  • The Fed was sued by financial news network Bloomberg two years ago.  Bloomberg wants the Fed to reveal which banks received $2 trillion in bailout money and why.  Bloomberg won the case and the Fed appealed.  Bloomberg, also, won the appeal in March 2010!  The precedent setting case would force the Fed to reveal the details of secret bank bailouts–including $500 billion given to foreign financial firms!!    In a Bloomberg story earlier this week, lawyers representing the Federal Reserve (which is made up in part by big U.S. banks) said, “U.S. commercial banks will take their fight against disclosure of Federal Reserve (documents) in 2008 to the Supreme Court if necessary . . .”  Lawyers representing the Fed say they are worried that if details of trillions of dollars in bailouts are revealed, it could cause another financial meltdown.  General Council for the Fed, Paul Saltzman, says, “Our member banks are very concerned about real-time disclosure of information that could cause a run on the banks.”  This is another story, with dire implications, the mainstream media is ignoring.  (Click here for the complete Bloomberg story)

    This article has two parts.  The first is Bernanke's waarnign to Congress that the Federal debt is out of control and they need to raise taxes AND cut spending.  The second part however is far more interesting.  Author Greg Hunter describes the Bloomberg Media court quest to force the Fed to reveal which banks received $2 trillion in bailout money and why.  Bernanke of course is fighting in the courts to keep this secret.   excerpts:  Earlier this week, Fed Chief Ben Bernanke told Congress to basically raise taxes and cut the federal budget.  The inference was, if Congress doesn't get its financial house in order, it will be their fault if the economy tanks.  Here is how Bernanke actually said it, ". . .   • It’s a mystery I covered from the start and now it has been solved. A big breaking story this morning features startling revelations about the infamous raid by antiwar activists on the FBI office in Media, Pennsylvania, (yes, that’s the name) in 1971, on the night of the Ali-Frazier “fight of the century,” who are finally exposing themselves in a new book and film. The book is by the Washington Post reporter who received some of the leak files back then, Betty Medsger. The activists, none of them household names then or now, cleared out all the files there that day and this led to the first big scoops on illegal FBI surveillance and the notorious COINTELPRO program, which we covered so widely at Crawdaddy that decade. One of the perps even waved to Edward Snowden on the Today show today and said, “Hi, from one whistleblower to another.” And The New York Times has now posted a thirteen-minute video.
  • Of course, by 1971, there had been rumors and personal reports about undercover FBI snooping, including use of electronic surveillance, for years but with little black-and-white official evidence. Hell, we even had a break-in at the Crawdaddy office that seemed suspicious and, as a longtime (if minor) antiwar activist, I always figured I might have drawn some official attention. But the Media raid proved incredibly valuable, even as it made many of us more paranoid. Indeed, as NBC reports: Among the stolen files: plans to enhance “paranoia” among “New Left” groups by instilling fears that “there is an FBI agent behind every mailbox.” Another instructed agents in the Philadelphia area to monitor the “clientele” of “Afro-American type bookstores” and recruit informants among the “the Negro militant movement.” The raid and its results didn’t immediately stop COINTELPRO, then run by good old Deep Throat himself, Mark Felt.

From NBC: “These documents were explosive,” said Medsger, who was the first reporter to write about them after receiving a batch of the files anonymously in the mail. Her book traces how the stolen files led to a landmark Senate investigation of intelligence and law enforcement agency abuses by the late Idaho Sen. Frank Church, and eventually to new Justice Department guidelines that barred the bureau from conducting investigations based on First Amendment protected political activity. After the burglary, said Medsger, “The FBI was never the same.” Glenn Greenwald weighs in on today’s revelations. He is, of course, supportive of the 1971 action.

    The New York Times video is worth watching for its historical footage and the linked post by Glenn Greenwald adds valuable perspective about the failure of NYT and the LA Times to do anything with the documents. Only the Washington Post pushed the story. One might wonder if these days, any mainstream media might have covered the Snowden documents had The Guardian not told The Washington Post that the Guardian was going to run with the story regardless.

  • Texans are having nightmares of a Niger Delta nature, and while they have always been the friends of Big Oil, TransCanada is changing the rules of the game in a legally-aided land grab that will test just how tough Texans are.
  • The lawsuits against TransCanada are piling up to the dismay of the Keystone XL pipeline project, which has been beleaguered by political, socio-economic, environmental and legal woes at every step from its US origins in Montana to its final destination point in south Texas. No one thought Texas would be part of the problem: Texans love their pipelines. Why the change of heart, then? The simplest answer is that Texans love their pipelines because Big Oil has been paying big bucks for the privilege of running them through Texas farmland, but TransCanada is bullying them out of their fair share. This is how it works: TransCanada makes an unacceptably low offer for the land it needs; the landowner rejects the offer; TransCanada gets the land condemned in court; then it legally acquires the land for a fraction of its original offer. Condemning land is not a new tactic by Big Oil, but while US oil companies have traditionally kept this to a minimum, TransCanada has taken far too much advantage of this legal loophole to get what it wants. According to CNBC.com, the Canadian company has so far condemned over 100 tracts of land out of the 800 tracts it has acquired for the pipeline in Texas.
  • Since Texans are being forced to give up their land for peanuts for the bigger picture “common good”, let’s look at why they aren’t buying it and why they don’t feel any less patriotic for their opinion. (Common good in this case meaning “national interest”)

