media that the tunnels from Gaza to Israel were created for purposes of terrorist attacks in Israel. In fact, the tunnels were built to smuggle supplies into Gaza, which has been blockaded since 2007. That Israel has now destroyed 32 of those tunnels only cranks up the humanitarian crisis in Gaza, which now has a drastically reduced ability to bring in critical foodstuffs and medical treatment supplies. Massive tunnel destruction has also been done by the Egyptian government on the southern Gaza border, so the Gaza situation is now desperate.  Hopefully, the Turkish military's announced plan to guard a convoy of ships to deliver humanitarian aid to Gaza happens very soon.  But note that this truce is only for 72 hours. I think it very likely that Hamas will resume rocket attacks on Israel at the end of that period unless massive humanitarian aid reaches Gaza before the end of that period.

From a Ninth U.S. Circuit Court of Appeals en banc ruling in 2010. The Court's holding was that federal investigators had vastly overstepped the boundaries of multiple subpoenas and a search warrant --- and the Fourth Amendment --- by seizing records of a testing laboratory and reviewing them for information not described in the warrant or the subpoenas. At issue in this particular case was the government's use of a warrant that found probable cause to believe that the records contained evidence that steroids had been found in the urine of ten major league baseball players but searched the seized records for urine tests of other baseball players. The Court upheld the lower courts' rulings that the government was required to return all records other than those relevant to the ten players identified in the warrant. (The government had instead used the records of other player's urine tests to issue subpoenas for evidence relevant to those players potential use of steroids.) This decision cuts very heavily against the notion that the Fourth Amendment allows the bulk collection of private information about millions of Americans with or without a warrantor court order on the theory that some of the records *may* later become relevant to a lawful investigation.   Or rephrased, here is the en banc decision of the largest federal court of appeals (as many judges as most other federal appellate courts combined), in direct disagreement with the FISA Court orders allowing bulk collection of telephone records and bulk "incidental" collection of Americans' telephone conversations on the theory that the records *might* become relevant to national security investigations. Yet none of the FISA judges in any of the FISA opinions published thus far even cited, let alone distinguished, this Ninth Circuit en banc decision. This is all information that has been out there in the alternative media for over a year. But CNN has decided to push it forward now.  If you click through and watch the CNN segment, you'll learn about the incredible lengths CIA is going to keep anyone with knowledge of actual events from talking to media or Congress.  What is being covered up is the fact that the Obama administration authorized the ratline of weapons from Libya to Syria long before Congress authorized the arming of the Syrian opposition.

The neocons are howling about former Reagan Secretary of State James Baker being one of Jeb Bush's advisors. Baker has never been forgiven by the neocons since he barred the Israeli Deputy Foreign Minister -- Benjamin Netanyahu -- from being allowed into the State Dept. building because of his outrageous public statements. Now Baker is doubly hated because he is scheduled to be a keynote.  speaker at a conference of the liberal pro-Israel J Street lobbying group. J Street is "left-leaning" in neocon eyes because it actully supports a 2-state solution in Palestine, rather than using the 2-state solution as a political fig leaf while Israel completes its colonization of Palestine and then annexes it. But while screaming that only AIPAC represents Israel's real interests and acknowledging that Baker is closely tied to the Bush family, they're not addressing the political reality that Baker is the global oil industry's top lobbyist nor the fact that it was Baker who put the kibosh on the neocons' goal of privatizing all the oil in Iraq and flooding the market with cheap oil to break the OPEC Cartel. The western oil companies are profoundly against privately owned oil in the Mideast and even less enthused about breaking the OPEC Cartel, which normally keep crude oil prices high, enabling higher oil company profits. Apparently the oil industry also wants the 2-state solution to actually happen in order to obtain a more stable Middle East. And that is anathema to Netanyahu, AIPAC, and the neocons..