  • First of all, Texans point out that TransCanada is a foreign company that does not feel obliged necessarily to use American steel for its pipeline construction. According to media reports, a large percentage of the steel used for construction is imported. They also balk at the idea that much of the tar sands oil refined it Texas will be exported via the Gulf of Mexico. If the US is going to export its crude oil that should mean that it is producing more than it needs. In other words, the US must achieve oil independence before it starts exporting oil; otherwise it’s moving away from rather than toward independence. Every good Texan knows this. The US is producing about 6.2 million bpd this year, and consuming twice that. To the Texan mind, foreign-company plus exports does not add up to a reduction of US independence on foreign oil. It only adds up to revenues for TransCanada and Big Oil.
  • What is most interesting is that Texans will end up making Keystone XL a bipartisan issue. Previously, anyone who balked at Keystone XL environmental and socio-economic risks was a tree-hugging hippie. Anyone supporting Keystone XL was a Big Oil “yes man” with no respect for the environment. With Texans now up in arms over Keystone XL thanks to TransCanada, the debate will metamorphose into something more rational. The Texans, in their own unique way, will bring legitimacy to this debate. After all, no one could accuse them of being tree-hugging liberals. Texans want Keystone, they want pipelines, but they won’t stand for being cut out of the “common good” equation. To this end, some landowners are opening the gates to activists to stage protests, and this has so far ended in a handful of arrests.

    Keep your eye on this battle. It sounds like the same conditions that led to the farmer uprising over the Minnesota Powerline Project in the late 70s. < http://en.wikipedia.org/wiki/CU_project_controversy#Organizations_formed_to_fight_the_power_line >.   In that fiasco, farmers occupied tower construction sites, tore down towers, shot out over 10K power line insulators, and sprayed hog manure on the state police using manure spreaders, on and on. And the establishment couldn't get a single criminal conviction because juries simply refused to find accused protesters guilty. A good time was had by all. 'Twas a marvelous rebellion, going well beyond passive resistance to include rampant sabotage. Will Texas farmers and ranchers follow that lead? It sounds like they may be.

      Disclosure here:  I actually met Buffett back in the 70's while workign at the Millyard Restaurant in Manchester NH.  Buffett purchased the old Amoskeag Mills "Berkshire Hathaway" shirt manufacturing building just across the Merrimack River.  Nice guy, very friendly, polite and considerate.  Of course, that was years before he made it big investing in the worldwide, McDonald's led USA franchise explosion of the late 80"s.  For sure he made a great call predicting that President Reagan would succeed in ending the Cold War, collapsing the walls, and unleashing the capitalist forces of both free and merchantilist trade.  And that the USA Franchise system was extremely well prepared to launch worldwide as soon as the barriers fell.  He made billions off this call.  Knowing Paul Volker does pay off.

    What is it with billionaires these days? Buffett suggesting we need to tax him more? Stop coddling the super-rich he says.  In other words, he's saying "I've done such a fine job with my money, now I want to give more to a government that hasn't."  Mr. Buffett, has someone changed your suppositions? It seems counter intuitive to your "invest in great management" philosophy.  Shouldn't you really be telling the government to cut costs? Just like you demanded of your Netjets, Clayton Homes, and Helzberg Diamond Shops executives.

  • The massive consolidation of wealth, combined with the removal of any limits on money in campaigns, has allowed for the purchase of our government. Today I am publishing a comprehensive and important guest essay,&nbsp;The Purchase of Our Republic, by longtime correspondent Y. Falkson.
  • Americans know that something is wrong, deeply wrong.&nbsp;They see signs of the problem everywhere: income inequality, growing concentration and power of mega corporations, political donations/corruption, the absence of jobs with decent salaries, the explosion of the US prison population, healthcare costs, student loan debt, homelessness, etc. etc.&nbsp; However, the true causes and benefactors behind these problems are purposely hidden from view. What Americans see is Kabuki Theater of a functioning form of capitalism and democracy, but beyond this veneer our country has devolved into the exact opposite. Those who benefit from this crony capitalist state go to extreme lengths to paper over the reality and convince Americans that the system works, the American Dream is still a reality and that American democracy is in fact democratic. Below I hope to begin to outline some of the underlying dynamics and trends that have evolved in recent decades and led us so far from what we once were. As fun as it would be, the answer is not some evil conspiracy by the Illuminati, but rather the unfortunate result of three long term and mutually reinforcing components that have been attacking the fundamental roots of the structure of our Republic. The consequence of the first two components is a democracy in name only that represents the very few.

  • 1. Faux Capitalism = Wealth Consolidation / Income Inequality
  • While there is no true beginning to the story, we can start with the incredible build up and concentration of wealth among corporations in recent decades.&nbsp;The USA now boasts a cartel-like set of corporate titans in almost every industry. It goes beyond, but certainly includes, our Too Biggerer To Fail banks, merged from what was 37 banks in 1995 into a Frankenstein’s monster like 5 (Citigroup, JP Morgan-Chase, Bank of America, Wells Fargo and Goldman Sachs). In agriculture, Monsanto alone controls over 85% of all corn and soy bean crops, four companies control 83% of the beef market, 66% of the hog market and 58% of the chicken market. So while shopping at the grocery store might appear to be the manifestation of capitalism at its finest, it doesn’t take much digging to look behind the curtain to see how little competition truly exists.
  • When the average American goes to pick up some groceries, they are shopping at Walmart and buying something from P&amp;G that is mostly made of Monsanto corn. Is that true choice? The same story plays out with our news and media (and other industries) where we have gone from 50 companies in 1983 to the big 6 which control over 90% of all media. Is choosing to watch one of 30 news channels, all of which are owned by News Corp (Rupert Murdoch) a real choice? This is not capitalism and they are not competing, not in the true sense of the word. Along with this consolidation of corporations in recent decades, their senior leaders have taken up a larger and larger piece of the pie at the expense of their employees. In particular, the ratio of CEO-to-worker pay has increased 1,000 percent since 1950. Unsurprisingly, Walmart is both the largest employer in the country and the worst CEO pay offender with a ratio of over 1000:1. This is at a time where worker productivity has increased significantly, something that historically correlated with increased pay. But no more.&nbsp;It’s a new twist on the old Soviet saying “we pretend to work and they pretend to pay us”, but now it’s closer to “we do all of the work and they pretend to pay us”.
  • Private Wealth: As a consequence of the royal tribute we pay to the C-suite class these days, we have likely surpassed the pre-Depression Roaring Twenties in terms of inequality.
  • This, amazingly, has only accelerated since the crisis in 2008 in thanks to bailouts, Quantitative Easing and other gifts from Congress and the Fed. The wealthy 1% and in particular the .01% have now grown their fortunes to levels that tax comprehension and even their ability to spend it (the decisions by a few billionaires such as Bill Gates to essentially donate his fortune is a tacit acknowledgement that our current system over provides wealth to a select few).
  • So what is an incredibly wealthy capitalist CEO of a mega-corporation do once they control their industry and have essentially limitless wealth? Well in a competitive market, the only way to go from the top is down and the only thing that can make that happen is competition. Consequently, competition must be avoided whenever possible.
  • To squash or prevent competition, the oligopolies and oligarchs target their resources on the one place that can make competition illegal, our government.Something to keep in mind the next time you see a corporate billionaire grandstanding about the importance of “Free Markets” when their strategy is quite the opposite. As this capture of the government has taken place we have essentially shifted from capitalism and to crony capitalism. So we now have industries that have mastered the art of faking capitalism by turning our government into one that fakes democracy. This government takeover took time, but the purchase of all 3 branches of government has almost been completed by 2014. You don’t have to take my word for it, luckily that has now been empirically proven&nbsp;in an analysis of over 20 years of government policy where the clear conclusion was that policy makers respond solely to those in the top 90th percentile and essentially ignore the large majority of Americans.
  • 2. Wealthy Purchase of Government Institutions / Elections
  • Purchase of the Executive Branch:
  • Let’s take a step back and take a glimpse at how the government was purchased, beginning with the executive branch. In 1980, Reagan’s election cost less than $300 million. When Bush beat Kerry in 2004, it cost almost 3x times as much, almost $900 Million. 4 years later, the 2008 election cost a record $1.3 Billion. It was in this election where Obama hammered the final nail in the coffin for government funded for elections. Obama, more so than any other candidate in recent decades had the widespread support of millions of small donors, but in the end I guess it wasn’t enough. So when Obama “leaned to the green”, it forever set the precedent that you can’t win without the backing of our nation’s oligarchs. Consequently, the money has only gushed in since as the cost of Obama’s reelection in 2012 skyrocketed to an unfathomable $7 billion. Needless to say this is slightly above the rate of inflation. Our Presidents are now preselected exclusively by a tiny fraction of Americans can have the money to fund what has become necessary for a legitimate run. Summary:&nbsp;Candidates spend years courting the super-rich to build up a multi-billion dollar war chest. Only those who succeed can actually run a campaign that an average American will be aware of. Then Americans get to choose one of the pre-selected “candidates”. No wonder voter turnout is so low… Executive branch, check!
  • – Note that media corporations benefit doubly as they can use their cash to fund elections, but are also the beneficiary of all that money as it is used for campaign spending.
  • Purchase of the Legislative Branch:
  • The process has progressed similarly in Congress. In 1978, outside groups spent $303,000 on congressional races. In 2012 that was up to $457,000,000. That is over 1,500 times the level in 1978. It would be funny, if it was so blatant and terrifying. By many accounts, our “leaders” in Congress spend 50% or more of their time working the phones or fundraisers rather than trying (and failing) to actually do the “people’s business”. Let’s also take a minute to appreciate the hypocrisy of anyone that pretends that the money doesn’t influence our government. Businesses do not give to politicians for charity. This is a payment for services that has proven exceedingly reliable and profitable.&nbsp;The ROI for money invested in purchasing Congressman is what CEO dreams are made of. No wonder the incentive is to invest in Congress rather than R&amp;D or marketing. There are very few places in the world or times in history where you can find ROI’s in the thousands, or even the tens of thousands.
  • Review:&nbsp;Congressmen beg for money to get elected, make sure to vote the way your benefactors would like, consequently get more money to get elected again. If at any point they do lose or quit, they take the big payday to work for those who have been paying them all along. Legislative Branch, Check!
  • In addition, increasingly those who work on Congress (and regulators) were previously employed by these large corporations or expect to work there later. A recent example is Chris Dodd who left the Senate the head lobbyist for Hollywood at the MPAA, the guys behind SOPA and PIPA, but there are many many others.
  • Judicial Branch Endorsement of the Purchase of Government:
  • Last but not least, we have the enabling Judicial Branch. It only took a few purchased presidents to ensure the appointment of a majority of “free market” and “pro-business” judges. For instance, and disgracefully, Clarence Thomas was once legal counsel for Monsanto, but has not once recused himself from any cases involving Monsanto and always votes in their favor. These radicals have now fully endorsed and enabled the influx of money used to purchase the other branches. Specifically, 2 major decisions have completely opened the floodgates, Citizens United and McCutcheon. The first allowed unlimited contributions of corporate money into elections and brought us the notorious declaration that “corporations are people” and that “money is free speech”. This was more recently followed up with the private wealth equivalent in McCutcheon. In this ruling, Supreme Court Chief Justice John Roberts said as part of his majority opinion (presumably with a straight face) “… nor does the possibility that an individual who spends large sums may garner influence over or access to elected officials or political parties”. And with this, the Supreme Court has fully endorsed both major sources of immense wealth to purchase our elections and consequently our government. Review:&nbsp;The rich fund Presidential elections, Presidents nominate “business-friendly” judges and then the bought Congress approves their nominations. New judge then votes to ensure even more money is allowed to purchase elections. Judicial Branch, CHECK!
  • 3. A Faux Republic Dependent Upon the Funders and Not the Voters
  • The Founder’s Hope and the Sad Reality:
  • Acknowledging where we are as a country, it is often helpful to look to where we started for some perspective. Unsurprisingly, this type of problem was not overlooked back in the 18th century. In 1776, James Madison stated that his goal was to design a republic in which “powerful interest groups would be rendered incapable of subdoing the general will”. Madison hoped, perhaps naively, that factions would be thwarted by competing with other factions. Sadly, we are now in a time where factions (aka wealthy special interests) subdue the will of the people and ensure the government responds to them alone on those issues where they have a “special interest” and consequently asymmetric stakes in the game (Charles Hugh Smith). As a result, these groups essentially collude to allocate their resources to their own issues, but do not “thwart” or compete with other factions as they do the same. It’s a pretty great system, as long as you’re one of the wealthy few who can use their money to drown out the poor and voiceless many. And just like that, what was once a Republic has become a corrupt shell of its past self. All the signs are still there; votes, elections, campaigns, branches of government, etc., but behind the scenes the only ones represented are those who can afford to be heard.
  • Summary:&nbsp;This massive consolidation of wealth, combined with the removal of any limits on money in campaigns, has allowed for the purchase of our government, or as Dick Durban once stated, “frankly they [the banks in this case] own the place”. If money = free speech, then those with all the money, have all the free speech.
  • What Might Help? Now that I have likely and thoroughly depressed the reader, let’s bounce around some ideas for what can be done. As stated in the beginning, this is not an unknown problem and many people are promoting a number of ways to fix or at least ameliorate the problem. I will briefly describe just a few which I think provide some direction any of us could easily implement or support.
  • Change the Rules:&nbsp;Laurence Lessig of Harvard Law has put forward a visionary proposal for re-writing the way that campaigns are financed in his book,&nbsp;Republic, Lost: How Money Corrupts Congress--and a Plan to Stop It. Put simply, he would like to empower every voter with a stipend, say $150 per election to give to whatever candidate or candidates they prefer. If you would like to accept this money, you would need to forgo any other contributions or support (one would hope including the indirect PAC kind). This would actually provide even more money than is used in current elections, but would effectively democratize the funding process. While there would still be a “funding election” that takes place before the actual election, the funding would not be unequally provided. Lessig’s work has only begun, as this sort of bill or likely constitutional reform is nearly impossible to achieve, but he has undertaken and I assume will continue to implement many brave and creative ways of bringing about the change all American’s should support. Most recently he has suggested we begin to fund, ironically enough, a Super PAC to end all Super PACs. It would be funded with the solitary goal of changing how money impacts our elections.   • Change Our Day-to-Day:&nbsp;At the more micro level, Charles Hugh Smith believes that we will inevitably see our overly centralized and inefficient system erode away as it is replaced by more resilient, local and efficient businesses and societies outside of the current system. With that in mind, he recommends that&nbsp;“all anyone can do is the basic things--lower our energy footprint, stay healthy and avoid unnecessary medications and procedures, support local businesses, organic food growers, etc. In other words, what we can do is support local businesses that are part of the emerging economy rather than support corporate cartels.” Your Vote Does Matter:&nbsp;Do you live in Ohio, Florida or New Hampshire? Probably not. Despite what we are told every 4 years, there are actually states outside of the “swing states”, and even more surprising, the very large majority of Americans live in those states where your “vote doesn’t matter”. New Yorkers an Californians all know their state will turn Blue no matter who the candidates are and either don’t vote at all, or often vote for the Blue team in order to feel like they are on the winning side.
  • The truth is that if you see the election as Red vs. Blue, you vote probably doesn’t matter.&nbsp;But here is the trick, if all the people who think their vote didn’t matter decided to vote for whom they might actually believe in, then their votes just might matter.
  • What if all the growing number of “Independents” (who usually still vote Blue), chose to vote for a third party? What if a third party candidate won a state like New York or California? What if that candidate was one whose primary promise to the voters was to champion a change to the role of money in government (perhaps in line with what Lessig proposes)? Would you vote for such a person?I would argue you should. If California alone (with 55 electoral votes) were to vote for a 3rd party that would likely prevent either Red or Blue candidate from winning the requisite 270 electoral votes.
  • Think about the message that would send to both parties.&nbsp;I would predict that both sides would start to bend over backwards for an endorsement from that 3rd party and they would have to get it by taking up the same primary cause for reforming money in government. Consequently, at the root of our corrupted system which is perpetually ignored as both sides might suddenly become the big issue of the election. Then maybe we might begin to turn things around.

  • For the first nine days of February, eight of the Los Angeles Police Department’s top brass were 7,500 miles away from home, being shuttled around Israel in a minibus.
  • LAPD Deputy Chief Jose Perez, a good-natured 30-year veteran of the department who oversees its central bureau, tweeted updates at nearly every stop. On Feb. 2, he shared a group photo of the Los Angeles delegation visiting the corporate headquarters of Nice Systems, an Israeli security and cyber intelligence company that can intercept and instantly analyze video, audio and text-based communications. (A seemingly tongue-in-cheek inspirational poster on the wall behind them reads: “Every voice deserves to be heard.”)

Weekly investigations in 2012 found that the LAPD uses expensive StingRay devices, which can locate cellphones (and their users) by acting like cellphone towers, and license-plate recognition cameras that track millions of drivers. Although both devices technically require a warrant to be used in a police investigation, there is little way to know whether police are always complying with the rules.
  • Surveillance drones manufactured by Israel Aerospace Industries (IAI) and Sky Sapience were also hot items on the LAPD tour. Both Frank and Perez lit up when talking about the HoverMast, a new tethered drone from Sky Sapience that was just released to the IDF late last year. “There are several things on the wish list, but we did like Sky Sapience — that was incredible,” Perez said. “For me personally, just for my command, which is five stations, and all the special events that I have, crowd control and being able to see everything would be some technology that is needed immediately.” However, Frank added, the HoverMast “has its challenges: from a political standpoint, convincing our political leaders, and from a community standpoint, convincing the community that it’s not Big Brother watching over you.”
  • A spokeswoman for Sky Sapience said the HoverMast can intercept wireless communications, and its cameras are capable of facial recognition. A spokeswoman for IAI said that while showing LAPD officers their drones, the company “wanted to emphasize the fact that drones can be very helpful in giving intelligence in urban scenarios… you need it now, you need it quick, you need to see what’s inside a window, and what’s behind this building.”
  • Many of the companies attracting LAPD interest have one thing in common: They were formed by veterans of the IDF’s elite, top-secret 8200 Unit, better known as Israel’s version of the NSA.

The Washington Examiner's Tim Carney points out that the administration is filled with Googleites and that President Obama and Google have a long standing love affair. Remember Obama's No. 2 tech staffer at the White House was Google's former top lobbyist-who improperly worked with active Google lobbyists on pushing polic.... Obama appointed non-registered Google lobbyist and max-Obama donor Vint Cerf to a science advisory board.     Excellent analysis of the 2012 elections based on recent polling data and the voting history of five generations. excerpt: Pundits have long been predicting that the presidential election will be much closer and much meaner in 2012 than it was in 2008. Closer it now is. According to the RCP Poll Average, the race is now a virtual tie: Incumbent Obama now leads by a mere 1.8 percent over Romney, whereas challenger Obama led McCain by 7.6 percent exactly four years ago. It will certainly revolve around a very different array of issues-much less argument about the war on terror and GOP performance, and a lot more about the stagnating economy and Democratic performance. In one respect, however, the next election will be a replay of the last: There will be a historically large divide in the preferences of younger voters (under 30) versus older voters (65+). In 2008, this divide (21 percentage points) was wider than in any election since the advent of age-bracketed voting data in the 1960s. The second-biggest divide (16 percentage points) was back in 1972, when nearly half of all young voters voted for McGovern while older voters went overwhelmingly for Nixon. I've been tracking generational leanings in the polls pretty carefully. The Pew Research Center has issued several reports (most notably, The Generation Gap and the 2012 Election) exploring this divide, and Time followed up with its own cover story ("The New Generation Gap"). More recently, Mike and Morley, Forbes, The New York Times, and many others have also weighed in. The Maryland trial court denied this motion, holding that the warrantless installation of the pen register did not violate the Fourth Amendment. Petitioner was convicted, and the Maryland Court of Appeals affirmed. Held: The installation and use of the pen register was not a "search" within the meaning of the Fourth Amendment, and hence no warrant was required. Pp. 739-746. (a) Application of the Fourth Amendment depends on whether the person invoking its protection can claim a "legitimate expectation of privacy" that has been invaded by government action. This inquiry normally embraces two questions: first, whether the individual has exhibited an actual (subjective) expectation of privacy; and second, whether his expectation is one that society is prepared to recognize as "reasonable." Second, even if petitioner did harbor some subjective expectation of privacy, this expectation was not one that society is prepared to recognize as "reasonable." When petitioner voluntarily conveyed numerical information to the phone company and "exposed" that information to its equipment in the normal course of business, he assumed the risk that the company would reveal the information [442 U.S. 735, 736] &nbsp; to the police, cf.     The Washington Post has reported that "on July 15 [2001], the secret surveillance court allowed the NSA to resume bulk collection under the court's own authority. The opinion, which remains highly classified, was based on a provision of electronic surveillance law, known as "pen register, trap and trace," that was written to allow law enforcement officers to obtain the phone numbers of incoming and outgoing calls from a single telephone line." .  The seminal case on pen registers is the Supreme Court's 1979 Smith v. Maryland decision, bookmarked here and the Clerk's syllabus highlighted, with the Court's discussion on the same web page. We will be hearing a lot about this case decision in the weeks and months to come.  Let it suffice for now to record a few points of what my antenna are telling me:  -- Both technology and the law have moved on since then. We are 34 years down the line from the Smith decision. Its pronouncements have been sliced and diced by subsequent decisions. Not a single Justice who sat on the Smith case is still on the High Bench.   -- In Smith, a single pen register was used to obtain calling information from a single telephone number by law enforcement officials. In the present circumstance, we face an Orwellian situation of a secret intelligence agency with no law enforcement authority forbidden by law from conducting domestic surveillance perusing and all digital communications of the entire citizenry. -- The NSA has been gathering not only information analogous to pen register results but also the communications of American citizens themselves. The communications themselves --- the contents --- are subject to the 4th Amendment warrant requirement. Consider the circuitous route of the records ordered to be disclosed in the Verizon FISA order. Verizon was ordered to disclose them to the FBI, not to the NSA. But then the FBI apparently forwards the records to the NSA, who has both the "pen register

  • A man with a kid in arm runs towards the camera. The kid's face is heavily colored, but it looks otherwise fine. On the lower left we see the back of a man with a "White Helmets" logo on his vest. Dust in the background. Always dust or smoke. A bunch of men looking very busy but are they actually doing anything? That would be a lucky by-chance photo shot for any normal photographer. Even in country where rubble from a fresh bombing may be around some near corner. But this is a typical "White Helmets rescue kid" propaganda picture. The photo above is, except for maybe the old rubble, likely completely staged. There the 43 similar pictures below the fold to demonstrate that. Just ask yourself: Could all these very similar by-chance pics, taken within about a year, be real? Really?
  • The pictures above all look astonishingly similar: rubble, dust or rather haze from a smoke grenade in the background, dusted/greasepaint bloody kids who have no visible trauma, the rescuer with the kid moving towards the camera. Dramatic, high quality scenes which do get distributed by news agencies and published again and again by major "western" media. Isn't it an amazing fortune that so many kids get rescued alive by the "White Helmets", without any serious wounds visible, just moments after bomb impacts? This week after week? With all the same attributes in each picture? No photo editor at any of the big media ever wondered about that? These staged photos are part of the war propaganda against the Syrian people and their government. The "White Helmets" take and distribute these photos. They also distribute lots of "kids rescued from rubble" videos. We wrote about those a month ago: Other typical features of these movies, see this one, are smoke (grenades) in the streets, dramatic but small open fires nearby, dust or some red color on the children's face or arms. The camera is often used in a hectic, intentionally amateurish first person view, a style extensively developed in the 1999 horror clip Blair Witch Project. Sometimes sounds of additional "bomb impact" bangs or screaming/wailing women are added. The "White Helmets" are part of the (anti-)Syria Campaign. "Kid rescued from rubble" is their standard shtick. They are financed with some $60+ million from your taxes by the U.S., the UK and other governments. Such money will buy a lot of good cameras and props and will pay for many actors and extras.
  • The Syria Campaign was created by Purpose Campaigns LLC. The company fabricates and runs for you any world-wide "grass root" movement you would like. With Purpose LLC or other such companies involved, big dollars will buy you big effects. How about an automated Twitter campaign to spread anti-Shia sectarianism? Someone paid for it and here it is. The "White Helmets" campaign demonstrates the amazing manipulation potential such companies and their high paying customers have.

It's getting real that matters :) ................... Fragmentation is an issue. Which is exactly why the core set of principles must be very limited. IMHO, restoring the founding documents and principles; the American Republic, the Constitution and the principles so famously described in the Declaration of Independence are the single point of agreement that defines "America". The founding documents created a Republic based on "individual liberty". So it would seem that the concept and value of "individual liberty" would be the single "lowest common denominator" that all Americans can rally around. Stray from the Constitution and Declaration, and you will have arguments that divide and defeat. Stay on point, arguing the value and importance of "individual liberty" and it becomes very hard to wander from the importance of limiting government, and protecting individual rights to privacy, property and prosperity. I've been very successful at arguing that a socialist can not honestly take the oath of office, oath of citizenship, or pledge of allegiance. The socialist believes that the rights and liberty of the individual is subordinate to the needs of society. For the socialist, there is no such thing as individual liberty or inalienable rights. They are un-Constitutional and un-American to the core of their being. For the libertarian, an ordered society based on limited government and the Rule of Law, is the best guarantor of effective and meaningful "individual liberty". The ess

  • Trump's National Security Advisor Flynn resigned after only three weeks in office. While I am certainly no fan of Flynn or of Trump I find this defenestration a dangerous event. It will hamper any big change in U.S. foreign policy that Trump may envision. The resignation followed a highly orchestrated campaign against Flynn by intelligence officials, the media and some people within the White House. After the election and Trump's unexpected win the Obama administration slapped sanctions on Russia and sent Russian embassy officials back to Moscow. This move was intended to blockade a Trump policy of better relations with Russia. Flynn talked with the Russian ambassador and, as a direct result, the Russian's did not respond tit for tat for the sanctions and expulsions. This was an absolutely positive move and in full accordance with announced Trump policies.
  • Despite tens or hundreds of claimed White House leaks in the media I am still not sure what really happened next. Trump's enemies and some intelligence officials accused Flynn of lying about the phone calls with the Russian ambassador. It is unclear what the alleged lies really are and especially why they should matter. Obfuscation is part of any White House business. If Flynn had secretly talked with the Israeli ambassador (which he probably did) no one would have attacked him. So why was Flynn really under pressure and why didn't Trump back him? It would have been easy for Trump to say: "I ordered Flynn to do that. Obama did similar. In both cases it was a GREAT success. USA! USA! USA!" Nobody would have been able to further attack Flynn over the issue after such a protective move. But Trump, completely against his style, held his mouth and did nothing. What else happened in the White House that let him refrain from backing Flynn? Sure, the real beef other people have with Flynn is not about Russia but other issues, like his plans to reform the intelligence services. But by throwing Flynn out like this Trump opened himself to further attacks. As it looks now a rather small gang of current and former intelligence officials - with the help of the anti-Trump media - leaked Flynn out of his office. They will not stop there.
  • Now blood is in the street and the hyenas will lust for more. The Trump magic is broken. He has shown vulnerability. Now they will go after their next target within the Trump administration and then the next and the next until they have Trump isolated and by the balls. He just invited them to proceed. All major foreign policy moves he planned will be hampered. The detente with Russia has probably ended before it even started.

  • Flynn is no big loss for the world, the U.S. or the Trump administration. But Trump has now lost the initiative. He long managed to set the media agenda for the day by this or that "outrageous" tweet or remark. Now this advantage has been taken away from him over some nonsense allegations and his lack of backing for one of his top people. He will soon rue the day he let this happen.

  • It’s happening! According to a new poll, Americans have finally maxed out their tolerance for “lesser evils” in presidential politics. The survey, published by independent research firm, Data Targeting, found a majority of Americans now want an independent candidate to take on Hillary Clinton and Donald Trump — two of the most disliked candidates in recent history. Researchers for the poll, conducted among 997 registered voters via both home and mobile phones this month, reported that “58% of respondents are dissatisfied with the current group of Republican and Democratic candidates for President” — and that 55 percent believe there should be an independent ticket (it is unclear why 3 percent apparently dislike the current candidates but puzzlingly do not think there should be another option). In perhaps the most extreme finding of the analysis, “a shocking 91% of voters under the age of 29 favor having an independent candidate on the ballot.” Considering younger generations’ lack of party allegiance and disillusionment with the status quo, their disapproval of Clinton and Trump seems predictable — but 91 percent constitutes near-total rejection. Tellingly, over 68 percent of participants in the poll were over the age of 50. Older generations are more likely to be attached to party identity, making their acceptance of other options a telling indicator of the populace’s distaste for their current options.
  • The United States has notoriously clung to the narrow two-party duopoly for most of its history — even as the crafters of the Constitution, for all their staggering shortcomings, cautioned of the dangers of such myopic political representation and party allegiance. But considering the unpopularity of Trump and Clinton — the former has a 55 percent unfavorability liking, the latter 56 percent — Americans appear to be turning a corner on their perception of who deserves power in politics. In fact, 65 percent of poll respondents said they would be “at least somewhat, pretty or very willing to support a candidate for President who is not Donald Trump or Hillary Clinton” — a stark difference from 2012, when Americans resisted deviation from the norm. A Gallup poll from that year highlighted the nation’s two-party rigidity. “U.S. registered voters show limited support for third-party candidates…with the vast majority preferring Barack Obama or Mitt Romney,” analysts reported just a few months before the 2012 general election. They concluded about 5% of Americans would vote for a third-party candidate that year. Just four years later, however, that figure has exploded. As the Data Testing report explains: “In a ballot test against Clinton and Trump, a truly independent candidate starts off with 21% of the vote,” already far greater than 2012’s 5%. “But this number increases to 29% in the ‘Big Sky’ region, 30% in ‘New England’ and 28% in the ‘West’ region.”
  • Independents were even more willing to break away from the options they’ve been given. “Among voters with an unfavorable opinion of both Trump and Clinton, the independent actually wins the ballot test,” researchers reported, noting that of the three options, 7 percent of respondents chose Clinton, 11 percent chose Trump, and a staggering 56 percent chose the unspecified third-party candidate. Though these ballot test findings are lower than the statistic that 65 percent would be open to breaking away from Clinton and Trump, the increase of third-party interest from 2012 remains palpably significant. It should be noted that Data Targeting is a GOP-affiliated political research firm, however, the results indicate little room for bias. In fact, they are paramount in an election where, as the analysis notes, Clinton and Trump provoke more animosity than enthusiasm. Perhaps highlighting lingering attachments to two-party thinking, Clinton’s highest unfavorability rating (78 percent) came from Republicans, while Trump’s highest unfavorability rating (71 percent) came from Democrats. Regardless, it is undeniable Americans are fed up with the system at large. According to another recent poll, just over half believe elections are rigged. Interest in third-party options, like the Libertarian and Green parties, is also steadily growing. As Ron Paul, the outspoken former presidential candidate, whose 2012 campaign wasundermined by the media and Republican establishment, recently said, “I’ve never bought into this idea that the lesser of two evils is a good idea” — and Americans increasingly agree. According to a Gallup poll released last year, 43 percent of Americans identify as independent — the highest number in the history of the poll.

  • The Associated Press story this week revealing that as secretary of state, Hillary Clinton frequently met with donors to the Clinton Foundation, set off a firestorm in the media. Many Democrats and sympathetic&nbsp;pundits are criticizing the article&nbsp;— and have made the sweeping claim that,&nbsp;contrary to many deeply reported investigations, there is no evidence that well-heeled backers of the foundation&nbsp;received favorable treatment from the State Department. While there are some&nbsp;legitimate criticisms&nbsp;of&nbsp;the AP story — its&nbsp;focus, for instance, on a Nobel Peace Prize winner meeting with Clinton distracts from the thesis of the piece — it&nbsp;is nonetheless a substantive investigation based on calendars that the State Department has fought to withhold from the public. The AP took the agency to court to obtain a partial release of the meeting logs. Other&nbsp;commentators&nbsp;took issue with a tweet promoting the AP piece, which they said might confuse readers because the AP story reflected private sector meetings, not overall meetings. But in challenging&nbsp;the overall credibility of the AP story, Clinton surrogates and allies are going well beyond a reasoned critique in an effort to downplay&nbsp;the serious ethical issues raised by&nbsp;Clinton Foundation activities.
  • The Intercept has also reported on the Clinton Foundation and the conduct of the State Department under Clinton.&nbsp;Leaked government documents obtained by The Intercept revealed that the Moroccan government lobbied Clinton aggressively to influence her and other officials on the Moroccan military occupation of Western Sahara, which holds some of the world’s largest reserves of phosphate, a lucrative export for the kingdom. As part of its strategy for influence, the Moroccan government and companies controlled by the kingdom donated to the Bill Clinton presidential library, the Clinton Foundation, and hired individuals associated with the Clinton political network. Despite a statement by the Obama administration that suggested it would reverse the previous Bush administration support for the Moroccan government and would back a U.N.-negotiated settlement for the conflict in Western Sahara, Clinton announced there would be “no change” in policy — and has gone on to praise the Moroccan government’s human rights record. As recently as Monday, we learned that after being denied an official meeting with the State Department, Peabody Energy, the worlds largest coal company, used a consultant who donated heavily to the Clinton Foundation to back channel and attempt to set up a meeting with Clinton via her aide Huma Abedin. The consultant, Joyce Aboussie, wrote that “It should go without saying that the Peabody folks” reached out to her because of her “relationship with the Clinton’s [sic].” Peabody and Aboussie have declined to comment, and it is unclear if the meeting took place.
  • The assertions above obscure the problems unearthed through years of investigative reporting on the foundation. Journalist David Sirota, who has reported extensively&nbsp;on the Clinton Foundation, rounded up a sample of the stories that provide a window into Clinton Foundation issues: The Washington Post found that two months after Secretary Clinton encouraged the Russian government to approve a $3.7 billion deal with Boeing, the aerospace company announced a $900,000 donation to the Clinton Foundation. The Wall Street Journal found&nbsp;that Clinton made an “unusual intervention” to announce a legal settlement with UBS, after which the Swiss bank increased its donations to, and involvement with, the Clinton Foundation. The New York Times reported that a&nbsp;Russian company assumed control of major uranium reserves in a deal that required State Department approval, as the chairman of the company involved in the transaction donated $2.35 million to the Clinton Foundation.

  • There may be many other potential influence-peddling stories, but the State Department has not&nbsp;released all of the emails from Clinton’s private server and other meeting log documents, while redacting identifying information that could shed light on other stories. For example, Mother Jones&nbsp;and The Intercept&nbsp;have reported that Clinton used the State Department to promote fracking development across the globe, and in particular her agency acted to benefit particular companies such as a Chevron project in Bulgaria and ExxonMobil’s efforts in Poland. Both ExxonMobil and Chevron are major donors to the Clinton Foundation. The release of more meeting log documents and emails would certainly reveal a better picture of potential influence.
  • Earlier this year, in similar fashion to the questions raised about the Clinton Foundation, Democrats in Arizona raised influence peddling&nbsp;concerns&nbsp;regarding the reported $1 million donation from the Saudi Arabian government to the McCain Institute for International Leadership, a nonprofit group closely affiliated with Sen. John McCain, R-Ariz. As chairman of the Armed Services Committee, McCain oversees a range of issues concerning Saudi Arabia, including arms sales. But none of the pundits rushing to the defense of the Clinton Foundation defended McCain. In fact, the more Clinton’s allies have worked to defend big money donations to the Clinton Foundation, the more closely they resemble the right-wing principles they once denounced. In one telling argument in defense of the Clinton Foundation, Media Matters, another group run by David Brock, argued this week that there was “no evidence of ethics breaches” because there was no explicit quid pro quo cited by the AP. The Media Matters piece mocked press figures for focusing on the “optics” of corruption surrounding the foundation. Such a standard is quite a reversal for the group.&nbsp;In a piece published by Media Matters only two years ago, the organization criticized conservatives for focusing only on quid pro quo corruption — the legal standard used to decide the Citizens United and McCutcheon Supreme Court decisions — calling such a narrow focus a “new perspective of campaign finance” that dismisses “concerns about institutional corruption in politics.” The piece notes that ethics laws concerning the role of money in politics follow a standard, set forth since the Watergate scandal, in which even the appearance, or in other words, the “optics” of corruption, is cause for concern.

The Tyndall Report, a non-partisan media monitoring firm that has been tracking the nightly news broadcasts of ABC, CBS, and NBC, found that Trump is tromp, tromp, tromping over the airtime of everyone else. From last January through&nbsp;November, these dominant flagship news shows devoted 234 minutes of prime-time coverage to the incessant chirping of the yellow-crested birdbrain, with no other contender getting even a fourth of that.
  • Take Bernie Sanders, who’s stunning the political establishment with a fiery populist campaign that’s drawing record crowds. Indeed, Sanders’ upstart campaign is commanding a comparable share of support within the Democratic Party’s voting base to what&nbsp;Trump is enjoying from the Republican electorate. And&nbsp;—&nbsp;get this —&nbsp;polls also show Bernie trouncing The Donald if they face each other in November’s presidential showdown. So surely he’s getting a proportional level of media coverage by the networks on our public airwaves, right? Ha, just kidding! The big networks’&nbsp;devotion of 234 minutes to all-things-Trump was “balanced” by less than 10 minutes for Sanders. Most egregious was ABC, the Disney-owned network. ABC’s World News Tonight awarded 81 minutes of national showtime to Trump last year —&nbsp;and for Bernie: 20 seconds.

    This is an interesting post.  The WSJ published an article yesterday claiming that the Federal Reserve Bankster Cartel was looking at European Banksters and assessing the quality of "funding positions" and asset status for their USA branch operations.  The Fed Banksters are also consulting with EU regulators about European Bankster concerns. The WSJ article (http://on.wsj.com/nugr7s) triggered a massive market crash on Thursday.  Over $2 Trillion was washed away in the panic following the publication of this WSJ story.  That's on top of the $6 Trillion lost following the Obama Debt-Man-Walking deal with Congress. But here's where it gets interesting.  Bruce Krasting contacted Zero Hedge's Tyler Durden and got this reply; "the story is a Fed plant". Tyler Durden believes that the Feds want to create a world economic crisis to justify a massive QE3 where tens of trillions of dollars would be created and distributed to the worlds Banksters.  This follows the $16.1 Trillion created and distributed to the world's Banksters in 2009 - 2010 under QE1 and QE2. Incredible.  Just a few days ago Republican presidential candidate Gov Rick Perry warned the Fed Banksters not to flood the market with a new QE3.  No doubt what Perry has in mind is that the Fed will flood the world's economy with dollars, debasing the currency even further, but providing a phony and very temporary veil of prosperity - just enough to get Obama into a second term.   Not a bad concept for the Banksters since Obam has proven himself time and again as the bes tfriend the Banksters have ever had.  Obama has overseen the transfer of over $23 Trillion of USA taxpayer debt to the world Bankster community.
